In regards to the above case;

I, Deputy B. Williams, was on-duty and on patrol in Monroe County Sector 1. (The LowerKeys) Deputies working the Stock Island area received information that the listed suspectvehicle was out-bound from the city of Key West. Dep. J. Gordon was able to locate thatvehicle and notified Dispatch. He advised the vehicle was possibly being driven by anarmed-robbery suspect being sought by the Key West Police Department. Dep. D. Larizadvised over the air to stand-by, that he was en route, so that they could perform a felonyvehicle stop.

During the course of that initial visual contact, the suspect identified Deputies, thenattempted to elude both marked patrol cars in the area of 3rd Avenue and Sunshine Street.The suspect vehicle lost control coming off of the roadway, and striking a stop sign in the NWcorner of the intersection. Deputy Gordon attempted to make contact with the suspect/driver,when that subject opened fire at Deputy Gordon, striking him in the chest. Both Deputiesreturned fire at this point, in self-defense.

Deputy Lariz advised over the radio, that shots had been fired. I responded CODE 3 to thoseDeputies from the 28MM.

The suspect was able to free his vehicle and fled north on Sunshine Street, then east onto 2ndAvenue. Fearing further attack, Deputies retreated to the safety of their vehicles thenproceeded to 2nd Avenue, where the suspect vehicle was now stopped. The vehicle was parkedat 2nd Avenue and 5th Street. It appeared the suspect had fled the area on foot. Deputies

Gordon and Lariz cleared the suspect vehicle confirming it was empty.

While en route, I advised Dispatch to notify Sector 1 chain of command, and requested Sector4 Sergeant C. Kellenberger respond as well. We had Key West PD respond to the scene, aswell. I also requested that Communications have KWPD Officers come to our channel tocoordinate a response. (A temporary CP was established north of 5th Street and 2nd Avenue)

A perimeter was established, and a brief description of suspect was announced. We thenreceived a call from a witness stating that a subject, matching the suspect descriptionattempted to open the door to his vehicle and get in. This occurred at the intersection of 5thAvenue and 5th Street. (This was within 2 blocks of our location.) The witness fled the area,stating he did not know the subject. He also added that the suspect appeared to be injured.

(We confirmed an injury shortly after, by locating blood in and on the suspect vehicle)

The perimeter was shifted, as we now believed the suspect was mobile, on foot in the StockIsland area, and still armed. We then began to receive other calls through dispatch, advisingthe subject was in the area of Tom Thumb Food Store. Officers and Deputies searched thearea on foot with no success, as it appears he was picked up by persons unknown prior totheir arrival.

In the meantime, Dep. J. Gordon was sent to the Hospital for medical evaluation. Dep. S.Curry was assigned to him to observe him and be a point of contact until otherwise advised orrelieved. Dep. Gordon turned his MCSO issued patrol rifle over to me at the scene. I securedit and it was later turned over to CSI Detective J. Underwood on PR# 157536.

Information was received now, that the suspect had fled to the Big Coppitt area. The searchwas re-located to that area, and coordinated by Command Staff.

I held the crime scene located at 2nd Avenue and 5th Street until Detectives arrived. Det. Sgt.D. Catala responded to my scene along with FDLE Agents M. Quad and C. Fredericks. Acrime scene log was initiated and that log was subsequently collected by Agent Quad. CSIDetective J. Underwood also responded and at this point the scene was turned over to him forprocessing. Upon completion of processing that scene, the intersection was released andcleared. The suspect vehicle was towed by Anchor Towing on MCSO Vehicle Acquisition#46603. The vehicle was towed to MCSO impound for further processing.

At this point in time I have no further information. The case is currently active, open andpending. The case has been assigned to the Major Crimes Unit. Updates to follow.

On October 25, 2015, at approximately 9:42 pm, I heard Dep. Gordon advisedispatch and Dep. Lariz that he was behind a possible robbery suspect heading northboundon US1 passing Chevron. Dep. Lariz informed Dep. Gordon to wait for him to respond beforeinitiating a felony stop on the vehicle. Dep. Gordon advised the tag on the vehicle was a stolentag from a report that he had taken. Dep. Gordon continued to give his location as hefollowed the vehicle. I began responding to the area to assist in a possible felony stop. Dep.

Gordon advised the vehicle was now aware that he was following it and turned off the lightsand was taking off on 3rd Ave. Dep. Gordon then advised the vehicle went through the stopsign at 3rd Ave and 5th Street and hit a stop sign. I then heard Dep. Gordon or Dep. Larizadvising that shots had been fired. At approximately this time, I was turning onto 5th St fromMacDonald Ave. I did not see any police lights on 5th St, however, I saw numerous personsstanding on the corner of 5th St and 3rd Ave that appeared to be looking down 3rd Avetowards Sunshine St. I continued down 5th St and at this time I could hear gunshots goingoff. As I got to 3rd Ave, I was able to see Dep. Lariz and Dep. Gordon's patrol cars with theiroverhead lights on. I could not see the suspects vehicle. As I turned onto 3rd Ave towardsSunshine St, Dep. Lariz began pointing for me to turn around and he advised that the subjectwas headed out towards the highway. I turned around and went towards US1, however, I didnot see any vehicles or injured persons leaving the area. Dep. Lariz informed dispatch thatDep. Gordon had been hit in the vest.

