This follows several letters being issued by the City of Cape Town to beneficiaries currently living in the flats to square up their arrears. Klaas Present, chairperson of the Project Steering Committee (PSC) and the Flats’ Association, says while residents have been told to pay up their arrears, they will not be allowed to move into their new homes. He explains issues surrounding arrears were “never raised” by of- ficials from the City’s housing de- partment and has resulted in con- fusion. But Mayco member for Human Settlements Siyabulela Mamkeli says beneficiaries and the steering committee were informed. He says there are about 35 ten- ants who have arrears of more than R1000, 15 have no arrears or arrears amounting to less than R1000. Present says as the procedures around government housing devel- opments were new to the PSC they relied on the guidance from offi- cials. “We were told the criteria in- cluded a joint income of R3500 and beneficiaries are not to have any properties registered in their names. We were not informed the arrears needed to be paid,” he ex- plains. Present says while some of the completed houses have been com- pleted, there are many standing empty as beneficiaries cannot af- ford to pay the arrears. “The reason these people are beneficiaries is because they can- not afford the rental units. How can they now be expected to pay the arrears?” he fumes. Mamkeli says as a public sector owner, the City is legally bound to collect payment for services it renders. “Over the years, various pay- ment plans, debt arrangement and debt write-offs have also been im- plemented. While some of the ten- ant-beneficiaries fulfilled their ob- ligations, others did not,” he says. Mamkeli explains in some cases the payment arrangements were for R10 or R20. He says beneficiaries were in- formed in 2011 as part of the screen- ing process and were told to square their arrears or make arrange- ments. Mamkeli explains many became recipients of the City’s Indigent Policy, where all arrears are writ- ten off if a payment arrangement is entered into. “Some, however, did not honour this agreement even when their debt was written off,” he adds. But tempers are flaring and resi- dents have asked for urgent inter- vention into the matter. Present says there have been threats of protest action being tak- en and says warnings to authori- ties have yielded no responses. “The beneficiaries are angry and are demanding answers that the PSC cannot provide. We have asked officials to come and explain but received no answer,” he says. Present says City officials have been informed but have failed to re- spond. Mamkeli confirms that Present informed him about the protest and says the City has offered to ac- commodate these tenants in anoth- er phase of the project. “This will give them more time to fulfil their obligation on their rental debt.” In June, the streets of Mountain View were on fire as angry resi- dents set tyres and other flamma- ble objects alight. Residents claimed they were not allowed to ask questions at a public meeting. This, however, was denied by the PSC and the City who said the meeting was structured to ensure all questions were written down and responded directly to the indi- viduals affected. A group of residents from the CapricornBeach complex have rallied togetherto take on issues affecting residents of

gated communities.The group have taken up various issues

including building plan regulations, fines,and biometric systemswith theCity of CapeTown.In a letter to Mayor Patricia de Lille’s of-

fice, the group outlined several grievancesagainst the Home Owner’s Association(HOA)andasked theCity to intervene.Theymet with Mayoral Committee member forEconomic, Environmental and SpatialPlanning Johan van der Merwe.Helga Jansen-Daugbjerg, spokesperson

for the group, says theCity gave a clear indi-cation of where they stand on these mattersand says while a Gated Communities policyexisted, the City was reluctant to act on it.Van der Merwe explains as the City is nota party to the agreement nor a member ofthe HOA, they consider this a private mat-ter. “The City’s responsibility is to monitorthat the HOA does not become dysfunction-al,” he says.

ConstitutionJansen-Daugbjerg says the constitution

was flawed as it was registered under theSectional Title Act and the Land Use Plan-ningOrdinance (Lupo) guidelines set out bythe City.This, she says, was highlighted “problem-

atic” by City officials during the meeting.According to a response from the board

of trustees of the HOA, the body came intobeing on 1 April 2005 simultaneously withthe registration of the first erven.“One of the many sub-division require-

ments was that the submission and approv-

al of a constitution before the City wouldgrant transfer of the erven. The May 2010version was an amended and updated con-stitution,” they explain.They say the Sectional Title Act only ap-

plies to the sectional title blocks, of whichthere are currently four within CapricornBeach, with a fifth planned.These, they explain, are run by their own

respective boards and need to comply withthe Act. “As individuals they are membersof the HOA as well,” the board says.They say the HOA is registered under

Lupo. Van der Merwe says the City ap-proved the constitution as required in theconditions of approval for the development.“If a member of the HOA believes there

is an error contained in the constitution,then they should approach the HOA to cor-rect it and request the City to approve theupdated version,” he explains.

