Official sources told the Excelsior that the Cabinet Sub Committee on implementation of Agenda of Alliance of PDP- BJP Government had referred the issue of working out modali- ties for setting up of Delimitation Commission to a high-level bureaucratic panel, which has worked on various theories on composition and mandate (of the Commission). A final decision was now expected to be taken very short- ly. Though increase in total number of Assembly con- stituencies has been barred in the State like other parts of the country since 2002 when J&K Legislature adopted a Constitutional amendment (approved by the Parliament) to freeze number of Lok Sabha and Assembly seats till 2026, Jammu and Kashmir has the powers to revoke the law through another Constitutional amendment with 2/3rd majority and go for increase in total seats. However, the State can also set up the Delimitation Commission to re-adjust boundaries of Assembly con- stituencies and rotation of seven seats reserved for Scheduled Castes in total 87 Assembly seats in the State. Though a reserved seat had to be rotated after every two elec- tions, in J&K, the reserved seats have not been rotated during the past four Assembly elections. Noting that setting up of the Delimitation Commission is on agenda of the PDP-BJP coalition Government, sources said that composition of the Commission is being worked out but most likely it would comprise non- political persons like top retired bureaucrats representing all three regions of the States including Jammu, Kashmir and Ladakh. "The PDP-BJP coalition Government with the support of Independents has two-third majority in both Houses of the Legislature and they can easily pass a Constitutional amend- ment bill to set up Delimitation Commission,'' sources pointed out but said the Government would evolve a consensus on mandate and composition of the Commission before going to the Legislature. It was in early nineties when last Delimitation Commission was set up in Jammu and Kashmir. It had increased num- ber of Assembly seats of the State from 76 to 87 (Jammu from 32 to 37, Kashmir from 42 to 46 and Ladakh from 2 to 4). Official sources said that Pooja Express train was today can- celled as it was late by 12.30 hours. Intrusion bid foiled, one nabbed Excelsior Correspondent JAMMU, Dec 13: The BSF last night foiled an infiltration attempt by a group of four to five militants in Ramgarh sector of Samba district and apprehended a former Pakistan army personnel while other militants retreated to Pakistan. Official sources said alert jawans of the BSF noticed movement of four to five militants inside Pakistan territory close to the International Border in Ramgarh sector last night and became alert. They fired para illuminating bombs to lit up the area. Finding the BSF jawans alert, the militants, who were trying to infiltrate into the Indian territory under the cover of dense fog and thick sarkanda growth, retreated to Pakistan. The hurried decision in this regard was taken in wake of the theft of question papers of History, Physics and Education, from Government Higher Secondary School, Reasi. Ex-gratia for Burhan Wani’s kin SRINAGAR, Dec 13: The State Government has cleared ex-gratia to next of kin of 17 persons, including Hizbul Mujahideen militant Burhan Wani's brother, killed in militancy-related incidents in the Valley, while giving one week's time for filing of any objection before formal orders are issued. Burhan Wani's killing by security forces in an encounter in South Kashmir's Kokernag area on July 8 this year triggered unrest in the Valley which has left as many as 86 people dead. According to a notification issued yesterday by Deputy Commissioner Pulwama, ex-gratia relief under rules has been cleared by the District Level Screening-cum-Consultative Committee (DLSCC) in favour of next of kin of those persons who Sinha pitches for dialogue to resolve J&K issue Excelsior Correspondent SRINAGAR, Dec 13: Former Union Minister and Bhartiya Janta Party (BJP) leader, Yashwant Sinha, today said talks and not bullet are the only way forward for reso- lution of Jammu and Kashmir issue. Speaking to reporters here after concluding his second visit to Kashmir valley, Sinha said his delegation met cross-section of people including youth and asserted that dialogue is the only way forward. "See, like last time, wherever we went this time and met people, I told them in the beginning that we have come to attach ourselves with your pain for the sake of human- ity," he said. Sinha, who is former External Affairs Minister of India, said they conveyed to the people whom they met that they have no Government mandate and have come to Valley as "con- cerned citizens of India". "We have not come with anyone's mandate and we haven't come with any authority but we have to come to attach ourselves with your pain and agony as con- cerned citizens of India," he said. The delegation head, who for the first time arrived in Valley in the month of September and called on both moderate and hardline separatists, said the talks went ahead only after they conveyed to people that there is no Government backing to the delegation. "Having said this, it is obvious that talks went ahead and we keenly heard them (peo- ple)," he said. Sinha said that at every place and in every meeting, "people said that the basic reason of their pain is perhaps that no solution has been found for the issue of Jammu and Kashmir from last 70 years, a solution should come out of this issue and then auto- matically everything would be normal". He said they told the people that the way for finding solution of any issue is holding mutual talks and "we should talk to each other". "And when we will talk to each, the solution of the issue will come out," he said, adding: "bandooq ki goli se nahi niklega par pyaar ki boli se niklega (the solution won't come out through bullet of gun but through lan- guage of love)." Sinha said he believed most of the people were happy after hearing that language of love is the way forward for settling issue. "They (people) said 'you are very right and we should move ahead on this path'," the former Minister said. The former Union Minister said: "So, whatever talks they have had in these three days, it was good and the talks were also held with people who had come from far-flung areas. The local youths also attended several meetings and talks were held with them as well," he said. The delegation head said that he admitted there is lot of pain in some people's minds. We understood their Infiltration up, 116 militants sneak in Fayaz Bukhari SRINAGAR, Dec 13: The infiltration of militants into Jammu and Kashmir has gone up this year despite Army being on high alert along the Line