I made it to the intersection of 5th St and US1, where I turned around and wentback into Stock Island. At this time, I was trying to ascertain if the subject was still in the caror on foot. I informed dispatch I was going to be checking the nearby area. I proceeded easton MacDonald Ave and then south onto 3rd St. While driving down 3rd St, Dep. Gordonadvised he located the suspects vehicle on 2nd Ave. I turned onto 2nd Ave and proceeded to2nd Ave and 5th St. I observed a dark colored Ford Mustang in the middle of the road on2nd Ave facing 5th St. I used my vehicle to block 5th St to stop traffic from passing in front ofthe suspects vehicle. I then made my way on foot to the suspects vehicle, where Dep. Gordonand Dep. Lariz had already begun clearing the car. At this time, numerous KWPD units werearriving on scene. The suspects vehicle was cleared.

Station 8 responded to the scene and stopped directly behind my vehicle. I wasthen instructed by Dep. Williams that someone needed to stay with Dep. Gordon. I walkedwith Dep. Gordon to the rescue unit where they began checking his vitals.

I was then instructed by Dep. Williams, who had arrived on scene to follow Dep.Gordon, who was in the rescue unit to the ER. Just after arriving at the ER Sgt. Hernandezarrived and she advised that she would stay with Dep. Gordon.

I responded back to Stock Island and held perimeter on 3rd St and 1st Ave. Afterthe area was cleared, I responded back to the area of 3rd Ave and Sunshine St, whereby Iplaced crime scene tape. I placed crime scene tape across 3rd Ave, in front of Lonnie HelmsAutomotive and also just west of Sunshine St. I then began a crime scene log of all personsentering or exiting the scene at my location. I stayed at this location until the scene wasreleased.

This crime scene log was then turned over to FDLE Supervisor Fredrick.

On or about October 24, 2015 A BOLO was issued by Key West Police Department. DeputyJosh Gordon, was on duty in uniform and in a marked patrol vehicle, noticed a vehiclematching the description provided in the BOLO in the Stock Island area. A traffic stop wasinitiated on Sunshine Street and 3rd Avenue by Deputy Gordon.

The driver of the vehicle recognizing the deputies took notice of him, eluded the markedpatrol car in the area of 3rd Avenue and Sunshine Street. The suspect vehicle lost control andstriking the stop sign in the intersection. Deputy Gordon attempted to make contact with thedriver of the vehicle. The subject opened fire, firing multiple shots directly at Deputy Gordonstriking him once in the chest. Deputy Gordon returned fire after being struck and while onthe ground.

Subject fled the area in the same BOLO vehicle driving north on Sunshine Street and theneast on to Second Avenue in the Stock Island area.

The suspect was able to free his vehicle and fled north on Sunshine Street, then east onto 2ndAvenue. Fearing further attack, Deputies retreated to the safety of their vehicles thenproceeded to 2nd Avenue, where the suspect vehicle was now stopped. The vehicle was parkedat 2nd Avenue and 5th Street. It appeared the suspect had fled the area on foot. DeputiesGordon and Lariz cleared the suspect vehicle confirming it was empty. At this point both thesuspect and Deputy Gordon’s marked patrol vehicle had multiple gunshot strikes.

A law enforcement search involving multiple agencies was conducted in the Stock Island andBig Coppitt areas, as information from the suspect’s family indicated he was in the area. Thefamily indicated he informed them he had been shot and needed help. Following numerousattempts to locate Thomas in the Big Coppitt area, law enforcement was unsuccessful.

On October 25, 2015 information was received indicating Thomas was going to a location inthe city of Key West. That information was relayed to Key West Police Department, whereThomas was eventually located at a residence located at 1711 VonPhister Street, Key West, Fl.Contact there was established with Thomas by telephone, were he confirmed he needed helpfor injuries sustained by gun shot. After several hours of negotiations, Thomas surrenderedwithout incident.

In the surrender, your affiant, took note of two gunshot wounds to Thomas’ back andshoulder. Thomas made spontaneous utterances that police fired upon him first. He wastransported for treatment to Lower Keys Medical Center.

Subsequent search warrant conducted in the residence on 1711 VonPhister Street, which wasoccupied by Thomas, resulted in the recovery of two firearms.

