OFFICIAL PROCEEDINGS OF A REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE PLEASURE DRIVEWAY AND PARK DISTRICT OF PEORIA, ILLINOIS, HELD AT 6:30 P.M., AUGUST 12, 2020 HELD AT THE BONNIE NOBLE ADMINISTRATION BUILDING.

President Robert Johnson presided and called the meeting to order at 6:39p.m.

All stood for a moment of silence and recited the Pledge of Allegiance.
Jacqueline Petty requested clarification on whether it would be noted in future minutes if Trustees were participating in person or virtually. 5) STAFF REPORTS:
5.A. Executive Directors Report
Cahill thanked those who participated in the Christopher Columbus statue discussion last week. We have received over 250 official comments. The goal is to have a coordinating discussion with planning committee leadership on Wednesday, August 19 prior to the public planning meeting September 1, 2020. Cahill and Willie Howe will research the ability to obtain Zoom link chat transcripts from the public meeting.
Cahill noted that she and Matt Freeman had met with West Peoria citizens and would like to speak with Trustees Joe Cassidy and Joyce Harant to follow up.
President Robert Johnson requested more information about who manages the content released on the PPD Facebook page. Cahill described the marketing strategy of using a Social Media Team that curates marketing content. The team consists of 6 people from different departments throughout the District and Central States Media. Emily Cahill, Rebecca Shulman, Jenny Swanson, Susie Ingram, Brittany Moldenhauer, and a Central States Media representative.
Trustee Joyce Harant raised the issue of paper punch passes that have an expiration date. Karrie Ross stated that paper punch passes are several years old as we have moved on to a scan card format. The constituent should call the main PPD number to access information on the possibility of a refund.
5.B. Planning Monthly Report
Rebecca Fredrickson presented the report and asked if anyone needed clarification.
Trustee Joyce Harant asked about the status of the Dorothy Sinclair plaque.
Fredrickson responded that the plaque will be set at the time of dedication.

Matt Freeman presented the report and asked if anyone needed clarification.
Discussion took place regarding the number of downed trees due to recent storm (by Petty), barbed wire atop tennis court fence in Glen Oak Park (by Snowden).

President Robert Johnson asked for clarification on the progress of the lower Glen Oak Park tennis court project. Freeman and Fredrickson informed the Board that more rock than expected was found during the demolition. This rock will be repurposed into other upcoming projects, including the Donovan Service Building. The rock should be moved by the end of the year. Johnson asked to adjust the timeframe to improve the visual aesthetic of the Park.
Freeman updated the Board on the restrooms and water fountain closure strategy for the remainder of 2020. Discussion took place as to the locations and potential additions of portable toilets. Cahill and Freeman will look at the cost impact of adding portable toilets in additional locations.
Trustee Joyce Harant asked for clarification on the enforcement of mask wearing and social distancing in our parks. Chief Todd Green explained the practice of education to achieve natural compliance. Discussion continued. https://www.facebook.com/481893628530340/videos/782739079147734
Freeman talked about parks, trails and areas that remain open and what areas are closed (in relation to road closures).
5.D. Human Resources Division: 2020 Scholarship Award Winners
Shalesse Pie explained the concept of the Contributions Committee and Fund and announced the 2020 scholarship recipients and their educational plans. $750 was awarded to each recipient.

Pie read thank you notes from each recipient and thanked the members of the Contributions Selection Committee: Scott Loftus, Nicole Lipe, Brittany Moldenhauer.
President Robert Johnson inquired to whether or not there would be Pat Landon and Rhodell Owens Volunteer recognition awards distributed in 2020. Pie agreed to follow up on this project and request nominations for 2020.

7) NEW BUSINESS:
7.A. ICJIA Grant Overview
Cahill expressed her gratitude for the grant which was facilitated in conjunction with Representative Jehan Gordon-Booth. She noted the funds would be designated to three areas: youth, family, and community. The “youth” component would enhance after school programs. These programs would be staffed in part with graduates of the ELITE Adult Re-Entry program.The “family” component would support the Movies in the Park series which travels to eight parks in all regions of Peoria. The “community” component would be designated to security, and would assure an atmosphere of safety in parks.

7.B. Equipment Disposal Ordinance
Karrie Ross presented Ordinance #386 and asked for approval. Vice President Matt Ryan asked for clarification on the manner of disposal. Ross noted that anything having a value exceeding $100 needed Board approval for disposal. Some items will be auctioned, some will be recycled.

Trustee Jacqueline Petty notified the Board that former Trustee, Roger Allen expressed concern regarding “Ladies/Senior Tees” and their current conditions at Newman Golf Course. He would be willing to contribute funds to make improvements. Fredrickson addressed the status and plan to improve these tees. Improvements begin on Friday, August 14 and will continue through the end of the season.

*With Monday afternoon storms, almost every part of Bradley Park was a mess. Trees down, limbsand branches were everywhere. I want to say that I have never been so amazed and gratefulfor the Support Service Crews! Landscape Construction, Heavy Equipment and M and R had allof the large trees removed and the areas cleaned up by 1:00pm. And to add to the list, JDRussell, pitched in for a couple of hours and helped pick up limbs, sticks and debris! We can’tsay THANK YOU enough to them. The Bradley Park Crew wants to let them know how awesomethey are, and what a big help they were!

