Remarks From The Chairperson
Iamdelightedtogiveareportforanothersuccessfulyearfor Pest Control Products Board. On its establishment in1984, theBoardtookupthe important roleof regulatingpestcontrolproductstradedwithinKenya.TheBoardhasendeavored to fulfill this mandate amidst increasing chal-lengessuchasadynamicpesticideindustry,increasedcon-sumerdemandslikefoodsafetyforvariousproduceofferedintothemarketlocallyandinternationallyandthenationalmenaceofcounterfeitingandsubstandardproductsbyun-scrupulousdealersouttoenrichthemselvesquickly.
During the financial year 2006/2007, the Board was guided byitsvisionandmissionwiththeultimategoaltobecomea leader intheregion inregulatingpestcontrolproducts
through the provision of an efficient and effective regulatory service to our clients. The Board’sstrategicplanformulatedin2004outlineditsstrategicobjectivesandtheopera-tional objectives with defined activities as a road map for achieving the Board’s mandate. ThecoreobjectivesremainedthefocusthroughouttheyearwiththeBoardensuringthemeagerresourcesatitsdisposalwereprudentlyutilizedtosupporttheplannedactivities.Theactivitiesundertakenincludedregistrationofpestcontrolproducts,vettingthelabelsforpestcontrolproducts,inspectionandlicensingofpremises,investigationsandprosecu-tion, issuanceof import/exportpermitsand creatingawarenessabouttheBoardand itsfunctions. TheBoardcollaboratedwith relevant institutions including thoseofferingthenecessaryanalyticalandtestingfacilities.Allfunctionsandactivitieswereachievedwithalevelofsuccess.
Despitethesuccess,theBoardfacednumerouschallengeskeyamongthembeingtoraiserevenue from rendering services to finance planned activities particularly inspection, moni-toringandsurveillanceandassessingtheroleandperformanceofpesticidesandtheirim-pactonagricultureandtheenvironment.Otherchallengessuchas lackofanalyticalandtestingcapacityhindersystematicpostregistrationsurveillance.ThelimitedstoragespaceforillegalpesticidesthatareseizedbyinspectorswhileprosecutionsaretakingplaceandthelownumberofstaffmemberslimitstheBoardfromeffectivelycarryingouttheitsman-dateandfunctions.
On behalf of the Board Members and staff I wish to reaffirm our commitment to offer an ef-fective and efficient pest control products regulatory service and to facilitate safe and fair trade.Wewillendeavortocontinuallystrengthenourpartnershipswiththestakeholdersforbetterservicedeliverytoall.

Message From The Chief Executive/Secretary
ThisisyetanothersuccessfulreviewperiodduringwhichseveralactivitieswereundertakenbythePCPBinexecut-ing itsmandate inordertoattain theperformancecon-tracttargetsfortheperiod.
Intheperiodunderreview,theinspectoratedepartmentmanagedtoinspect1732premisesthusexceedingitstar-getof1670premises.13tonesofillegalpesticideswereseizedoutofwhich75.90%wereunregistered.Thiswasattributedtoalotofunregisteredadjuvantssuchasstick-ersandspreadersfoundmainlyincommercialagriculturalfarms.17casesofcontraventionofthePCPActwereinves-tigatedoutofwhich10werecasesofcounterfeits.
Duringtheyear,atotalof128newapplicationsofpestcontrolproductsregistrationwerereceived by the Registration and Analysis Department and all were sent for efficacy evalua-tiontovariousaccreditedinstitutions.Inaddition,177productswereapprovedandregis-teredbytheBoard.
TheBoardprocessedandauthorizedimportationofabout8749metrictonesofpestcon-trolproductsintothecountryvaluedataboutKsh.3billionforvarioususesinagriculture,animalhealthandpublichealth.182metrictones,upfrom82inthepreviousyear,ofpestcontrolproductsvaluedatKshs103millionwereexportedtoneighboringcountries.
During theyearunder review,several technical staffparticipated invarious trainings forinformationdisseminationonsafeandeffectiveuseandhandlingofpestcontrolproducts.Membersofstaffalsoattendedspecializedshort-termcourseslocallyandabroad.
Thesuccessoftheactivitiesundertakenduringthereviewperiodhasbeenrealizedthroughthecontinuedsupport fromtheMinistryofAgriculture,developmentpartners,collabora-tors,theBoardandsecretariatstaff,towhomweareallgrateful.

