DISCLAIMER

Unless otherwise defined below, all capitalised terms shall have the meaning given to them in this Invitation for Prequalification (IFP). The information contained in this IFQ has been compiled by the Ministry of Works (MOW), on behalf of the Government of the Kingdom of Bahrain (the Government) and the Tender Board of the Kingdom of Bahrain (the Tender Board) to assist interested parties in pre-qualifying to receive a Request for Proposal (RFP) in relation to the Consultancy Services for the Design and Supervision of Construction of Roads Master Plan – Strategic Projects (the Project). As such it does not constitute and will not form part of any offer or invitation to make an offer in relation to the Project. This IFQ does not contain all the information that interested parties and their advisers would desire or require in reaching a decision as to submission of a response to this IFQ. Interested parties should form their own views as to what information is relevant to such decisions, and make their own independent investigations in relation to information contained in this IFQ or any additional information. This IFQ outlines the Government’s expectations in relation to this tender process and details the Government’s current and future development plans. Such plans may not proceed and may be subject to significant change. The Government and the Tender Board reserve the right, in their absolute discretion, at any stage and without notice, to terminate further participation in the tender process by any party, to change the structure, terms and conditions and timing of the tender process, to amend the information contained in this IFQ or to terminate the tender process itself. Neither the Tender Board nor the Government shall have any responsibility or liability for any costs, expenses, other liabilities or implications incurred to and/or by any participants in the tender process. The Government and the Tender Board also reserves the right, in their absolute discretion, to allow further parties to enter the tender process at any stage of the process whether or not those parties have submitted an Application in accordance with this document. The Government and the Tender Board reserves the right, in its absolute discretion, to reject any or all of the Applications, proposals or other submissions and/or to terminate an Applicant’s further participation at any time prior to the execution of the Project Agreements. Neither issuance of this IFQ nor issuance of the RFP or any other document or request by or on behalf of the Government at any time will oblige the Tender Board or the Government or its Advisors to enter into any arrangement or agreement or impose any liability on any of them. Neither the Government nor the Tender Board shall be under any obligation to return any Application submitted by any Applicant or to reimburse any Applicant for any cost or expense, whether incurred in preparing its Application, response to the RFP or to any other request from the Tender Board or the Government its Advisors or otherwise. This IFQ and the information contained herein are confidential and may not be issued, published, distributed or otherwise divulged to any other persons (other than in accordance with a signed Confidentiality Agreement in the form of Annex 3 which is to be completed by the Applicant). The recipient of this IFQ shall, upon the request of the Tender Board

and/or the Government, promptly return this IFQ (and all copies thereof) to the Tender Board at the address specified in this IFQ. This disclaimer shall remain in full force and effect notwithstanding any Project Agreements or other document that may be concluded in respect of the Project.

DEFINITIONS Applicant(s) An individual company experienced in the roads sector or an

Arrangement of companies (at least one of which has experience in the roads sector) applying to prequalify in response to the IFP for submitting a Request for Proposal to undertake the Services.

Application An Applicants response to the Invitation for Prequalification outlined in this document.

Arrangement A Joint Venture, partnership or other combination of international and/or Bahraini companies jointly participating as an Applicant.

EXECUTIVE SUMMARY The Government is issuing this Invitation for Prequalification (IFP) to seek Applications for Prequalification from Applicants, who may be a single entity or an Arrangement comprising several entities. The Project will involve the planning, design and supervision of construction of a range of Strategic Roads projects developed from the Roads Master Plan of the Ministry of Works (MOW) of the Kingdom of Bahrain. The projects will range in scope and size and complexity and include civil, mechanical and electrical engineering works. The Project will be carried out under a Consultancy Services Agreement with the MOW. Successfully prequalified Applicants will be invited to respond to a Request for Proposal (IFP) which is expected to be issued in to 2012. The requirements of the Application and additional details regarding the Project are set out in the following sections. Information provided in each Application will be used by the MOW to evaluate the capabilities and experience (technical, organisational/managerial, and financial) of Applicants. It is then intended that fully qualified parties will be invited to participate in the subsequent competitive bid for the Services in accordance with the requirements of the Tender Board. In order to be invited to participate in the subsequent competitive bid an Applicant must submit all information requested under this IFP, which will be treated by the Government in confidence.

1.0 INTRODUCTION

1.1 The National Economic Strategy-2030 envisions the provision of high quality urban transit infrastructure in the pursuit of ensuring sustainability, promoting competitiveness and fairness and offering a higher quality of life for all the residents and citizens of the Kingdom. The Government of Bahrain is committed to implementing an accessible, affordable, reliable, safe and sustainable public transport system.

1.2 The Kingdom of Bahrain is experiencing congestion along the majority of

the transport arteries with increasing economic activity, rapid population growth, expanding urban landscape, high vehicular ownership trends (average 2 vehicles per household) and low public transport ridership levels (less than 5% of total person trips per day). To achieve sustainability in transport infrastructure, the Ministry of Works (MOW) conducted many transport studies to develop vision, policies and master plans. In 2003 the Bahrain Traffic Model was updated and a Roads Master Plan (RMP) was developed. Furthermore an Integrated Transport Strategy was developed in 2007. MOW has started the implementation of its RMP in 2006 and several road network improvement/capacity augmentation measures have been implemented. MOW intends to continue the implementation of the RMP by constructing grade separated interchanges at key congested junctions and providing new strategic links and causeways.

1.3 MOW now intends to shortlist, through a prequalification exercise,

suitably qualified, internationally experienced consultancy firms/joint ventures to tender for the planning, design, preparation of contract documents and supervision of construction of Roads Master Plan - Strategic Projects. Examples of schemes to be included in the Project are; Juffair Ring Road, Al Fateh Underpass, North Manama By Pass and Fourth Manama Muharraq Crossing.

1.4 Applications for prequalification will be by response to this Invitation for

Prequalification (IFP). Applications will then be evaluated, based on the prescribed eligibility criteria, and only those shortlisted will be invited to tender on the basis of a response to the Request for Proposal (RFP) as part of the second stage (referred to as Bid stage) of the selection process. MOW will provide detailed information about the method for selection of Firms/Joint Ventures during the second (Bid) stage of the project.

2.1 Only firms with significant regional and international experience in the planning, design and supervision of construction of major highways and their associated structures and infrastructure will be eligible to apply for prequalification. Firms without such experience should not apply.

2.2 Applicants must read carefully the directions concerning the requirements for submittal of Applications either as a single entity (firm) or by a group of companies/ firms in the form of Joint Ventures.

2.3 Prequalification submissions must include all the requisite information

(completed forms or questionnaire) as per the enclosed formats in this IFP. The IFP forms and questionnaires will be available from the Ministry’s web site www.works.gov.bh and the Tender Board web site www.tenderboard.gov.bh . However, MOW will provide soft copies of the forms and questionnaires if required, to facilitate submission of the application. EOI documents have to be submitted in sets of one original hard copy and one soft copy (PDF format).

2.4 Applicants should attach clearly marked and referenced continuation

sheets in the event that the space provided in the Questionnaire and Annexes are insufficient. Alternatively Applicants may format the prescribed forms to make provision for the requested information.

2.5 Applicants should submit with their Application a Letter of Application as

per the prescribed format at Annex 1. 2.6 MOW shall receive Applications (through the Tender Board) pursuant to

this IFP in accordance with the terms set forth herein as modified, altered, amended and clarified from time to time by MOW. All Applications shall be prepared and submitted in accordance with such terms on or before the Application due date and at the address, as specified in this IFP.

2.7 EOI Applications must be enclosed in a single outer envelope,

comprising of one original and one soft copy (PDF format) of the Application. The sealed outer envelope should have the clear marking of project title as EOI - Roads Master Plan – Strategic Projects along with the Applicant’s name and address.

2.8 Interested Firms/Joint Ventures are requested to submit their

Applications in the prescribed format, either in person or through Government mail/courier, to reach the address, as stated below, no later than 13.30Hrs on14/12/2011

2.9 EOI Applications can be submitted by an Individual Consultancy Company/Firm/Joint Venture, the Applicants should submit requisite documents as stated on this IFP.

2.10 Applications submitted by Fax/Telex or Email shall not be entertained.

2.11 Each page of the Application, contents of sections and all documents submitted with the Application shall be initialled by the authorised signatory of the Applicant.

2.13 MOW reserves the right, without any obligation or liability, to

accept or reject any or all the IFPs at any stage of the process, to cancel or modify the process or any part thereof or to vary any term or condition at any time, without assigning any reason whatsoever. Amendments/ Addendums to this IFP document, if any, will be posted in the prequalification category of MOW website (www.works.gov.bh).

2.14 Please note that applications will not be considered if they are found to make misleading or false representations in statements, attachments, pre- qualification questionnaire or other documents submitted as proof of the qualification requirements.

2.15 All documents are required to be submitted in the English

Language.

3.0 APPLICANTS EXPERTISE AND EXPERIENCE

3.1 MOW seeks Applications from suitably qualified, internationally experienced consultants/joint ventures to undertake requisite tasks as per the broad scope of services defined in subsequent sections of this IFP. Only responses from companies that demonstrate availability of expertise and experience in the following areas and with a firm financial foundation will be considered for shortlisting to be invited to submit a full tender submission during the Bid Stage: 3.1.1 Implementation of Roads Master Plan-Strategic Projects which

assessment, surveys, soil investigation, concept, preliminary and detailed design preparation of tender documents and reporting assessment of tenders and supervision of construction. This should include highway design and structural design of bridges, underpasses, marine bridges and causeways and other structures associated with strategic roads schemes.

3.1.2 Diversified expertise and experience relevant to the type of Services indicated above.

3.1.3 Availability of experienced key personnel within the firm/joint venture in all the relevant Services indicated;

3.1.4 Capability to manage and undertake the requisite Services in a manner and to a quality commensurate with the international best practices;

3.1.5 Availability of requisite software tools/equipment and financial resources;

3.1.6 Capability to initiate and operate a quality control system to ensure successful delivery of the Service’s deliverables.

4.0 PREQUALIFICATION ELIGIBILITY CRITERIA

4.1 Eligibility Criteria - General

4.1.1 Firms are eligible to submit an Application in response to this IFP either individually (a legal entity) or as a Lead Member of a Joint Venture.

4.1.2 In the case of a Joint Venture, Letters of Endorsement, as prescribed in Annex 2, from each member will be required confirming their willingness to be a member of the proposed Joint Venture and agreeing to be jointly and severally liable to MOW under any contract which may be subsequently awarded to the Joint Venture.

4.1.3 The Applicant Company (if an application is submitted

individually) or all the members of a Joint Venture including the Lead Member (if application is submitted as Joint Venture) should include in their submission an undertaking for each of the following: i) The Company/Firm should not have suffered bankruptcy/

insolvency in the last five years; ii) The Company/Firm should not have been blacklisted by

any Government/Public Sector Organization; iii) The Company/Firm should not have abandoned

projects/contract works in-complete; iv) The Company/ Firm should have a Quality Assurance

Programme in place.

4.1.4 Applicants should clearly specify in their submission letter (Annex-1) their intent to be prequalified for the Services indicated in this IFP. MOW will accordingly evaluate the applications and prepare a shortlist for those firms that will be invited to submit a tender during the Bid stage of the project.

4.2 Eligibility Criteria – Technical and Financial Strengths

4.2.1 Individual firms or the lead partner of Joint Ventures should have undertaken (or) successfully completed, in the last 10 years, projects of similar nature i.e. planning, transport and environmental assessments surveys, soil investigations, concept, preliminary and detailed design, preparation of tender documents, tender assessment and reporting, construction supervision and project management for implementation (either independently or as a lead partner of a Joint Venture).