*Our annual native plant sale is at Tawny Oaks TOMORROW from 9am to 4pm. Check it out... it's a great place to get some eco-friendly native plants... and you can take a great hike while you're there. *Forest Park Nature Center is now offering curbside pickup for birdseed. Check out their facebook page for more information. Construction Notes: The RiverPlex's south entrance will be closed to through traffic from August 25-28 for railroad repairs. With Many Local Schools Not In Person, Peoria Zoo Offers New Ways for Students to Play
PEORIA, ILLINOIS, August 19, 2020 - Having missed the spring field trip season due to COVID 19, Peoria Zoo is hoping to increase its use as an educational resource this fall by offering discounted rates for students.

All children with an ID card from an Illinois school will receive free admission Monday - Friday starting August 19 through the end of 2020. Accompanying parents and non-school age children will pay a reduced price of $7. Teacher's Packets and activity sheets can be downloaded from the Zoo's website, peoriazoo.org, to enhance the learning experience. They are located under the 'Classes & Programs' tab in the 'Teacher's Section'. "We are happy to be able to offer new ways for kids to play as they work through virtual school. The packets and activity sheets are great ways to have an in-person experience that supports what kids are learning in their school lessons," says Yvonne Strode, Peoria Zoo Director. Peoria Zoo is open daily from 10am to 5pm.

Chairman Petty called the meeting to order at 12:02 p.m.

GOLF OPERATIONSUPDATE: Greg Walker provided an update on golf operations. He provided
2020 membership numbers, which included 282 Partner to Play (P2P) packages. 839 total memberships were sold. $426,000 total was raised with membership sales. While this is below original budget, this represents a good response to our golf program and the efforts made by staff.
Discussion regarding the benefits of the P2P program followed. Walker recognized the work of Kevin Davis in the District’s Recreation Administration department for his assistance to the golf division.
Monthly play reports were provided in hard copy to those members in attendance at Noble. The reports will be provided to all committee members electronically after the meeting.
Walker reviewed month over month comparisons for rounds played cart rentals, and GLC range baskets for May, June and the first two weeks in July in detail with the group. He highlighted good progress against year to date use numbers and revenue earned versus 2019.
Next, Walker shared information on 2020 tournament dates. Goals are to host the big three: Men’s City, Central IL Women’s Championship, and the Senior Men’s City. He shared dates for all. Staff is still considering whether the Turkey Shoot is viable given restrictions. A final determination is to come. Safety is the District’s top priority.

Clara Hooks asked about the entry fees for each tournament and the differences between men and women’s fees. Discussion followed.
Walker also provided an update on the IESA state tournament. The District’s contact at IESA is resigning, but the current goal is to try to run the tournament. There should be more word by the end of July. The District is currently under contract to provide the tournament through 2020.
Finally, Walker shared an update on the difficulties of the point of sale software. He will continue to work with Golf Now to address.
Committee members raised questions about operations including putting the noodles back into the cups for play, cutting holes on the practice green, tee times, and the value of the Turkey Shoot.
MAINTENANCE REPORT: Superintendent Matt Freeman was on vacation so Greg Walker provided this month’s overview of maintenance operations throughout the District.
The purchase of 109 new golf carts for the rental fleet was approved by the Park Board last week. Erich will work with Nicole Staley from our Purchasing office to get the carts ordered and they should arrive in the next few months.
Marty and Tim have the irrigation systems working overtime at all courses trying to keep the greens and fairways from surrendering to the extremely hot start to July. Tim and Marty, along with their assistant managers are closely monitoring turf conditions and soil temperatures to quickly manage any onset of problem areas resulting from the hot days and warm, damp nights.
Marty, Cody and the golf maintenance staff at Newman have spent several days removing dead Ash trees at the course since we last met. Progress continues, but there is more work to be done. The District Forestry crew will work on removing the large dead Ash trees on the north edge of Newman later this summer or early fall.
Erich and the golf mechanical technicians, Tim DeJarnett Jr. and Chuck Simms, continue to do a great job keeping the golf carts and maintenance equipment running during the peak of the season.
Virgil Vogel has done an excellent job keeping the landscaped areas weeded and watered.
Discussion followed re the stump at the 10th hole at Newman. Staff will provide the quote/proposal at the next meeting.

