RESOLUTION TO CLOSE MEETING

Moved by Councillor Nahal, seconded by Councillor Anderson:

BE IT RESOLVED that the meeting be closed to the public in accordance with Section 90(1) of the Community Charter

a) Personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

c) labour relations or other employee relations; d) the security of the property of the municipality;

INTRODUCTION – DOWNTOWN VERNON ASSOCIATION EXECUTIVE DIRECTOR (0230-29)

Ms. Melanie Prince, President of the Downtown Vernon Association (DVA) introduced Ms. Susan Lehman, the new Executive Director for the DVA. It was also announced that Dudley Coulter has been hired as its new marketing and Events Coordinator and that Dina Mostat has been promoted from her position as Member Services Coordinator to Director of Member Services.

DEVELOPMENT VARIANCE PERMIT APPLICATION FOR 3509 25TH STREET

Moved by Councillor Nahal, seconded by Councillor Cunningham:

THAT Council not support the development variance permit application (DVP00394) to vary the following sections of Zoning Bylaw #5000 on Lot 1, Block 25, Sec 3, Twp 8, ODYD, Plan 327E (3509 25th Street):

a) to increase the maximum height to the lessor of 3.5 storeys or

11.7m (Sec. 9.11.6); and

b) to increase the maximum site coverage to 50% and together with driveways, parking areas and impermeable surfaces to not exceed 68% (Sec. 9.11.6)

AND FURTHER, that Council support the development variance application (DVP00394) to vary Subdivision and Development Servicing Bylaw #3843 Schedules A to allow the principles of the Integrated Transportation Framework (ITF) standards for offsite works in 36th Avenue and 25th Street adjacent to Lot 1, Block 25, Sec 3, Twp 8, ODYD, Plan 327E, subject to the following:

Mayor Mund called a first time for representation from the public in attendance who believe their interest in property is affected by Development Variance Permit #00394 to vary sections of Zoning Bylaw #5000 AND Subdivision and Development Servicing Bylaw #3843 Schedules A on Lot 1, Block 25, Sec 3, Twp 8, ODYD, Plan 327E (3509 25th Street).

Concerns regarding parking in area due to increased volume using street parking

Emergency vehicle access a concern

Sidewalk issues already

Aesthetics are a concern as view will be blocked

Sewers in area are old and may effect system

Property value a concern if it will decrease value of his property

2. Chelsea Taylor

Aesthetic of neighbourhood – doesn’t fit into area

Doesn’t believe it adds value

Concerns regarding on street parking issues that may arise

Sidewalk goes into 25th Street which then affects parking and traffic flow

It is under construction, now realizes being built to current regulations

Prefers denial due to height

E. Stranks, Manager, Engineering Development reviewed purpose and function of the ‘ITF Study’.

Owned property for 12 years

Echoes previous concerns

Height is not appropriate for neighbourhood

Does not respect nature of current neighbourhood

Heritage sites in area and this doesn’t fit

Parking and road safety a concern

Concerned regarding flash flooding with any change in permeable service regulations

No on street parking issues as two spots and two car garage

Did development down the street, and are allowed a vestibule on the rooftop – just asking for it to be wider

There will be a vestibule on the roof regardless

Impermeable surface variance just allows full paving of driveway

Applicants really like roof top patio and would like enclosed space to use in winter

The tree in question is across the street and the sidewalk was built around it

Energy needed to keep living space liveable may be issue as it will be hot up there

One year later, and now back to haunt City of Vernon

People will park in front when the laneway plugs up with traffic

Near or opposite ‘squeeze’ that will be a significant impact

Market in East Hill and other areas

COV mandate to improve aesthetics of East Hill and walkability of the City of Vernon

Desirable to increase density and as such need to go up

Empty nesters downsizing but still want outside space

Losing residents to Kelowna due to a lack of this type of housing

Very little negative response from buyers for this product

Believes that this will increase the value of everyone’s properties

This is the future and both positives and negatives can be addressed

Market and trends supporting this

Same trend in Vancouver and now coming here

10. Chelsea Taylor

Still strongly against

Not appropriate for area

Cannot imagine living directly beside

Does not fit the aesthetic of the neighbourhood

Did not buy in this area for this type of housing

All you see is a great big brown wall from his house

No difference with what they do on top

THAT Council support Development Variance Permit Application #DVP00402 to vary the following sections of Zoning Bylaw #5000 in order to construct a secondary building with a secondary suite on the property described as Plan B1275, Sec 2, Twp 8, ODYD (1702 39th Avenue):

a) to allow for a secondary building in the front yard (Sec. 4.5.4); and

b) to vary the maximum height of a secondary building from 4.5m to

7.5m (Sec. 9.3.5).

AND FURTHER, that Council’s support of DVP00402 is subject to the following:

a) That the site, elevation and floor plans noted as Attachments 2 to

5 inclusive in the report titled “Development Variance Permit Application for 1702 39th Avenue” and dated July 19, 2017 by the Planning Assistant be attached to and form part of DVP00402 as Schedule ‘A’.

