1. BRIEF NOTE ON IIMB

Indian Institute of Management Bangalore is a leading research-focused business

school in Asia with around 100 full time faculty members, more than 1200 students across

various long duration programmes and nearly 5000 annual Executive Education participants.

IIMB has a strong brand identity with a logo that has great recall.

The IIMB campus was designed by celebrated architect B V Doshi. The campus is a

destination and a pilgrimage for students of architecture and practising architects, with the

architecture of the academic and administrative blocks becoming a case study. Completed in

1983, the original stone architecture is now complemented by the greenery, just as B V

Doshi had intended.

• The 54,000 sq mt IIMB complex is built on a 100-acre campus.

• The design of IIMB reflects the architect’s perfect sense of scale, proportion and light.

• From the logo that portrays the rays of the rising sun to the design of the IIMB complex, light

plays a crucial role.

• The interplay of walls and openings, light and shadows, and solids and voids change the

character of the main building during different times of the day and during different seasons.

• The high corridors are sometimes open; sometimes partly covered with skylights and

sometimes with only pergolas to heighten the spatial experience.

• The width of the corridors is modulated to allow for casual seating.

• Access to classrooms and administrative offices is provided through these corridors.

• The design offers students and faculty the ability to see and feel nature even when inside the

classroom.

• The central courtyard or the central pergola gives one the feeling of being in a place not

unknown to one’s inner being.

• The courtyards and corridors are sensitive to the Indian context of community and

environment. They are lessons in rhythm and composition. They show that the interior must

be relevant to the exterior, and that life, art and architecture can co-exist.

• The IIMB campus was envisaged as a place to be inhabited, as a place to facilitate the course

of human interaction.

• The design therefore conserves energy – human or mechanical, optimizes technologies,

adopts innovative ways of building and uses alternative materials.

• Three-storied hallways, open quadrangles with ample area for greenery, sunlight streaming in

through pergolas, geometrical roofs and a rough texture finish are the unique features of this

‘glocal’ design.

• IIMB’s design therefore symbolizes a deep understanding of the past and a comfortable

relationship with the present. The aim, said B V Doshi, was “to create an atmosphere where

you don’t see divides and doors”.

2. SALIENT FEATURES OF PROPOSED PROJECT WORKS

SALIENT FEATURES OF THE PROPOSED PROJECT AT EXISTING CAMPUS ON

BANNERAGHATTA ROAD, BENGALURU-560076

• Proposed hostel facility is a low-rise structure and the campus has strongly prevailing language of low storey buildings. It is extremely important to respond to the context. The chosen location is ideal to accommodate the same since it is in close proximity to other hostel buildings.

• Location of 450 Single Room and 75 Studio rooms has been finalized at open area west of Sports Centre.

• A total foot print of 172.0 x 46.50m is considered for the proposed block.

• The proposed block of Ground+4 Upper floor structure consists of rooms, common and attached toilets, washing area, Ground floor is planned for dining which can accommodate 300nos. along with serving counter, common pantry and discussion rooms at intervals along with related maintenance and management offices, stores for housekeeping.

• Orientation of the rooms is such that no single will overlook the other and majority of them are along north south direction to achieve maximum thermal and visual comfort thus reducing the energy load required.

• Layout is planned retaining all existing trees by creating large courts and rooms around them.

• Predominant South-West direction is made use of by creating several double height openings at various heights to act as wind tunnels within the whole development.

• Materials pallet is predominantly stone and concrete to unify the new to the prevailing material language

• 25 discussions rooms along with Multipurpose space above dining at first floor is planned.

• Each floor is planned with an average of 90 rooms.

• Floor to floor height- 2.9m

• Common toilet at each floor adhering to NBC norms.

FORM FACE CONCRETE – FORMWORK BRIEF SPECIFICATIONS

• General: - Formwork shop drawings including form layout / sections drawings for more than one placement of formwork is to be used and mockup should be produced and submitted for approval to establish that the material, logistics and procedures to meet the specified results.