BODY FITNESS, INC.
This LEASE AGREEMENT (“Lease”) is between THE PLEASURE DRIVEWAY AND PARK DISTRICT OF PEORIA, PEORIACOUNTY, ILLINOIS (hereinafter referred to as “Landlord”) and BODY FITNESS, INC. (hereinafter referred to as “Tenant”).
WITNESSETH:
WHEREAS, Landlord runs and operates Lakeview Recreation Center as a recreation center that providesrecreational opportunities for the public and;
WHEREAS, Tenant is interested in leasing a portion of the facility to host their personal training, group exercise,physical therapy, and adult dance programming;
NOW, THEREFORE, in consideration of the premises and mutual promises contained herein, the Parties agree asfollows:
1. LEASED PREMISES. Landlord owns a building (“Building”) located on the real property with an address of 1013West Lake Street, and, in consideration of the rents, covenants and other agreements of Tenant, Landlord herebyleases to Tenant and Tenant hereby leases from Landlord that portion, described in Exhibit A, of the Buildinglocated at Lakeview Recreation Center, Peoria, Illinois and containing approximately 2797 square feet of leasablespace, together with the non-exclusive right of use of the parking lots, driveways, sidewalks and common areas atthis location in conjunction with Landlord’s patrons and with other tenants of the Building.
2. TERM. The initial term of this Lease shall commence on September 1, 2020 (“Commencement Date”), and willexpire one (1) year from the Commencement Date, on August 31, 2021.
3. RENT.A. Rent is payable in equal monthly installments due by the first of each month. Tenant’s rent payments to
Landlord total annual rent of $19,200 for the period September 1, 2020 through August 31, 2021.B. Utilities. In addition to the rent payable by Tenant to Landlord under the terms of this Lease, Tenant shall
pay to Landlord monthly installments of One Hundred Twenty Five and 00/100 Dollars ($125.00). TheUtilities shall be considered Tenant’s pro-rata share of the cost of electricity, water, gas and other utilityservices used in the Leased Premises (excludes internet/Wi-Fi). The Tenant shall pay to Landlord monthlyinstallments of Seventy and 00/100 Dollars ($70.00) for internet/Wi-Fi services.
C. Manner and Time of Payment. All Rent and Utilities shall be paid, in legal tender at the time of payment,in monthly installments on the first day of each month during the Term hereof at the office of the Landlordor at such other place as Landlord may designate. Any Rent not paid by the fifth (5th) of the month shallbear interest at the rate of ten percent (10%) per annum compounded daily from the due date of eachobligation, unless a lower rate shall then be the maximum rate permissible by law with respect thereto,in which event said lower rate shall be charged.
4. BUSINESS HOURS AND ACCESSA. The normal business hours of the Building shall be determined by Landlord; but, will be from
approximately 8:30am to 9:00pm, Monday through Sunday, with the exception of holidays, which shallbe determined by Landlord.
B. Should Tenant request access to the building outside of Landlord’s business hours, Landlord may permitTenant to use the Leased Premises during Landlord’s nonbusiness hours. However, Tenant agrees thattheir use will be limited to the hours between 6:00 am and 11:00 pm.
C. If Tenant is permitted use of the leased premise outside of Landlord’s business hours, Landlord will assigntwo keys and an alarm code to Tenant to allow access to the building. No duplication of keys will be

permitted. If additional keys are needed, Landlord may provide additional keys for a $20 nonrefundableper key fee. If a key is lost and there is a need to rekey the building, that cost will be passed on to Tenant.
D. Landlord shall ensure that the Building and its Common Areas are locked and secured at times when theBuilding is closed for Landlord’s business. Tenant shall be responsible for locking and securing the LeasedPremises. Additionally, Tenant shall be responsible for locking and securing the common area whenTenant is accessing the leased premise outside of Landlord’s business hours.
5. DELIVERY OF LEASED PREMISES. Landlord shall deliver the Leased Premises in vacant and in broom cleancondition with all systems in good working order and condition, with utilities necessary for Tenant to operate itsbusiness in the Leased Premises, which include water, natural gas, sanitary sewer, and electricity are installed,connected to and servicing the Leased Premises and Building.
6. REPAIRS, ALTERATIONS, CONSTRUCTIONA. Landlord Repairs or Alterations. At Landlord’s sole cost and expense, Landlord reserves the right to
construct, repair, maintain and replace utility lines, pipes, conduits or any other items that may benecessary or appropriate in Landlord’s opinion, for the operation, maintenance or improvement of theBuilding (including but not limited to such repairs, additions or improvements as Landlord may elect or berequired to make) in, under, upon or through the Leased Premises, and for such purposes Landlord mayenter the Leased Premises. Any activities of Landlord described in this Section shall not constitute adisturbance of Tenant’s use or possession of the Leased Premises and shall not give rise to any claim forabatement of Rent or any other claim; provided, however, that Landlord shall exercise reasonable careand due diligence to avoid or limit any material interference with Tenant’s trade or business, and shallprovide Tenant with reasonable advance notice before conducting any such work within the LeasedPremises except in the case of emergencies.
B. Landlord Changes to Building. Landlord reserves the right to construct additional improvements to theBuilding from time to time and to make such alterations thereof or additions thereto as Landlord may seefit, provided that such changes do not adversely affect Tenant or Tenant’s operations or signage. Landlordshall, at Landlord’s expense, make all revisions to the Building required by governmental rule orregulations, except such revisions as are required because of the operations of Tenant’s business in theLeased Premises. Tenant shall, at Tenant’s expense, make all revisions to the Building which are requiredby governmental rule or regulation because of operation of Tenant’s business in the Leased Premises.
C. Tenant’s Work. Tenant shall, at Tenant’s expense, fully equip the Leased Premises with all trade fixtures,furniture, furnishings, exterior signs, special equipment and other items and shall perform all work inexcess of Landlord’s Work necessary for the completion of the Leased Premises and the proper operationby Tenant. All items installed by Tenant shall be paid for by Tenant, and shall be of first-rate quality. Tenantshall not undertake any construction, nor shall Tenant install any equipment, without first obtainingLandlord’s written approval of plans and specifications therefore, which approval shall not beunreasonably withheld. Tenant shall diligently complete Tenant’s Work in accordance with the plans andspecification approved by Landlord and all applicable laws.
D. Alterations or Improvements by Tenant. Tenant shall not, without Landlord’s prior written consent, makeor permit to be made, any alterations, additions or improvements to the Leased Premises which wouldcost in excess of Twenty-Five Hundred Dollars ($2,500). Prior to commencing any alterations, additions orimprovements to the Leased Premises, Tenant shall submit to Landlord plans and specifications thereforeand a list of proposed contractors and subcontractors to perform such work, and Landlord shall have thirty(30) days to approve or reject such plans and specifications and any contractors or subcontractors on suchlist. If Landlord rejects such plans and specifications or any particular contractors or subcontractors onsuch lists, Landlord shall specify the reasons for such rejection. Thereafter, Tenant shall not commencesuch alterations, additions or improvements, or employ such rejected contractors or subcontractors,unless and until Tenant shall have modified such plans and specifications to respond to Landlord’s reasonsfor rejecting the plans and specifications, and shall have submitted such revised plans and specificationsto Landlord and received Landlord approval thereof, or selected alternate contractors or subcontractorsto who are acceptable to Landlord for such work. With respect to any alterations which may be permittedby Landlord, Tenant shall promptly pay all costs, expenses and charges thereof, shall perform such work

