At my law school in postSoviet Russia, the professors told us that only references to statutes were possible and that case law could not be the source of law. We had only one comparative law course there, namely the
constitutional law of foreign countries, and it was rather a description of the state structure than information about legal systems of other states. In addition, all that we knew about lawandorder abroad was that the German order was closest to ours. I’m aware of a few stories about some people who wrote dissertations at that time pursuing only one goal, i.e. to obtain a confession as to incorrectness and inappropriateness for entry of AngloSaxon legal institutions such as trust and judicial precedent into our law.
These days, the latter have a quasiofficial recognition as a source of law in Russia, but in fact the lawyers refer to previous cases as a base for ‘stare decisis’ over the last ten years. Being involved in the deal concerned with the issuance of additional shares by a Russian stateowned company last year, I was a witness of the issuer lawyers’ supreme efforts to find the possibility for application of the law of England, not the law of Russia, for that deal, and that was in spite of the fact that the Russian law, as one would think, is of undisputable authority for any structure which is closely connected with the state.
Wellknown Russian entrepreneur Oleg Tinkov is amazed that we not only build, sale and float stock for investors using English law, but even bake bread solely under English law. One powerful lawyer notes that only one in twenty M&A transactions in Russia will be governed by domestic law; the other nineteen will have English law applied to them. A firstrate Russian law firm managing partner at an eyecatching professional forum speaks in the same vein as one who would insist that the predominance of English law in our market is an example of a national security threat. Newspapers report cases from the UK in which both parties are Russians in substance and the disputed property is also Russian every week or so. In one word, this is the tendency…
Up until a century ago scholars began to identify the group of countries that we now call mixed jurisdictions. They are legal systems in which the RomanoGermanic tradition has become suffused to some degree by AngloAmerican law. These include Scotland, South Africa, Egypt, Province of Quebec in Canada, Louisiana in the U.S. and others.

But will Russia evolve in this way? The answer is obvious, because the fact that some sectors of economy – investment business and a considerable part of banking and development – are governed by English law speaks for itself. But it is not about what can’t be overcome or cannot be stopped (if such things should be done at all, but that is another story), limiting, for example, any possibilities of using offshore companies in business or altering the rules of play within the local market for international (English and U.S.) law firms (though it should be stated that the entry into the WTO will restrict the capabilities in this regard).
However, there are deeper trends, the results of which are probably not particularly visible or, at least, are not yet visible but could be notable for the degree to which English law will expand its territory here, especially when compared with one’s expectations.
To begin with is the structure of Western legal education. These days, journeys abroad to the universities of Great Britain or the United States after finishing Russian law school, for studies within the number of master (LL.M) programmes is no longer a matter of prestige; rather, what is of interest for many graduates of leading institutes of higher education. The University of London opened its doors for external study programmes in Moscow in cooperation with the Russian Academy of Justice and sent over academics for this purpose. Finally, how many of the cleverest Russians have worked for English and U.S. law firms established here in the past twenty years? Could they refuse to follow the ideas which were derived from their practice?
Secondly, is the issue of globalisation. With the arrival of the 21st century, the boundaries, essentially those concerning economic issues and information, were abolished. IFRS perform the leading role and, therefore, the national authorities are forced to give them preference today. If you want to be allowed the sources of international financing or to be listed on the leading stock exchange you should be working in compliance with the relevant rules and, in particular, with the international rules focused on accounting and financial reporting.
Of course, this was not all started from the ground up. There were those who already held an interest in it. This was above all true of “Big Four” companies, Wall Street and City banks, NYSE and LSE, i.e. those who originated from the AngloSaxon world. And it is notable that the majority of leading law firms, the global players, were also created there. Why not place the AngloSaxon law flush with IFRS?
We know which is the best course to take but we can go ahead in a variety of ways. We could proceed forward following the lead of Singapore where the statute on application of English law was enacted, but it is hardly appropriate for our country. We can set up islets or “enclaves” in imitation of Skolkovo liberalising activity in this regard. Alternatively, we can start the same ideas, adopt the institutions and create something which would be similar to the original in order to be drawn closer stepbystep. We are not allowed to say that it is alien to only us.
What does it mean to be the mixed jurisdiction? It isn't the best but it isn't the worst either. There is every likelihood that we will be simply faced with the necessity of forming it ourselves.

Когда я учился в юридическом вузе, а это было уже в постсоветскую эпоху, профессора говорили нам, что в судебных решениях нужно ссылаться только на законы, что судебная практика не может высту
пать источником права. У нас был только один сравнительноправовой курс, конституционное право зарубежных стран, и это было скорее описание государственного устройства, чем характеристика правовых систем других государств, при этом все, что мы знали о зарубежных правопорядках, – это то, что германский к нам ближе всего. Я знаю несколько примеров, как в то время люди делали диссертации, которые были посвящены только одному – признать неправильным и совершенно неподходящим для нас проникновение таких англосаксонских правовых институтов, как траст и судебный прецедент.
Сегодня последний практически официально провозглашен источником права в России, а дефакто юристы ссылаются на ранее разрешенные кейсы в подкрепление своих позиций в судах уже больше десяти лет. В прошлом году, участвуя в структурировании сделки по выпуску дополнительной эмиссии акций российской госкомпании, я стал свидетелем тому, как юристы эмитента старались всеми возможными способами найти допустимым применить к этой сделке английское, а не российское право, и это вопреки тому, что, казалось бы, уж для структуры, близкой к государству, последнее должно быть непоколебимым авторитетом.
Известный российский предприниматель Олег Тиньков изумляется, что мы не только строим, продаем и размещаемся на бирже, используя английское право, но даже хлеб мы выпекаем, уже только подчиняясь ему. Один из влиятельных на рынке юристов замечает, что только каждая двадцатая из сделок M&A в России будет подчинена нашему праву, тогда как девятнадцать – праву англосаксонских юрисдикций. Управляющий партнер крупнейшей отечественной юрфирмы, выступая на очень заметном профессиональном форуме, высказывается в том ключе, что засилье английского права в нашем обороте – это проявление угрозы безопасности страны. Газеты практически каждую неделю выдают репортажи о судебных процессах в Великобритании, в которых россияне по сути спорят в отношении российских же активов. Одним словом, тенденция…
Еще столетие назад ученыеюристы стали выделять группу стран, которые мы именуем смешанными юрисдикциями. Они представляют собой правовые системы, в которых романогерманская традиция в некотором роде оказалась размытой англоамериканским правом. Это Шотландия, Южная Африка, Египет, провинция Квебек в Канаде, штат Луизиана в США и др.
Не движется ли и Россия в этом пути? Ответ очевиден, факт того, что отдельные сектора экономики, в
первую очередь инвестиционный бизнес, значительная часть банкинга и девелопмента, управляются английским правом, говорит сам за себя. Но это то, с чем можно бороться, что можно остановить (нужно ли, это другое дело), ограничив, к примеру, возможности использования оффшоров в бизнесе либо изменив правила игры на местном рынке для международных (английских и американских) юрфирм (хотя, нужно заметить, вступление в ВТО существенно сузит возможности в этой части).
Однако есть и более глубинные процессы, последствия которых, быть может, не так или, по крайней мере, еще не так видны, но могут отличаться тем, что корни, которые английское право пустит на нашей почве, окажутся более крепкими, чем ктото будет думать.
Первое – это западное юридическое образование. Сегодня, получив диплом российского юриста, уехать учиться на Запад, главным образом – в университеты Англии или США, на одну из магистерских программ становится уже не вопросом престижа, «уделом избранных», а тем, что интересно многим из выпускников лучших вузов. Лондонский университет открывает обучение в России, кооперируясь с Академией правосудия и привозя своих преподавателей в Москву. А сколько лучших умов прошли за последние двадцать лет через школу английских и американских юрфирм, имеющих офисы в России? Откажутся ли они от тех идей, что прочно засели в их головы?
Второе – глобализация. Наступил 21й век, границы, в первую очередь экономические и информационные, стираются, МСФО уже играет главенствующую роль и национальные регуляторы вынуждены мириться с этим. Желаешь иметь доступ к трансграничному финансированию, выйти на ведущую биржу, – будь добр жить и работать по определенным правилам, а если конкретнее, – вести учет по международным стандартам.
Это, конечно же, возникло не на пустом месте. Были те, кто был заинтересован, в первую очередь, «большая четверка», банки Уоллстрит и Сити, ньюйоркская и лондонская биржи, то есть те, кто опять же происходит из англосаксонского мира. Но большинство сильнейших юрфирм, а ведь это глобальные структуры, происходит оттуда же. Не встанет ли англосаксонское право вровень с МСФО?
Путь очевиден, но идти по нему можно поразному. Можно как Сингапур принять акт о применении английского права, но это вряд ли приемлемо для нашей страны. Можно создавать островки, «анклавы», тот же «Сколково», где допускать больше либерализма в этом вопросе. Наконец, можно брать идеи, копировать институты, создавать чтото хотя бы схожее, чтобы постепенно сближаться. Единственное, нельзя говорить, что нам это чуждо.
Что же означает быть смешанной юрисдикцией? На самом деле, это и не плохо, и не хорошо. Скорее всего, мы просто будем поставлены перед необходимостью создать ее.

There’s a saying in English, “All work and no play makes Jack a very dull boy”. I’d actually take this one stage further and say that all work, no play and no philosophy means that Jack is not someone you want to spend time
with.I’m using the term “philosophy” in a very broad sense here.
Really what I mean is any discussion of life and its daily routine, from what your favourite food is, through last night’s football results to an evaluation of the meaning of life itself. In fact, anything that makes us the human beings that we are.
A number of things came together recently to set me thinking along this route. I had a very challenging – and enjoyable – business discussion with a member company of the Chamber with whom, we agreed, we weren’t doing enough. For nearly an hour and a half we discussed his business, what the Chamber does and if there were better ways we could bring these two areas together. It was a solid and fascinating business talk.
I had had a different kind of discussion shortly before that with another member, who complained about the kind of speakers we were choosing for our Parliamentary Lunch. “In the past you’ve had some really good economists”, he declared.

“Now you’re inviting historians, journalists, political commentators; what do they know about business?”
Well, either I haven’t explained clearly my vision of the role of the Chamber; or maybe I’ve got it wrong. Of course RBCC is there to facilitate business between the UK and Russia; that’s our core role. But around that core I see the Chamber as having a wider function. And that’s to create a community of people who are brought together by the desire to do business, but carry out that business in a variety of ways: through networking, through frank business talk and also through getting to know each other as individuals. In my experience, it is often this last element which ultimately creates the best environment for business.
It is very important to take time to develop a relationship with your Russian partner. Do take time to discuss the weather; his family; which football team he supports; which fashions she most likes; which subjects her children like most in school. By doing so, you each gain a better understanding of each other, which will give you a better idea of whether or not you can actually do business with this person.
Of course, the business side of things has to be discussed. But there should always be the time and space for broadening the conversation. Why is the business lunch so popular? Why are so many companies prepared to pay for corporate hospitality? Because these are excellent places to build business in the broadest sense. If a good lunch means to you simply tastе food and fine wine, you’re missing something. Surely the most important element of such an occasion is the company with whom you dine? Yes, good food and wine help; but I can guarantee that your meal won’t be memorable if your companion wants to talk simply about the widgets that he makes.

