3. ACCEPTANCE

A. In submitting this Bid, it is understood that ESLHA reserves the right to reject any and all Bids. If written notice of the acceptance of the Bid is mailed, faxed, E-mailed or delivered to the undersigned within thirty (30) days after the Notice to Proceed, the undersigned agrees to perform all work as prescribed herein.

B. The Contracting Officer may waive minor informalities or allow the Bidder to correct them depending on which actions is in the best interest of the housing authority. Minor informalities are matters of form rather than substance, evident from the Bid document, or insignificant mistakes that can be waived or corrected without prejudice to the other Bidders: That is; the effect on price, quantity, quality, delivery, or contractual conditions is negligible.

C. This offer shall be open to acceptance and is irrevocable for sixty (60) days from the Bid closing date.

D. If this Bid is accepted by Owner within the time period stated above, we will:

1. Execute the Agreement within seven (7) days of receipt of Notice of Award. 2. Furnish the required bonds (if applicable) within seven days of receipt of Notice of Award.

3. Commence work within seven days after written Notice to Proceed of this Bid.

The contractor shall begin performance within 7 calendar days and complete it within 60 business days after

receiving award notice to proceed. This performance period is mandatory negotiable. The contractor must furnish any required performance and payment bonds? Yes No

bond(s) within seven calendar days after award.

Additional solicitation requirements: A. Sealed offers, in original only, to perform the work required are due at the place specified above by May 30,

2017 local time at 3:00 PM. If this is a sealed Bid solicitation, offers will be publicly opened at that time.

SECTION 1 – INTRODUCTION

1.0 STATEMENT OF NEED

ESLHA requests Bids from responsive and responsible Bidders to meet its needs. A brief description is set forth be- low for the Bidder’s convenience, with detailed requirements in subsequent sections of this solicitation. If interested and able to meet these requirements, the ESLHA appreciates and welcomes a Bid.

1.1 BID PRICES – FIRM FIXED PRICE

Bids shall be in the form of a firm unit price for each line item set forth in this Solicitation, Offer, and Award. Bidders shall provide pricing as noted on the Bid form. ESLHA reserves the right to award contracts in a manner that is beneficial to ESLHA. Unit pricings are to be provided as requested. Do not include sales tax for any item in this Bid.

1.2 CONTRACT TYPE AND ADMINISTRATION

This is a “Firm Fixed Price contract solicitation. This Bid will result in a firm fixed price contract to supply the items as listed on the Bid along with unit prices as requested for items. Firm Fixed Price shall be firm for the terms of the contract and shall include all associated costs. The Bidder must provide a firm; fixed price for all requirements set forth in the Solicitation, Offer, and Award. A lump sum firm, fixed price must be shown on page 2 of the ESLHA Form 1442 (Solicitation, Offer, and Award) which must be completed, signed and returned with the Bidder's acknowledgment of all solicitation amendments.

1.3 BID BOND Required For This Project

Each Bidder must submit with his Bid a satisfactory bid bond or a certified check or bank draft, payable to The Housing Authority of the City of East St. Louis, in the amount of 5% of total Bid amount. If the Bid guarantee is not submitted with the Bid, The Housing Authority shall reject the Bid.

1.3.1 a satisfactory performance, labor, and material payment bond in the amount equal to 100 percent (100%) of the contract amount;

1.3.2 a separate performance bond and payment bonds, each 50% or more of the contract price;

1.3.3 a 20 percent (20%) case escrow;

1.3.4 a 25 percent (25%) Irrevocable Letter of Credit. The Irrevocable Letter of Credit must contain language acceptable to the Housing Authority. The surety company must be authorized to do business in the State of Illinois and must be acceptable to the Government and be listed on the most recently published U.S. Treasury Circular 570 http://ww.fm.treas.gov/c570/indext.html.

1.4 OTHER

Contractors omitting the Solicitation, Offer and Award form, and any other required forms from their submittals may be considered non-responsive.

The Housing Authority of the City of East St. Louis reserves the right to reject any and all Bids and to waive any informality in the Bid process. The Owner also reserves the right to reduce the scope of work in this project to stay within budget limitations. No Bids shall be withdrawn for a period of sixty (60) days subsequent to the opening date.

The work is to be funded by the U.S. Department of Housing and Urban Development (HUD), and the contract ad- ministered by the Housing Authority of the City of East St. Louis. HUD reserves the right to approve the contractor selected by the Authority.

1.5 HA’S RESERVATION OF RIGHTS: ESLHA reserves the right to:

Reject any or all Bids, to waive any informalities in the IFB process, or to terminate the IFB process at any time, if deemed by the HA to be in its best interests.

Not to award a contract pursuant to this IFB.

Make an award to the one Bidder (aggregate for all items; or, to make an award to multiple Bidders for the

same or different items.

To terminate a contract awarded pursuant to this IFB, at any time for its convenience upon 30 days written notice to the successful Bidder(s).

Determine the days, hours and locations that the successful Bidder(s) shall provide the services called for in

this IFB.

Retain all Bids submitted and not permit withdrawal for a period of 60 days subsequent to the deadline for receiving Bids without the written consent of the HA Contracting Officer (CO).

Reject and not consider any Bid that does not meet the requirements of this IFB, including but not necessarily limited to incomplete Bids and/or Bids offering alternate or non-requested services.

Have no obligation to compensate any Bid for any costs incurred in responding to this IFB.

ESLHA retains the right to demand and receive a change in personnel assigned by the Contractor to provide services to ESLHA if ESLHA believes that such change is in its best interest.

At any time during the IFB or contract process to prohibit any further participation by a Bidder or reject any

Bids submitted that does not conform to any of the requirements detailed herein, and contractor further agrees that he/she will inform the CO in writing within 5 days of the discovery of any item listed herein or of any item that is issued thereafter by the HA that he/she feels needs to be addressed. Failure to abide by this time frame shall relieve the HA, but not the prospective Bidder, of any responsibility pertaining to such issue.

1.6 BID DOCUMENTS

DO NOT FOLD OR MAKE ANY ADDITIONAL MARKS, NOTATIONS OR REQUIREMENTS ON THESE DOCUMENTS! As all the pages of this document are considered to be a part of the Form of Bid, Bidder shall not be allowed to change the conditions or specifications contained herein by entering onto these documents any changes, notations, or additional requirements. If any such additional marks, notations, or requirements are entered on the original signed documents that are submitted to the ESLHA, the entire Bid will be determined invalid and it will be rejected without further consideration.

It shall be the responsibility of each Bidders to be aware of and to abide by all dates, times, conditions, requirements, and specifications set forth within all applicable Documents issued by the ESLHA; including any addenda and attachments to the completed forms submitted by the contractors. By virtue of completing, signing, and submitting the completed Documents and attachments, the contractor is stating his/her agreement to comply with the Instructions, Conditions and requirements set forth within the Documents.

1.7 BID FILING INSTRUCTIONS

Bids shall be submitted in sealed envelopes or package. All required forms shall be submitted in the envelopes or package(s), and shall be clearly marked, “Bid Documents” along with the project name and number, name of Bidder, and the date and time when Bids are due. Once received by the ESLHA, Bids will not be returned.

Formal communication such as requests for clarification and/or information concerning this solicitation shall be sub- mitted and received only in writing to the ESLHA’s Contracting Officer. No information concerning this solicitation or request for clarification will be provided in response to initiated telephone calls. 1.8 TIME FOR RECEIVING BIDS

Bids received prior to the closing date and time will be securely kept, unopened until opening date. The officer, whose duty it is to open them will decide when the specified time has arrived, open them, and no Bids received thereafter will be considered responsive.

1.10 CONTRACT COMPENSATION

The vendor shall be paid full compensation for work required, performed, and accepted under the contract at the prices indicated on the attached bid sheets.

1.11 CONTRACT AWARD

Due to the nature of the work and the critical importance of timely services, the ESLHA reserves the right to award a contract to more one Contractor for accomplishing this work. The contract will be awarded to the Bidder(s) that is most responsive and responsible and that is most advantageous to the ESLHA, provided the bid complies with all conditions of the solicitation. The ESLHA reserves the right to reject any and all Bids and to waive any informality in the process. The ESLHA is prohibited from making any awards to contractor firms (including subcontractors) or any individuals that are on the list of firms ineligible to receive awards from the United States Government, as furnished by HUD.

Responsiveness: A responsive Bidder is one who submits a Bid that conforms to in all material respects to the IFB, and includes all required forms.

Responsibility: A responsible Bidder is one who has the capability in all respects to perform fully the contract requirements and who has the integrity and reliability that will assure good faith performance. The ESLHA determines whether the Bidder is a “Responsible” Bidder with whom the ESLHA can or should do business.

Respondent should bear in mind that any offer that is unrealistic in terms of the technical, schedule commitments, or unrealistically high or low in cost, shall be deemed reflective of an inherent lack of technical competence or indicative of a failure to comprehend the complexity and risk of the requirements as set forth in this IFB.

A written award or acceptance of offer mailed or otherwise furnished to the successful Bidder within the time for acceptance specified in the offer shall result in a binding contract without further action by either party.

1.12 BID WITHDRAWAL/MODIFICATIONS OF BIDS

Bids may be withdrawn or modified by written notice received from Bidders prior to the deadline fixed for Bid receipt. The withdrawal or modification may be made by the person signing the bid or by an individual(s) who is authorized by him/her on the face of the Bid. Written modifications may be made on the Bid form itself, on the envelope in which the bid is enclosed, or on a separate document. Written modifications, whether the original is delivered, or transmitted electronically or by facsimile, must be signed by the person making the modification or withdrawal.

No Bid shall be withdrawn for a period of sixty (60) days subsequent to the opening of the Bids without the written consent of the ESLHA.

1.13 FINAL NOTIFICATION AND COMMENCEMENT OF WORK

All respondents will be notified by mail of the ESLHA’s selection as soon as possible. The selected vendor will be

expected to begin work no later than seven (7) days after the Notice to Proceed has been issued.