in accordance with all applicable laws and the plans and specifications approved by the Landlord, shallemploy only contractors and subcontractors approved by Landlord, shall perform such work in a good andworkmanlike manner, and shall fully indemnify and hold harmless Landlord from and against anymechanic’s or other liens or claims in connection with the making of such alterations, additions orimprovements. Tenant shall promptly repair any damage to the Leased Premises or the Building causedby and such alterations, additions or improvements.
Tenant shall obtain, or shall cause all contractors and subcontractors to obtain, insurance (namingLandlord and, at Landlord’s request, Landlord’s mortgagee, as additional insureds) against all riskrelating to any construction or improvements performed in the Leased Premises by Tenant.
E. Removal of Improvements. All items of Landlord’s construction, all heating, ventilating and airconditioning equipment and all permanent improvements installed by Landlord shall be the property ofLandlord and shall not be removed from the Leased Premises without the prior written consent ofLandlord. All trade fixtures, furniture, furnishings and signs installed in the Leased Premises by Tenant andpaid for by Tenant shall remain the property of Tenant, and may be removed upon the expiration of theTerm of this Lease, provided that:
i. Tenant shall have fully performed all of the covenants, conditions and provisions to be performedby Tenant under this Lease; and
ii. Tenant repairs any damage to the Leased Premises or the Building caused by such removal andrestores the Leased Premises to the condition that existed on the commencement date of thisLease, reasonable wear and tear excepted.
If Tenant fails to remove any such items from the Leased Premises within thirty (30) days after theexpiration or earlier termination of this Lease, all such trade fixtures, furniture, furnishings and signs shall,at Landlord’s options, become the property of Landlord, unless Landlord elects to require their removal,in which case Tenant shall promptly remove the same and restore the Leased Premises to its priorcondition. If Tenant fails to promptly remove the same, Landlord may remove and store such items at theexpense of Tenant.
7. COMMON AREAS. The “Common Areas” are all of the improved portions of the Building other than the LeasedPremises and the remaining leasable space in the Building which are held for the joint use of all tenants andoccupants of the Building, their employees, customers and invitees, and Landlord hereby grants to Tenant, itsemployees, customers and invitees the right to use in common with all other tenants of the Building, all of saidCommon Areas for ingress and egress to and from the Building and for the parking of motor vehicles in areas sodesignated. Landlord reserves the following rights with respect to the Common Areas of the Building and property:
A. To establish reasonable rules and regulations for the use thereof;B. To use the Common Areas for promotional activities and sale, or permit such use by others to whom
Landlord may grant or may have granted such rights; andC. To make reasonable or necessary changes in the layout of the Common Areas, including the right to add
to or subtract from the shape and size of the Common Areas, whether by the addition of Buildingimprovements or otherwise, provided that such changes do not adversely affect Tenant or Tenant’soperations or signage.
8. USE OF LEASED PREMISES AND BUILDING.A. Tenant shall use the Leased Premises solely as a Personal Training/Group Exercise/Adult Dance/Physical
Therapy Space, open only to Tenant’s members, and shall not use the Leased Premises for any other useor purpose without the prior written consent of the Landlord, which may be withheld in Landlord’s solediscretion.
B. At all times Tenant shall provide supervision for its activities and use of the Leased Premises. Thesupervision shall at all times be by those persons with the appropriate training and professionalcredentials for the activity being conducted. Upon by demand by Landlord, Tenant shall confirm andcertify to the Landlord that its activities comply with all applicable laws, rules, regulations, and standardsgoverning its operation.