4.2.2 Average annual turnover of the company/firm (individual or lead member of the Joint Venture) must have exceed BD 7 Million (USD20 Million) in the past 3 years.

5.0 ASSESSMENT OF APPLICATIONS

5.1 Assessment of Applications will be undertaken by an assessment panel comprising senior MOW staff. Applications will be assessed on the following general parameters in addition to the expertise, experience and eligibility criteria indicated above. The firm (in case of individual applicant) and/or all the members of the Joint Venture (JV) individually (in the case of an Application submitted by JV) should provide a summary of the following supported by necessary documents/brochures etc in the format indicated at Annex 4.

i) Company Profile, track record, organizational/management

structure, general reputation for work competence and client focus. Firms/Joint Ventures will be expected to have a high standard of project management capabilities compatible with the Ministry’s Project Management System.

ii) Recent relevant experience in similar projects (with regard to nature of work, scale and size). Overall experience of the firm in planning, design, implementation and project management will also be taken into consideration. Client certificates for at least 3 major projects (for recently implemented works) undertaken in the last 10 years that satisfy the eligibility criteria need to be attached.

iii) Financial strength (Average Annual Turnover for last 3 years). iv) Details of computer software and equipment. v) Involvement in similar projects in Gulf/Middle East or in

‘successfully implemented’ similar projects elsewhere across the world.

vi) Availability of experienced key professionals in all relevant sectors and capability to mobilize expert staff.

vii) Ability to define and comply with Quality Assurance Plans/ Quality Management Systems.

6.0 OTHER MATTERS RELATING TO APPLICATIONS: 6.1 Detailed techno-commercial proposals (i.e. Bids) for awarding the

Project will be invited from those Applicants who have been shortlisted through assessment of responses to this IFP.

6.2 Applicants should note that this IFP document is intended to provide the Applicants/prospective respondents with preliminary information only. The information contained herein shall not in any way be considered as binding on MOW.

6.3 MOW in its sole discretion and without incurring any obligation or

liability, reserves the right, at any stage without assigning any reasons whatsoever, to:

i) Suspend and/or cancel the bidding process and/or amend and/or supplement the bidding process or modify the date, Scope of Services or other terms and conditions relating thereto;

ii) Consult with any Applicant in order to receive clarifications or further information;

iii) Independently verify and disqualify any/or all the Applications other information and/or evidence submitted by or on behalf of any Applicant.

6.4 No binding legal relationship will exist between any of the Applicants

and the MOW as a consequence of this IFP and the short listing process.

6.5 All costs and expenses incurred by Applicants in any way associated with the preparation of the Applications will be borne by Applicants.

6.6 It should be noted that each firm is eligible to make only one

application either independently or as part of a Joint Venture. Applicants should not have a conflict of interest that affects the bidding process. Any Applicant found to have a conflict of interest shall be disqualified. The Applicant may be considered to have conflict of interest that affects the bidding process, if:

i) A constituent of an Applicant is also a constituent of another Applicant.

ii) Applicant or any associate thereof has participated as a consultant to MOW in the preparation of any documents, design or technical specifications of this Project.

In the case of a conflict of interest as defined above, MOW reserves the right to reject all such Applications with overlapping partners.

6.7 To be eligible for pre-qualification, an Applicant must fulfil the expertise and experience requirements, general assessment criteria and eligibility criteria as indicated in Sections 3, 4 and 5 above.

client(s) stating that similar services to that outlined in this IFP and commissioned (for at least 3 major projects), as the case may be, during the past 10 years have met with the eligibility criteria indicated above. In case of a particular project that has been jointly executed by the Applicant, the firms should further support their claim for the share of work done for that particular project by producing a certificate from its statutory auditor or the client.

ii) Audited financial reports for the past 3 years along with certificates from statutory auditors to support the evaluation of financial strength of the firm/Joint Venture.

6.9 Each Applicant must enclose a forwarding letter (in the prescribed

format at Annex-1) either as individual firm or as a lead member of a Joint Venture, expressing their intent to associate with MOW for this project, with a commitment to deliver the requisite tasks to meet the expectations of the Client. In the case of a Joint Venture, the Application must comply with following additional requirements: i) Members of Joint Venture shall nominate one member as the

lead member ii) Applications should include a brief description of the roles and

responsibilities of each individual firm of the joint venture; iii) Letters of Endorsement (as per the format enclosed in Annex-

2) from each member of the JV (in case of joint venture) designating the lead member, authorizing the contact point etc. Please note that MOW will not consider the experience or qualifications of an associate firm unless a Letter of Endorsement from such an associate firm is attached with the Application. In the case where an associate firm has provided Letters of Endorsements to more than one Applicant (individual/joint venture), MOW reserves the right to ignore the qualifications/experience of such associate firm in the evaluation of Applications.

iv) An individual Applicant of the Joint Venture cannot be at the same time being a member of another Joint Venture Applicant for prequalification.

v) Except as provided under this IFP and the bidding documents, there shall not be any amendment to the Joint Venture partners without the prior consent of MOW.

vi) Please note that change of Joint Venture partners or addition of new Joint Venture partner to the individual firm (or) Joint Venture at the bidding stage (i.e. second stage of selection process) is usually not accepted by the Tender Board and MOW.

6.10 Applicants are encouraged to submit their respective Applications after visiting potential sites of Roads Master Plan – Strategic Projects and ascertaining for themselves as to the site conditions, transport, location, surroundings, climate, availability of power and other utilities for construction, access to site, applicable laws and regulations and any other matter considered relevant by them.

6.11 Applicants shall be responsible for all the costs associated with preparation of their Application, site visit and their participation in either the IFP stage or Bid Stage. MOW will not be responsible or in any way liable for such costs, regardless of the conduct or outcome of the IFP or bidding process.

6.12 The bidding process shall be governed by, and construed in

accordance with, the laws of Kingdom of Bahrain and the courts of Bahrain shall have exclusive jurisdiction over all disputes arising under, pursuant to and / or in connection with this bidding process.

6.13 Although adequate care has been taken in preparation of this IFP

document, each respondent must make and rely on its own investigations to satisfy itself in relation to all aspects of the proposed project. MOW will not be liable for any incorrect or misleading information or omission of information in respect of this IFP.

6.14 Applicants and their respective officers, employees, agents and

advisors shall observe the highest standard of ethics during the IFP and bidding process. Notwithstanding anything to the contrary contained herein, MOW shall reject an Application without being liable in any manner whatsoever to the Applicant if it determines that the Applicant has, directly or indirectly or through an agent, engaged in corrupt practice, fraudulent practice, coercive practice, undesirable practice or restrictive practice in the IFP or bidding process.

6.15 MoW and their employees will have no liability to any prospective

Firm/Joint Venture or any other person under the law of contract, tort, the principles of restitution or unjust enrichment or otherwise for any loss, expense or damage which may arise from or be incurred or suffered in connection with anything contained in this IFP document, any matter deemed to form part of this IFP document, the award of any subsequent contract, the information and any other information supplied by or on behalf of MOW or their employees, any agents or otherwise arising in any way from the IFP or bidding process.

6.16 Applicants will be deemed to have understood and agreed by

submitting the Application that they have:

i) Made a complete and careful examination of the IFP ii) Received all relevant information requested from MOW;

iii) Acknowledged and accepted the risk of inadequacy, error or mistake in the information provided in this IFP or furnished by MOW relating to any relevant matters of this project;

iv) Acknowledged that no explanation or justification of any aspect of the pre-qualification process will be given and that MOW’s short listing decisions are without any right for appeal whatsoever;

v) Agreed to be bound by the undertakings provided within their Application.

6.17 All the documents and other information supplied by MOW or the

information / documents submitted by an Applicant shall remain or become the property of MOW. Applicants are to treat all information as strictly confidential and are required to submit with their Application a signed Confidentiality Agreement in the prescribed format at Annex 3. MOW will not return any pre-qualification Application.

6.18 During the evaluation of an Application: i) If MOW finds that the information furnished by the Applicant is

incomplete or not as per the formats required, MOW, in its sole discretion, may exclude the relevant information from assessment for eligibility for pre-qualification.

ii) If the Applicant claims credit for an eligible project, and such claim is determined by MOW as incorrect or erroneous, MOW will exclude the same from assessment for eligibility for pre-qualification. Where any information is found to be patently false or amounting to a material mis-representation, MOW reserves the right to reject the Application.

6.19 MOW will notify all the successful and unsuccessful Applicants of the

result of their pre-qualification separately. However pre-qualification of an Applicant does not infer any binding agreement on behalf of MOW to assign them any further work.

6.20 Unsuccessful Applicants can seek reasons for disqualification or file an appeal for re-evaluation. Such an appeal should be filed either with MOW or the Tender Board within 2 weeks from the date of announcement of the results. MOW will set up a committee of senior representatives to carefully review such appeals and issue response within 2 weeks. Decision of the MOW committee shall be final.

6.21 If a contract is subsequently awarded to a Joint Venture, each

member of the group thereof will be severally and jointly liable for the whole performance of the contract obligations.

6.22 Applicants requiring clarification on this IFP may notify MOW in

writing or by fax and email in accordance with clause 2.12. They

should send in their queries two weeks prior to the last date of submission as stated in clause 2.8 MOW will send responses by Fax/ Email.

6.23 MOW may also on its own initiative, if deemed necessary, issue

interpretations/clarifications/addendums prior to the deadline for submission of Applications and these will be posted under the ‘Prequalification Category’ section of MoW website (www.works.gov.bh).

7.0 ANTICIPATED TIMELINES FOR SELECTION PROCESS

The Following tentative timelines are envisaged for selection of firms/Joint Ventures for short listing and to bid, in the second stage of the selection process: i) Last date for receipt of Expression of Interest (EOI) applications –

as specified in the clause 2.8 above. ii) Evaluation of EOI Applications and short listing of firms, receipt of

Tender Board approval on the list of prequalified consultants, finalization and issue of Request for Proposal (RFP) documents to the prequalified Firms/Joint Ventures within 8 weeks from the last date for submission of Applications in response to the IFP.

iii) Receipt of completed RFPs/Bids from the Applicants, within 8 weeks from the date of issue of RFP.

iv) A Pre-Bid Conference will be scheduled, if necessary, for the pre-qualified Applicants within 4 weeks from the date of issue of the RFP.

v) Evaluation of RFPs, selection and appointment of firms/Joint Ventures, within 8 weeks from the last date for receipt of completed RFPs. Consultants may be asked to give presentations to the evaluation committee, if required.

8.0 DOCUMENTS/INFORMATION TO BE SUBMITTED AS PART OF THE EOI

8.1 LETTER OF APPLICATION (AS PER THE FORMAT ENCLOSED IN ANNEX-1) FROM THE COMPANY/FIRM/LEAD MEMBER OF THE JOINT VENTURE, EXPRESSING THEIR INTENT TO BE PREQUALIFIED FOR THIS PROJECT AND COMMITMENT TO ASSOCIATE WITH MOW TO DELIVER THE REQUISITE TASKS OF THIS PROJECT. THE LETTER OF APPLICATION MUST CONTAIN FULL CONTACT DETAILS OF AUTHORISED CONTACT POINT FOR THE FIRM OR JOINT VENTURE.

8.2 Letters of Endorsement (as per the format enclosed in Annex-2) from

each member of the Joint Venture (in case of submission as Joint

Venture) expressing their intent and commitment to associate as part of the proposed Joint Venture and to agree to be jointly and severally liable to MOW under any contract which may be subsequently awarded to the Joint Venture.