1.14 MINORITY BUSINESS PARTICIPATION

Pursuant to established ESLHA and the U.S. Department of Housing and Urban Development (HUD) Affirmative Action and Equal Employment Opportunity goals, all Bidders are advised they must satisfy the goal to utilize qualified minority businesses to perform subcontractor work or supply materials and/or equipment for this project. The established goal for said participation shall be no less than 25% (twenty-five percent) of the total contract price.

1.15 CERTIFICATION OF ELIGIBILITY

Each company submitting a bid for consideration must provide a certified statement that the company is not de- barred, suspended, or otherwise prohibited from professional practice by any federal, state, or local agency.

1.16 *INSURANCE REQUIREMENTS

Contractor shall present to ESLHA prior to execution of a contract, proof of insurance compliant with the requirements below and must be submitted on an Accord “Certificate of Insurance” form:

1.17 CURRENT REGISTRATION/LICENSING REQUIREMENT

Each company submitting a bid for consideration must be registered in the City of East St. Louis, Illinois and must have a working knowledge of Federal, State and local building codes and regulations.

By submitting a Bid the successful vendor certifies that he/she possess and will, prior to issuance of a contract pre- sent to ESLHA, proof and/or certification of the following:

1.18 INTEREST OF MEMBERS, OFFICERS OR EMPLOYEES AND FORMER MEMBERS,

OFFICERS OR EMPLOYEES

No member, officer, or employee of the ESLHA or former member, officer, or employee of ESLHA who ceased to be a member, officer, or employee within one (1) year shall voluntarily acquire any interest, direct or indirect, in any property included or planned to be included in the project, or in this contract or any subcontracts relating to the project.

If any such firm involuntarily acquires any such interest prior to appointment or employment as such member, officer, or employee, then such firm shall immediately disclose any such interest in writing to the ESLHA. Upon any such disclosure, a member, officer, or employee shall not participate in any action by the ESLHA relating to the property or contract in which he may have any such interest.

1.19 INTEREST OF MEMBER OF CONGRESS OR RESIDENT COMMISSIONER

No member of or delegate of the Congress of the United States of America or Resident Commissioner shall be admit- ted to any share or part of this contract or to any benefit to arise there from, unless it be made with a corporation for its general benefit.

1.20 INDEMNITY

The following indemnification clause is hereby included, by reference, as a part of the proposed contract: To the extent authorized by law, the successful Bidder shall protect, indemnify and hold the ESLHA, it officers, employees, agents and other retained consultants harmless from and against any and all claims, damages, losses, suits, actions, decrees, judgments, attorney’s fees, court costs and other expenses of any kind or character which the ESLHA its officers, employees, agents or other retained consultants may suffer, or which may be sought against, recovered from or obtainable against the ESLHA, its officers, employees, agents, or other retained consultants (i) as a result of, or arising out of, or on accounts of, or in consequences of any act or failure to act on the part of the successful Bidder, its subcontractors or agents, or anyone directly or indirectly employed by any subcontractor or agent, in the fulfillment or performance of the terms, conditions or covenants that are contained in the contract or agreement, regardless of whether or not the occurrence which gave rise to such claim, damage, loss, suit, action, judgment or expense was caused, in part, by any party indemnified hereunder; or (ii) as a result of, or by reason of,

or arising out of, or on account of, or in consequence of, any neglect of safeguarding the work; (iii) through the use of unacceptable materials, and/or products, or both, which may be defective or manufactured, designed, or installed or used so as to give rise to a claim; or (iv) because of any claim or amount recovered under the “Illinois Industrial Insurance Act”, or any other law, ordinance, or decree, which claim or recovery arose out of or is attributable to any

act or failure to act on the part of the successful Bidder in the fulfillment or performance of the terms, conditions and covenants that are contained in the contract. Any money due the successful Bidder under and by virtue of the con- tract which is considered necessary by the ESLHA for such purpose, may be retained by the ESLHA for its protection;

or in case on money is due, its surety, if any, may be held until all such claims, damages, losses, suits, actions, decrees, judgments, attorney’s fees and court costs and other expenses of any kind or character as aforesaid shall have been settled and suitable evidence to that effect furnished to the ESLHA; provided, however, that money due the successful Bidder will not be withheld when the successful Bidder produces satisfactory evidence that it is adequately protected by public liability and property damage insurance.

In this connection, it is expressly agreed that the successful Bidder shall, at its own expense, defend the ESLHA, its officers, employees, agents and other retained consultants, against any and all claims, suits or actions which may be brought against them or any of the, as a result of, or by reason of, or arising out of, or on account of, or in consequences of any act or failure to act which the successful Bidder has indemnified the ESLHA, its officers, employees, agents and other retained consultants against, and if the successful Bidder shall fail to do so, the ESLHA shall have the right, but not the obligation, to defend the same and to charge all direct and incidental costs of such defense to the successful Bidder, including attorney’s fees and court costs; provided however, that, if the forum in which such claim suit, or action is heard determines that the occurrence that gave rise to the same was caused, in whole or in part, by any party who is indemnified hereunder, the ESLHA shall reimburse the successful Bidder for all, or the indemnified party’s proportionate share, as the case may be, of the costs of such defense.

The successful Bidder guarantees the payment of all just claims for materials, supplies and labor, and all other just claims against it or any subcontractor, in connection with the contract.

2.0 GENERAL REQUIREMENTS

2.1 Required Submittals

The successful Bidder will be required to submit the following:

(a) Names of subcontractors they propose to sublet portions of the work; and

(b) Listing of subcontract amounts; and type of work

The successful Bidder shall not assign any right, nor delegate any duty for the work proposed pursuant to this solicitation (including, but not limited to, selling or transferring the ensuring contract) without the prior written consent of ESLHA. Any purported assignment of interest or delegation of duty, without prior written consent of ESLHA shall void and may result in the cancellation of the contract with ESLHA.

2.2 Subcontractors

Bidder shall clearly list any proposed subcontractors and the dollar amount, percentage and services to be provided in this offer on the letter of intent. At contract award, the following sub-contractor information will be required: Core employee list, City of E. St. Louis Registration; Complete contact information (include email); Certification of Davis-Bacon Compliance; Copy of Contract between Prime and Sub-contractor; Certificate Insurance. Subcontractors with minority/WBE status are to be identified.

2.3 References

The Contractor must submit at least three (3) current written letters of references for work of similar nature. In the event the HA elects to conduct reference checks, a uniform set of questions will be used to check each reference. ESLHA reserves the right to check references.

2.4 Notice of Award

Award shall be made to the responsive and responsible contractor(s) that submits the best value to ESLHA using price and other factors herein. The Contractor agrees that upon receipt of Notice of Award, they will sign Notice of Award and will deliver to the ESLHA:

(a) Signed Notice of Award; (b) Required City Registration Certificate; (c) Required Permits and Licenses; (d) Insurance Certificates; and

(e) Be prepared to execute a contract within seven (7) calendar days. 2.5 Holiday Schedule

The following list of holidays is observed by ESLHA. Contractors are advised that these dates of our office will be closed. Contractors are obligated to observe these holidays. Upon award Contractor shall provide list of their observed holidays.

2.6 Permits and Inspections (if applicable)

It is the responsibility of the Contractor to secure all necessary permits and inspections as required by local code and governing agencies.

2.7 Work Procedures

Work procedures shall be such as to minimize inconvenience to occupants surrounding the site. Trucks and other heavy equipment shall not be driven over unpaved areas or where underground utilities are located. All adjacent buildings and their contents shall be protected from damage.

2.8 Daily Work Hours (Hours other than those listed below require ESLHA approval)

Daily work hours shall be as follows: Starting time: No earlier than 8:00 a.m. Ending time: No later than 4:30 p.m.

2.9 Wage Classifications (Apply to this contract)

Application for Additional Wage Rate Classifications must be submitted to the Department of Labor prior to start of the Project. Bids should be based on a Labor Classification similar in effort and skill as the basis of the Davis Bacon Wage Determination Rate.

The contractor must submit weekly certified payrolls, indicating contract number, the employees complete name, last four (4) digits of social security number, address, employee’s title, pay rate, and fringes (if any). Authorized personnel of the company must sign the certified payrolls.

2.12 Utility Locations (if applicable)

The Contractor shall be responsible for contacting JULIE to mark public utilities underground prior to

digging. ESLHA will be responsible for private locates. The Contractor shall protect all public utilities from damage during the work. Any existing public utilities damaged by the contractor shall be repaired promptly by the Contractor, at Contractor’s expense.

3.0 Administrative Requirements

3.1.6 Access by grantee, the sub-grantee, the Federal Grantor Agency or any duly authorized

representative to any books, documents, papers and records of the contractor that pertain to that specific contract.

3.1.7 Retention of all required records for three (3) years after grantees or sub-grantees makes final

payment.

3.1.8 Compliance with applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act and Clean Water Act.

3.1.9 Mandatory Standards and policy relating to energy efficiency that is contained in the State

Conservation Plan issued in compliance with the Energy Policy and Conservation Act. 3.2 Changes

The Contracting Officer may at any time, by a written order and without notice to the sureties, make changes within the general scope of this contract. If any such change causes an increases or decrease in the cost of or the time required for performance of this contract, whether changed or not changed by such order, an equitable adjustment shall be made by written modification of this contract.

Any claim by the Contractor for adjustment under this clause must be asserted within 30 days from the date of receipt by the Contractor of the Notification of Changed provided that the Contracting Officer, if he decides that the facts justify such action, may receive and act upon any such claim if asserted prior to final payment under this contract. Failure to agree to any adjustment shall be a dispute concerning a question of

fact within the meaning of the clause of this contract entitled "Disputes". However, nothing in the clause shall excuse the Contractor from proceeding with the contract as changed.

