    requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

    AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

    Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

    EmergencyExecutiveOrders.Thegovernor'sauthorityisspecifiedintheConstitutionoftheStateofMinnesota,ArticleV,andin Minnesota Statutes§4.035.EmergencyExecutiveOrders,forprotectionfromanimminentthreattohealthandsafety,becomeeffectiveimmediately,arefiledwiththesecretaryofstate,andpublishedintheState Registerassoonaspossibleaftertheyareissued.OtherExecutiveOrdersbecomeeffective15daysafterpublicationintheState Registerandfilingwiththesecretaryofstate.Unlessotherwisespecified,anexecutiveorderexpires90daysafterthedatethegovernorwhoissuedtheordervacatesoffice.

    Office of the GovernorEmergency Executive Order 20-104: Safely Reopening Pools for Lap Swim, Lessons, and Organized Swim Teams

    I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

    TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.Minnesotahastakenextraordinarystepstopreventandrespondtothepandemic.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.SincedeclaringthepeacetimeemergencyinMarch,Ihaveextendeditevery30days,withthemostrecentextensionoccurringonDecember14,2020.

    Weareoveronemonthintoadialbackperiodoncertainsocialgatherings,sportsactivities,andplacesofpublicaccommodationthatwereinstitutedtocombatanoverwhelmingstatewidesurgeofCOVID-19cases.Lastweek,asdailycasenumbersslowlybegantodecrease,wemadesomeadjustmentstothedialbackwithExecutiveOrder20-103.Thoseadjustmentswereintentionallysmallandgradualbecausecasenumbersandcommunitytransmissionremainatdangerouslevels.Weprovidedopportunitiesforfamiliesandfriendstogathersociallyinsmallgroupswithincreasedprecautionarymeasures,andforrestaurantsandvenuestobeginaslowreopening,startingwithoutdoorspaces.Inaddition,recognizingthephysicalandmentaltollofCOVID-19restrictions,weallowedindoorphysicalfitnessandexercisefacilitiestoreopenwithreducedcapacity,increasedsocialdistancing,andmandatoryfacecoverings.

    Manyathletesareeagertoreturntoorganizedsportsactivities,whichsimilarlyprovidemanyphysicalandsocialbenefits.ExecutiveOrder20-103permittedathletesandcoachestoresumeone-on-onetrainingandsmalloutdoorgroupworkoutsandskillbuilding.WhenIannouncedthatExecutiveOrder,IalsosignaledmyintentiontotakeadditionalstepstowardthereturnoforganizedsportsinearlyJanuary.ThisExecutiveOrderreopenspoolsforanarrowrangeofactivitiesincompliancewithindustryguidance—includinglapswim,lessons,andorganizedsports—beginningonJanuary4,2021.

    InMinnesotaStatutes2020,section12.02,theMinnesotaLegislatureconferredupontheGovernoremergencypowersto“(1)ensurethatpreparationsofthisstatewillbeadequatetodealwithdisasters,(2)generallyprotectthepublicpeace,health,andsafety,and(3)preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2020,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagementaswellascarryouttheprovisionsofMinnesota’sEmergencyManagementAct.

    MinnesotaStatutes2020,section12.21,subdivision3(7),authorizestheGovernortocooperatewithfederalandstateagenciesin“matterspertainingtotheemergencymanagementofthestateandnation.”Thisincludes“thedirectionorcontrolof...theconductofpersonsinthestate,includingentranceorexitfromanystrickenorthreatenedpublicplace,occupancyoffacilities,and...publicmeetingsorgatherings.”Pursuanttosubdivision3ofthatsamesection,theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”oftheEmergencyManagementAct.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionofthestatearesuspendedduringthependencyoftheemergency.

    Executive OrdersForthesereasons,Iorderasfollows:

    1. EffectiveSunday,January3,2021at11:59pm,throughSunday,January10,2021at11:59pm,individualsandbusinessesthroughoutMinnesotamustcontinuetocomplywiththeprovisionsofExecutiveOrders20-99and20-103,exceptasmodifiedorsupersededbythefollowingamendments.AllotherprovisionsofExecutiveOrders20-99and20-103remaininfullforceandeffect.

    2. Paragraph7.c.iiiofExecutiveOrder20-99,asamendedbyExecutiveOrder20-103,isamendedbythefollowingadditions(indicatedbyunderlinedtext)anddeletions(indicatedbystrikethroughtext):

    iii. Certain Places of Public Accommodation Closed to Members of the Public. ThefollowingPlacesofPublicAccommodationareclosedtomembersofthepublicassetforthbelow.“Membersofthepublic”meanspeoplewhoarenotworkersaffiliatedwiththePlaceofPublicAccommodation.

    A. Publicpools,asdefinedinMinnesotaStatutes2020,section144.1222,subdivision4(d),areclosedtoingress,egress,use,andoccupancy.