8.3 A signed Confidentiality Agreement in the format indicated in Annex 3.

8.4 Completed Questionnaire (Annex 4) including observations/suggestions on the proposed Services and support documents clearly demonstrating their track record, capabilities and experience in similar projects.

8.5 Any other information (brochures/firm profiles, organisation structure, project management capabilities of the firm, international recognition/awards etc), details of available software tools and equipments, quality Assurance System/Quality Management Plans, and other details as deemed relevant by the Applicant.

8.6 All documents submitted by Applicants shall be in English Language

and financial data in BD (Bahraini Dinars).

9.0 DESCRIPTION OF THE CONSULTANCY SERVICES 9.1 The purpose of the Services will include, but not be limited to:

(i) Assisting Roads Affairs in the planning and development of Strategic Road projects. (ii) Producing concept, preliminary and final designs for Strategic Road projects. (iii) Producing tender documents carry out tender assessments and producing tender reports for Strategic Road projects. (iv) Supervising the construction of Strategic Roads projects as Engineer under the MOW Standard Contract Agreement and Conditions of Contract.

9.2 The Roads Master Plan - Strategic Projects may be located in either urban or rural areas in the Kingdom of Bahrain and may include, but not be limited to, the design and supervision of road works, bridges, underpasses, causeways, viaducts, road furniture, road marking and road signs, traffic diversions, ITS network, embankments, reinforced earthworks, retaining walls, drainage, landscaping, dewatering, street lighting and relocation/protection of existing services such as high voltage cables 11kv, 66kv, 220kv and water, sewage storm water and telecommunications networks.

9.3 It is anticipated that the construction cost of the individual Roads Master Plan Strategic projects may range normally between BD2

million to BD150 million. It is possible that some project construction costs may extend beyond this sum.

9.4 The scope of the Services will be divided into multiple construction

packages of varying sizes and complexity that will be implemented in a staged programme over the next few years.

9.5 An example Scope of Services for a MOW Strategic Roads Project is

included at Annex 5 however this should be taken to indicate a potential range of services that may be need to be undertaken and not a template for future projects as their scope my differ significantly from that shown in this Annex.

“Permitted Purpose” means considering and evaluating whether to submit a Statement of Qualification and response to any subsequent Request for Proposal in respect of the Project.

1. Confidentiality Undertaking

We undertake (a) to keep the Confidential Information confidential and not to disclose it to anyone except as provided for by paragraph 2 below and to ensure that the Confidential Information is protected with security measures and a degree of care that would apply to our own confidential information, (b) to use the Confidential Information only for the Permitted Purpose, and (c) to use all reasonable endeavours to ensure that any person to whom we pass any Confidential Information (unless disclosed under paragraph 2(d) below) acknowledges and complies with the provisions of this letter as if that person were also a party to it.

2. Permitted Disclosure

You agree that we may disclose Confidential Information:

a) with your prior written consent;

b) to our employees, professional advisors and authorised representatives to the extent that disclosure is necessary for the Permitted Purpose;

c) to any person whom we may (i) form a consortium with or (ii) contract with,

in each case in relation to and to the extent necessary for the Permitted Purpose; and

d) (i) where requested or required by any court of competent jurisdiction or any

competent judicial, governmental, supervisory or regulatory body, (ii) where required by the rules of any stock exchange on which our shares or other securities are listed, or (iii) where required by the laws or regulations of any country with jurisdiction over the affairs of our company,

provided that, (i) in the case of any disclosure under paragraph 2(b), the relevant third party has read and understood this letter and we ensure such third party complies with the terms of this letter as if such third party were a signatory to this letter and (ii) in the case of any disclosure under paragraph 2(c), such person shall have first delivered a letter to us in equivalent form to this letter.

3. Notification of Required or Unauthorised Disclosure

We agree (to the extent permitted by law) to inform you of the full circumstances of any disclosure under paragraphs 2 (c) or (d) or upon becoming aware that Confidential Information has been disclosed in breach of this letter.

4. Return of Copies

If you so request in writing, we shall return all Confidential Information supplies by you to us and destroy or permanently erase all copies of Confidential Information made by us and use all reasonable endeavours to ensure that anyone to whom we have supplied any Confidential Information destroys or permanently erases such

5. Continuing Obligations

The obligations in this letter are continuing and, in particular, shall survive the termination of any discussions or negotiations between you and us. Notwithstanding the previous sentence, the obligations in this letter shall cease (a) if we become party to the Consultancy Agreement for the Project or (b) twelve months after we have returned all Confidential Information supplied to us by you and destroyed or permanently erased all copies of Confidential Information made by us (other than any such Confidential Information or copies which have been disclosed under paragraph 2 above or which, pursuant to paragraph 4 above, are required to be returned or destroyed).

6. No Representation; Consequence of Breach etc.

We acknowledge and agree that:

• neither you nor any of your officers, employees or advisors (each a “Relevant Person”) (i) make any representation or warranty, express or implied, as to, or assume any responsibility for, the accuracy, reliability or completeness of any of the Confidential Information or any other information supplied by you or the assumptions on which it is based or (ii) shall be under any obligation to update or correct any inaccuracy in the Confidential Information or any other information supplied by you or be otherwise liable to us or any other person in respect to the Confidential Information or any such information; • you may be irreparably harmed by the breach of the terms hereof and damages may not be an adequate remedy; each Relevant Person may be granted an injunction or specific performance for any threatened or actual breach of the provisions of this letter by us; and • we will (in addition to, and without affecting, any other rights or remedies you may have) indemnify and keep you indemnified and hold you harmless from and against all actions, claims, demands, liabilities, damages, costs, losses or expenses (including legal and other professional costs and expenses) resulting from any breach or non-performance by us, or any person to whom we have disclosed or given access to any part of the Confidential Information, of any of the provisions of this letter. 7. No Waiver; Amendments, etc

This letter sets out the full extent of our obligations of confidentiality owed to you in relation to the information which is the subject of this letter. No failure or delay in exercising any right, power or privilege hereunder will operate as a waiver thereof nor will any single or partial exercise of any right, power or privileges hereunder.

The terms of this letter and our obligations hereunder may only be amended or modified by written agreement between us.

8. Inside Information

We acknowledge that some or all of the Confidential Information is or may be price-sensitive information and that the use of such information may be regulated or prohibited by applicable legislation relating to insider dealing and we undertake not to use any Confidential Information for any unlawful purpose.

9. Governing Law and Jurisdiction

This letter (including the agreement constituted by your acknowledgement of its terms) is governed by Bahrain Law.

Any dispute arising out of or in connection with this letter, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under Bahrain Law are deemed to be incorporated by reference into this clause.

The number of arbitrators shall be three. The arbitration proceedings shall be located in Bahrain.

The language to be used in the arbitral proceedings shall be English.

2.2 The approved and digitally coordinated cadastral corridor for the roads described in ……. will be made available to the Consultant at the commencement of the commission. 2.3 The Client will endeavour to answer all such requests and/or queries provided that they are received at least seven (7) days before the date specified for the submission of Proposals. Any such requests and/or queries, and the Client’s responses, may be sent to all consultants.

3. GENERAL SERVICES

3.1 The Consultants shall collect all the available data and information relevant to the project. The data and documents of major interest shall include, but not be limited to, the following:

i) Available feasibility studies and reports;

ii) Marine related data including available borrow areas and fishing facilities;

iii) Meteorological and weather data including rainfall; iv) Sub-surface and geo-technical data for construction of roads and

structures; v) Survey and evaluation of locally available construction materials; vi) Historical and archeological data; vii) Type, location and condition of existing utility services including

trial hole information;

3.2 The scope of the brief includes; conducting/updating traffic impact studies covering the entire study area, traffic assessment and recommendations, identifying the requirements for public transport corridor in liaison with the Ministry of Works Roads Affairs Department (RA);highway alignment studies; economic assessment studies, environmental and social impact studies; hydrodynamic modelling studies, assessment of compensations if required, including that for the fishing industry affected by the proposed reclamation, preparation of environmental management plan, development of alternatives, approved concept plans, preliminary design, value engineering assessment of total life cycle cost analysis, stake holder discussions and approvals, detail design, tender preparation and supervision.

3.3 Separate documents/reports for the above mentioned activities shall be submitted for approval as part of the consultancy under each of the following areas of work:

a) Land Reclamation; b) Roads; c) Road Structures; and d) Any other Structures (land and marine) to be constructed within the Study Area as deemed necessary.

3.4 The Consultant shall develop, liaise and manage the Project through the inception, feasibility studies, planning, concept, preliminary and detail design stages, arranging approvals and production of relevant drawings, bar schedules, and tender documents, undertaking tender processes, issuing of contract documents, construction drawings as identified in these Scope of Services including, but not limited to the following:

i) The preparation of separate tender documents for various elements or their combinations as directed, pre-qualification of

contractors, tendering, tender evaluation and reporting, assignment of utility services corridors, civil engineering design for diversions/protection of services, liaison with utility agencies including processing of planning permissions and wayleave approvals.

ii) The design of utilities of external agencies such aswater, electricity, telephone, and sewerage are not included in the consultancy,however their corridor allocation is part of the consultancy, as are street lighting, surface water drainage, traffic Signalsetc. shall be within the consultancy.

iii) Design and tendering of dredging, reclamation and shore protection.

iv) Design and tendering of roads and structures which shall proceed as per programme agreed with the client.

v) Sufficient period of consolidation of reclamation platform shall be accounted for in programming the works.

vi) TheConsultant shall prepare detailed designs, prequalification of contractors, tender documentation, tendering and attending to tender queries, tender evaluation and reporting.

vii) The Consultant shall submit a constructability/project methodology statement, detailing the following:

a) How the Project will be phased and delivered, including design, Tendering and construction sequencing.

b) Identifying the marine sand borrow areas and method of dredging and reclamation.

c) Rock armouring and shore protection.

d) Fishing facility compensation and provision of new fishing facility as required by the study.

e) Liaison for land acquisition and compensation.

f) Stakeholder liaison and approvals.

g) How existing traffic flow will be maintained or diverted incorporating input from appropriate traffic simulation models.

h) How any live utility services are required to be diverted/ protected/ maintained, during and after the construction of the Project. It will also detail any required utility diversions. The Consultant shall ascertain whether or

not services authorities require diversion of their existing plant and the provision of appropriate corridors accordingly.

i) Processing and securing approvals of planning permissions and wayleaves. j) Maintenanceof public relations and safety during

construction. 3.5 The Consultant shall submit in his proposals a durability statement, detailing the proposed measures to meet the service life required by the Client. He shall also produce a Maintenance and Operation statement/manual, detailing how the reclamation platform, roads and structures are to be maintained during their serviceable lives.

3.6 As part of the methodology for project implementation, the Consultant shall develop a likely programme for the design, tendering and construction of the works in liaisonwith the Client. The Consultant’s programme shall be produced using primavera or primavera compatible project planning software or equivalent as approved by the Client.

3.7 The objective of the consultancy service is to establish the technical viability of the project, then leading to the preparation of detailed design, project reports, in two phases:

i) for Dredging, Reclamation & Shore protection works; and ii) for Road and structures. iii) The output from the consultancy shall align with this Ministry’s Business Objective of implementing the projects with Sustainable Solutions.

requirements based on environmental impact assessment studies, borrow area locations, wave action, sea-bed conditions, shore protection requirements, fishing facility requirements, reclamation works design, traffic impact assessment studies, highway design, pavement design, provision of new service roads and rehabilitation of existing roads wherever necessary, construction of new bridges, intersections, underpasses/flyovers, rehabilitation and widening of existing and/or construction of new roads, bridges and structures on existing highways, road safety features, quantities of various items of works and probable construction cost estimates. 3.9 Prior to submitting the recommended concept plan for approval by the

Client, the Consultant shall prepare alternative concept plans along with their respective estimated costs. They shall also undertake and submit Traffic Impact Assessment (TIA) and Environmental Impact Assessment

(EIA) and Value Engineering Assessment (VEA) for each of the submitted alternatives of the project.