веком, погруженным в работу, в жизни которого нет ни развлечений, ни философии, не хочется проводить время.
Я имею ввиду философию в самом широком смысле. То есть речь о рассуждениях о жизни и ежедневных делах – от любимых блюд и результатах вчерашнего футбольного матча до смысла жизни. В общем, всего, что делает нас людьми.
Эти размышления вызвали несколько недавних событий. У меня состоялась очень интересная, хоть и непростая, деловая беседа с одной компанией – членом Палаты, с которой, как мы в результате согласились, мы могли бы больше работать. Около полутора часов мы обсуждали их бизнес, деятельность Палаты и как мы могли бы найти точки пересечения. Это был замечательный продуктивный деловой разговор.
Некоторое время до этого, у меня была совсем другая беседа с другим членом Палаты, который жаловался по поводу выбора спикеров для Парламентских ланчей. «Раньше у вас были отличные экономисты, – заявил он. – А теперь вы приглашаете историков, журналистов, политических комментаторов. Что они знают о бизнесе?»
Либо я недостаточно четко объяснил мое видение роли Палаты, либо у меня неверное ее понимание. Конечно, РБТП призвана способствовать российскобританскому бизне
су, это ее основная роль. Но я вижу второстепенные функции Палаты гораздо шире, а именно в создании общности людей, которых объединяют деловые цели, но также различные бизнессредства, такие как завязывание новых контактов на мероприятиях, откровенный разговор о делах и обычное человеческое общение. По моему опыту, именно последнее зачастую создает лучшую основу для бизнеса.
Очень важно уделить время развитию отношений с вашим российским деловым партнером. Найдите время поговорить о погоде, его семье, любимой футбольной команде, если это дама – о ее предпочтениях в моде, любимых школьных предметах у детей. Таким образом, вы оба лучше узнаете друг друга, что даст вам лучшее понимание, насколько вы хотите вести бизнес с этим человеком.
Конечно, дела тоже нужно обсуждать, но всегда необходимо находить время и возможность расширить тему разговора. Почему так популярен бизнесланч? Почему так много компаний готовы выделять средства на корпоративное гостеприимство? Потому что именно это помогает построить бизнес в самом широком смысле. Если хороший ланч сводится к вкусной еде и вину, чегото не хватает, ведь важный элемент такой встречи, это компания, с которой вы встречаетесь. Хорошая еда и вино – это прекрасно, но я уверен, что такая встреча едва ли запомнится, если ваш собеседник будет говорить лишь о гаджетах, которые производит его компания.

Deutsche Post DHL recently presented a study of the future named "Delivering Tomorrow: Logistics 2050", which outlines five probable scenarios for the development of world trade, business and society by 2050.
These models came as a result of a detailed expert analysis of the key factors which influence the development of civilisation: trading mechanisms, consumer behaviour, social and technological trends, climate change, as well assessing the impact of these factors on people’s behaviour and their values.
Clearly, in our rapidly changing world, it’s not good enough to predict the future of our society with a notorious ‘’fiveyear plan’’ or even a decade ahead, therefore 50 years no longer seems such a distant prospect. However, the catastrophic nature of some scenarios makes one hope that the future is still distant (authors emphasise the fact that one way or another, it will be a combination of all five separate scenarios). Furthermore, the authors also predict a special role for logistics and related infrastructure in any scenario.
But perhaps in Russia, the formulation of national development goals even for such a long term perspective will hardly be

Безусловно, в нашем стремительно меняющемся мире уже недостаточно прогнозировать будущее «пятилетками» или даже декадами, потому 50 лет уже не кажутся такой далекой перспективой. Однако катастрофичность некоторых сценариев заставляет надеяться, что такое будущее еще далеко (подчеркивается, что в том или ином виде это будет комбинация отдельных элементов всех пяти). При этом авторы предсказывают особую роль логистике при любом раскладе.
Но едва ли в России будут ориентироваться на мнение футурологов в постановке целей развития страны даже на такой длительный период. Как известно, перспектива вступления России в ВТО до последнего момента была не менее эфемерна, чем, к примеру, возможность в обозримом будущем разрабатывать и создавать собственные продукты при помощи 3Dпринтеров, согласно одному из сценариев. Очевидно, поэтому вопрос обеспечения современной инфраструктурой торговых потоков, которые неминуемо

It is commonly known that until the very last moment, the prospect of Russia joining the WTO was no less shortlived than, for example, the possibility of developing and creating consumer goods with the help of a 3D printer in the foreseeable future as suggests one of the scenarios. It would seem that the issue of secure trade flows will inevitably become more prevalent as modern infrastructure has only recently become a real order of the day. There is a need to modernise what was left of the Soviet transport infrastructure, and to all appearances, this reason is more objective than the economic backwardness of the country per see. In other words, internal stimulus is not enough, while external circumstances literally force measures to be taken to bring airports, ports, roads and other into accordance with international standards. Likewise, it is unlikely that the North Caucasus would have received such attention as a potential international sports and leisure centre if it were not for the Olympics in Sochi. It is unlikely that the French corporation Caisse des Depots et Consignations would have signed an agreement to established a joint venture with ‘’North Caucasus Resorts’’ for the development and construction of North Caucasian tourist resorts. Even the Krasnodar region would have most likely remained a back country in all senses of the word (although there are those who believe that this would have been for the better, especially in terms of environmental protection).
Organic growth is, seemingly, unsuitable for the Russian economy in general: playing catchup and breaking our neck produces a much bigger effect. To be fair, the eastern part of London would have perhaps remained a depressed, postindustrial area, a reminder of a stormy port life if it were not for this year’s Olympics. As they say, if ifs and ands were pots and pans… However, the abovementioned projects will definitely make part of history.

Появилась необходимость модернизировать то, что осталось от советской транспортной инфраструктуры, и судя по всему, это причина более объективная, чем само по себе экономическое отставание страны. Другими словами, внутренний стимул недостаточно силен, тогда как внешние обстоятельства вынуждают предпринимать меры по приведению аэропортов, портов, дорог и других элементов инфраструктуры в соответствие с мировыми стандартами.
Аналогично, едва ли Северный Кавказ получил бы такое внимание как потенциальный международный спортивнорекреационный центр, если бы не Олимпиада в Сочи. Едва ли французская госкорпорация Caisse des Depots et Consignations заключила бы соглашение о создании совместного предприятия с ОАО «Курорты Северного Кавказа» для развития и строительства Северокавказского туристического кластера. Сам Краснодарский край, скорее всего, так бы и оставался бы глубокой провинцией во всех смыслах (хотя есть те, кто полагают, что это ему было бы только на пользу, особенно с точки зрения охраны окружающей среды).
Органический рост, похоже, в целом несвойственен экономике России: игры в догонялки и прыжки через голову часто дают больше эффекта. Но справедливости ради стоит отметить, что и восточная часть Лондона, возможно, так бы и оставалась депрессивным индустриальным районом, напоминанием о бурной портовой жизни города – если бы не Олимпийские игры в этом году. Впрочем, говорят, история не имеет сослагательного наклонения, а упомянутые проекты уж точно в нее войдут.

On 23 March, the new RVC brand was launched in Moscow. The brand platform and graphic identity were developed by international consultancy firm Strategic Consulting Group (SCG) London, a company specialising in design and strategic consulting services for the financial sector. The rebranding will mark the beginning of a new phase for RVC. The decision to renew the company’s brand was brought about by the major changes that have taken place within the company over the last three years. These changes have included a new strategy, new team and business tools, as well as an increase in effective cooperation with other major players in the market. One main aspect of the rebranding is the change of the official name of the company used in external communications. In Russia, only the abbreviated form of the name will be used – RVC. The same abbreviated name will be used for global markets, but with the added descriptor, Russian Venture Capital. Igor Agamirzian, CEO of RVC, says: “Today our rebranding demonstrates to the global innovative community that we have changed – and that this change is not only internal but also enables us to offer effective market development solutions. During the rebranding process we considered several options, including a completely new name for the company. However, taking into account our established brand recognition and credibility, we decided to go with the abbreviation RVC, which is also wellknown”. In creating the brand platform, SCG London analysed current perception of the RVC brand among several target groups. This analysis, together with a benchmark study of large international investment companies and venture funds, led to the recommendation to change the logo visually. In addition to international research, the consultants used the communication strategy that had already been put into place by Russian specialists. This strategy included recommendations on forming both
the internal structure and external communication of the company, including the brand’s positioning. Clive Woodger, Chairman of SCG London, commented: “The new RVC brand transforms the elements of the previous identity into a contemporary, dynamic mark communicating progress, growth and interaction. Triangular shapes combine to create a multidirectional mark. This signifies Russian export of business and ideas while also representing global investment into Russia. In this concert in Wigmore Hall, that took place on 5 April, Maxim Vengerov brought together the greatest cornerstones of his repertoire in what some considered to be a landmark in the London concert season. This transaction was a classic preexport financing but had a peculiar security and coverage ratio structure, one unusual aspect being that the coverage ratio was set with respect to the ultimate sales contracts. A typical preexport finance structure will normally set the coverage ratios with respect to what is being assigned. The new facility will provide specialist maintenance and support services for commercial aero engines. This is four times larger than the existing facility, enabling teams to work on up to 13 aero engines at any one time, double what was previously possible.

Kaspersky Lab continues to lead the way among top IT security vendors, according to the results of InformationWeek’s 2012 Antivirus and AntiMalware Vendor Evaluation Survey. Among the nine vendors rated, Kaspersky Lab shared the highest ranking for overall performance and took top spot for AV/antimalware features with a ranking of 83%. The InformationWeek 2012 Antivirus and Antimalware Vendor Evaluation Survey asked 386 IT professionals to gauge their impressions of antivirus/antimalware vendors. Respondents only ranked vendors they had used or evaluated within the past 12 months. The core of the survey asked two sets of questions: one focused on the vendor overall, including price, general performance and product reliability, while the second focused on productspecific features such as virus and malware detection and removal. Kaspersky Lab was ranked first or second in all of the nine feature evaluation categories, ranging from Central Management to Platform Support. There was especially high praise for its accuracy of detection, efficient signaturebased detection and ability to spot malware and viruses before they are executed or installed.

Alan graduated in Russian Studies from the University of Leeds, and moved to Russia in 1999 in search of a challenge. His career has led him through a broad spectrum of
businesses, from agricultural projects, to insurance, advertising sales, and latterly providing hygiene and disinfectant products to hotels in Russian and Eastern European markets.
Alan is a very strong networker and driven by the exciting Russian business environment to find synergies. He enjoys combining networking with elements of his native Scottish cultural background. He has been the main coordinator of events for the Scottish expatriate community in Moscow over the last five years, and is a regular participant in a whiskey tasting club.

Martin drew on his experience as twotime BBC Moscow Correspondent and the major radio series he made about Russia last year to discuss the current social and political climate in Russia and share his thoughts on the outlook for business following the election of Vladimir Putin as Russian President. Martin’s speech provoked one of the liveliest discussions we have seen at a Parliamentary Lunch. We are very grateful to Martin for joining us for such an interesting meeting; and our thanks, too, to Mark Menzies for hosting this very memorable occasion for a second time.

On 14 March RBCC welcomed a delegation from the Ulyanovsk Region of the Russian Federation to London for a presentation of the Region’s investment and development opportunities. The delegation was led by Deputy Governor of the Ulyanovsk Region, Anatoly Ozernov, and included several senior representatives from the Region’s administration. The presentation, which took place at the Grosvenor House Hotel on London’s Park Lane, focused upon Ulyanovsk’s key sectors: the automotive, aerospace and logistics industries. The audience, made up of UK business people working in these areas, was welcomed by Stephen Dalziel, RBCC Executive Director, and HE Alexander Yakovenko, Russian Ambassador to the UK, both of whom emphasised the importance of Russia’s regions to the future of RussoBritish business relations. Mr Ozernov was next to speak. He gave a brief overview of the Ulyanovsk Region and warmly welcomed the audience to the presentation. This was followed by a presentation from the Region’s Minister for Strategic Development, Alexander Smekalin. Mr Smekalin detailed what he sees as the key areas for potential investment in the region, before underlining that the Ulyanovsk Region’s government is youthful, enthusiastic and ready to work with British companies. There followed a diverse assortment of presentations from companies working or planning to work in
Ulyanovsk. First, Dmitry Grishin, UK Sales Director at VolgaDnepr, gave a fascinating explanation of the company’s history. Founded in Ulyanovsk in 1990, VolgaDnepr has become the world leader in air cargo heavy lift, especially using the An124 “Ruslan”, the largest cargo aircraft in the world, which is built in Ulyanovsk Region. Darya Dunaeva, of Ulyanovskkurort JSC then spoke, before Brian Simpson, CEO of the Oxford Aviation Academy Group, explained his company’s plans to cooperate with the Ulyanovsk School of Higher Civil Aviation on a series of pilottraining schemes. A memorandum of understanding was then signed between the Ulyanovsk government, represented by Deputy Governor Ozernov, and the Oxford Aviation Academy Group, represented by Mr Simpson. In terms of both its contents and the public nature of the signing, this document is a clear example of the Ulyanovsk government’s commitment to offer the highest possible support for cooperation between local and British companies. The presentation was closed by Mr Ozernov, who expressed his delight at this chance to meet British companies interested in working in the Ulyanovsk region and offered the best possible reception for any who plan to visit.

