Conditions of Acceptance of Copy

FAILURE to comply with any of the following conditions will result in the rejection of copy, and no responsibility can be accepted if such rejection should affect any date contained in such copy or any requirement of publication on a specific date.

Persons drafting any kind of notices are strongly advised to follow the guidance offered in—

(a) the Instructions Relating to the Drafting and Typing of Legislation (Attorney-General’s Circular 1 of 1978); and

(b) the Manual of Style for the Drafting and Preparation of copy published by Printflow (Private) Limited;

which two booklets are intended for complementary use.In these conditions, other than where a particular kind of copy is

specified, “copy” means copy for all matter contained in the Gazette itself and for subsidiary legislation issued as supplements to the Gazette.

1. (1) Other than by prior arrangements, only original typing is accepted.

(2) Carbon-copies are not normally acceptable, other than in cases where the original typing has to be legally retained, elsewhere, as, for example, in the case of a proclamation.

(3) Computer print-outs are not accepted automatically, as discussion may be necessary with regard to the extra time and costs involved.

2. (1) All copy must be clear and legible, and there must be double or one and a half spacing between the lines.

(2) Any corrections or alterations made by the originator, must be clearly effected in blue or black ink, using editorial marks—not proof-reader’s marks:

Provided that any copy containing extensive alterations will be rejected.

(4) Where any matter is added after the copy has beenprepared, and such additional matter results in one or more sheets being inserted between those already numbered, all sheets must be renumbered from there onwards—not, for instance 7, 7b, 8, et cetera.

4. Photographic copy or copy produced on a duplicating machine may be accepted if it is abundantly clear.

5. (1) Should any copy—(a) exceed 10 pages of double-spaced typing on size A4

paper; or(b) contain tabular or other matter which involves complicated

setting; it will be classed as “lengthy’ copy, and will be required to be submitted not less than 21 days before the date of closing for the Gazette in which it is to be published.

(2) Lengthy copy may be accepted at less than 21 days’ notice if—

(a) the work involved is of a straight forward and non-tabular nature; and

(b) the total volume of work on hand for the time being permits its acceptance.

6. Notwithstanding anything to the contrary contained in these conditions, any copy—

(a) which is of national importance, and which is originated as a matter of urgent necessity, may, by prior arrangement, be accepted late for the current week;

(b) may, due to shortage of staff or to technical considerations, be delayed until conditions permit its processing.

7. Copy must not be submitted as part of a letter or a requisition.It must appear on a separate sheet of paper, on which there is no instruction or other extraneous matter.

8. (1) In cases where notices have to be published in tabular form, copy must be drafted exactly as it is to appear. If printed forms for any such notices are unavailable, advertisers must prepare their own forms. While it is not necessary to include the preamble, the box-headings must be there, and, where applicable, the number of the form; for example, “Insolvency Regulations—Form 3”.

(2) In the case of copy for tabular notices, the provision of subsection (2) of section 3 does not apply.

9. Copy for all advertisements, whether sent by post or delivered by hand, must be accompanied by a requisition or a letter which clearly sets out—

(a) the name and address of the advertiser; and(b) the debtor’s code number, if any; and(c) the required date or dates of publication.

10. If a typographical error occurs in the Gazette, it is rectified as soon as possible by a correcting notice without charge to the ministry or department concerned, subject to the following conditions—

(a) that such error is reported to the editor within three months from the date of publication; and

(b) that the relevant copy, upon re-examination, is proved to be abundantly clear; and

(c) that the correction of such error is legally necessary.(2) If a drafting error is not detected before publication,

the originating ministry or department is required to draft its own correcting notice, take it to the Attorney-General for vetting and pay for such notice to be published.

(3) For the removal of doubt—(a) a typographical error is made by a typographer;(b) a typist’s error is classed as a drafting error by reason of

the fact that the officer responsible for drafting failed to check the typist’s work.

