This taskaims to facilitate theMemberStates the identificationof the legalprovisions suchasUnitedNationsand IMOConventionsandResolutions,andEuropeanGuidelinesandStandardsthatcouldbeappliedinscenarioswhereaccidentsmayoccur.

ArapidandeasyqueryoftheseStandardscouldinitiallyhelptoguidethecourseofactionoftheStateMemberinordertodemandaccountabilitytotheship-ownersandthecrewortheloader,asapplicable,forthepossiblelossoflives,thedamagetheaccidentmaycausetothehealthofpeopleonboardandcoastalpopulation,thedamageitmaycausetotheterritorialseaandtheexclusive economic zone of the Member State, and the possible pollution of the marine,terrestrialoratmosphericenvironment.

Basedon theprevious, this task isorientated to identify the tools that International StandardsoffertotheStateMember,whichcomplementthose(tobe)includedinTask4.4.4.“Proceduresaftertheaccident”,inordertohelpidentifyinganddelimitingtheliabilityofthecasualty.

Thisdocumentcontainsgeneral informationabouttheobligationsconcerningthecrewandthestate of the vessel, giving in some occasion illustrative examples of casualties in which theseobligationswerenotfulfilledwithheavilynegativeconsequences.

In addition, lists of the relevant directives, standards, regulations, conventions, etcetera, havebeenincludedregardingdifferentaspectsofthem,suchasinspectionandsurvey,typeofvessel,marineequipment,obligationsoftheparties,pollutionandothers.

Finally, an Annex is attached to this report, where the main Conventions and Agreementscontainedinthiscompilationaredevelopedintermsofwhatiscontemplatedinthesepages.

1. OBLIGATIONS OF THE CREW. 1.1. OBLIGATIONS INCLUDED IN SOLAS AND MARPOL

CONVENTIONS

Inthissection,thefulfilmentoftheobligationsthattheSOLASConvention,ChapterIIIpartB,rule19requiresthecrewwillbeanalysed.

Regardless the following paragraphs, the checking of the existence of training manuals andauxiliarymeansfortheonboardtraining(accordingtoRule35)wouldbeobligatory,aswellastheexistenceofinstructionsfortheonboardmaintenanceofrescuedevices(Rules36and37).

1.1.1. Regarding training, periodical exercises for emergency and maintenance of lifesaving devices.

• Training Itisnecessarytocheckthateachmemberofthecrewtowhomanydutiesincaseofemergencyhasbeenassignedisfamiliarwiththembeforestartingthetrip.

Training will be given to all new employees on board as soon as possible, nomore than twoweeks after joining the ship, on the use of lifesaving appliances, included the equipment ofsurvivalvesselsand fireextinguishingdevices.However, if thecrewmember isassigned to thevessel according to a regular shifts program, hewill receive training nomore than twoweeksafterthedateofthefirstincorporationintheship.Instructionsfortheuseoffire-fightingdevicesanddevicesforsalvageofthevesselandforsurvivalintheseawillbeatthesameintervalsthatthe exercises. The instruction can be given separately on different parts of rescuing andextinctionoffiredevices,buttrainersmustencompassallwithinaperiodoftwomonths.

Itshallbeverifiedthatallcrewmembershavebeeninstructed,atleaston:

§ Thehandlingandtheuseoftheinflatablesurvivalcraftsoftheship;

§ The problems caused by hypothermia, first aid indicated in case of hypothermia, andothercaseswhereitisappropriatetogivefirstaid;

§ Theuseofthelife-savingappliancestheshipcarriesincaseofbadweatherandbadsea;

§ Thehandlinganduseoffireextinguishingdevices.

Atregularintervals,notexceedingfourmonths,trainingshallbeprovidedontheuseoflifeboatdavit rafts on board of any ship equipped with such devices. Whenever possible, this wouldincludetheinflationandlaunchingofalifeboat.Thismaybeaspecialsurvivalcraftintendedonly

toprovidetrainingandnottobepartoftheequipmentofsalvageofthevessel;insuchcasethisshouldbeclearlymarked.

• Exercises ü Checkingtheexistenceofalistofobligationsonboard.