On 27 March, the RBCC Moscow office held its annual conference on construction and real estate, as leading specialists in their chosen fields gathered for the conference. RBCC Director in Russia, Alan Thompson, opened the conference. Alan welcomed guests and then handed control of the first session over to Andrei Postnikov, Member of the
Board of Directors, Regional Director, Financial Markets and Investment, Jones Lang LaSalle Russia & CIS. Andrei gave a brief review of the key events and trends of 2011, focusing on the sphere of construction and real estate, and he also set the tone of the discussion, having prepared a number of topical issues for the speakers. One of the most significant developments in the area of urban development in the previous year was the wellknown extension of Moscow’s city limits, which immediately generated many discussions. Maxim Perov, VicePresident, Russian Union of Architects, presented an expert report and commentary on the issue, giving his own assessment on the ongoing changes. The mention of infrastructure development smoothly brought the debate to the speech of Evegeny Arbuzov, partner of the law firm, ART DE LEx, whose report was devoted to the development of publicprivate partnership in the area of infrastructure construction and the advantages and disadvantages of such projects. David Owens, Head of Project Management in Russia, Director of Communications in Europe at ARUP, completed a series of speeches on the construction industry. David’s presentation was focused on the restoration of historic buildings and was, perhaps, the most outstanding speech of all, culminating in loud applause. The panel of specialists on real estate chaired the second session. Maxim Gasiev, Managing Director,
Colliers International, Moscow, led the discussion on trends in this area. Mr Gasiev spoke about residential real estate, and discussed the questions surrounding its affordability: “Affordable housing: myth or reality?’’ Grigory Poltorak, President, Russian Guild of Realtors, President of BEST Real Estate tried to answer this difficult question. By the end of his presentation, Grigory led guests to the conclusion that affordable housing is a reality, if the authorities truly want it. Alexander Kopylov, former manager and director of a group which specialises in valuating real estate, “Ernst & Young’’, Moscow, presented his report on the topic, “The cluster mechanism of growth of the economy and realestate’’. Mr Kopylov spoke about the idea of a “cluster’’, citing examples of clusters in Russia and shared international experience of developing the infrastructure of realestate clusters. David Godchaux, Managing Director, NAI Becar Russia, finished the series of presentations in this session, talking about the investment attractiveness of Russia in the field of commercial real estate and the risks, which await investors in this sector. Александр Смекалин, Министр Ульяновской области по стратегическому развитию
работать в области, выступили со своими презентациями. Сначала Дмитрий Гришин, директор по продажам компании «ВолгаДнепр» в Великобритании, рассказал увлекательную историю компании. Основанная в Ульяновске в 1990 году, «ВолгаДнепр» стала мировым лидером в грузоперевозках, используя знаменитый самолет Ан124 «Руслан», самый большой грузовой самолет в мире, который был построен именно в Ульяновской области. Затем выступила Дарья Дунаева из ОАО «Ульяновсккурорт», а следом Брайан Симпсон, глава компании Oxford Aviation Academy Group осветил планы компании сотрудничать с Ульяновским высшим авиационным училищем по ряду программ подготовки пилотов. Меморандум о взаимопонимании был подписан между правительством Ульяновской области в лице гна Озернова и Oxford Aviation Academy Group в лице гна Симпсона. По своему содержанию и открытому характеру подписания этот документ дал явный пример готовности руководства Ульяновской области предоставить всю необходимую поддержку сотрудничеству местных и британских компаний. Он поприветствовал гостей и передал контроль над первой сессией в руки Андрея Постникова, Члена Совета Директоров, Регионального Директора, Финансовые рынки и инвестиции, Jones Lang LaSalle Russia & CIS. Андрей выступил с кратким обзором ключевых событий и тенденций 2011 года, так или иначе повлиявших на сферу строительства и недвижимости, а также задал острый тон дискуссии, подготовив для докладчиков ряд актуальных вопросов. Одним из наиболее значимых событий в области градостроительства в прошлом году стало известие о расширении границ Москвы. С экспертным докладом и комментариями по данному вопросу выступил Максим Перов, Вицепрезидент Союза архитекторов России, давший собственную оценку происходящим изменениям. Упоминание о развитии инфраструктуры плавно подвело ход дискуссии к выступлению Евгения Арбузова, Партнера юридической фирмы ART DE LEx, чей доклад был посвящен развитию государственночастного партнерства в области инфраструктурного строительства, преимуществах и недостатках подобных проектов. Завершил серию выступлений в сфере строительства Дэвид Оуэнс, Глава проектного менеджмента в России, Директор по коммуникациям в Европе компании ARUP. Презентация Дэвида была посвящена теме восстановления исторических зданий и стала, пожалуй, самой яркой, завершившись громкими аплодисментами.
Вторая сессия собрала за столом президиума специалистов по недвижимости. Руководил ходом обсуждения тенденций в данной области Максим Гасиев, Генеральный директор, Colliers International, Москва. Говоря о жилой недвижимости, нельзя не упомянуть так интересующий всех вопрос о его доступности. «Доступное жилье: миф или реальность?» – именно на этот нелегкий вопрос пытался ответить Григорий Полторак, Президент, Российская Гильдия Риэлторов, президент компании «БЕСТНедвижимость». В конце своего выступления Григорий подвел гостей к выводу, что доступное жилье – это реальность, если властям это действительно нужно. С докладом на тему «Кластерный механизм роста экономики и недвижимость» выступил
старший менеджер и руководитель группы по оказанию услуг по оценке недвижимости «Эрнст энд Янг», Москва, Александр Копылов. Он рассказал о понятии «кластер», привел примеры кластеров в России и поделился международным опытом развития инфраструктуры недвижимости кластеров. Завершил серию выступления в данной сессии Давид Годшо, Управляющий директор, NAI Becar Россия, рассказавший об инвестиционной привлекательности России в области коммерческой недвижимости и рисках, которых ожидают инвестора в данном сегменте. Russia's accession to the World Trade Organisation will lead to a substantial increase in foreign investments in two to three years’ time, Economic Development Minister Elvira Nabiullina said during a meeting with Prime Minister and PresidentElect Vladimir Putin. “We expect that joining the WTO, firstly, will make it possible to grow exports and to lower barriers to exports; secondly, it will make the conditions for raising foreign investment more attractive. It could be that that won't happen immediately, but we expect a trend like this in the next two or three years. Here the world financial situation will also have an influence – resources and investors evaluate risks depending on this situation," the minister said. Against a backdrop of overall capital outflow in 2011, the inflow of foreign direct investment in Russia was $52 billion – an increase compared to 2010, when volume ran to $4 billion, Nabiullina said. "In 2011 we returned to the 2007 level. In 2008 we had a rather big, record volume [$75 billion]. Oil prices were very high then, and there was a great deal of investment based on borrowing," she added.

Industrial production in Russia in February 2012 grew 6.5% against February 2011 and 0.6% against January (1.6% excluding the seasonal and calendar factors), reported the Federal Statistics Service. The biggest growth in February 2012 was seen in the production and distribution of electricity, gas and water – up 6.7% against February 2011.

Russia’s grain exports since 1 July 2011 have reached a record high figure of more than 21m metric tonnes and are likely to equal 26 million tonnes by 30 June, Dmitry Rylko, Director General of the Institute for Agricultural Market Studies (IKAR) told Interfax. According to IKAR’s preliminary forecasts, Russia’s 2012 gross grain harvest could reach “some 92 million tonnes,” which is less than in 2011 (93.9 million tonnes).

The Russian government’s debts on outstanding Eurobonds, the largest debt item, amounted to $29,183 billion as of 1 January 2012. Liabilities to international financial institutions stood at $2553 billion; Russian government’s liabilities to other official creditors equalled $1.448.
RussiatoBuildNuclearSpaceEngineby2017A Russian Megawattclass nuclear propulsion system for longrange manned spacecraft must be ready by 2017, Skolkovo Foundation's Nuclear Cluster head Denis Kovalevich said on Wednesday. “At present we are testing several types of fuel and later we will start drafting the design,” Kovalevich said. “The first parts [of the nuclear engine] should be built in 2013, and the engine is expected to be ready by 2017.” The engine is being developed for interplanetary manned spacecraft to ensure that Russia maintains a competitive edge in the space race, including the exploration of the Moon and Mars. The Russian government allocated 500 million roubles ($16.7 million) in 2010 to start a project to build a spacecraft with a nuclear engine. The overall investment in the project is estimated at 17 billion roubles (over $580 million) until 2019. According to Russia’s nuclear power agency Rosatom, the development and construction of a nuclear propulsion system for spacecraft will cost over 7.2 billion roubles ($247 million). NASA started a program to develop a nuclear propulsion system in 2003, and spent several hundred million dollars on the project before cutting funding. What were your impressions of your first trip to Russia? The visit was too brief but I did manage to walk through Red Square!
On a serious note, I have made several conclusions. Most importantly, I have seen what a busy visa operation we have in Moscow. It is our second biggest operation in the world, after Abu Dhabi, which is a hub for a number of other countries. This means that we issue a huge number of visas in Russia: last year the total was about 180,000. It is an important centre for us; we grant visas to 9596% of applications, which is a really high rate. That’s why it is also really important that we provide a good service, and I think we do.
I also met the Visa User Panel members and it was great to hear their feedback on various issues – for example, the amount of documentation, how long it takes to get a visa etc. I have now discovered that people don’t necessarily know about all of our various options, such as longterm visas, which I think we need to do more to tell people about.
At the RBCC reception which I attended, I got a sense of how much trade and travel there is between Russia and the UK, how important that is and therefore how important the visa service is in facilitating that trade and travel. Obviously, our service has to be consistent with our control and security standards: we do have to do necessary checks but we are open to ideas and suggestions about how we can improve this service.
What dynamics have you seen in business visas applications?2011 was a record year, and there has been a big increase already this year, so much so that we are well ahead of our forecasts. We are looking at bringing more resources in to enable us to keep meeting our service standards, which is 15 working days for visit visas. We are already working some weekends as well
as bringing in more staff from other regions. Last year saw an approximate 25% increase on the year before and we are already seeing a further increase this year.
The UK prides itself on being a special place for business. It’s a great financial headquarters here. London has so many natural advantages as a business location – its time zone position, for example. Clearly, we pride ourselves on being an open trading nation wanting to attract business, to bring in the brightest and the best. The government has a very clear policy to reduce the overall migration numbers and to tackle abuse but equally we want to attract legitimate visitors who will come for short periods to do business here. The system is designed so that the brightest and the best can come from around the world to work and study here.
What is your experience with the business express scheme (BEX) in Moscow?It works reasonably well at the moment but we’re now looking to expand that to other companies whilst we are working on the preparation of the Priority Visa service. It will replace the BEx eventually, but we’re still working on it. The priority visa service will be run along similar lines to the service which has been launched in St Petersburg as a pilot project, but it will be available across the whole of Russia. If the applicant chooses to pay for the service, once the application comes to us it will go to the front of the queue. Plans to introduce the threeday business visa are part of the priority scheme and details of that are still being finalised.
I’d like to make a point here to regular business travellers about the existing benefits. We issue two, five and 10year multientry visas which allow you to travel frequently without the constant hassle of renewing your visa every time. Obviously, we charge more for those visas and it’s necessary to comply with the purposes of which the visa was issued. Nonetheless, for frequent business travellers it eliminates the anxiety of getting a visa in time for your flight if you are suddenly called for an urgent meeting. One of the things I have been told is that Russians are quite impulsive. Last minute decisions are a usual thing, and so for people in a very fastpaced world where they need to be very flexible, a longterm visa is a very good option.

Visa issues will never lose their relevance in the business community (as well for other groups of travellers). The success of the visa service is, in a sense, a barometer of the intensity of the business contacts between Russia and Great Britain. We at the Russo-British Chamber of Commerce try to keep our finger on the pulse and inform the Chamber’s members about the latest changes to British and Russian visas. From a conversation with Jonathan Sedgwick, the head of international group at UK Border Agency, we discovered that many people, who are applying for a British visa, don’t know about the existing services available for the convenience of frequent business travellers.