THE charge for printing statutory instruments is USD0,07 per A5 page and USD0,14 per A4 page multiplied by 2 000 (being the number of copies printed).

of the page, such as lost insurance policies, deceased estates, insolvent estates, company liquidations, notices in terms of the Insolvency Act [Chapter 6:04], changes of companies’ names: US$30,00 cash per entry.

Notices of intention to alienate a business or the goodwill of a business or any goods or property forming part of a business, otherwise than in the ordinary course of business shall cost USD120,00 cash for the three consecutive publications.

Except in the case of approved accounts, remittances must accompany all copy of advertisements, failing this, copy will be returned with an assessment of charges.Times of closing

The Gazette closes for the receipt of copy for all notices to be published in the normal columns, and for statutory instruments at 11 a.m. on the Monday preceeding the Friday of publication.

Copy for all notices to be set in tabular form must be received by 11 a.m. on the Friday preceeding the Friday of publication.

IT is hereby notified, for general information, that it is necessary to draw attention to the “Conditions for Acceptance of Copy”, which appears in every issue of the Gazette; and particularly the need to submit lengthy copy, in the case of Statutory Instruments, at least 21 days before the date of closing for the Gazette in which the notice is to be published.

During the past few months or so there have been many cases where urgent copy for subsidiary legislation, which requires the signature of the President or a minister to give it effect, and which is of national importance, has been sent in for publication in the Gazette after closing-time. Whilst I acknowledge that it is the duty of Printflow (Private) Limited to give certain notices special treatment, I am, however, of the view that a Gazette Extraordinary has tended to be a must rather than a matter of priority in respect of unwarranted delays of urgent copy.

While every effort will continue to be made to publish Extraordinaries on the required dates, copy must be submitted timeously so that it can be programmed into the printing-work-flow as soon as it is available.

IT is hereby notified that the Minister of Public Service, Labour and Social Welfare has, in terms of section 80(1) of the Labour Act [Chapter 28:01 ], approved the publication of the Collective Bargaining Agreement set out in the Schedule which further amends the agreement published in Statutory Instrument 116 of 2014, registered in terms of section 79 of the Act [Chapter 28:01],

NATIONAL EMPLOYMENT COUNCIL FOR THE AGRICULTURAL INDUSTRY

COLLECTIVE BARGAINING AGREEMENT: AGRICULTURAL INDUSTRY

Made and entered in accordance with the Labour Act [Chapter 28:01], as amended from time to time, between Kapenta Producers Association (KPA), Indigenous Kapenta Producers Association (IKPA), Zimbabwe Agricultural Employers Organisation (ZAEO), Zimbabwe Commercial Farmers Union (ZCFU), Zimbabwe Farmers Union (ZFU), Zimbabwe Tobacco Association (ZTA), Zimbabwe Tea Growers Association (ZTGA), Timber Producers Association (TPA), Zimbabwe Sugarcane Employers Organisation (ZSEO), Commercial Farmers Union (CFU), and Agro and Horticulture employer representatives (herein referred to as “the employers” or “the employers’ organisations”), of the one part, and the General Agriculture and Plantation Workers ’ U nion of Zimbabwe (GAPWUZ), Horticulture, General Agriculture and Plantation Workers’ Union of Zimbabwe (HGAPWUZ) and Kapenta Workers Union of Zimbabwe (KWUZ) (herein referred to as “the employees” or “the trade unions”), of the other part, being parties to the National Employment Council for the Agricultural Industry of Zimbabwe to further amend the Collective Bargaining Agreement published in Statutory Instrument 116 of 2014.

This further agreement shall be deemed to have come into operation on the 24th of January, 2020.

