I. OBJECTIVE

The objective of this project is to serve as technical consultants to help evaluate energy conservation measures, verify projected energy savings and validate measurements and for an energy savings project at the NJ Dept. of Human Services, Hunterdon Developmental Center [HDC] and the NJ Dept. of Corrections, Edna Mahan Correctional Facility [EMCF], Clinton, NJ.

II. CONSULTANT QUALIFICATIONS

A. CONSULTANT & SUB-CONSULTANT PRE-QUALIFICATIONS

The Consultant shall be a firm pre-qualified with the Division of Property Management & Construction (DPMC) in the P051 Energy Auditing Professional Discipline and have in-house capabilities or Sub-Consultants pre-qualified with DPMC in P025 Estimating/Cost Analysis and all other Architectural, Engineering and Specialty Disciplines necessary to complete the project as described in this Scope of Work (SOW).

III. PROJECT BUDGET

A. CONSULTANT’S FEES The Consultant’s fees shall be based on the information contained in this Scope of Work document and the observations made and/or the additional information received during the pre-proposal meeting. Complete the THIRD PARTY MEASUREMENT AND VERIFICATION BID PROPOSAL FORM. The form is on the supplemental disk to be distributed at the Pre-Bid Conference. Services related to ECMs that are not submitted for review or are not included in the Energy Savings Plan will be deducted from the awarded fee.

IV. PROJECT SCHEDULE

A. CONSULTANT’S PROPOSED SCHEDULE Exhibit ‘D’ shows a condensed schedule for the existing Energy Savings Plan. Using this schedule as a guide, the Consultant shall submit a project schedule with their technical proposal.

The bar chart schedule developed by the Consultant shall reflect their recommended project activities and durations. A written narrative shall also be included with the technical proposal explaining the schedule submitted and the reasons why and how it can be completed in the time frame proposed by the Consultant. This schedule and narrative will be reviewed by the Consultant Selection Committee as part of the evaluation process and will be assigned a score commensurate with clarity and comprehensiveness of the submission.

VI. PROJECT DEFINITION

A. BACKGROUND Pursuant to the Energy Savings Improvement Program Law (“ESIP Law”), N.J.S.A. 52:34-25, et seq., the State of New Jersey, Division of Property Management and Construction (DPMC) will be contracting with an Energy Services Company (ESCO) under project A1226-01, to develop an Energy Savings Plan (ESP) that can be implemented through a customized Energy Savings Improvement Program (ESIP) for both the Hunterdon Developmental Center and the Edna Mahan Correctional Facility in Clinton. The ESCO will provide a proposal setting forth energy conservation measures (ECMs) for the facility through contracts in which the costs of the ECMs are paid for by the savings produced by the improvements. The State has obtained a preliminary independent energy audit from Gannet-Fleming. The audit and 24-months of historical utility billings for the facility and attendance at the mandatory pre-proposal meeting and site visit will serve as the foundation on which the Energy Auditing Consultant will base its proposal for this project, A1226-02 3rd Party Measurement and Verification Services, to be submitted in response to this Scope of Work. The term of this contract will commence with the Notice to Proceed prior to Task 1: Audit Baseline Energy Use and extend through issuance of the third anniversary annual report.

B. FUNCTIONAL DESCRIPTION OF THE FACILITY Hunterdon Developmental Center (HDC), located on 102 acres in Clinton, Hunterdon County, opened in 1969. HDC provides a broad spectrum of behavioral, medical and habilitation services to women and men with intellectual and developmental disabilities. HDC also operates a Work Activity Center (WAC). As of May 2016, HDC has a census of 495 residents. Edna Mahan Correctional Facility for Women (EMCFW) houses state-sentenced female offenders. The prison provides a campus-like setting with housing units and various support buildings. In terms of security designation, there are two compounds – minimum and maximum/medium. There is a third housing compound for inmates with varying classifications of special mental health needs.