When I arrived at the scene at 5th Street and 2nd Ave, on Stock Island, there wereseveral Deputies / Officers from multiple agencies already there. Detective Sgt Catalainformed that this location was in fact the 'secondary' crime scene. I photo documented andprocessed the scene, the suspect's vehicle, and collected evidence there. The vehicle wasstopped on 3rd Ave, approximately fifteen ( 15 ) feet from the intersection with 5th Street.The vehicle had multiple bullet holes and strikes on all four planes. The suspect had fled thescene on foot. The car and surrounding area had been secured.

The vehicle, a black in color Ford Mustang, two ( 2 ) door, was situated in themiddle of the street with the driver's side door open. Both of the front windows had beenbroken out and lay on the street on each respective side of the vehicle. I counted thirteen ( 13 )of what appeared to be bullet holes on the left rear ( driver's side,) of that vehicle. Two ( 2 ) holes, in the lower left rear of the vehicle bumper appeared to be of much smaller size orcaliber, On the ground, on the driver's side of the vehicle, I saw one ( 1 ) empty / fired 9mm'Hornady' cartridge case. There was what appeared to be blood stains on the front of thedriver's seat back on the upper left portion of that seat. There were what appeared to beblood drops on the driver's side of the center console arm rest. A cell phone, believed tobelong to the suspect was on the floor under the left side of the driver's seatThere were four (4 ) fired / spent bullets of what appeared to be .45 caliber found inside the car. Two ( 2 ) ofthose bullets were found on the front floor of the driver's side of the vehicle. One ( 1 ) fired /spent bullet, that appeared to be of .45 caliber was found on the front floor of the passengerside of the vehicle. Another ( 1 ) fired / spent bullet of what appeared to be of .45 caliber wasfound on the floor behind the driver's seat. Behind the driver's seat on the rear floor I foundan ( 1 ) additional fired / empty 9mm 'Hornady' cartridge case. Also from the rear floorbehind the driver's seat, I found one ( 1 ) fired / spent bullet that appeared to be of .40 caliber.

From the front and back floors of the vehicle I collected miscellaneous items suchas empty drink containers, empty cigar wrappers, one black 'stocking / ski type cap, three ( 3) 'walkie talkie' type radios. All of the items found and mentioned in this report are listed inthe F7 portion of this report and were collected as follows;

I then changed locations to the 'primary incident scene', where the shooting had occurred.The scene was secured at that point in time by FDLE Agent Smith and Deputy SpencerCurry.

It had been reported to me that the suspect's vehicle had been stopped when he (suspect ) tried to make the turn off of 2nd Ave onto Sunshine Street because the vehicle slidinto a 'Stop' sign located on the lower side of that corner. The driver's door opened towards2nd Avenue with the front of the vehicle against the 'Stop' sign on the lower side of theintersection while the rear of the car was towards 5th Street. The suspect vehicle was stoppedat that moment in time,almost straight acroos/ blocking Sunshine Street and almost parallelwith 2nd Avenue. There is a house / residence on the lower side of Sunshine directly on that corner that iscurrently occupied, There was a noticable absence of fired / spent cartridge cases at thatintersection, where the majority of the shots from all three ( 3 ) parties had been fired.According to the Deputies actually involved in the shooting, they each fired thirteen ( 13 )rounds from their respective handguns and Deputy Gordon reported that he fired two ( 2 )additional rounds with his patrol carbine. At the exact location where the gunfight took placeI found one ( 1) empty / fired .40 caliber 'Federal' cartridge case in the middle of 2nd Ave. Ifound four ( 4 ) fired / spent bullets and / or fragments that appeared to be of .40 caliber inthe grassy road side where the suspect vehicle had been stopped. In that same area I foundfour ( 4 ) empty / fired 9mm 'Hornady' cartridge cases. I found two ( 2 ) empty / fired .45caliber 'Federal' cartridge casings underneath a car on the upper ( behind suspect vehiclelocation ) right side of the intersection.

There is concrete wall, six ( 6 ) feet tall , along the south eastern side of 2nd Ave forapproximately one hundred ( 100 ) feet. That wall extends approximately fifty ( 50 ) feet ineither direction from the intersection. There are two ( 2 ) holes that appear to be fresh bulletstrike / impact points in that wall as depicted in scene photos. Only fragments of bullets werefound at that wall. Widening the search pattern, approximately seventy five ( 75 ) feet from the suspectvehicle's location at the moment of the shooting, I found ten ( 10 ) empty / fired .40 caliber

'Federal' cartridge casings in a small group area. It appeared as if someone ( s ) had pickedthe empty cartridge casings up at the intersection and then as if they had been dropped, orthrown against the wall there. In that same small concentrated area there were also two ( 2 )empty / fired .45 caliber 'Federal' cartridge cases and one ( 1 ) empty / fired .223 'Federal'cartridge case.

