MINUTES Thornbury Township Board of Supervisors Meeting Wednesday, September 2, 2015

The Thornbury Township Board of Supervisors held a Public Meeting on Wednesday, September 2, 2015, at the Township Administration Building, 6 Township Drive, Cheyney PA.

Chairman Raith called the meeting to order at 7:00 p.m. with a salute to the flag.

PRESENT: James H. Raith, Chairman James P. Kelly, Vice Chairman Sheri L. Perkins, Supervisor Jeffrey Seagraves, Township Manager

Attendees: 10 Chairman Raith announced that that the Board previously held a brief Executive Session this evening regarding legal and personnel matters. APPROVAL OF CHECK REGISTERS On a motion by James Kelly, seconded by Sheri Perkins, and carried unanimously, the General Fund check register in the amount of $39,110.39, for the period August 20, through September 2, 2015, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly, and carried unanimously, the Sewer Fund check register in the amount of $12,692.69, for the period August 20, through September 2, 2015, was approved. Chairman Raith called for public comment. There was no public comment. APPROVAL OF MINUTES

On a motion by James Kelly, seconded by Sheri Perkins and carried unanimously, the Wednesday, August 19, 2015 Zoning Ordinance Hearing minutes as presented. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly and carried unanimously, the Wednesday, August 19, 2015 Floodplain Ordinance Hearing minutes as presented. Chairman Raith called for public comment. There was no public comment. On a motion by James Kelly, seconded by Sheri Perkins and carried unanimously, the Wednesday, August 19, 2015 Public Meeting minutes were approved as presented. Chairman Raith called for public comment. There was no public comment.

BOARDS AND COMMISSSIONS

PARKS & RECREATION Joe Burke reported they met on August 25th and spent the bulk of the meeting planning for the Fall Festival to be held Sunday, October 25th.

HISTORICAL COMMISSION

Ric Miller stated that he had nothing additional to report. Chairman Raith asked to move forward on the Springhouse renovations by approving Francis Hawes’ proposal. On a motion by James Kelly, seconded by Sheri Perkins and carried unanimously, the proposal from Francis Hawes to renovate the Springhouse at the Thornbury Park Field at a cost of $7203.00, was approved. Chairman Raith called for public comment. There was no public comment.

PLANNING COMMISSION

Jim Quinn was not present. Vice Chairman Kelly reported that they continue to work very hard.

SEWER COMMITTEE Ted Jacquet reported that summer is over and he had nothing to report. Chairman Raith asked Ted to contact him by email and they will get together.

ENVIRONMENTAL ADVISORY COUNCIL Rich White was not present.

LIBRARY BOARD Jean Mackenzie was not present but her report was submitted. Jeff Seagraves mentioned their 35th Anniversary held on August 29th was a success and they were grateful for our support.

AGENDA ITEMS On a motion by Sheri Perkins, seconded by James Kelly and carried unanimously, the purchase of trout from Crystal Springs Trout Hatchery at a cost not to exceed $2,000.00, was approved. Chairman Raith called for public comment. There was no public comment.

On a motion by James Kelly, seconded by Sheri Perkins and carried unanimously, waiving the Historic Resource Impact Study on HRP# 186, at 430 Thornton Road, as per the conditions recommended in the Historical Commission letter, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly and carried unanimously, Change Order No. 2 (and closeout), for the Fox Lair/ Highpoint Sewer Contract, at a cost of $39,216.70, bringing the total contract cost to $189,419.70, was approved. Chairman Raith called for public comment. Jeff Seagraves mentioned that the final payment will be processed assuming we receive the As-Built Plans on the project. On a motion by James Kelly, seconded by Sheri Perkins and carried unanimously, the extension granted on the "LAWLOR" Subdivision, extending the present action date from October 1st, to December 30th, 2015, was approved. Chairman Raith called for public comment. There was no public comment. On a motion by Sheri Perkins, seconded by James Kelly and carried unanimously, the extension granted on the "BEARD" Subdivision, extending the present action date from October 6th, 2015, to January 4th, 2016, was approved. Chairman Raith called for public comment. There was no public comment.