1.2.0 MANDATEThemandateofthePestControlProductsBoardasprescribedinthePestControlProductsActandalsoinlinewithitsvisionandmissionstatementincludesthefollowingactivities: • Assessing the safety, efficacy, quality, merit and economic value of pestcontrolproductswithaviewtoregisteringthem,iffound suitable. • Assessingsuitabilityofpremisesusedformanufacture/formulation, re-packing,storageanddistributionofpestcontrolproductsfor purposesoflicensingthemforthosefunctions. • Processingandissuingimport/exportpermitstoensurethatonly registeredproductsareimportedandinrightquantities. • AdvisingtheMinisteronallmattersrelatingtotheProvisionsofthe PCPActandRegulationsmadethereunder. • Monitoringandensuringadherenceofqualitystandardsofpest controlproductsfromproductiontouse. • Creatingawarenessofthegeneralpubliconallaspectsofsafety, storage,handling,disposalanduseofpestcontrolproducts. • InvestigatingandprosecutingcontraventionofthePestControl ProductsAct. • Supervisingthedisposalofobsoleteorundesiredpestcontrol products.
TheBoardoperationalizesthemandatethroughtwotechnicaldepartmentsandonesupportdepartment.TheRegistrationandAnalysisDepartmentundertakesregistra-tionandrelatedactivitieswhileInspection,LicensingandTrainingDepartmentisre-sponsibleforlicensing,trainingandenforcementoftheProvisionsofthePestControlProductsAct.TheFinanceandAdministrationDepartmenthasthesupportfunction.

This annual report covers activities undertaken during the 2006/2007 financial year bythefollowingDepartments; • RegistrationandAnalysisDepartment. • Inspection,LicensingandTrainingDepartment. • FinanceandAdministrationDepartment.
2.1 REGISTRATION & ANALYSIS DEPARTMENT
Thedepartmentcomprisesoftwodivisions,namelyRegistrationandAnalyticaldivi-sions.Thedepartmentischargedwiththeresponsibilityofenforcingthefollowing: i) Registrationregulations,whichrequirethatallpesticidesdistributed, soldandused,inKenya,areregisteredbyPCPB.Inaddition,ensures that all pesticide for use in Kenya are efficacious under local conditions,safe,ofhighqualityandhavemeritandeconomicvalue. ii) Labelingandpackagingregulations,whichrequirethatallpackages ofpesticidesdisplayastandardlabelonthepackagingmaterial.Such labelsareessentiallysummariesofthetechnicaldossiersandmustbe approvedbyPCPB. iii) Importationandexportationregulations,whichrequirethatpermits forimportandexportofpesticidesforbothcommercialandexperi mentalpurposesmustbegrantedbyPCPB.
2.1.1 REGISTRATION PROCEDURE FOR PEST CONTROL PRODUCTS
Registrationofpesticidesfollowstheevaluationandacceptanceofextensivetech-nical data as part of risk assessment to determine safety, efficacy, quality and economicvalue.Safetycomprisesofsafetytousers,nontargetorganismsandtheenvironment.Theprocedureinvolvesseveralsteps,asfollows: • Pre-registrationconsultation(Advisory). • Submissionofanapplicationonprescribedforms. • Submission of the scientific/technical dossier, its summary, proposed label,productsampleandanalyticalgradeactiveingredient. • Dossierevaluation. • Efficacy testing under local conditions by accredited intuitions. • RegistrationCommitteereviewandrecommendationstotheBoard after local efficacy trial results are received. • Registration/RejectionbytheBoard. • Registration certificate issuance.

Therefore,registrationimpliestheacceptancebyPCPBoftheevidencesubmittedinsupport of the registrant’s claim for efficacy, safety, quality and economic value of theproposedpesticide.
2.1.2 EVALUATION OF NEW APPLICATIONS
128newapplicationsforregistrationswerereceivedduringtheyearcomparedto154 in the previous year. This was a significant reduction that was probably due to thenewlyintroducedsystemforupfrontrejectionofincompleteandsubstandardapplications.36requestsforlabelextensionswerereceivedandprocessed.

2.1.9 IMPORTATION AND EXPORTATION OF PEST CONTROL PRODUCTS
2.1.9.1 Imports
Duringtheyearunderreviewapproximately8749tonsworthapproximatelyKshs3billionconsistingofvariousclassesofpestcontrolproductswereimportedintoorexportedoutofthecountry.Thetablebelowshowsthequantitiesofvariousclassesofpesticidesthatwereimportedintothecountryduringtheyear.