After processing this scene, I again changed locations to the MCSO HeadquartersTraining Office. I met with Deputy Sgt. Hernandez who escorted me to a locked door, sealedwith 'Evidence' tape. Cutting the tape i entered the room where Sgt. Hernandez showed methe handgun with ammunition and magazines taken from deputy Gordon. She ( Sgt.Hernandez also showed me a white plastic bag from LKMC that contained Deputy Gordon'suniform completely intact. I photo documented and took custody of those items under P.R. #156358 as follows ;

1 - class ' B' unform shirt with name tag - Gordon- and allinsignia and badges in place with what appeared to be a bullet hole beside

the inner edge of the left shirt pocket1 - pair of uniform trousers with empty pockets1 - white tee type shirt with what appeared to be small

The following is a summary of the initial incident and actions of this case, as I obtained frompreliminary information, investigation and video obtained from both Deputy Gordon andDeputy Lariz in car arbitrator systems. All actions are summarized and should be viewed inits entirety from the videos for a complete and accurate account.

On 10-24-15 just before 9:42 p.m., Key West Police put out a BOLO on their radio channel tolook out for a black colored mustang headed out of the city of Key West. A suspect from anarmed robbery in the city from weeks prior was believed to be in the vehicle. The suspectTimothy E. Thomas, and the black mustang, had previously been observed in the city of KeyWest by a citizen and MCSO employee Deonte Stemage, whom called KWPD two times toreport the sighting. The second time, Stemage reportedly saw the vehicle headed out of thecity into Stock Island.

Deputy David Lariz, whom was working the Stock Island area with Dep. Gordon, heard theradio traffic from the KWPD, as he was scanning his police radio channels. Lariz and Dep.Gordon decided to sit at the “triangle” entrance to Key West, in an attempt to observe thevehicle leaving the city. A short time later, Lariz followed and checked a silver coloredMustang leaving the city, which ultimately turned out not to be the suspect vehicle.

About that point, the suspect vehicle – a black colored Ford Mustang - was spotted on StockIsland out bound by Deputy Joshua Gordon. Gordon began to follow the vehicle and DeputyDavid Lariz responded to back him up from the Boca Chica bridge area where he hadfollowed the other Mustang. At that time, Deputy Gordon took note the tag attached to theblack Mustang FL-452-QEL was in fact a stolen tag from a report he himself had taken on aprevious date 10-23-15 case # 15-6588.

The suspect driving the black Mustang, identified as 25 year old Timothy Eugene Thomas ofKey West, spotted Dep. Gordon following him at the intersection of 2nd St and 3rd Ave.Thomas then sped up, fleeing from Gordon down 3rd Avenue, toward 5th Street at speedsgreater than 60 miles per hour in a 25 MPH zone. Thomas drove through the intersection at5th Street and 3rd Avenue, ultimately attempting a right turn north onto Sunshine Street, buthit a stop sign, which stopped the vehicle.

Deputy Gordon exited his patrol patrol car in an effort to detain the suspect. Thomas thenexited his vehicle from the driver side door showing one left hand, as Gordon was shoutingcommands to show his hands. Thomas then went back into the mustang and then exiting,raised his right hand and began firing multiple gunshot rounds at Deputy Gordon, onestriking Gordon in the chest causing Gordon to fall to the ground near his patrol vehicle,while returning fire toward the suspect Thomas. At this time, Deputy Lariz arrives on scene,

exiting his vehicle and further returns fire toward the passenger side of the Mustang andThomas. Thomas was able to maneuver the vehicle at that time away from the sign post andflee north on Sunshine St. while still firing at least six more gunshot rounds from his driverside door. During this exchange, Dep Gordon was able to retrieve his long gun from his patrolvehicle trunk and return fire toward Thomas, firing at least three rounds.

Deputy Gordon and Deputy Lariz after assessment of the situation and their conditions,return to their respective vehicles to pursue Thomas in the Mustang, finding it abandoned at2nd Avenue and 5th Street, just a short distance away. Thomas apparently fled on foot priorto their arrival. Upon clearing the vehicle, blood was found in the abandoned car, indicatingThomas may have been injured in the exchange of rounds. There were no other passengers inthe vehicle at that time. An extensive initial search of the area failed to locate Thomas.

On Saturday, October 24, 2015 in the late Kiera James came to my Big Coppitt residence. Ihave known Ms. James for several years as at one point in time she was a student of my wifeJennifer, who is employed with the Monroe County School District.

At the time, Ms. James appeared to be upset as she indicated she had her cousin TimmyThomas on her cellular phone at the moment who was apparently seeking her advice. Ms.James stated Thomas advised her he had been involved in a, "...shoot out with the cops..."She also stated he advised her he had been shot as well.

At the time, Thomas was allegedly somewhere behind the Tom Thumb Food Store on StockIsland,n possession of a handgun and was asking her advise as to what he should do. Ms.James posed the question to me at which time I advised her to tell him to drop the weapon,spread his arms wide with his hands open, slowly walk from wherever it was he was hidingand once clear, drop to his knees then face down to the ground and fully cooperate with theinstructions of any law enforcement officer.