PUBLIC COMMENT

Ted Jacquet congratulated Ric Miller on recently receiving the Lewis Smith Award from the Delaware County Historical Society, for outstanding contributions to the history of the Township and the County. Chairman Raith congratulated Ric.

STAFF REPORTS

TOWNSHIP MANAGER'S REPORT- Jeff Seagraves

The Township Manager’s Report was submitted and is attached. Jeff reported on the August movie in the park, receiving notification from Sunoco Logistics pertaining to pipeline maintenance, presently working on the budget, grinder pump

maintenance, ending summer hours this week and resuming regular hours September 8th, awaiting Pennoni’s evaluation on pump station equipment, and PennDot will be starting this evening on repaving Creek Road. He then thanked Lindsey for a great job. There was no comment on the Manager’s report. Sheri Perkins and Vice Chairman Kelly thanked Lindsey.

TOWNSHIP ROADMASTER’S REPORT – Lindsey Price The Roadmaster’s report was submitted and is attached. Lindsey also mentioned the Creek Road work will commence from 7 PM to 4 AM for the duration of the project. There was no comment on the Roadmaster’s report.

TOWNSHIP SOLICITOR’S REPORT – Kenneth Kynett, Esq. The Township Solicitor’s Report was submitted and is attached. Ken reported working on the abandoned properties in the township. There was no comment on the Solicitor’s report.

TOWNSHIP ENGINEER’S REPORT – Mike Ciocco, PE The Township Engineer’s Report was submitted and is attached. Mike reported the Road Program has been completed and he expects close-out soon. There was no comment on the Engineer’s report. Chairman Raith asked Lindsey to make a final inspection. There was no comment on the Engineer’s report.

TOWNSHIP SEWER ENGINEER’S REPORT – Charles Faulkner, PE The Township Sewer Engineer’s Report was submitted and is attached. Chuck reported on the NPDES Permit for the Wastewater Treatment plant and additional testing has been requested by the DEP. He mentioned that Delcora will be collecting samples for the next three weeks. There was no comment on the Sewer Engineer’s report.

MANAGER’S REPORT

9-2-15

1. We held our August Movie in the park on Friday 8-28-15. The evening started with Makin Music playing children’s tunes and a sing-a-long.

2. We received notification from Sunoco Logistics that they were going to postpone the line cleaning scheduled for Friday 8-29-15. They are working on some coordination of the line clearing and told us they would let us know the new timeline. I notified the affected residents of the postponement.

3. I would like to recommend the Board of Supervisors approve the purchase of trout from Crystal Springs Trout Hatchery for a cost not to exceed $2,000.00.

4. We have sent out letters to all of the Boards and Commissions regarding budget requests. We have a budget meeting scheduled with Peter Barzs.

5. We have a grinder pump that needs to be evaluated at Creek Road East. I received a quote from Farris Enterprises for the evaluation and also from JWC Environmental on the replacement of the pump. I approved the evaluation at $700.00 and am waiting to see if it needs to be rebuilt. The cost of the rebuild is $9195.00.

6. The Historical Commission has reviewed a submission for 430 Thornton Road for an accessory building. I believe they will recommend waiving the Historical impact study so that will be an agenda item pending the HC recommendation.

7. We will be ending Summer Hours this week and will resume regular work schedule 8:30 am to 4:30pm on Tuesday September 8, 2015.

8. Pennoni Associates is working on an evaluation of equipment at all of the Pump stations as well as the treatment plant to develop a working Capital plan for the sewer system.

THORNBURY TOWNSHIP Public Works Department Report – Week Ending August 28, 2015

1. Routine maintenance performed throughout the Township, including mowing of Parks.

2. Met with electrician regarding installing electric at 90 Station Road. Electrician requested removal of certain trees in order to install pole line. Knight Brothers will remove and chip trees – see attached. PECO is clearing power lines down the driveway to the last transformer at 90 Station in preparation for installing electric service.