3.3 Disputes

a. "Claims," as used in this clause, means a written demand or written assertion by one of the contracting par-

ties seeking, as a matter or right, the payment of money in a sum certain, the adjustment or interpretation of contract terms, or other relief arising under or relating to the contract. A claim arising under the con- tract, unlike a claim relating the contract, is a claim that can be resolved under a contract clause that pro- vides for the relief sought by the claimant. A voucher, invoice, or other routine request for payment that is

not in dispute when submitted is not a claim. The submission may be converted to a claim by complying with the requirements of this clause, if it disputed either as to liability or amount or is not acted upon in a reasonable time.

b. All claims by the Contractor shall be made in writing and submitted to the Contracting Officer for a written

decision. A claim by the PHA/IHA against the Contractor shall be subject to a written decision by the Contracting Officer.

c. The Contracting Officer shall, within ninety (90) (unless otherwise indicated) days after receipt of the re-

quest, decide the claim or notify the Contractor of the date by which the decision will be made. 3.4 Termination for Default:

The Contracting Officer, by written notice, may terminate this contract, in whole or in part for failure by the Contractor to perform any of the provisions hereof. In such event, the Contractor shall be liable for damages, including the excess cost of re-procuring similar supplies or services. The contractor shall not be charged with damages under this clause if:

a. It is determined for any reason that the Contractor was not in default; or

b. The Contractor's failure to perform is without his or her subcontractor's control, fault or negligence, the termination shall be deemed to be a termination for convenience under paragraph 28 as used in this provision. The term "subcontractor" means subcontractors at any tier.

3.5 Termination for Convenience:

The Contracting Officer, by written notice, may terminate this contract, in whole or in part, when it is in the best interest of the ESLHA. If this contract is for supplies and is so terminated, the Contractor shall be compensated in accordance with parts 49 of the FAR.

To the extent that the contract is for services and is so terminated, the ESLHA shall be liable only for payment in accordance with the payment provisions of this contract for services rendered prior to the effective date of termination.

3.6 Administration of Contract:

After award has been made, the Capital Improvements Department will administer this contract. Any re- quest for information or clarif ication after award of contract shall be referred to this office at (618) 646-

St. Louis, 700 North 20th Street, East St. Louis, IL 62205. 3.7 Invoice Payments

Payment terms are Net 30 days from date of receipt of invoice. Payments shall be submitted at the end of each month. Payments will be made in 30 day increments. Invoices shall contain company’s name, address, phone number, contract #, invoice date, invoice # and detailing full description of work performed by date. The payment requests shall be submitted to:

3.8 Lien Waivers (If applicable)

Unconditional lien waivers for labor and materials shall be provided from Contractor, all subcontractors and materials suppliers. Lien Waivers must be provided to the ESLHA within ten (10) days after receipt of disbursement of all payment requests.

3.9 Notices to Contractor

Payments will be made to the address shown on Invoice or Payment Request. To expedite payment of this order, you are required to submit your invoice or request for payment to the address listed on the Solicitation, Offer, and Award. The contract number must appear on your invoice or request for payment.

3.10 Hours of Delivery

Daily work hours and delivery of items under this order shall be accomplished between the local hours of 8:00 a.m. and 4:30 p.m., Monday through Friday. Deliveries shall not be made on Saturdays, Sundays, or

Federal legal holidays. No variations to this schedule shall be made without prior approval from the ESLHA.

3.11 Tax Exemption

ESLHA is exempt from Illinois State Sales tax. If necessary, Contractor may request the applicable Agency’s Illinois tax exemption number and federal tax exemption information.

3.12 Conflict of Interest

The Contractor certifies by acceptance of this order that no related official, during his or her tenure or for one year thereafter shall have any interest, direct or indirect, in this purchase order of the proceeds thereof. The term "related official" means any: 1) member, officer, or employee of the Housing Authority, 2) member of the governing body of the locality in which the Housing Authority was activated, 3) member of the governing body of the locality in which the project is situated, and 4) other public official of such locality (parties) who exercises any functions or responsibilities with respect to the project.

3.13 Contract Prices

Unless otherwise specified, all prices are firm-fixed prices, which are not subject to adjustment based on costs incurred. Prices should be stated in the units specified. All prices are considered to be f.o.b. destination, unless otherwise indicated.

3.14 Inspection

All items covered by this order shall be subject to inspection and acceptance at destination.

3.15 City Registration/Permit

The Contractor shall provide to the Housing Authority a copy of the Certificate of Registration and permit with the City of East St. Louis. The number to East St. Louis City Hall is 618-482-6810 for more information.

4.0 MBE/WBE/DBE, SECTION 3/ AFFIRMATIVE ACTION POLICY

4.1 Section 3 Requirements

The ESLHA will require perspective Bidders to provide with the Bid , a written “Section 3 Plan showing their possible compliance with the Plan. Prior to execution of a contract, a preliminary statement of work force needs (skilled, semiskilled labor, and trainees, of which the ESLHA will supply a list of potential candidates for the program) where known; or where not known.

A copy of the ESLHA Section 3 Policy-Plan can be found on the Agency’s website http://www.eslha.org.

This contract is subject to the following conditions under Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3).

4.2 SECTION 3 CLAUSE

A. The work to be performed under this contract is subject to the requirements of section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing.

B. The parties to this contract agree to comply with HUD's regulations in 24 CFR part 135, which

implement section 3. As evidenced by their execution of this contract, the parties to this contract certify that they are under no contractual or other impediment that would prevent them from complying with the part 135 regulations.

C. The contractor agrees to send to each labor organization or representative of workers with which the

contractor has a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or workers' representative of the contractor's commitments under this section 3 clause, and will post copies of the notice in conspicuous places at the work site where both employees and applicants for training and employment positions can see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin.

D. The contractor agrees to include this section 3 clause in every subcontract subject to compliance with

regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable

provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulation in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135.

E. The contractor will certify that any vacant employment positions, including training positions, that are

filled (1) after the contractor is selected but before the contract is executed, and (2) with per- sons other than those to whom the regulations of 24 CFR part 135 require employment opportunities to be directed, were not filled to circumvent the contractor's obligations under 24 CFR part 135.

F. Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this

contract for default, and debarment or suspension from future HUD assisted contracts.

G. With respect to work performed in connection with Section 3 covered Indian housing assistance, section 7 (b) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be performed under this contract. Section 7 (b) requires that to the greatest extent feasible (1) preference and opportunities for training and employment shall be given to Indian organizations and Indian-owned Economic Enterprises. Parties to this contract that are subject to the provisions of Section 3 and Section 7 (b) agree to comply with Section 3 to the maxi- mum extent feasible, but not in derogation of compliance with Section 7 (b).

4.3 AFFIRMATIVE ACTION CONTRACTORS AGREEMENT

During the performance of this Contract, the Contractor agrees as follows:

4.3.1 The Contractor will not discriminate against any employee or applicant for employment because of race, creed, color, sex, national origin, or handicap. The Contractor will take affirmative action to ensure applicants are employed, and employees are treated during employment without regard to their race, creed, color, or national origin. Such action shall include, but not be limited to the following: Employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places, available to employees and applicants for employment, notices to be

provided by the Contracting Officer setting forth the Provisions of this nondiscrimination clause.

4.3.2 The Contractor will, in all solicitations or advertisements for employees placed by or on behalf of the Contractor; state all qualified applicants will receive consideration for employment without regard to race, creed, color, sex, national origin, or handicap.

4.3.3 The Contractor will send to each labor union or representative or workers with which he has a collective

bargaining agreement or other contract or understanding, a notice, to be provided by the agency Contracting Officer, advising a labor union or workers' representative of the Contractor's commitments

under this Equal Opportunity clause, and shall post copies of the notice in a conspicuous places available to employees and applicants for employment.

4.3.4 The Contractor shall comply with all provisions of Executive Order No. 11246 of September 24, 1965, as

amended by Executive Order No. 11375 of October 13, 1967, Executive Order No. 11914 of April 28, 1976, and of the rules, regulations, and relevant order of the Secretary of Labor.

4.3.5 The Contractor will furnish all information and reports required by Executive Order No. 11246 of September 24, 1965, as amended by Executive Order No. 11375 of October 13, 1967, Executive Order No. 11914 of April 28, 1976, and of the rules, regulations, and relevant order of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records, and accounts by the contracting agency and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders.

4.3.6 In the event of the Contractor's noncompliance with the Equal Opportunity clause of this contract or with

any of such rules, regulations, or orders this contract may be canceled, terminated, or suspended in whole or in part and the Contractor may be declared ineligible for further Government contracts in accordance with procedures authorized in Executive Order No. 11246 of September 24, 1965, as amended by Executive

Order No. 11375 of October 13, 1967, Executive Order No. 11914 of April 28, 1976, and such other sanctions may be imposed and remedies invoked as provided in Executive Order No. 11246 of September 24,

1965, as amended by Executive Order No. 11375 of October 13, 1967, Executive Order No. 11914 of April 28, 1976, or by rule, regulation or order of the Secretary of Labor, or as otherwise provided by law.

4.3.7 The Contractor will include the provisions of Paragraph (1) through (7) in every subcontract or purchase

order unless exempt by rules, regulations, or orders of the Secretary of Labor, issued pursuant to Section

204 of the Executive Order No. 11246 of September 24, 1965, as amended by Executive Order No. 11375 of

October 13, 1967, Executive Order No. 11914 of April 28, 1976, so such provisions will be binding upon each subcontractor or vendor. The Contractor will take each action with respect to any subcontractor or purchase order as the contracting agency may direct as a means of enforcing such provisions including sanctions for noncompliance; PROVIDED, however, that in the event the Contractor becomes involved in, or is threatened with litigations with a subcontractor or vendor as a result of such direction by the contracting agency, the Contractor may request the United States to enter into such litigation to protect the interests of the United States.

In addition to the above, the Contractor will be required to comply with all requirements of Title VII of the Civil Rights Act of 1964 (42 U.S.C. 2000-2000d-4), 24 CFR Part 1; Fair Housing Act (42 U.S.C. 3601-36), 24

CFR Part 100; Executive Orders 11063 (Equal Opportunity in Housing), 11246 (Equal Opportunity), and

12138 (Women's Business Enterprise); Section 3 of the HUD Act of 1968, as amended, (123 U.S.C. 1701u),

24 CFR Part 135, Age Discrimination Act of 1975 (42 U.S.C. 6101 et seq.), 24 CFR Part 146; Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), 24 CFR Part 8.

