Minutes of Meeting of Inter Ministerial Committee (IMC) for consideration of proposals for setting up ICDs / CFSs held under Chairmanship of Shri P.K. Chaudhery, Additional Secretary (AS), Department of Commerce (DoC) on 21st October, 2010

Inter-Ministerial Committee (IMC) met on 21.10.10 in Udyog Bhawan, New Delhi, with Shri P.K. Chaudhery, AS, DoC in Chair, for consideration of proposals for setting up Inland Container Depots (ICDs) / Container Freight Stations (CFSs). Following officials participated in the meeting :

1. Dr. Shyam Agarwal, Joint Secretary, Department of Commerce 2. Shri H.D. Gujrati, Executive Director (TT-S), Ministry of Railways 3. Shri A.K. Bamba, Director, Department of Commerce 4. Shri Srinivasa Naik, Director, Ministry of Shipping 5. Shri Navraj Goyal, Under Secretary(Customs), CBEC, Deptt. of Revenue. 6. Shri S.G. Sood, Under Secretary, Department of Commerce. 7. Shri Hemant Kumar, Section Officer, Department of Commerce 8. Shri N.K. Sinha, Section Officer, CBEC, Deptt. of Revenue.

2.1 At the outset, issue regarding distinction between ICD and CFS was discussed. In this regard, it was observed that ICD, basically a dry port, is located in the interiors (outside the port towns) of the country and CFS is an off dock facility located near the servicing port, which helps in decongesting the port by shifting cargo and customs related activities outside the port area. 2.2.1 To that extent, an ICD is a sort of virtual port, and therefore does all documentations relating to international trade goods just like a regular international sea port / airport. 2.2.2 In contrast to above, a CFS is actually a facility supporting the port activities (rather than a port itself). And therefore, a CFS must be necessarily linked to either a port or an ICD, asserted CBEC representative. 2.2.3 Representative of CBEC was of the view that if any CFS is to be set up in the interior part of country, it has to be attached with an ICD (preferably nearby). Representative of Railway Board was of the view that this may not be necessarily so, as earlier many CFSs were set up without any linkage to an ICD.

2.2.4 It was decided that CBEC and Railway Board will give detail information in this regard and matter regarding setting up of CFS in the interior will be discussed in next meeting, with feedback as above. 2.3 Further, land requirement has been broadly fixed as under : For ICD - 4 Hectares CFS - 1 Hectare

However, IMC has the powers to relax these requirements in specific cases, where modernized equipments, electronic processing, etc. may require less land for operations.

3. Following decisions were taken on the Agenda :-

3A

NEW PROPOSALS

3A.1 Setting up a CFS at Rai (Sonepat), Haryana by Container Corporation of India (CONCOR) (F.No.16/16/2010-Infra-1) Representative from CBEC stated that the proposal was examined in consultation with Commissioner of Central Excise, Rohtak and it was reported by Commissioner, Rohtak that ICD Kundli was notified in the year 2003. However, from 2006-07 onwards no import / export activity has taken place at the said ICD. The proposed CFS which will be a deemed extension of ICD will, therefore, not be a worthwhile preposition. Accordingly, it was observed that CONCOR may consider to set up an ICD instead of CFS at Rai. It was decided that an amended application for setting up ICD may be submitted along with duly registered Lease Deed by CONCOR. CONCOR will also submit detailed justification of trade volume for proposed ICD with a copy to Commissioner of Customs, Rohtak. 3A.2 Setting up of rail-linked ICD at Timmapur, Mahaboob Nagar Distt., Andhra Pradesh by Kribhco Continental Multimodal Logistic Park Limited, Hyderabad (F.No.16/17/2010- Infra-1)

The proposal was approved.

It was decided that since the proposed ICD is located in hinterland far away from the sea port, comments of port authorities are not required in this case.

