The decision wasgiven Friday.

    :=; Oddly enougl1, the decision, ai~ though precisely nullifying sections: of the code under which an effort:: was made to con trol the nature of

    occupancy of buildings, is not a rea lsetback to that principle, because al at er act o f the Leg is la tu re givesfirst-class townsllips the power of"zoning," which covers it.

    In t he bui lding code of LowerMerion, f irst passed in 1919 andlater re-enacted with some changesin 1921, regulations were providedfor light and air space for dwellingsdifferent from business buildings.

    The Harrisons, after startingconst ru ct ion o f t he ir building withstores on the first f loor and apart-ments on the second, changed thedimensions of a l ight well. Township officials advised them the workcould not proceed on that basis.

    The builders said they intended

    to Use the whole structure for business purposes, but some monthsa ft er i t was f ini shed the bu ildinginspector discovered that four families were l iving in the rea r apa rtments.

    . N otification was sent to all t ovacate, on the ground their occupancy violated the building code.The litigation, however, was finallyconducted only against the ownersof the buildings, starting with a suitbefore Magistrate H. E. Stillwagon,a t Ardmore, who fined them $25.On appeal the fine and the principleinvolved wer e susta ined by t helVlontgomeryCOl1nty Common PleasCourt.

    The Superior Court tookthe position that the legislative act providingfor building regulation in first-classtownships conveyed just that powerand no more; a power to regulatethe nature and strength of foundations, thickness of wal1s, fireproofingand similar factors of strength and

    public safety, but not to regulate theoccupancy of any building after i twas completed.

    Meantime the Legislature of 1923passed another law authorizing firstclass townships to enact "zoning"ordinances, Lower Merion is nowtaking the lead in this, with a zonmgcommission, of which Major JohnLewis Evans, of Haverford, a former township commissioner, ischairman.

    The zoning ordinance will supplement the building code, establishingby law restricted residence zones,"half-anel-half" zones and businessand manufacturing-localities, andmay restore the right of the township building regulation departmentto control the character of c o n s t t U C ~tion in buildings with respec t tooccupancy.

    EXPLANATIONS OF DRAWINGS

    In the basement the presentk it chen wil l be enlarged and newequipment added. Th e socialroom, which will be used for agymnasium as wellas for other s o ~cial purposes, will extend from thebasement to the second floor witha cei ling height of 20 f eet .     The perspect ive sketch showsthe bui ld ing as it will eventuallybe developed along Windsor avenue. Studies have also been madeto p rov ide f or a ne w t ow er on t hecorner of \ iVindsor and Graylingavenues. Th e new bui ld ing is tobe of Foxcroft s tone with Indianal imes tone t rim, mul li oned windows, metal casements and leadedglass, the design being a modifiedform of English Tudor.

    N o one whit dismayed by thiscatastrophe, the congregation rallied round their officers and a temporary building was erected in theb ri ef space o f one week and services resumed Januarly 19, 1896.