Insurance (Amendment) Regulations, 2020 (No. 23)

IT is hereby notified that the Minister of Finance and Economic Development has, in terms of section 89 of the Insurance Act [Chapter 24:07], made the following regulations: —

1. These regulations may be cited as the Insurance (Amendment) Regulations, 2020 (No. 23).

2. Section 3 of the Insurance Regulations, 1989, published in Statutory Instrument 49 of 1989 (hereinafter called the “principal

Statutory Instrument 59 of 2020.

regulations”), is amended by the repeal of subsection (1) and the substitution of the following—

“(1) The minimum unencumbered capital requirement for an insurer for registration or ongoing operations shall be the equivalent of—

(a) seventy-five million dollars in the case of an insurer which carries on life assurance business including funeral assurance;

(b) thirty-seven million five hundred dollars in the case of an insurer which carries on non-life insurance business;

(c) one hundred and twelve million dollars in the case of an insurer which carries on insurance business referred to in both paragraphs (a) and (b);

(d) seventy-five million dollars in the case of an insurer which carries on reinsurance or reassurance business;

(e) sixty-two million five hundred thousand dollars in the case of an insurer which carries on life assurance solely for the purpose of issuing funeral policies;

(f) four million five hundred thousand dollars in the case of an insurer which carries on micro insurance only.”.

3. Section 5 of the principal regulations is repealed and the following is substituted—

“Minimum capital for insurance brokers

5. (1) Every registered insurance broker shall hold capital of not less than one million five hundred thousand dollars.

(2) For purposes of calculating capital for insurance brokers, sections 3A (1) to (4) shall apply with necessary changes to insurance brokers.

(3) Every registered insurance broker shall effect and maintain a professional indemnity insurance with a limit of liability of not less than—

(a) one million two hundred thousand dollars; or(b) fifty per centum of such broker ’ s net brokerage income

in his or her preceding year;

whichever is greater.”.

4. Section 12 of the principal regulations is amended by the repeal of subsection (3) and the substitution of the following—

“(3) The fee payable by the owner to the insurer for the issue of a correct and certified copy of the policy shall be such sum, not exceeding two hundred dollars, as the insurer may fix, together with the costs incurred by the insurer—

(a) in proving the loss or destruction of the policy; and(b) advertising the loss or destruction of the policy; and

(c) in respect of any stamp-duty payable on the copy of the policy.”.

5. Section 13 of the principal regulations is amended by the repeal of paragraphs (a), (b) and (c) and the substitution of the following—

“(a) for the inspection of any document, twenty dollars;(b) for the inspection and copying of any document, two

hundred dollars;(c) for a certified copy of or abstract from any document,

ten dollars for every hundred words or part thereof. ”.

6. Section 16 of the principal regulations is repealed and substituted by the following—

“Security required for discharge ofprofessional function by multiple agent

16. (1) Every multiple agent shall—(a) obtain and maintain a professional indemnity

insurance cover for not less than one million one hundred and twenty-five thousand dollars; or

(b) hold an investment in approved securities of not less than one million one hundred and twenty-five thousand dollars, which securities shall be lodged with the Commissioner but any interest due on the investment shall accrue to the multiple agent; or

(c) obtain a guarantee by a bank or insurer or other third party approved by the Commissioner in the form of an irrevocable undertaking given to the Commissioner that, in the event of the insolvency of the multiple agent, the guarantor shall pay to the Commissioner on demand a sum of not less than one million one hundred and twenty-five thousand dollars for disbursement to the creditors of the multiple agent; or

(d) maintain deposits with a bank or other assets or investments worth not less than one million one hundred and twenty-five thousand dollars; or

(e) obtain, maintain or hold any combination of the foregoing investments, insurance, guarantee, deposits or assets the values of which, when added together, equal a sum of not less than one million one hundred and twenty-five thousand dollars; or

(0 have a paid-up capital of three hundred and seventy- five thousand.

7. Section 21 of the principal regulations is amended by the repeal of subsection (2) and the substitution of the following—

(2) Any holder of a licence who fails to comply with subsection (1) shall be liable to pay a penalty of five thousand dollars for each day during which he is in default.”.