3.10 The approved concept plan shall further be developed into the reclamation design drawings, preliminary road design and submitted for the traffic Stage 1 Safety Audit approval. The recommendations of the Stage 1 Safety Audit shall be incorporated into the detailed road and structures design to follow. 3.11 The Consultant shall obtain the Approval In Principle (AIP) and the appropriate Design Check Certificate for all the structures included in the consultancy from the AIP authority of RA. 3.12 The Detailed Project Report (DPR) would inter-alia include detailed reclamation design, any fishing jetty design and compensations if required, highway design, design of pavement, design of marine bridges, and cross drainage structures and grade separated structures underpasses and flyovers, At-grade junctions/roundabouts, design of new service roads and rehabilitation of existing roads, quantities of various items, detailed working drawings, detailed cost estimates, EIA, TIA, VEA reports social feasibility report, social and environmental action/management plans in the form of appropriate and complete documents required for competitive tendering of the project. 3.13 The Consultant shall ensure detailed project preparation incorporating the Ministry’s Project Management System requirements, value engineering analysis, quality audit, Traffic Safety Audit Stage 2 requirements, traffic diversion plan, environmental and quality management plans and safety plan to be implemented during construction. 3.14 The assessment of road corridors and public transport corridors, shall include the provision of service roads, utilities corridors, alignment corrections, improvement of existing intersections/roundabouts including provision of at-grade and grade separated junctions etc. as necessary and practicable but cost effective. This may involve acquisition of land. The land acquisition procedure has been initiated but the Consultant shall review and forward any reductions or increases required for his approved alternative. 3.15 Complete with all setting out, cross sections, profile ready to implement ‘Approved for Construction’ drawings shall be prepared for both reclamation works and roads and structures. Included are additional construction drawings for road and structures, as required. 3.16 Traffic Impact Assessment (TIA) and Environmental Impact Assessment (EIA) Social and Economic Impact Assessment, Value Engineering Assessment, Category 2 or 3 design check, as applicable, for structures shall be carried out and approved reports submitted by the Consultant. The Road Safety Audits report at Stages 1,2 & 3 shall be prepared by independent road safety auditor and approved by RA.

3.17 Wherever required, the Consultant will liaise with concerned authorities and arrange all approvals, information, clarifications etc. The Consultant will also obtain approvals for Planning Permissions and Wayleaves from various ministries/utility agencies as per requirement in liaison with the Ministry’s Central Planning Office (CPO). The Consultant shall also prepare and incorporate the DPR the estimated costs for relocation or diversion of utilities of all types determined in liaison with the concerned authorities/agencies. 3.18 The Consultant shall obtain the necessary approvals required for implementation of the project from the concerned stake holders, such as Governmentinstitutions, governorates, municipalities, municipal council and concerned agencies. The Client shall apply to the relevant Government agencies in order to gain all approvals required to complete the scope of works. In the event that the Consultant does not obtain all the necessary approvals prior to commencement of the particular element of contracted work, a deduction of up to a maximum of 5% of design fee will be withheld from payment. The amount thus withheld will be released only after all necessary clearances have been obtained. 4. TRANSPORT STUDIES

4.1 The Consultant shall liaise with MMAUP to determineany additional major traffic flows and services requirement for the study area within the project implementation horizon.In particular he shall take cognizance of ………………………………. which may or may not induce additional traffic impacts. They shall be integrated into the project planning (adequacy of capacity planned)and implementation strategy (additional services corridors and delivery dates). 4.2 In particular the feasibility report should take account of the possible scenarios arising from: i) The Bahrain National Plan. ii) Significant other major investment projects which are confirmed by the Land Use Planning Authority of MMUP. iii) The possible impacts due to the introduction of a public transportation initiative to the various options arising from the final report of the Bahrain National Strategy. 4.3 Further; MOW has recently commissioned three major Strategic Transportation Studies as follows: i) Intelligent Transportation System for Kingdom of Bahrain. ii) Integrated Transportation Strategy for Kingdom of Bahrain. iii) National Road Safety Strategy Study.

4.4 The Consultant shall update and validate the traffic model described in ………… in accordance with …………………….. i) The Consultant shall obtain, if available at time of execution of the model validation, the preferred model land-use data which shall be incorporated within the model as part of the model update process. ii) Prior to the commencement of design, the Consultant shall consider the updated traffic analysis for ………………. In the event that there is a conflict between the updated land-use data for ……………..and the data, the former shall be taken as current. 4.5 The Base Year population and land-use data will be made available to the Consultant and a full demand model run undertaken. The year for this would be subject to available data and agreement with RPDD, but could be 2010, subject to preliminary 2010 Census data being available. 4.6 A comparison of the Base Year ‘forecast’ traffic flows against the available traffic count data would be undertaken to enable the model ‘accuracy’ to be determined. An understanding of the model discrepancies would then be more transparent. 4.7 Roads Affairs(RA) intends that the Consultant should comprehensively review all the aspects related to transport planning, public transport corridor requirements, future traffic operations, safety, noise and air quality in order that he may propose suitable corridor widths and road sections for …… and its accesslinks, develop optimal configurations for various junctions (access links and other local major/collector roads) and for the proposed new interchange on ……………. 4.8 It is expected that the transport assessment as part of the current study will provide a detailed transport planning basis for development of ………………… 4.9 The successful consultant will be provided with the latest VISUM/VISSIM model for their further work in this regard to ensure that a balanced road network is planned and a safe and workable configuration is evolved for the proposed at-grade and grade separated junctions and interchange on ………………. 4.10 As part of the current study, the Consultant is required to update and further detail the local area traffic model for the study region of the current project to comprehensively assess the impact on the current project with progressive and ultimate developments of all future proposed projects in the study area. The Consultant also needs to undertake detailed micro- simulation analysis using VISSIM software for reviewing the performance of

junctions/ interchange configurations and propose Sustainable Solutions as required by this Ministry’s Business Objective. 4.11 Detailed estimates for the traffic on……., its access roads and at various junctions in the study area must be precisely established for the opening year, 2021 and 2030. It is important that likely impacts on ……….. also needs to be analysed, as part of the study, to evaluate the need for widening and improvement of requisite junctions on……………... 4.12 The scope also includes liaising with MMAUP for the establishment of corridors for road and services, the preparation of required documents for land acquisition and compensation, services diversion, etc., and the improvement of ………………… 4.13 It is important to note that the road network master plan, conceived as part of National Planning & Development Strategy-2030, considers provision of public road connectivity between ….. and ………. 4.14 Consultant should review the need and identify suitable location for provision of public road connectivity between ….. and ………………. 4.15 The Consultant shall develop and suggest suitable configurations for the

Phased development of …… and its junctions with access roads. Scaled drawings in Microstation/Auto Cad need to be submitted for detailed review. Detailed basis must be established through the traffic study to justify the adequacy of suggested configurations for phased development in the corresponding horizon years.

5. ENGINEERING SURVEYS AND INVESTIGATIONS

Reconnaissance and Alignment

5.1 The Consultant shall collect and make an in-depth study of the available land Right Of Way (ROW), the topographic maps, satellite imageries, aerial photographs of the project area and any other available relevant information concerning the proposed/existing alignment. The Consultant himself will need to obtain the required maps and the information needed by him from authorised sources.

5.2 The detailed ground reconnaissance will need to commence immediately after the limit of survey has been established by the study of maps and other data.

5.3 The data derived from the reconnaissance surveys will be utilised for planning and programming the detailed surveys and investigations. All field studies including the traffic surveys shall be taken up on the basis of information derived from the reconnaissance surveys.

5.4 The data and information obtained from the reconnaissance surveys shall be documented.The data analysis and the recommendations concerning alignment and the field studies shall be included in the Inception Report.The data obtained from the reconnaissance surveys shall form the core of the database which would be supplemented and augmented using the data obtained from detailed field studies and investigations.

5.5 The Consultant shall review accident data for the last five years and assess their effect on the road network within the Study Area.

Topographic Surveys

5.6 The basic objective of the topographic survey would be to capture the essential ground features along road corridors in order to consider improvements and for working out construction costs.The detailed topographic surveys should normally be taken up after the completion of reconnaissance surveys.

5.7 The carrying out of topographic surveys will be one of the most important and crucial field tasks under the project.The detailed field surveys shall be carried out using high precision instruments i.e. Total Stations.The data from the topographic surveys shall be available in (x, y, z) format for use in a sophisticated Digital Terrain Model (DTM). The Consultant would be fully responsible for the inaccuracy of surveys.

5.8 The detailed field surveys would essentially include topographic surveys along the proposed ROW and beyond as required. The collection ofdetails include for all features such as structures (bridges, culverts etc.) utilities and their markers, existing landfalls and shoreline, shoreline protections, existing roads and footpath, electric and telephone installations (both O/H as well as underground), huts, buildings, landscaping features, drainage channels, fencing and trees (with girth greater than 0.3 metre) oil and gas lines etc. falling within the extent of survey.

5.9 The width of the survey corridor should take into account the footprint of the layout of the proposed alignment including the extent of embankment and private land affected, and cut slopes and the general ground profile.While carrying out the field surveys, the widening scheme (i.e. right, left or symmetrical to the centre line of the proposed carriageway) should be taken into consideration so that the topographic surveys cover sufficient width beyond the road corridor.

5.10 Bench Marks shall be established at site connected to National Bench marks at an interval of 250 metres on Bench mark pillar (15 cm X 15 cm X 45 cm) which shall be cast in RCC of grade M15 with a nail fixed in the centre of the top surface. Thereference pillar shall be embedded in concrete upto a depth of 30 cm with CC M10 (5 cm wide all around).The balance 15 cm above ground shall be painted yellow with RL and BM No. marked on the pillar with red paint.

5.11 The use of Value Engineering tools forTotal Life Cycle cost Analysis including the cost of mitigation measures recommended by the Management Plans of both Environment and Traffic Impact Assessment Reports shall be the responsibility of the Consultant. The Consultant shall submitthe Value Engineering Assessment Report with his recommendations and justifications to the approval of the MOW.

Bathymetric survey

5.12 The Bathymetric survey shall comprise of both the IN Survey and the OUT survey of the seabed levels of the reclamation area as well as the borrow area based on National Datum and coordinates. The survey grid of levels shall be determined by the consultant to maintain sufficient accuracy of works. It shall include any marine related structures or facilities existing in the study area.

Longitudinal and Cross-Sections 5.13 The topographic and bathymetric surveys for longitudinal and cross-sections

shall cover the following:

i) Longitudinal section levels along final centre line at every 20 m interval, at the locations of curve points, shorter intervals as required, also at intersections and at the locations of change in elevation.

ii) Cross sections at every 20 m interval in full extent of survey covering sufficient number of spot levels on existing carriageway and adjacent ground for profile correction and earth work calculations. Cross sections shall be taken at closer interval at curves.

iii) Longitudinal section for cross roads for length adequate for design and quantity estimation purposes.

iv) Landfall profile, shoreline, shoreline protections, fish traps and fishing facilities, any marine structures etc. shall be accurately represented in the survey

Details of Utility Services and Other Physical Features 5.14 The Consultant shall collect details of all important physical features along

the alignment either in the sea or on the ground. These features affect the project proposals and should normally include any buried objects in the sea, fish traps, marker buoys, rock outcrops, buildings and structures, monuments, burial grounds, cremation grounds, places of worship, water mains, sewers, drainage pipes, drainage channels, gas/ oil pipes, crossings structures, trees, plantations, utility services such as electric, and telephone

lines (O/H & U/G) and poles, optical fibre cables (OFC) etc. Trial hole surveys shall be done to ascertain type, depth, location etc. of the existing utilities along the alignment and the results presented in a report both in printed and in an approved electronic format and referenced to National Bench Mark and Survey grid. The survey would cover the entire ROW of the road and an adequate allowance for possible shifting of the central lines at some of the intersections locations.