of Control (LoC) and militants are making desper- ate attempts to sneak in as they suffered record number of casualties this year. According to Multi-Agency Centre (MAC) figures, 116 mili- tants, mostly belonging to Lashkar-e-Toiba (LeT), have infil- trated into Kashmir this year till November while last year the number was 35 for the whole year. However, sources said that it is a conservative estimate and the figure could be more than the offi- cial one. Sources said that some of the recently infiltrated groups are yet to come under security forces radar and others are still in the forests along the LoC. The infiltration attempts are still going as militant launch pads are active despite first snowfall along the LoC. Sources said militant training camps are active in PoK with 19 of them most active including those at Skardu, Kel, Karko, Dullu, Titwal, Chakoti, Kotli, Dehri, Barhal Mirpur and Chaprai. In these training camps, the mili- tants are receiving rigorous training besides map reading, GPS use, weight, weapon and tactical training. Sources said that as a record number of militants have been killed this year and militants are desperate to infiltrate in more numbers to fill the void. They said that over 200 militants are still waiting at launch pads for infiltra- tion before the heavy snowfall closes the mountain passes. According to official figures, 147 militants have been killed this year so far while last year the figure for the whole year was 97. The killed include 40 of this year's infiltrated militants. As per the official figure, this year 71 security force per- sonnel were killed along the LoC, International Border and hinterland, in Pakistani troops firing and during gun battles with militants. The figures suggested that 76 locals joined militancy this year and 16 of them were killed and surrendered leaving 60 still active. Majority of them joined after July 8 following the killing of Hizbul Mujahideen com- mander Burhan Wani. Army has intensified its vigil along the LoC and already two Brigades of Army have been sent to LoC in North Kashmir to take on the infiltrated militants and one more brigade of Army has been sent to South Kashmir after increased militancy in the area. Most shocking aspect is that even the Government build- ings are flouting the law open- ly right under the nose of the concerned authorities. The issue of strict enforce- ment of The Water (Prevention and Control of Pollution) Act, 1974 and installation of individual STPs by the hotels, guest houses and lodges came to the fore when the Division Bench of the State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan was hearing a Public Interest Litigation (PIL) highlighting encroachments on banks of River Tawi and its pollution due to unchecked flow of effluent from the commercial establishments, in the third week of last month. The Division Bench had noted with concern that for the last two decades countless hotels, guest houses and lodges came up in the City of Temples and majority of such establish- ments have been contributing to the pollution of sacred River Tawi by allowing the effluent to flow into the river. With these observations, the DB had put three agencies of the State Government--- Pollution Control Board, Jammu Municipal Corporation and Tourism Department in the dock as Pollution Control Board has the mandate to ensure imple- mentation of provisions of The Water (Prevention and Control of Pollution) Act while as Jammu Municipal Corporation is responsible for checking flow of effluent in the River Tawi. Similarly, Tourism Department is the agency han- dling the registration of hotels, guest houses and lodges. However, none of these agen- cies of the State have ever paid any serious attention towards checking this menace, official sources told EXCELSIOR, adding "the most shocking aspect is that they are even not aware of number of establishments which are violating the law". The Pollution Control Board which is the main agency to ensure strict implementation of Water (Prevention and Control No focus on enforcement of W ater (Prevention & Control of Pollution) Act Govt agencies don’t have data about hotels, guest houses lacking STPs *Official buildings too openly violating law Govind Sharma JAMMU, Dec 13: Due to sheer negligence of Microbiology department of Government Medical College and Hospital, Jammu, the State exchequer has suffered a loss of Rs 6.30 crore, an amount which was sanctioned for establishing a BSL 2/3 swine flu lab in the hospital premises, as the department has already a Centrally fund- ed laboratory wherein besides swine flu testing of various other viral diseases can be done. However, both the labs are not in a position to conduct tests for swine flu and the sam- ples are being sent to GMC Kangra, as BSL 2/3 lab is not complete in terms of medical equipments, staff and kits while the department has no testing kits for Centrally fund- ed lab. According to the sources in the administrative department, the proposal to establish BSL 2/3 swine flu lab was moved by Microbiology Department of GMCH Jammu in 2009 after the outbreak of major swine flu epi- demic in the same year but the department didn’t get any response from administrative department. However, due to increasing morbidity and mortality with each passing year and after many reminders to the adminis- trative department, the project was conceived by the adminis- trative department in 2011 but the decision to establish the swine flu lab was taken by the State Cabinet only on March 4, 2015 following which Planning and Development Department sanctioned an amount of Rs 6.30 crore for the said project. Sources said that project was taken on priority and the work on the lab along with isolation wards was completed fully till ending December 2015. In June 2016, the purchasing committee of GMCH Jammu also placed order to J&K Medical Supplies Corporation Limited (JKMSCL) for required medical equipments and testing kits so that the lab may be made functional from this winter season but despite lapse of over five months the Corporation could not provide these essential equipments and as a result, the lab is unlikely to be started from this winter sea- son. As per JKMSCL sources, the Corporation cannot provide these medical equipments in another 5-6 months as the bid is still awaited. “Meanwhile in the year 2013, the Department of Health Research (DHR), Indian Council of Medical Research (ICMR), New Delhi also provided financial grant worth crores for establishing a BSL-2 Virus Research Diagnostic Laboratory (VRDL) to Microbiology Department of the Hospital. Sinha, who is formerExternal Affairs Minister ofIndia, said they conveyed to thepeople whom they met that they

