Thank you again to Neil Callahan and Jeff Bean, with the Law Offices of Borton Petrini, for their presentation last month. They informed us on how to Avoid Costly Litigation Claims and discussed some examples of these litigation claims filed today. We also held our Board of Director elections at the November luncheon. Please Note: We have a new venue for our holiday luncheon this year. It will be on Friday, December 11, 2015 from 11am-3pm at The Reserve at Spanos Park where our golf tournaments are held. The address is 6301 West Eight Mile Road, Stockton CA 95219. You can all look forward to a fabulous buffet lunch, to include Tri-Tip and Chicken Cordon Bleu. Members are free, since we want to say thank you to all of you for supporting MVCA. Non-members can join us at the regular price of $27.00.As always, our Claims Association strives to provide toys for those in need. For several years we have donated Toys-for-Tots, to the Marine Core families. This year, we plan to donate the toys to Haven of Peace. Please bring an unwrapped new toy for a boy or girl of any age and receive two (2) raffle tickets for each toy you bring. As many of you know, our own Beth Ossino, Claims Manager at Golden Bear Insurance, is an extremely active member of Haven of Peace, donating her time and love to this great community organization. She has done much to help make us aware of the work this wonderful non-profit does for the families of San Joaquin County in need of their services.

Avoiding Costly Litigation Explored at November MVCANeil Callahan, a partner at Borton Petrini, LLP’s Modesto office, was the featured guest speaker at the November 20, 2015 Mid-Valley Claims Association luncheon meeting.A specialist in civil litigation involving public entities, law enforcement and civil rights, Callahan has represented multiple public entities in California for over 14 years. Together with partner, Jeff Bean, he shared his insights on how to avoid the costs associated with excessive or unneces-sary litigation. “There is no guaranteed result in litigation,” he stated. Settling claims is the only guar-antee. “Settle early if you can,” he advised. Both Callahan and Bean spoke plainly about the realities of dealing with litigants; backed-up calendars in court rooms; and the uncertainty juries present. “Go to mediation if you can’t settle.” Steps should be taken long before there is any notion of litigation to avoid lawsuits. Having good contracts that limit your liabil-ity, and making sure you pay your premiums go a long way to avoiding costly litigation.

President’s Messagecontinued from page 3

Long time member of the claims industry, and the Mid-Valley Claims Association, Vincent Morales, of Stockton, passed away peacefully November 7, 2015. Born in San Antonio, Texas to Vicente and Maria Morales, Vince spent most of his life in Stockton, California. He married his wife of 31 years, Hope Castro, in June. 1985. They enjoyed a full and busy life with a blended family of 7 children.Vince is survived by Hope, his sons Randal (Randy), Robert (Robbie), Michael (Lori) Jamey, Alex Montoya (Lisa), Edith Montoya, and Anthony Montoya (Melissa). Vincent was the second oldest of 7 siblings. He is preceded in death by sisters Alicia Tener, Dena Gauuan and Paul Morales. He is survived by brothers John (Josie), Antonio (Doreen), and Joseph. Vincent leaves behind 13 grandchildren and 15 great grandchildren.

After graduating from Edison Senior High School and what was then known as Stock-ton Junior College, he apprenticed at Chase Chevrolet of Stockton. Vince specialized in body and fender work. He had the eye of an artist and the hand skills that could make the damaged side of a vehicle look like the op-posite side that was undamaged. While working at Chase, he was elevated to various positions of responsibility and ulti-mately moved to the front office. He excelled at being an estimator/spokesman of the dealer-ship's body shop. Vince was a people person and, along with his work knowledge, he captured a number of vehicle repair jobs previously going to other shops. He worked at Chase for 30 years before he founded Central California Appraisal Service in 1973. So successful was the business that Vince retired in 2002 after bringing his sons

Randy, Robert, Michael and Jamey, into the business under his guidance and training. Vincent was at times in his life an artist, a teacher at the community college, business-man, and a community voice of reason. He enjoyed playing golf, rooting for the 49er's and the Giants. He couldn't get enough of Mexican music (Boleros, Mariachi) and the man could dance until forever!The family wishes to thank the staff at the Hospice of San Joaquin and the doctors and nurses at the San Joaquin County Hospital for their compassionate care and professionalism.A viewing was held Thursday, November 19th from 2:00pm -6:00 pm at the DeYoung Funeral Chapel, 601 N. California St. A Rosary was conducted the same day from 6:00 pm. Funeral Services were held Friday, November 20th,, 10:00 am, at the Cathedral of Annunciation, 425 W.