C. Landlord warrants and represents that the Building is zoned R1, Single Family Residential District.D. Landlord warrants and represents that the property and Building is in compliance with all federal, state
and local laws, ordinances and regulations, including but not limited to life safety codes.E. Tenant shall not use or occupy the Leased Premises or permit the use or occupancy of the Leased Premises
for any purpose or in any manner which (1) is unlawful or in violation of any applicable legal orgovernmental requirement, ordinance or rule; (2) may be dangerous to persons or property; (3) mayinvalidate or increase the amount of premiums for any policy of insurance affecting Lakeview RecreationCenter and if any additional amounts of insurance premiums are so incurred, Tenant shall pay to Landlordthe additional amounts on demand; or (4) may create a nuisance, disturb any other tenant, program, orinjure the reputation of the Landlord; provided, however, that Landlord agrees that Tenant’scontemplated uses of the Leased Premises will not violate any provisions in this section 8.
9. TENANT’S COVENANTS WITH RESPECT TO OCCUPANCY. During the Term of this Lease, Tenant shall at all times:A. Occupy the Leased Premises in a safe and careful manner, without committing or permitting waste and in
compliance with all laws, regulations and orders of all governmental bodies having jurisdiction over theLeased Premises.
B. Permit no lien, notice of intention to file lien, or other charges (whether arising out of work of Tenant orany contractor, subcontractor, mechanic, laborer or materialman of Tenant or any mortgage, conditionalsale, security agreement, chattel mortgage or otherwise) which might be or become a lien orencumbrance or charge upon the Leased Premises or Building, or any part thereof of the incometherefrom. If any such lien or claim of lien is filed against the Leased Premises or Building, or any partthereof, Tenant shall remove or bond over the same within sixty (60) days after the filing of such lien orclaim of lien. If Tenant fails to remove or bond over such lien or claim of lien within such sixty (60) dayperiod, Landlord may do so and recover the cost thereof from Tenant, with interest as permitted herein,upon demand.
10. REPAIRS AND MAINTENANCEA. By Landlord.
i. Landlord shall be responsible and pay for all repair or replacement of the Leased Premises’ roof,supporting members, foundations, outside walls, doors, doorframes, and windows, except forrepairs necessitated by or of the acts, omissions or negligence of Tenant and Tenant’s employees,agents, invitees, licensees, contractors, sub-tenants or assignees. In addition, Landlord shall beresponsible for replacement of all heating and air conditioning equipment on the LeasedPremises.
ii. Landlord shall be responsible for operating, maintaining, repairing, insuring, improving, orreplacing the Common Areas including: cleaning, awnings, lighting, painting, snow and iceremoval, mowing, line painting, management fees, resurfacing and repaving of parking areas,maintenance of the common sign for the Building (if any) and landscaping.
B. By Tenant. Tenant shall be responsible for custodial maintenance and repairs to the Leased Premises andthe fixtures and equipment located therein caused by the acts, omission or negligence of Tenant andTenant’s employees, agents, invitees, licensees, and contractors. Landlord shall assign to or enforce onbehalf of Tenant, at Landlord’s option, any manufacturer’s guarantees or warranties covering mechanicalequipment or systems servicing the Leased Premises.
11. INSURANCE AND INDEMNIFICATIONA. Liability Insurance. During the Term of this Lease, Tenant shall, at Tenant’s expense, procure and maintain
comprehensive general liability insurance covering the Leased Premises, from companies authorized todo business in the State of Illinois and rated A or better by Best’s Insurance Rating System or its equivalent,with minimums of not less than $3,000,000 on account of bodily injuries to or death of any one or morepersons as a result of any occurrence, and $2,000,000 coverage for property damage, and to deposit saidpolicy or policies (or certificates thereof) with Landlord prior to the date of any use, occupancy orpossession of the Leased Premises by Tenant. Said policy or policies shall name Landlord and, at Landlord’srequest, Landlord’s mortgagee, as additional insureds, shall include contractual liability, and shall bear

endorsements to the effect that the insurer agrees to notify Landlord not less than thirty (30) days inadvance of any modifications or cancellation thereof. Tenant agrees to deliver to Landlord, not less thanten (10 ) days prior to the commencement of any work a policy or certificate of insurance from a companyauthorized to do business in the State of Illinois and rated A or better by Best’s Insurance Rating Systemproviding worker’s compensation coverage, and such other insurance as Landlord may reasonablyrequire, naming Tenant, Tenant’s general contractor, all subcontractors, Landlord and, at Landlord’srequest, Landlord’s mortgagee, as additional insured, endorsed so as to cover any and all liability arisingout of or in any manner connected with the work to be performed by Tenant. Tenant’s general liabilityinsurance or self-insurance shall be primary insurance as respects the Landlord. Any insurance or self-insurance maintained by the Landlord shall be excess of Tenant’s insurance and shall not contribute withit.
B. Fire and Extended Coverage Insurance. During the Term of this Lease, Landlord shall procure and maintainan All Risk fire and casualty insurance policy insuring the Building and improvements on the real propertyin an amount equal to the full replacement cost of such improvements, together with insurance againstsuch other risks (including loss of rent) and in such amounts as Landlord deems appropriate. Suchinsurance shall be carried with companies authorized to do business in the State of Illinois and rated A orbetter by Best’s Insurance Rating System or its equivalent. In addition, Tenant agrees to comply with allreasonable requirements of Landlord’s insurance company and to refrain from any activities, which wouldcontravene or violate the reasonable requirements of Landlord’s insurance company.
Notwithstanding anything to the contrary contained in this Section, the Landlord’s obligations to carrythe insurance provided for in this Section shall be satisfied by the coverages extended to the Landlord bythe Park District Risk Management Agency (“PDRMA”) or other similar risk management agency whichprovides risk management and insurance coverage for park districts so long as the coverages set forth inthis Section are maintained. Landlord shall not be responsible for insuring or replacing Tenant’s personalproperty located in the Lease Premises.
C. Tenant’s Personal Property. Tenant shall also maintain insurance against fire and such other risks as are,from time to time, included in standard extended coverage endorsements, insuring Tenant’s stock-in-trade, trade fixtures, furnishings, furniture, special equipment, plate glass, floor and wall coverings and allother items of personal property of Tenant located in the Leased Premises, in an amount equal to the fullreplacement cost thereof. Prior to Tenant’s use or occupancy of the Leased Premises, Tenant shall furnishLandlord with a certificate evidencing such coverage.
D. Professional Liability Insurance. Tenant shall, during the entire term hereof, keep in full force and effectand pay all premiums or other charges for policies of professional liability insurance.
E. Workmen’s Compensation Insurance. Tenant shall, during the entire term hereof, keep in full force andeffect and pay all premiums or other charges for policies of workmen’s compensation insurance, asrequired by the Illinois Workers’ Compensation Act (IWCA).
12. DAMAGE AND DESTRUCTION OF LEASED PREMISESA. Damage or Destruction. In the event the Leased Premises are rendered wholly untenantable by fire or
other casualty and Landlord decides not to restore the same, Landlord or Tenant may terminate this Leaseby written notice within ninety (90) days after the date of such fire or casualty, and the Rent shall beapportioned to the date of such fire or casualty. If the Leased Premises are rendered partiallyuntenantable by fire or other casualty, the Landlord shall proceed with diligence to restore the LeasedPremises, subject to reasonable delays for insurance adjustments and delays caused by forces beyondLandlord’s control, and the Base Rent shall abate in proportion to the non-usability of the Leased Premisesduring the period of restoration. In the event the Landlord fails to complete the rebuilding or repairswithin one hundred eighty (180) days from the date of the damage under this Section, Tenant may, at itsoption, terminate this Lease upon written notice to Landlord, at which time all rights and obligations underthis Lease shall cease.