• Materials

• Plywood: Approved brand of Plywood with surface treatment that provide a nearly impervious and smooth surface. Mixing different brands or surface treatments should be avoided to avert variations in color caused by different amounts of water absorption.

• Accuracy: In general, formwork for architectural use should be designed, constructed, and maintained in accordance with the recommendations of ACI 347-04 and the additional requirements outlined as follows. As placing and consolidating requirements are more demanding than for structural concrete, architectural concrete requires particular care in formwork design to minimize deflection, deformations, pillowing, offsets, and mortar leakage. Specified clearances between reinforcing steel and formwork should be maintained. The form face should be designed as a stable envelope to contain the fresh concrete. Extra walers, additional anchors, ties and bracing to satisfy the deflection requirements and to maintain alignment if the forms are externally vibrated.

• Form Joints (Prevention of Leakage):

a) A surface defect will result when the formwork experiences fluid loss. The resulting defect is characterized by a color change and an aggregate rich surface, inconsistent with the normal, dense, adjacent surfaces. There may be streaking, mottling, or a darker appearance as a result of less water available for hydration. This aggregate-rich condition penetrates the concrete mass to a considerable depth, and the discoloration may still be noticeable after additional surface treatment. Low-slump concrete less than 125 mm will reduce the tendency for fluid to escape through fine openings in the formwork. Low-slump concrete is more difficult to vibrate and consolidate and may cause entrapped air on the concrete face. When establishing the slump of the concrete, consideration should be given to the difficulty of placement, placement method, and reinforcing steel congestion. More precautions against leakage will be needed if fluidized concrete such as self-consolidating concrete (SCC) or self dynamic concrete (SDC) is used.

b) Leakage should be minimized for uniform color, texture are critical. Leakage

shall be minimized by providing lining forms with separate materials and staggering the joints using pressure sensitive compressible gaskets / tapes or sealants within form interfacing joints. Care should be taken to prevent displacement of taped joint / gaskets during concrete operations.

c) Taped joint should be inspected before casting to ensure the tape has not

moved. A mockup panel should be done to verify the effectiveness of the joints. Chamfer and rustication strips should be sealed at the edges to prevent the leakage behind the strips.

• Formwork accessories

a) Ties Stripping and finishing requirements may dictate the system of form ties. Recommended form ties should leave no corrosive metal closer than 38 mm to the finished surface. Snap-ties are available in a variety of sizes and strengths with cones. Snap-ties with washers are usually not acceptable for architectural concrete. Care should be taken when snap ties with cones are used to ensure that the cone is maintained tight to the contact form face under placing pressures. Ties can be removed early (generally within 24 hours), provided a form release agent was used on the embedded section of the ties and they are removed in a torsional motion. Spacing of ties will normally be dictated by the strength of the ties, the strength of the forming members, the concrete placing rates, allowable deflection, amount of vibration and architectural requirements. To reduce spalling, removal of cones should be delayed until the concrete has adequate strength. When the cones are removed, the bond should be broken with a torsional motion. This may require a special tool. The part of the tie remaining in the concrete should be immediately coated with dry packed mortar or sealed with pre-molded plugs.

• Form coatings and sealers Function—Form coatings are non-moisture-transmitting and form sealers are semi-moisture-transmitting. Both are usually applied in liquid form to the form sheathing either during manufacture or in the field to serve one or more purposes:

• To protect and prolong the useful life of the form material;

• To prevent color variations and dusting of the concrete surface caused by wood sugar transfer;

• To facilitate release from concrete during stripping. Despite careful application of a release agent, some of it may be removed accidentally before or during concrete placement and consolidation;

• To alter the texture of the contact surfaces, such as preventing transfer of undesirable grain patterns. Multiple coats may be required;

• Form release agents General—Release agents are materials applied to the form sheathing to prevent the bonding of concrete to the sheathing, keep the formwork clean, and assist in the successful production of high-quality architectural surfaces. Effect of seasonal temperature extremes on application procedures when the concrete placing portions of the project overlap more than one season, which may affect both concrete color and bug hole blemishes on the surface; Uniformity of appearance: the same release agent should be used for all the architectural concrete surfaces;