have no Government mandateand have come to Valley as "con-cerned citizens of India". "Wehave not come with anyone'smandate and we haven't comewith any authority but we haveto come to attach ourselves withyour pain and agony as con-cerned citizens of India," he said.

The delegation head, who forthe first time arrived in Valley inthe month of September andcalled on both moderate andhardline separatists, said thetalks went ahead only after theyconveyed to people that there isno Government backing to thedelegation. "Having said this, itis obvious that talks went aheadand we keenly heard them (peo-ple)," he said.

Sinha said that at everyplace and in every meeting,"people said that the basicreason of their pain is perhaps

that no solution has beenfound for the issue of Jammuand Kashmir from last 70years, a solution should comeout of this issue and then auto-matically everything would benormal".

He said they told the peoplethat the way for finding solutionof any issue is holding mutualtalks and "we should talk to eachother". "And when we will talkto each, the solution of the issue

will come out," he said, adding:"bandooq ki goli se nahi niklegapar pyaar ki boli se niklega (thesolution won't come out throughbullet of gun but through lan-guage of love)."

Sinha said he believed mostof the people were happy afterhearing that language of love isthe way forward for settlingissue. "They (people) said 'youare very right and we shouldmove ahead on this path'," theformer Minister said.

The former Union Ministersaid: "So, whatever talks theyhave had in these three days, itwas good and the talks were alsoheld with people who had comefrom far-flung areas. The localyouths also attended severalmeetings and talks were heldwith them as well," he said.

SRINAGAR, Dec 13: Theinfiltration of militants intoJammu and Kashmir has goneup this year despite Armybeing on high alert along theLine of Control (LoC) andmilitants are making desper-ate attempts to sneak in asthey suffered record numberof casualties this year.

According to Multi-AgencyCentre (MAC) figures, 116 mili-tants, mostly belonging toLashkar-e-Toiba (LeT), have infil-trated into Kashmir this year tillNovember while last year thenumber was 35 for the whole year.

However, sources said that itis a conservative estimate and thefigure could be more than the offi-cial one. Sources said that some ofthe recently infiltrated groups areyet to come under security forcesradar and others are still in theforests along the LoC.

The infiltration attempts arestill going as militant launchpads are active despite firstsnowfall along the LoC. Sourcessaid militant training camps areactive in PoK with 19 of themmost active including those atSkardu, Kel, Karko, Dullu,Titwal, Chakoti, Kotli, Dehri,Barhal Mirpur and Chaprai. Inthese training camps, the mili-tants are receiving rigoroustraining besides map reading,

GPS use, weight, weapon andtactical training.

Sources said that as a recordnumber of militants have beenkilled this year and militants aredesperate to infiltrate in morenumbers to fill the void. They saidthat over 200 militants are stillwaiting at launch pads for infiltra-tion before the heavy snowfallcloses the mountain passes.

