Assessment of Environmental Impact of the export of woodchips produced from silvicultural residues from state forests in NSW and forestry and dearir private property by Sawmillers Exports Pty Ltd.

Sawmillers Exports Pty Ltd, a subsidiary of Boral Limited, seek approval to export v^oodchips produced from silvicultural residues from State Forests in NSW and forestry and clearing operations on private property for the period to 2003. In accordance with the Administrative Procedures under the Commonwealth Environment Protection (Impact of Proposals) Act 1974, a draft Environmental Impact Statement (EIS) describing the proposal and its potential impacts has been prepared by the Sawmillers Exports Pty Ltd.

(c) adding after paragraph (r) of the definition of "prescribed amount" the following paragraphs:

"(s) an amount referred to in paragraph (a) of the definition of 'accunulated government body contributions' in subsection 62A(1) of the Act;

(t) an amount referred to in paragraph (a) of the definition of 'notional accumulated SG contributions' in subsection 62A(1) of the Act;

(u) an amount referred to in paragraph (a) of the definition of 'accumulated government body contributions' in subsection 110SB(1) of the Act;

(V) an amount referred to in paragraph (a) of the definition of 'notional accumulated SG contributions' in subsection 110SB(1) of the Act; and

(w) an amount referred to in paragraph (a) of section 156A of the Act."

5. The Principal Determination is amended by inserting the following clauses after clause 5A:

"5B. For the purpose of ascertaining any of -

(a) the accumulated government body contributions within the meaning of subsection 62A(1) of the Act; and

(b) the notional accumulated SG contributions within the meaning of subsection 62A(1) of the Act

in relation to a person who has ceased to be an eligible employee after 30 June 1993, notional interest is payable in respect of the prescribed amounts described in paragraphs (s) and (t) of the definition of 'prescribed amount' in clause 4 in accordance with clause 6 and the Schedule as if:

(c) a reference in that clause and the Schedule to interest were a reference to notional interest; and

(d) subclause (5) of that clause provided -

'In this clause, "period of interest", in respect of a prescribed amount means the period commencing on the day that is the first contribution day in relation to the person in the "relevant period of employment" within the meaning of section 62A(1> and ending on the day that is the termination day in relation to the person.'


5C. For the purpose of ascertaining any of -

(a) the accumulated government body contributions within the meaning of subsection IIOSB(I) of the Act; and

(b) the notional accunulated SG contributions within the meaning of subsection nOSBd) of the Act

of a person who has ceased to be an eligible ernployee after 30 June 1992, notional interest is payable in respect of the prescribed amounts described in paragraphs (u) and (v) of the definition of * prescribed amount' in clause 4 in accordance with clause 6 and the Schedule as if:

(c) a reference in that clause and the Schedule to interest were a reference to notional interest; and

(d) subclause (5) of that clause provided -

M n this clause, "period of interest", in respect of a prescribed amount means the period conmencing on the day that is the first contribution day in relation to the person in the "relevant period of employment" within the meaning of section IIOSB(I) and ending on the day that is the termination day in relation to the person.'"

6. The Principal Determination is amended by inserting the following clause after clause 7:

•'8. For the purpose of ascertaining the amount to be refunded to a person pursuant to section 156A of the Act, interest is payable in respect of the prescribed amount described in paragraph (w) of the definition of "prescribed amount" in clause 4 in accordance with clause 6 and the Schedule as if:

(a) a reference in that clause to a person who has ceased to be an eligible employee were a reference to a person in respect of whom the Commissi oner has become aware is not an eligible employee; and

(b) subclause (5) of that clause provided •

M n this clause, "period of interest", in respect of a prescribed amount shall be read as a reference to the period commencing:

<i) if the amount was deducted from the person's salary on a contribution day or was otherwise paid to the Coninissioner on a contribution day - that day; or

(ii) in any other case - on the next contribution day following the day on which the amount was paid to the Corrmissioner

and ending on the day 3 days after the day on which the Commissioner has completed action required to effect a refund of the amount to the person.'"

RECOMMENDATIONS OF THE AUSTRALIAN DRUG EVALUATION COMMITTEE The 166th Meeting of the Australian Drug Evaluation Committee (ADEC) (12-13 August 1993) resolved to advise the Minister for Family Services and the Secretary, Department of Health, Housing, Local Government and Community Services that the following drugs and drug products should be approved for registration, subject to resolution of all outstanding matters to the satisfaction of the Committee and the Therapeutic Goods Administration. The recommendation for approval, in some instances, may be subject to specific conditions. BOTOX Clostridium botulinum toxin type A, lyophilised powder containing 100 units/vial with human serum albumin 0.5 mg and sodium chloride 0.9 mg, for reconstitution with non-preserved sterile saline prior to intramuscular injection. Indlcat:lon8: For the treatment of blepharospasm associated with dystonia, including benign blepharospasm and Vllth nerve disorders (hemifacial spasm) in patients 12 years and over. Indications: For the treatment and control of symptomatic benign prostatic hyperplasia in patients who are not candidates for immediate surgery. CUSTOMS ACT 1901 - PART XVB PRELIMINARY FINDING INTO THE ALLEGED DUMPING AND SUBSIDISATION OF FORMULATED TRIFLURALIN EXPORTED