Atotalof1201importapplicationswereprocessedduringtheyear.Themajorgroupsofpesticidesimportedwereacaricidesandinsecticides.Themajoractivesubstanc-esinvolvedwereGlyphosate,Mancozeb,Sulphur,CopperOxychloride,Dimethoate,1,3-dichloropropene,Amitraz,Chlorothalonil,Cypermethrin+Imiprothrin,CuprousoxideandParaquatinorderofdecreasingvolume.
2.1.9.2 ExportsApproximately 182 metric tones worth Kshs 103 million of pest control productswereexportedtoneighbouringcountries(Uganda,TanzaniaandBurundi).ThePes-ticides exported were mainly products that contain pirimiphos +permethrin andT=triadimefon.
2.1.10 POST REGISTRATION SURVELLIANCE Postregistrationwasintroducedasanactivityinourperformancecontractfortheyeartomonitorthequalityofproductsthatareactuallyavailedtotheconsumerafter the registration process. We managed to monitor 16 samples and this figure is expectedtoincreaseinfuture.
2.1.11 LABELING Labelsaresupposedtosummarizeinformationfromthetechnicaldossieranddataobtained from local efficacy trials. The department assesses and approves pesticide labels.Throughouttheyearthedepartmentliaisedwiththepestcontrolproductsagentsinmakingstandardlabelsforapproval.

2.2 INSPECTION, LICENSING AND TRAINING DEPARTMENT
TheInspectionDepartmentisanenforcementarmofthePCPB.Thedepartmenten-suresthattheplayersinthepesticideindustrycomplywiththePestControlProductsAct and the Regulations made there under. The officers in the department ensure quality compliance by inspection of the pesticide premises and products certifica-tionwiththeviewofissuinglicencestothepremisesthatcomplywiththerequire-ments.TheserequirementsarecontainedinthelegalnoticesmadeundertheAct.Inaddition,thedepartmentisinvolvedinawarenesscreationtoallstakeholderstofacilitatesafehandlinganduseofpesticides.
Therequirementsaredesignedtoensurethat:- i) Suitablephysicalstructuresforpesticidesareinplace. ii) Healthofworkersisguaranteedinanyoperation. iii) Productsinthepremisesareregistered,packagedandlabeledas specified in the law. iv) The personnel in the premises are qualified in the activities for which thelicenseisissued.
2.2.1 PREMISE INSPECTION AND PRODUCT CERTIFICATION
During the year under review, the following categories of pesticide dealerswereinspected:- • Manufacturers/formulators. • Repackers. • Majorstorage/warehousingfacilities. • Commercialfarmstoresforownuse. • Othersmallerdealerssuchasretailers,supermarkets, wholesalersofdomesticclassofpesticidesandpestcontroloperators.
Theinspectionactivitiesinvolvedphysicalvisitstopremisesandcarefulcheckingofalltheproductsandfacilitiesfollowingwhichappropriaterecommendationsweremade.Premisesthatwereinspectedandfoundtobesuitablewererecommendedforlicensingwhilethosefoundunsuitablewereadvisedtoaddresstheshort-comingsforre-inspectionandconsiderationforlicensingthereafter.
Newpremisesencounteredwereissuedwithapplicationformsandlistofrequire-mentstofacilitatelicensing.
In the 2006/2007 financial year, a total of 1732 pesticide premises were inspected in

thecountryagainstatargetof1670intheperformancecontract.

Duringtheprocessofinspectionofpesticidepremises,inspectorsuseachecklistasadecisionguidancetoolonwhethertoissuealicenseornot.Duringtheyearunderreview 603 premises representing 71.70% qualified for licensing and the rest 238 premisesrepresenting28.30%failedtomeettheminimumrequirementsforlicens-ing.ThehighestcompliancewasnotedinCoastProvincewith83.33%followedbyCentralProvincewith81.10%.TheleastcompliancewasnotedinWesternProvincewith40.35%.Thehighlevelofcompliancecouldbeattributedtostockists’trainingsthathavebeengoingonintheprovincesforanumberofyears.Therewerenostock-isttrainingsinWesternProvinceandhencethelowlevelofcompliance.

