CHAPTER 3

TECHNICAL SPECIFICATIONS

•It may kindly be noted that in the specification wherever support for a feature has been asked for, it will mean that the feature should be available without RailTel requiring any other hardware/software/licenses. Thus all hardware/software/licenses required for enabling the support/feature shall be included in the offer.• Equipment offered or Similar Equipment shall be of proven performance of six month and also OEM should have 24*7 TAC support in India. Relevant document in support of the same shall be submitted. • Equipment offered shall be compatible with RailTel existing MPLS routers like Juniper M10, M20, M120, M10i and MX80 Router. If required, POC (Proof of concept) for the offered Equipment shall be done at time of technical evaluation. The eligibility of offer will be considered only after satisfactory POC of the offered Equipment for verifying the technical specifications.

1. Specification of LAN Extenders (2 Mbps) Make:-Zexel, Mrotek, D-link and

a) Should support IEEE 802.3/Ethernet 10/100-Base-T-supporting bridging capability.

b) Should have RJ45 Connectors with auto-speed sensing, auto learning, aging and auto polarity detection.

c) The speed/s supported at digital interface shall be with any combination/s of 64 Kbps between 64 Kbps to 2048 Kbps.

d) It is desired that the LAN Extenders are powered both using 230VAC and –48V DC. Rates may be quoted based on both the option that RailTel may choose DC powered LAN Extenders or AC powered LAN Extenders.

2. Specification of LAN Extenders (10 Mbps) Make:-Zyxel, Mrotek, D-link and

a) The equipment shall support the following digital interface which should be plug-in type and field upgradable.

b) Should support IEEE 802.3/Ethernet 10/100-Base-T-supporting bridging capability having following minimum characteristics.

c) Should have RJ45 Connectors with auto-speed sensing, auto learning, aging and auto polarity detection.

d) The speed/s supported at digital interface shall be with any combination/s of 64 Kbps between 64 Kbps to 10 Mbps.

e) It is desired that the Equipment are powered both using 230VAC and –48V DC. Rates may be quoted based on both the option that RailTel may choose DC powered Equipment or AC powered Equipment.

a) Should have 2 No.10/100 Mbps IEEE 802.3 Ethernet interface with RJ-45 (UTP) connector.

b) It must be possible to configure CIR (Committed Information Rate) and EIR (Excess Information Rate).

c) Should support IPv4 and IPv6.d) Should support OSPF, RIPv2 & static route.e) Should support Multicast (IGMPv3, PIM)f) Access filtering on both interfaces should be possible with

a) Should have one 10/100Base-T port. This port should be shielded RJ-45, with half/full duplex support as well as with Auto MDI-I/MDI-X.

b) Should have one 100Base FX port. This port should be with SC/LC connector.c) Should be possible to haul data on single SM fiber up to 10km. d) Should support fiber fault to be propagated to the copper port. e) Should work on both 230V AC and -48V DC. Option for both type of power inbuilt

interface should be provided.

6. Specification for Gigabit Ethernet Media Converter Make:-Zyxel, Mrotek, D-link and

9. Specification of L3 Switches Make:-Zyxel, Dlink, Extreme, Cisco, Juniper ,HP and Alcatel

a) The switch shall be designed for continuous operations .The bidder shall furnish the MTBF (Mean Time between Failures) and MTRR (Mean Time to Restore) and predicted and observed values along with calculations by manufacturer.

b) In case of full system failure, Switches shall maintain a trace area in the NVRAM, which would be used for analysis /diagnosis of the problem.

c) Switch shall have built in power on diagnostics system to detect hardware failures.d) Switches shall have suitable Visual Indicators for diagnostics and healthy

/unhealthy status of ports & modules.e) Switch shall have 24 Nos. 10/100/1000 Base –TX auto sensing ports with 4 No.

gigabit SFPs ports complying to IEEE 802.3, IEEE 803.3u and 802.3ab standard , supporting half duplex mode ,full duplex mode and auto negotiation on each port to optimize bandwidth.

f) Switch shall have minimum of 28 Gbps forwarding bandwidth at layer 2 and layer 3 switching fabric.

g) Switch shall have minimum 32 million packets (64 Byte packets) per second forwarding rate.

h) Switches shall have a minimum of 8, 000 MAC address space.i) Switch shall be capable of working with DC and DC voltage -40 to -54 V. Power

supply should be inbuilt in switch. j) It should be possible for the switches to be mounted on a 19-Inch rack. All

accessories required for this mounting should be supplied.k) Switches shall have the following features. All softwares/hardwares/License

10. Specification of MiniPOP’s Routers (8 GE Ports ) Make:- Cisco, Juniper ,HP and Alcatel

a) The router is supposed to be used in the minor MPLS pops of RailTel to be setup in a phased manner.