ü Checking that all crewmembershave takenpart in exercisesof abandonmentof the shipandfireemergencieseachmonth,accordingtoA.690(17)Resolution-Periodicalinspectionofabandonshipandfiredrillsonpassengerships.

o Regarding the abandon of the ship drill

Checkingthatpassengersandcrewhavebeeninstructedontheproperapparel;thecorrectplacementofthelifejacketandthatpassengersunderstandthecalltothemeetingpoints.

Checkingthatthecrewhaveparticipated inat leastoneabandonoftheshipdrillandonefire drill per month; at least once loosened one of the lifeboats after the necessarypreparationforsettingitafloat;madethelifeboatenginework;activatedthedavitsusedtoset the lifeboats afloat; carried out the training exercises for search and rescue of thepassengerstrappedintheircabins,andifnecessary,giveninstructionsabouttheutilizationoftheradiolife-savingappliances.

Although when it comes to elaborate this report, the causes of the loss of lives at theaccidentoftheSouthKoreanvesselSeawolareunknown,itisindeedknownthatpassengersdidnottakethe lifeboatsanddidnotattendthemeetingpoints. Inanaccident likethis, itwouldbenecessarytochecktheprotocolspreviouslymentioned.

Checkingthateachofthelifeboatshasbeenputafloatandmaneuveredinthewaterbythecrew assigned for handling at least once every three months during an abandon shipexercise.

Checking that all lifeboats, at least once every threemonths, havebeen loosened, and atleastonceperyearlaunchedandmaneuveredinthewater.

Checking the emergency lighting at the meeting points of the passengers and theabandonmentoftheshiponeachabandonshipexercise.

o On fire-fighting exercises

Itshallbeverifiedthatfire-fightingexercisesareplannedconsideringthestandardpracticesfordifferentemergencycasesthatmaytakeplacedependingonthetypeofshipandcargo.

Checkingthatthefollowingactionsineachpracticeoffirefightinghavebeenconsidered:

§ Go to the positions and get ready for the tasks required to eachmember of thecrew.

§ Startafirepumpusingatleastthetwojetsofwaterrequired,inordertoverifythatthesystemworksproperly;

§ Checkingthefireman'sequipmentandotherindividualrescueequipment;

§ Checkingtherelevantcommunicationsequipment;

§ Checkingtheoperationofthewatertightdoors,firedoors,fireprotectionbutterflyvalvesandtheinletandoutletkeyholesoftheventilationsystems;

§ Checkingthenecessaryprovisionsforthesubsequentabandonmentoftheship.

Equipmentused in theexercises shall immediatelybeback in conditionsofoperationandanyfaultsordefectsdiscoveredduringtheperiodshallbesolvedassoonaspossible.

• Cargo ItshallbecheckedwhetherithascompliedwiththeprovisionsoftheSOLASConvention.ChapterVI, part A; rules 2 and 5. In case of dangerous goods, application standards are arranged inChapterVII of the SOLASConventionpartA fordangerous goods inpackages andpartA-1 forsoliddangerousgoodsinbulk.

Check if theshipperprovidedappropriate informationabout the loadso thatyoucan take thenecessaryprecautionsforitsproperstowageandtransportwithoutrisk.

Checking if the shipper provided appropriate information about the load so the relevantprecautionsforitsproperstowageandriskfreetransportcanbetakenwouldbenecessary.

It must be checked if loading units and transport units carried on deck or under deck werestowedandfastenedinaccordancewiththeResolutionA.714(17)amended.

Itwillbeverifiedthattheloading,unloadingandstowageofbulkcargoeshavefollowedthecodeofsafepracticeinaccordancewiththeResolutionA.862(20),amendedbyMSC238(82).

Checking would be necessary, in case of transport of grain, that the provisions of theInternational Code for the Transport of Grain have been followed and that the ship has theauthorizationdocumentrequiredbythecode.

• Annotations Theentries in the logbookabout thedetailsof theexercisesofabandonmentof the shipandfight against fires, theexerciseswithotherdevices for rescuing and trainingonboard shall bechecked.Ifattheprearrangedtimeitisnotperformedinitsentiretyameeting,anexerciseora

trainingsession,thisshallberecorded intheship’s log, indicatingthecircumstancesthatcametogetherandthescopeofthemeeting,theexerciseorthetrainingsessionthattookplace.