3A.3 Setting up of ICD at Modinagar, Distt. Ghaziabad (U.P.) by Kribhco Infrastructure Limited, Noida (F.No.16/18/2010-Infra-1) The company is required to submit requisite land documents including proof of ownership / possession of land and Change of Land Use (CLU) certificate for non-agriculture use of land from the concerned authorities along with an undertaking that the proposed land is free from all encumbrances. Thereafter, the proposal would be decided on file after customs opinion is received.

3A.4 Setting up of CFS at Jokatte Road, Baikampadi, Dakshina Kannada, Mangalore by ABG Infralogistics Limited, Mumbai (F.No.16/20/2010-Infra1)


3A.5 Setting up of ICD at Fathepur village, Tauru Thensil, Mewat District, Haryana by Continental Warehousing Corporation (Nhava Seva) Ltd., Chennai (F.No.16/22/2010-Infra-1) The proposal was deferred for want of requisite documents / comments viz. :

(i) Attested / notarized copy of registered Sale / Lease Deed in the name of the company,

(ii) Attested copy of Non acquisition certificate from Tehsildar, (iii) CLU for non agriculture use of land and (iv) Clarification regarding area of land being less than prescribed 4 hectares.

3A.6 Setting up of CFS at Pipavav Port, Gujarat by Kesar Terminals & Infrastructure Limited, Mumbai (F.No.16/26/2010-Infra-1)

The proposal was deferred. The company may be advised to submit details of traffic volume in the proposed CFS to Commissioner of Customs concerned / CBEC. Conversion of Land use from agriculture to non agriculture purpose (CLU) certificate for non-agriculture use of land is also awaited from the company.

3A.7 Setting up of CFS at village Dighode, Uran Taluka, Raigad Distt., Maharashtra by Sarveshwar Logistics Services Pvt. Ltd., Navi Mumbai (F.No.16/28/2010-Infra-1) The proposal was deferred for want of comments from CBEC. Company is required also to submit CLU certificate.

3A.8 Setting up an ICD at Kannur (Kerala) by Central Warehousing Corporation, New Delhi. (CWC) (F.No.16/10/2010-Infra-1) CBEC has recommended the proposal. As regards availability of less land than that prescribed for setting up an ICD, company had stated that the ICD being a road-fed facility, does not require aggregation of export containers prior to their dispatch to the load port. Besides this, multi rack system, fixing fenders and dock levelers, reach stackers, etc. would be used for maximum use of land available. The explanation given by CWC was accepted as to less land requirement.

It was decided that the proposal will be forwarded by DoC to Ministry of Shipping, who in turn will furnish their comments within two weeks. After receipt of comments of Mo Shipping the proposal will be processed on file for a final decision. 3A.9 Setting up of CFS at Methwada village, Deepalpur Taluk, Indore distt., Madhyapradesh by Continental Warehousing Corporation (Nhava Seva) Ltd., Chennai (F.No.16/25/2010-Infra-1) (Additional Agenda) The proposal was deferred.

3B

DEFERRED CASES

3B.1 Setting up an ICD at Hazira, Surat (Gujarat) by KRIBHCO Infrastructure Ltd., Noida (F.No.16/5/2010-Infra-1) CBEC has recommended the proposal. The proposal was ‘in principle’ agreed to.

It was decided that the proposal will be processed on file for final decision after receipt of requisite land documents and comments of Kandla Port Trust and Railway Board.

3B.2 Setting up of CFS at Kochi, Kerala by Central Warehousing Corporation, New Delhi (F.No.16/9/2010-Infra-1) The proposal was approved ‘in principle’ subject to receipt of requisite land documents from the company. After receipt of requisite land documents, the proposal will be processed on file for a final decision.