5.15 The information collected during reconnaissance and field surveys shall be

shown on a strip plan so that the proposed improvements can be appreciated and the extent of land acquisition indicated with a Land Acquisition Schedule. Utility removals and relocations of each type shall be assessed so that suitable actions can be initiated. Separate strip plan for each of the services involved and a composite services plan shall be prepared for submission to the concerned agency.

Inventory of Road and Pavement Investigations 5.16 The Consultants shall carry out detailed field studies in respect of road and

its sub-grade. The data collected through road inventory and pavement investigations shall be sufficient to meet the input requirements of road design both for constructing new roads and for improving/ rehabilitating existing roads in optimum economic way. The Consultant shall also collect sufficient data for resolving the rutting problem prevalent at junctions of Bahrain roads and include in his proposals the following:

i) Detailed road inventory surveys which shall be carried out to collect details of all cross roads and pavement features along the proposed road sections.

ii) The data shall be collected in sufficient detail to be compiled and presented in tabular as well as graphical form.The inventory data would be stored in computer files using simple utility packages, such as EXCEL.

Wave surge and sea bed soil and rock characteristics

5.17 Wave surge, draw down, fetch, tidal current and scour characteristics, wind direction and velocity, physical and petrology characteristics of rock used for shoreline protection etc. as applicable for the design of the reclamation works shall be collected and used by the Consultant in his preparation of the reclamation drawings.

5.18 A Soil Investigation Report including seabed and its subsurface soil conditions and borehole details of both the reclamation area as well as the borrow area shall be prepared.It shall provide sufficient data to design the reclamation platform and its shore line protection and also to identify the borrow area that yields sufficient marine sand of acceptable quality.

Sub grade Characteristics and Strength

5.19 The data on soil classification and mechanical characteristics for soils along the proposed alignments may be collected from site if not available with the MOW or any other Ministry/Municipality agencies.

The testing for subgrade soil to the required depth shall include:

i) In-situ density, moisture content, ground water levels at each test pit ii) Field CBR at each test pit at different depth iii) Characterisation (grain size and Atterberg limits) at each test pit and, iv) Laboratory moisture-density characteristics); v) Laboratory CBR (unsoaked and 4-day soak compacted) and swell. vi) Borehole data and recommendation vii) An Interpretive Report with recommendation shall be prepared by the

Consultant based on the above mentioned collected data. viii) The laboratory for testing of material should be approved from MOW

before start of work.

Investigations for Existing Bridges and Structures

5.20 Inventory of Bridges, Culverts and Structures - The Consultant shall make an inventory of all the existing structures (bridges, viaducts, flyovers, intersections, culverts, etc.) within and in the vicinity of the proposed study area of the project. The inventory shall be presented in a tabular form covering the technical data of each structure.

5.21 Hydraulic and Hydrological Investigations shall include the following:

i) The hydrological and hydraulic characteristics of all drainage and sewerage structures existing within and in the vicinity of the road corridor shall be conducted by the consultant.

ii) The Consultant shall make a desk study of available data on topography (topographic maps, stereoscopic aerial photography), storm duration, rainfall statistics, top soil characteristics, vegetation cover etc. so as to assess the catchments areas and hydraulic parameters for all existing and proposed drainage provisions. The findings of the desk study would be further supplemented and augmented by a reconnaissance along the area. All important hydrological features shall be noted during this field reconnaissance.

iii) The Consultant shall collect information on high flood level (HFL), low water levels (LWL), discharge velocity etc. from available past records, local inquiries and visible signs, if any, on the structural

components and embankments. Local inquiries shall also be made with regard to the road sections getting overtopped during heavy rains.

5.22 Survey of Structural Condition of Existing Bridges, Culverts and Structures - The Consultant shall thoroughly inspect the existing structures, review the Operations and Maintenance Manual and shall prepare a report about their structural condition. This report shall be prepared by competent staff who have a good track record of conducting similar studies.

5.23 Geo-technical Investigations and Sub-Soil Exploration shall include the following:

i) The Consultant shall carry out geo-technical Investigations and sub- surface soil explorations including bore holes for the proposed bridges, flyovers, over bridges, tunnels, viaducts, interchanges etc., as well as along the foot prints of high embankments and any other location and conduct all relevant laboratory and field tests on soil and rock samples as necessary for the design of the works.

ii) The scheme for the boring locations and the depth of boring required shall be prepared to determine the necessary characteristics of underlying rock strata by the Consultant and submitted to MOW for approval.

iii) The sub-soil exploration and testing shall be carried out through the geo-technical consultants who have carried out geo-technical investigation work of similar nature. In case of outsourcing geo- technical investigation, the firm selected by the Consultant for this purpose shall also be approved by MOW before start of such works.

iv) For the road pavement, bore holes at each major change in pavement condition or in deflection readings or at 1 km intervals whichever is less shall be carried out to a depth of at least 2 m below embankment base or to rock level and are to be fully logged. Appropriate tests to be carried out on samples collected from these bore holes to determine the suitability of various materials.

Provision of Services Corridor

5.25 The service corridors for …………………………… have to be provided in accordance with the current code of practice for service corridors on Arterial Highways(ref. Latest version of the Code of Practice for Service Installations: May 1988: Ministry of Works, Power & Water; State of Bahrain.)

5.26 The Consultant will be required to liaise with the utility authorities, CPO of the Ministry of Works to determine the requirements for service corridors for all the roads included in the consultancy. All corridors shall be planned based on the current code of practice for services installations unless specific exemptions are approved.

5.27 The Consultant shall make provision for services corridor along the proposed road corridors or elsewhere that meet the requirements of the utility authorities.

5.28 The Consultant shall provide an assessment of the total corridor requirement of the major transmission networks as well as other distribution network with a view of reducing the land take for utility services as practiced elsewhere and/or per international standards.

5.29 In conjunction with the utility authorities and CPO, the Consultant shall prepare alternative service corridor routing for any key infrastructure services that cannot be accommodated within the expected delivery date along arterial link road corridors.

5.30 Assessment of Property Acquisitions: For each road access scenario the

Consultant shall determine and identify the areas of land acquisition to accommodate the services, road carriageways, at-grade junctions and interchanges. Any buildings or other structures existing within the acquisition area shall be highlighted and included in an inventory prepared by the Consultant to determine the costfor each road access scenario, if not in accordance with the land acquisition previously prepared.

Impact on Pedestrian Activity

5.31 The at grade signalised junctions on ……………….shall provide for safe pedestrian crossing facilities to ensure that pedestrian desire lines are catered, especially for ……………….. In case grade separated pedestrian crossing is required for safety reasons, the Consultant shall include them in their proposal, for MOW approval

5.32 Should it be considered that aparticular pedestrian desired line is other than at the proposed traffic signal junction, then consideration should be made for appropriate grade separated pedestrian crossing facilities. Pedestrian underpasses/overbridge shall be considered at the identified locations across ………….

Impact on Amenity of Existing Properties

5.33 All access options will require land acquisition.These options may require the through traffic generated by …….. to pass close to existing properties. The Consultant shall produce an inventory of affected properties and his proposals to mitigate adverse effect like noise etc. due to the proximity of traffic to existing developments, along with cost.

6. DETAILED DESIGN OF RECLAMATION, ROAD AND PAVEMENTS,

BRIDGES, STRUCTURES AND TUNNELS, FLYOVER, VIADUCT, CULVERTS, UNDERPASS ETC.

General

6.1 The Consultants are to carry out detailed designs and prepare working drawings for the following:

i) Reclamation, edge protection, rock armouring, borrow area and dredging, any fishing facility or marine structures that are required to be built due to compensation agreement;

ii) Highway with divided or single carriageway configuration complete as required in all respects with service roads at appropriate locations and tying into existing;

iii) Design of pavement, paved shoulders, medians, footpath,verges;

iv) Bridges, viaducts, flyovers,underpasses, culverts, structures etc.;

v) At-grade junctions, roundabouts, grade-separated interchanges;

vi) Alignment plans, longitudinal sections and cross-sections at critical locations and at 100m intervals of the highway;

vii) Designs for road furniture and road safety/traffic control features, traffic calming measures,including trafficsignals, markings and signs, ITS;

viii) Designs and drawings for utility service corridors, landscaping and tree planting, fencing at locations wherever necessary;

xi) Drainage and cross drainage design including pumping stations, channels,culverts, out fall structures etc;

x) Bridges and structures rehabilitation plans if required with all relevant design and drawings;

xi) Traffic amenities (parking areas, weighing station, permanentcount sites and rest areas, etc.);

xii) Median separation, traffic islands, pedestrian crossing and other safety features;

xiii) Pedestrian underpass, overbridge, footways etc; and

xiv) Any land acquisition details required

The proposed new highway shall be a partially access controlled and the design shall meet appropriate standards.

Design Standards

6.2 The Consultant’s design standards and material specifications shall primarily bebased on Road Design Manual/ publications, MOW Contract conditions- 2009 and any relevant circulars and recommendations as per the International Standards mainly British or similar to achieve world class roads and structures. It shall cover all aspects of detailed design including reclamation standards and guidelines followed by the Ministry, geometric design, pavement design, bridges and structures, traffic safety, workmanship and materials.

Dredging and Reclamation Design

6.3 The design shall be in accordance with the requirements of this Ministry’s Dredging and Land Reclamation Technical manual- 2008 and the current CIRIA publication. The design shall be compatible with the locally available rock material for shore protection and rock armouring works.

Geometric Design

6.4 The highways within the project area are to be developed as a partially access controlled highway facility in line with the national transportation plan, with appropriate measures to provide access at required locations as per traffic demand. The design of geometric elements shall, therefore, take into account all the essential requirements of such facilities.

6.5 The Consultant shall prepare the Departure Statement comprising of all deficiencies in design with respect to the standards. Appropriate justification and mitigation measures shall be included in the report to ensure safety, to the approval of MOW.

6.6 The detailed design for geometric elements of highways shall cover, but not be limited to, the following major aspects:

i) Appropriate key plans; ii) Horizontal alignment; iii) Longitudinal profile and super elevations; iv) Cross-sections; v) Junctions, intersections and interchanges; vi) Service roads if any, pedestrian walkways and facilities; and vii) Utility services drawings showing both existing and proposed services. 6.7 The Consultant shall make detailed analysis of traffic flow and propose the level of service for the road and workout its traffic flow capacity. 6.8 In the case of closely spaced cross roads the Consultant shall conduct traffic analysis and examine different options such as, providing grade separated

structure for some of them with a view to reduce number of at-grade crossings, services roads connecting the cross-roads and closing access from some of the intersections and prepare and furnish appropriate proposals for this purpose keeping in view of the cost of improvement, impact on traffic movement and accessibility to cross roads. The detailed drawings and cost estimate should include the provisions for realignments of the existing cross roads to allow such arrangements. 6.9 The Consultant shall also prepare design of pedestrian facilities to suit desired pedestrian movements, e.g. they may be in the form of pedestrian crossing, underpasses/overpasses for large cross traffic of pedestrians, cyclists and / or animals at identified locations if necessary particularly at identified locations. 6.10 The Consultant shall also prepare details for at-grade junctions, which may be adopted as alternative to the grade separated structures. The geometric design of at-gradejunctions and interchanges shall take into account the site conditions, turning movements, operating speed characteristics, level of service, overall economy and operational safety, landscaping and aesthetics. 6.11 The Consultant shall prepare design and other required details in respect of the service roads at required locations to cater to the local traffic.