b) These will be connected to the Major MPLS pops where Juniper M-10.M-10i, M120, M20 and MX 80 series of routers have already been installed. The connectivity will be done mostly on Multiple E1s or on Ethernet over SDH or Optical Fibre.

c) The routers to be procured are intended to be generic in nature so that RailTel can use the routers in various different scenarios depending upon requirement.

d) The Router shall have 4 Nos. 10/100/1000 Base –TX auto sensing ports with 4 No. gigabit SFPs ports complying to IEEE 802.3, IEEE 803.3u and 802.3ab standard , supporting half duplex mode ,full duplex mode and auto negotiation on each port to optimize bandwidth

e) The router shall support 10 Gbps throughput at 8 Mpps .f) The router shall support RIB capacity of upto 16k for IPv4 routesg) The router shall support operating temp 10 -60 C h) Features to be supported by the routers:i) IPv4 and IPv6.j) Should support OSPF, BGP, RIPv2 & static routers.k) Should support Multicast (IGMPv3, PIM, SDP, DVMRP & source specific)l) Should support the following minimum encapsulation:

CHAPTER 43.2 The supplier will have to supply the material within 60 days of the issue of confirmed

supply order/sub-purchase order against this Rate Contract. The exact locations/stations (any where in India) where material is to be delivered will be advised in the confirmed sub Purchase Order.

4. PAYMENT TERMS

4.1 90% of the value of the part supply of the equipment/material on receipt by the consignee at site duly inspected and accompanied with the following documents and any other documents mentioned in the contract:-

i) Invoice. ii) Delivery Challan iii) Contractor’s certificate of dispatch iv) Excise duty payment gate pass or equivalent v) Inspection certificate vi) Consignee’s receipt vii) Warranty guarantee certificate of OEM viii) Insurance certificate ix) Undertaking against Fall Clause

4.2 Balance 10% value of supply on receipt and acceptance of full supply at site by consignee on submission of Performance Bank Guarantee valid for 2 months beyond warranty period for each sub PO (i.e. 26 months from date of delivery to consignee).

4.3 Accounting unit/bill passing unit for the supplies under this Rate Contract is Corporate Office. Bills to be submitted to the Executive Director/RGM of the concerned Region for certifying receipt of material & services for onward submission to Corporate Office for payment.

4.4 Form “C”, if required, shall be issued for respective stations, by respective ED only.

4.5 The break up of taxes has to be furnished and same should be reflected in the bills so that any CENVAT/input credit can be availed by RailTel.

5. PERFORMANCE BANK GUARANTEE

The supplier is required to submit a Standing Performance Bank Guarantee (PBG) of Rs. 10,00,000/- within 15 days of issue of LOA for Rate Contract with validity upto 2 months beyond contract period and PBG of each sub PO for 10% of the value of the order equivalent in Indian Rupees for the satisfactory performance of contract with validity upto 2 months beyond warranty period. The proforma for PBG is given in Chapter 5.

The Performance Bank Guarantee (security deposit) shall be submitted to Corporate Office & will bear no interest.

6. TAXES & DUTIES

6.1 The price quoted should be firm, indicating the breakup and inclusive of all duties

and taxes, as applicable. The offer should be inclusive of packing, forwarding, freight & insurance charges upto destination. Form ‘C’, if required will be issued by respective ED/RGMs of RailTel Corporation of India Limited.

6.2 The Octroi / entry tax shall be paid extra as per actuals on production of proof of payment.

6.3 Tender should while quoting the prices, pass on to the purchaser the full effect of duty set off available on inputs under CENVAT scheme and should agree to pass on additional set off as may become available in future in respect of all the inputs used for manufacture of final product on the date of supply.

6.4 Wherever Value Added Tax (VAT) is being claimed, tender should pass on to the purchaser the set off/tax credit available on inputs, while quoting the prices. Additional set off, as may become available in future should also be passed on at the time of supply.

7. LIQUIDATED DAMAGES

The timely delivery is the essence of this project. Liquidated damages will be applicable at the rate of half percent per week or part thereof for undelivered portion subject to a maximum of 10% of the cost of unsupplied quantities/material. RailTel will have the right to cancel the order, place order on alternative source at risk & cost of the supplier besides levying the L.D.

8. TRANSPORTATION

The rates quoted should be F.O.R destination. The destination shall be the nominated Depots of RailTel Regional office as indicated in Sub Purchase Orders (Sub POs).

9. STATUTORY DEDUCTION

These will be made at source at the time of making payment as per the prevalent rules.

10. PURCHASER’S RIGHT TO ACCEPT OR REJECT BID

The Purchaser reserves the right to accept or reject bid, and to annul the bidding process, at any time prior to award of contract without assigning any reason whatsoever and without thereby incurring any liability to the affected bidder on the grounds for the Purchaser’s action.

