(0.72 Million TPA ROM) of M/s. The Ramco Cements Limited in lease area of
98.62 Ha located in Pudur, Nadukattur and SennayamPatti Villages,
Vilathikulam Taluk, Thoothukudi District, Tamil Nadu State - Additional
documents submission - reg.

In response to reference cited 2 above, the additional details sought by the EAC are
provided below:
Point 1: Examination of the proposal in view of the judgment passed by Hon'ble Supreme Court
of India on 02.08.2017 in the matter of Common Cause Vs Union of India & Others
after submission of details of permissions obtained by it since 1993-94 for mining
operations (EC as well as Consent) vis-a-vis year-wise authenticated production
figures.
Reply: As an additional document we have submitted the authenticated past
production details from Dept of Geology and Mining, Thoothukudi District
pertaining to the Financial Years from 2010-11 to 2016-2017 to MoEF vide
our letter dated 31.07.2017. Further, based on deliberations during the 22nd
EAC meeting held on 19.09.2017, we have obtained authenticated past
production details in respect of Financial Years from 1994-95 to 2016-2017
from Dept of Geology & Mining vide their letter No.GM.1/438 dated
26.09.2017. (Refer Enclosure —IA) Subsequently as per the Minutes of the
Meeting of 22nd EAC meeting, we have obtained authenticated past

production details for the years 1992-93 and 1993-1994 from Dept of
Geology 8t Mining, Thoothukudi District vide their letter No.GM.1/438 dated
05.10. 2017 and the same has been appended as Enclosure-1B.
In the EIA/EMP report we have provided the production details for the year
1992-93 as 1, 47,000 Tonnes. In this regard, we would like to submit that the
production figure mentioned as 1,47,004 tonnes for the year 1992-1993 was
covering 15 months of production from 01.01.1992 to 31.03.1993. This is due
to the changing of accounting method from Calendar year to financial year by
the Dept of Geology and Mining. Prior to the year 1992, calendar year
accounting method was followed by Dept of Geology et Mining.
It is pertinent to mention that EC for this lease was obtained vide letter No 3-
11015/6/99-IA-II (M) dated 21.11.1999. Also, the mining operation was
being carried out by obtaining valid Consent to Operate from Tamilnadu
Pollution Control Board. A copy of the latest consent to operate for the years
2017-18 has been appended as Enclosure - 1C.
Point 2: Executed lease deed in support of lease validity till 28.07.2033.
Reply: 1st renewal of Mining Lease has been granted vide G.O.Ms.No 168
(MMA.1) Industries Dept dated 17.11.2014 over an extent 98.62 Ha in Pudur,
Nadukattur and Sennayampatti villages, Vilathikulam Taluk, Thoothukudi
District for 20 years period from 29.07.2003 to 28.07.2023 and the copy of
executed lease deed has been submitted.
It is submitted that the Govt. of India, enacted "The Mines and Minerals
(Development Et Regulation) Amendment Act, 2015", vide Gazette notification
No.13 dt 27.03.2015 (Effective from 12.01.2015). In respect of Mining Leases
granted prior to 12.01.2015 and where mineral is exclusively used in captive
industry, Section 8A(5) of the MM(D&R)Amendment Act stipulates that "the
period of lease granted before the commencement of MM(D&R) Amendment
Act 2015, where the mineral is used for captive purpose, shall be extended
and be deemed to have been extended upto a period ending on the
31.03.2030 , w.e.f. the date of expiry of period of renewal last made or till the
completion of renewal period , if any or a period of 50 years from the date of
grant of such lease , whichever later, subject to the condition that all the
terms and conditions of the lease have been complied with". As stipulated in

the Section 8A(5) of MM(D&R) Act, 2015,and since the validity of Original
Grant is 29.07.1983, this lease is eligible for extension till the validity period
up to 28.07.2033. It is significant to mention that the Department of Geology
and Mining & Industries Dept, Govt. of Tamilnadu is in the process of issuing
suitable orders as per Section 8A(5) of MM(D&R) Act,2015.
Point 3: PP to prepare breakup of activities and submit a detailed plan with enhanced
budgetary provisions for Enterprise Social Commitment.
Reply: To present the budgetary provisions under Enterprise Social Commitment, the
following major issues raised during Public Hearing has been considered. As
per the Standard TOR, 2.5 % of the total Project cost shall be earmarked
towards the Enterprise Social Commitment based on the Public Hearing
issues in addition to the CSR commitment of Rs 20 Lakhs per annum. The
present project cost for the expansion of production capacity is Rs.1.0 Crore.
Therefore, Rs.2.50 Lakhs per Year has been allotted towards the fulfillment of
the issues raised during Public Hearing exclusively under Enterprise Social
Commitment.

