commencing be re-worded to enable building works to commence. It is further
advised that the proposed entrance is currently fenced off. Notice has been
served on the current occupier which takes effect on January 1st 2008. The
applicant encloses a copy of the Land Registry Plan showing the extent of the
boundaries of No. 10 Heol Pentwyn and a copy of a letter from Leader Property
Management confirming that access has been granted over the land currently
occupied by the owners of No. 10 Heol Pentwyn.
In addition, the applicant refers to the recent consent (Ref. 07/184) given for the
removal of protected trees to the rear of the plot to facilitate a temporary access
to the site.
The Head of Engineering and Transport (Highways) has confirmed that
condition No. 4 be re-worded to read:
“Prior to the first occupation of the dwelling a 3.2 metre wide drive shall be
constructed together with a pedestrian vehicular crossing and retained as such
thereafter.”
Reason
In the interests of highway safety.
Coedffranc Community Council – raises concerns regarding the access and
egress for the dwelling could be difficult as the entrance is only the width of a
single gate. The proposed temporary access for the delivery of building
materials is inadequate. These issues have been addressed previously in the
report.

Additional correspondence has been received raising concerns with regard to:
1. The proximity of the proposed mast to properties on Water Street
2. The visual impact of the mast on the surrounding area and its affect on
property values
3. Potential short and long term affects of radiation from the mast to the
residents of Water Street

4. The potential of the mast setting off car and household alarms.
In respect of the objections received, concerns raised with regard to distances
from properties and potential impact upon health and the visual impact of the
mast have been dealt with in the report to Committee. With regard to the affect
on house prices, this is not a material planning consideration and therefore
cannot be considered in this report. There is no evidence to suggest that car or
domestic alarms will be set off by the mast.

The applicants’ agents have submitted a further letter relating to the retail and
highways issues.
In respect of the retail issues these relate to matters they previously raised and
can be summarised as:
Significant retail and qualitative need demonstrated
The Authority has not provided any figures to contradict need
Clawback and reversal of leakage of expenditure is UDP objective
No sequentially preferable site
Site is identical to that previously approved
Site accords with Planning Policy
These matters are addressed in the report.
In respect of Highways:
PLANDEV-260607-MIN
- 46 -
1. In respect of service road to units 5 and 6, it would require a queue of
3 lorries to cause a problem and conditions could be overcome by
restricting times of loading.
2. With regard to unit 1, they query that this should read “unit 7”. If this
is the case the service bay is some way from the public highway and
would not result in any conflict.
3. The applicants have modelled and “tracked” turning movements and a
safe turn into the site can be achieved without straddling the opposite
side of the carriageway.
4. Any potential conflict between staff and vehicle movements will be
minimal and no public will access the area.
In response to this supporting statement the Head of Engineering and Transport
(Highway Section) has considered the proposed scheme in detail and maintains
his objection for the reasons given in the appraisal and reason for refusal.
Amendments to two of the four reasons for refusal to read as follows:
(1) There is a clear and significant risk that the proposal could undermine the
UDP strategy to strengthen Pontardawe's role as an important shopping centre
within the Swansea Valley and could cause significant harm to the vitality,
attractiveness and viability of the shopping centre - particularly when
considering the cumulative effects of recently completed developments and
outstanding planning permissions, and could lead to the loss of retail outlets and
other businesses that are best located in a town centre and is therefore contrary
to Policy S5 of the West Glamorgan Structure Plan, Policy S2 of the Northern
Lliw Valley Local Plan, and Policies 15 and TRL 3 of the Neath Port Talbot
Deposit Draft Unitary Development Plan (as amended).
(2) The proposal is located further away from the existing shopping centre than
the sequentially better located scheme for which planning permission has been
granted. If granted consent, the proposal could divert retailers away from this
better-located site and result in the development of a new out of centre focus
and generate adverse impacts in terms of traffic generation and reducing the
likelihood of linked trip benefits for Pontardawe town centre, contrary to Policy
S5 of the West Glamorgan Structure Plan, S2 of the Northern Lliw Valley Local
Plan and Policies 15 and TRL 3 of the Neath Port Talbot Deposit Draft Unitary
Development Plan.

The Head of Engineering and Transport (Highways) recommends refusal on the
grounds that the dwelling would be accessed via an overly long drive of
insufficient width to accommodate a turning facility. This in turn would result
in additional manoeuvres in reverse gear onto a busy district road.
Reason for Refusal
The proposed access drive by virtue of its width is unable to accommodate a
turning facility, resulting in additional manoeuvres in reverse gear onto a busy
district road to the detriment of highway safety and contrary to policy T2 of the
Northern Lliw Valley Local Plan and Policy T1 of the Neath Port Talbot
Deposit Draft Unitary Development Plan.