FROM THE REPUBLIC OF SOUTH AFRICA

The Australian Customs Service has completed its inquiry mto the alleged dumping and subsidisation of formulated trifluralin exported from the Republic of South Africa (South Africa), The inquiry commenced on 26 July 1993 following an application by Nufarm Limited. Customs found that:

formulated trifluralin exported from South Africa has been dumped; formulated trifluralin exported from South Africa has been subsidised; the Australian industry producing like goods suffered material injury caused by these dumped/subsidised exports; material injury to the Australian mdustry is not threatened by fiiture exports of dumped formulated trifluralin from South Africa; and material injury to the Australian industry is threatened by fiiture exports of subsidised formulated trifluralin from South Africa.

Securities under section 42 of the Customs Act 1901 will be imposed in respect of any countervailing duty that may become payable on the goods from the Republic of South Africa that are imported on or after 4 November 1993. Customs will now refer the matter to the Anti-Dumping Authority who must hold an inquiry and report to the Minister as to whether countervailing duties should be imposed.

BROADCASTING LICENCES PURSUANT TO SECTION 96 OF THE BROADCASTING SERVICE ACT 1992.

On 21 October 1993, the Australian Broadcasting Authority ('ABA') allocated twenty-eight subscription television broadcasting licences (Licence Identifier Nos. 0009 - 0036) under section 96 of the Act to Rowcom Holdings Pty Ltd. Rowcom propose to provide a subscription television broadcasting service to Darwin, Cairns, Townsville, Sunshine Coast, Hobart and Launceston. The service will be delivered via cable. The ABA must not allocate a licence under section 96 that uses satellite as a means of service delivery. The ABA must not allocate a licence under section 96 for a service that is dependent on an MDS system as its means of transmission (or as part of its means of transmission) before satellite Pay TV services commence under licence A, licence B or licence C or until 1 January 1995, whichever is the earlier.

FEDERAL AIRPORTS (AKENDMEKT) BY-LAWS NO.l 1993

THE FEDERAL AIRPORTS CORPORATION, acting pursuant to section 72 of the FEDERAL AIRPORTS CORPORATION ACT 1986, hereby makes the following By-laws.

1. These amendments may be cited as the Federal Airports (Amendment) By-laws No.l 1993.

2. By-law 2.1 of the Federal Airports By-laws is amended by inserting in the appropriate place the following additional definition:-

"aircraft stand" means an area at a Federal Airport designated by the Corporation for the parking of aircraft including, but not limited to the parking of aircraft for the purposes of loading and unloading of freight, mail and cargo, and for the embarkation or disembarkation of passengers.

3. The Federal Airports By-laws are amended by the insertion of the following new By-laws after existing By-law 15C:

15CA.1 By-laws 15CA.2, 15CA.3 and 15CA.4 apply only to aircraft in relation to aircraft stands on Federal Airports at Sydney, Melbourne, Brisbane, Adelaide, Perth, Hobart, Darwin, Townsville, Coolangatta, Canberra and Alice Springs, apart from areas which are leased by the Corporation to third parties.

15CA.2 The pilot in control of an aircraft and the operator shall obey all reasonable directions by the airport officers employed by the Corporation to administer aircraft movements and parking in relation to:

(a) movement of the aircraft on an aircraft stand;

(b) allocation of particular aircraft stands;

(c) time limitations applying to aircraft stands; and

(d) removal of aircraft when a time limitation has been exceeded or in an emergency.

Penalty $500


15CA.3 If directions under By-law 15CA.2 are not obeyed, those directions may be repeated or varied by the relevant airport officer of the Corporation and every failure to comply with the initial instruction and with any subsequent repetition or variation shall, subject to clause 15CA.4, constitute a separate offence.

15CA.4 No person shall be liable for more than four offences in respect of breaches of clause 15CA.3, in any one hour period, in respect of each aircraft.

15CA.5 Where a person fails to comply with a direction given under By-law 15CA.2, the airport officer may, with such assistance (if any) as is necessary, remove the aircraft as required by the direction.

15CA.6 An action does not lie against the Corporation, or against the airport officer or any other officer, employee or agent of the Corporation acting in the course of his or her employment, for or in respect of : (a) loss of, or damage to, an aircraft during

its removal under By-law 15CA.5; or (b) loss of, or damage to, an aircraft so

removed while it is in the custody, possession or control of the Corporation or the airport officer or any other officer, employee or agent of the Corporation;

other than loss or damage wilfully or negligently caused by such an airport officer, employee or agent.