• Types of release agents Release agents fall into two main classes: barrier and chemically active. Barrier types are water-insoluble materials that include oils without additives (neat oils), diesel oil, paraffin wax, and silicone oils. The EPA prohibits the use of uncut or straight diesel oil as a release agent. Barrier-type release agents are not recommended for architectural effects. Chemically active release agents are the most common for architectural concrete surfaces. Fatty acids chemically react with the basic materials in concrete and produce soap. Soap is a better lubricant than oil for the removal of entrapped air in fresh concrete. The formation of the soap film from the ingredients in the cement paste and the chemically active release agent prevents the concrete from bonding to the formwork.

• Types of foam work proposed to achieve the best exposed concrete finish are as stated below;

8.2.4 (a) The prequalification (technical bid) document should be submitted to Project Managers

office at IIMB in the form of hard copy only duly signed with seal. No softcopy shall be

accepted from the contractors.

(b) The late receipts will not be accepted.

8.2.5 Incomplete details are liable to be rejected and no correspondence will be entertained during

the process.

8.2.6 Language of tender: The language for submission of application should be English.

8.2.7 In the event of any form wishing to withdraw from pre-qualification, the contractor must

return the document with an explanatory letter to the employer.

8.2.8 Period of validity of tender: The Tender shall remain valid for a period of 75 days after the

last date of the submission of tender. A Tender valid for a shorter period, may be rejected by

the owner.

8.2.9 Period for completion of work: The duration for completion of project works is 15 months

from the date of issue of Letter of Award.

8.2.11 No cost of whatsoever will be paid towards site visits, etc, during pre-qualification/progress

of the work.

8.2.12 While submitting the schedule duly filled in, the Contractor shall enclose latest copies of

brochures and technical documentation giving more information about the firm and all the

members of the consortium/joint venture.

8.2.13 The contractor should organize for inspection of their works done at their own cost if

required by the technical evaluation committee.

8.2.14 All information called for in the enclosed forms shall be furnished against the relevant

columns in the forms. If for any reason, information is furnished on a separate sheet, this

fact shall be mentioned against the relevant column. Even if no information is to be provided

in a column, a "nil/not applicable/ no such case" entry shall be made in that column. If any

particulars/ queries are not applicable in case of the contractor, it shall be stated as “not

applicable". The contractors are cautioned that not giving complete information called for in

the application forms or not giving it in clear terms or making any change in the prescribed

forms or deliberately suppressing the information may result in the contractor being

automatically disqualified. Applications received late will not be entertained.

8.2.15 The application shall be page numbered and each page shall be signed & stamped.

8.2.16 Overwriting shall be avoided. Correction, if any, shall be made by neatly crossing out,

initialling, dating and rewriting. Pages of the pre-qualification document shall be numbered.

Additional sheets, if any added by the contractor, shall also be numbered.

8.2.17 References, information and certificates from previous clients certifying suitability, technical

knowhow or capability, quality of work of the contractor shall be signed by an officer not

below the rank of Executive Engineer or equivalent.- (FORM- I)

8.2.18 The contractor may furnish any additional information, which he thinks is necessary to

establish his capabilities to successfully complete the envisaged work. He is, however,

advised not to furnish superfluous information. No information shall be entertained after

submission of pre-qualification document unless the specifically required by and asked for

by IIM Bangalore.

8.2.19 Any information furnished by the contractor found to be incorrect either immediately or at

a later date, would render him automatically disqualified.

8.2.20 The pre-qualification document in prescribed form duly completed and signed shall be

submitted in a sealed cover. The sealed cover shall be super scribed “Pre-qualification of

Contractors for ‘The construction of New Hostel Block at Existing IIMB Campus’

8.2.21 Application for pre-qualification supported by prescribed annexure shall be submitted in

sealed envelope duly super-scribed with the name of work, name & phone nos. of the

contractor and due date of opening.

