Introduction
What is Planning Permission?– The authorisation to carry out development– Planning conditions to control development– A method for enforcement and regulation– Achieved through a planning application

Planning Permission
Who needs it?– Are the proposals ‘development’?
• The carrying out of building, engineering, mining or other operations in, on, over or under land
• The making of any material change in the use of any buildings or other land
– Are the proposals permitted?• General Permitted Development Order 1995 (Part 6
Agricultural Buildings and Operations)

Planning Permission
Is it required for Anaerobic Digestion?
YES– Importing biodegradable waste is a change of use– Engineering works and buildings, including
weighbridges and portable units– Changes to a facility such as a bigger area or
increased inputs.
MAYBE– Utilising waste arisings from within the farm unit

A Successful Planning Application
What makes a successful planning application?• Choosing the right site• Creating the right proposals for the site• Engaging with the planning application process
to satisfy the requirements of the local planning authority, the community and other organisations
• Taking account of the other relevant regulatory matters

A Successful Planning Application
Is a site physically suitable?– Distance from sensitive receptors / neighbours– Site visibility– Sensitivity of the surrounding landscape– Ecology, nature and heritage conservation– Noise, dust, odours and bioaerosols– Surface and groundwater sensitivity– Flood risk– Traffic and access implications

Does the site comply with planning policy?– National Waste Strategy 2007 and Energy White
Paper 2007– Green Belt; National Parks; Areas of Outstanding
Natural Beauty; Sites of Special Scientific Interest.– Regional and local level planning policies– Need for the proposed facility– Sources of waste within a defined catchment area– Destination of end products

Environmental Impact Assessment (EIA)– For large proposals or those in sensitive locations– Schedule 1 development - mandatory– Schedule 2 development - discretionary
• Paragraph 3 (a) - Energy projects: area exceeds 0.5 hectare• Paragraph 11(b) - Other installations: area exceeds 0.5
hectare, is within 100m of a controlled water
– Circular 2/99 Guidance• Power stations - EIA is unlikely for low output units• Waste operations - EIA is more likely where inputs are more
than 50,000 tonnes per annum or the site is more than 10 hectares

Consultation– Pre Submission Consultation
• Local planning authority and highways authority• Environment Agency• Local community • Meetings, site visit, visits to demonstration projects