According to official figures,147 militants have been killedthis year so far while last yearthe figure for the whole year was97. The killed include 40 of thisyear's infiltrated militants.

As per the official figure,this year 71 security force per-sonnel were killed along theLoC, International Borderand hinterland, in Pakistanitroops firing and during gunbattles with militants.

The figures suggested that 76locals joined militancy this yearand 16 of them were killed andsurrendered leaving 60 stillactive. Majority of them joinedafter July 8 following the killingof Hizbul Mujahideen com-mander Burhan Wani.

Army has intensified its vigilalong the LoC and already twoBrigades of Army have been sentto LoC in North Kashmir to takeon the infiltrated militants andone more brigade of Army hasbeen sent to South Kashmir afterincreased militancy in the area.

timony of non-seriousapproach towards strictenforcement of The Water(Prevention and Control ofPollution) Act, 1974, severalagencies of the StateGovernment don't have anydata about the hotels, guesthouses and lodges lackingindividual Sewage TreatmentPlants (STPs), which other-wise are mandatory to checkpollution of water bodies.Most shocking aspect is thateven the Government build-ings are flouting the law open-ly right under the nose of theconcerned authorities.

The issue of strict enforce-ment of The Water (Preventionand Control of Pollution) Act,1974 and installation of individualSTPs by the hotels, guest housesand lodges came to the fore whenthe Division Bench of the StateHigh Court comprising ChiefJustice N Paul Vasanthakumarand Justice Tashi Rabstan washearing a Public InterestLitigation (PIL) highlightingencroachments on banks of RiverTawi and its pollution due tounchecked flow of effluent fromthe commercial establishments, inthe third week of last month.

The Division Bench hadnoted with concern that for thelast two decades countless

hotels, guest houses and lodgescame up in the City of Templesand majority of such establish-ments have been contributing tothe pollution of sacred RiverTawi by allowing the effluent toflow into the river.

With these observations,the DB had put three agenciesof the State Government---Pollution Control Board,Jammu MunicipalCorporation and TourismDepartment in the dock asPollution Control Board hasthe mandate to ensure imple-mentation of provisions of TheWater (Prevention andControl of Pollution) Act whileas Jammu Municipal

Corporation is responsible forchecking flow of effluent in theRiver Tawi. Similarly, TourismDepartment is the agency han-dling the registration of hotels,guest houses and lodges.

However, none of these agen-cies of the State have ever paidany serious attention towardschecking this menace, officialsources told EXCELSIOR,adding "the most shocking aspectis that they are even not aware ofnumber of establishments whichare violating the law".

sheer negligence ofMicrobiology department ofGovernment Medical Collegeand Hospital, Jammu, theState exchequer has suffered aloss of Rs 6.30 crore, anamount which was sanctionedfor establishing a BSL 2/3swine flu lab in the hospitalpremises, as the departmenthas already a Centrally fund-ed laboratory wherein besidesswine flu testing of variousother viral diseases can bedone. However, both the labsare not in a position to conducttests for swine flu and the sam-ples are being sent to GMCKangra, as BSL 2/3 lab is notcomplete in terms of medicalequipments, staff and kitswhile the department has notesting kits for Centrally fund-ed lab.

According to the sources inthe administrative department,the proposal to establish BSL2/3 swine flu lab was moved byMicrobiology Department ofGMCH Jammu in 2009 after theoutbreak of major swine flu epi-demic in the same year but thedepartment didn’t get anyresponse from administrativedepartment.

However, due to increasingmorbidity and mortality witheach passing year and aftermany reminders to the adminis-trative department, the projectwas conceived by the adminis-trative department in 2011 butthe decision to establish theswine flu lab was taken by theState Cabinet only on March 4,2015 following which Planningand Development Departmentsanctioned an amount of Rs 6.30crore for the said project.

Sources said that project wastaken on priority and the work

on the lab along with isolationwards was completed fully tillending December 2015. In June2016, the purchasing committeeof GMCH Jammu also placedorder to J&K Medical SuppliesCorporation Limited (JKMSCL)for required medical equipmentsand testing kits so that the labmay be made functional fromthis winter season but despitelapse of over five months theCorporation could not providethese essential equipments andas a result, the lab is unlikely tobe started from this winter sea-son. As per JKMSCL sources,the Corporation cannot providethese medical equipments inanother 5-6 months as the bid isstill awaited.

“Meanwhile in the year2013, the Department ofHealth Research (DHR),Indian Council of MedicalResearch (ICMR), New Delhialso provided financial grant

worth crores for establishing aBSL-2 Virus ResearchDiagnostic Laboratory(VRDL) to MicrobiologyDepartment of the Hospital.