3B.3 Setting up a CFS in Haldia, Kolkata by Ralson Petro Chemicals Ltd., Calcutta (F.No.16/13/2010-Infra-1)

The proposal was approved ‘in principle’. Representative of Ministry of Shipping was requested to furnish their comments within two weeks. The proposal will be processed on file after receipt of comments of Ministry of Shipping for grant of LOI. 3B.4 Setting up of CFS at Edayanchavadi village – Port of Chennai by Caravel Logistics Pvt. Ltd. (F.No.16/14/2010-Infra-1) The proposal was approved ‘in principle’ subject to submission of CLU certificate for non-agriculture use of land by the company. 3B.5 Setting up of ICD at Samalkha, Panipat by India Infrastructure & Logistics Pvt. Ltd., New Delhi (IILPL) (F.No.16/25/2008-Infra-1) The proposal was approved ‘in principle’ subject to the condition that road would be outside the notified area of ICD and the High Tension Electric Lines would be lifted to 29 metre height before commencement of operations and adoption of all other safety measures as required. As regards Railway siding in the proposed facility, company will complete all formalities / conditions as laid down by Ministry of Railways.

3C

EXTENSION OF LOI :

3C.1 Setting up of ICD at Ballabhgarh (Haryana) by CONCOR – Upgradation of existing rail-linked Container Terminal – Extension of LOI from 30.6.10 to

28.9.10 (Ex-post facto approval for 3 months extension) (F.No.16/16/2007-Infra-1) The proposal was approved. Since the ICD has been notified under section 8 of Customs Act, 1962 on 28.9.10, the extension of validity of LOI is granted upto 28.9.10. 3C.2 Setting up of ICD at Mandavariya (Kishangarh), Rajasthan by Inland Conware Pvt. Ltd., Gurgaon (F.No.16/38/2006-Infra-1) – Extension of LOI from 1.8.2010 to 31.1.2011 for a period of six months.


3C.3 Setting up of ICD at Wardha, Maharashtra by Worlds Window Wardha Infrastructure Pvt. Ltd., New Delhi – Extension of LOI from 30.6.2010 to 30.12.10 (F.No.16/5/2008-Infra-1)


3C.4 Setting up of ICD / Rail linked ICD at Hyderabad by All Cargo Global Logistics Limited, Mumbai (F.No.16/34/2007-Infra-1) – Extension of LOI for one year from 2.9.10 to 2.9.11.

The proposal was approved. 3C.5 Setting up Rail / Road Linked ICD at Growth Centre Bawal (Haryana) by Sanjvik Terminals Pvt. Ltd. (F.No.16/21/2008-Infra-1) – Extension of LOI for one year.

The proposal was approved. 3C.6 Setting up of CFS at Majerhat (CTKR), Khidderpur, Kolkata by CONCOR (F.No.16/10/2009-Infra-1) – Extension of LOI from 31.10.10 to 30.4.11


3C.7 Setting up of CFS at Tuticorin, Tamil Nadu by Sical Distriparks Ltd., Chennai (F.No.16/27/2007-Infra-1) – Extension of LOI for 4 months from 31.10.10 to 28.2.11 The proposal was approved. 3C.8 Setting up of CFS at Pipavav (Gujarat) by M/s Ameya CFS (P) Ltd. Mumbai – (File No.16/15/2007-Infra 1) - Extension of LOI w.e.f 4.9.2010 to 4.9.2011 (Additional Agenda)

The proposal was approved. N.B. : Proposals from 3C5 to 3C8 were approved when the Chairman was not present. 3D

CHANGE IN NAME OF THE COMPANY AFTER AMALGAMATION

D.1 Proposal of Continental Container Freight Stations Pvt. Ltd., Chennai for carrying on the business in the name of Indev Logistics Private Limited after permission of Madras High Court (F.No.16/19/2010-Infra-1)(Part-1)


4. REVIEW OF LOIs ISSUED

:

4.1 It was decided to review all cases where LOI was granted but requisite customs notification has not been issued. A list of all such cases is annexed (Annexure-1). 4.2 Port authorities and Customs authorities will also review functioning of CFSs and ICDs for having minimum equipments / facilities as per LOI granted. If not, notices will be issued by them to the operators of concerned CFSs / ICDs. However, a final view in this regard would be taken in IMC meeting only. List of such ICDs/CFSs is annexed (Annexure-2). Meeting ended with thanks to the Chair.
