What is GHS?

- U.N. Initiative: Globally Harmonized System of Classification and Labelling of Chemicals (GHS)

- Harmonized- Classification Criteria- Safety Data Sheets (SDSs)- Label Elements

U.S. Situation

U.S.- OSHA released Final Rule on March 19, 2011. - Final Rulemaking will be issued on March 26,

2012.

U.S. Situation

OSHA calling this new standard a “Right to Understand” – an evolution of “Right to Know”

Will still be called the Hazard Communication Standard (HCS). To avoid confusion, OSHA proposes the informal name of Hazcom 2012.




Hazcom 2012 Key Dates

- June 25, 2012 [60 days after publication] Goes into effect.

- December 1, 2013 Employees must be trained on SDSs and labels.

- June 1, 2015 Compliance with final rule. (Same date as EU for mixtures)





- December 1, 2015 Distributors must stop shipping products with “old” labels.

- June 1, 2016 Update alternative workplace hazard communication program if necessary.





NOTE: NO staggered phase in date for mixtures and substances.

Presents a bit of a problem: You need the classifications for the individual components in order to classify the mixture.

There is no official/mandatory US inventory of classifications, but OSHA believes EU/Japan/Korea experience provides classifications for most pure substances.

Canada – WHMIS GHS

- Still working on it. Expect a draft rule by the end of the year.

- Hold-up: Want to follow OSHA’s lead, plus translation issues.

We expect a shorter phase in period, that may also end on June 1, 2015.




Hazcom 2012 and WHMIS GHS Omissions

- U.S.: Omitted Hazard Categories- Acute Toxicity Cat. 5 (Oral, Dermal & Inhl.)- Skin Corrosion/Irritation Cat. 3- Aspiration Haz. Cat. 2Note: These were also omitted from EU CLP, however

show up in other implementations (Oral Cat 5. in China, New Zealand, Brazil, etc.)

- Canada: Likely to follow suit.




Hazcom 2012 and WHMIS GHS Omissions

- Entire Enviro. Hazard Group omitted from OSHA (U.S.) and WHMIS (Can) adoption.- Jurisdictional Issue

- Could appear in other N.A. adoptions (e.g. pest control products)

Hazcom 2012 Additions

- Both U.S. and Canada adding classes.- U.S. – Added Classes

- Combustible Dust - Simple Asphyxiants- Pyrophoric Gases- ‘Hazards Not Otherwise Classified’




Hazcom 2012 Additions

- ACGIH Threshold Limit Values will need to be referenced on Hazcom 2012 SDSs, as they are under the existing HCS.




WHMIS GHS Additions

- Canada (Likely)- Biohazardous Infectious Material (Class D3 –

would use GHS modified version of existing pictogram)

- Water reactive substances (Part of Class F, not in GHS Revision 3)




Precautionary Statements

- Standardized statements given in regulations/Purple Book.

- Hazcom 2012 allows inappropriate or redundant statements to be consolidated or eliminated.




Label Pictograms

NOTE: Colour red mandatory for all Hazcom 2012 label pictograms.

NOTE: Not allowed to have blank red diamonds or fill them in with ‘THIS DIAMOND INTENTIONALLY LEFT BLANK’.




Likely Canadian GHS Additions

- Name ‘WHMIS’- WHMIS Concentration Ranges- Three year expiry date for SDSs.- Reference to SDS on Label- Hatched WHMIS Border on Label! (Possibly)




Consumer Products

- U.S. CPSC: Interagency Working Group on Harmonization

- Canada CCCR: Consumer Chemical Sector Working Group

Progress quite slow. GHS adoption not expected in near future.




Harmonization with EU

- EU (453/2010) layout appears to be compliant with Hazcom 2012 allowing for one document for both jurisdictions.

- However in all likelihood will not be able to simply take an existing EU document and use it in US (or vice versa). Need to add additional information.





- Need to ensure that the additional classes covered (EU – Enviro, US – Combustible Dust, Can – Water Reactive, etc.)

- Need ACGIH TLV’s on Hazcom 2012 SDSs.- Remember to also include other necessary

state/country level regs (German Water Regulations Prop 65, etc.)





- Different jurisdictions have different rules RE: component ranges and component disclosures. Canada likely to keep existing WHMIS rules in GHS adoption. US ‘proprietary’ rules remain.




To Dos – In Order of Importance

1. Budget and develop a training plan for employees. December 1, 2013 will come quickly.





2. Determine how you will print your product labels to be in compliance with the new standard, specifically the red diamond and the requirement that there be no blank diamonds on the label.





3. Determine how you will author your SDSs and labels and set aside a budget to do so.

OSHA estimates cost (software + labour) of SDS authoring to be $406 per SDS for large businesses (500+ employees) to $462 per SDS for small businesses (fewer than 99 employees).





4. If authoring in house, ensure software (if using) is compliant with Hazcom 2012 standard, author trained in new regulation, and that the necessary substance level classifications are obtained.