1.1.2. With respect to the maintenance and inspection of the life-saving appliances. SOLAS Part B, Rule 20.

It shall be checked that instructions for on-boardmaintenancehave come from the life-savingappliancesreferredtorule36ofthisSOLASchapterandpeacekeepingoperationswillbecarriedout in accordancewith them. Yet the log bookwill be analyzed to verify that the inspectionslistedbelowhavebeenregisteredinthementionedship´slogbook.

Ingeneraltheexistenceoftechnicalmanualsofoperationsandmaintenanceonboardmustbechecked.

• Maintenance of strips Itshallbeverifiedthatthestripsusedinlaunchingdeviceshavebeeninspectedregularly,payingparticularattentiontotheareaswhichpassthroughpulleys,andthattheyhavebeenrenewedwhenithasbeennecessaryduetoitsdeteriorationoratintervalsnotexceedingfiveyears,ifthisperiod is shorter. The existence of spare parts and repairing equipment for the life-savingappliancesandcomponentsofthesesubjecttointensivewearordeteriorationshallbecheckedandhavetobereplacedperiodically.

• Weekly inspection It shall be verified that eachweek the tests and following inspections are carried out and thereportontheinspectionshallbeincludedinthelogbook:

Allsurvivalcrafts,rescueboatsandlaunchingdeviceshavebeensubjectedtoavisualinspectioninordertoverifythattheyarereadytobeused.ThisinspectionwillanalyzetheStateofhooks,attachment to the lifeboats and the release with charging mechanism being properly andcompletelytight;

Thateachengineofthelifeboatsandrescueboatshavebeenputonduringatotalperiodofatleast threeminutes (or the timeprescribedby themanualof themanufacturer),providedthatthe temperature is above the required minimum temperature for starting the engine. At thesametimethetransmissionandthegeartrainengaginghavetobechecked.

Lifeboats, except free-fall ones, of cargo shipswill bemovedaway from the stowageposition,with no one aboard, as far as necessary to demonstrate the satisfactory operation of thelaunchingdevices,whenevertheweatherconditionsandtheseastateallowthis;andthegeneralemergencyalarmsystemshallbetested.

• Monthly inspections

§ That all lifeboats, except free-fall ones, have been moved away from the stowagepositions,withnooneaboard,attheexpensetotheweatherandtheseaconditions.

§ That every month an inspection of the life-saving appliances has been carried out,includinglifeguardsandboatsequipmentinordertoverifythattheyarecompleteandingoodcondition.Thereportofinspectionshallbeincludedinthelogbook.

• Other inspections Itshallbecheckedthattheservicemaintenanceofinflatablesurvivalcrafts,inflatablelifejacketsandmarine evacuation systems, andmaintenance and repair of the inflated rescue boats hasbeenperformed

Themaritime Safety Committee considered at its eighty-third session period (3 to 12October2007)arecommendationabouttheneedpointingouttoallstakeholders,theimportanceofthecrews of the vessels having access to technical manuals of operations and maintenance ofonboardupdated,accurateandeasytouse,inparticularregardingmaritimeequipmentessentialforsafety.

Inaddition,theCommitteetooknoteoftherecommendationNo.71oftheIACS(inSeptember2000), entitled Guide for the Development of Shipboard Technical Manuals (Guide for thepreparationoftechnicalmanualsonboard),andagreedthatthisguideisausefulreferenceforthepeopleresponsiblefordrawingupsuchmanuals.

It is recommended that the technical manuals of operations and maintenance on board areavailable in the working language of the ship and, if this language is not Spanish, French orEnglish, itshould includeatranslation intooneofthese languages;andtoencouragedesignersandbuildersofshipsprovidediagramsanddrawings inwhichthefunctioningofthe integratedsystemsofvesselsareexplained,aswellastheoperationofsuchsystemsincaseofemergency,taking into account that it is possible that the ships systems are composed of differentequipment, and to point out the above to the attention of ship-owners, captains, shipyards,recognizedorganizationsand,inparticular,maritimesafety-criticalequipmentmanufacturers.