These visas do take a bit longer to process – about 30 working days – so we offer a special service for the submission of your passport, so that people can have their passports back whilst the application is being processed. Additionally, there is no requirement to get the visa transferred into a new passport if the passport expires during its legitimacy.
I can’t help but ask you about last summer when we had huge difficulties in Russia, in Moscow at least, with getting visas. What was the reason for such a back-log? As I said, we had a record year in 2011 in the number of applications, let alone the seasonal upsurge. We work very hard to plan our work, to understand what the demand is likely to be, to make sure we’ve got the resources there to meet it. Sometimes the demand is higher than expected and sometimes it comes sooner than expected. I think that was the case in Moscow last year. The growth was so significant that as a result we did fall behind, and in a busy period, it’s quite hard to catch up afterwards. That is why we are redoubling our efforts this year: we have recruited four new longterm staff in Moscow and we will bring in some temporary staff from the regions.
Was this situation also caused by the general budget cuts in the UK? Did you suffer at all from these cuts?We have reduced the number of staff around the world but we have also made our processes more efficient, both technically and in numbers. We’ve just closed a number of smaller posts and moved staff into what we call ‘hubs’ in some places and that works very well because you have bigger teams taking in a number of countries and you can manage the peaks and troughs of different countries a bit better. You can be more flexible with your resources and that enables you to plan and to cope with upsurges better. It’s really about how good we are at making our projections.
What are your expectations of the Olympics year?We are expecting significant growth and we are providing for that. One of the difficulties we face is being able to react quickly to unexpected increases in demand. Last year we did bring additional staff into Russia to help meet the demand but it took time to get them in place. This year, we’ve already got staff waiting in the wings in other posts in the region should we need to call them.
As for the Olympic families, they don’t need to apply for a visa but we do need to do a biometric (fingerprints and photograph) check on them. So, we are working very hard with the sporting authorities in Moscow to identify Olympic family members. When I was in Moscow, there was an event at the Embassy where we had a unique biometric enrolling kit, so that Olympic family members could come and have a drink at the Embassy and enrol their biometrics at the same time.
In regard to others who want to attend the Olympics, I would say it is sensible to apply for your visa early. Russia is
one of two global markets where, for 2012, we have introduced a facility where applicants can apply up to six months before their date of travel.
Will applicants going to the Olympics be given any sort of pri-ority compared to others? Not if they are going as spectators; they may mention this in the visa application form but we deal with applications in order of the date received.
Are you planning any major changes to the technical side of applying for a visa? We have introduced mandatory online payments, so the individual or representative has to go online and pay the visa application fee before making the appointment. That has worked very well, and we think it has been very beneficial because we used to have significant numbers of noshows for slots at the visa application centres and biometric centres. It was a waste of our time, and it meant that people who did want to come for an appointment couldn’t get a slot when, in fact, there were lots of them. Requiring people to make their own appointment and pay immediately has resulted in far fewer noshows, which is a great improvement.
Have you seen big changes in the visa category for investors? There have been some fairly big changes. Last year some of the thresholds were reduced, making it faster and easier to move to settlement for investors and entrepreneurs who were coming in with specific amounts of investment. We were keen to use both the investors and entrepreneurs routes more, as part of the range of visas that we offer, and as a result, we’ve seen a growth in the number of those coming to the UK, Russians in particular.
Obviously, people travel as part of their work for big multi-nationals but for us, it’s especially interesting to see what kinds of people arrive and set up a business of their own. People would normally have to tell us about their business plans as part of applying for the visa. If someone was coming to set up a business in the UK then a business visa is not suitable for that purpose. They would have to come under the entrepreneur route in line with our pointsbased system and show they’ve got a certain amount to invest, that they are coming to establish a business that will provide work etc.
Would you say that the UKBA has any special Russia-tailored solutions?Giving passports back during the application process for certain applicants is a special service that we do exclusively in Russia. Additionally, you have to apply for a visa with us in English but there’s a special Russian microsite – one of the few translated microsites – which provides information about the application in English. It’s partly in recognition of how important the Russian market is to us. It’s not in our interests to make life difficult for genuine business travellers. The more ways we can find to make life easier, that are still consistent with our necessary checks, the better for everyone. Какова динамика заявлений в категории деловых виз?Прошедший 2011 год стал для нас рекордным, и уже в этом году мы получаем значительно больше заявлений, чем мы ожидали, так что мы опережаем прогноз. Предполагается, что такая система будет привлекать лучших специалистов со всего мира приезжать учиться и работать в Великобритании.
Как складывается опыт работы по схеме Business Express в Москве?Эта схема неплохо работает на данный момент, но мы не планируем расширять ее, принимая новые компании, поскольку уже идет подготовка услуги Priority Visa. Со временем она заменит ВЕХ, но пока находится в разработке. Эта услуга будет похожа на ту, которую мы уже запустили в Петербурге в порядке пилотного проекта, но в будущем она будет доступна по всей России. Пакет документов клиентов по программе Priority Visa будет рассматриваться в приоритетном порядке. План по внедрению услуги оформления визы за три дня является частью этой схемы, но детали еще дорабатываются.
Я также хочу подчеркнуть ряд возможностей для тех, кто часто ездит в Великобританию. Мы оформляем мультивизы на 2, 5 и 10 лет, которые позволяют вам часто путешествовать, не тратя каждый раз время на оформление новой визы. Конечно, они и стоят дороже обычной визы, и необходимо проходить все те же процедуры безопасности, но для этого и существует визовая система. Успешность визовых служб является в определенном смысле барометром интенсивности дело-вых контактом между Россией и Великобританией. Мы в Российско-британской торговой палате стараемся держать руку на пульсе и информировать членов палаты о последних изменениях в системе оформления бри-танской и российской виз. Из разговора с главой международной группы Пограничного Агентства Великобри-тании (UK Border Agency) Джонатаном Седжвиком выяснилось, что многие, оформляя британскую визу, не знают о уже имеющихся услугах для удобства часто путешествующих деловых людей.

Не могу не спросить Вас о проблемах, которые возникли в России в Москве прошлым летом. Почему происходили такие задержки с оформлением виз?Как я уже сказал, 2011 год стал рекордным по количеству заявлений, не говоря уже о сезонном увеличении потока заявлений. Мы стараемся лучше планировать свою работу, заранее оценивать возможный спрос на услуги, чтобы обеспечить необходимые ресурсы для его обслуживания. Иногда спрос выше и порой начинает расти раньше ожидаемого времени. Я думаю, именно это случилось в Москве в прошлом году. Рост был настолько большим, что мы не успевали обрабатывать документы в срок, а в высокий сезон с таким отставанием очень сложно справиться. Именно поэтому мы прикладываем особые усилия в этом году, привлекая дополнительные кадры в Москву на длительный срок, а также сотрудников из регионов на срочную работу в столице.
Можно ли сказать, что такую ситуацию также спровоциро-вали и бюджетные сокращения в Великобритании? Вы ощутили эти сокращения?Нам пришлось сократить штат по всему миру, но мы также оптимизировали работу и с технической точки зрения и в плане необходимых кадров. Мы только что закрыли ряд небольших позиций и перевели сотрудников в офисы, которые служат «хабами» для нескольких стран. Это удобно, поскольку расширенная команда позволяет лучше справляться с пиковыми колебаниями спроса. Можно более гибко распоряжаться имеющимися ресурсами, что позволяет планировать работу лучше. В конечном итоге, все дело в том, насколько хорошо мы можем прогнозировать спрос.
Какие у Вас ожидания от Олимпийского года?Я думаю, рост оборота будет значительным, и мы к нему готовимся. В прошлом году мы привлекли дополнительные кадры в Россию, чтобы справиться с внезапно и сильно возросшим спросом, но это заняло много времени. В этом году мы уже подготовили необходимые мощности в регионах, на случай, если они потребуются позже.
Что касается олимпийцев, им не нужно оформлять визу, но им придется все равно пройти проверку биометрических данных. Мы плотно работаем со спортивными властями в Москве, чтобы определить список участников Олимпиады. Когда я был в Москве в декабре, Посольство организовало мероприятие, на которое было предоставлено оборудование для обработки биометрических данных, так чтобы члены олимпийской семьи могли прийти на прием в Посольство и одновременно пройти биометрическую проверку.
Что касается всех остальных, кто хочет поехать на Олимпиаду, я бы посоветовал подавать документы для оформления визы как можно скорее. Россия – один из двух глобальных рынков, где на 2012 год мы ввели опцию подачи документов за 6 месяцев до поездки.
Будут ли те, кто едет на Олимпиаду, обладать неким преи-муществом перед всеми остальными?
Нет, если они едут как зрители; то есть можно уточнить цель визита в визовом заявлении, но рассматриваться они будут в порядке общей очереди.
Планируются ли какие либо изменения в технической сто-роне подачи заявления о выдаче визы?Мы ввели систему обязательной онлайноплаты услуг, поэтому любой аппликант может оплатить визу на сайте перед тем, как назначить визит в визовый центр. Эта услуга дала прекрасный результат, потому что раньше часто случалось так, что люди не являлись в ими самими назначенное время. В итоге, это превращалось в трату времени для нас и для тех, кто не смог назначить свой визит в визовый центр, так как не было свободных «окон», хотя на самом деле времени было очень много. Теперь ввиду необходимости оплатить визовые услуги заранее при назначении визита в визовый центр, люди гораздо реже пропускают его, что без сомнения улучшило эффективность нашей работы.
Какие изменения претерпела категория визы для инвесторов?Произошли большие изменения. В прошлом году мы сняли ряд барьеров для инвесторов, что упростило и ускорило для инвесторов и бизнесменов процедуру привнесения капитала в Великобританию. В спектре визовых услуг, которые мы оказываем, мы решили сделать особенный акцент на этой категории, в результате, количество инвесторов и предпринимателей, приезжающих работать в страну, увеличилось, и среди них немало русских.
Очевидно, что многие приезжающие в Великобританию рабо-тают в крупных международных корпорациях, но нам осо-бенно интересны те, кто приезжает открывать свой бизнес.Как правило, люди сообщают нам о таких намерениях в заявлении о выдаче визы. Но для открытия бизнеса в Великобритании деловая виза не подходит. Необходимо оформлять визу по категории предприниматель в соответствии с нашей системой баллов, и доказать, что у заявителя есть необходимые средства для инвестирования, и что предполагаемый новый бизнес откроет рабочие места и т.п.
Можно ли сказать, что у UKBA есть особые решения именно для российского рынка?Надо отметить, что возможность забрать паспорт – особая услуга, доступная только в России. Кроме того, вы подаете заявление на английском языке, но есть специальный микросайт на русском – один из немногих переведенных подобных микросайтов! – представляющий информацию по процедуре ее заполнения на русском. В определенном смысле это признание того, как нам важен русский рынок. Не в наших интересах усложнять жизнь деловым людям. Чем больше путей мы найдем упростить им процесс получения визы, отвечающие при этом нашим стандартам безопасности, тем лучше для всех. Поэтому я бы хотел предложить Вашим партнерам поделиться с нами идеями таких путей, а мы передадим их рабочей группы панели по визовым вопросам в британском Посольстве.

