What is a common name?A common name is a commonly used name for an organism. Common names can be local, family or traditional names and can vary widely by region. Any organism can have many com-mon names, so binomial nomenclature is used so each species has only one ‘scientific’ name.

What is a plant hardiness zone?A plant hardiness zone is a geographic area in which categories of plant life are capable of growing as defined by climatic conditions including minimum temperatures of the zone. Asheville is currently in zone 6b (-5°F to 0°F)

How to ask a nursery or garden center for a plantFinding a plant for your landscape can be a challenge if it is new in the trade or has unusual characteristics. Before calling your local garden center or nursery, you need the scientific name. Horticultural professionals use scientific names and may also need to know a series, trademark or marketing name. Ask to speak with someone who knows the business inventory and how that inventory is sourced. It may be a good idea to place your request in advance of a growing season to give the center time to acquire the plant.

Plant PatentsPlant breeders are awarded patents by the US Patent and Trade-mark Office for new and distinct cultivated varieties of plants. To be eligible, a plant must have been asexually propagated and exactly reproduced by the breeder. A patent lasts for 20 years and forbids the propagation, selling, or use of the variety with-out permission.

PPAF = Plant Patent Applied For/ PP = Patent PendingBoth terms indicate that someone has applied for a patent and serves as a warning that copiers should be careful not to infringe upon it. Once a patent is issued, the patent owner stops using the “patent pending” terms and starts identifying the plant by its patent number, written, for example, as PP278654.

Trademarks ™ and Registration ®Trademarks protect names and unlike patents can be renewed forever as long as they are being used in business. A trademark does not prevent others from selling the same plant, or from selling the plant under a clearly different mark. When nurseries add memorable names to plants to boost sales it often causes confusion in the industry.

Plant names followed by the ® mark indicates that the plant’s trade-mark name has been registered. Although federal registration of a trademark is not required, it does give notice to the public of a claim to ownership, gives exclusive right to use the mark in connection with the marketing of a plant, and gives the owner the right to bring action on infrigement in federal court. It also allows the owner to file the registration with US Customs to prevent the importation of infringing foreign goods.