The provisions of the Act of General Assembly of the State of Illinois entitled "An Act to Prohibit Discrimination and Intimidation on Account of Race or Color in the Employment under Contracts for Public Buildings or Public Works", approved July 8, 1977, as well as the Equal Employment Opportunity clause required by the Illinois Fair Employment Practices Commission, are hereby made a part of the contract the same as if incorporated verbatim herein.

4.3.8 Utilization of Minority Business

a. It is the policy of this Authority that minority businesses shall have the maximum practicable opportunity to participate in the performance of contracts of the Authority. This Authority has established a goal of at least 25% of its approved Comprehensive Grant funds be awarded to contracts

with MBE construction contractors, architect/engineers, consultants, or material suppliers. b. The Contractor agrees to use its best efforts to carry out this policy in the award of its subcontracts to

the fullest extent consistent with the efficient performance of this contract. As used in this con- tract, minority individual controls the term “minority business” means a business with at least 51% minority ownership, control or distribution of profit and losses and whose management and daily business operations. For the purposes of this definition, minority group members are African- Americans (Blacks), Hasidic Jews, Spanish-speaking Americans, American Indians, Aleuts, Puerto Ricans, Asian Pacific Americans, and Asian Indians.

c. Contractors may rely on written representation by a subcontractor regarding its status as a minority

business in lieu of an independent investigation.

4.3.9 Employment and Training Opportunities for Residents of Public Housing

a. It is the policy of the Authority to provide to the greatest extent feasible, opportunities for training

and employment are given by construction Contractors and subcontractors to tenants of public housing owned by the Authority and Section 8 tenants.

b. The Contractor agrees to use its best efforts to carry out this policy in accordance with the

Authority's Affirmative Action Plan and in the awarding of its subcontracts to the fullest extent consistent with the efficient performance of this contract.

4.3.10 Affirmative Action Program

The Contractor shall submit for the review and approval of the ESLHA an Affirmative Action Program that is incompliance with the requirements listed above prior to the issuance of Notice to Proceed. This program shall include the specific steps to be taken to guarantee equal employment opportunity keyed to the problems

and needs of minority groups and the proposed manner of implementation.

5.0 SCOPE OF WORK

5.1 SCOPE OF WORK (SOW)/PROJECT DESCRIPTION

The East St. Louis Housing Authority, hereafter referred to as ESLHA, hereby seeks competitive sealed Bids from certified licensed electrical contractors to provide all labor, equipment, materials, tools, expertise and supervision necessary for the Underground Wiring Replacement Project. Except herein specified, to maintain adequate and safe conditions in strict compliance with all local, state and national codes for the following location (See Volume 2 – For Complete Scope of Work):

The work is to be funded by the U.S. Department of Housing and Urban Development (HUD), and the contract administered by the Housing Authority of the City of East St. Louis (ESLHA). HUD reserves the right to approve the contractor selected by the Authority.

It is the intent of the ESLHA to award to one (1) general contractor to perform these services, however the owner reserves the right to award to more than one contractor for accomplishing work.

Contractor

Applicable Codes/Statutes/Regulations: All work provided by the contractor pursuant to the ensuing

contract shall be completed pursuant to all applicable L o c a l C o de, State Statue, and Federal regulation, and the work plan submitted shall reflect such.

Employee Identification: At all times on ESLHA property to perform work all employees, agents and

representatives of the c o n t r a c t o r shall wear distinctive identifications (i.e. uniforms; ID

badge; etc.) to clearly identify that person as a representative of the contractor.

Local Code Change: The contractor shall be responsible for ensuring that all equipment that is installed

is in conformance with all applicable local, State and Federal regulations, codes and/or laws. If, during

the term of the ensuing contract, such regulations, codes and/or laws change necessitating a change or

addition to the currently installed ESLHA equipment, it shall be the responsibility of the contractor to

inform ESLHA of such in writing, and ESLHA shall be financially responsible to pay the Contractor for such

changes, if ordered by the ESLHA. All work shall be performed by the contractor in conformance will all

applicable local, state and federal regulations.

Contractor will be responsible for removing and disposing of all materials at an approved off-site landfill.

C ontractor shall maintain a clean worksite continuously throughout the duration of the project.

C ontractor shall be responsible for properly disposing, at no additional cost, any trash, debris

& construction material generated by work performed.

Contractor shall perform site visit, field verify, verify all field conditions, all dimensions and quantities

provided herein for and bring to ESLHA attention any recommendations for accuracy prior to bidding.

Failure to do so will not constitute grounds for change order to contract once awarded. Contractor

shall be responsible for all measurements to ensure proper fit. Any discrepancies shall be brought to the

attention of the ESLHA Project Manager.

The Contractor shall schedule his work to minimize disruption to residents. Normal work hours are

Monday-Friday, 8:00 a.m. to 4:30 p.m., excluding designated holidays. Prior approval must be granted

to work outside of normal work hours. The Contractor is responsible for on-site security of equipment and materials during performance of work

and during off-hours for any equipment and materials left onsite. Worksite security and control is the responsibility of the contractor and as such the contractor shall be responsible for measures that ensure the safety of residents, employees and the general public.

Traffic Plan/Public Safety: The contractor shall be responsible for setting controls in maintaining public

convenience and safety, both inside and outside of the related areas of the premises, during the

performance of the work. When necessary, the contractor shall provide portable barriers, clearly

distinguishable, and placed at least 20 feet in front of the work area. All barriers must be prominently

marked to warn pedestrians and placed in such a manner to ensure safe passage around the work area.

The Contractor will be responsible for the care and handling of materials and equipment on the work

site.

The Contractor shall be responsible for any damage to his work or equipment from the date of

agreement to the date of acceptance of his work and shall make good any damage or loss during that

period without additional cost to the Authority.

Staffing – Capacity of Bidder to provide adequate staffing and experience for performing activities related to the Scope of Work.

Contractor shall be responsible for the preservation and protection of all work and property form damage. In the event damage does occur, all damage shall be completely repaired or replaced to the satisfaction of ESLHA. All costs of such work shall be paid by the Contractor as liquidated damages.

ESLHA is a non-smoking environment employer. Contractor shall not permit smoking by any

employee’s or sub-contractors on ESLHA property.

Contractor shall comply with all EPA and OSHA Regulations and any Federal, State, and Local

Regulations that may apply.

5.2 TECHNICAL SPECIFICATIONS (T/S): (SEE VOLUME 2 OF BID DOCUMENT)

5.2.1 All OSHA rules are to be followed on this project

5.2.2 All material and equipment shall be installed according to the manufacturer specifications 5.2.3 Or an “Approved Equal” Product

The ESLHA will allow any substantially equivalent "or Approved Equal" product to be use in place of

the products specified.

When brand names products are used, it is intended to inform the vendors that such references

establish only design or quality standard; in fact, any products that clearly and demonstrably meet

the standard

are also acceptable. Hence, in addition to the products listed the ESLHA will allow and "or approved

equal" product to be used.

The vendor requesting to substitute a substantially equivalent or approved equal brand must

demonstrate equivalency to the products specified. The review and approval shall be provided in

the manner determined by the ESLHA. The decision of the ESLHA for such purpose, shall be final

with respect to such products.

5.2.4 Provide Sample Warranty and Warranty on manufacturer’s letterhead for a period of not less than 1 year, (materials and workmanship) after date of substantial completion unless manufacturer

warranty states otherwise.

5.2.5 At the close of the project, Contractor shall remove all construction debris and material

and restore any damaged property to its original condition.

5.3 Contract Modifications If at any time ESLHA desires to expand, alter, or terminate a portion of the scope of work, as defined herein, the contract will be amended to reflect the changes at costs/deductions acceptable to both parties. ESLHA shall provide written notice to the contractor for any changes to the scope of work. Any modifications or changes to this contract must be received in writing for ESLHA approval. ESLHA will not be responsible for any change(s) not authorized in advance. No verbal changes are allowed and will not be accepted. 5.4 Site Visit

Additional site visits can be arranged by appointment for prospective vendors to see worksite in person. In the event the Offeror is awarded a Contract, no plea of ignorance of conditions that exist, or may hereafter exist, or of

difficulties that may be encountered in the execution of the task under the Contract will be accepted as an excuse for any failure or omission on the part of the Contractor to fulfill in every detail all of the requirements of the Contract, nor accepted as a basis for any claims for extra compensation.

6.0 INSPECTION OF WORK

Contractor will coordinate with ESLHA HA Inspector for inspecting any damaged items. All work is subject to inspection by the HA Inspector or other designated party at all times, but such inspection shall not relieve the Contractor from any obligation to perform said work in accordance with the specifications or any other modification thereof, as hereby provided. Work not done strictly in accordance with the specifications shall be corrected and made good by the Contractor whenever so ordered by the Authority without reference to any previous oversight or error in inspection and at no additional cost to the Authority

7.0 CONTRACT SUBMITTALS

8.0 GENERAL

8.1 Buy Local

The Housing Authority of the City of East St. Louis encourages contractors and their sub-contractors to make efforts to purchase materials and services within the local area.

The total price should include all the items listed above. The Permit is a mandatory requirement by the City of East St. Louis and it should be included in bid submitted. The bid is non-compliant if a price is not included for all items.

The Bidders agrees to provide all material, equipment, transportation and incidentals in accordance with the conditions of the Bid and specifications.

ALL DEVIATIONS FROM THE SPECIFICATIONS ARE TO BE NOTED IN THE BID RESPONSE.

If no equals or substitutes are submitted, the Bidder assures ESLHA of full compliance with the specifications and conditions contained herein.

8.2 COOPERATIVE/JOINDER/PIGGYBACK CONTRACT

Joinder Contract Pricing: ESLHA will entertain and is eligible for joinder contract pricing awarded to

vendor, i.e, State and Local Government, National Joint Powers Alliance(NJPA), etc. Vendor must specify in

their bid Joinder contract’s pricing information.

