2. Money orders / cheque will not accepted.
3. EMD amount as mentioned in the Tender forms may be paid by Demand Draft only
drawn in favour of the General Manager, Pudukkottai Dist. Co-op Milk Producers Union
Ltd., Pudukkottai – 622002 payable at Pudukkottai. The offers without EMD will be
summarily rejected. The old EMD/Security deposit will not be taken into account as
EMD for this fresh tender.
4. The State Government under takings/Co-op institution and public sector/ SSI units
within Tamilnadu and NSIC unit of other state are exempted from the payment of EMD/
Security deposit and cost of tender forms. For claiming the exeption, the Xerox copy of
G.O/SSI/NSIC certificates should be attested by a Gazetted Officer and the same must
be enclosed with the technical Bid without fail.

Supply, erection and commissioning of Walk-In Cooler Cold Room of capacity
10 KL – 1 No. for Pudukkottai Dairy
TECHNICAL SPECIFICATION
1.0. Functional Requirement:
The milk will be packed in the sachets stacked in crates and stored
in walk in cold room at a temperature ranging between 2˚ C & 4ºC
2.0. Design Requirement of walk in cooler cold room.
2.1. Room size – 17’.2 L X 15’.7 W X 8’ H to store milk sachets in crates

3.0. Scope of supply:
3.1. Split type air cooled condensing unit comprising of Hermetically sealed
energy efficient compressor and condenser mounted on common base
frame made by GI pre-coated to meet the required refrigeration load – 2
Nos. (3 TR X2)

3.2. Total refrigeration capacity – 36,000 BTU/hr. at 2 deg. C X 2Nos.
3.3. Compressor type – Reciprocating HERMETIC
3.4. Power supply – 415 v / 3 ph / 50 Hz
3.5. Evaporator unit to maintain the room temperature of 2˚C - 4˚C with
electric defrosting arrangement – 2 Nos.
3.6. Necessary refrigerant piping with hard drawn 19 SWG Copper pipes
shall be provided by the contractor – 1 Lot.
3.7. Refrigerant controls that includes:-

3.8. Digital temperature indicator with micro processor controller to control
the compressor operation and defrost the system based on room

3.9. Electrical control panel consisting of switches, contactors, relays, over
load relays and indication lamp etc. 1 Lot.
3.10. Necessary electrical cabling for compressor, condenser, evaporator and
sensor with accessories. 1 Lot.
3.11. Suction line insulation of nitrile hose. 1 Lot.
3.12. Drain piping for drain out the condensed water from evaporator – 1 Lot.

4.0. Scope of work
Supply, installation and commissioning of thermally insulated panel
are joined together by means of tongue and groove joints / cam lock
joints and assembled at Pudukkottai Dairy.
4.1. Fire rating : Meets flame redundancy requirements according to DIN
4102 class B3 and according to ASTMD 1692 and ISO 3582 test (Self
extinguishing foam.)
4.2. Door : Flush / hinged type door with PCGI lamination on both sides.
60 mm thick. 74”X47” clear opening. Accessories: Anti-Condensation
door heater, Pad lock, Posi seal closure, Human safety release knob with
air curtain – 1 No.
4.3. Internal lighting – 4 Nos. shall be provided by the contractor.
The supplier should prepare a detailed general assembly drawing
showing plan, elevation, end view and cross sectional view of the walk in cool
room with complete materials. The drawing should be got approved by
Pudukkottai DCMPU Limited, before starting fabrication. The brought out
items should be clearly indicated with make, model and type.
4.4. Suitable alarm system to be provided in case of operator / staff getting
locked up inside the cold room.

ANNEXURE
This Limited tender document consists of technical and commercial terms:
1. Read all the terms and conditions of the Limited tender before to start filling up.
2. The tenderers are to submit the original set of the Limited tender duly filled in,
attach necessary documents and are advised to retain the duplicate set of
documents for records.
3. The Limited tender consisting of pages submitted in sealed cover duly super
scribed as “Tender for the Supply, erection and commissioning of Walk-in
Cooler Cold Room capacity 10000 Lts., for Pudukkottai Dairy under IDDP
scheme and addressed to “The General Manager, PDCMPU Ltd.,
Kalyanaramapuram 1st Street, Thirugokarnam, Pudukkottai -2 either in
person or by post so as to reach on or before the time and date specified.
Tenders received after the specified date and time shall be summarily rejected.
4. Go through the check slip given and ensure compliance of the terms and
conditions.
5. The tenderer is specifically informed that all the pages should be signed at the
bottom of each page without any omission by the authorized signatory with
name and seal of the firm.
6. The tender forms are not transferable or assignable.
7. The signatory of the tender should indicate his/their status in which he/they
have signed and submit necessary documentary proof admissible in law in
respect of such authority assigned to him/them by the firm. If the tender
opening day is declared as a holiday, the tenders shall be received and opened
immediately on the next working day at the same time and place.
8. E.M.D. PAYABLE:
8(a) All tenders must be accompanied with the prescribed amount of EMD along
with tender

