NOTICE OF REMOVAL
Defendants Iowa Board of Regents, State of Iowa, the University of Iowa, Sally
Mason and Bonnie Campbell (the Iowa Defendants), pursuant to 28 U.S.C. 1441 et
seq., for removal of cause of action from the Iowa District Court for Johnson County
to the United States District Court for the Southern District of Iowa, respectfully
state:
1. The Iowa Defendants are Defendants in a civil action commenced
August 2, 2010 in the Iowa District Court for Johnson County entitled Marcus Mills
v. Iowa Board of Regents, et al. (the state court action). That action is docketed as
No. CVCV 072346.

2. The Iowa Defendants were served with the Original Notice and Petition
at Law on August 9, 2010 by acceptance of service. Copies of the Original Notice, the
Petition at Law and Jury Demand are attached hereto and constitute all
process, pleadings and orders served upon the Iowa Defendants in that cause of
action.
3. In the state court action, as set forth in the Petition at Law, Plaintiff
Marcus Mills seeks to recover from Defendants as a result of the termination of his
employment and surrounding circumstances.
4. This Court has original jurisdiction over the claims alleged here. Count
I of the Petition at Law asserts claims for alleged wrongful termination in violation of
42 U.S.C. 1983 and the United States Constitution, Count II asserts claims for alleged
violation of due process pursuant to 42 U.S.C. 1983, and Count VI alleges violation
of Plaintiffs federal constitutional due process and liberty interests. This Court
possesses original jurisdiction over such claims pursuant to 28 U.S.C. 1331. Such
claims may be removed to this Court by the Iowa Defendants pursuant to the
provisions of 28 U.S.C. 1441(b).
5. Venue for removal to this Court is proper pursuant to the provisions of
28 U.S.C. 1391(b).
6. As required, all Defendants in the state court action have timely
consented to removal to this Court. In addition to the Iowa Defendants, Defendants
in the present cause include James Bryant and The Stolar Partnership, LLP. Those

Defendants, represented by attorney Gregory Lederer, have timely consented to the
Iowa Defendants removal of the present cause. Their consent to removal is attached
as an exhibit to the present Notice of Removal. Pitchett v. Cottrell, Inc., 512 F.3rd
1057, 1062 (8th Cir. 2008).
WHEREFORE, Defendants Iowa Board of Regents, State of Iowa, the
University of Iowa, Sally Mason and Bonnie Campbell remove the state court action
pending as No. CVCV 072346 in the Iowa District Court of Johnson County to this
honorable Court.