VII. CONSULTANT RESPONSIBILITIES

A. SCOPE OF WORK The Energy Savings Improvement Program requires that Measurement and Verification be performed per the International Performance Measurement and Verification Protocol [IPMVP]. The State of New Jersey seeks a professional firm to administer the IPMVP protocol being performed by the Energy Services Company [ESCO] contracted for this project. The State also requires the services of this company to provide Third Party Technical Review of engineering proposals being put forth by the ESCO. The scope of work for this contract is as follows: Task 1 - Audit Baseline Energy Use:

• Review ESCO’s baseline energy profile for accuracy and inclusion of all relevant energy use.

• Take measurements to ensure that baseline energy use is accurate. • Provide/confirm sub-metered data logged from portable meters installed where buildings

are served through meters in other buildings. • Deliverable: Prepare report to include:

o Details to confirm adherence to sampling plan. o Provide details of any baseline adjustments recommended. o Provide recommendation to accept agreed upon baseline

Task 2 - Energy Savings Plan (ESP) Review:

• Review the ESP information supplied by the contracted ESCO to become familiar with the project requirements.

• Assist in validation of proposed Energy Conservation Measures [ECM] and selection of those measures to form comprehensive Energy Savings Plan. A preliminary list of proposed ECM’s as included in the DCO Energy Technical Proposal is shown in Exhibit ‘C’. The ESCO will be submitting its own list of ECM’s which is not limited to the scope of the ECM’s contained in the preliminary list.

• Energy savings and financial analysis: Provide a review of the energy and cost savings that can be achieved from the proposed Energy Savings Plan. Include detailed pre- and post-implementation analysis info (energy, demand and water usage/savings).

• Make recommendations to ensure that optimizations are realized by coordinating measures.

• Evaluate equipment pricing, labor, mark-up, contract and financial model review. • Evaluate if project will perform to expectation.

• Evaluate level of indoor environmental quality changes from existing to post-retrofit conditions.

• Deliverable: Issue report of analysis of Energy Savings Plan commenting on the above bullet items within 14 days from the ESP presentation.

• Deliverable: Provide certification stating ESP savings were properly calculated and all required elements of the law were covered. Review must be completed within 30 days from the ESP presentation.

Task 3 - Incentive Research and Analysis:

• Review of applicable regional utility incentives and/or rebates. • Incentive qualification assistance: Consultant contacts customer’s utility and/or third-

party incentive administrator to qualify the project for applicable incentives and/or rebates.

• Incentive/rebate documentation assistance: Consultant assists in the completion of utility/third party incentive and/or rebate documentation.

• Verify who is applying for each incentive and to whom each incentive will be paid. • Deliverable: Issue a report of analysis of ESCO’s incentive goals. Identify

additional funding opportunities that might exist, if any. Verify that net savings will be achieved after all borrowing costs are considered. The calculations must show that the costs, (including acquisition, installation and financing) of implementing the energy conservation measures will be offset by energy savings as well as grants or other related funding and will result in a break even or net savings to the agency on an annual basis. Savings must be positive in each year.

Task 4 - Design Documents Review:

• Consultant will act as the customer’s representative, providing review services to ensure that the design documents accurately reflect the intent of ESCO’s Energy Savings Plan.

• Meeting participation will be required at Schematic Design (SD), Design Development (DD) and 100% Construction Document (CD) review sessions with DPMC and ESCO’s design consultants.

• Deliverable: Issue a report of each review within 7 days of SD Presentation, 7 days of DD presentation and 14 days of CD presentation.

• Deliverable: Issue certification that Construction Documents are in compliance with approved ESP in intent and savings capability.

Task 5 - Commissioning Observation:

• Consultant shall review / comment on the Preliminary Commissioning Plan as prepared by the ESCO. Consultant shall review the final Commissioning documentation for compliance with the Energy Savings Plan.

Task 6 - Measurement and Verification Plan:

• Together with ESCO, develop a measurement and verification plan for each measure selected in the Energy Savings Plan. Completion of the M&V Matrix (to be provided) will speak to consultants approach to the project.

• Independently verify the performance and energy savings through on-site functional testing.