Pavement Design 6.12 Detailed design of pavement shall include: i) Design of new road pavement ii) Design ofimprovement/ rehabilitation of existingpavement; iii) Design of junction pavement to prevent rutting iv) Pavement design for service roads (if any), v) Design of footpath/paved shoulders. vi) Design of rumbling strip at carriageway edges 6.13 The design of pavement shall primarily be based on Bahrain Road Design

Standard and locally available materials. However, the Consultant shall use the recommendations given in widely used international practices wherever appropriate on approval by MOW to achieve world class pavements and riding quality.

6.14 The design of pavement shall be rigorous and shall make use of the latest

Bahrain and international practices. The most appropriate design, option shall be established based on Total Life Cycle Analysis Cost including socio-economic considerations.

6.15 For the design of pavements, each set of design input shall be decided on

the basis of rigorous testing and evaluation of its suitability and relevance in respect of in-service performance of the pavement.The design methodology shall accompany the design proposals and shall clearly bring out the basic

assumptions, values of the various design inputs, rationale behind the selection of the design inputs and the criteria for checking and control during the implementation of works.The design of pavement structure shall take due account of the type, characteristics of materials used in the respective layers, variability of their properties and also the reliability of traffic predictions.Furthermore, the methodology adopted for the design of pavement shall be complete with flow charts indicating the various steps in the design process, their interaction with one another and the input parameter required at each step.

6.16 Latest techniques of pavement strengthening including the addition of fibre,

polymer, crumb rubber etc. to the asphalt mix shall be duly considered by the Consultant for achieving enhanced performance and economy.

6.17 The paved shoulders shall be designed as integral part of the pavement for

the main carriageway.The design requirements for shoulder pavements shall be proposed by the Consultant to the approval of MOW.

6.18 The pavement design task shall also cover preparing a Maintenance Manual

indicating periodic strengthening requirements including the details and justification of such treatments.

Design of Bridges and Structures 6.19 The Consultant shall consider various options for the construction of the

bridgeworks.These options shall be presented to the Client in the form of preliminary estimates, sketches perspectives, and a list of advantages/disadvantages associated with each option.The Consultant shall also render whole life cycle costs analysis obtained by applying value engineering techniques, which are to be specifically defined and justified.

6.20 On agreement with the Client on the proposed option for each structure, the

Consultant shall provide general arrangements and elevations, three dimensional views etc. of the structures. The Consultant shall also submit an initial estimate for the cost of the bridgeworks.

6.21 Following approval of the visual format of the structure by His Excellency the

Minister, the Consultant shall submit to RA a formal application for Approval-In-Principle (AIP) of each of the proposed structure:three weeks should be allowed for the approval period.

6.22 Once the Approval-In-Principle (AIP) has been granted, the Consultant shall

undertake the detailed design of the structures.The bridges shall be designed to current British Standards and UK Highways Agency Memoranda or as approved by the Ministry. The structures will be required to carry full HA loading, 45 units of HB loading and Abnormal Indivisible Loads (AIL’s).Details of AIL’s will be provided by RA.The Consultant shall also liaise with all utility services agencies to ascertain their requirements of their provision of services on the structures and also the required

protection,signing and markings of services during the construction of the structures.

6.23 The Consultant shall submit comprehensive reports and structural

calculations for each of the structural components:

i) Foundations; ii) Substructure; iii) Superstructure; iv) Waterproofing and other protective coatings; v) Bearings and expansion joints; vi) Abutments, retaining walls, pedestrian access; vii) Bridge furniture, safety measures and lighting; viii) Provision of services; and, ix) Cathodic Prevention System compatible with other requirements.

6.24 Category 2/3 design checks as required by the Ministry shall be undertaken by the Consultant in consultation with RA and shall be allowed for in the design fee. Approved Design Check certificates shall form part of the approved detailed design.

6.25 All drawings necessary to enable the construction of the bridgeworks shall be submitted to RA for approval.Three weeks shall be allowed for the approval period.

6.26 On completion of the detailed design and prior to tender the Consultant shall submit a detailed cost estimate for the bridgeworks.The estimate shall be derived from an itemised Bill of Quantities and is expected to be within +10% of the lowest acceptable tender.

Drainage System 6.27 The requirement of roadside drainage system and the integration ofthe same

with proposed cross-drainage system shall be worked out for structures and the entire length of the project road section.

6.28 In addition to the roadside drainage system, the Consultant shall design the special drainage provisions for sections with super-elevated carriageways, high embankments and for road segments passing through cuts.The drainage provisions shall also be worked out for road segments passing through urban areas.

6.29 The designed drainage system should show locations of outfall points with details of outfall structures fitting into natural contours.

6.30 Any existing natural drainage channel/ pipes/culverts/outfalls or road drainage shall be integrated into the overall drainage design.

Traffic Safety Features, Road Furniture and Road Markings

6.31 The Consultant shall design suitable traffic safety features and road furniture including traffic signals including overhead signals, artwork, materials used, signs, road markings, gantry structures and boards, crash barriers, safety barriers, pedestrian fence, crash cushions, delineators etc. The locations of these features shall be given in the reports and also shown in the drawings. The traffic safety features, road furniture and road markings shall comply with the requirements of the Traffic Engineering Section, RA and approved by them.

6.32 RA standards for the design of traffic signals shall be followed, and the final drawings shall be approved by the Traffic Signals & ITS group. Material used for the installation of the traffic signals should be purchased from approved suppliers locally and/or abroad according to the specifications which will be provided by the Traffic Signals & ITS group. As soon as the drawings are finalized and approved, the suppliers shall be approached in order to acquire the material in time. The Consultant shall ensure that the traffic signals civil and installation work must be done in close coordination with the Technical Support Unit of the Traffic Signals & ITS group.

Arboriculture and Landscaping

6.33 The Consultant shall prepare appropriate landscaping and irrigation plan in liaison with concerned Municipality for planting of trees and ground cover(specifying type of plantation), horticulture, floriculture on the available land of the right-of-way with a view to beautify the highway and making the environment along the highway pleasing.The existing trees / plants shall be retained to the extent possible. The design shall include both hard and soft landscaping.

The landscaping design shall be as directed by the Client and carried out in consultation with the MMAUP. Petrol service station, Parking Areas and Rest Areas etc.

6.34 The Consultant shall identify suitable locations for retail petrol service station, weighing stations, parking areas and rest areas and prepare suitable access plans in this regard.

Miscellaneous Works

6.35 The Consultant shall prepare detailed plan for the traffic diversion/management ensuring safety and lighting during the construction period in liaison with Traffic Engineering Section RA and the Street Lighting Section of Electricity Distribution Directorate of the Electricity and Water Authority. The traffic management plan to suit the program of construction shall be submitted by the Consultant to RA for approval by the General Directorate of Traffic prior to commencement of the works. The Consultant

shall comply with the procedure for traffic management application and approval.

7. ENVIRONMENT, SOCIAL AND ECONOMIC ASSESSMENT

Environmental Impact Assessment

7.1 Environment Impact Assessment(EIA) shall be carried out as applicable for the road and bridge works as well as for the reclamation works to the requirements of the Environmental Planning and Assessment Agency. The Consultant shall also submit an approved Environmental Management Plan to be implemented during the Construction stage. Both documents shall besubmitted for approval.

7.2 The Consultant shall carry out the preliminary environmental screening and prepare the Environmental Scoping Report to assess the direct and induced impacts due to the project. The Consultant shall arrange its approval from the Environmental Agency prior to proceeding with the EIA.

7.3 The Consultant shall undertake the analysis of alternatives to address the environmental concerns of the stake holders. This should include the current base line analysis and with the project scenario and modifications incorporated in the proposed project due to environmental considerations.

7.4 The Consultant shall give special attention to the environmental enhancement measures in the project for the following:

i) Cultural property enhancement along the highways ii) Bus bays and bus shelters including a review of their location, iii) Highway side landscape and enhancement of the road junction

landscape, iv) Enhancement of cornice, highway side water bodies, and v) Redevelopment of the borrow areas located on public land.

7.5 The Consultant shall establish a suitable monitoring system within the

Environmental Management Plan (EMP) with regard to air, water and noise pollution during construction. The Consultant will also provide additional inputs in the areas of performance indicators and monitoring mechanisms for environmental components during construction and operational phases of the project.

7.6 The Consultant shall provide the cost of mitigation measures and ensure that environmental related staffing, training and institutional requirements are budgeted in the project cost.

7.7 The Consultant shall prepare the application forms and obtain environmental approvals from the respective authorities on behalf of MOW.

The Consultant will make a presentation, if required, in defending the project to the Cabinet Services Sub-Committee.

7.8 The Consultant shall identify and prepare plans for plantation ofsuitable trees/shrubs, ground cover along the highway in accordance with guidelines.

Hydrodynamic Modelling and Studies 7.9 The Consultant shall undertake the appropriate Hydrodynamic modelling

studies to ascertain the marine bridge characteristics and to ensure the integrity of the reclamation and shore protection. Their report and recommendation shall be to the requirement of the concerned approving authorities.

Social Assessment

7.10 The consultant shall conduct base line socio-economic and census survey to assess the impacts on the society, properties and loss of livelihood. A social assessment is conducted for the entire project to identify mitigation measures and propose mechanisms to improve project designs to meet the needs of different stakeholders. A summary of stakeholder’s discussions, issues raised and how the project design was developed to meet stakeholders’ need shall be prepared by the consultant and the Report submitted to the approval of the Stakeholders.

7.11 The consultant shall prepare the finalised Land Acquisition Plans and assist RPDD in the acquisition of land under existing legislation of Bahrain. Economic Assessment 7.12 The Consultants shall carry out economic analysis for the project. The benefit and cost streams should be worked out for the project using internationally recognized life-cycle costing model. 7.13 The economic analysis shall cover but be not limited to be following aspects: i) assess the capacity of roads and the effects of capacity constraints on vehicle operating costs (VOC); ii) calculate VOCs for current road situation and those for the completed project; iii) quantify all economic benefits, including those from reduced congestion, travel distance, road maintenance cost savings and reduced incidence of road accidents; and, iv) estimate of the economic internal rate of return (EIRR) for the project over a 30-year period. In calculating the EIRRs, identify the tradable and non-tradable components of projects costs and the border price value of the tradable components.

7.14 The economic analysis Report submitted by the Consultant shall take into account all on-going and future road and transport infrastructure projects and future development plans in the project area. 8. ESTIMATION OF QUANTITIES AND PROJECT COSTS

8.1 The Consultant shall prepare detailed estimates for quantities and project costs using current market rates.The estimation of quantities shall be based on detailed design of various components of the projects.

8.2 The Consultant shall make detailed analysis for computing the unit rates for the different items of works.The unit rate analysis shall duly take into account the various inputs and their basic rates, suggested location of plant and respective lead distances for mechanized construction.The unit rate for each item of works shall be worked out in terms of manpower, machinery and materials.

8.3 The project cost estimates so prepared for MOW projects are to be checked against rates for similar on-going works in Bahrain.

8.4 The Consultant shall prepare the appropriate contract documents including the Bill of Quantities (BOQ) and Technical Specifications for all items of work in such a way that these may be readily integrated to the construction contracts. The Consultant shall submit an Engineer’s Estimate that includes the cost of all contracted construction works as well as the cost of other associated works of services protection, diversion, provision of street lighting, landscaping, compensations applicable fees etc that are payable by the Ministry, to arrive at the total project cost. The tender documents are required to be approved by both RA and Cost Engineering Directorate (CED).