Ms. James relayed this information to Thomas and was met with some resistance as sherepeatedly told him, "You have to do it or they're going to kill you!"

Over the course of several minutes,Ms. James continued her conversation with Thomasencouraging him to surrender. At one point she indicated Thomas was no longer behind theTom Thumb Food Store and was likely in the Big Coppitt area at his girlfriend's apartmentwhich was right up the street from my Avenue D residence.

This information was relayed and units converged to that area. After a thorough search,Thomas was not located. It was then indicated Thomas' cellular phone was "pinging" in the

October 25, 2015I met with Detective Fraser in the Big Coppitt area reference information received on thelocation of subject Timothy Thomas. Detective Fraser and I surveilled different areas of BigCoppitt.

Information was learned that Timothy Thomas was hiding in a residence on Von PhisterStreet in the city of Key West.

Detective Fraser and I relocated to Washington and Ashby Streets in Key West, meetingmulti agency officers and agents.

I was asked to park on the corner of Von Phister and George Street. I parked my vehicleacross from 1713 Von Phister Street in Key West. A black male exited the house adjacent to1713 Von Phister, numbered 1711 Von Phister Street. The subject had a mobile device inhand. He walked along Von Phister towards Ashby Street. That subject was later identifiedas David Gray, Sr.

Communications were established with subject Timothy Thomas. KWPD negotiators wereable to persuay Thomas to walk out of the residence. The subject was taken in to custody andtransported to Lower Keys Medical Center via rescue.

I took in to custody of a backpack subject David Gray, Jr. was carrying. Subject attempted toleave 1711 Vonphister through the back of the house. The subject was apprehended andtaken in to custody for narcotics. (See MCSO15OFF6625)

The green backpack containing miscellaneous items (item # 45) was entered in to evidence onMCSO property receipt # 157583. Also entered in to evidence are the following:

Empty 9 mm Glock magazine, Item # 46LG mobile phone, Item # 47

I relocated to Lower Keys Medical Center. I arrested Timothy Thomas for two active out ofcounty warrants. (See MCSO15OFF6631 and MCSO15OFF6632).

Thomas was transported by Sergeant Rodriguez with KWPD to the Monroe CountyDetention Center without incident.

I returned to the primary scene on 10/27/2015 in regards to a report of bullets /bullet holes in a business located at the scene. The business front of Lonnie HensleyAutomotive Repair had two ( 2 ) , what appeared to be bullet holes in the front door. One ( 1) bullet had struck the upper most portion of the door and lodged into it. Another ( 1 ) bullethad passed completely through the lower most portion of the door, passing completelythrough and coming to rest on the floor inside the business. I recovered the bullet from thefloor that appeared to be of 9mm caliber. The bullet that struck the upper door hadfragmented and only the copper jacket was lodged into the wood. The jacket appeared to beconsistent with a 9mm caliber bullet. Those items were collected, in the presence and with thepermission of the business owner and in the presence of FDLE Agent Quad, as evidenceunder P.R. # 156352 and entered into the F7 portion of this report as follows

2- 9mm bullets / fragments from door of automotive business at primary scene

While at that scene it was reported that the house on the corner of 2nd Avenue andSunshine Street ( directly behind the STOP sign where the suspect vehicle had stopped, hadbeen struck by bullets / fragments. With the residents permission and in his presence, and inthe presence of FDLE Agent Quad, I was able to locate and collect bullets/ fragments fromthe exterior of the house. The bullets / fragments appeared to be of .40 caliber I collected andtook custody of those items on P.R. # 156356 as follows ;

3 - fired / spent .40 caliber bullets recovered from exterior of house

After the bullets / fragments were recovered and secured, as Agent Quad spoke with theresidents of the house, a youth who resides at that address came forward with two ( 2 ) empty/ fired .45 caliber 'Federal' cartridge cases that he had picked up at the original scene beforeDeputy Curry arrived to secure that scene. The youth admitted that he had called the localnews station and had shown the cartridge cases to a reporter. Those cases were collected andentered as evidence in the F7 portion of this report under P.R. # 156352 as follows;

2 - ..45 caliber fired / empty 'Federal' cartridge cases

Later that same day, at the MCSO Crime Lab, in the presence of FDLE Quad and MajorCrimes Detective Cuervo, I cut into the ballistic armor trauma plate, worn on the night of theincident by Deputy Gordon, and recovered what appears to be a 9mm bullet from the fibersof the trauma plate. The bullet is entered as evidence in the F7 portion of this report andunder P.R. # 156352 as follows ;

1 - 9mm fired / spent bullet recovered from the trauma plate of Deputy Gordon'sballistic armor vest Later on this same day I went to the MCSO Impound Lot where the vehicle was secured.I used trajectory rods and tape to mark each hole and determine the approximate angles oftrajectory, from the outside of the vehicle, to better process the evidence recovered. I photodocumented the process.