• Follow additional guidelines for analysis and report preparation given below . • Preliminary measurement and verification plan for each measure, following the current

version of the International Performance Measurement and Verification Protocol (IPMVP), explaining how savings from each measure is to be measured and verified.

• The M&V strategy will be reviewed following the first month of implementation to ensure that procedures and processes are effective for capturing the required data. Monthly data recordings will be reviewed promptly for anomalous values that could signal data errors or underperforming equipment.

• Conduct measurements taken per the M&V plan to verify the performance of the installed measures at completion of implementation.

• Conduct walkthrough of the installed measures at the 11-month post-completion milestone to assess any potential warranty issues.

• Conduct measurements taken per the M&V plan to verify the performance of the installed measures annually for three (3) anniversaries of substantial completion.

• Deliverable: Documentation detailing results of verification for each facility in the ESP. Identify non-compliance and magnitude between installed ECM conditions and ESP intended requirements.

• Deliverable: Issue a quarterly report (within 30 days of the end of each quarter) consisting of summaries of logged information for each ECM, log deviations from expected savings, provide recommendations for corrective actions and future savings and record any significant O&M work performed on equipment associated with ECM’s. Quarterly reports are to be issued during the period starting with substantial completion through the first anniversary.

• Deliverable: Issue annual report within 45 days of the anniversary of substantial completion that consists of summaries of logged information for each ECM, log deviations from expected savings, provide recommendations for corrective actions and future savings and record any significant O&M work performed on equipment associated with ECM’s. The annual report will be used to substantiate or dispute the annual projected energy savings and will be used to enforce any guaranty of energy savings.

• Review ESCO’s preliminary Operations and Maintenance Plan. • Review and monitor ESCO’s training plan implementation. • Deliverable: Provide comments/recommendations on the Operations and Maintenance

Plans. • Deliverable: Provide comments/recommendations on the training plan and

implementation.

B. PROJECT COMMENCEMENT A pre-design meeting shall be scheduled with the Consultant and the Project Team members at the commencement of the project to obtain and/or coordinate the following information: 1. Project Directory: Develop a project directory that identifies the name and phone number of key designated representatives who may be contacted during the design and construction phases of this project. 2. Site Access: Develop procedures to access the project site and provide the names and phone numbers of approved escorts when needed. Obtain copies of special security and policy procedures that must be followed during all work conducted at the facility and include this information in Division 1 of the specification. 3. Project Coordination: Review and become familiar with any current and/or future projects at the site that may impact the design, construction, and scheduling requirements of this project. Incorporate all appropriate information and coordination requirements in Division 1 of the specification. 4. Existing Documentation: Copies of the following documents will be provided to each Consulting firm at the pre-proposal meeting to assist in the bidding process.

• Preliminary Energy Audits for Edna Mahan Correctional Facility and Hunterdon Developmental Center (prepared by Gannett-Fleming November 1, 2016)

Review these documents and any additional information that may be provided at a later date such as reports, studies, surveys, equipment manuals, as-built drawings, etc. The State does not attest to the accuracy of the information provided and accepts no responsibility for the consequences of errors by the use of any information and material contained in the documentation provided. It shall be the responsibility of the Consultant to verify the contents and assume full responsibility for any determination or conclusion drawn from the material used. If the information provided is insufficient, the Consultant shall take the appropriate actions necessary to obtain the additional information required. All original documentation shall be returned to the provider at the completion of the project.

VIII. GENERAL REQUIREMENTS

A. SCOPE CHANGES The Consultant must request any changes to this Scope of Work in writing. An approved DPMC 9d Consultant Amendment Request form reflecting authorized scope changes must be received by the Consultant prior to undertaking any additional work. The DPMC 9d form must be approved and signed by the Director of DPMC and written authorization issued from the Project Manager prior to any work being performed by the Consultant. Any work performed without the executed DPMC 9d form is done at the Consultant’s own financial risk.

B. ERRORS AND OMISSIONS All claims for errors and omissions will be pursued by the State on an individual basis. The State will review each error or omission with the Consultant and determine the actual amount of damages, if any, resulting from each negligent act, error or omission.