Insurance (Amendment) Regulations, 2020 (No. 23)

8. Section 25 of the principal regulations is amended by the repeal of subsections (2) to (4) and the substitution of the following—

“(2) The register referred to in subsection (1) shall be open for inspection during the normal business hours of the office of the Commissioner, on payment of a fee of fifty dollars:

Provided that the Commissioner may waive the fee in respect of an agent, registered insurer or insurance broker.

(3) In the event of the loss or destruction of a licence, the Commissioner may, upon written application and the payment of a fee of fifteen thousand dollars, issue a certified copy of such licence.

(4) A fee of seven thousand five hundred dollars shallbe payable for any change of name or other endorsement on the licence.”.

9. Section 26 of the principal regulations is amended by the repealed and substituted by the following—

“Penalties for failure to take out or renew licence

26. (1) Any agent who fails to take out or renew a licence required by these regulations within one month of the date from which he or she is required to hold or renew the licence shall be liable to pay one thousand dollars to the Commissioner for each month or part of a month during which he or she carried on the business of an insurance agent without the prescribed licence.

(2) any registered insurer who is represented by an agent, who has failed to take out or renew a licence required by these regulations shall be liable to pay a penalty of ten thousand dollars to the Commissioner in respect of each such agent, and, additionally, shall be liable to pay to the Commissioner a sum of ten thousand dollars for each month or part of a month during which the default continues”.

6. The Third Schedule is repealed and the following is substituted—

Control of Goods (Open General Import Licence) (Amendment) Notice, 2020 (No. 7)

IT is hereby notified that the Minister of Industry and Commerce has, in terms of section 4(1) of the Control of Goods (Import and Export) Regulations, 1974, published in Rhodesia Government Notice 766 of 1974, made the following notice: —

1. This notice may be cited as the Control of Goods (Open General Import Licence) (Amendment) Notice, 2020 (No. 7).

2. The Control of Goods (Open General Import Licence) Notice, 2018, published in Statutory Instmment 237A of 2018, is amended by the insertion of the following products to the Open General Import Licence—

(i) Grain;(ii) Maize meal; and

(iii) Wheat flour.

3. (1) Explanatory note (c)(i) to the Control of Goods (Open General Import Licence) Notice, 2017, published in Statutory Instrument 122 of 2017, is amended by changing the import licence fee for the remaining products under the Open General Import Licence to ZWL$150,00.

(2) Pursuant to listing grain, maize meal and wheat flour on the Open General Import Licence, individuals and corporates may import these products without the need for an import licence.

Exchange Control (Exclusive Use of Zimbabwe Dollar for Domestic Transactions) (Amendment) Regulations, 2020 (No. 1)

IT is hereby notibed that His Excellency the President, in terms of section 2 of the Exchange Control Act [Chapter 22:05], has made the following regulations: —

1. These regulations may be cited as the Exchange Control (Exclusive Use of Zimbabwe Dollar for Domestic Transactions) (Amendment) Regulations, 2020 (No. 1).

2. The Exchange Control (Exclusive Use of Zimbabwe Dollar for Domestic Transactions) Regulations,2019, published in Statutory Instmment 212 of 2019, is amended in section 4 (‘Transactions excluded from scope of “domestic transactions”) by the insertion of the following paragraph after paragraph (1) —

“(g) payment foremergency passports, that is the payment out of free funds (as defined in section 2 of the Exchange Control Regulations, 1996) of any fee for the issuance of a passport within twenty-four hours of the fulfilment of the requirements for such issuance by the person in whose name the passport is to be issued. ”.

IT is hereby notified that the Minister of Lands, Agriculture, Water and Rural Resettlement has, in terms of section 21 as read with section 17 of the Land Commission Act [Chapter 20:29\, made the following regulations: —

Title

1. These regulations may be cited as the Land Commission(Gazetted Land) (Disposal in Lieu of Compensation) Regulations, 2020.