Biometric systemJansen-Daugbjerg says residents have al-

so objected to the implementation of a bio-metric system without a policy.She explains parents are required to load

fingerprints of minors to ensure access tothe complex. “There are various privacylaws which this system is in violation of.Those of us who are not registered with thesystem are effectively locked into the com-plex in the case of a fire,” she says.The board says the system was installed

in 2012 after approval by homeowners at theannual meeting. This, they say, was donefor better security. A tag or private code isavailable to residents opting not to use thissystem. They also say there is a policywhich has been distributed to homeowners.

However, residents claim to have notseen the policy. Van der Merwe says theCity’s fire department assessed the emer-gency access and found the system in order.

FinesJansen-Daugbjerg says “innocuous” fines

are also a hot potato as residents receiveseveral fines for small infractions. Theyclaim the fines are used to harass them. In

one case, she says, a minor was fined andforced to clean the bin house.“We also want to know what the money

obtained from fines are used for as this isnot reflected on financial statements,”Jansen-Daugbjerg says. But the board saysall income and expenses are accounted forin their books which are audited annually.They claim the policy on fines was signed

and adopted by homeowners and say chil-dren cannot be fined. “Residents have theright to appeal. They need to send in a writ-ten reason for an appeal to the HOA office.A meeting is generally set up with the own-er and trustee(s). If they are still unhappywith outcome, they can request an appeal,which is put before entire board of trus-tees,” they say. The board says after thisthe owner still has the right to invoke dis-pute resolution as set out in constitution.Following the assault of Valerie Appany

(65) by Anton Noffke, residents have alsocalled for Noffke to be removed from theboard. “Ironically, he is in charge of thesafety and security portfolio on the board,”Jansen-Daugbjerg explains.However, the board says, he is in charge

of the new projects portfolio not security.“This is a private matter between two

neighbours, and has nothing to do with theHOA or board of trustees. It is an ongoinglegal matter of which we are not a party,”they say. Residents applied for permissionto protest on Thursday 7 August but say theapplication was “lost”. Jansen-Daugbjergsays they submitted the application severalweeks in advance and when they did nothearback they contacted the official respon-sible. “She said she had not received it andnotified us on the day of the protest we hadbeen granted permission. This did not giveus enough time and it was called off,” shesays. Van der Merwe says the City receiveda call on Friday 1 August from Jansen–Daugbjerg asking about the application.He says four days later another residentemailed the application and they receiveda response the morning of 7 August.V What are your thoughts? management of access to the Kalk Bay tidalpools has been rejected by residents.Last week residents rallied together to

have their voices heard about the proposedMemorandum of Understanding (MOU) asthey claim they were not consulted.Resident Faeez Poggenpoel explains a

protest was to have been held on Saturday9 August during which residents wouldhave demonstrated their unhappiness.He says access to the pools has been com-

prised since the erection of the woodendecks.Following a previous protest, residents

approachedCity officials, the authors of theMOU, to get clarity. “The official agreedthat access has been compromised but saidas it has taken place on Prasa land the Cityhas little power,” he says.Residents argue that the construction of

the decks have taken place over years andclaim authorities did not step in.Poggenpoel says after this site meeting

residents approached Prasa for help.“When we didn’t get an answer, we decidedto protest. We reject the MOU and will notaccept the response ‘it is on Prasa land’.”Just before the protest was to commence

residents were visited by a Prasa officialwho agreed theMOU needed public partici-pation. “He assured us that residents willbe part of the discussions regarding theMOU. There will now be a series of meet-ings regarding this,” he says.The protest was called off.JohanvanderMerwe,Maycomember for