9. TENDER DOCUMENTATION / CONTRACT STRATEGY

9.1 The Consultant shall arrange prequalification of Contractors in liaison with CED and the RA for the several contracts that comprises the totality of the project.

9.2 The Consultant shall be responsible for the preparation of separate tender document packages for the several construction work packages as directed by RA.

9.3 Separate Tender Packages shall be prepared for reclamation, road works and bridge works.

9.4 The dredging and reclamation works tender documents shall consists of dredging and reclamation and rock armouring, reclamation methodology as well as location of borrow areas and quarry details. The requirements and recommendations of the EIA report, Value Engineering Assessment report,

Environmental Management Plan and agreed fishermen facilities and compensations shall be included in the documents for each phase.

9.5 The Consultant shall submit draft copies of tender documents for the road and bridge works upon completion of the final detailed design.The detail design report shall include copies of approved AIP, design calculations, design check certificates, traffic safety audit reports, soil investigation reports and any other reports deemed necessary. The requirements of the EIA and Value Engineering Assessment reports shall be included in appropriate tender packages. The final tender documents shall be approved by RA and CED before it is issued to the prequalified contractors.

9.6 The Specification for the Bridgeworks shall be the latest UK Highways Agency Specification or an equivalent as approved by the Client, with the addition of special clauses for the Kingdom of Bahrain specification, or as approved by the Client.

9.7 Measurement for the structures shall be in accordance with the UK Highways Agency Method of Measurement for Road & Bridge Works, or otherwise as stated in this document.

9.8 The highway works will be constructed to the current Specification referenced in this document.Road works shall be measured in accordance with the current Civil Engineering Standard Method of Measurement. The form of contract used will be a Lump Sum Contract.

9.9 The contract documents shall allow for any testing and sampling to be carried out by external agencies via prime cost sums with a percentage on-cost for the Consultant’s administration and management included in the fee proposal.

9.10 The Consultant shall be responsible for the whole of the tender process in liaison with RA and CED. This shall include but not limited to prequalification of contractors, tendering, attending to the tender queries, advising the Client on tender status, arranging tender clinics/workshops with contractors as required, tender analysis and reporting.

9.11 The Consultant shall produce and submit a detailed Tender Analysis Report to the approval of CED, including arrangements for tender presentation and evaluation by selected tenderers and finally, the recommendation for award.

9.12 The consultancy fee for all deliverables of tender documentation and tendering process shall be entered in the Payment Schedule break down of the Fourth Schedule to the Conditions of Contract.

10. SITE SUPERVISION AND CONTRACT MANAGEMENT.

10.1 All tenderers’ should note that Site Supervision is included within the scope of services, but that this service is presented as an option to the design contract to be adopted by the Client at his discretion.

i) The Consultant’s Supervision fee shall be entered in the Payment Schedule break down of the Fourth Schedule to the Conditions of Contract.

ii) The Consultant shall be appointed as Engineer for the Works in coordination with Roads Projects and Maintenance Directorate (RA). The Consultant shall be responsible for the site supervision, contract management and site management of all the envisaged works, liaison with utility agencies, public relations, approval and management of traffic diversions, safety at work site, monitoring QA/ QC of works. The Contract works shall include a reclamation contract;road works contracts;bridgeworks contracts; and, any other associated works including landscaping, utilities protection/diversion works as applicable.

iii) The FiveContracts envisaged are of the following construction duration: ………

10.2 The Consultant shall identify and employ expatriate staff resources who shall be suitably qualified with a commensurate level of experiencefor the roles they undertake in the supervision of the contracts which may run independently. The duration and level of involvement of each team member shall be shown in the fee calculation. The Consultant shall optimise the resource profiling of the supervisionstaff to appreciate both the build-up and tail-down of construction, during which time there will be less construction activity, in order to provide a best value bid; this profile shall bereflected in the fee proposal of each supervision team. Necessary supervision staff shall be accounted for, one month prior to the commencement of the works and two months during the defects liability period or as required by the client.

10.3 The Consultant shall propose his site supervision management structure, and his proposed organograms should be submitted as part of his bid for Client review. The site supervision teams shall be composed of the required resources based upon the provision of the following suitably qualified and experienced staff:

i) Resident Engineer

ii) Assistant Resident Engineer

iii) Senior Engineer (Structures)

iv) Senior Engineer (Highways)

v) Quantity Surveyor

vi) Senior Inspector (Structures)

vii) Senior Inspector (Highways)

ix) Any specialist Engineer/Inspector as required

10.4 If the Consultant considers that additional resources, beyond those shown above, should be incorporated within his supervision team composition for any of the four referred contracts, then he shall provide details to justify the inclusion along with cost and additional man-month rates. The additional rates shall be presentedwithin his technical and financial submission as extra-over items, to the above base staff requirements.

10.5 The Consultant’s proposed supervision team structure, with individual monthly rates and their duration should be presented within his financial proposal. All other additional associated costs (e.g. drafting, documentation, office accommodations, administration, PPE and other equipment, transportation etc.) shall be presented on a per calendar month basis within the cash flow requirements for the supervision forthe four separate contracts within the financial proposal.

10.6 It is the Consultant’s responsibility that the key personnel, as proposed within the tender submission, are available for the periods shown within the resource profile. If the Consultant fails to provide the tendered resources, the Ministry reserves the right to terminate the consultancy.

11. DEFECTS LIABILITY PERIOD / MAINTENANCE PERIOD

11.1 The defects liability period for the structures included in the Project will be two years. All other associated works will have a one-year defects liability period.

11.2 In addition to the supervision of the contract, the Consultant shall complete and submit as-constructed drawings (hard copy and approved electronic format) including 3D location plans of all services installed, ducts register and project photographs in both electronic and approved print format. The Consultant shall also produce and submit the Maintenance Plan including the maintenance of reclamation works, road works and bridge/structure works, as well as the structure files and maintenance manuals for the structure in accordance with the UK Highways Agency Specifications, or an equivalent as approved by the Client, at the end of the contract construction period

11.3 At the end of the defects liability period, the Consultant shall carry out a formal handover of the reclamation platform, road network and the structures to the Client. The Consultant shall also carry out a Principal Inspection Report and a proposed Maintenance Regime for each structure/road/element of contracted works showing specific activities to be undertaken and their time schedules towards the end of design life. This document shall be submitted to the Client for approval.

11.4 Within the first two months of the defects liability period the Consultant shall review, approve and submit to the Clients, the Contractor’s As-constructed Drawings (hard copy and approved disk format), for all structures, reclamation works and road works, ducts register and necessary documentations for handing over of the project to the Roads and Bridges Maintenance Section.

11.5 The Consultant shall specify any additional fee requirement with break down if applicable and include in his submission for undertaking the above responsibilities.

12. PROJECT DELIVERABLES

Reports to be submitted by the Consultant to MOW

12.1 All reports, documents and drawings are to be submitted separately. The analysis of data and the design proposals shall be based on the data derived from the primary surveys and investigations carried out during the period of assignment. The sources of data and model relationships used in the reports shall be indicated with complete details for easy reference.

12.2 Project preparation activities will be reported through the following:-

i) Quality Assurance Plan ii) Inception Report (IR) iii) Feasibility Study Reports (FSR) iv) Strip Plans and Clearances v) Land Acquisition Report vi) Preliminary Project Report (PPR) vii) Detailed Project Report (DPR) viii) Data and Software

12.3 The Consultant shall be required to complete, to the satisfaction of the client, the individualstudy stages within the time frame indicated in Third Schedule to the Conditions of Contract. The Consultant shall submit all documentsrequired to be delivered in order to confirm payment eligibility for each stage,prior to the commencement of the subsequent stage of the consultancy.

12.4 The Consultant shall prepare and submit EDMS-PMIS documents including,

but not limited to, the Project Charter, Project Scope Statement and manage the consultancy as required by Project Management Office (PMO) of MOW in their specified formats.

12.5 The Consultant shall adhere to the requirements of ISO 9001- 2008 Quality

Management system and manage the consultancy complying with the Ministry requirements.

Quality Assurance Plan (QAP) Document

12.6 Immediately upon the award, the Consultant shall submit the QAP document incorporating all aspects of proposed field studies, investigations, design approach, feasibility studies and economic and financial analysis. The quality assurance plans/procedures for different field studies, engineering surveys and investigation, design and documentation activities shall be presented as separate sections like traffic and engineering surveys and investigations, material geo-technical and sub-soil investigations, road and pavement investigations, investigation and design of reclamation, roads, bridges & structures, environmental impact, value engineering analysis, Economic analysis, social impact and compensations, drawings and documentation, their preparation, checking, approval and filing, andcalculations, Identification and traceability of project documents etc. The QAP document thus prepared shall be compatible with the Ministry’s requirements of Project Management Office and ISO 9001-2008.

12.7 Further, additional information shall be furnished regarding the details of personnel who shall be responsible for carrying out/preparing and checking/verifying various activities forming part of feasibility study and project preparation, since inception to the completion of work.The field and design activities shall start after the QAP is approved by Ministry.

Inception Report (IR)

12.8 The report shall cover but not limited to the following major aspects: i) Project appreciation;

ii) Detailed methodology to meet the requirements of the ITT finalised in consultation with the MOW officers; including scheduling of various sub-activities to be carried out for completion of various stages of the workstating out clearly their approach & methodology for project preparation after due inspection of the entire project stretch and collection/ collation of necessary information;

iii) Task Assignment and Manning Schedule;

iv) Work programme;

v) Format for data collection including trial hole survey/investigation to locate existing services;

vi) Design standards, parameters and proposed cross-sections;

vii) Key plan and Linear Plan;

viii) Development plans being implemented and / or proposed for implementation in the near future by the local bodies and the possible

impact of such development plans on the overall scheme for field work and design for the study;

ix) Quality Assurance Plan (QAP) finalized in consultation with MOW;

x) Draft design as appropriate;

xi) Proposed Road Right of Way corridor required for the project elements including roads, bridges, embankments and interchanges shall be submitted for Client’s review; and,

xii) A Separate report for reclamation and rock armouring works, to commence as advanced works shall be submitted for approval.

Feasibility Study (FSR)

12.9 The Consultant shall commence the Feasibility Study of the project in accordance with the accepted IR. Each of the reports shall contain the following:

i) Executive summary; ii) Project description; iii) Methodology adopted for the feasibility study; iv) Details of the study; v) Analysis of the data; vi) Conclusion; and, vii) Recommendations.

Special attention of the Consultant is drawn to the following which should be covered in the reports:

i) Design standards, methodologies and specifications; ii) Data collection and Traffic Impact Analysis; iii) Environmental screening, Environmental Scoping Report; iv) PreliminarySocio-economic profile of the project areas; v) Environmental Impact Assessment; vi) Environmental Management Plan; vii) Hydrodynamic modelling and study; viii) Preliminary and Final Value Engineering analysis; ix) Confirmed Road Right of Way plans, including land

acquisition/resettlement, compensation plan; x) Verification of location of existing utility services by undertaking trial

hole exploration/survey, Updating existing utility layout, their diversion

plans as required and proposed utility corridors etc. in liaison with the concerned; and,

xi) Cost estimates; and, xii) Economicand financial analysis.

12.10 The basic data obtained from the field studies and other investigations shall

be submitted in a separate volume as an Appendix to Feasibility Reports. 12.11 The Final Feasibility Study Report incorporating comments, revisions and modifications suggested by MOW shall be submitted within 15 days of receipt of comments from MOW on the submitted draft feasibility study reports. 12.12 A Summary Feasibility Report comprising of the executive summaries of all the studies shall be submitted to the Client’s approval.