1.1.3. Synthesis obligations under the SOLAS Convention The reality of the vessel must correspond with the conformity of materials, equipment,installations andmachinery covering the certificates issued by the Administration. Indeed, theissuanceofa certificatecorresponds to the locationof theshipat the time it isextended.Theconsistenceof the conditionof the shipwith theactual validityof these certificates shouldbesupervisedbythecrew.

The ship and its equipment condition beingmaintained so as to conform to the provisions oftheserulesmustbechecked,inordertoensurethattheshipremains,ineverysense,abletoseawithoutdangerforitselforforthepeopleonboard

Itshallbeverifiedthatasthesurveysoftheshippursuanttorules7,8,9or101takeplace,nochanges in the structural layout, machines, equipment and other components that were thesubjectofsurvey,withoutpriorauthorizationofthemanagement2,havebeencarriedout.

It shallbe checked if the stowageof the loadwasadequateandwhether the consignor, inhiscase,gavetheinformationnecessaryforitsproperstowageandtransportwithoutrisk.

There should be emergency planning on board in case of contamination by hydrocarbons andharmfulsubstancesliquids.

TheindustrystandardthatshallbeappliedtoavesselinemergencyincludesthecompliancewiththerelevantprovisionsoftheInternationalConventionofSafetyofLifeAtSea(SOLAS)andtheEmergencyPlanaboardtheMARPOLConvention forcasesofcontaminationbyoilandnoxiousliquid substances. These plans must be used by the staff in land of the owner and must beunderstoodbythecaptainandcrewofthevesselthroughpracticesandtrainingaimedtoverifythefunctionalityoftheplan.

For example, in the oral hearing of the Prestige case the following defaults to the pollutionemergencyPlanbyhydrocarbonsweredemonstrated:

Communicationsdidnotcomplywiththemethodofreportorthescopeoftheinformation.ThePrestigecommunicationswiththeSpanishauthoritieswereunsatisfactory:

o The type of load/condition of the ship - probing/transfer capacity was not reported in anappropriateoraccurateway.

o The stability of the vessel or the non-damaged side tanks ballast was not reported in anappropriateoraccurateway.

o Thestateofthespacesfor loadandballast(tankbytank)andstateofthefueltankswerenotdefined.

Whenever the ship suffers an accident or that a defect is discovered and one or the other affect its safety or efficiency or integrity of its salvage or other equipment devices, the master or the owner of the ship must inform as soon as possible the Administration, the Inspector appointed or the organization recognized responsible for issuing the relevant certificate, who will make that the research aimed to determine following actions begin.

o The status of the main machine and auxiliary machinery, including steam boilers in themachinerydeckwerenotidentified.Thenon-workingoftheemergencytowingandthelackofthrowingdeviceswerenotreported.

o Neitheracompletedescriptionnortheconditionofthecrewwasprovided.

o Noadvicetotheauthoritiesoncontractsforresponse/supportwasprovided.

o NoloadspecificationswerecommunicatedtohelpcontainpollutionbycoastalStateplan.

In addition, the Captain did not gather his response team for the ShipOil Pollution EmergencyPlan(SOPEP)andoptedtoevacuateit.Thisdeprivedtheshipofthestaffnecessaryonboardtorespondappropriatelytothepollutionincidentandtocollaboratewithimmediaterescueefforts,leavingtheshipapproachingdangerouslytothecoast.

These actions or omissions by the shipowner settled Spain, the coastal State, at a cleardisadvantageousplaceregardingtheinformationrelatingtotheStateandtheshipcondition.

Thecommunicationsandactions takenat thebeginningof thePrestige incident, showthat theshipownerdidnot follow theguidelinesof the ShipOil PollutionEmergencyPlan (SOPEP).Asaresult, Spain, as the coastal State affected, faced a severely compromised vessel and withoutmeanstohaveaccesstocriticalinformationandcontrolofthesituation.