Economic, Environmental and SpatialPlanning, says while the area in questionis not administered by the City, a decisionwas taken to ensure the guaranteed rightsof access to the coastline and tidal pools.Hence the City had two decisions: go the

legal or a facilitated route.“TheCity opted to pursue a facilitated ap-

proach through a formal negotiated agree-ment such as the MOU,” he says.In negotiating the MOU, the City made it

clear to Prasa and the Brass Bell that if rea-sonable consensus was not reached, Vander Merwe says, the City would seek legal

action. “All parties have agreed in princi-ple to theMOUand in sodoing, the essentialrights of access have been assured.”But theMOUdoes not dealwith thewood-

en decks as, Van derMerwe says, under theNational Environmental Management Act(Nema), the provincial Department of De-velopment Planning deals with the legali-ties.The MOU stipulates that restaurant fur-

niture be removed from around the pool toensure adequate public space and access tothe pools as well as to prevent anyone frombeing excluded from the area.Van der Merwe says the concerns of resi-

dents relating to access, the land use anddecks were taken into account while draft-ing the MOU through consultation with lo-cal councillors.Prasa Corporate Real Estate Solutions

It’s that time of the year when residentsacross the Far South gather at Fish Hoekbeach to wish away the winter blues.Line dancing, sand castles, treasure hunts

and a big splashwill take centre stage at thisyear’s Spring Splash. The annual event willtake place on Sunday 7 September and willkick off just after noon.

At 15:00 hordes of beachgoers dressed in

their favourite outfit will take part in the bigdip.

The launch was held at Fish Hoek Beachlast week where well-known businessmenand City of Cape Town councillors dressedup for a pre-splash.

Organiser Manu Choudree explains theevent is about creating a fun family outingfor all to enjoy. Therewill also be an attemptto break the line dance record, where organ-isers are trying to gather 1000 people to par-ticipate.

Old favourites suchas the sand castle com-petition and treasure huntswill also be held.

This year, residents are also encouragedto bring video cameras and smartphones torecord the splash. Choudree says thosewanting to enter will have to fill in an entryform and load their videos on YouTube.

“The video which receives the most hitswill then be named the winner. The prizeswill be confirmed shortly,” he says.

He explains sports clubshave been invitedto attend.

Fish Hoek Central Improvement District(CID) director Mike Reaper says they havespoken with City officials and Shark Spot-ters to ensure the shark net is deployed onthe day.

“We want to promote Fish Hoek Beach asa safe swimming beach,” he says.

As ’n 85-jarige inwoner van Vishoek, watal meer as 50 jaar hier woon, ken die meestemense my hier.

Ten spyte daarvan [dat twee gay mans ge-reelde besoekers was] beskuldig die berigmy dat ek ’n lesbiese dame en haar moederuitgegooi het – en dit nogal omdat dit teenmy “Christelike beginsels” is.

My twee vakansie-eenhede is nie ’n on-derneming nie, maar slegs ’n stokperdjiewat ek bedryf omdat ek van mense hou, on-geag hul godsdiens, ras of seksuele oriënte-ring.

[Monique Duval] het ’n foto van my huiskom neem. Hoekom het sy nie kom aanklopen my in die oë kom kyk nie?

Ek is geskakel oor die aantygings vanWerda Kruger van Vereeniging, en gevraof ek sou reageer “in the interests of thepublic”. Toe ek vra om self met haar te kanpraat, was die verontwaardigde antwoord:“Oh, no, it’s client confidentiality!” Wat is“confidential” oor hierdie hele storie?

Ek het hul faks met vier vrae na Suid-skiereiland se subraad-voorsitter FelicityPurchase, wat my goed ken, geneem, watdadelik gesê het: “Ignore it, nobody will be-lieve it.” Op my aandrang, het sy en ek eg-ter met ’n brief geantwoord.