NOTICE IS HEREBY GIVEN that copies of this Amendment: to the Federal Airports By-laws and all current Federal Airports By-laws may be purchased from all outlets of the Australian Government Publishing Service.

FEDERAL AIRPORTS ^AMENDMENT) BY-IAWS NO. 2 1993

THE FEDERAL AIRPORTS CORPORATION, acting pursuant to section 72 of the FEDERAL AIRPORTS CORPORATION ACT 1986, hereby makes the following By-laws.

These amendments may be cited as the Federal Airports (Amendment) By-laws No.2 1993.

2. By-law 2.1 of the Federal Airports By-laws is amended by the deletion of the existing definition of "airside" and inserting in the appropriate place the following definitions:

'airside' means the movement area of an airport, adjacent terrain and buildings or portions thereof, access to which is controlled, but excluding leased areas;"

'Airside Vehicle Control Handbook' in relation to each Federal airport means the latest edition of the book by that name issued before 16 September 1993 in respect of that airport;"

'Authority to Drive Airside' means a document validly issued by the Corporation which is expressed to authorise the person to whom it is issued to drive a vehicle on the airside at a Federal airport;"

3. The Federal Airports By-laws are amended by the deletion of existing 15H.1, 15H.2, 15H.3 and 15H.4 and the insertion of the following new By-laws.

15H.1 No person shall operate or use a vehicle on the airside of a Federal airport in breach of the requirements of the Airside Vehicle Control Handbook.

Penalty : $500

15H.2 No person or company shall permit a vehicle which it owns or controls to be operated or used on the airside of a Federal airport in breach of the requirements of the Airside Vehicle Control Handbook.

Penalty : $500


15H.3 An airport officer may require a person apparently in control of a vehicle on the airside of a Federal airport to produce his or her Authority to Drive Airside for inspection and to state his or her name and address if the airport officer considers it appropriate to do so for the purposes of safety or these By-laws.

15H.4 A person who is required to state his or her name and address under By-law 15H.3 shall not, without reasonable excuse, refuse or fail to do so or state a false name and address. Penalty ; $500

15H.5 A person who is required to produce his or her Authority to Drive Airside for inspection under By-law 15H.3 shall not, without reasonable excuse, refuse or fail to do so. Penalty : $500

15H.6 An aixrport officer may give such directions or prohibitions as the airport officer considers reasonable to a person apparently in control of a vehicle on the airside of a Federal airport, or to any other person on the airside of a Federal airport, as are, in the opinion of the officer, necessary to eliminate a cause of danger, produce a more efficient flow of traffic, remove an impediment to traffic, for the purposes of aviation security, or for the purposes of these By-laws.

15H.7 A person shall not, without reasonable excuse, refuse or fail to comply with a direction given by an airport officer under By-law 15H.6. Penalty : $500"

2, By-law 2.1 of the Federal Airports By-laws is amended by deleting the definition of the term "authorised identification card" and inserting the following additional definition :

"ASIC" means a current aviation security identification card issued to a person for access to security restricted areas at a Federal Airport;"

3. By-law 15F.2(c) is amended by :

(i) Deleting the word "holding" and substituting in its place the word displaying";

(ii) Deleting the words "authorised identification card" and substituting in its place the phrase "ASIC, lawfully issued to and validly held by that person for that area".

By-law 15F.5(a) is amended by deleting the words "authorised identification card" and substituting in its place "ASIC".

By-law 15F.5(b) is amended by deleting the existing wording and substituting the following wording in its place:

"(b) A person who is required by an airport officer to surrender such a card shall forthwith surrender that card to the airport officer."

The Federal Airports By-laws are amended by the insertion of the following new By-laws after current By-law 15F:

"15FA.1 Where a person who has been issued with an ASIC by the Corporation :


(a) for any reason including termination, change in nature of employment or completion of contract, ceases to require access from time to time to the appropriate area for the purposes of his or her employment, the person must immediately return the ASIC to the Corporation at the place at which it was issued; or

(b) loses the ASIC, or has reason to suspect that the ASIC may be destroyed or stolen, the person must immediately notify the Corporation at the place at which it was issued and his or her employer.

Penalty: $500

15FA.2 Every person to whom an ASIC has been issued by the Corporation shall, within ten working days, notify the Corporation of any change of name, address or telephone number of that person. Penalty: $500

15FA.3 The employer of a person who has been issued an ASIC by the Corporation shall take all reasonable steps to ensure that;

(a) the ASIC is returned to the Corporation at the place at which it was issued in accordance with by-law 15FA.l(a);

(b) the Corporation is notified in accordance with by-law 15FA.(b); and

(c) the Corporation is notified, within ten working days, of any change of name, address or telephone number of either the employer, or of the person to whom the Corporation has issued the ASIC.

Penalty: $500

NOTICE IS HEREBY GIVEN that copies of this Amendment to the Federal Airports By-laws and all current Federal Airports By-laws may be purchased from all outlets of the Australian Government Publishing Service.