At the beginning of 2012, holding group Interros created the company Interport in order to consolidate and manage assets in the
transport and logistics sphere, and also in order to construct new loading infrastructure at airports. Currently, cargo terminals at Shermetyevo (Moscow) and Yemelyanovo (Krasnoyarsk) are the main areas of emphasis in the Interros project. Under the management of Interport, an operator and developer of the cargo complex which is made up of a transfer warehouse and terminal, totalling more than 21,000 sq m, will be installed in Sheremetevo. In Krasnoyarsk, under the
MC, Interport was transferred using one of the largest loading terminals in Siberia and the Far East. It comprises an area of 23,000 sq m and includes a warehouse and office units with a total area of 10,300 sq m.
Interport is aiming to take over a large percentage of the cargo market, currently flying through Russian airspace. Both airports have the chance to become a cargo hub of global importance. Now, around 12% of all cargo transported in Russia by aeroplane is processed in Interport’s terminals in Moscow and Krasnoyarsk. Interport plans to develop its business and occupy 15% of the Russian market by increasing its presence in the general cargo sector. It is estimated that in the Moscow junction point, this share will increase by 50% in the next three years, and by 90% in the Siberian market.
Apart from this, the land service operators used by Interport in Moscow and in Krasnoyarsk will use stateoftheart technology for processing cargo with powerful automatic processes. Additionally, the standards of electronic technology efreight, implemented by means of huge cargodeliveries in airports around the world, allow technological hubs in airports and quality control systems which are equivalent to the best Western counterparts. Accordingly, the implementation of the Interport projects in Yemelyanovo and Shermetyevo is dependent on the development of Russia’s transit potential and the implementation of the RF Transport strategy, which gives the opportunity to put integration into practice in the global economic sphere.
Nevertheless, when it comes to a multiple increase in the growth of freight flow in Russia today, the main factor to consider is the possibility for a
protracted reduction in aviation powers in various countries in accordance with the international agreement, which regulates the activity of air transport service workers.
In Yemelyanovo, for example, permission to land for foreign air transport service companies without transit money is only possible if changes are made to the intergovernmental agreement with the relevant countries. This process will take at least two years, but business can and is ready to work at full strength even today.
At the beginning, profits will allow technical embarkation of airlines in the airport: every daily cargo flight yields around $70,000. The potential demand of international airfreight companies, through Yemelyanovo, is 3,500 flights a year. It is also possible to earn around $245 million a year on top of this. If a foreign airline receives absolute freedom, then the effect will be considerably larger: cargo traffic at Yemelyanovo may increase tenfold to 200,000 tonnes a year. There are plans to increase the size of the work load to one million tonnes a year by 2030 at Sheremetyuevo. The cargo hub being created at the airport base ‘’Shermetyevo’’ will become the leading cargo complex of Eastern Europe. According to the prognosis of the international association of air transport (IATA), dead loss of European air carriers this year could total $600 million, operative profitability – 0.3%. The aviation industry in Europe incurs considerable losses due to taxation, increasing gas prices worldwide, and introduction of systems of commerce quotas on emission of carbon dioxide. The Russian air cargo market is only just emerging but it has a bright future; having joined the WTO, Russia will have to stop charging foreign air companies royalties for flying over its territory, giving the transit air cargo market the push it needed, thereby creating the main cargo flow. Today, approximately 70-80% of all world-wide cargo transfer is concentrated on the two biggest routes of air service: Europe-South-East Asia and Europe-America. The volume of air service between South-East Asia and Europe is around 40 million tonnes of cargo a year, but at the same time, all Russian freight traffic (airborne cargo) counts for less than one million tonnes a year.

Interros holding company, explained in more detail the challenges that Russian airport infrastructure faces.
Why did the idea of cargo hubs only gain traction now and not, let’s say, in the pre-crisis years? Was the main impetus the prospect of joining the WTO?As paradoxical as it seems in a country as large as Russia, aviation and airport infrastructure has not been a priority over the last 20 years and currently it is lagging behind in terms of development, in contrast to other sectors of transport infrastructure. The country’s largest passenger carriers (Aeroflot, Transaero, and so on) were created on the basis of Soviet, central and regional airlines. In the cargo market segment, the main player is still AirBridge Cargo (VolgaDnepr group). This corporate group has become the leading company in Russia and one of the biggest groups in the world. The Russian civil aviation industry could not meet the demands of the market and our airlines started to use foreign fleet. They fly long and medium haul Boeing or Airbus, shorthaul is also starting to be available on foreign planes. But in contrast with the first two segments, regional service was unprofitable for a long time, because there wasn’t enough purchasing power on the part of consumers to fit regional airline fleets with the modern facilities available. Consequently, there was no demand for modern airport infrastructure in the regions.
We inherited the existing infrastructure from the Soviet times, and generally, up until now, only airports with large cargo or passenger flow have been developed. Only in the last 5 years have regional airlines started to grow, starting a direct service between cities. Now
the growth of passenger flow is increasing, showing that solvent demand has emerged and that there are companies which can provide such services.
As far as the cargo traffic is concerned, it is still quite low overall. Moreover, tens of millions of cargo a year are flown around Russian airspace because our government prioritised the protection of local air carriers through bilateral agreements. Another ‘’Soviet relic’’ is a system of royalties, which Russia should abandon in the next two years due to the framework of WTO membership but it doesn’t automatically lead to “open skies” for foreign airlines. The position of the government as represented by the Ministry of Transport is that if an airline wants to fly in the Russian Federation or land on its territory, then they must contact the corresponding air authorities in their own country which is turn must contact the air authorities in Russia with their own request. This is then followed by negotiations between the two aviation authorities of both countries until it is decided whether to grant permission or not, and what each party receives as a result.
But the negotiation process has already begun?It has, but, to use an example, as a result of the recent intergovernmental commission with Germany, German air carriers have now lost the few rights they had before. This all stems from the fact that the European Commission recently passed a law to bring in ecological standards which force air carriers travelling through Europe to pay taxes on emissions. This is the result of several years of discussion and lobbying by the green movement which is very strong in
Europe and has a lot of political weight. Other countries are unhappy with the decision, seeing it as a violation of international regulations.
The Ministry of Transport has taken a rather firm stance. Lufthansa has a route across Krasnoyarsk and there was talk of offering them the chance to make technical stopovers and to give them commercial rights upon Russia’s entry into the WTO. This would allow the airport to make use of the modern infrastructure which already exists there. As a result, the airline will now be making 19 flights a week instead of 40. This amounts to a loss of $20 million dollars which Yemelyanovo will no longer receive as a result of the harsh punitive measures taken by the government. However, the new European tax is not anywhere near as catastrophic for companies such as Aeroflot.
The financial damage can most likely be covered by the increase in air traffic.This can be done by either an increase in traffic or by more subtle countermeasures on the part of the government. We believe that the defence of national airlines should not involve sacrificing an airport into which $300 million has already been invested. When the federal principal programme for the development of Yemelyanovo airport came into place, we discussed our plans to build an international transport hub in Krasnoyarsk which is a convenient transit point for cargo on its way from Europe to China or Southeast Europe. It will be in demand from both Russian and foreign air companies. The authorities have talked of the need to develop the region and attract private investment. It now seems that private capital is building the infrastructure while the increase in the stream of cargo which is essential for further development is not taking place because we are punishing Europe for the tax they introduced.
For countries as large as Russia, are two hubs enough? Are there plans to expand the network of hubs in the future?At the moment, only a very small amount of cargo passes through Sheremetyevo – less than 300,000 tonnes a year. Less than 500,000 tonnes a year pass through the whole Moscow junction point, and this is the largest cargo hub in the country. year, roughly the same amount as passes through our entire country. In the future, Interport may also include other airports. There are also other players in the business, such as Renova which is building an airport in Yekaterinburg, Novoport which is building an airport in Novosibirsk; Gruppa Alyans have gone to Khabarovsk and Vladivostok. In Moscow the picture is more complicated since Domodedovo is privately owned and the ownership structure of Vnukovo also includes private partners, while Sheremetyevo is owned by the state. Clearly the business world has realised that this sector is potentially very profitable. In time we will see whether it is the size of these market players which increases or their degree of specialisation; for example, some of them deal with cargo terminals throughout the country, some of them with filling stations, etc.
Is there a place for foreign capital in this infrastructure project?Foreign capital has not yet been invested into the construction project but foreign companies with a wide range of experience offering highquality service have been invited to manage the airports or separate parts of the latter. For example, the South Korean company Incheon International Airport Corporation will take over management of Khabarovsk airport. Our partner in the Moscow airport is the company Servisair which already manages several airports in Europe.
What is happening in Vladivostok? In recent years, this city has been prepar-ing for the APEC summit. They have built a new passenger terminal with a capacity volume based on the estimate that more than one million passengers will be passing through. Then the new infrastructure will pay off. The problem is that at the moment the flow of passengers and cargo is relatively small and conditions need to be created for the air companies to work, so that they continue to fly there even after the APEC summit. During discussions on how to load Vladivostok airport, giving it an “open skies” regime was also discussed. However, this clashed with the arguments from the Ministry of Transport that “opening” the sky can only be done on a bilateral basis, even if the right for transit flights provided by the other side is not essential to
us in the shortterm. We need to consider what is profitable to us as a country: to gain this – currently superfluous – right, or to load up an airport which has already been built. We should also remember that this is not simply a matter of “winning back” the invested funds, it is also about solving socioeconomic problems. In cities such as Vladivostok, young skilled workers are leaving in search of employment elsewhere and this international hub could create the necessary jobs.
Is there any chance of compromise in such a situation?We understand that Europe is looking after its own interests and that Russian officials are defending their interests. But the Soviet system of intergovernmental agreements is slowing down the development of a potentially very lucrative industry, which is why we are suggesting that the Ministry of Transport has a selective open sky policy. It is reasonable to support the major Russian airlines which have created a large passenger flow in recent years. However, when it comes to cargo transportation we do not face any competition: AirBridge Cargo, despite its scale, is unable to cover all the cargo transportation in the world. We can assign a select number of destinations to the company and defend its interests by means of the intergovernmental agreements; other routes can be opened up for interested foreign companies.
Do you have any estimates of the poten-tial economic effect?According to our calculations, the new hub in Krasnoyarsk could attract an additional 200,000 tonnes of freight flow a year. About 2000 jobs will be created and the airport and its operators could earn over 7 billion roubles. Tax and duties revenues to the budgets at all levels could reach 1.5 billion roubles. The indirect benefits stemming from the development around airport activity could double these indicators. Besides, we need to remember that we are creating a new sort of business for Russia. We have learnt how to trade in natural resources and it’s no rocket science charging airlines flying over the country. But creating a modern, international, cargo transport hub – this is a much more ambitious project. In order to attract international companies, it is not enough to build a cargo terminal; we need to fill it with advanced technology as well.
Which sort of technology?Technology used around the world but adapted to Russia; for example, in order to work with international companies you need an efreight system which can be used worldwide. In order to work with foreign airlines you need to carry out an audit to ensure that laws on the servicing of airplanes are met. This includes infrastructure, skilled workers with the relevant qualifications, software, culture, quality of service, etc. By succeeding in the above categories, our business will be able to compete for worldwide cargo flow
In Krasnoyarsk, we have built a new terminal but we are unable to fit it with the latest technology because it is not essential until there is an increase in the volume of cargo turnover. For example, using Interport’s capacity, less than 100,000 tonnes of cargo a year can pass into Sheremetyevo. In order to introduce new technology we will have to double this number not only for the imported cargo processed there but also for transferred cargo which is being sent to other countries through Russia.
If it were possible for both parties to reach a compromise, how would you go on from there? We are already working “in advance”. The terminal in Krasnoyarsk has been built and we have reconstructed the old Aeroflot terminals at Sheremetyevo and are beginning construction of a new large cargo terminal there this year. We are teaching people, working with current clients and also discussing the fact that this has not been calculated on the same tens of thousands of tonnes of cargo being turned over at the moment but rather on those hundreds and millions of tonnes which we know how to bring into the country and how to process. So far this business has been a “byproduct” and now it is obvious that it is worthy of becoming independent, bringing in a large income and even becoming the driver of regional growth. If it succeeds in increasing the turnover of cargo to the necessary amount as a result of selectively “open skies”, then we can be assured that it would be profitable for both the business and the state to replicate this experience inside the country and attract investment capital and technology.