8(c) The EMD amount to be drawn by means of the Bank Demand Draft only from
any Nationalised Bank or Scheduled Bank drawn in favour of the “General
Manager, PDCMPU Limited,” Payable at Pudukkottai. IT SHALL BE ENCLOSED
WITH THE TENDER DOCUMENT. No other form of remittance shall be
accepted.
8(d) Any tenderer claiming exemption from the payment of EMD, should produce
necessary valid documentary proof for SSI Registration in the form of
entrepreneurs memorandum (EM) No. part II as per new system of MSMED
Act 2006 of Tamilnadu Small Industries Development Corporation the
District Industries Centre of Directorate of Industries and Commerce in
respect of those items for which the Registration certificate has been
obtained and tenders called for by the Federation.
8(e) In respect of Small Scale Industries Units located outside Tamilnadu, such of
these units registered with National small Industries Corporation in respect of
items manufactured by them for which tenders have been called for by the
Federation alone will be granted exemption from payment of EMD.
8(f) Domestic Small Scale Industrial Unit means an Industrial Unit in which the
investment in fixed assets in Plant and machinery whether held in ownership or
on lease or by hire purchase does not exceed rupees one hundred lakhs and
which manufactures the goods within the State and Registered with the
Director of Industries and Commerce as defined under clause 2 (aa) of TT Act
of 1998.

8(g) Tenders not accompanied with demand draft towards the prescribed EMD
or the relevant documentary proof for the exemption thereon be
summarily rejected.
8(h) If the tenderer withdraw his offer before finalisation of the tender,
the EMD remitted by the tenderer shall be forfeited in full.
8(i) The EMD remitted by the Tenderer shall be forfeited in full.
1. If the tenderer submit fresh offer / revises offer in case of any omission subsequently after opening.
2. If withdraws his tender or backs at before the expiry of validity period or after acceptance.
3. If revises any of the terms quoted during validity period.
9. PAN / SALES TAX REGISTRATION / CLEARANCE CERTIFICAT:
1. Tenderers shall furnish Photostat copies of valid VAT or CST registration
certificates along with the tender.
2. Tenderers shall furnish Photostat copy of PAN registration certificate along
with the tender.
10. SECURITY DEPOSIT
The successful tenderers would be required to sign an agreement and
furnish a Security Deposit of 5% of the order value, drawn by means of Bank
Draft from any Indian Nationalised Bank or Scheduled Bank drawn in favour of
“General Manager, PDCMPU Ltd” payable at Pudukkottai within 15 days of
notifying them.
The EMD already paid along with tender shall be adjusted in the SD to be paid
by the successful tenderer. The security deposit will be refunded only after the expiry
of a period of 6 months from the date of satisfactory completion of the contract.
No exemption will be given for payment of Security deposit under any
circumstances and the same should be remitted by Demand Draft.

11. AGREEMENT:
The successful tenderer has to execute an agreement on Rs.40/- non judicial
stamp paper incorporating the terms and conditions of the contract and the
specification within 15 days from the date of intimation of the acceptance of the
tender. In case of default of either of the conditions (i.e) remitting the security deposit
or execution of the agreement within the time allowed, the EMD paid is likely to be
forfeited by the Union.
11(a) In case of default or either of the conditions (i.e) remitting the security
deposit or execution of the agreement within the time allowed, the EMD
paid is likely to be forfeited by the Union.
11(b) If the contactor fails to execute the contract satisfactorily at the tendered rate,
the security deposit will be forfeited by the Union.
11(c) If the Union incurs any loss / additional expenditure due to the negligence of
the contractor in connection with the work during the period of contract, the
same shall be recovered together with all charges and expenses from the
contractor.
11(d) The breakages or damages, if any, caused by the contractor to the property of
the Union, the cost will be recovered from the contractor.
10(e) No increase in the rate will be allowed during the period of contract under any
circumstances.
11(f) No interest shall be paid on Earnest Money Deposit/Security Deposit.
11(g) The Agreement in Rs.40/- non-judicial stamp paper shall be signed and
returned within 15 days of receipt of the purchase order along with the
D.D. for Security Deposit.