2.2.6 INVESTIGATIONS AND PROSECUTIONS
InvestigationsandProsecutionofthosecontraveningthePCPActwithregardto: • Illegalimports • Counterfeiting(Productslabels) • Illegalmanufacturing • Unregisteredpestcontrolproducts • Hawking • Open-airsales • Decanting/reweighingetc.
A total of seventeen (17) cases were investigated out of which five cases were taken tocourt.Fourofthesewereconcludedandtheaccusedpleadedguiltyandwerefined. The fifth case was lost due to a technicality.

Outofthecases,tenofthemwereforcounterfeitproductswhilereweighed/de-cantingandillegalimportshadtwocaseseach.Oneinvolvedunregisteredproducts,saleoffumigantsoverthecounter,openairmarketsaleofpesticidesandmisuseofpesticidewhereSulphurwasbeingusedasfungicideinsteadofasfertilizer.
2.2.7 DISPOSAL OF OBSOLETE PESTICIDE AND EMPTY CONTAINERS
During the 2006/2007 financial year 1.216 Tones of illegal products that had been im-poundedfromthecountrysideweredisposedthroughincinerationbyEnvironmentalCombustionConsultants(ECC)fundedbyPestControlProductsBoard.
During the sameperiod, two (2) pesticide contaminated siteswere fencedoff inNorth Eastern Province to avoid poisoning arising from contamination before thecleanupexercisecouldbedone.
2.2.8 TRAININGS
Informationdissemination on safe andeffective use andhandling of pest controlproductstargetedthefollowing: - TrainingofTrainers(TOT).TheseincludeExtensionAgents,from Government,ParastatalsandNGOs. - Commercialagriculturalgrowers’. - PestControlOperators. - Pestcontrolproductstransporters. - Pestcontrolproductsstockists.

In addition to the above named activities, specific training courses were conducted forthepesticideindustrystafftoensureconformitywithproperformulation,proce-duresforregistrationofproducts,labeling,warehousing,safetyandhygiene.
Inordertorealizetheabovefunctionsofthedepartment,variousactivitiesweredesignedtoaddressthestrategicandoperationalobjectivesasindicatedinthePCPBStrategicPlan2004-2014.
Officers from inspection department were involved in a number of trainings in which variousstakeholdersweretrained.Thedetailswereasfollow:- • One officer participated in stockists training at Bukura Institute of Agriculture. • One officer participated in training Dudutech where 9 people were trained. • One officer participated in training of sprayer team in Murang’a where 30peopleweretrained.
2.2.9 MEETINGS/WORKSHOPS
• One officer attended Rotterdam Convention Conference. • One officer attended a workshop organized by AAK on Pesticide PoisoningandTreatment. • All officers attended an annual inspectors meeting to come up with annualprogramme.

TheBoardhasatotalhumanresourcecapacityof35membersofstaffoutwhomthirteen(13)aredeployedfromtheMinistryofAgricultureandone(1)fromMinistryofLivestockDevelopmentandFisherieswhiletherestareBoardemployees.
Duringthereviewperiod,Mr.MburaPoleDimawasemployedasaseniorsupportstaff to replace an officer who left the Board services.

2.3.1.3 Staff Training
TheBoardrecognizestheneedtohavestaffwhoarewellinformedanditisforthisreasonthatstaffareencouragedtoattendspecializedshortcoursetrainingslocallyandabroad.Atotalof5staffmembersweretrained.Staffwerealsotrainedonspe-cific ICT courses to improve their level of literacy. Other staff members continued topursuefurthertrainingbothprofessionalandAcademicthroughself-sponsorship.AtthemomenttheBoardisnotabletosponsortrainingactivitiesduetobudgetaryconstraints.
2.3.1.4 Support Services
Motortransport isourkeymodeoftransportationaswestrivetoofferourmuchneededservicestostakeholders.Duringtheperiodunderreview,theBoardhadfourdiesel vehicles that were in good condition and five Petrol vehicles of which two are infairconditionwhilethreearegrounded.
2.3.1.5 Information Technology Services
TofacilitatetheimplementationofthePestControlProductsBoardDatabaseMan-agement System, development, data entry and verification were undertaken. Entry fordataonproductsdetailswascompletedfortheperiodunderreview.Thelistofpest control products registered foruse inKenyawasalsoupdated regularly andmadeavailabletoregisteredusersviaourwebsitewhile100copiesofthelistwerealsoprintedandsold.Seventy(70)websiteusershadbeenregisteredasat30thJune2007.