B. Abatement of Rent. If any casualty shall render the Leased Premises untenantable, in whole or in part, aproportionate abatement of the Base Rent shall be allowed until the date the Leased Premises arerestored to tenantability, unless such fire or other casualty is caused by the acts or negligence of Tenantor Tenant’s employees, servants or agents in which event all rental and other obligations of Tenanthereunder shall remain in full force and effect throughout the period of such repair or rebuilding.
13. ASSIGNMENT AND SUBLETTING. Tenant shall not assign this Lease nor sublet the Leased Premises without in eachcase the prior written consent of Landlord, which approval shall not be unreasonably withheld or delayed. In theevent Tenant desires to assign this Lease or sublet the Leased Premises, Tenant shall give written notice thereofto Landlord, identifying the proposed assignee or sub-tenant and their proposed use of the Leased Premises,whereupon Landlord shall, within thirty (30) days after receipt of such notice, either (i) approve such assignmentor sub-lease or (ii) refuse such assignment or sub-lease, stating the reasons for such refusal. Landlord’s consentto any sub-lease shall not release Tenant from its obligations hereunder.
14. DEFAULT.A. Default by Tenant. If Tenant (i) defaults in the payment of Base Rent, Utilities or other monetary charges
due hereunder and fails to remedy such default within ten (10) days after written notice from Landlord,or (ii) defaults in the performance of any other obligation hereunder and fails to remedy such defaultwithin thirty (30) days after written notice from Landlord (except that if such failure cannot be curedwithin such thirty (30) day period, this period shall be extended for a reasonable additional time providedthat Tenant commences to cure such failure within thirty (30) day period and proceeds diligentlythereafter to effect such cure), or (iii) if any proceeding shall be commenced to declare Tenant bankruptor insolvent or to obtain relief under any chapter or provision of any bankruptcy or debtor relief law, or(iv) if any assignment of Tenant’s property be made for the benefit of creditors, or (v) if a receiver ortrustee be appointed for Tenant or Tenant’s property or business, then without further notice to Tenant,Landlord, in addition to all of Landlord’s other rights and remedies at law and equity, may enter upon theLeased Premises and terminate this Lease. In the event of such termination, the obligations of Landlordshall cease without prejudice, however, Landlord shall have the right to immediately recover from Tenant:(a) any sums due Landlord for Base Rent or otherwise to the date of such entry; (b) the discounted netpresent value (using a discount rate of 10%) of the unpaid Base Rent that would have expired but for suchtermination, less the discounted net present value (using a discount rate of 10%) of the reasonable fairmarket rent for the Leased Premises during said time period; (c) the cost of all repairs to correct anydamage to the Leased Premises or the Building caused by Tenant (ordinary wear and tear excepted); and(d) all attorney’s fees and costs incurred by Landlord to effect the termination. In addition, or alternatively,Landlord may enter into the Leased Premises without terminating this Lease and may relet them in itsown name for the account of Tenant for the remainder of the Initial Term and recover from Tenant on amonthly basis any deficiency between the amount of Base Rent and other payments of Tenant requiredhereunder and the amount for which the Leased Premises are relet, less expenses of relating (includingall necessary repairs, alterations and attorney’s fees).
B. Non-waiver of Default; Cumulative Remedies. No failure of Landlord to enforce rights or remedies uponany default of Tenant shall prejudice or affect the rights of Landlord upon any subsequent or similardefault. All rights and remedies of Landlord hereunder shall be cumulative, and shall not exclude any otherremedies allowed at law or in equity.
C. Landlord’s Right to Cure: Interest on Late Payments. If Tenant fails to make any payment or perform anyact required by this Lease, Landlord, without waiving or releasing Tenant from any obligations or defaultunder this Lease, may, at its options, make such payments or perform such act for Tenant, and all sumsthus expended by Landlord and all costs and expenses so incurred shall constitute additional rent due andpayable hereunder and shall be paid by Tenant to Landlord upon demand, together with interest at therate of Ten Percent (10%) per annum. All sums payable by Tenant to Landlord under this Lease, if not paidwhen due, shall accrue interest at the rate of Ten Percent (10%) per annum from the due date until paid.