Point 4: PP to provide specific details on plantation and green belt development carried out till
date within and outside the M.L. area. Further, the plantation and green belt
development may be shown through KML also. PP to revamp its plantation programme
with budgetary provisions w.r.t. selection of plant species and avoid inclusion of
Casuarinas, Eucalyptus and Coconut.
Reply: Presently about 9.175 Ha of area are covered with plantation / green belt, of
which 2.90 Ha are within the lease area and the remaining 6.275 Ha are
outside the lease area. The details of existing Plantation are given below:

Trees already planted include Neem, Eucalyptus, Naval, Tamarind, Teak, Aval
Vagai, Mango, Guava, Kodikai, Nettilingam, Coconut, Pungai, Mangium,
Casurina, Arasa, Murungai, Banana, Seetha, Vanni, Yellow Arali etc. the
existing plantation is shown in KML file (Enclosure - 2) the link is mailed to
MoEF separately..
In the ultimate stage, plantation / bench plantation will be carried out in
35.77 Ha mined out area including 3.897 Ha of backfilled area. Besides, 16.72
Ha of Dump area & Topsoil storage area of 3.70 Ha will also be covered with
plantation. Besides, Green belt over an area of 14.13 Ha will be carried out
along mine periphery, virgin area and along the mine hauling roads. Thus
about 70.32 Ha covered under Green Belt/ Bench Plantation in the total lease
area of 96.82 Ha in post operational period. For future plantation local species
like Neem - Azadirachta indica, Tamarind - Tamarindus indica, Albizia lebbeck
- Vagai, Pongamia pinnata - Pungai, etc will be planted. As suggested by the
EAC species like Casuarinas, Eucalyptus and Coconut will be avoided.
Action plan for Green Belt / Afforestation :
In the Chapter VI of the EIA/EMP report (Table No.6.3) of Page No.6-10,
activity wise the Environmental Control Cost has been elaborated. With
regard to Green belt and Afforestation, the recurring cost per annum is Rs.9.0
Lakhs per Annum out of the total Environmental Control cost of Rs.56.0 Lakhs
per Annum.

Note: Budget includes Cost of the plant/species, plantation, watering, manure,
maintenance etc., new sapling for the year as well as maintenance of existing
plantations.
Point 5: PP to provide status of backfilling of topsoil/ rejects along with the timelines
proposed for the same.
Reply: With the available residual reserves and the proposed rate of Production, the
life of the mine would be 14 years. Status of Mining and back filling are given
below:
For the periods, 2018-19 to 2027-2028 (2 nos. of five year plan period),
Mining is proposed in the Western (existing) Block for 10 years period, till
exhaustion of mineable limestone reserves.
During the period from 2028-29 to 2031-32, Eastern Block will be operated
and the reject generated in the Eastern Block will be used to refill the
exhausted portion between ML 15 and ML12 of Western Block.
About 8.47 Mil.t of side burden development quantity from Eastern Block will
be used for refilling.
An extent of 3.897 Ha will be refilled, about 5.95 ha will be left as water
reservoir and the remaining area of 31.87 Ha is will have bench plantation. Top
soil to be mined during the period 2028-29 to 2031-32, in Eastern block shall be
stacked separately and utilised during reclamation of the Mine & waste dumps.
Point 6: PP to revamp and prepare breakup of activities covered under the Occupational Health
Action Plan with budgetary provisions
Reply : Action plan for Occupational Health :
In the Chapter IV of the EIA/EMP report, para 4.8.3 in Page No.4-53, details
of activities covered under Occupational Health has been provided. Also, the
overall budget per annum is given in the Chapter VI- (Table 6.3) for
Occupational Health & Hygiene. The recurring cost per annum is Rs.6.0 Lakhs
per Annum. However, breakup of activities and its budget provisions has been
described below for the Occupational Health.