Moved by Councillor Cunningham, seconded by Councillor Lord:

THAT Council support Development Variance Permit Application #DVP00403 to vary Section 6.5.11 of Zoning Bylaw #5000 with respect to the height of a retaining wall on Lot 16, Plan EPP38363, Sec 13, Tp 8, ODYD (7188 Apex Drive), subject to the following:

a) That a retaining wall height in excess of 1.2m, if necessary to

support onsite building and or driveway construction, be permitted provided the design for this is acceptable to the Building Inspector and the garage floor is lowered and the driveway rebuilt to not exceed a grade of 20% onsite and 8% in the boulevard;

AND FURTHER that Council not support the following request as part of Development Variance Permit Application #DVP00403 to vary the Subdivision and Development Servicing Bylaw #3843 and Traffic Bylaw #2747 with respect to the driveway grade within the boulevard of Apex Drive directly adjacent to Lot 16, Plan EPP38363, Sec 13, Tp 8, ODYD (7188 Apex Drive): a) To vary the maximum driveway grade within the boulevard in Apex

Drive directly adjacent to 7188 Apex Drive from 8% to 16.7% [Bylaw #3843, Schedule C. 2.05 and Bylaw #2474, Section 410, 1. (c), (iii)].

Reason why wall is the way it is – wanted to maintain view and followed grade of property

Neighbour didn’t’ do that and now resulted in big wall on his property

Did work two days ago so COV not aware

Admin: Wall still needs a variance – will need Building Inspectors to have a look to determine

Has sold property and if this is not approved now the deal will fall through

COUNCIL INQUIRIES:

EASTSIDE ROAD SIGNAGE

Council requested the Manager, Transportation to examine Eastside Road signage. Confusing for public as Eastside Road heads toward Ellison Park but there is another road called Eastside Road which is narrow, dead ended and large vehicles cannot turn around. Requested to perhaps rename or label ‘no exit’. A. Admin: There is a ‘No Thru’ sign posted, but will move closer to intersection and will indicate a ‘no turnaround’. An Admin Update will be provided.

DCC BYLAWS Council inquired as to status of amendments to City of Vernon Development Cost Charges (DCC) bylaws. A. Admin: Parks DCC coming along very well. Meeting with RDNO very soon. Delayed work on sewer and roads DCCs – hoping to have draft in front of Council Spring 2018.

HAZMAT ROUTE Council noted that the Transportation Plan has been in effect for a few years – when can we expect Hazmat Route Bylaw and procedures to come forward? A. Admin: Plan is not implemented as yet. Need Ministry of Transportation approval for Hazmat Route and have not begun work on this. An Admin Update will be provided.

SUBDIVISION AND DEVELOPMENT SERVICING BYLAW

Council noted that there seems to be constant variances to the Subdivision & Development Servicing bylaw - when will the bylaw be addressed so variances will not be required. A. Admin: Staff are working to create a layer with ITF information so that applicants can see requirements. The process is nearing completion, but must it be user friendly. That is the amendment to the bylaw that will be brought forward.

THAT Council directs Administration to provide a report to Council for the designation of one parking spot for resident only use at 3006 Gateby Place. CARRIED.

MANDATORY SEWER CONNECTIONS FOR SUBDIVISION AND DEVELOPMENT (5340-09)

Moved by Councillor Cunningham, seconded by Councillor Lord:

THAT Council receive the memorandum titled “Mandatory Sewer Connections for Subdivision and Development” from the Manager, Long Range Planning and Sustainability and the Municipal Technician III, Infrastructure Management, dated July 31, 2017 for information. CARRIED.

COMMUNITY ECONOMIC DEVELOPMENT INITIATIVE (CEDI) (6750-20)

Moved by Councillor Lord, seconded by Mayor Mund: THAT Council appoint Councillor Cunningham as the Council Liaison for the Community Economic Development Initiative;

AND FURTHER, that Council direct Administration to assist in organizing a joint workshop with the Okanagan Indian Band as part of the Community Economic Development Initiative Program in October 2017. CARRIED.

MATTERS REFERRED FROM SPECIAL COMMITTEE OF THE WHOLE – AUGUST 3, 2017

Moved by Councillor Cunningham, seconded by Councillor Lord: THAT Council ratifies and confirms the following resolutions adopted at the August 3, 2017, Special Committee of the Whole meeting of Council:

‘THAT Council authorizes the Vernon Fire Rescue Services Temporary Strengthening of Emergency Deployment as detailed at the August 3, 2017 Special Committee of the Whole meeting, effective immediately;

AND FURTHER, that Council authorizes funding up to $79,000 for this emergency deployment, source of funds 2016 Unexpended / Uncommitted year-end balance;

1. Okanagan Landing/Eastside Road to Municipal Limits 2. Tronson Road to Municipal Limits 3. The Rise Development’

MATTERS REFERRED FROM IN-CAMERA:

THAT Council brings forward, as public information, the following

motions declassified from confidential to non-confidential at the August 14, 2017, In Camera meeting:

INTERIM STRATEGY FOR POLSON PARK IMPROVEMENTS (6140-20)

‘THAT Council direct Administration to investigate and report back on the details, costs, source of funds and implications of the following measures:

(a) Replacing the sand at the Polson Park playground with a

compressed recycled rubber surfacing, utilizing the proposed donation by Kal Tire;

(b) Establishing a two year pilot program permitting dogs on-leash in Polson Park, including signage, stations with waste receptacles and water stations;

(c) Trimming the vegetation along the path and boardwalk in the southern portion of Polson Park, including cleaning and repair of the boardwalk and existing interpretive signage;

(d) Enhancing Bylaw Compliance presence in the Polson Park.’

