The Head of Planning presented the undermentioned application which

had been recommended by him for approval, but required determination

in conjunction with the circulated copy of the Minutes of the Planning

(Site Visits) Sub Committee held on 14th June, 2007 and the amendment

sheet - attached.

Demolition of existing Hotel and erection of 2 and 3 storey building

comprising of 40 x 2 bedroomed apartments together with Associated

Two additional conditions to read as follows:

17. Notwithstanding the submitted plans, prior to

commencement of work on site a scheme for

the strengthening of the existing culvert where

it runs beneath the proposed garages shall be

submitted to and agreed in writing with the

Local Planning Authority. The agreed

strengthening works shall be completed prior to

the commencement of work on each of the

culvert.

commencement of work on site a scheme for

RESOLVED: that the undermentioned application be deferred for a

to allow Members to assess the impact of the proposed

8. LISTED BUILDING AND CONSERVATION AREA

RECOMMENDED FOR REFUSAL

The Head of Planning recommended that due to the decision to defer

Planning Application No. P/2006/1340 for a Site Visit, it would be

appropriate to defer consideration of the undermentioned application until

such time that Planning Application No. P/2006/1340 had been

determined by Committee.

10. ENPT 3954 - ENFORCEMENT NOTICE AT ‘BROOKLANDS’

BUNGALOW, INTERVALLEY ROAD, BANWEN, NEATH

RESOLVED: that the Enforcement Notice served upon the owner of

“Brooklands” Bungalow, Intervalley Road, Banwen,

Neath be withdrawn and that the Legal Services

Section be instructed to withdraw the prosecution

action against the landowner for non-compliance with

the Enforcement Notice.

11. ENPT 5821 - CHANGE OF USE OF PROPERTY FROM RETAIL

TO OFFICE ACCOMMODATION AT 117 SWANSEA ROAD,

TREBANOS

RESOLVED: that authorisation be granted for the service of an

Enforcement Notice in respect of the unauthorised

change of use from retail shop to an office at 117

Swansea Road, Trebanos.

The steps required by the Enforcement Notice be as

follows:-

i) cease the use of the property at 117 Swansea

Road, Trebanos as office accommodation as

defined by the A2 Classification of The Town

& Country Planning (Use Classes Order) 1987;

ii) that the timescale for compliance be 3 months

after the date on which the Notice takes effect;

iii) that the reasons for such action is that the

unauthorised change of use is contrary to Policy

T1 of the Neath-Port Talbot Unitary

Development Plan (Deposit Draft) and is

harmful to highway safety, as the applicant has

failed to demonstrate that the use will not result

in unacceptable levels of indiscriminate on

street parking.

RESOLVED: that no further action be taken in respect of the

13. ENPT 5865 - REMOVAL OF TREES PROTECTED BY A TREE

PRESERVATION ORDER AT “THE CLOGGERY”,

YNYSGOLLEN, ABERDULAIS

RESOLVED: (a) that no action be taken against the landowner of

“The Cloggery”, Ynysygollen, Aberdulais for

the felling of 12 semi-mature Alder trees

protected by Tree Preservation Order T139 and

that agreement be reached with the landowner

on a replanting programme to augment those

trees lost;

(b) that the situation be monitored in consultation

with the Authority’s Arboricultural Officer and

where replanting is not undertaken within the

first 2 months of the next planting season

(which starts on 1st October 2007), that

authorisation be sought for the service of a Tree

Replacement Notice.

14. ENFORCEMENT NOTICE AND STOP NOTICE ISSUED AT 75

RESOLVED: that no further action be taken in respect of the

A letter has been received from Pontardawe Town Council stating that “The

Town Council are concerned that this development is being called St James

Parade and would prefer to see it have a Welsh name in a predominantly Welsh

area. They are also concerned to see 10 new houses being built in this area when

Thomas Street is already congested and each new house will have at least one

car, if not two or more.”

With regards to the issues raised by Pontardawe Town Council the naming of

the development would not be a material planning consideration. The main

report has discussed the highway issues and the Head of Engineering and

Transport (Highways) has no objections subject to conditions.

A consultation reply has been received from the Head of Engineering and

Transport (Drainage) who identifies that a culvert crosses underneath the garden

and garages of plots 1 and 2, and the garages of plots 9 and 10. The culvert also

crosses underneath the dwelling at plot 10.

In response to this the following two additional conditions are recommended to

read as follows:

17. Notwithstanding the submitted plans, prior to commencement of work on

site a scheme for the strengthening of the existing culvert where it runs

beneath the proposed garages shall be submitted to and agreed in writing

with the Local Planning Authority. The agreed strengthening works shall

be completed prior to the commencement of work on each of the garages

which are proposed to be sited over the culvert.

18. Notwithstanding the submitted plans, prior to commencement of work on

site a scheme for the diversion of the existing culvert around the footprint

1. In respect of service road to units 5 and 6, it would require a queue of

3 lorries to cause a problem and conditions could be overcome by

restricting times of loading.

2. With regard to unit 1, they query that this should read “unit 7”. If this

is the case the service bay is some way from the public highway and

would not result in any conflict.

3. The applicants have modelled and “tracked” turning movements and a

safe turn into the site can be achieved without straddling the opposite

side of the carriageway.

4. Any potential conflict between staff and vehicle movements will be

minimal and no public will access the area.

In response to this supporting statement the Head of Engineering and Transport

(Highway Section) has considered the proposed scheme in detail and maintains

his objection for the reasons given in the appraisal and reason for refusal.

Amendments to two of the four reasons for refusal to read as follows:

(1) There is a clear and significant risk that the proposal could undermine the

UDP strategy to strengthen Pontardawe's role as an important shopping centre

within the Swansea Valley and could cause significant harm to the vitality,

attractiveness and viability of the shopping centre - particularly when

considering the cumulative effects of recently completed developments and

outstanding planning permissions, and could lead to the loss of retail outlets and

other businesses that are best located in a town centre and is therefore contrary

to Policy S5 of the West Glamorgan Structure Plan, Policy S2 of the Northern

Lliw Valley Local Plan, and Policies 15 and TRL 3 of the Neath Port Talbot

Deposit Draft Unitary Development Plan (as amended).

(2) The proposal is located further away from the existing shopping centre than

the sequentially better located scheme for which planning permission has been

granted. If granted consent, the proposal could divert retailers away from this

better-located site and result in the development of a new out of centre focus

and generate adverse impacts in terms of traffic generation and reducing the

likelihood of linked trip benefits for Pontardawe town centre, contrary to Policy

S5 of the West Glamorgan Structure Plan, S2 of the Northern Lliw Valley Local

Plan and Policies 15 and TRL 3 of the Neath Port Talbot Deposit Draft Unitary

Development Plan.