8.2.22 Contractors are advised to keep visiting the IIM Bangalore’s web-site from time to time (till

the deadline for PQ bid submission) for any updates in respect of the Pre-Qualification

notice, if any. Failure to do so shall not absolve the contractor of his liabilities to submit its

Pre-Qualification application complete in all respect including updates thereof, if any. An

incomplete application may be liable for rejection.

8.2.23 IIM Bangalore reserves the right to verify the particulars furnished by the contractor

independently. If any information furnished by the contractor is found incorrect at a later

stage, he shall be debarred from tendering and taking up of any work in IIM Bangalore.

8.2.24 Documents submitted in connection with pre-qualification will be treated confidential and will

not be returned.

8.2.25 Applications from Joint Venture or consortium companies will not be accepted or considered

for evaluation. Contractors, if required, may use agencies as sub-contractor for specialized

services, which need to be informed at the time of submission of application for pre-

qualification.

8.2.26 After the technical evaluation, IIM Bangalore will to inform the prequalified contractors who

shall be eligible for issuance of tender documents for participation in the bidding process.

IIM Bangalore, is likely to provide a comparatively short time span for submission of the Bids

for the Project. The Contractors are, therefore, advised to visit the site and familiarize

themselves with the Project. Any contractor may enquire about its qualification status which

may be informed to it after the completion of contractor selection procedure. However, IIM

Bangalore is not bound to inform the contractor regarding the reason for its non-qualification.

8.2.27 Arbitration:

In case, any dispute or difference shall arise between the parties during the progress

of work or after construction or abandonment of the work as to the meaning of

construction of this contract or touching or relating either to the said buildings or

works, or to any other matter of thing arising directly or indirectly under this contract,

then and in such an event the same shall be referred to arbitration by the Director of

the Institute of Management Bangalore as the Sole Arbitrator who shall alone consider

and determine the same and whose award shall be binding and conclusive upon both

the said parties and this clause shall be deemed a submission within the meaning of

the Arbitration and Conciliation Act, 1996, or statutory modification or re-enactment

thereof.

8.2.28 The venue of arbitration proceedings shall be Bangalore.

8.2.29 It is further agreed between the parties hereto that the Bangalore Courts alone shall have

the exclusive jurisdiction.

8.2.30 IIM Bangalore reserves the right to reject any or all prospective applications without

assigning any reason and to restrict the list of pre-qualified contractors to any number

deemed suitable.

8.3 METHOD OF APPLICATION:

8.3.1 If the contractor is a proprietary firm, the application shall be signed by the proprietor

above his full typewritten name and the full name of his firm with its current address.

8.3.2 If the contractor is a firm in partnership, the application shall be signed by all the partners

of the firm above their full typewritten names and current addresses or alternatively by a

partner holding power of attorney for the firm. In the latter case a certified copy of the

power of attorney shall accompany the application. In both cases a certified copy of the

partnership deed and current address of all the partners of the firm shall accompany the

application.

8.3.3 If the contractor is a limited company, the application shall be signed by a duly authorized

person holding power of attorney for signing the application accompanied by a certified

copy of the power of attorney. The contractor shall also furnish a copy of the

Memorandum & Articles of Association duly attested by a Public Notary. (Refer Form-C)

8.4 FINAL DECISION MAKING AUTHORITY:

Director, IIM Bangalore reserves the right to accept or reject any application, to annul the pre-

qualification process and reject all applications at any time, without assigning any reason or

incurring any liability to the contractors.

IIM Bangalore reserves the right to reject any or all prospective contractors without assigning any

reason and to restrict the list of pre-qualified contractors to any number deemed suitable.

8.5 PARTICULARS PROVISIONAL:

The particulars of the work given in “Sl.no.2” are provisional. They are liable to change and must

be considered only as advance information to assist the contractor to apply for proposed work.