12.13 Separate feasibility study report shall be prepared for undertaking dredging, reclamation and rock armouring as advanced works.

Strip Plan and Clearances

12.14 The Consultant shall submit the following documents

i) Details of the centre line of the proposed roads along with the proposed right-of-way limits to appreciate the requirements of land acquisition;

ii) The information concerning the area including ownership of land to be acquired for the implementation of the project shall be collected from the revenue and other concerned authorities and presented along with the strip plans. Foot print of structures and embankments shall be clearly shown in the plans;

iii) Strip plans showing the position of existing utilities and services indicating clearly the position of their relocation as well as future utility corridor requirements;

iv) Details for various clearances such as environment and archaeological clearances;

v) Separate strip plan showing shifting / relocation of each utility services in consultation with the concerned local authorities; and,

vi) The utility relocation plans should clearly show existing right-of-way and pertinent topographic details including buildings, major trees, fences and other installations such as water-mains, telephone, telegraph and electricity poles,and suggest relocation of the services along with their crossings the highway at designated locations as required and prepare necessary details for submission to the Service Departments.

vii) Land Acquisition Plan and schedules.

12.15 The strip plans and land acquisition plan shall be prepared on the basis of

ROW requirements and on the data collected from reconnaissance and detailed topographic surveys.

12.16 Separate plans for reclamation and rock armouring as advanced works shall be prepared in liaison with the concerned.

Land Acquisition Report

12.17 The Land acquisition report showing Right of Way requirements shall be prepared and submitted separately for each land parcel.The report shall include detail schedules about acquisition of land holdings in a strip plan and also the applicable costs as per authorized agencies. The land acquisition reportshall be submitted in both Arabic and English languages.

12.18 The land acquisition report shall be prepared in consultation with affected land owners, non-governmental organizations and government agencies as applicable.It shall also include plan of compensating land requirement, if applicable with specific locations and cost involved for undertaking all activities in this regard.

Preliminary Project Report- PPR

12.19 The Draft PPR shall be prepared separately for each construction package and shall contain the following:

iii) The basic data obtained from the field studies and investigations and input data from the Concept Report shall be incorporated in the preparation of the preliminary design and shall be submitted in a separate volume as an Appendix to PPR.

iv) The Final PPR incorporating comments, revisions and modifications suggested by Ministry of Works shall be submitted within 15 days of the receipt of comments of MOW on the Draft PPR.

Draft Detailed Project Report (DPR)

12.20 The draft DPR Submission shall consist of Main Report, Design Report, Materials Report, Engineering Report, Drainage Design Report, Economic and Financial Analysis Report, Environmental Assessment Report including Environmental Action Plan), Value Engineering Report, Draft Tender Documents and Drawings.

12.21 Separate draft Detailed Design Report for Reclamation and rock Armouring works shall be prepared along with all the required approvals to undertake the construction of the road platform as advance works

12.22 The Documents and Drawings shall be submitted in the following format:

12.23 Volume I - Main Report

i) This report will present the project background, social analysis of the project, details of surveys and investigations carried out, analysis and interpretation of survey and investigation data, traffic studies and demand forecasts, designs, cost estimation, environmental aspects, economic and commercial analyses and conclusions;

ii) The report shall include Executive Summary giving brief accounts of the findings of the study and recommendations;

iii) The report shall also include maps, charts and diagrams showing locations and details of existing features and the essential features of improvement and upgrading;

iv) The Environmental Impact Assessment (EIA) Report and Environmental Management Action plan shall be submitted separately as a part of the main report;

v) HydrodynamicModeling and Study Report with recommendations shall be submitted separately;

vi) The Value Engineering Analysis Report along with justification, assumptions and weights used in the report shall be submitted as a separate document; and,

vii) The basic data obtained from the field studies and investigations and the preliminary design Report shall be submitted in a separate volume as Appendix to Main Report.

12.24 Volume II - Design Report:

i) This volume shall contain design calculations, supported by computer printout of calculations wherever applicable.The Report shall clearly bring out the various features of design standards adopted for the study.The design report will be in four parts;

ii) Part –I shall comprise of the design of reclamation and rock armouring works. This shall include necessary cross sections, plans, In survey of sea bed, foundation details, borrow areas, soil investigation reports, compensation plans, method statements;

iii) Part-II shall primarily deal with the design of road , road drainage, and pavement;

iv) Part-III shall deal with the design of bridges, structures and cross- drainage structures.The sub-soil exploration report including the complete details of boring done, analyses and interpretation of data and the selection of design parameters shall be included as an Appendix to the Design Report;

v) Part –IV shall comprise of the utility services layout, diversions, protections, corridor assignments, cross sections, procurement details and their programs, Installation schedules and any other associated details required for the implementation of the project;

12.25 The detailed design for all features and elements of the project shall be carried out as per the requirements of the appropriate Design Standards. However, there may be situations wherein it has not been possible to strictly adhere to the design standards due to the existing site conditions, restrictions and other considerations.The report should clearly bring out the details of these deviations from the Design Standards in the form of a report which shall be approved by the Client; and,

12.26 The detailing of the design by the design consultant shall be such that the contractor will be able to price and also to build as per the design. The setting out details, levels, profiles, cross sections etc. shall provide sufficient information to build as required by the specification. Contractor’s design responsibility shall be limited only to method related elements.

12.27 Volume III - Environmental Impact Assessment (EIA) Report including Environmental Management Action Plan (EMP) and Hydrodynamic Modelling and Study Report (HMS) - The EIA and HMS Report shall be prepared conforming to the requirements of Specifications and Guidelines of the concerned Government Agency of the Kingdom of Bahrain as appropriate and approved by them. The EMP shall be approved by the same agency and shall comprise of the mitigation measures proposed in the EIA. The HMS shall contain recommendations and Mitigation measures to be adopted in the design of the project;

12.28 Volume- IV Value Engineering Analysis (VEA) Report -It Shall comprise of Total Life Cycle Cost Analysis of the project elements. It shall provide justification to the assumptions made and weighting assigned to determine the assessment and ensuing recommendation. Particular attention shall be paid to the proportional relationshipbetween the reclaimed and structured road lengths with due regard to the hydrodynamic and environmental impact, and, the need to accommodatenavigable sea channels as advised by the Authorities;

12.29 Volume-V,Technical Specifications – TheStandard Technical Specifications for Road and Bridge works shall be followed for this study. However, this volume shall contain the Particular technical specifications

which are not covered by standard Specifications for Roads and Bridges (latest edition / revision) and also specific quality control norms for the construction of works;

12.30 Volume – VI , Rate Analysis - This volume will present the analysis of rates for all items of works.The details of unit rate of materials at source, carriage charges, any other applicable charges, labour rates, machine charges as considered in arriving at unit rates will be included in this volume;

12.31 Volume - VII, Cost Estimates - This volume will present the cost of each item of work as well as a summary of total cost;

12.32 Volume - VIII, Bill of Quantities - This volume shall contain the detailed Bill of Quantities for all items of works. Priced BOQ showing the Engineer’s Estimate shall also be submitted;

12.33 Volume - IX, Drawing Volume - All drawings forming part of this volume shall be ‘good for construction’ drawings with sufficient details.All plan and profile drawings will be prepared in scale 1:500H scale.In addition this volume will contain ‘good for construction’ drawings for the following:

i) Key Plans, Existing Survey and field features ii) Horizontal Alignment showing ROW iii) Longitudinal Profile and Levels as required iv) Cross-section at 20m interval along the alignment showing ROW v) Typical Cross-Sections with details of pavement structure. vi) Detailed Working Drawings for individual Culverts and Cross-Drainage

Structures. vii) Detailed Working Drawings for individual Bridges, and Structures. viii) Detailed Drawings for Improvement of At-Grade and Grade-Separated

Intersections and Interchanges. ix) Drawings for Road Sign, Markings, and other Facilities. x) Traffic Signal, Gantries, Overhead signals, ITS installations xi) Schematic Diagrams (linear chart) indicating but be not limited to be

following: a) Widening schemes; b) Locations of median openings, intersections, interchanges,

underpasses, overpasses, bypasses; c) Locations of service roads; d) location of traffic signals, traffic signs, road markings, safety features;

and,

e) locations of parking areas, weighing stations, bus bays,rest areas, if any.

xii) All drawings will be prepared in A0 or A1 size sheets.The format for

plan, cross-section and profile drawings shall be finalized in consultation with the concerned MOW officers.The drawings shall also include details of all BM and Reference pillars.The co-ordinates of all points should be referenced to Bahrain National Datum.The drawings shall also include the locations of all traffic safety features including traffic signals, signs, markings, crash barriers delineators and rest areas, bus bays, parking areas etc.

xiii) The proposed cross-sections of road segment passing through urban areas should indicate the provisions for pedestrian movements and suitable measures for surface and sub-surface drainage and lighting, as required.

12.34 Volume - X, Tender Documentation - Tender documents shall be prepared in accordance withrelevant packages as approved by the Ministry

12.35 Volume-XI, Project Approvals and Clearances from Authorities –Allthe necessary(project related) approvals and clearances (such as Planning Permissions, Wayleaves, Inter Utility Works Requests) shall be obtained by the consultant and submitted to Ministry of Worksso that project implementation canproceed without any delay.

Consultant’s Other Responsibilities

12.36 The consultant shall be responsible for the correction or re-execution of all or any part of any stage of the consultancy services in the event that such correction or re-execution is required by the Client as a result of the action, inaction, default or negligence from the part of the Consultant or any member of their staff either during the design phase or during the execution stage.

12.37 The Consultant shall be responsible for preparing complete set of buildable

detailed drawings, with levels, coordinates, set back, services diversion corridors, services protection, traffic diversion plans etc., that are required for the construction. Also the supply ofany additional design drawings previously omitted but are required for constructionand/or of any additional design modifications/ revisions which may become necessary during the construction due to consultant’s omissions or negligence, except when such additional design works constitutes change of scope, shall be the responsibility of the Consultant.

Data and Software

12.38 The CD’s containing all basic as well as the processed data from all field studies and investigations, report, appendices, annexure, documents and drawings shall be submitted to the Roads Project and Maintenance

Directorate of the Ministry of Works at the time of the submission of the Final Report.The data can be classified as follows:

i) Engineering Investigations and Traffic Studies: Road Inventory,

Condition, Roughness, Test Pit (Pavement composition), Benkelman Beam Deflection, Material Investigation including test results for subgrade soils, Traffic Studies (traffic surveys) and result, axle load surveys, Sub-soil Exploration, Drainage Inventory, Inventory data for bridge and culverts indicating rehabilitation, new construction requirement etc.

ii) Topographic Surveys and Drawings: Alltopographic data would be supplied in (x, y, z) format along with complete reference so that the data could be imported into any standard highway design software.The drawing files would be submitted in Microstation format.

iii) Rate Analysis: The Consultant shall submit the rate analysis for various works items including the data developed on computer in this relation so that it could be used by the Authority later for the purpose of updating the cost of the project.

iv) Economic and Financial Analysis, EIA Report, VE Report, TIA Report

v) Basic and processed data used for the preparation of the above reports.

Software:

12.39 The Consultant shall also hand-over to Roads Planning & Design Directorate of the Ministry of Works CD’s containing any general software/model including the traffic/financial model which has been specifically developed for the project.

12.40 The CD’s should be properly indexed and a catalogue giving contents of all CD’s and print-outs of the contents (data from field studies topographic data and drawings) should be handed over to Roads Planning & Design Directorate of the Ministry of Works at the time of submission of the Final Report.