THAT Council endorse the proposed amendment to University of British Columbia - Okanagan Connector Transit Service Establishment Amendment Bylaw No. 2752, 2017 relating to basing the cost allocation for this service on an increased number of ridership surveys;

AND FURTHER, that Council endorse the following consent resolution addressed to the Regional District of North Okanagan:

THAT, pursuant to the provisions of Section 346 [Consent on behalf of municipal participating area] of the Local Government Act, the Council of the City of Vernon does hereby consent, on behalf of the electors of the City of Vernon, to the Board of the Regional District of North Okanagan adopting the following bylaw:

University of British Columbia – Okanagan Connector (UBCO)

Transit Service Establishment Amendment Bylaw No. 2752, 2017

a bylaw to amend Bylaw 2547 which established a transit service within the Regional District of North Okanagan for the purpose of providing a public passenger transportation service to the University of British Columbia – Okanagan from the Vernon Transit Terminus. CARRIED.

2017 – 2018 SUSTAINABILITY GRANTS PROGRAM TIMELINE (5280-03)

VERNON PUBLIC ART GALLERY – REQUEST TO PAINT DOWNTOWN BENCH (5410-10)

THAT Council direct staff to approve the Vernon Public Art Gallery’s request to paint the bench located at 3211 30th Avenue as per the submitted conceptual design;

AND FURTHER, that Council direct staff to assist with the removal and re-installation of the bench when completed. CARRIED.

HESPERIA LANDFILL – ACTION PLAN (5360-02)

THAT Council direct Administration to proceed with the action items identified in the approved Action Plan attached as Appendix A and included in the report titled Hesperia Landfill – Action Plan and submitted by the Manager of Public Works dated July 24, 2017 at an estimated cost of $115,000 over three years, to be funded from current waste tipping fees;

AND FURTHER, that Council direct Administration to monitor and adjust waste tipping fees on an annual basis to ensure that appropriate revenue is generated to fund the long term operation of this site. CARRIED.

CITY OF VERNON / QUEEN OF SILVER STAR FLOAT (1280-01)

THAT Council direct staff to discontinue the practice of supplying, maintaining and repairing the current float, float trailer and tow vehicle currently used by the Winter Carnival Queen’s Committee;

AND FURTHER, that Council encourage the Winter Carnival Queen’s Committee to seek support from private sponsorship or the Greater Vernon Advisory Committee (GVAC) if they wish to continue with a new float or other means of representation; AND FURTHER, that the current Winter Carnival Queen’s Committee float be disposed of for safety reasons and the float trailer and tow vehicle be re-assigned or sold. CARRIED.

PROCUREMENT OF AN ELECTRIC VEHICLE (1280-01)

THAT Council approve the capital acquisition of one new electric vehicle in 2017, at a cost of $30,000 using funding from the Vehicle and Equipment Operating Reserve. CARRIED.

THAT Council endorse the proposed phasing plan for sanitary sewer local area service extensions to properties in Okanagan Landing Sanitary Sewer Service Area #1 and Service Area #2, as shown in Table 1, Proposed Okanagan Landing Local Service Timelines, in the report titled Okanagan Landing Sewer Phasing Plan and Design Funding Request, dated July 19, 2017, as submitted by the Municipal Design Technician III;

AND FURTHER, that Council direct Administration to allocate design funds for the proposed 2018 and 2019 sewer local area service projects in the amount of $350,000 from sewer utility reserves. CARRIED.

HOSPITAL RESIDENT EXEMPT PARKING AREA PETITION RESULTS (8300-09-10)

THAT Council directs Administration to implement 16 new parking meter spaces (four double and eight single meters) along 31st Street and 18th Avenue only, at an initial cost estimated at $12,000 to be funded from the Data Processing Reserve in 2018;

AND FURTHER, that Council support an increase to the parking meter maintenance budget by $3,850 annually to be funded from the new parking meter revenue. CARRIED.

REQUESTS FOR FREE TRANSIT (8500-06)

THAT Council approve free public transit within the City boundary for the RespectFEST Multicultural Festival on September 23, 2017. CARRIED.

POTTERY ROAD IMPROVEMENTS – FUNDING TRANSFER (5410-10-Pottery Rd)

THAT Council endorse a budget increase of $350,000 for the Pottery Road Improvement Project to be funded through a reallocation of $200,000 from the authorized budget for the 2017 Capital Project 30th Street Road and Utility Rehabilitation (Highway #6 to 30th Avenue), and the remaining $150,000 from Infrastructure Reserve Funds. CARRIED.