В настоящее время опорными точками проекта «Интерроса» являются грузовые терминалы аэропортов «Шереметьево» (Москва) и «Емельяново» (Красноярск). Под управлением «Интерпорта» в аэропорту «Шереметьево» находятся: оператор и девелопер грузового комплекса, состоящего из трансферного склада и терминала площадью свыше 21000 кв.м. В Красноярске под управление УК «Интерпорт» перешла компания, эксплуатирующая один из крупнейших в Сибири и на Дальнем Востоке грузовой терминал. Он расположен на территории в 23 000 кв. м и включает в себя складские и офисные помещения общей площадью 10 300 кв. м.
«Интерпорт» претендует на определенную долю грузов, которые сегодня летают в обход России. В перспективе у обоих аэропортов есть шансы стать грузовыми хабами международ
ного масштаба. Сейчас в терминалах «Интерпорта» в Москве и Красноярске обрабатывается порядка 12% всех грузов, перевозимых в России авиатранспортом. «Интерпорт» планирует развивать бизнес и занять 15% российского рынка с учетом роста общего грузооборота. Предполагается, что в московском авиаузле эта доля в ближайшие три года вырастет до 50%, а в Сибирском регионе – до 90%.
Кроме этого, операторы наземного обслуживания, которыми «Интерпорт» управляет в Москве и Красноярске, будут использовать современные технологии обработки грузов с большой степенью автоматизации процесса, а также стандарты электронной технологии efreight, внедренной в крупнейших грузовых аэропортах мира. Это позволит ввести хабовые технологии в аэропортах и систему контроля качества, соответствующую лучшим западным аналогам.
Таким образом, реализация проекта «Интерпорт» в «Емельяново» и «Шереметьево», направленная на развитие транзитного потенциала России и воплощения в жизнь Транспортной стратегии РФ, может способствовать интеграции страны в мировое экономическое пространство. Но сдерживающим фактором увеличения кратного роста грузопотока в России сегодня является отсроченная перспектива приведения в соответствие авиационными властями разных стран межправительственных соглашений, регулирующих деятельность авиаперевозчиков.
Разрешение посадки для иностранных авиаперевозчиков без уплаты пролетных денег, например, в «Емельяново» возможно только после внесения изменений в межпра
вительственное соглашение с соответствующей страной. На это уйдет минимум 2 года, в то время как бизнес может и готов работать в полную силу уже сегодня.
На начальном этапе прибыль принесет и техническая посадка авиакомпаний в аэропорту: каждый ежедневный грузовой рейс даст около $70 000. Потенциальный спрос на полеты зарубежных авиакомпаний, например, через «Емельяново» – 3500 рейсов в год, дополнительно можно заработать около $245 миллионов в год. Если иностранные авиакомпании получат полную свободу, то эффект будет гораздо выше: грузовой трафик «Емельяново» может вырасти в 10 раз до 200 000 тонн в год. В «Шереметьево» до 2030 года планируется увеличить объем обрабатываемого груза до 1 миллиона тонн в год, поэтому грузовой хаб, созданный на базе аэропорта «Шереметьево», станет ведущим грузовым комплексом Восточной Европы.
По прогнозам международной ассоциации воздушного транспорта (IATA),чистый убыток европейских авиаперевозчиков в этом году может составить $600 миллионов, операционная прибыльность – 0,3%. Авиационная отрасль Европы несет значительные потери изза налогообложения, мирового роста цен на нефть и введения системы торговли квотами на выбросы углекислым газом. В этой связи транзитные перевозки через Россию для многих иностранных авиаперевозчиков представляются очень привлекательными.

Рынок грузовых авиаперевозок в России только формируется, но он имеет большие перспективы: вступив в ВТО, Россия должна будет отказаться от платы иностранных авиакомпаний за пролет над своей территорией (роялти), что даст толчок рынку транзитных грузовых авиаперевозок, а именно они создают основной грузопо-ток. Сегодня примерно 70-80% всего мирового грузооборота сосредоточено на 2-х самых крупных маршрутах грузовых авиаперевозок: Европа – Юго-Восточная Азия и Европа – Америка. Объем авиаперевозок между Юго-Восточной Азией и Европой составляет порядка 40 миллионов тонн грузов в год, в то время как весь грузооборот России (грузов, перевозимых по воздуху) насчитывает меньше 1 миллиона тонн в год.

Почему идея создания грузовых хабов получила развитие только сейчас, а не, скажем, в докризисные годы? Основным толчком послужила пер-спектива вступления в ВТО?Как ни парадоксально, в такой огромной стране, как Россия, авиация и аэропортовая инфраструктура последние лет 20 находились не в приоритете и в настоящее время сильно запаздывают с развитием, в отличие от остальных отраслей транспортной инфраструктуры. Крупнейшие пассажирские авиаперевозчики страны («Аэрофлот», «Трансаэро» и др.) были созданы еще на базе советских центральных и региональных авиакомпаний. В сегменте грузовых перевозок главным игроком остался AirBridge Cargo («ВолгаДнепр»). Эта группа компаний стала ведущей компанией в России и одной из крупнейших в мире. Российский гражданский авиапром не смог ответить требованиям рынка, и наши авиакомпании перешли на иностранный авиапарк. Они летают дальне и среднемагистральными самолетами Boeing или Airbus, ближнемагистральные сейчас тоже начинают замещаться иностранными самолетами. Но в отличие от первых двух сегментов, региональные перевозки долго были нерентабельны, так как не было достаточного платежеспособного спроса потребителей, чтобы региональные авиакомпании заполнили имеющиеся мощности современным авиапарком. Соответственно, не было и спроса на современную аэропортовую инфраструктуру в регионах.
Имеющаяся инфраструктура досталась нам в наследство от советских времен, и до сих пор в основном развивались те аэропорты, где есть большой грузовой или пассажирский поток. И лишь последние 5 лет активизировались региональные авиакомпании, начались прямые перевозки между городами. Сейчас рост пассажиропотока растет, то есть появился платежеспособный спрос и есть компании, которые могут предоставлять такие услуги.
Что касается внутреннего грузопотока, он в целом в стране попрежнему очень невысокий. При этом десятки миллионов грузов в год летают в обход России, так как наше правительство выбрало приоритетом
защиту местного авиаперевозчика в режиме двусторонних договоров. Другим «советским рудиментом» является система роялти, от которой Россия должна отказаться в течение двух лет в рамках вступления в ВТО, но автоматически это не приведет к «открытию» неба для иностранных авиакомпаний. Позиция государства в лице Минтранса такова, что если какаято авиакомпания хочет летать над РФ или делать посадку на территории РФ, она должна обратиться в соответствующие авиационные инстанции в своей стране, которые в свою очередь должны обратиться к авиационным властям России с соответствующим запросом. Далее следуют переговоры авиационных властей двух стран по поводу того, кому разрешить летать и что каждая из сторон в результате получает.
Но процесс переговоров уже начался?Да, но, например, в результате недавней межправительственной комиссии с Германией, немецкие авиаперевозчики лишились даже тех прав, которые у них были. Дело в том, что Еврокомиссия недавно приняла закон, который вводит экологические стандарты, обязывающие авиаперевозчиков, следующих через Европу, платить налог на выбросы. Это результат дискуссий и лобби нескольких лет зеленого движения, которое в Европе очень сильно и имеет политический вес. Недовольны и другие страны, усматривая в этом шаге нарушение мировых авиапорядков.
Позиция Минтранса достаточно жесткая. Например, Lufthansa летала через Красноярск, и речь шла уже о том, чтобы с вступлением в ВТО не только дать им возможность делать технические остановки, но и дать коммерческие права, позволяя, таким образом, аэропорту использовать ту современную инфраструктуру, которая там уже существует. В итоге, авиакомпания вместо 40 будет делать 19 рейсов в неделю. Прямой убыток – $20 миллионов, которые недополучает аэропорт «Емельяново» в результате ответных запретительных мер государства. Кстати, сама сумма европейского налога далеко не катастрофична для такой компании, как, например, «Аэрофлот».
И финансовый урон наверняка можно покрыть увеличенным трафиком.Либо увеличенным трафиком, либо адекватными, но более тонкими контрмерами со стороны государства. Мы считаем, что защита отечественных авиакомпаний не должна оборачиваться ущербом аэропорту, в который уже вложено $300 миллионов. Когда принималась федеральная целевая программа по развитию аэропорта «Емельяново», мы говорили о том, что планируем построить международный транспортный хаб в Красноярске, так как это удобный транзитный пункт для грузов на пути из Европы в Китай и ЮгоВосточную Азию, он будет востребован и российскими, и иностранными авиакомпаниями. Власти говорили о необходимости развивать регион, привлекать частные инвестиции. Теперь получается, что частный капитал за свои деньги строит инфраструктуру, а роста грузопотока, который необходим для ее дальнейшего развития, не происходит, потому что мы наказываем Европу за односторонне введенный налог.
Для страны таких масштабов, как Россия, все же мало двух хабов. Есть ли планы расширять сеть хабов в будущем? Пока через все Шереметьево идет очень маленький объем грузов – меньше 300 000 тонн в год, весь московский узел – меньше 500 000 тонн в год, и это самый крупный грузовой хаб страны. Для сравнения, аэропорт Дубаи сегодня обрабатывает в год больше миллиона тонн грузов, а у нас примерно столько приходится на всю страну. Но в будущем, в «Интерпорт» могут быть включены и другие аэропорты. А вообще в этом бизнесе сейчас есть такие игроки, как «Ренова» – строит аэропорт в Екатеринбурге, «Новопорт» в Новосибирске, «Альянсгруппа» пошла в Хабаровск и Владивосток. В Москве более сложная картина, так как «Домодедово» – частный аэропорт, структура владения «Внуково» также включает частных партнеров, «Шереметьево» – государственный аэропорт. Но очевидно, что бизнес увидел в этой отрасли прибыльную возможность для себя. Далее будет происходить

либо укрупнение этих игроков, либо их специализация: например, ктото может заниматься грузовыми терминалами во всей стране, ктото – топливнозаправочными станциями и т.п.
В этом инфраструктурном проекте есть место иностранному капиталу?Иностранный капитал пока не инвестирует в строительство, но иностранные компании с широким опытом качественного сервиса уже приглашаются на управление аэропортами, либо их отдельными частями. Например, ЮжноКорейская компания Incheon International Airport Corporation займется управлением аэропортом Хабаровска. Наш партнер в аэропорте «Москва» – компания Servisair, которая управляет несколькими аэропортами в Европе.
А что происходит во Владивостоке? Этот город активно готовили послед-ние годы к саммиту АТЭС.Там построили новый пассажирский терминал, пропускная емкость которого рассчитана на то, что туда будут летать более миллиона пассажиров, тогда новая инфраструктура окупится. Проблема в том, что там сейчас нет большого потока ни пассажиров, ни грузов, и надо создать условия для работы авиакомпаний, чтобы они туда полетели и после саммита АТЭС. Кстати, когда обсуждалось, как загрузить аэропорт Владивостока, речь также шла о предоставлении ему режима «открытого неба». Но все натолкнулось на те же доводы Минтранса, что «открывать» небо надо только на двухсторонней основе, даже если предоставляемое другой стороной право транзитного пролета, возможно, пока и ненужное нам в краткосрочной перспективе. Надо всетаки посчитать, что нам выгодно, как стране: получить это ненужное пока право или загрузить уже построенный аэропорт. При этом надо понимать, что это не просто «отбивка» вложенных средств, это еще и решение социальноэкономических задач. В таких городах, как Владивосток, есть проблема утечки молодых кадров в поисках занятости, а международный хаб смог бы создать необходимые рабочие места.
Есть ли какие-то возможности ком-промисса в такой ситуации?Мы понимаем, что Европа блюдет свои интересы, а российские чиновники защищают интересы нашей страны. Но советская система межправительственных соглашений тормозит развитие потенциально очень прибыльной отрасли, поэтому мы предлагаем Минтрансу открыть небо выборочно. Резонно оказывать поддержку крупным российским авиакомпаниям, которые за последние годы развили большой пассажиропоток. Но в грузоперевозках у нас нет конкурентов: AirBridge Cargo, несмотря на свой масштаб, все грузовые перевозки в мире не закроет. Можно выделить для нее определенные направления, на которых механизмом межправительственных соглашений можно будет ее защищать, а остальные маршруты открыть для заинтересованных иностранных компаний.
У Вас уже есть подсчеты по потенци-альному экономическому эффекту?По нашим оценкам, создание хаба в Красноярске может привлечь дополнительно 200 тысяч тонн грузопотока в год. Будет создано 2000 рабочих мест, дополнительная выручка для аэропорта и операторов составит более 7 миллиардов рублей. Поступления от налогов и сборов в бюджеты всех уровней достигнут 1,5 миллиарда рублей. Косвенные же эффекты от развития около аэропортовой деятельности могут удвоить данные показатели.
При этом надо понимать, что мы создаем нетрадиционный для России бизнес. Торговать природными ресурсами мы уже научились, заставить заплатить за пролет над страной тоже несложно. А создать современный международный грузотранспортный хаб – это уже гораздо более амбициозный проект. И для того, чтобы привлечь иностранные компании, мало построить грузовой терминал, надо наполнить его передовыми технологиями.
Какие это технологии?Это мировые технологии, адаптированные к России: например, для работы с иностранными компания
ми необходима используемая во всем мире система электронного грузового авиабилета (efreight). Ведь чтобы работать с зарубежными авиакомпаниями, нужно пройти аудит на соответствие правилам обслуживания конкретных воздушных судов. Это и инфраструктура, и квалифицированные кадры, и программное обеспечение, и культура, и качество обслуживания и т.п. По этим параметрам бизнес и будет конкурировать за тот поток грузов, который существует в мире.
В Красноярске мы построили новый терминал, но мы не можем оснастить его новыми технологиями, потому что они не нужны, пока нет достаточного объема грузооборота. Например, на мощности «Интерпорта» в «Шереметьево» приходится меньше 100 000 тонн грузов в год. Чтобы внедрять новые технологии, нужно удвоить этот объем, причем не просто за счет обработки импортного груза, а за счет трансфертного груза, который направляется в другие страны через Россию.
Если представить, что компромисс достигнут, какие Ваши дальнейшие действия? Мы уже работаем «на опережение». Терминал в Красноярске построен, мы реструктурировали старые терминалы «Аэрофлота» в «Шереметьево», в этом году начинаем там строительство нового большого грузового терминала. Мы обучаем людей, работаем с имеющимися клиентами, при этом говорим о том, что все это рассчитано не на те десятки тысяч тонн грузооборота, который сегодня есть, а те сотни и миллионы тонн, которые мы знаем, как привести в страну и как обработать. Пока этот бизнес сопутствовал прочим, а сейчас речь идет о том, что он достоин быть самостоятельным, приносить большой доход и даже стать драйвером регионального роста. И если удастся повысить грузооборот до необходимых масштабов в результате хотя бы частично «открытого неба», можно будет убедиться в том, насколько это выгодно и бизнесу, и государству и тиражировать этот опыт внутри страны, привлекая инвестиционный капитал и технологии.