A.Venuesprovidingindooreventsandentertainment(whetherpermanent,temporary,ormobile)suchastheaters,cinemas,concerthalls,festivals,fairs,vendorfairs,museums,performancevenues,stadiums,arcades,trampolineparks,partybuses,andbowlingalleysareclosedtoingress,egress,use,andoccupancybymembersofthepublic.Suchestablishmentsmay,andareencouragedto,usetheirfacilitiestoprovidevirtualorremoteprogramming.

    C. B.Forprofessionalandintercollegiateathletesandteamsauthorizedtopracticeandcompeteunderparagraph7.h.ii.BandC,thisclosureofeventandentertainmentvenuestomembersofthepublicmeansthatonlyathletes,coaches,andotheressentialstaffareauthorizedtobepresentinvenueshostingtheseactivities.Spectators,includingfamilyandfriendsofparticipantsandstaff,arenotpermittedtoattendpermittedsportingeventsorpractices.

    D. C.PlacesofPublicAccommodation,whichwouldotherwisebeorderedclosed,maystayopeniftheyhavebeenrepurposedtoexclusivelyprovideservicespermittedunderparagraph7.c.iiorasprovidedinapplicableguidanceavailableontheStaySafeMinnesota website (https://staysafe.mn.gov/).Forexample,avenueprovidingindooreventsandentertainmentthathasbeenrepurposedtoprovidehealthcareactivities,suchasblooddrives,COVID-19testing,orvaccinations,isauthorizedtoprovidethoseessentialservices,subjecttorelevantlicensingandotherrequirements,andapplicableMDHandCDCguidelines.

    I, Tim Walz, Governor of the State of Minnesota, bytheauthorityvestedinmebytheConstitutionandapplicablestatutes,issuethefollowingExecutiveOrder:

    TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.Minnesotahastakenextraordinarystepstopreventandrespondtothepandemic.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.Sincedeclaringthepeacetimeemergency,Ihaveextendeditevery30days,withthemostrecentextensionoccurringonDecember14,2020.

    ThisCOVID-19pandemichasdisruptedMinnesota’seconomyandplacedunexpecteddemandsonthestatebudget.AsweworktopreventthespreadofCOVID-19andsupportcommunitiesacrossMinnesota,weremainfocusedonbeingdiligentstewardsofstateresources.Tolessentheimpactofthepandemiconthestatebudget,membersofmyCabinet,myChiefofStaff,andIvoluntarilyagreedtoreduceoursalariesfromApril15,2020toDecember31,2020.ThemembersoftheCabinetandthestateemployeesateachoftheiragenciesareworkingextraordinarilyhardtoservethepeopleofMinnesotaduringthepandemic,andtheState’sbudgetoutlookhasimproved.Giventhesecircumstances,thesalaryreductionforCabinetmemberswillexpireasplannedonDecember31,2020.InsolidaritywithallthoseinMinnesotawhocontinuetoexperiencehardshipduetothepandemic,myChiefofStaffandIwillcontinuetoreduceoursalariesinto2021.

    UnderMinnesotaStatutes2020,section12.21,subdivision3(10),theGovernormayalteroradjustpayrolllawsregardingexecutivebranchstateemployeesasnecessarytominimizetheimpactoftheemergency.

    Forthesereasons,Iorderasfollows:

    1. NotwithstandingMinnesotaLaws2013,Chapter142,article6,section12,mygrosssalarywillbereducedby10percentbetweenJanuary1,2021andJune30,2021.Thistemporaryreductioninmysalarymustnotaffectthesalariesofanyotheremployeesorofficialswhosesalaries,pursuanttocertainlaws,aresetproportionallytotheGovernor’ssalary.

    2. NotwithstandingtheOfficeoftheGovernorCompensationPlanadoptedpursuanttoMinnesotaStatutes2020,section43A.18,subdivision4(b),thegrosssalaryofmyChiefofStaffwillbereducedby10percentbetweenJanuary1,2021andJune30,2021.

    OnApril10,2020,IsignedExecutiveOrder20-34,whichdirectedtheCommissionerofHealthtosharelimitedhealthinformationwiththeDepartmentofPublicSafety,pursuanttotheMinnesotaGovernmentDataPracticesAct(“MGDPA”).TheMGDPApermitsthedisclosureofprivatehealthdatatotheextentnecessarytocontrolorpreventthespreadofseriousdiseasesuchasCOVID-19.ThepurposeofExecutiveOrder20-34,issuedearlyoninthepandemic,wastoprovideextraprotectionforfirstresponderswhofacedtheprospectofexposuretoanovelviruswithlimitedpersonalprotectiveequipment(“PPE”).Ourknowledgeofthevirusanditsspreadwaslimited,andIdeterminedthatlimitedinformation—theaddresseswhereapositiveCOVID-19testresulthasbeenobtainedandwhethertheindividualtestedisstillcontagioustoothers—shouldbedisclosed.AfterIissuedExecutiveOrder20-34,theDepartmentofHealth(“MDH”)andtheDepartmentofPublicSafety(“DPS”)workedcollaborativelywitheachotherandexternalstakeholderstodevelopandimplementastringentdatasharingprotocoltoprotectprivacy.Governedbythisprotocol,thedatasharingprogramhasbeenutilizedbyfirstrespondersacrossMinnesotafornearlyeightmonths.