8.6 SITE VISIT:

The contractor is advised to visit the site of work, at his own cost, and examine it and its

surroundings by himself, collect all information that he considers necessary for proper assessment

of the prospective assignment.

8.7 CRITERIA FOR ELIGIBILITY OF PRE-QUALIFICATION:

8.7.1 Contractors working or registered with CPWD /PWD /MES/ Railways/ Government

Departments/Public Sector Undertakings who fulfill the following requirements shall

be eligible to apply. The Contractor shall have been involved in the Civil Engineering

Construction Business for last Seven (7) years or more in India.

8.7.1 Similar work shall mean “Development and Construction of Residential / Commercial /

Institute / Office Buildings campus with RCC framed structure, exposed concrete

surfaces, shear wall construction including Public Health, Internal and external Electrical

works, fire fighting works, security systems. HVAC, lifts, Building Management System

and infrastructure development works in campus area having any rating related to GRIHA

or its equivalent LEED rating” executed in India for the Institutes of Higher Learning.

8.7.2 Application from joint ventures and consortium shall not be accepted.

8.7.3 The contractor must submit an undertaking that the contractor is not in default of payment

of Statutory dues (other than disputed dues being contested by the contractor) and that

up to tax returns have been filed along with the payment of due taxes, and submit copies

of such returns submitted to the IT department/ Department of Trade and Taxes.

8.7.4 The eligible contractor is required to have average annual financial gross turnover of

minimum Rs. 150 Crores (excluding the turnover of the associate for MEP works, if any)

on similar works for any three financial years (Relevant Years) during the last five years

ended 31st Jan 2019. Further, the aforesaid average turnover will be computed after

considering price updation of 7% per annum to bring the turnover of the Relevant Years

to 2017-2018 Price Level. (Refer Form – D)

8.7.5 As per the audited financial statement and after considering the impact of qualifications,

the contractor shall not have incurred any loss in during the last three financial years

ending 31st Jan 2019.(Refer Form – D)

8.7.6 Shall have sanctioned funds based banking limit of at least Rs.100 crores from scheduled

banks. The contractor shall submit a Certificate, not older than three months prior to 31st

Jan 2019, issued by any scheduled bank in original. (Refer Form – E)

8.7.7 Shall have average net worth of at least Rs. 100 crores in the last financial year ending

31st Jan 2019. (Refer Form – D)

Certificate(s) from a Chartered Accountant/statutory auditors specifying the net worth of

the Contractor(s), as at the close of the preceding financial year, and also specifying that

the methodology adopted for calculating such net worth conforms to the provisions of this

Clause. For the purpose of this pre-qualification, net worth (the "Net Worth") shall mean

the sum of capital (paid up capital in case of companies) and reserves from which shall be

deducted the sum of revaluation reserves, miscellaneous expenditure not written off and

reserves not available for distribution to equity share holders (in case of companies).

8.7.8 Should not be black listed by any State/Central Govt. Department or PSU or Autonomous

bodies. The contractor must submit a duly notarized affidavit to this effect.

Applications received without this declaration in original shall stand automatically

rejected.

8.7.9 The bidding capacity of the contractor shall be equal to 75% or more than the cost of the

work. The bidding capacity shall be worked out by the following formula: Bidding Capacity

= A x N x 2 – B

where

A= Maximum value of construction works executed in any one year during the last seven

years (on the basis of construction revenue recognized in the audited financial

statements and updated at 7% per annum to 2018 price level) taking into account the

completed as well as works in progress.

N= Number of years prescribed for completion of work for which pre-qualification

application has been invited. (2 years)

B = Value at the year 2018 price level of existing commitments and on-going works to be

completed during the period of completion of work for which pre-qualification has been

invited. (2 years)

The contractor shall submit the calculation sheet of Bid Capacity and also indicate

value of balance work/commitments in hand. (Certified by a Chartered Accountant)

8.8 DESIRABLE CRITERIA:

8.8.1 It is desirable that the contractor does not have any litigation(s) in process. The

contractor must submit information of on-going litigations and the history of

concluded litigations in the past seven years, duly highlighting litigations arising from

the construction contracts. In the event that the contractor has no litigations either

in process or in the past 7 years, an affidavit to this effect, duly notarized must

be submitted in original. For all the pending litigation for construction

contracts, it shall in total not represent more than 20% (twenty percent) of the

contractor’s net worth and an affidavit to this effect duly notarized must be

submitted in original.