1.1.4. Obligations under MARPOL synthesis. Regulation6.4.3oftheAnnexI:RegulationsforthePreventionofPollutionbyOil:

“WheneveranaccidentoccurstoashiporadefectisdiscoveredwhichsubstantiallyaffectstheintegrityoftheshiportheefficiencyorcompletenessofitsequipmentcoveredbythisAnnexthemaster or owner of the ship shall report at the earliest opportunity to the Administration, therecognized organization or the nominated surveyor responsible for issuing the relevantCertificate, who shall cause investigations to be initiated to determine whether a survey asrequiredbyparagraph1ofthisregulationisnecessary.IftheshipisinaportofanotherParty,themasterorownershallalsoreportimmediatelytotheappropriateauthoritiesoftheportStateandthe nominated surveyor or recognized organization shall ascertain that such report has beenmade.”

1.2. OBLIGATIONS CONTAINED IN THE AGREEMENT OF TRAINING AND WATCHKEEPING (STCW AGREEMENT)

Verifythatthefollowingfunctionsarecarriedoutbythestaffonboard:

• The officer in charge of the deck watch shall:

o makeroundstoinspecttheshipatappropriateintervals;

o payparticularattentionto:

§ the condition and securing of the gangway, anchor chain and moorings,especially at the turn of the tide and in berths with a large rise and fall, ifnecessary,takingmeasurestoensurethattheyareinnormalworkingcondition;

§ the draught, under-keel clearance and the general state of the ship, to avoiddangerouslistingortrimduringcargohandlingorballasting,

§ theweatherandtheseastate

§ theobservanceofallregulationsconcerningsafetyandfireprotection;thelevelofwaterinthebilgesandtanks,

§ thewaterlevelinbilgesandtanks;

§ all personsonboardand their location, especially those in remoteorenclosedspaces;and

§ theexhibitionandsounding,whereappropriate,oflightsandsignals;

o inbadweather,oronreceivingastormwarning,takethenecessarymeasurestoprotecttheship,personsonboardandcargo;

o takeeveryprecautiontopreventpollutionoftheenvironmentbytheship;

o inanemergencythreateningthesafetyoftheship,raisethealarm, informthemaster,takeallpossiblemeasurestopreventanydamagetotheship, itscargoandpersonsonboard, and, if necessary, request assistance from the shore authorities or neighboringships;

Itmustbecheckedthatsurveysofrescuedevicesandotherequipmentofcargoshipshavebeencarriedout.

Itwillbeverifiedthatradiofacilitiesandradarsurveyshavebeenconductedoncargoships.

Itmustbecheckedthattheinspectionofthehull,machinesandtheequipmentforcargoshipshavebeencarriedout.

Itwillbeverifiedthat thepropermaintenanceof thestateof theshipafter the inspectionhastakenplaceinaway:

o Tobesurethattheconditionoftheshipandhisteamensurethattheshipremains, ineverysense,unabletoseawithoutdangerforitselforforpeoplewhomaybeonboard.

o Tobesurethatnochangeinthestructuralarrangement,machines,equipmentandothercomponents that were the subject of survey, without prior authorization from theAdministrationismade.

Itmustbecheckedthat,iftheshiphassufferedapreviousaccidentoriffromthisaccidentitisdeductedthatthecaptainknewanydefectsthatcouldaffecttheirsafety,efficiencyorintegrityof its salvage or other equipment devices, the master or the owner of the ship reports toAdministration(inspectororrecognizedorganization).

7. IMO CONVENTIONS

In1945,representativesof50countriesmetinSanFranciscoattheUnitedNationsConferenceon International Organization to draw up the United Nations Charter and the United Nationsofficiallycameintoexistenceon24October1945.ThefoundersoftheUnitedNationsenvisagedit as comprising not just one but a series of international organizations, each dealing with adifferent subject, some humanitarian, some technical. As a result, a number of specializedagencies were established and agencies which already existed were brought within theframework of the United Nations. In 1944 the International Civil Aviation Organization wasfounded. The Food and Agriculture Organization (FAO) and the United Nations Educational,Scientific and Cultural Organization (UNESCO) were created in 1945, followed by the WorldHealthOrganization(WHO)in1947.

A conference in Geneva was convened in 1948 to consider the establishment of a newOrganization to deal with international shipping, especially shipping safety. The conferenceended with the adoption of the Convention for the Establishment of an Inter-GovernmentalMaritimeConsultativeOrganization.