Offered Incentives: Vendor should specify any other incentives being offered as part of response for

ESLHA's consideration

PRE-CONSTRUCTION CONFERENCE

Contractor shall be present and accompanied by his project coordinator, job superintendent andall major subcontractors including testing agencies.

PROGRESS MEETINGS

Contractor, subcontractors, material men and vendors whose presence is necessary orrequested must attend meetings when called by the Owner or his representatives for purpose ofdiscussing execution of work.

Meetings will be held at a time and place designated by the Owner or his representative.

Decisions, instructions and interpretations given by the Owner or his representative at thesemeetings, shall be binding and conclusive on the Contractor.

Proceedings of these meetings will be recorded and Contractor will be furnished one copy for hisuse. Contractor shall distribute copies to the various subcontractors, material men and vendorsinvolved.

CONSTRUCTION SCHEDULES

PROGRESS REPORTS

Keep progress reports on a daily basis to cover each facet of work. Keep these reports on file atfield office and make available for the PHA or his representative's review upon request.

SCHEDULE OF VALUES

Submit schedule of values as required by General Conditions.

PROJECT RECORD DOCUMENTS

Submit project record documents as required by Project Closeout Section.

OTHER SUBMITTALS

Submit all other information required by Contract Documents.

SUBMITTAL PROCEDURES

A. Coordination: Coordinate preparation and processing of submittals with performance ofconstruction activities. Transmit each submittal sufficiently in advance of performance ofrelated construction activities to avoid delay.

1. Submit shop drawings and samples for all items called for in the specifications.

a. Submit electronic (email) copy of shop drawing to Architect.b. Submit (3) hard copies of each color sample, unless otherwise specified.c. Electronic (email) copy of the shop drawing and brochure bearing “final

action” stamp of the Architect will be returned to the Contractor.d. One printed hardcopy of each drawing and one sample bearing "final

action" stamp of the Architect shall be kept at project office and shall bemaintained in good condition.

e. No shop drawing or sample shall be submitted directly to the Architectfrom a manufacturer, jobber or subcontractor.

2. Coordinate each submittal with fabrication, purchasing, testing, delivery, othersubmittals, and related activities that require sequential activity.

3. Coordinate transmittal of different types of submittals for related elements of theWork so processing will not be delayed by the need to review submittalsconcurrently for coordination.

a. The Architect reserves the right to withhold action on a submittal requiringcoordination with other submittals until all related submittals are received.

4. Processing: To avoid the need to delay installation as a result of the timerequired to process submittals, allow sufficient time for submittal review, including

a. Allow fourteen (14) working days for initial review. Allow additional time ifthe Architect must delay processing to permit coordination withsubsequent submittals. The Architect will advise the Contractor promptlywhen it is determined that a submittal being process must be delayed forcoordination.

b. Allow forty (14) working days for color selections to be made. Colorselections will only be made after ALL materials have been “reviewed”with “no exceptions”.

c. If an intermediate submittal is necessary, process the same as the initialsubmittal.

d. Allow seven (7) working days for reprocessing each submittal.e. No extension of Contract Time will be authorized because of failure to

transmit submittals to the Architect sufficiently in advance of the Work topermit processing.

f. The Contractor shall pay the Architect a review fee of $300.00 per shopdrawing sheet and a review fee of $30.00 per page (letter and legal size)for third and subsequent resubmittals of shop drawings, product data andsamples.

g. Copies of the Contract Documents SHALL NOT be used for submittals.

B. Submittal Preparation: Place a permanent label or title block on each submittal foridentification. Indicate the name of the entity that prepared each submittal on the label ortitle block.

1. Provide a space approximately 4 by 5 inches on the label or beside the title blockon Shop Drawings to record the Contractor’s review and approval markings andthe action taken.

2. Include the following information on the label for processing and recording actiontaken.

a. Project name.b. Data.c. Name and address of the Consultant.d. Name and address of the Contractor.e. Name and address of the subcontractor.f. Name and address of the supplier.g. Name of the manufacturer.h. Number and title of appropriate Specification Section.i. Drawing number and detail references, as appropriate.

3. Provide a space on the label for the Contractor review and approval markings,and a space for the Architect’s “Action” marking.

C. Submittal Transmittal: Package each submittal appropriately for transmittal andhandling. Transmit each submittal from the Contractor to the Consultant using atransmittal form. The Consultant will not accept submittals received from sources otherthan the Contractor and will be returned to sender “without action”.

1. On the transmittal, record relevant information and requests for data. On theform, or separate sheet, record deviations from Contract Document requirements,including variations and limitations. Include Contractor’s certification thatinformation complies with Contract Document requirements.

D. In checking shop drawings and samples, the Architect shall not be required to checkdimensions, quantities, electrical characteristics, specific capacities or coordination withother trades, these being Contractor's responsibility.

1. Contractor shall attest, either in writing or by stamp or signature that all shopdrawings and samples submitted for approval have been checked for compliancewith Contract Documents prior to submission to the Architect; otherwise, they willbe returned REJECTED.

2. If sample warranties of items requiring warranties are not included in submittalsthey will be returned REJECTED.

3. Incomplete submittals will be returned REJECTED.

E. Stamp on returned shop drawing and samples shall be interpreted as follows:

No Exceptions Taken: No corrections, proceed with work.

Revise and Resubmit: Items unacceptable as submitted, make corrections andresubmit.

Note Markings: Items marked up shall not be fabricated or furnished withoutincorporation of marks and notes.

Rejected: Item is rejected as not in accordance with contract requirements, or for otherjustified cause. Submission shall be revised and resubmitted. No item shall befabricated or furnished under this stamp.

CONTRACTOR’S CONSTRUCTION SCHEDULE

A. Bar-Chart Schedule: Prepare a fully developed, horizontal bar-chart-type, contractor’sconstruction schedule. Submit within 15 days after the date established for“Commencement of the Work”.

1. Provide a separate time bar for each significant abatement, demolition orconstruction activity. Provide a continuous vertical line to identify the first workingday of each week. Use the same breakdown of units of the Work as indicated inthe “Schedule of Values”.

2. Within each time bar, indicate estimated completion percentage in 10 percentincrements. As Work progresses, place a contrasting mark in each bar toindicate Actual Completion.

3. Prepare the schedule on a sheet, or series of sheets, of stable transparency, orother reproducible media, of sufficient width to show data for the entireconstruction period.

4. Secure time commitments for performing critical elements of the Work fromparties involved. Coordinate each element on the schedule with otherconstruction activities; include minor elements involved in the sequence of theWork. Show each activity in proper sequence. Indicate graphically thesequences necessary for completion of related portions of the Work.

5. Coordinate the Contractor’s Construction Schedule with the Schedule of Values,list of subcontracts, Submittal Schedule, progress reports, payment requests, andother schedules.

6. Indicate completion in advance of the date established for SubstantialCompletion. Indicate Substantial Completion on the schedule to allow time forthe Consultant’s procedures necessary for certification of Substantial Completion.

B. Work Stages: Indicate important stages of construction for each major portion of theWork, including submittal review, testing, and installation.

C. Area Separations: Provide a separate time bar to identify each major construction areainvolved in the work. Indicate where each element in an area must be sequenced orintegrated with other activities.

D. Cost Correlation: At the head of the schedule, provide a cost correlation line, indicatingplanned and actual costs. On the line, show dollar volume of work performed as of thedates used for preparation of payment requests.

E. Distribution: Following response to the initial submittal, print and distribute copies to theConsultant, PHA, subcontractors, and other parties required to comply with scheduleddates. Post copies in the Project meeting room and temporary field office.

1. When revisions are made, distribute to the same parties and post in the samelocation. Delete parties from distribution when they have completed theirassigned portion of the Work and are no longer involved in construction activities.

F. Schedule Updating: Revise the schedule after each meeting, event, or activity whererevisions have been recognized or made. Issue the updated schedule concurrently withthe report of each meeting.

SUBMITTAL SCHEDULE

A. After development and acceptance of the Contractor’s Construction Schedule, prepare acomplete schedule of submittals. Submit the schedule within 10 days of the daterequired for submittal of the Contractor’s Construction Schedule.

1. Coordinate Submittal Schedule with the list of subcontracts, Schedule of Values,and the list of products as well as the Contractor’s Construction Schedule.

2. Prepare the schedule in chronological order. Provide the following information:

a. Scheduled date for the first submittal.b. Related Section number.c. Submittal category (Shop Drawings, Product Data, or Samples).d. Name of the subcontractor.

SECTION 015000 - TEMPORARY FACILITIES AND CONTROLS

PART 1 - GENERAL

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General andSupplementary Conditions and other Division 01 Specification Sections, apply to thisSection.

1.2 SUMMARY

A. Section includes requirements for temporary utilities, support facilities, and security andprotection facilities.

1.3 USE CHARGES

A. General: Installation and removal of and use charges for temporary facilities shall beincluded in the Contract Sum unless otherwise indicated. Allow other entities to usetemporary services and facilities without cost, including, but not limited to, Owner'sconstruction forces, Architect, testing agencies, and authorities having jurisdiction.

B. Sewer Service: Pay sewer-service use charges for sewer usage by all entities forconstruction operations.

C. Water Service: Pay water-service use charges for water used by all entities forconstruction operations.

D. Electric Power Service: Pay electric-power-service use charges for electricity used byall entities for construction operations.

1.4 QUALITY ASSURANCE

A. Electric Service: Comply with NECA, NEMA, and UL standards and regulations fortemporary electric service. Install service to comply with NFPA 70.

B. Tests and Inspections: Arrange for authorities having jurisdiction to test and inspecteach temporary utility before use. Obtain required certifications and permits.

1.5 PROJECT CONDITIONS

A. Temporary Use of Permanent Facilities: Engage Installer of each permanent service toassume responsibility for operation, maintenance, and protection of each permanentservice during its use as a construction facility before Owner's acceptance, regardlessof previously assigned responsibilities.