10.1 LONG TERM AVAILABILITY OF SPARES & SYSTEM SUPPORT

10.1.1 The tenderer shall undertake to supply on payment all maintenance spares and tools required for the equipment for at least five years after expiry of warranty. He shall also undertake to supply additional equipment required for replacement or expansion of the network that may become necessary due to additional traffic requirements.

10.1.2 The manufacture shall guarantee that spare parts for the system shall be available for a minimum of five years after expiry of the warranty period and thereafter at least, six month advance notice shall be given RailTel before any equipment or components are discontinued or phased out from the manufacturing plans. This will enable RailTel to asses the lifetime requirement of spares needed and order in sufficient quantity prior to stoppage of the manufacture.

10.1.3 That the successful tenders shall further guarantee that if he goes out of production of spare parts he shall supply the specifications of materials at no cost to the purchaser, if and when required in connection with the equipment to enable the purchaser to fabricate or procure from other sources.

11. ISSUE OF LETTER OF ACCEPTANCE (LOA)

11.1 The bidder shall within 7 days of issue of the LOA, give his acceptance and submitperformance bank guarantee within 15 days as per clause 5.

12. BID PRICES

12.1 The bidder shall give the total composite price inclusive of all duties and taxes, packing forwarding, freight and insurance etc. The basic unit price and all other components of the price need to be individually indicated against the goods it proposes to supply under the contract as per schedule given in Chapter 2. The price shall be firm in Indian Rupees and FOR Destination. No foreign exchange will be made available by the purchaser.

12.2 The break up of price of each item of SOR in terms of basic Unit price, Excise duty, Sales Tax, Freight, Forwarding, Packing, Insurance and any other Levies/charges already paid or payable by the tenderer shall be indicated separately in the SOR Chapter 2. Any changes in statutory duties/taxes after opening of technical bid will be to RailTel’s account within the contracted delivery period.

12.3 FALL CLAUSE:- The firm shall undertake that in case the firm offers same material at a lower price to any other purchaser including Central/State/ Government Organization or Public Sector Undertaking, during the validity of Rate Contract, the equal benefit of lower prices will be passed on to RailTel.

12.4 Except in conditions of clause 12.3 above, the price quoted by the bidder shall remain fixed during the entire period of contract and shall not be subject to variation on any account.

13 CLAUSE WISE COMPLIANCE

Clause wise compliance statement of the Terms & Conditions shall be enclosed with the offer along with the technical literature of the material and other documents in support of relevant clauses.

14. Pre-shipment/pre-dispatch inspection shall be carried out at manufacturer’s/supplier’s works by RailTel’s authorized representative. The material/equipment/interface cards should be offered for inspection within 3 weeks of issue of confirmed Purchase Order/sub purchase order. Traveling, lodging & boarding expenses of RailTel’s representative and charges for 3rd party inspection if any shall be borne by RailTel but necessary facilities to carry out tests/witness inspection shall be provided by the manufacturer/supplier, free of cost.

14.2 Along with inspection call, the supplier/manufacturer shall submit details of test procedures, test programme, test parameters together with permitted values, etc., and their Quality Assurance Plan.

14.3 In case material/equipment /interface cards fails during inspection, the fresh lot of materials/equipment/material shall be offered without any extra cost, by the manufacturer/supplier. In such a case, total cost of re-inspection including travel, lodging & boarding of the inspecting officials shall be to manufacturer’s/supplier’s account.

15 FORCE MAJEURE

15.1 If during the Agreement, the performance in whole or in part, by either party, of any obligation under this is prevented or delayed, by reason beyond the control of the parties including war, hostility, acts of the public enemy, civic commotion, sabotage, Act of State or direction from Statutory Authority, explosion, epidemic, quarantine restriction, strikes and lockouts (as are not limited to the establishments and facilities of the parties), fire, floods, earthquakes, natural calamities or any act of GOD (hereinafter referred to as EVENTS), provided notice of happenings of any such EVENT is given by the affected party to the other, within twenty one (21) days from date of occurrence thereof, neither party shall have any such claims for damages against the other, in respect of such non-performance or delay in performance. Provided service under this Agreement shall be resumed as soon as practicable, after such EVENT comes to an end or ceases to exist.

15.2 In the event of a Force Majeure, the affected party will be excused from performance during the existence of the Force Majeure. When a Force Majeure occurs, the affected party after notifying the other party will attempt to mitigate the effect of the Force Majeure as much as possible. If such delaying cause shall continue for more than sixty (60) days from the date of the notice stated above, the party injured by the inability of the other to perform shall have the right, upon written notice of thirty (30) days to the other party, to terminate this Agreement. Neither party shall be liable for any breach, claims, damages against the other, in respect of non-performance or delay in performance as a result of Force Majeure leading to such termination.