8.8.2 It is desirable that the contractor has at least one of the valid certifications, namely

ISO 14001:2004 and ISO18001:2007 valid on the date of application. ISO-

9001:2008 is required.

8.8.3 It is desirable that the contractor has specific experience of the following works. This will

enable the contractor to score higher credits:

i. Executed exposed architectural work, exposed finished architectural

brickwork, exposed architectural form finish in a single project for an area of

10000 Sqm. The executed project should be supported with A3 size

photographs preferably with date mentioned over it.

ii. The details of the shuttering materials used for achieving the best exposed

surfaces during insitu constructions.

iii. Execution of Slabs for an area not less than 30,000 Sqm.

iv. Having completed at least one building of 30000 Sqm which obtained GRIHA

3 certification or equivalent LEED gold certificate.

v. Execution of flexible/rigid pavements or roads 5000 Sqm.

8.8.4 The value of works shall be brought to current costing level by enhancing the actual

value of work at simple rate of 7% per annum: calculated from the date of completion

to last date of receipt of applications for PQ documents.

8.8.5 For all the purposes, cost of work shall mean gross value of the completed work

including the cost of materials supplied by the Govt. /Client, but excluding those

supplied free of cost. If customer supplied free of cost material is added in cost of work,

due supporting documents, regarding the cost of material from client, should be

submitted.

8.9 ESSENTIAL SUBMISSIONS AND INFORMATION:

8.9.1 The bidder shall provide copies of work orders as well as completion certificates from the

Employer as documentary proof for having executed similar works. However, decision with

regard to eligibility of the contractor will be taken by the Employer, only after necessary

documents provided by the contractor have been examined.

8.9.2 The contractor's performance for each work completed in the last seven years and works

in hand shall be certified by an officer not below the rank of Executive Engineer or

equivalent and shall be obtained in sealed cover. (Form- I)

8.9.3 The contractor must submit an undertaking that the contractor is not in default of payment

of Statutory dues (other than disputed dues being contested by the contractor) and that up

to tax returns have been filed along with the payment of due taxes, and submit copies of

such returns submitted to the IT department/ Department of Trade and Taxes.

8.9.4 The contractor shall own construction equipment as per list (Form H) required for the proper

and timely execution of the work. Else, he shall certify that he would be able to manage the

equipment by hiring etc. and submit the list of firms from whom he proposes to hire. Details

of any plant / equipment required for the work need to be indicated. Facilities of field lab

and test equipment shall also be furnished.

8.9.5 The contractor shall have sufficient number of Technical and Administrative employees for

the proper execution of the contract work. The contractor shall submit the organization chart

along with a list of the employees stating clearly how they would be involved in this work.–

8.9.6 Minimum requirement of Technical Staff for this work furnished as under which shall be

assessed for evaluation:

Contractor shall submit the supporting Documents such as:

a) List of full time Technical staff he proposes to deploy against the work with name

qualification and experience each along with complete CV.

b) Attested copies of Degree/Diploma & Experience certificate.

c) Declaration from the Technical staff that they are employed with the contractor

d) Documents like PF subscription, copy of Income Tax return with IT Form 16

8.9.7 In case the contractor has himself not executed any works of Services (MEP), he can have

a sub-contractor who meets the condition in respect of works of MEP Services. In such a

case, the contractor will have to produce an MOU in original (on a stamp paper) with the

party whom the contractor would like to take as a sub-contractor for execution of works of

Services (MEP). The contractor will be solely responsible to the Employer. In case his firm

gets pre-qualified and awarded the work, the contractor will be responsible for the work

done by its sub-contractor. In such cases, documentary proof of the proposed associate

party meeting the eligibility criteria should be enclosed. In-addition, the contractors need to

submit documentary proof regarding the successful completion of previous similar work

with the agency being engaged as sub-contractor.