2.2 EQUIPMENT

A. Fire Extinguishers: Portable, UL rated; with class and extinguishing agent as requiredby locations and classes of fire exposures.

PART 3 - EXECUTION

3.1 INSTALLATION, GENERAL

A. Locate facilities where they will serve Project adequately and result in minimuminterference with performance of the Work. Relocate and modify facilities as requiredby progress of the Work.

B. Provide each facility ready for use when needed to avoid delay. Do not remove untilfacilities are no longer needed or are replaced by authorized use of completedpermanent facilities.

3.2 TEMPORARY UTILITY INSTALLATION

A. General: Install temporary service or connect to existing service.

1. Arrange with utility company, Owner, and existing users for time when servicecan be interrupted, if necessary, to make connections for temporary services.

B. Sewers and Drainage: Provide temporary utilities to remove effluent lawfully.

1. Connect temporary sewers as directed by authorities having jurisdiction.

C. Sanitary Facilities: Provide temporary toilets, wash facilities, and drinking water for useof construction personnel. Comply with requirements of authorities having jurisdictionfor type, number, location, operation, and maintenance of fixtures and facilities.

1. Toilets: Use of Owner's existing toilet facilities WILL NOT be permitted.

D. Lighting: Provide temporary lighting with local switching that provides adequateillumination for construction operations, observations, inspections, and trafficconditions.

3.3 SUPPORT FACILITIES INSTALLATION

A. Traffic Controls: Comply with requirements of authorities having jurisdiction.

1. Protect existing site improvements to remain including curbs, pavement, andutilities.

2. Maintain access for fire-fighting equipment and access to fire hydrants.

B. Parking: Use designated areas of Owner's existing parking areas for constructionpersonnel.

C. Dewatering Facilities and Drains: Comply with requirements of authorities havingjurisdiction. Maintain Project site, excavations, and construction free of water.

1. Dispose of rainwater in a lawful manner that will not result in flooding Project oradjoining properties or endanger permanent Work or temporary facilities.

3.4 SECURITY AND PROTECTION FACILITIES INSTALLATION

A. Protection of Existing Facilities: Protect existing vegetation, equipment, structures,utilities, and other improvements at Project site and on adjacent properties, exceptthose indicated to be removed or altered. Repair damage to existing facilities.

B. Environmental Protection: Provide protection, operate temporary facilities, and conductconstruction as required to comply with environmental regulations and that minimizepossible air, waterway, and subsoil contamination or pollution or other undesirableeffects.

C. Temporary Erosion and Sedimentation Control: Provide measures to prevent soilerosion and discharge of soil-bearing water runoff and airborne dust to undisturbedareas and to adjacent properties and walkways, according to erosion- andsedimentation-control Drawings.

1. Verify that flows of water redirected from construction areas or generated byconstruction activity do not enter or cross tree- or plant- protection zones.

E. Tree and Plant Protection: Install temporary fencing located outside the drip line oftrees to protect vegetation from damage from construction operations. Protect tree rootsystems from damage, flooding, and erosion.

3.5 OPERATION, TERMINATION, AND REMOVAL

A. Supervision: Enforce strict discipline in use of temporary facilities. To minimize wasteand abuse, limit availability of temporary facilities too essential and intended uses.

B. Maintenance: Maintain facilities in good operating condition until removal.

C. Termination and Removal: Remove each temporary facility when need for its servicehas ended, or when it has been replaced by authorized use of a permanent facility.Complete or, if necessary, restore permanent construction that may have been delayedbecause of interference with temporary facility. Repair damaged Work, clean exposedsurfaces, and replace construction that cannot be satisfactorily repaired.

CLEANING UP

Keep building free of combustible materials.

Do not dump debris, waste and excess earth on other property without prior permission ofproperty owner.

Burning of waste materials on site will not be permitted.

Upon completion of work, remove temporary buildings and structures, fences, scaffolding,surplus materials, equipment and rubbish of every kind from site of work.

DOCUMENTS REQUIRED PRIOR TO FINAL PAYMENT

Prior to final payment and before issuance of a final certificate of payment in accordance withprovisions of General Conditions, file the following papers with the Owner.

Warranties:

Three (3) copies of warranty required by General Conditions and other extendedwarranties stated in technical specification sections shall be bound and submitted in a 3-ring binder.

Release of Waiver of Liens:

As required by General Conditions.

Project Record Documents:

As work progresses, keep a complete and accurate record of all changes or deviationsfrom Contract Documents including all addenda items. Changes shall be neatly andcorrectly indicated on respective portion of affected document, using blackline or bluelineprints of Drawings affected or Project Manual with appropriate supplementary notes.This record set Drawings and Project Manual shall be kept at job site for inspection byArchitect, Owner or their representatives.

The record drawings shall not be used as a construction set.

All Addenda, Architect’s Supplemental Instructions, Field Orders and Change Ordersissued for this project shall be included in the Record Drawings.

3.1 PLAN IMPLEMENTATION

A. General: Implement approved waste management plan. Provide handling, containers,storage, signage, transportation, and other items as required to implement wastemanagement plan during the entire duration of the Contract.

B. Training: Train workers, subcontractors, and suppliers on proper waste managementprocedures, as appropriate for the Work occurring at Project site.

1. Distribute waste management plan to everyone concerned within three days ofsubmittal return.

2. Review plan procedures and locations established for recycling, and disposal.

C. Site Access and Temporary Controls: Conduct waste management operations toensure minimum interference with roads, streets, walks, walkways, and other adjacentoccupied and used facilities.

1. Designate and label specific areas on Project site necessary for separatingmaterials that are to be salvaged, recycled, reused, donated, and sold.

3.2 RECYCLING WASTE, GENERAL

A. Recycling Incentives: Revenues, savings, rebates, tax credits, and other incentivesreceived for recycling waste materials shall accrue to Contractor.

B. Preparation of Waste: Prepare and maintain recyclable waste materials according torecycling or reuse facility requirements. Maintain materials free of dirt, adhesives,solvents, petroleum contamination, and other substances deleterious to the recyclingprocess.

C. Procedures: Separate recyclable waste from other waste materials, trash, and debris.Separate recyclable waste by type at Project site to the maximum extent practicalaccording to approved construction waste management plan.

1. Provide appropriately marked containers or bins for controlling recyclable wasteuntil they are removed from Project site. Include list of acceptable andunacceptable materials at each container and bin.

a. Inspect containers and bins for contamination and remove contaminatedmaterials if found.

2. Stockpile processed materials on-site without intermixing with other materials.Place, grade, and shape stockpiles to drain surface water. Cover to preventwindblown dust.

PART 1 - GENERAL

1.1 SUMMARY

A. Section Includes:

This Section includes all work; labor, machinery, disposal and replacement ofunsuitable soil, removal of rock and any materials encountered to plan bottomdepth/ subgrade for all earthwork related items. These items shall include, but arenot limited to, earthwork procedures for walks, utility trenches, etc.

All excavation, fill work shall be considered as unclassified with regard to type andcondition with costs reflecting all expenses necessary to achieve plan bottom depth/subgrade and all grading effort as shown on the drawings.

No change in the contract price will be considered for any materials encounteredand/or required to be removed, or replaced to achieve plan bottom depth/ subgradethe earthwork requirements.

1.2 DEFINITIONS

A. Backfill: Soil material or controlled low-strength material used to fill an excavation.

B. Base Course: Aggregate layer placed between the subbase course and concretewalks.

C. Bedding Course: Aggregate layer placed over the excavated subgrade in a trenchbefore laying pipe.

D. Borrow Soil: Satisfactory soil imported from off-site for use as fill or backfill.

E. Excavation: Removal of material encountered above subgrade elevations and to linesand dimensions indicated.

1. Authorized Additional Excavation: Excavation below subgrade elevations orbeyond indicated lines and dimensions as directed by Architect. Authorizedadditional excavation and replacement material will be paid for according toContract provisions for unit prices changes in the Work.

2. Unauthorized Excavation: Excavation below subgrade elevations or beyondindicated lines and dimensions without direction by Architect. Unauthorizedexcavation, as well as remedial work directed by Architect, shall be withoutadditional compensation.

G. Base Course: Aggregate layer placed between the subgrade and base course forcement concrete pavement.

H. Subgrade: Uppermost surface of an excavation or the top surface of a fill or backfillimmediately below subbase, structures, drainage fill, drainage course, or topsoilmaterials.

I. Topsoil: ASTM D 5268, pH range of 5.5 to 7, 4 percent organic material minimum, freeof stones 1 inch (25 mm) or larger in any dimension, and other extraneous materialsharmful to plant growth.

1. Topsoil Source: Reuse surface soil stockpiled on the site and /or amend existing sur-face soil to produce topsoil. Supplement with imported topsoil when quantities are in-sufficient to achieve the grading effort as shown on the drawings. Clean topsoil ofroots, plants, sods, stones, clay lumps, and other extraneous materials harmful to plantgrowth.

J. Utilities: On-site underground pipes, conduits, ducts, and cables, as well asunderground services within buildings.

1.3 PROJECT CONDITIONS

A. Traffic: Minimize interference with adjoining roads, streets, walks, and other adjacentoccupied or used facilities during earth moving operations.

1. Do not close or obstruct streets, walks, or other adjacent occupied or usedfacilities without permission from Owner and authorities having jurisdiction.

2. Provide alternate routes around closed or obstructed traffic ways if required byOwner or authorities having jurisdiction.

B. Existing Utilities: Do not interrupt utilities serving facilities occupied by Owner or othersunless permitted in writing by Architect and then only after arranging to providetemporary utility services according to requirements indicated:

1. Notify Architect not less than two days in advance of proposed utilityinterruptions.

2. Do not proceed with utility interruptions without Architect's written permission.3. Should uncharted, or incorrectly charted, piping or other utilities be encountered

during excavation, consult the utility owner immediately for directions. Cooperatewith Owner and utility companies in keeping respective services and facilities inoperation. Repair damaged utilities to the utility owner’s satisfaction at no cost tothe Owner.