D. Waiver of Redemption. In the event Tenant shall be dispossessed of the Leased Premises for any reasonhereunder, Tenant, for itself and its heirs, successors and assigns, waives and releases (to the extentpermitted by law) any right of redemption or restoration of this Lease under any present or future law.
E. Landlord Defaults. Landlord shall not be in default unless Landlord fails to perform obligations required ofLandlord within a reasonable time, but in no event later than thirty (30) business days. No default shallexist until the expiration of the applicable cure period after Landlord’s receipt of written notice by Tenantto Landlord and to the holder of any first mortgage covering the Leased Premises whose name and addressshall have theretofore been furnished to Tenant in writing, specifying wherein Landlord has failed toperform such obligations; provided, however, that if the nature of Landlord’s obligations is such that morethan thirty (30) business days are required for performance then Landlord shall not be in default ifLandlord commences performance within such thirty (30) day period and thereafter diligently prosecutesthe same to completion. If Landlord fails to cure, then Tenant may, after providing Landlord with anadditional ten (10) day notice, and in addition to any other remedies at law or equity, incur any reasonableexpense necessary to perform the obligations of Landlord specified in such notice and bill Landlord forsuch expense, and shall provide Landlord with such supporting documentation as Landlord shallreasonably request. Landlord shall reimburse Tenant such amount within thirty (30) days of receipt ofsuch bill and documentation.
15. NOTICE. Any notice or consent required or desired to be given by or on behalf of either party to the other shall bedeemed given when delivered in person, deposited in the U.S. Mail by Registered or Certified mail. Return ReceiptRequested, or delivered to a national overnight carrier, prepaid, at the following address:

16. SIGNS AND ADVERTISEMENT. Tenant will not place or maintain any sign or advertising matter of any kindanywhere outside the Leased Premises, nor any place within the Leased Premises if intended to be seen from theexterior of the Leased Premises, without the prior written consent of Landlord, which shall not be unreasonablywithheld or delayed. Tenant further agrees to maintain in good condition and repair at all times any signs oradvertising materials of any kind, which have been approved by Landlord for the Leased Premises.
17. LANDLORD’S RIGHT OF ENTRY. Landlord and Landlord’s agents shall have the right to enter the Leased Premisesat all reasonable times, upon reasonable advance notice, to examine and show the same to prospectivepurchasers (and during the last six months of the Lease Term, to Tenants) of the real property, and to make suchrepairs, alterations, improvements or additions to the Building as Landlord may deem necessary or desirable, andLandlord shall be allowed to take such materials into and upon the Leased Premises that may be requiredtherefore without the same constituting an eviction of Tenant in whole or in part and the rent received shall in noway abate while said repairs, alterations, improvements or additions are being made, provided the same shall bedone with as little interference with Tenant’s business in the Leased Premises as is reasonably possible.
18. TERMINATION. This Lease may be terminated, by any of the following events:A. Written agreement by both parties to terminate this Lease.B. Upon breach by either party beyond any applicable cure period.C. Buyout. Tenant may terminate this Lease upon no less than sixty (60) days’ written notice and payment
of a buyout fee that is equal to the discounted net present value of the remaining Base Rent due underthe Lease and for purposes of this provision the discount rate shall be 10 percent (10%).
19. MISCELLANEOUSA. Accord and Satisfaction. No payment by Tenant or receipt by Landlord of any lesser amount than the
amount stipulated to be paid hereunder shall be deemed other than on account of the earliest stipulated

rental or other sum payable by Tenant to Landlord hereunder; nor shall any endorsement or statementon any check or letter be deemed an accord and satisfaction, and Landlord may accept any check orpayment without prejudice to Landlord’s rights to recover the balance due and/or to pursue any otherremedy available to Landlord.
B. No Waiver. No consent, approval or waiver, express or implied, by either of the parties hereto to or ofany breach of any covenant, agreement or obligation of the other party shall be construed as a consentor waiver to or of any other breach of the same or any other covenant, agreement or obligation.
C. Brokerage. Landlord and Tenant represent that each has had no dealings with any brokers or agents inconnection with this Lease. Landlord and Tenant agree to defend, indemnify and hold the other harmlessfrom any and all claims for compensation or commission in connection with this Lease by any broker,agent, or finder claiming to have dealt with such party.
D. Successors and Assigns. The Lease shall inure to the benefit of, and be binding upon, the heirs, successorsand assigns of the parties hereto; provided, however that no transfer by Tenant in violation of theprovisions hereof shall vest in such transferees any right, title, or interest whatsoever in this Lease or theLeased Premises.
E. No Third Party Beneficiary. This Lease is entered into solely for the benefit of the contracting parties, andnothing in this Lease is intended, either expressly or impliedly, to provide any right or benefit of any kindwhatsoever to any person or entity that is not a party to this Lease, or to acknowledge, establish or imposeany legal duty to any third party.
F. Entire Agreement. This Lease and the exhibits and addendums hereto, set forth all the covenants andunderstandings between Landlord and Tenant concerning Tenant’s occupancy of the Leased Premises,and there are no other covenants or understandings, either oral or written, between Landlord and Tenant.Except as otherwise provided herein, no subsequent alteration, amendment, change or addition to thisLease shall be binding upon Landlord or Tenant unless in writing and signed by both parties.
G. Surrender and Holding Over. Upon the expiration of this Lease by lapse of time, termination or otherwise,Tenant shall deliver up and surrender to Landlord possession of the Leased Premises in as good conditionand repair as at the commencement of the Term hereof, ordinary wear and tear excepted. Should Tenantremain in possession of the Leased Premises after the termination of this Lease without the consent ofthe Landlord, tenancy shall convert to a month to month tenancy on the same terms as provided in theLease except that Rent shall be paid in an amount equal to one hundred twenty-five (125%) of the BaseRent most recently due; and such holdover shall not exceed a period of one hundred eighty (180) days.
H. Severability. In the event any provisions of this Lease is rendered invalid by the decision of any court orby the enactment of any law, then at Landlord’s option, such provision of this Lease shall be deemed tohave never been included herein and the balance of this Lease shall continue in full force and effect.
I. Applicable Law. This Lease and the rights and obligations of the parties hereunder shall be governed byand construed in accordance with the laws of the State of Illinois.
J. Attorney’s Fees and Costs. In the event that either party should find it necessary to retain an attorney forthe enforcement of any of the provisions hereof occasioned by the fault of the other party, the non-defaulting party shall be entitled to recover reasonable attorney’s fees and court costs incurred as a resultthereof, whether said attorney’s fees are incurred for the purpose of investigation, negotiation, trial,appellate proceedings or other legal services.
K. Attornment. In the event any proceedings are brought for the foreclosure of, sale in lieu thereof, orexercise of any power of sale under, and mortgage, deed of trust or other security instrument of Landlord