Hierdie brief het ek eers na my proku-reur verwys. Sy antwoord: “Die brief is100%. Moet tannie Bettie nie ontstel nie!”So het ek dit aan People’s Post ge-e-pos.

Duval se antwoord: “Thank you for yourresponse. We are going ahead with the sto-ry, but will not use your words verbatim.”

Daarop het ek geantwoord óf julle plaasmy volledige antwoord, áf ek trek dit terugen volstaan met: Geen kommentaar.

En toe kry ek verskeie foonoproepe ene-posse soos: You have changed your mindnumerous times. You have been givenample opportunity to give your side of thestory.

Wat word deur die perskode onderskryf?In reaksie op bogenoemde, maak ek be-

swaar teen hierdie onware, onakkurate,onregverdige, ongebalanseerde en lasterli-ke storie.

Ek het nie rookfasiliteite nie, so geen as-bakkies nie.

Daar is geen tuin nie, slegs ’n toegeboudestoepie.

In ons kort gesprek op die stoep het diewoorde “gay” of “Christelike beginsels”nooit ter sprake gekom nie, en [Kruger se]ma was nie naby nie. Sy het binne gesit enTV kyk.

So, waar kom daardie “confirmation”van mev. Prinsloo vandaan?

Sover ek weet, was daar geen probleemnie. Me. Kruger het net kom sê hulle gaanuittrek en gevra of sy haar geld kan terug-kry. Toe ek vra waar hulle dan so skielikander blyplek gaan kry, sê sy hul gaan byhaar skoonsuster bly. Binne 10 minute hetsy die sleutels gebring en vertrek. Dit duidaarop dat hulle nooit alles uitgepak hetnie; dat hulle eintlik gehoop het, maar nieseker was of die familie hul sou huisvesnie; dat met hul besoek die oggend aan diefamilie hul wel gesê is dat hul kon kom, endat hul ’n verskoning gesoek het om uit tetrek sonder om hul deposito te verbeur!

De Jongh is genader om haar kant te stel,wat sy wel gedoen het. In haar laaste e-posaanPeople’sPost het sy geweier dat dit gepu-bliseer word. Sy het daarop aangedring datdit verbatim geplaas word. Duval het ver-duidelik dat De Jongh se kommentaar tenvolle geplaas sou word, maar nie verbatimnie.

Duval het Kruger se naam gebruik virkommentaar oor die aantyging, anders souDe Jongh nie geweet het waaroor om kom-mentaar te lewer nie.

De Jongh het aangedring om met die re-dakteur te praat. Sy is telefonies deur ’n re-dakteur geskakel en het daarop aangedringom haar kommentaar deur haar prokureurte doen. Get ready the rigging, hoist your an-chors and set sail.

It’s that time of year when thecountry’s top sailors make their way tothe Far South for the annual Lipton Chal-lenge Cup in Simon’s Town.

This year will see the 61st sailing of therace which is hosted by False Bay YachtClub. The event will be held from Sunday24 to Friday 29 August. A total of 15 teamswill vie for the coveted title at the BlueFlag statusmarina; six raceswill be sailedthroughout the challenge.

And the host club will have a vested in-terest in the event, as they look to defendthe title they roped in last year. The FBYCcrew, captained by Markus Progli, willagain be sailing FBYC Intrasure. But theyhave to fend off the challenges of seasonedcrews and skippers before they can retaintheir title.

The largest and toughest challenge, byfar, will come from nine-time winningskipper Greg Davis and his Royal CapeYacht Club crew on Co-Ordination. Theclub has a rich and successful history at

the challenge.Another team who will be looking to

win the cup will be Zeekoe Vlei YachtClub, on B&G captained by Daniel Agul-has.

Both Co-Ordination and B&G have lift-ed the cup a staggering 11 times.

The visiting crews to keep an eye on areRoyal Natal Yacht Club who have beencrowned champions on 10 occasions andseven-time victors Point Yacht Club. TheKwaZulu-Natal crewwill raceOrionB2G2and be skippered by Brennan Robinson,while the Mossel Bay team – on PointYacht Club – will be led by Craig Millar.