Interpretation

2. In these regulations —“acquired agricultural land” means land (or any piece thereof)

compulsorily acquired under the Land Reform and Resettlement Programme;

“alienate” in relation to a farm compulsorily acquired under the Land Reform and Resettlement Programme means to transfer ownership of it to a person referred to in section 3;

“application” means any application made in terms of section 4, and “applicant” shall be constmed accordingly.

“BIPPA or BIT country” means a country with which the Republic of Zimbabwe has concluded a Bilateral Investment Protection and Promotion Agreement or a Bilateral Investment Treaty;

“committee” means the committee appointed in terms of section 4;

“identity document” means a valid passport, or a notice or identity document issued in terms of section 7 of the National Registration Act [Chapter 10:17], or a valid driver’s licence containing an identity number assigned to the holderthereof underthe National RegistrationAct [Chapter 10:17]

“Land Reform and Resettlement Programme” means the programme referred to in the definition of “A2 farm” of the Act;

Object of regulations

3. The object of these regulations is to provide for the disposal of land to persons referred to in section 4, who are, in terms of section 295 of the Constitution, entitled to compensation for acquisition of previously compulsorily acquired agricultural land.

Identification of persons to whom these regulations apply

4. (1) These regulations apply to the following persons who, before agricultural land owned by them was compulsorily acquired under the Land Reform and Resettlement Programme (hereinafter in these regulations referred to as “acquired agricultural land”), were the owners thereof under a deed of grant or title deed or had completed the purchase of their farms from the State in terms of a lease with an option to purchase —

(a) indigenous individual persons (or where such persons are deceased, their legally recognised heirs);

(b) individuals whowerecitizensofaBIPPAorBIT country at the time their investments in agricultural land were

compulsorily acquired under the Land Reform and Resettlement Programme (or where such persons are deceased, their legally recognised heirs);

(c) partnerships, if the partners who held any farm jointly were—

(i) indigenous individuals; or(ii) citizens of a BIPPA or BIT country;

(d) private companies whose shareholding is wholly or predominantly owned by—

(i) indigenous individuals; or(ii) individuals who were citizens of a BIPPA or BIT

country.

(2) Where -(a) anindividual(whetherindigenousornot) hadcompleted

the purchase of a farm from the State in terms of a lease with an option to purchase; and

(b) before obtaining title thereto from the State, the individual sold the farm to an indigenous individual in the expectation that a title deed or deed of grant will be granted; and

(c) before the title was issued in relation to such farm, the farm was acquired under the Land Reform and Resettlement Programme;

the indigenous purchaser may lodge an application in terms of these regulations.

Submission and processing of applications

5. (1) Any person listed in section 4 who wishes to obtain titleto a piece of acquired agricultural land that was formerly his or her farm may apply in writing to the Minister, who shall refer all such applications to the committee.

(2) The Minister shall constitute a committee which shall receive and process applications from persons referred to in section 4, with a view to recommending to the Minister, whether or not to alienate the land in question to the applicant.

(3) The committee shall be headed by the Director of the Department of Lands Management, who shall be deputised by the Legal Adviser of the Ministry of Lands, Agriculture, Water and Rural Resettlement.

(4) The committee shall further consist of three other members employed in the Ministry, appointed by the Minister on an ad hoc basis or for terms not exceeding twelve months.

(5) The Minister shall ensure that the membership of the committee is gender balanced.