I returned again to the primary scene, with FDLE Agent Quad and Major CrimesDetective Cuervo on 10 /29/2015, to search for additional evidence. After viewing the 'in car'videos of both Deputies it became clear that additional shots had been fired after the Deputieshad disengaged the suspect and he ( suspect ) was fleeing the scene. Evidence indicates thatthe suspect fired six ( 6 ) additional shots as he fled down Sunshine Street before it makes acurve and becomes named as 3rd Avenue. Along the left / lower side of Sunshine Street,approximately one hundred twenty ( 120 ) feet from the intersection of 2nd Avenue andSunshine Street, I found, and photo documented two ( 2 ) empty / fired 9mm 'Hornady'cartridge cases. Further down that street, in the curved area, on the right / upper side of theroad, I found one ( 1 ) more 9mm empty / fired 'Hornady' cartridge case. I used a metaldetector and the assistance of two ( 2 ) other FDLE Agents searching on foot, but no otherevidence was found. Those cartridge cases were collected and entered as evidence in the F7portion of this report and under P.R. # 156356 as follows ;

3 - empty / fired 9mm 'Hornady' cartridge cases from the sides of Sunshine Street.

On 10/30/2015, a Search Warrant for the interior of the vehicle was obtained. Inthe presence of and with the assistance of FDLE Agent Quad and Major Crimes DetectiveCuervo I photo documented and completed a complete search of the car, it's interior, andinternal parts, for evidence relating to the crime. It was evident from examining the exteriorof the car that, black, was not the original color. The vehicle had been bright yellow beforesomeone ( s ) had spray painted it black with spray cans.

To recover all the bullets I followed the trajectories suggested by the rods I hadpreviously used to indicate the bullet holes, I used a 'sawzall' and crowbars to cut and chiselthe vehicle fenders, steering wheel, front and rear windshield, vehicle roof supports, seats anddash areas. I did locate and collect bullets / bullet fragments from several areas and enteredthem as evidence in the F7 portion of this report. All the items are listed on P.R. # 156359 asfollows

On October 24, 2015 I received information in regards to a deputy who had just been shot inthe Stock Island area.

Recognizing the shift on duty was previously the same I had supervised I immediately turnedon my department issued radio and upon confirming the information based upon radio trafficI responded to the E.R. of Lower Keys Medical Center.

Upon my arrival Rescue 8 was backing into the bay of the hospital and Deputy Curry wasexiting his patrol vehicle parked near the bay.

I confirmed with Deputy Curry that Deputy Gordon had been shot and stood by as he exitedthe rescue truck.

Deputy Curry and I escorted Deputy Gordon into the emergency room where he was takeninto an exam room for treatment. I then advised Deputy Curry I would remain with DeputyGordon for the rest of the night, so he could return to assist with the search for the suspect, ifapproved by Deputy Williams, who was the O.I.C. of the scene at the time. Deputy Curry wasthen relieved of his assignment to Deputy Gordon.

I explained to Deputy Gordon I would have to take all of his clothing , vest and weapon intomy possession as all were of significant evidential value. All items were placed into a largeplastic bag and remained within my view and control for the duration of the hospital stay.While Gordon was being examined by the medical staff I notified Captain Phelps who advisedshe would respond to H.Q. to meet with me and Deputy Gordon.

I then made contact with Sgt. Trevor Wirth, at the request of Gordon , briefed him of thesituation and asked him to respond to Gordon's home to personally notify his family of theincident. Sgt. Wirth advised he would stand by with the family until they were able to maketelephone contact with Gordon and to assist them with any of their needs or request.

I took two photographs of Deputy Gordon, the first is of the injuries to his chest from theimpact of the shot fired into his vest and a second of him with his vest and internal shockplate. I have forwarded the photographs to F.D.L.E. Special Agent Mid Quad as well asDetective Cuervo.

Once Gordon was released from Lower Keys Medical Center I drove him and the evidence toH.Q. and waited for Special Agent Mid Quad from F.D.L.E. to arrive in order to conduct his

investigation. Once the Quad had completed his documentation of Gordon's weapon it wassecured , with all of his clothing and duty gear by Captain Phelps until retrieved by DetectiveUnderwood. I witnessed as Detective Underwood cut through the evidence seal on the door ofour double-locked supply room door to take possession of the evidence.

The first notice of injury was completed by me and returned to Lower Keys MedicalAdmissions staff for processing this same evening.

On October 26, 2015 I advised Executive Assistant Tamara Snider I had made an error in theinitial NOI as a I failed to note the injuries Gordon sustained to his hands during the incident,she immediately added the notes to the paperwork.