for the property, Tenant shall, upon request, attorn to the purchaser upon any such foreclosure or sale,recognize such purchaser as Landlord under this Lease and execute such instruments as may reasonablybe requested by such purchaser to evidence such attornment, including a new Lease for the balance ofthe term hereof, provided the terms thereof are the same as the terms of this Lease.
L. Force Majeure. In the event that either party shall be delayed, hindered or prevented from theperformance of any act required hereunder other than the payment of rent by reason of acts of God,strikes, lock-outs, labor disputes, inability to obtain labor or materials at reasonable cost, power failure,governmental laws or regulations, riots, insurrection, war, unusually severe weather conditions, or otherreasons not the fault of such party, then the performance of such act shall be excused for the period ofsuch delay and the period for the performance for such act shall be extended for a period equivalent tothe period of such delay; provided, however, that if a delay extends for more than 30 days, the non-impacted party may terminate this Lease without further obligations.
M. Recording. Tenant or Landlord shall not record this Lease without the prior written consent of the otherparty; provided however, that upon the request of either party, the other party hereto shall join in theexecution of a Memorandum or Short Form of this Lease for the purpose of recordation. SaidMemorandum or Short Form of this Lease shall identify the parties, the Leased Premises and the Term ofthis Lease, and shall incorporate this Lease by reference.
N. Counterparts. This Agreement may be executed in any number of counterparts, all of which shallconstitute a single Agreement. Signatures delivered by facsimile, PDF, or electronic signatures shall bedeemed to constitute original signatures for purposes of execution of this Lease.

In August 2019, Body Fitness, Inc. entered into an agreement with the Peoria Park District to formally lease space at Lakeview Recreation Center to conduct personal training, group exercise, and physical therapy. As part of this agreement, Body Fitness pays $19,200 plus utilities to lease the space for a year.
This new lease is for a one-year term and will be revisited annually so that changes can be made each year.
Recommendation:
Staff recommends the approval of the attached one-year Lease Renewal Agreementbetween Pleasure Driveway and Park District of Peoria, Illinois and Body Fitness, Inc. for space at Lakeview Recreation Center.

Proposal – Fire and Security Alarm Monitoring, Maintenance and Testing
Budget: Various Budgets Background: Proposals were solicited from ten vendors with one response. The single response received is from the current provider of services. For this reason, an addendum is being provided to continue services under the original agreement for an additional five-years effective September 1, 2020 through August 31, 2025. At the conclusion of the five-year term, the Peoria Park District can extend the agreement on a yearly basis. Included in the contract are the daily monitoring, routine maintenance, and inspections and testing per applicable codes for the intrusion and fire alarm systems at Park District facilities. Locations may be added or removed as required by the Park District. Recommendation: Staff recommends the acceptance of the proposal for Fire and Security Alarm Monitoring, Maintenance and Testing from Interface Security Systems of Earth City, MO for an estimated monthly total cost of $4,487.88.

August 14, 2020 Mr. Scott Loftus Peoria Park District 1125 W Lake Ave Peoria, IL 61614 Re: Request for use of Donovan Park - October 17 (or October 3), 2020 Hello, Members of the committee, Quest is planning a multi-faceted “hybrid” event for October 17 (preferable, but October 3 was previously discussed as well). It’s a fundraising and community awareness event. We hope to attract runners/walkers who are missing out on other events that have been cancelled due to the Covid restrictions. There is a Quest Runners Club. Bicyclists will be invited to use the Rock Island Greenway. We would use the trails for groups of runners/walkers not to exceed 50 individuals in each of four groupings at these times: 8am, 10am, Noon, and 2pm. Most of the participants would be virtual, however, and not restricted to this date. We’ll encourage participants to do laps in their yard, run on treadmills, or whatever they choose to do. They’ll make a contribution to Quest by way of personal giving or sponsorships All of Quest’s students, families, and the general public will be encouraged to participate But, we will limit the number of participants on-site at Donovan Park to the limitations imposed by the Covid restrictions. Participants will be made aware of the public restrooms, parking and Cyd’s restaurant, as well as the Observatory and all of the park’s wonderful natural surroundings. We understand there is a fee of $55 per hour, not including our setup and tear down time. I am the point of contact for the event. We look forward to this partnership with the Peoria Park District.
