That complaint was brought against Mr. Milligan in his capacity as Treasurer of State and as a candidate for that office during the 2014 election cycle, and in his former capacity as Saline County Circuit Clerk. Please be advised that Act 1280 of 2015 established Ark. Code Ann. § 7-6-229, which sets forth the following affirmative defense provision:  a It is an affirmative defense to prosecution or disciplinary action if a person required to file a report under [subchapter 2 of chapter 6, Title 7 of the Arkansas Code] amends the report within thirty 30 days of discovering or learning of an unintentional error in the report.  b 1 The [Ethics Commission] shall not proceed with an investigation of an alleged error in a report filed under [subchapter 2 of chapter 6, Title 7 of the Arkansas Code] if the commission determines that a person would be eligible to raise the affirmative defense under [Ark. Code Ann. § 7-6-229 a ]. 2 If the commission does not proceed with an investigation of an alleged error in a report under [Ark. Code Arm. § 7-6- 229 b 1 ], the person shall not be considered to have committed a violation of the applicable statute.  c This section shall not be construed to: 1 Remove the duty to file a report under this subchapter; or 2 Authorize a person to knowingly fail to file a report under this subchapter.