I took no other action in this investigation.

It is important to note that all of the empty/fired cartridge cases from the suspect's9mm handgun were each and every one, all had the 'Hornady' name brand on the headstampof the cartridge cases.

It is important to note that all of the recovered empty cartridge cases, from thesuspect's gun and from the handguns of the Deputies, all, bear the firing pin impressionsconsistent with 'Glock' hand guns.

It is important to note that all of the recovered fired/ spent bullets/ fragmentsrecovered at all the scenes and and all follow ups with this case including all of the Deputiesand all of the suspect's,, all show the distinctive 'polygonal' bore pattern ( lands and grooves )consistent with 'Glock' handguns. The ending total rounds fired / recovered are as follows ;

9mm ( believed to be from suspect's 'Glock' handgun )------- 4 fired/spent bullets /fragments ------ 9-fired/empty 'Hornady' cartridge cases

.40 caliber ( believed to be from Deputy Gordon's 'Glock' handgun ) ------- 12fired/spent bullets/fragments -------- 11 fired/empty 'Federal' cartridge cases

.45 caliber ( believed to be from Deputy Lariz's 'Glock' handgun ) ------ 7fired/spent bullets/fragments -------- 6 fired/empty 'Federal' cartridge cases

There was a total of twenty four ( 24 ) bullets strikes / holes in the suspect's car. There was a total of five ( 5 ) bullet strikes / holes from the suspect's handgun ( includingthe one ( 1 ) in Deputy Gordon's vest ) two ( 2 ) in the wall along 3rd Ave, and two ( 2 )into the door of a business located on 3rd Ave. There was a total of three ( 3 ) bullet strikes in the house exterior at the corner of 3rd Aveand Sunshine Street.

On Wednesday, November 4th, 2015, all items collected by this Office connected to this case

On Saturday, October 24th, 2015 at approximately 9:30p.m. I received information fromDeputy Lariz that the Key West Police Department had reports of an armed robbery suspect,Timothy Thomas, was within the city limits and driving a black Ford Mustang. Prior to thisincident I received an inter-agency email containing BOLO information about TimothyThomas. This BOLO indicated that Timothy Thomas may be in possession of a handgun andhad made comments threatening violence against law enforcement. The BOLO informationalso contained several photographs of Timothy Thomas. I positioned my marked MonroeCounty Sheriff’s Office vehicle in the center median at the entrance to Key West on U.S.Highway One facing outbound traffic. My vehicle was positioned adjacent to Deputy Lariz’smarked Monroe County Sheriff’s Office patrol vehicle. Deputy Lariz observed a vehiclematching the suspect’s vehicle description and began to follow it northbound and I remainedin the center median. At approximately 9:42p.m. I observed a black Ford Mustang leavingthe city of Key West traveling northbound on U.S. Highway One. I pulled my patrol vehicleonto U.S. Highway One and began to follow the vehicle northbound.

While following the vehicle I observed that it displayed Florida license plate #452QEL. (TheBOLO had indicated a tag # of 452-DEL). Additionally, I immediately recognized that theFlorida license plate affixed to the rear of the suspect vehicle was stolen as I was theinvestigating Deputy of its reported theft on Friday evening, October 23rd, 2015. I radioeddispatch and advised them of the license plate affixed to rear of the suspect’s vehicle. Dispatch verified via radio that the license plate was listed as stolen. I continued to follow thesuspect’s vehicle on U.S. Highway One and as it turned onto MacDonald Avenue located onStock Island. I continued to follow the suspect’s vehicle as it turned right on 2nd Street. Thesuspect’s vehicle came to a complete stop at the intersection of 2nd Street and 3rd Avenuebefore it turned right. I was behind the suspect’s vehicle when it accelerated to an extremelyhigh rate of speed in the 25 m.p.h. posted residential speed limit zone. I activated myemergency lights and sirens in an attempt to conduct a traffic stop on the suspect’s vehicle. The suspect’s vehicle continued to accelerate reaching speeds of approximately 70 m.p.h. Ipursued the suspect’s vehicle in my marked patrol car with my emergency lights and sirenactivated. I observed the suspect’s vehicle continue on 3rd Avenue and cross the intersectionof 5th Street without stopping at the posted stop sign.

I observed the suspect’s vehicle crash into the stop sign and fence in front of a residentialhome located on the northwest corner of the intersection at 3rd Avenue and Sunshine Street. As I approached I observed the suspect’s vehicle attempting to back away from the damagedstop sign and fence it had struck. I positioned my marked Monroe County Sheriff’s Officepatrol vehicle directly behind the suspect’s vehicle in an attempt to prevent it from escaping. I turned off my audible siren and left my emergency overhead lights activated. I exited mypatrol vehicle with my handgun drawn and was wearing my department issued MonroeCounty Sheriff’s Office class B uniform with full insignia.