    CircumstancesrelatedtothevirushavechangeddramaticallysinceApril.Communityspread—viralspreadwherewecannotdeterminethesourceofinfection—hasgrownsignificantly.TotaldailypositivetestratesdwarfthoseobservedinApril.Thesefactorsmakeitmoredifficulttotimelyidentifypositivecasesandconductcontacttracing.Thisreducestheefficacyofdatasharedwithfirstresponders.WehavealsostockpiledPPEaccessibletofirstresponders,reducingtheoverallneedfortheprogram.Inaddition,arecentDPSsurveyoffirstrespondersand911dispatchersshowedonlymixedsupportfortheprogram.SomesurveyrespondentsnotedthataskingCOVID-19screeningquestionsisamoreeffectiveapproach.Moreover,wehavereceivedreportsthattheveryexistenceoftheprogramhastragicallydissuadedsomefromseekingtestingortreatment,despitetheprotocol’smanyprivacysafeguards.Inmyassessment,theprogram’scostsappeartobeonthevergeofoutweighingitsbenefits.Forthisreason,IhavedecidedtoendthedatasharingprogrameffectiveJanuary31,2021.ThisdateprovidesampleopportunityfortheLegislaturetomakeadifferentpolicydetermination,ifitsochooses.

    Separately,theGovernor’sCommitteetoAdvisetheMinnesotaPollutionControlAgencywasestablishedbyGovernorDaytoninExecutiveOrder15-15andcontinuedinExecutiveOrder19-29.Awidearrayofotherexistingandnewlycreatedstatecouncils,committees,andotherentitieshaveasimilarscopeandfocusofworkandallowforengagementwiththeMinnesotaPollutionControlAgency.SincetheworkofthisCommitteeisaddressedbyotherentities,andintheinterestofefficientgovernance,ExecutiveOrder15-15shouldberescinded.

    Healthcareprofessionals,includingpharmacistslicensedbytheMinnesotaBoardofPharmacy(“BoardofPharmacy”),arecriticalfrontlineresponderstotheCOVID-19pandemic.Thesehealthcareprofessionalsworklonghoursandtakeextraordinarymeasurestoprotectthehealth,safety,andlivesoftheirneighbors.FullyutilizingthisdedicatedworkforceisvitaltoprotectingallMinnesotans.TheUnitedStatesDepartmentofHealthandHumanServiceshasreachedagreementswithcertainpharmaciestoadministerapprovedCOVID-19vaccinestoindividualsinlong-termcarefacilitiesandtoindividualswhoseektobevaccinatedatpharmacies.Asthepandemiccontinues,somepharmaciesarefacingshortagesofpharmacistsduetostaffillnessorinabilitytoworkforotherreasons.FurthershortagesareexpectedduetothevolumeofCOVID-19vaccinationsthatmustbeadministered.Icallonhealthcaresystems,hospitals,andpharmaciestoworkcloselywiththeirpharmaciststoensurethatadequatepersonalprotectiveequipmentisavailabletothemwhentheyareadministeringCOVID-19vaccines.Finally,itshouldbenotedthatnothinginthisExecutiveOrderismeanttounderminetherightsofMinnesota’spharmacistsandotherhealthcareprofessionalstocollectivelybargain.

    PharmaciesandpharmacistswillplayacriticalroleinadministeringCOVID-19vaccinestoresidentsandstaffoflong-termcarefacilitiesduringtheinitialphasesofCOVID-19vaccinations.Giventhattheyarereadilyaccessibletothepublic,pharmaciesandpharmacistswillalsoplayacriticalroleinprovidingCOVID-19vaccinationstootherindividualsinlaterphases.Torespondquicklyduringthispandemic,hospitals,pharmacies,andotherhealthcareprovidersneedtemporaryflexibility,includingtheabilitytohirequalifiedpharmacistsfromotherstates,especiallythosewithexistingexperienceinadministeringvaccines.Forallofthesereasons,IhavedeterminedthatitisnecessarytosupporttheeffortsofMinnesota’shealthcareprofessionalsandpharmaciesbyallowingout-of-statepharmaciststoadministerCOVID-19vaccinesinMinnesotaatthiscriticaltimeofthepeacetimeemergency.