The 2010 “Enabling Trade Index” (World Economic Forum) rates Russia as 48th in terms of the quality of transport infrastructure across all modes of transport. Russia needs to develop its transport infrastructure to
avoid this issue becoming a restraint to economic development in the coming years. Given that Russia has some of the most challenging climatic and geological conditions in the world, this is not a simple task, especially when combined with the fact that Russia is not the easiest country in which to do business and ranks 124th out of 182 countries in the World Bank’s “Ease of Business” report 2012.
Articles written about Russia often centre on the size of the country, the number of time zones and corruption. However, for the construction industry, the main challenges would appear to be the sheer scale of some of the infrastructure required, which needs to be built in climatic and geological conditions that are often extreme.
RoadnetworkrequirementsA report by “Avtodor” which looked at the condition of the federal road network in 2009 concluded that 28,500km (57%)
failed to meet minimum ride quality requirements, 12,200km (24.4%) failed to meet minimum friction requirements, 24,900km (49.9%) failed to meet minimum strength requirements and 35,100km (70.3%) failed to meet minimum defects requirements. These figures not only bring home the size of the task in hand, but also bring in to focus the sheer scale of the Russian federal road network.
A report put together by the National Intelligence Council in the USA looked at the “Impacts of Climate Change to 2030” in Russia. The report concluded that amongst the impacts of climate change in Russia will be permafrost thaws that are deeper and earlier. Approximately 65% of Russia is underlined by permafrost and the problem of the “active layer” of soil at the top of a permafrost layer thawing to a deeper level and earlier in the year means that it will be extremely difficult to build any infrastructure on these areas, including the areas that produce by the far the largest revenue stream for the Russian state via the oil and gas industry.
GovernmentinvestmentplansHaving said all that, the country is not shying away from building infrastructure but is facing the challenge head on. In May 2011, Vladimir Putin announced that Russia will spend £173bn over the next ten years on road building, this will effectively double the rate of road building. Putin told a government meeting in Tver in May last year that “the state of our roads is a real problem, constraining business activity, investment and development of the Russian territories...our financial resources will allow us to double road construction volumes in the next 10 years”.

This is to stabilise the ground in the Imeretinskaya Valley in Sochi, which will house the “coastal cluster” of venues for the 2014 Sochi Winter Olympics. The site will also be the site of the new Formula 1 track, designed by the German company “Tilke”.
The 2014 Sochi Winter Olympics is a classic example of the Russian government’s willingness to invest time and money in facilitating large infrastructure projects. The Sochi site is the biggest construction site in Europe with 393 construction projects and literally thousands of sub projects. All competition venues are due to be completed by the end of 2012 facilitated by 55,000 people working 24 hours a day, 7 days a week.
WorldCupbidHaving done well in Sochi, Tensar International is setting its sights on another major sporting event in Russia that will require significant infrastructure investment, the 2018 FIFA
World Cup Russia™. Tensar attended a Trade Mission in March this year where meetings were arranged with the Local Organising Committee.
Russia’s World Cup bid relies heavily on investment in infrastructure, due to the large distances between host cities, Kaliningrad in the west to Yekaterinburg in the east, St Petersburg in the north to Sochi in the South.
Alexey Sorokin, CEO of the Local Organising Committee stated that: “Our goal is to organise the best tournament in FIFA’s history. We can achieve this in part by drawing on foreign expertise on how to design and build stadia, make commercial use of arenas, plan and stage events, ensure security at sports facilities and modernise transport infrastructure and information technology.
“This is a clear example of mutually beneficial cooperation. Foreign companies will be able to extend the geographical reach of their business, while Russia will benefit from the rich legacy of the World Cup, in the form of state of the art infrastructure which the public will be able to use for many years to come”.
To turn the outline plans in to a concrete plan, the 2018 FIFA World Cup Russia™Local Organising Committee has signed a partnership agreement with the Olympic Games Transport Directorate to develop concepts for transport services for the World Cup. Formed in 2009, the Transport Directorate has a lot of experience of developing infrastructure solutions for key sporting events, the xxII Winter Olympic Games in Sochi and the xxVII World University Summer Games in Kazan.
WorldTradeambitionsUnderlying all of this has been the recent success of Russia’s approximately 18 years of negotiations to become members of the World Trade Organisation. The WTO enforces trade liberalisation agreements which have the effect of removing barriers to trade. Pascal Lamy, Director General of the WTO, stated that “the accession of Russia to the WTO is a winwin deal. It will cement the integration of the Russian Federation into the global economy. It will bring greater certainty and stability to business operators and trading partners. It is a contribution to the rule of law. It strengthens and opens new trade opportunities. It accords the WTO quality label to the Russian Federation”.
ContinuingtheprogressRussia needs to invest in infrastructure if the country’s economy is to develop to its full potential in the long term. Significant spending commitments have been made as part of Vladimir Putin’s election campaign. Commitments have already been made as part of the 2018 FIFA World Cup Russia™ bid and construction of the xxII Winter Olympic Games in Sochi is continuing apace. The unique geological and climatic conditions in Russia combine to make this a difficult but not insurmountable task. Significant opportunities exist for British companies working in the infrastructure sector. Russia is not an easy place to do business and time and effort is required to enter the market and to make sure that your particular offering works in a market which is both unique and challenging. Необходимость инвестиций в развитие транспортной инфраструктуры для дальнейшего экономического роста в России очевидна. Принимая во внимание тот факт, что климат и геологические условия на территории РФ одни из самых суровых в мире, реализация этой задачи становится объективно не простым делом. Ситуация осложняется и тем, что российский рынок на сегодняшний день является далеко не самым надежным и комфортным для ведения бизнеса: в отчете Мирового Банка 2012 года по этому показателю Россия из 182 стран занимает 124-е место.
Развитие транспортной инфраструктуры Россиив условиях климатических изменений
Большинство публикаций о России в качестве тормозящих факторов называют размеры страны, большое количество временных зон и коррупцию. Однако для строительного сектора основной про
блемой является чрезвычайно большая протяженность линейных объектов, которые необходимо строить в экстремальных климатических и геологических условиях.
ТребованияксетиавтодорогСогласно актуальным данным «Автодора» о состоянии федеральной сети автодорог, 28500 км (57%) не соответствует минимально предъявляемым требованиям. При этом 12200 км (24.4%) не соответствует требованиям по шероховатости покрытия, 24900 км (49.9%) не отвечают прочностному критерию и 35100 км (70.3%) не соответствуют минимально предъявляемым требованиям к целостности асфальтобетонного покрытия. Эти цифры дают представление как о масштабах существующей сети Федеральных автодорог, так и о масштабах предстоящих задач.
Согласно отчету Национального Разведывательного Совета США о «Влиянии изменений климата до 2030
года», в России одной из значимых проблем будет таяние вечной мерзлоты, занимающей сегодня почти 65% территории Российской Федерации. Проблематика оттаивающего активного слоя в ближайшие годы крайне затруднит строительство объектов инфраструктуры. Это также затронет регионы, в которых сконцентрированы основные запасы нефтегазовых месторождений.
ИнвестиционныепланыправительстваНесмотря на перечисленные факты, страна не отказывается от своих намерений строительства инфраструктуры, хотя это и связано с предстоящими трудностями. В мае 2011 года Владимир Путин выступил с заявлением о планах инвестировать £173 миллиарда на строительство дорог в ближайшие 10 лет, что удвоит протяженность строящихся дорог. На этом правительственном заседании в Твери он отметил, что «состояние дорог в России является серьезной проблемой, сдерживающей рост деловой активности, инвестиций и развития регионов. Наш бюджет позволит в последующие 10 лет вдвое увеличить объемы дорожного строительства».

Все соревновательные объекты должны быть закончены к концу 2012 года, над этим непрерывно работают 50000 человек.
ЧемпионатмирапофутболуУспешный опыт Сочи позволил Tensar International обратить внимание на другое крупное спортивное событие, которое в ближайшее время потребует значительных усилий по улучшению инфраструктуры – Чемпионат мира по футболу 2018. Tensar принял участие в торговой миссии в марте этого года и встречах, организованных олимпийским оргкомитетом.
Успешность проведения Чемпионата мира по футболу в России очень сильно зависит от объема инвестиций в инфраструктуру, особенно с учетом больших расстояний между городами, принимающими матчи: от Кали
нинграда на западе до Екатеринбурга на востоке, и от СанктПетербурга на севере до Сочи на юге.
Алексей Сорокин, директор российского отделения Оргкомитета FIFA сообщил: «Наша задача – организовать лучший чемпионат в истории FIFA. Мы сможем добиться этого за счет привлечения зарубежного опыта на стадии проектирования и строительства, обеспечения коммерческой загрузки построенных объектов, грамотного планирования и четкой организации мероприятий, обеспечения безопасности на спортивных объектах, а также глобальной модернизации транспортной инфраструктуры и информационных технологий.
Это простой пример взаимовыгодного сотрудничества. Иностранным компаниям предоставляется возможность расширить географию своего бизнеса, в то время как Россия получает после Чемпионата Мира богатое наследство в виде современной инфраструктуры, которая будет эксплуатироваться долгое время по окончании чемпионата».
Для того чтобы превратить мысли в конкретные планы, российский Оргкомитет FIFA 2018 подписал партнерское соглашение с Олимпийской Транспортной Дирекцией и разрабатывает концепцию транспортного обслуживания гостей и участников Чемпионата Мира. Созданная в 2009 году, Транспортная Дирекция накопила большой опыт разработки транспортных решений для ключевых спортивных событий, в том числе xxII Зимней Олимпиады в Сочи и xxVII Универсиады в Казани.
НадеждынаВТОНа протяжении последних 18 лет Россия предпринимала много шагов по вступлению в ВТО, которая в свою очередь требовала введения либеральных соглашений для снятия торговых барьеров. Паскаль Лами, генеральный директор ВТО, сообщил в своем интервью: «Допуск России в ВТО представляет обоюдный интерес. Это закрепит интеграцию Российской Федерации в глобальную экономику, даст больше уверенности и стабильности бизнесу и торговым партнерам, откроет новые возможности. Так, в ходе своей предвыборной кампании Владимир Путин сделал серьезные обещания по затратам на инфраструктурные проекты. Страна уже взяла на себя обязательства по подготовке к Чемпионату мира по футболу в 2018 году, и полным ходом идет строительство объектов для зимней Олимпиады в Сочи. Уникальные геологические и климатические условия в России усложняют эти задачи, но не делают их невыполнимыми. Для британских компаний, работающих в секторе инфраструктуры в России открыты большие перспективы. Россия – не самое простое место для работы, поэтому бизнесу нужно затрачивать определенные усилия для того, чтобы объяснить свои конкурентные преимущества, обеспечить спрос на этом одновременно уникальном по своей доходности и сложности рынке.

