Exemption approvedExemption applies to:This exemption applies to persons conducting a business or undertaking: (a) with the management or control of plant, (b) that manufacture plant, (c) that import plant (d) that supply plant, and (e) that commission plant,as referred to in the Parts.

Regulations to which the Exemption applies:This exemption applies to:Those persons identified above are exempt from the requirements of Parts 5.2 and 5.3 of the Regulation that require: (a) design registration of plant; or (b) item registration of plantto the extent specified, and subject to the conditions, in the Schedule to this Exemption.

Relevant DefinitionsFor the purposes of this Exemption:Parts means Parts 5.2 and 5.3 of the Regulation,Regulation means the Work Health and Safety (National Uniform Legislation) Regulation 2011

Conditions of the Exemption:This Exemption is subject to the following conditions: (a) A person is only exempted from the requirement

to have design registration for plant the design of which is required to be registered under Part 5.3 if it has current design registration for the plant under one of the Regulations listed below and the registration holder is not located in the NT WHS jurisdiction, and

(b) A person is only exempted from the requirement to have item registration for mobile plant, which is required to be registered under Part 5.3 if it has current item registration for the plant under one of the Regulations listed below and the registration holder is not located in the NT WHS jurisdiction:

list of applicable regulations:

(i) South Australia: The Occupational Health, Safety and Welfare Regulations 2010

(ii) Tasmania: The Workplace Health and Safety Regulations 1998

(iii) Victoria: The Occupational Health and Safety Regulations 2007

(iv) West Australia: The Occupational Safety and Health Regulations 1996.

(c) Nothing in this Exemption affects any other applicable requirement imposed by law in relation to the matters relating to this Exemption.

note: the intent of this exemption is to grant recognition to current plant registrations from jurisdictions that have yet to implement the model Whs legislation in the same manner as clauses 245 and 247 of the regulation. also this provides for design registrations from these jurisdictions to be used to item register plant in the nt.

Date and duration of exemption:

this exemption commences on the date of gazettal in the nt Government Gazette and has effect until 31 december 2017.

note:

the exemption may expire at a date earlier if there is a change in legislation or the exemption is cancelled by the Whs regulator.

Zuccoli Parade named after Guido Zuccoli who was born in Italy and migrated to Australia as a 20 year old. He worked as a Civil Engineer for Transfield Pty Ltd in Cairns before starting Steelcon Pty Ltd in 1967. Guido died in a plane crash at Tindal Airport on 6 March 1997, when his newly restored Harvard suffered an engine failure.