The suspect, who I immediately recognized the suspect to be Timothy Thomas, quickly exitedthe driver’s side, front seat of the black Ford Mustang without my prompting. The suspectwas wearing a black shirt and had a shaven head. I issued the suspect several loud, repetitiveverbal commands to show his hands. The suspect initially complied and raised his left handwith nothing in it. The suspect then quickly ducked back into his vehicle, drew a handgun,and fired several gunshots at me. Being in fear for my life, I quickly returned fire from myhandgun at the suspect to stop his violent threat and in defense of myself as I attempted tomove away from his directed gunfire. While moving away, I felt the impact of the suspect’sgunfire strike me in the center of my chest. Even though I was wearing a protective vest theimpact knocked the wind out of me and knocked me down to the ground. I fell on my back;however, I continued to return fire at the suspect as he attempted to go further into hisvehicle and close its door. I quickly relocated to the rear of my patrol vehicle for cover as Iobserved Deputy Lariz attempt to flank the suspect on the passenger side of the vehicle. Iaccessed the rear trunk of my patrol vehicle and retrieved my S.W.A.T. issued AR-15 carbineas Deputy Lariz was returning gunfire at the suspect. I observed the suspect flee in the FordMustang in a northbound direction on Sunshine Street. I heard several gunshots comingfrom the direction of the Ford Mustang as it fled. I fired my carbine at the suspect in anattempt to stop him as he was still an armed threat and was heading toward the direction ofother responding Law Enforcement Officers.

Deputy Lariz quickly accessed my condition and I retrieved the spent handgun magazinesthat were on the ground and placed them into the trunk of my patrol vehicle. I entered mypatrol vehicle and pursued the suspect down Sunshine Street. I observed the suspect’s blackFord Mustang stationary at the intersection of 2nd Avenue and 5th Street. I advised dispatchof the vehicle’s location and waited for Deputy Lariz to arrive. Deputy Lariz arrived and weutilized his patrol vehicle as cover to get closer to the suspect’s vehicle. I observed that thedoors were closed and that it was difficult to see inside the vehicle due to the window tint anddamage. Deputy Lariz, members of the Key West Police Department, and I safely positionedaround the vehicle to ensure no one was inside. As I approached the suspect’s vehicle I couldnot see inside to determine if anyone was in the back seat. I broke the rear passenger sidewindow to see inside. After checking the front and rear seats of the vehicle, we searched thevehicle’s trunk. No one was located inside the vehicle.

Responding units from various agencies arrived and we began to organize in an effort tolocate the suspect. Medical personnel from Monroe County Fire Rescue arrived on scene andI entered the ambulance to be evaluated. I removed my issued Kevlar vest and observed thata bullet appeared to be wedged inside of the soft trauma plate insert located in the frontcenter of the vest. I had an abrasion and redness across the center of my chest near thebottom of my sternum. I observed a large cut on the knuckle of my left index finger. AfterMedical personnel checked my vital signs and bandaged my finger I was advised that Ineeded to report to Lower Keys Medical Center to be evaluated. I gave my agency issuedS.W.A.T. carbine to Deputy Williams and advised him that it was utilized in an effort to stopthe suspect. I gave the keys to my Sheriff’s Office patrol vehicle to Deputy Curry and left thescene in the ambulance.

I was met at Lower Keys Medical Center by Sgt. Hernandez and gained admittance fortreatment. While preparing to receive medical treatment I turn my handgun, remaining

magazines, ammunition and the rest of my duty belt over to Sgt. Hernandez as evidence inaddition to my Monroe County Sheriff’s Office uniform with attached insignia. I was treatedfor the injuries sustained to my chest and finger by hospital staff members. I was medicallyreleased from the hospital and taken to the Monroe County Sheriff’s Office Headquarters.

At 15:00 hours on 11/04/2015 I met with the State Attorney Vogel and SAOProsecutor Madruga, Major Crimes Detective Cuervo, and Key West Police Detective Deanat the Key West Police Headquarters, to examine and review all the evidence collected thusfar in this case. Because K.W.P.D. made the actual arrest of the suspect Thomas within the confines of thecity, the case has a separate number from the one MCSO has assigned. The MCSO case # is15OFF006614. The Key West case # is 15-4797. At that meeting, in the presence of all Officersnamed, I opened evidence item # 57 ( which is item # 45 in the MCSO case file ), that is onegreen canvas backpack belonging to the suspect Thomas. The backpack was empty. There arestains that appeared to be blood on the backpack. I photo documented the backpack and thenremoved two ( 2 ) small cuttings from the material in the areas of blood stains. Those cuttingswere packaged for submission to FDLE on KWPD property receipts as item # 60. Thebackpack was then repacked by Detective Cuervo in it's original container.

All photos are entered into the MCSO VERIPIC Program. Copies of all photoshave been made and delivered to Detective Cuervo.