Documents to he submitted with application

6. (1) An applicant must submit—(a) a copy of the deed of grant or title deed or lease with an

option to purchase in respect of the farm for which title is sought to be obtained (and in the latter case, proof satisfactory to the committee that all the instalments due under the lease agreement were paid); and

(b) his or her identity document of the applicant, and if the application is made by the applicant in his or her capacity as an heir, and the death certificate of the deceased; and

(c) in the case of an applicant who is a citizen of a BIPPA or BIT country, the following in addition to the documents referred to in paragraph (a) and (b)—(i) a copy of the relevant BIPPA; and

(ii) a passport or passports showing that the applicant was a citizen of the BIPPA or BIT country when the farm was acquired and continues to be such a citizen at the time of the application; and

(iii) if the farm in question was held by a partnership, proof satisfactory to the committee that the applicants constituting the partnership were citizens of a BIPPA or BIT country;

(d) individuals referred to in section 4(2) proof satisfactory to the committee that—

(i) they purchased the land in question from persons who had completed the purchase of their farms

from the State in terms of a lease with an option to purchase; and

(ii) they purchased the land in question prior to the gazetting of such farm; and

(iii) with the expectation that a title deed or deed of grant will be granted to them.

(e) in the case of an applicant who is an indigenous person claiming title to the farm held by a private company, proof satisfactory to the committee that the applicant wholly or predominantly owned the company at the time the farm was acquired.

(2) If any document submitted with an application is queried by the Director of Land Management or the Legal Adviser, further proof may be required in the form of (but not limited to) the following documents as may be appropriate—

(a) an agreement of sale relating to the farm before it was acquired;

(b) a certificate of no interest made in terms of the Land Acquisition (Right of First Refusal for Rural Land) Regulations, 1992, or an affidavit executed in terms of section 6 of the same regulations or in terms of the Land Acquisition (Disposal of Rural Land) Regulations 1999;

(c) any record showing proof of payment forthe farm before it was acquired by the State;

(d) an affidavit from the applicant deposing to such facts as the Director of the Department of Land Management or Legal Adviser may require.

Consideration of applications by committee7. (1) For the avoidance of doubt, it is declared that these

regulations do not confer a right or legitimate expectation to obtain title to any piece of acquired agricultural land upon persons who may otherwise qualify to obtain such title.

(2) In considering whether to recommend any application for approval by the Minister the committee shall take into account any of the following considerations as seem to it to be relevant to the application—

(a) whether the farm in question is wholly or partially occupied by A1 permit holders or holders of 99 year leases;

(b) whether the applicant in question is in occupation of the farm or a part of it;

(c) whether (on the basis of previous policy directives issued by the Minister that are known to the committee) granting the application would be contrary to the interests of defence, public safety, public order, public morality, public health, regional or town planning or the general public interest.

(d) whether the State on its own discretion, prefers to pay compensation in respect of the acquired agricultural land in question.Procedure after consideration of application

8. (1) If in the opinion of the committee—(a) an applicant qualifies to obtain title to a farm in part

or in full, the committee shall make the appropriate recommendation to the Minister;

(b) an applicant does not qualify to obtain title to a farm in part or in full, the committee shall inform the applicant in writing accordingly and give him or her reasons why he or she does not qualify.

(2) In considering a recommendation of the committee, the Minister shall invite the Land Commission to make representations, if any, on the recommendation within a period (not being less than seven days) specified by the Minister.

(3) The Minister may reject any application on the basis that granting it would be contrary to the interests of defence, public safety, public order, public morality, public health, regional or town planning or the general public interest.

(4) The Minister shall notify every applicant in writing of the outcome of his or her application and, where the application is rejected, the reasons for the rejection.

(5) The Minister’s decision upon an application shall befinal.

(6) If the Minister accepts a recommendation to alienate any piece of acquired agricultural land, the Minister shall direct the Director of the Department of Land or the Legal Advisor to inform the applicant in writing accordingly.

(7) The Minister shall ensure that a person whose application has been successful receives transfer of the land in question under individual registered title.

Effect of alienation

9. (1) Alienation of a piece of acquired agricultural land comprising a farm to a qualifying applicant in terms of these regulations shall be a final settlement of any claims that the applicant may have from the State in respect of compensation.

(2) Alienation of a piece of acquired agricultural landcomprising only part of a farm toaqualifying applicant in termsof these regulations shall be a final settlement of any claim for compensation to the extent that the application is successful.