2.1 SOIL MATERIALS

A. General: Provide borrow soil materials when sufficient satisfactory soil materials arenot available from excavations.

B. Satisfactory Soils: Soil Classification Groups GW, GP, GM, SW, SP, and SMaccording to ASTM D 2487 or a combination of these groups; free of rock or gravellarger than 3 inches (75 mm) in any dimension, debris, waste, frozen materials,vegetation, and other deleterious matter.

C. Unsatisfactory Soils: Soil Classification Groups GC, SC, CL, ML, OL, CH, MH, OH,and PT according to ASTM D 2487, or a combination of these groups.

1. Unsatisfactory soils also include satisfactory soils not maintained within 2 percentof optimum moisture content at time of compaction or as noted in theGeotechnical report..

2. CH with a dry density below 100, a Liquid Limit greater than 50 and aPlastic Index greater than 30 will be considered for use only byrecommendation by the Geotechnical Engineer. Additional requirementsfor use of these types of soil may be required

D. Subbase Material: Naturally or artificially graded mixture of natural or crushed gravel;ASTM D 2940; with at least 90 percent passing a 1-1/2-inch (37.5-mm) sieve and notmore than 12 percent passing a No. 200 (0.075-mm) sieve.

E. Bedding Course: Naturally or artificially graded mixture of natural or crushed gravel;ASTM D 2940; except with 100 percent passing a 1-inch (25-mm) sieve and not morethan 8 percent passing a No. 200 (0.075-mm) sieve.

PART 3 - EXECUTION

3.1 PREPARATION

A. Protect structures, utilities, sidewalks, pavements, and other facilities from damagecaused by settlement, lateral movement, undermining, washout, and other hazardscreated by earth moving operations.

B. Protect and maintain erosion and sedimentation controls during earth movingoperations.

C. Provide erosion-control measures to prevent erosion or displacement of soils anddischarge of soil-bearing water runoff or airborne dust to adjacent properties andwalkways.

3.2 DEWATERING

A. Prevent surface water and ground water from entering excavations, from ponding onprepared subgrades, and from flooding Project site and surrounding area.

B. Protect subgrades from softening, undermining, washout, and damage by rain or wateraccumulation.

1. Reroute surface water runoff away from excavated areas. Do not allow water toaccumulate in excavations. Do not use excavated trenches as temporarydrainage ditches.

2. Install a dewatering system to keep subgrades dry and convey ground wateraway from excavations. Maintain until dewatering is no longer required.

3.3 EXCAVATION, GENERAL

A. Unclassified Excavation: Excavate to subgrade elevations regardless of the characterof surface and subsurface conditions encountered. Unclassified excavated materialsmay include rock, soil materials, and obstructions. No changes in the Contract Sum orthe Contract Time will be authorized for rock excavation or removal of obstructions.

1. If excavated materials intended for fill and backfill include unsatisfactory soilmaterials and rock, replace with satisfactory soil materials, or lean concrete, asallowed by the Architect.

3.4 EXCAVATION FOR UTILITY TRENCHES

A. Excavate trenches to indicated gradients, lines, depths, and elevations.

B. Trench Bottoms: Excavate trenches deeper than bottom of conduit elevations to allowfor bedding course.

C. Stockpiling excavated material is NOT allowed.

1. Backfill trenches as work progresses.

D. Place backfill on subgrades free of mud.

E. Place and compact bedding course on trench bottoms and where indicated. Shapebedding course to provide continuous support for joints, fittings, and bodies of conduits.

F. Coordinate backfilling with utilities testing.

G. Place and compact final backfill of satisfactory soil to final subgrade elevation.

3.5 COMPACTION OF SOIL BACKFILLS AND FILLS

A. Place backfill and fill soil materials in layers not more than 8 inches (200 mm) in loosedepth for material compacted by heavy compaction equipment, and not more than 4inches (100 mm) in loose depth for material compacted by hand-operated tampers.

B. Place backfill and fill soil materials evenly on all sides of structures to requiredelevations, and uniformly along the full length of each structure.

C. Compact soil materials to not less than the following percentages of maximum dry unitweight according to ASTM D 698.

1. Under walkways, scarify and recompact top 6 inches below subgrade andcompact each layer of backfill or fill soil material at 95 percent. The moisturecontent shall be maintained between minus 3, plus 1 percent of theoptimal moisture

2. Under turf or unpaved areas, scarify and recompact top 6 inches below subgradeand compact each layer of backfill or fill soil material at 85 percent.

3.6 PROTECTION

A. Protecting Graded Areas: Protect newly graded areas from traffic, and erosion. Keepfree of trash and debris.

B. Repair and reestablish grades to specified tolerances where completed or partiallycompleted surfaces become eroded, rutted, settled, or where they lose compaction dueto subsequent construction operations or weather conditions.

1. Scarify or remove and replace soil material to depth as directed by Architect;reshape and recompact.

C. Where settling occurs before Project correction period elapses, remove finishedsurfacing, backfill with additional soil material, compact, and reconstruct surfacing.

1. Restore appearance, quality, and condition of finished surfacing to matchadjacent work, and eliminate evidence of restoration to greatest extent possible.

3.7 DISPOSAL OF SURPLUS AND WASTE MATERIALS

A. Remove surplus satisfactory soil and waste materials, including unsatisfactory soil,trash, and debris, and legally dispose of them off Owner's property.

PART 3 - EXECUTION

3.1 PREPARATION

A. Check for unstable areas and verify need for additional compaction. Proceed withpavement only after nonconforming conditions have been corrected andsubgrade/base is ready to receive pavement.

B. Remove loose material from compacted subbase surface immediately before placingconcrete.

3.2 EDGE FORMS AND SCREED CONSTRUCTION

A. Set, brace, and secure edge forms, bulkheads, and intermediate screed guides forpavement to required lines, grades, and elevations. Install forms to allow continuousprogress of work and so forms can remain in place at least 24 hours after concreteplacement.

B. Clean forms after each use and coat with form release agent to ensure separationfrom concrete without damage.

3.3 STEEL REINFORCEMENT

A. General: Comply with CRSI's "Manual of Standard Practice" for fabricatingreinforcement and with recommendations in CRSI's "Placing Reinforcing Bars" forplacing and supporting reinforcement.

B. Clean reinforcement of loose rust and mill scale, earth, or other bond-reducingmaterials.

D. Install welded wire fabric in lengths as long as practicable. Lap adjoining pieces atleast one full mesh, and lace splices with wire. Offset laps of adjoining widths toprevent continuous laps in either direction.

3.4 CONCRETE PLACEMENT

A. Inspection: Before placing concrete, inspect and complete formwork installation,reinforcement steel, and items to be embedded or cast in.

B. Moisten subbase to provide a uniform dampened condition at the time concrete isplaced. Do not place concrete around manholes or other structures until they are atthe required finish elevation and alignment.

C. Comply with requirements and with recommendations in ACI 304R for measuring,mixing, transporting, and placing concrete.

D. Do not add water to concrete during delivery, at Project site, or during placement.

E. Deposit and spread concrete in a continuous operation between transverse joints. Donot push or drag concrete into place or use vibrators to move concrete into place.

F. Screed pavement surfaces with a straightedge and strike off. Commence initialfloating using bull floats or darbies to form an open textured and uniform surface planebefore excess moisture or bleed water appears on the surface. Do not further disturbconcrete surfaces before beginning finishing operations or spreading dry-shakesurface treatments.

3.5 CONCRETE FINISHING

A. General: Wetting of concrete surfaces during screeding, initial floating, or finishingoperations is prohibited.

B. Float Finish: Begin the second floating operation when bleed-water sheen hasdisappeared and the concrete surface has stiffened sufficiently to permit operations.Float surface with power-driven floats, or by hand floating if area is small orinaccessible to power units. Finish surfaces to true planes. Cut down high spots, andfill low spots. Refloat surface immediately to uniform granular texture.

3.6 CONCRETE PROTECTION AND CURING

A. General: Protect freshly placed concrete from premature drying and excessive cold orhot temperatures. Comply with ACI 306.1 for cold-weather protection and followrecommendations in ACI 305R for hot-weather protection during curing.

3.7 REPAIRS AND PROTECTION

A. Remove and replace concrete pavement that is broken, damaged, or defective, ordoes not meet requirements in this Section.

B. Drill test cores where directed by Architect when necessary to determine magnitude ofcracks or defective areas. Fill drilled core holes in satisfactory pavement areas withportland cement concrete bonded to pavement with epoxy adhesive.

C. Protect concrete from damage. Exclude traffic from pavement for at least 14 daysafter placement. When construction traffic is permitted, maintain pavement as cleanas possible by removing surface stains and spillage of materials as they occur.

D. Maintain concrete pavement free of stains, discoloration, dirt, and other foreignmaterial. Sweep concrete pavement not more than two days before date scheduledfor Substantial Completion inspections.

2.5 SOURCE QUALITY CONTROL FOR UNDERGROUND ENCLOSURES

A. Handhole and Pull-Box Prototype Test: Test prototypes of handholes and boxes for compliancewith SCTE 77. Strength tests shall be for specified tier ratings of products supplied.

1. Tests of materials shall be performed by an independent testing agency.2. Strength tests of complete boxes and covers shall be by either an independent testing

agency or manufacturer. A qualified registered professional engineer shall certify testsby manufacturer.

3. Testing machine pressure gages shall have current calibration certification complyingwith ISO 9000 and ISO 10012 and traceable to NIST standards.

PART 3 - EXECUTION

3.1 RACEWAY APPLICATION

A. Outdoors: Apply raceway products as specified below unless otherwise indicated:

1. Exposed Conduit: GRS.2. Concealed Conduit, 1” c min.: PVC, GRS.3. Underground Conduit: RNC, Type EPC-40-PVC or Type EPC-80-PVC.4. Boxes and Enclosures, Aboveground: NEMA 250, Type 3R

B. Minimum Raceway Size: 1 inch trade size.

C. Raceway Fittings: Compatible with raceways and suitable for use and location.

1. Galvanized Rigid Steel Conduits: Use only fittings listed for use with this type of conduit.

3.2 INSTALLATION

A. Comply with NECA 1 and NECA 101 for installation requirements except where requirementson Drawings or in this article are stricter. Comply with NECA 102 for aluminum conduits.Comply with NFPA 70 limitations for types of raceways allowed in specific occupancies andnumber of floors.