12. PAYMENT TERMS:
NO ADVANCE PAYMENT WILL BE MADE.
SUPPLY
a) 80% of basic price + taxes and other charges shall be released on receipt of the
Walk –in Cooler Cold Room at Pudukkottai Dairy in good condition.
b) The remaining 20% payment shall be released after the satisfactory erection
and commissioning of the Walk –in Cooler Cold Room at Pudukkottai Dairy
ERECTION AND COMMISSIONING:
1. 80% of the erection and commissioning charges shall be released on
completion of the erection and commissioning of the equipment.
2. The balance 20% of erection and commissioning charges shall be released after 3
months from the date of satisfactory commissioning and performance of the
equipments.
13(a) NO OTHER PAYMENT TERMS WILL BE CONSIDERED BY THE UNION IN
RESPECT OF BOTH SUPPLY AND ERECTION & COMMISSIONING).
13(b) If the tenderer / Contractor fails in its due performance of the contract
within the time fixed in the schedule accompanying the order or
extension of time granted, Liquidated damages will be levied up to 1%
per month on contracted value for the number of days the work / supply
has been delayed.
13(c) Time being the essence of contact no variation shall be permitted in the delivery
time as prescribed in the delivery schedule. If the tenderer fails to supply and
execute the work in full or part of the order as per the delivery schedule, the
Federation shall reserve the right to cancel the order besides forfeiture of
Security Deposit.

13(d) The variation in the statutory levies and taxes by State Government/Central
Government shall be effected on the end price to the benefit of either the
tenderer or the Union as the case may be.
13(e) Notwithstanding anything contained in the tender schedule, no obligation is
rests on the Union to accept the lowest tender and the Union shall also have
the right to accept or reject any or all the tenders without assigning any
reasons.
13(f) For violation of any of the terms and conditions of the contract, the Federation
reserves the right to terminate the contract, with or without notice as
applicable.
13(g) On termination of contract, the Security Deposit is liable to be forfeited and any
of the resultant loss beyond Security Deposit will be recovered from the
contractor by legal means apart from forfeiture of any amount due to the
contractor.
14. GUARANTEE:
A guarantee certificate shall be furnished for the workmanship and
performance of the equipment for a period of 18 months from the date of supply
or 12 months from the date of satisfactory commissioning whichever is earlier.
If any defects are noticed in the equipments during the guarantee period the
same should be rectified at site at free of cost and charges.
15. FORCE MAJEURE:
Failure or delay in the part of tenderer for supply due to force majeure causes
enumerated hereunder shall be considered, provided the supplier produces
documentary evidence.
a. Any cause which is beyond the reasonable control of the tenderer.
b. Natural phenomena, such as floods, drought, earthquakes and epidemics.

c. Act of any Govt. Authority, domestic or foreign, such as Wars declared or
undeclared quarantines, embargoes licensing control on production or
distribution restrictions.
d. Accident and disruptions such as fire, explosion, increase in power cut with
respect to date of tender opening etc.,
e. Strikes, slow down and lockouts.
The cause of force majeure condition will be taken into consideration only if the
supplier notifies within 30 days from the occurrence of such eventualities. The
purchaser shall verify the facts and grant such extension as the facts justify. For
extension due to force majeure conditions, the scrutiny by the purchaser and
decision of the purchaser shall be binding on the time.
16. DISPUTES AND ARBITRATION:
In case of disputes arising out of this tender, an arbitrator as mutually
acceptable to the tenderer and Federation will be appointed by the
General Manager, PDCMPU Limited. The arbitrator’s decision shall be
final, conclusive and binding on both the parties.
17. LEGAL JURISDICTION
In case if either party to the tender is aggrieved by the award of the arbitrator so
appointed as per clause 13 or otherwise, they can appeal to Court. The courts
situated in Pudukkottai alone shall have jurisdiction to entertain such
disputes.
18. VALIDITIY:
1. The tender offer shall be kept for acceptance for a period of 60 days from
the date of opening of Limited tender. The offers with lower validity
period are liable for rejection.
2. Further the tenderer shall agree to extend the validity of the bids without
altering the substance and prices of their bid for further period, if any required
by union.

19. DEVIATION:
1. The offers of the tenderers with deviations in commercial terms of the tender
document are liable for rejection.
2. No alternate offer will be accepted.
20. DELIVERY PERIOD:- Within 15 days from the date of receipt of work order or the
supply and erection of Walk –in Cooler Cold Room at Pudukkottai dairy.

and full understand the nature of the machinery required and quality /
specifications of the same and that our offer to supply union in strictly in
accordance with these requirements.
8. We hereby expressly accepted the liability and indemnify the Pudukkottai
District Co-operative milk Producers union or its authorized agent for any
losses, damages or inconvenience including of sales goodwill etc., caused
by any deviation or noncompliance on our part with specifications and or
supply of goods, due to any verifications in quality of the goods, deviations
from specifications, departure from schedule of supply, on-supply or late
supply any other breach of contract.
9. We agree that the decision of the General Manager, Pudukkottai District
Co-operative milk Producers union Ltd., shall be final in any dispute
regarding the terms and conditions of this tender.