16 SETTLEMENT OF DISPUTES

In case of any dispute concerning this order both the supplier and RailTel shall try to settle the same amicably through mutual discussion/negotiations. Any unsettled dispute shall be settled in terms of Indian Act of Arbitration and conciliation 1996 or any

amendment thereof. Place of arbitration shall be New Delhi. Arbitrator shall be appointed by Managing Director, RailTel Corporation of India Limited.

17. TRAINING

17.1 During execution of the supplies covered in sub POs issued against rate contract, the tenderer shall undertake to train RailTel staff nominated by RailTel in different aspects of equipment designs, functioning, field installation, testing, commissioning, operation, maintenance and repair, covering both hardware and software. The training should be comprehensive for transfer of complete know-how so as to impart full knowledge and competence to independently and successfully execute the installation, operation, user related software changes, maintenance and repair of all equipment.

17.2 The tenderer shall arrange formal class room training as per approved course structure for 100 men days and shall also include hands on practical experience at the manufacturer’s premises. Set of Documents related to training to each of the trainees shall be provided.

17.3 All expenses of Training shall be bear by the tenderer; however, expenses for travel to and from the place of training, boarding and lodging of the trainees shall be borne by RailTel.

18 GOVERNING LAWS:

This contract shall be interpreted in accordance with the laws of India. The courts at New Delhi shall have exclusive jurisdiction to entertain and try all matters arising out of this contract.

19 TERMINATION FOR DEFAULT

19.1 The purchaser may, without prejudice to any other remedy for breach of contract, by written notice of default, sent to the Supplier, terminate this contract in whole or in part.

a) If the supplier fails to deliver any or all of the goods within the time period(s) specified in the contract.

b) If the supplier fails to perform any other obligation(s) under the contract; and c) If the supplier, in either of the above circumstance(s) does not remedy his failure

within a period of 30 days (or such longer period as the Purchaser may authorise in writing) after receipt of the default notice from the Purchaser.

19.2 In the event the Purchaser terminates the contract in whole or in part, pursuant to para 19.1 the Purchaser may proceed, upon such terms and in such manner as it deems appropriate, goods similar to those undelivered and the supplier shall be liable to the Purchaser for any excess cost for such similar goods. However, the Supplier shall continue performance of the contract to the extent not terminated.

20 TERMINATION FOR INSOLVENCY

The purchaser may at any time terminate the contract by giving written notice to the supplier, without compensation to the supplier, if the supplier becomes bankrupt or otherwise insolvent as declared by the competent court provided that such termination will not prejudice or affect any right of action or remedy which has accrued or will accrue thereafter to the Purchaser.

21 SECURITY CLEARANCE FROM DoT

21.1 In connection with the security clearance, the latest directives issued from time to time by the Department of Telecommunication, Ministry of Communications & IT or any other Ministry of Government of India on security considerations shall be applicable to the present tender.

21.2 Accordingly as per the extant Amendment of the National Long Distance (NLD) Service License Agreement for security related concerns for expansion of Telecom Services in various zones of the country issued vide Department of Telecommunication, Ministry of Communication & IT, Government of India’s letter no. 10-54/2010-CS-III (NLD) dated 31.05.2011, the successful bidder’s OEM shall comply with the provisions stated in the above mentioned directive of DoT and shall have to enter into an agreement with RailTel as per the template agreement between Telecom Service provider and the Vendor of equipment, product and services (available on DoT website). The tenderer must submit a declaration alongwith their offer.

22 BID SUBMISSION AND OPENING DATE

22.1 Each and every page of bid should be signed by authorized representative of the firm. Power of attorney in favour of the signatory duly authorizing the signatory shall be enclosed in the bid.

22.2 The bid should be submitted in two copies-one original and one copy. The packet containing the original and copy of the bid duly marked “ORIGINAL & COPY” should be sealed by the personal seal of the bidder.

22.3 The envelope shall be addressed to the Purchaser at the following address:

We,…………………………………………… (indicate the name of Bank) further agree with RailTel that RailTel shall have the fullest liberty without our consent and without affecting in any manner our obligations hereunder to vary any of the terms and conditions of the Agreement or to extend time of to postpone for any time or from time to time any of the powers exercisable by RailTel against the said contractor(s) and to forbear or enforce any of the terms and conditions relating to the said Agreement and we shall not be relieved from our liability by reason of any such variation, or extension to the said Contractor(s) or for any forbearance, act or omission on the part of RailTel or any indulgence by RailTel to the said Contractor(s) or by any such matter or thing whatsoever which under the law relating to sureties would, but for this provision, have affect of so relieving us.

This Guarantee will not be discharged due to the change in the Constitution of the Bank or the Contractor(s) / Tenderer(s).