B. Complete raceway installation before starting conductor installation.

C. Install no more than the equivalent of three 90-degree bends in any conduit run.

D. Raceways Embedded in Trenches or Slabs:

1. Change from RNC, Type EPC-40-PVC or Type EPC-80-PVC to GRS before rising abovegrade.

E. Threaded Conduit Joints, Exposed to Wet, Damp, Corrosive, or Outdoor Conditions: Applylisted compound to threads of raceway and fittings before making up joints. Follow compoundmanufacturer's written instructions.

F. Coat or paint field-cut threads on GRS raceway with a corrosion-preventing compound prior toassembly.

G. Raceway Terminations at Locations Subject to Moisture or Vibration: Use insulating bushingsto protect conductors including conductors smaller than No. 4 AWG.

H. Terminate threaded conduits into threaded hubs or with locknuts on inside and outside of boxesor cabinets. Install bushings on conduits up to 1-1/4-inch trade size and insulated throat metalbushings on 1-1/2-inch trade size and larger conduits terminated with locknuts.

I. Do not rely on locknuts to penetrate nonconductive coatings on enclosures. Remove coatings inthe locknut area prior to assembling conduit to enclosure to assure a continuous ground path.

J. Cut conduit perpendicular to the length.

K. Comply with manufacturer's written instructions for solvent welding RNC and fittings.

L. Flexible Conduit Connections: Comply with NEMA RV 3.

3.3 INSTALLATION OF UNDERGROUND CONDUIT

A. Direct-Buried Conduit:

1. Excavate trench bottom to provide firm and uniform crushed stone or sand support forconduit.

2. After installing conduit, backfill and compact. Start at tie-in point, and work toward end ofconduit run, leaving conduit at end of run free to move with expansion and contraction astemperature changes during this process. Firmly hand tamp backfill around conduit toprovide maximum supporting strength. After placing controlled backfill to within 12 inchesof finished grade, make final conduit connection at end of run and complete backfillingwith normal compaction.

3. Underground Warning Tape: Comply with requirements in Section 260553 "Identificationfor Electrical Systems."

3.4 INSTALLATION OF UNDERGROUND HANDHOLES AND CAST JUNCTION BOXES

A. Install handholes and boxes level and plumb and with orientation and depth coordinated withconnecting conduits to minimize bends and deflections required for proper entrances.

B. Unless otherwise indicated, support units on a level bed of crushed stone or gravel, graded from1/2-inch sieve to No. 4 sieve and compacted to same density as adjacent undisturbed earth.

C. Elevation: In paved areas, set so cover surface will be flush with finished grade. Set covers ofother enclosures 1 inch above finished grade.

D. Install handholes with bottom below frost line, 24” below grade.

Install removable hardware, including pulling eyes, cable stanchions, cable arms, andinsulators, as required for installation and support of cables and conductors and as indicated.Select arm lengths to be long enough to provide spare space for future cables but short enoughto preserve adequate working clearances in enclosure.

F. Field-cut openings for conduits according to enclosure manufacturer's written instructions. Cutwall of enclosure with a tool designed for material to be cut. Size holes for terminating fittings tobe used, and seal around penetrations after fittings are installed.

3.5 PROTECTION

A. Repair damage to GRS coatings or paint finishes with matching touchup coating or paintrecommended by manufacturer.

SCOPE OF WORK

PART 1 - GENERAL

1.1 GENERAL INFORMATION

A. Information shown in these Contract Documents have been obtained from general fieldobservations. The information is included herein with the intent to provide the contractorwith a basic understanding of the scope of work. Actual conditions may vary from thoseshown.

B. All Contractors shall be responsible for visiting the site to verify existing conditions andgather/ determine all quantities required for bidding and demolition, and shall include allcost associated with the work whether shown in these documents or not. No additionalcost consideration will be given.

C. No work shall commence until insurance certificates, schedule of values, constructionschedule, and additional items as required by the Contract Documents have beenreceived and approved.

D. The adjacent buildings and grounds are occupied.

E. Security and protection of the Contractor's materials and equipment is the responsibilityof the Contractor.

F. Staging and storage of materials and equipment will be coordinated with the successfulbidder and Owner.

G. The contractor shall be responsible for acquiring permits from all governing agencieshaving jurisdiction. The general contractor shall be responsible for the costs of, allpermits and fees required by authorities having jurisdiction over the project. Contractorshall pay for all highway fees, and utility service fees (plumbing, electrical, gas, water,sewer fees, etc.).

H. The Contractor must be licensed with the City of East St. Louis.

I. Photo Documentation is required by successful bidder: Document the existing conditionsof adjoining construction and site improvements, including finish surfaces that might bemisconstrued as damage caused by work in this contract. Photo documentation andwritten documentation to be submitted prior to beginning Work.

J. The Owner shall not be responsible for vandalism and condition of the lighting andsalvageable material from the time bids are submitted until the award of the contract.

Job site safetyis outside the scope of work of Sherman Carter Barnhart Architects, PLLC, (SCB).Neither the professional activities or the presence of SCB employees or subconsultantsat the demolition site shall relieve the contractor or any other entity of their obligation,duties, and responsibilities including, but not limited to, demolition means, methods,sequences, techniques, to procedures necessary for performing superintending orcoordinating all portions of the work of demolition in accordance with the contractdocuments and any health and safety precautions required by good constructionpractices or any regulatory agencies. Anyone using information from these plansacknowledges and warrants that Sherman Carter Barnhart Architects, PLLC, is notresponsible for site safety in any way.

B. The contractor is solely responsible for all safety regulations, programs and precautionsrelated to all work on this project.

1.3 INFORMATIONAL SUBMITTALS

A. Existing Conditions: Documentation of existing trees and plantings, adjoiningconstruction, and site improvements that establishes preconstruction conditions thatmight be misconstrued as damage caused by site clearing.

B. Include plans and notations to indicate specific wounds and damage conditions of eachtree or other plant designated to remain.

C. Record Drawings: Identifying and accurately showing locations of utilities and othersubsurface structural, electrical, and mechanical conditions.

1.4 FIELD CONDITIONS

A. Traffic: Minimize interference with adjoining roads, streets, walks, and other adjacentoccupied or used facilities during site-clearing operations.

B. Do not close or obstruct streets, walks, or other adjacent occupied or used facilitieswithout permission from Owner and authorities having jurisdiction.

1.5 TEMPORARY EROSION AND SEDIMENTATION CONTROL

A. Provide temporary erosion- and sedimentation-control measures to prevent soil erosionand discharge of soil-bearing water runoff or airborne dust to adjacent properties andwalkways, according to requirements of authorities having jurisdiction.

B. Verify that flows of water redirected from construction areas or generated byconstruction activity do not enter or cross protection zones.

C. Inspect, maintain, and repair erosion- and sedimentation-control measures duringconstruction until permanent vegetation has been established.

D. Remove erosion and sedimentation controls, and restore and stabilize areas disturbedduring removal.

E. All storm water inlets and basins shall be maintained and protected.

1.6 EXISTING UTILITIES

A. Owner shall arrange for locating and marking all utilities prior to any site excavation.

B. Owner will contact Tri-County Locators, for location services. Contact person is DaleMerriman; phone 815-973-4568. PO Box 401, Leaf River, IL.

C. The utilities are privately owned by ESLHA, and Utility Companies will not enter the siteto locate and mark utilities.

D. Interrupting Existing Utilities: Do not interrupt utilities serving facilities occupied byOwner or others, without Owner's written permission, and then only after arranging toprovide temporary utility services.

PART 2 - PROTECTION

2.1 PROTECTION

A. Provide necessary precautions to avoid damage to existing adjacent structures and site;any damaged items shall be repaired or replaced, at no additional cost.

B. Contractor shall be responsible for protecting all existing in place construction and itemsto remain during work. Any item damaged or disturbed shall be replaced and/orrestored, at the contractor's expense, to a "like new" condition.

C. Any damage to existing curbs, sidewalks, paving, etc. shall be the responsibility of theContractor. Refer to general note above.

D. Access around the building may be inhibited by landscaping/ trees, fences, etc., fieldverify. Contractor shall include all cost required to facilitate work in their bid.

E. Temporary Protection: Erect temporary protection, such as walks, fences, railings,canopies, and covered passageways, where required by authorities having jurisdiction.

REMOVE EXISTING VANDAL RESISTANT SHIELDS FROM COMMUNITY CENTERWALL-PACK LIGHTING FIXTURES AND DISPOSE OF PROPERLY. CLEAN ANDRELAMP EXISTING WALL PACKS WITH E26 MEDIUM BASE, 100 WATT, M.H., 8,500LUMEN, MINIMUM 10,000 HOUR LONG LIFETIME LAMPS.

REMOVE, THOROUGHLY CLEAN ALL SURFACES WITH AMMONIA BASEDCLEANER AND APPLY RAIN-X TO LIGHTING FIXTURE FACING SURFACE OFEXISTING BULLET RESISTANT SHIELD FOR EACH LIGHTING FIXTURE.COORDINATE SHIELD CLEANING AND LIGHTING POLE WIRING EFFORTSBECAUSE THE SHIELD BRACKET MUST BE REMOVED TO ACCESS THE LIGHTINGFIXTURE WIRING TERMINAL BLOCK LOCATED WITHIN THE FIXTURE MAST ARM.FURNISH AND INSTALL NEW APPROXIMATELY 20" FRONT SHIELD MOUNTINGTETHER AVAILABLE FROM VANDAL SHIELDS TO BE TWO INCHES SHORTERTHAN EXISTING TETHER. RETURN EXISTING TETHERS TO OWNER.