3. In the process of replacing missing street signs throughout the Township. 4. Chester Water Authority discovered excess water usage at Thornbury Park.

Representative investigated and discovered there was a leak at the frost free hose bib located at the Pavilion causing underground water leakage. Parts have been ordered to repair the cause of the leak. Once repaired, Township will receive an adjusted water bill from Chester Water Authority.

5. Road program is complete.

6. Stormwater inlet program should be complete by end of week.

7. Clean up project at Sewage Treatment Plant is complete. Two items remain: Ford Utility Body Truck and a small roller. Will speak to Township Solicitor to determine best way to dispose of the items.

8. Clearing of trees and brush at Martin Park remains ongoing in preparation of Fishing Derby and Scouts.

9. Met with Eagle Scout Rudy Rachuti and representative of Park and Rec Board regarding his proposed project. Eagle Scout is proposing to install exercise stations at Thornbury Park. Will keep Board informed.

REPORT OF THE ENGINEER September Regular Meeting September 2, 2015

Work completed for the period:

Grading and Road Encroachment Permits – Reviewed several plans for grading and road encroachment. Continuing construction inspections of various properties.

Planning Commission – Continued working with members on Pipeline Ordinance.

Subdivision Plans: Wills - No further submission has been received. Lawler Subdivision - Awaiting revised plans. Crane Property – Issued review letter on revised plan submission and awaiting response. Phillips – Lot Line Change – Natalie Road Subdivision Plan received and under review.

Sweetwater Road Tract – Amending existing 3 lot subdivision plan to remove pond, received and under review.

Floodplain Ordinance – Ordinance adopted on August 19th, DCED notified, and information for forwarding to FEMA/DCED for final acceptance forwarded to the subdivision coordinator for final processing.

Andover – Concrete restoration sample location has been reviewed and recommended for approval on curbs only with an extended maintenance bond period for those areas. Storm sewer video inspection has been reviewed and requires numerous repairs prior to acceptance. Public Improvement repair work (curb, sidewalk, and roadway) has begun in an effort to prepare for the roadway dedication process.

Romill Associates – Parking lot base, curbing and storm sewer is completed. Working on finishing up remainder of site work.

Mill Creek – Awaiting work to continue. Reviewed site for deficiencies and preparing list.

Greenbriar V – Dallet Tract – New punch list was issued and recommendation on escrow reduction was forwarded for consideration. Repair work has just begun and developer projects completion by end of September.

Road Program 2015 – Road work begun and is expected for completion the week of August 31.

Snow & Ice Contract – Executed contracts received from Knight Brothers, reviewed by Solicitor and forwarded to the Township for execution.

3 Keswick Drive – Drainage improvement work on Keswick and Slitting Mill Road has been certified by the engineer of record. Final inspection during a rain event will be performed prior to recommendation of permit closeout.

90 Station Road – Sketch plan for roadway drainage improvements is with Roadmaster.

Barrett’s Meadow – Sent updated list with concerns to PA DOT along with a status update request.

Sunoco Logistics – Attended informational meeting with Sunoco. New 16” and 20” pipelines for liquid propane, ethane and butane are proposed through open space of Andover and behind Duffers and along their existing pipeline in that area. New valving proposed at existing valve site behind duffers. In discussions with Sunoco officials and engineers, they stated that no odor or sound would be associated with the proposed improvements in Thornbury. No new pump stations proposed within Delaware County. NPDES MS-4 - Goose Creek Basin TMDL Plan – Advertised for 30 day public comment on August 26, 2015. Plan required to be submitted by December 31, 2015. Required compliance within 15 years of permit, currently yields year 2028 to meet reduced phosphorous rates. Malvern School – Met with PA DEP, Contractor and Owner regarding unauthorized fill in a floodplain related to their lower parking area. Owner is working out removal of fill with PA DEP and will have any new work permitted with PA DEP and the Township.