Развитие транспортной отрасли является стратегическим и приоритетным направлением для каждого государства. Создание современных автомобильных и железных дорог, аэропортов, вокзалов является необходимым условием улучшения качества жизни населения, развития экономики страны и повышения ее конкурентоспособности на международных рынках.
Государственно-частное партнерство в транспортной инфраструктуре России: наши цели и зарубежный опыт
Следует отметить, что в России существуют значительные ограничения роста экономики, обусловленные недостаточным развитием транспортной системы. Объемные и качественные характеристи
ки объектов инфраструктуры в настоящее время не позволяют в полной мере и эффективно решать задачи экономики. Так, по данным Росавтодора ежегодные потери России изза недостаточного развития автодорожной инфраструктуры оцениваются в 550600 миллиардов рублей, что превышает 3% ВВП страны.
В связи с этим в последние годы государство обратило особое внимание на необходимость усовершенствования и модернизации транспортной инфраструктуры страны. Для решения этих задач был принят ряд целевых программ, регулирующих стратегию развития транспортной инфраструктуры России.
Исходя из этого, в ближайшие годы государство собирается потратить на строительство и модернизацию транспортной инфраструктуры порядка 13 триллионов рублей. На эти деньги будет построено и реконструировано более 17 тысяч км автодорог, более 100 взлетнопосадочных полос, проложено свыше 20 тысяч км новых железных дорог. На реализацию региональных программ по развитию объектов транспортной инфраструктуры также выделяются значительные суммы: так, на модернизацию транспортной инфраструктуры Правительство Москвы планирует потратить в ближайшие 5 лет до 1 триллиона рублей.
Обеспечение развития инфраструктуры и поддержание ее на должном уровне традиционно является задачей государства. В связи с наличием широкого спектра сфер развития, в которых требуется значительное бюджетное финансирование, государственный сектор заинтересо
ван в привлечении частных инвесторов для помощи в реализации своих задач. Одним из способов привлечения инвестиций частного бизнеса является ГЧП (государственночастное партнерство), представляющее собой аналог PPP (Public Private Partnership) – европейской формы взаимодействия государства и частного бизнеса.
Необходимо отметить, что в настоящее время государство планирует осуществлять реализацию проектов по модернизации объектов транспортной инфраструктуры именно на основе государственночастного партнерства, на что прямо указывается в целевых программах и стратегиях развития транспортной отрасли.
Заметим, что взаимовыгодное сотрудничество государства и частного бизнеса это не изобретение чегото нового, а правильно используемые уроки прошлого. ГЧП в России имеет давнюю историю. Еще в третьей четверти 19 века при строительстве железных дорог и разработке месторождений государство очень активно привлекало сторонний капитал, а в период НЭПа в 2030е годы применялись концессии. Сотрудничество государства с частными инвесторами, которое происходит в России в последние годы, можно рассматривать как третий этап развития института ГЧП в нашей стране. Вместе с тем, несмотря на активное применение ГЧП в России в настоящее время, нормативноправовое регулирование государственночастного партнерства является несовершенным, что влечет возникновение проблем при реализации проектов.
Одним из важнейших недостатков нормативноправового регулирования государственночастного партнерства в России является отсутствие четкого определения ГЧП, поскольку до настоящего времени с одной стороны не принят единый федеральный закон о ГЧП, с другой стороны уже в 46 регионах существуют свои законы о ГЧП.
Это привело к тому, что в настоящее время как в доктрине, так и в законотворчестве, происходит смешение механизмов взаимодействия государства и частного бизнеса. Кроме того, необходимо отметить, что в силу пункта ж) статьи 71 Конституции РФ правовые основы единого рынка и гражданское законодательство находят

ся в исключительном ведении Российской Федерации, что означает, что нормативноправовое регулирование в сфере ГЧП может осуществляться только на федеральном уровне. Поэтому в случае противоречия региональных законов федеральным, существует риск признания их недействительными.
Поэтому разработка региональных законов, несмотря на их поддержку правительством РФ, сталкивается с определенными трудностями. В качестве примера можно привести судьбу закона о ГЧП в Пермском крае, когда принятие закона было заблокировано региональным управлением Федеральной антимонопольной службы. Управление ФАС по Пермскому краю сочло отдельные положения этого закона, предусматривающие возможность реализации неконцессионных форм ГЧП на территории региона, несоответствующими федеральному законодательству. Данная ситуация наглядно показывает другую проблему, тормозящую развитие государственночастного партнерства в России – создание новых форм сотрудничества государства и частного бизнеса, неурегулированных напрямую федеральным законодательством.
Федеральное законодательство содержит регулирование только одной формы ГЧП – концессионных соглашений. Регулирование заключения и исполнения таких соглашений на федеральном уровне на основании ФЗ «О концессионных соглашениях» №115ФЗ от 21.07.2005 года, поставлено в достаточно жесткие рамки и, более того, не предоставляет частным инвесторам тех гарантий и льгот, которые обычно в мировой практике предоставляются им в проектах ГЧП.
Поскольку апробация на практике предлагаемой законодателем концессионной модели ГЧП выявила ряд принципиальных недостатков, мешающих ГЧП быть эффективным, в настоящее время государство осуществляет совершенствование регулирования ГЧП на федеральном уровне.
Например, в Министерстве экономического развития РФ в качестве пути решения указанных проблем обсуждается принятие отдельного рамочного федерального закона, позволяющего закрепить проекты государственночастного партнерства как отдельный предмет правового регулирования. Одновременно, в закон «О концессионных соглашениях» предлагается внести изменения, расширяющие сферу регулирования и возможные формы ГЧП. В частности, эти поправки позволят реализовывать проекты ГЧП в форме «контрактов жизненного цикла» (Life Cycle Contract, LCC).
Следует отметить, что LCC заимствовано российским законодателем из опыта зарубежных стран. Форма LCC давно воспринята и успешно реализуется в Европе, в частности, в форме PFI (private finance initiative) в Великобритании, которая является лидером по количеству реализованных проектов ГЧП. В рамках PFI государство заключает с частным инвестором договор на предоставление, как основных фондов, так и долгосрочных услуг по их эксплуатации. В настоящее время до 15% государственных инвестиционных расходов на общую сумму около £73,05 миллиардов в Великобритании приходится на PFI, количество проектов которых составляет около 930. При
этом в транспортной инфраструктуре реализуется 67 проектов на общую сумму £26,23 миллиардов, что составляет 36% от общего количества проектов PFI в Великобритании, реализующихся во всех остальных отраслях инфраструктурного развития (здравоохранении, окружающей среде, образовании и т.д.).
Таким образом, важность реализации проектов по созданию новых и модернизации существующих объектов транспортной инфраструктуры несомненна, поскольку их реализация влечет возникновение ряда преимуществ, как для публичного образования, так и для частного инвестора, в связи с чем является взаимовыгодным для обеих сторон.
Необходимо отметить, что реализация проектов ГЧП требует участия технических, финансовых и юридических консультантов, поскольку участие экспертов при подготовке проекта ГЧП влияет на жизнеспособность проекта, в особенности, на оптимальное соотношение цены проекта и работ, подлежащих выполнению по нему.
ART DE LEx, учитывая важность интересов участников проекта и конечных пользователей услуг, а также осознавая значимость проектов ГЧП как стратегических проектов приоритетного характера, которые являются частью отраслевой стратегии и экономической политики государства, проводит исследования в области ГЧП и оказывает услуги в качестве юридического консультанта при реализации проектов ГЧП.
При сопровождении проектов ГЧП ART DE LEx обращается к опыту зарубежных стран с целью разработки наилучших решений при реализации проектов ГЧП. Следует также подчеркнуть важность участия, в процессе развития и популяризации государственночастного партнерства, международных информационных площадок, позволяющих как сторонам соглашения о ГЧП, так и консультантам проекта ГЧП осуществлять поиск зарубежных партнеров, сотрудничество с которыми позволяет более успешно реализовывать проекты ГЧП. Без сомнения, такой информационной площадкой является РоссийскоБританская торговая палата (РБТП). Благодаря широкой сети контактов среди представителей частного бизнеса, связям в правительствах обоих государств, в дипломатических кругах и деловых ассоциациях, РБТП способствует установлению делового сотрудничества и обмену опытом между странами в сфере государственночастного партнерства.
Думается, что сотрудничество государства и частного бизнеса, опирающееся на зарубежный опыт, поможет качественно изменить состояние транспортной инфраструктуры, что, несомненно, скажется на экономическом развитии нашей страны и повышении ее конкурентоспособности на международных рынках.

The following is information about the Russian govern-ment’s development programme aimed at boosting the capacity of shipping and port industry.
The Russian government has launched a major invest-ment programme in a bid to build a number of new sea ports nationwide and to reconstruct the existing ports on the Northern, Baltic, Black sea and Far-Eastern basins and said it welcomes any participation of western companies. The following is the complete list of projects provided by the State’s Customer General Directorate created to implement the programme of revival of the Russian Merchant Marine.
Baltic basin1. The construction of a new port (Ust-Lugha) in Luzhskaya
inlet (KInghisepp region) for the transhipment of general, timber, bulk cargoes and containers of up to 35 million tonnes per year. The first state of port construction is to be implemented until 2000 and will generate operation facilities to handle 17 million tonnes of cargo per year on a total extent of berth lines of 7,700 metres.
2. The construction of a new port in Primorsk (Vyborg region) for reloading up to 45.0 million tonnes per year of crude oil, petroleum products, liquid chemical cargoes, and liquefied gas. The projects are to be implemented by 1998, and provide facilities for handling of 23.0 million tonnes per year (19.0 million tonnes of crude oil and 4.0 million tonnes of petroleum products). The project also includes dredging, development of the port area and railway facilities.
3. The Construction of a new port in Batareynaya Bay (Lomonosov region) for transhipment of 15 million tonnes per year of petroleum products. The first stage includes the period from 1994-1999, with a planned capacity of 7.5 million tonnes per year on 4 piers with a total length of 1,260 metres for transhipment of petroleum products. The total value of the first stage, including the develop-ment of the railway facilities is US$270 million.
4. The reconstruction of the existing St. Petersburg port:• The reconstruction of the existing pier for transhipment
of 0.3 million tonnes per year of refrigerated goods, together with the construction of a refrigerated storage house for 10 thousand tonnes of goods. The value of the construction operations, including purchase of the technological equipment, is US$80 million.
• The construction of a new container terminal for tran-shipment of 1.5 million tonnes per year of large-ton-nage containers and ‘’RO-RO’’ cargoes, including two 666 metre piers, as well as purchase of technologi-cal equipment. The value of the construction is about
US$100 million. The project is to be implemented within 1995-1996.
Northern basin1. The development of Mumransk sea merchant port for
the period up to 2000 includes the construction of new, and reconstruction of existing reloading complexes for transhipment of general and bulk cargoes including;• The reconstruction of pier no.19 to the length of 187
metres for export of 2.0 million tonnes of mineral fertilisers per year. The value of the reconstruction is US$24.9 million, including US$9.65 million for pur-chase of equipment;
• The reconstruction of pier no.2 to the length of 205 metres for transhipment of 0.6 million tonnes of fer-rous-ore concentrate per year. The value is US$29 million.
Black and Azov Sea Basin1. The development of Novorossiisk sea merchant port for
the period of up to 2000 includes the reconstruction of existing, and construction of new reloading complexes for transhipment of general, grain and petroleum in bulk cargoes, including;• The reconstruction of the existing grain complex on
berths 21-22, with a capacity of up to 1.0 million tonnes per year. The cost of the required reloading equipment is $10 million.
• The construction of the 2nd oil pier on the existing oil pier, for export of 15 million tonnes of crude oil per year. Its costs amount to US$50 million.
• The construction of a reloading complex for incoming grain with a capacity of 3.0 million tonnes per year, and with an elevator for 120,000 tonnes, and two berths with a total length of 570 metres, for receiving vessels up to 80,000 dwt.
• The construction of container terminals on four piers, with 822 metres total length, for transhipment for 120,000 20-foot containers per year, and the recep-tion of container carry, with space for 100-1200 con-tainers. One of the piers is also planned to be used for the reception for ‘’RO-RO’’ vessels from 4,500 to 12,000 dwt. The total cost of the grain and container terminals is US$250 million.
• The construction outside the port territory of a cargo terminal for collection, sorting and preparation of ves-sel cargo lots passing through the port, with a capacity of up to 4 million tonnes per year. The costs are US $19 million.