8.9.8 The contractor needs to make disclosure of any liquidated damages or penalties imposed

on it by the customers towards delay in completion of the project or for not meeting the

contractual specifications, including issues relating to defects, workmanship and warranty

obligations.

8.9.9 The contractor will be required to give an undertaking that it would comply with all statutory

laws and compliances, including those applicable to the subcontractors appointed by him

and indemnify the Institute of all implications and consequences resulting from any non-

compliances due to any reasons whatsoever.

The contractor should score minimum of 70 points to be prequalified in the prequalification

(Technical Bid).

8.11 TENDER SUBMISSION:

8.11.1 After evaluation of pre-qualification applications, a list of qualified agencies will be prepared.

Short listing of the bidders shall be done after thorough verification of their credentials and

inspection of similar works carried out/in progress by them, through a Committee to be

constituted by IIM Bangalore. Thereafter, pre-qualified agencies only would be invited to

submit bid for the work tendered.

8.11.2 IIM Bangalore, reserves the right, without being liable for any damages or obligation or

informs the contractor, to :

(a) Amend the scope of work and/or value of contract to the contractor.

(b) Amend the time for execution of work.

(c) Reject any or all the applications without assigning any reason.

8.11.3 Any effort on the part of the contractor or his agent to exercise influence or to pressurize

the employer would result in automatic rejection of his application. Canvassing of any kind

is strictly prohibited.

8.12 TENDER FORMAT FOR EXECUTION OF WORKS

Work shall be executed according to General Conditions of Contract for CPWD Works (GCC

2014 with up to date amendments) and in FIDIC form of contracts. IIM Bangalore reserves

the right to modify any of the conditions to suit to its specific requirements.

8.13 MISCELLANEOUS

8.13.1 The Bidding Process shall be governed by, and construed in accordance with, the laws of

India and the Courts in Bangalore (state of Karnataka) shall have exclusive jurisdiction over

all disputes arising under, pursuant to and/ or in connection with the Bidding Process.

8.13.2 IIM Bangalore, in its sole discretion and without incurring any obligation or liability, reserves

the right, at any time, to;

(a) suspend and/ or cancel the Bidding Process and/ or amend and/ or supplement the Bidding

Process or modify the dates or other terms and conditions relating thereto;

(b) consult any Contractor in order to receive clarification or further information;

(c) pre-qualify or not to pre-qualify any Contractor and/ or to consult any Contractor in order to

receive clarification or further information;

(d) retain any information and/ or evidence submitted to the Authority by, on behalf of, and/ or in

relation to any Contractor; and/ or

(e)Independently verify, disqualify, reject and/ or accept any and all submissions or other

information and/ or evidence submitted by or on behalf of any Contractor.

(f) Call for information from previous clients and evaluate the previous completed projects

regarding all submission including litigations.

(g) Undertake physical verification of completed projects and interact with clients.

(h) Call for information from taxation authority or by financial auditor, banker, charted accountant

engaged by the contractor.

(i) decide on the magnitude and scope of work before commencement of the project work

8.13.3 It shall be deemed that by submitting the Application, the Contractor agrees and releases the

Authority, its employees, agents and advisers, irrevocably, unconditionally, fully and finally

from any and all liability for claims, losses, damages, costs, expenses or liabilities in any way

related to or arising from the exercise of any rights and/ or performance of any obligations

hereunder and the Bidding Documents, pursuant hereto, and/ or in connection with the Bidding

Process, to the fullest extent permitted by applicable law, and waives any and all rights and/

or claims it may have in this respect, whether actual or contingent, whether present or in future.

8.13.4 Any addendum/change in the schedule will be uploaded in IIMB website only.
