ENDORSEMENT
Sub: With regard to issue endorsement regarding permission/ NOC requested to useground water for commercial and industrial purpose through well/borewell.
Ref: 1. Your application dt: 08-01-2018.2. As per Column No. 11 of Karnataka Ground Water Act, 2011 and Rules,2012.
3. Govt. Letter No. 08 GW2017 dt: 19-07-2017.4. Proceedings of the meeting of Karnataka Ground Water Authority held on30-05-2017 letter No. KGWA/ MEETING/ 2017-18/1800-1820.
With regard to the above subject and reference M/s. Shree Cement Ltd.,Benkanhalli&Kodla Village, Sedamtaluka, Kalaburagi district, in order to use groundwater in their industrial premises through borewells, submitted request letter to thisOffice for permission/ NOC vide ref.1 is appropriate.
As per Column No. 11 of Karnataka Ground Water Act, 2011, Permission/ NOC for thefor the usage of ground water from proposed new borewells and existing borewells has tobe obtained for the borewells coming under notified areas/ talukas. But, there is no anynotified areas/ talukas in Kalaburagi district.
As per ref. 3, in order to dispose the applications received from the commercial andindustrial units, Hon’ble Chairman, Karnataka Ground Water Authority, discussed in themeeting on 30-05-2017 and issued proceeding. As per proceedings para 11(1), forapplications received in non-notified areas/ talukas, it is intimated to dispose theapplications by giving endorsement as per ref.4.
Accordingly, as per column 11 of Karnataka Ground Water Act,2011 and since there areno any notified areas/ talukas in Kalaburagi district, it is intimated that there is noopportunity to issue permission/ NOC for use of ground water in your unit throughexisting borewells.
