REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN ANTONIO HELD IN THE COUNCIL CHAMBER, CITY HALL, ON THURSDAY, APRIL 3, 1980. The meeting was called to order at 1:00 P.M. by the presiding officer, Mayor Lila Cockrell with the following members present: CISNEROS, WEBB, DUTMER, WING, EURESTE, THOMPSONI ALDERETE, CANAVAN, ARCHER, STEEN, COCKRELL; &sent: NONE. 80-17 The invocation was given by the Reverend Jim Townsend, Stonewall ~aptzst Church. 80-17 Members of the City Council and the audience joined in the Pledge mlegiance to the flag of the United States. 80-17 The minutes of the meeting of March 27, 1980 were approved. 80-17 CONSENT AGENDA Mr. Steen moved that items 5-13, constituting the consent agenda be approved, with the exception of items #6,7,9 and 12 to be considered individually. Ms. Archer seconded the motion. On roll call, the motion, carrying with it the passage of the following Ordinances, prevailed by the following vote: AYES: Webb, Dutmer, Wing, Thompson, Archer, Steen, Cockrell; NAYS: None; ABSENT: Cisneros, Eureste, Alderete, Canavan. Ms. Bob Garcia, Executive Di rec to r o f t h e San Antonio Business Development Agency, spoke i n oppos i t ion t o t h e awarding of t h e b id t o M r . J o e F. Morales, H e stated that it would make more sense t o award t h e b i d t o t h e low bidder s i n c e it i s $600 less and t o handle t h e matter of the number of copies r equ i red through admin i s t r a t ion .

Mayor Cockre l l s t a t e d t h a t t h e Purchasing Department i s a very e f f i c i e n t o f f i c e because they have escaped c r i t i c i s m over the y e a r s through adherence t o t h e r e g u l a t i o n s and s p e c i f i c a t i o n s of t h e b idding process. . She spoke i n suppor t of t h e department 's recommendation.

I n response t o a ques t ion by M r . Thompson, M r . John Brooks, Di rec to r of Purchasing, s t a t e d t h a t t h e ques t ion ing of a l o w b i d award occurs i n f r e q u e n t l y , i n f a c t , it has only occurred onas in the past 12 mths, and i n t h a t case , s taf f recommendations were upheld by t h e Council . H e expla ined t h e reason f o r r e q u i r i n g three copies of t h e b i d document.

In response t o a ques t ion by M r . Thompson, M s . Jane Macon, City Attorney, s t a t e d t h a t b i d s p e c i f i c a t i o n s c a l l f o r t h r e e copies of the b i d document and urged t h a t t h e requirement be adhered to.

M r . Thompson spoke i n support of t h e low bidder.

Mayor Cockre l l then spoke i n favor of r e j e c t i n g a l l bids and going th ru t h e b id process aga in , r a t h e r than having Council make an I except ion and decid ing purchasing procedures a t t h e C i t y Council l e v e l .

M r s . Dutmew spoke a g a i n s t making an except ion and thus setting a precedent .

M r . Wing s t a t e d t h a t use of mul t ip le copies of b i d s mainta in t h e i n t e g r i t y of t h e bidding process and spoke i n f avor of s t a f f ' s recommendation. H e s t a t e d t h a t it would be an i n j u s t i c e t o M r . Morales i f t h e Council d id award t h e b i d t o the low bidder, s i n c e Mr.l@rdles caplied with all t h e b i d s p e c i f i c a t i o n s .

M r . Eureste s t a t e d t h a t same prospec t ive bidders have d i f f i c u l t y g e t t i n g i n t o t h e C i t y ' s s u p p l i e r bus iness whi le o t h e r s more f a m i l i a r wi th t h e processes do n o t have t h a t d i f f i c u l t y . H e s t a t e d t h a t r e c e n t ques t ions r a i s e d about s u p p l i e s i n t h e Ci ty Parks and Recreat ion Department make it d i f f i c u l t t o a c t on such mat t e r s u n t i l a l l q u e s t i o n s in t h a t a r e a are s e t t l e d .

M r . Brooks expla ined t h e process of opening b i d s and procedures used when any e r r o r s i n t h e b id process a r e noted a t t h e b i d opening.

Mayor Cockrell s t a t e d t h a t t h e Council r e g r e t s it when t h e r e are a l l e g a t i o n s a g a i n s t any City employee involved i n an a l l eged t h e f t , b u t this case has nothing t o do wi th t h e Purchasing Department.

M r . Thompson s t a t e d t h a t t h i s i s merely an admin i s t r a t ive d e f e c t and expressed h i s concern about t h e h igher c o s t i f t h e recommendation of staff is accepted. A t t h i s time, he made a s u b s t i t u t e motion t o accep t t h e low b i d , b u t t he motion died f o r lack of a second.

M r . Steen then urged t h e Council t o adhere t o t h e r u l e s and r e g u l a t i o n s as set out i n t he b id s p e c i f i c a t i o n s .

H e explained t h a t a postcard survey of C h u r c h i l l Estates by t h e City staff had produced a 74% response among t h e horneowncirs, o u t of the.195 postcards s e n t . H e stated t h a t a u t of that figure, 76% responded in favor of annexation by t h e City of San A n t o n i o , and only 24% responded i n opposition.

M r . Fernando C u e l l a r , Principal Planner wi th t h e Planning Department, provided t h e Council with a brief background summary of t h e annexation proceedings of Green Springs Valley. H e s t a t e d that t he C i t y ' s pos tcard survey of t h e a r e a r e s u l t e d i n a 79% response from t h e homeowners; 77% of the homeowners were a g a i n s t annexat ion and 22% were i n favor . H e stated t h a t staff recommends t h e City n o t proceed withdthe annexat ion of t h i s area.

Schlundt expressed concern about t h e plans for t h e Golden Street Drainage P r o j e c t , H e o u t l i n e d on a map t h e p o r t i o n of t h e d ra inage d i t c h which he is concerned about, s i n c e it c u t s a c r o s s much of the property concerned. H e stated that it would g r e a t l y a f f e c t t h e value of t h e proper ty and f e e l s t h a t p roper ty owners were n o t properly n o t i f i e d about the p lans f o r t he d i t c h .

Mr. Wing stated t h a t t h i s p r o j e c t was funded t h r e e y e a r s ago i n t h e Community Development Block Grant program, and much p u b l i c i t y was given t o t h e p r o j e c t , but he s t i l l a p p r e c i a t e s t h e f a c t t h a t c i t i z e n s i n %he a f f e c t e d area have a problem.

H e s t a t e d t h a t covering the dra inage d i t c h would e s c a l a t e t h e c o s t . H e spoke regarding t h e f o u r mentioned alternatives and noted t h e problems wi th each, H e s t a t e d t h a t the p r o j e c t i s scheduled t o begin cons t ruc t ion t h i s summer and would l i k e t o keep t h e c o n s t r u c t i o n w i t h i n the capital improvements schedule. H e stated t h a t a study r e p o r t on a p o s s i b l e a l t e r n a t e r o u t e fo r t h e dra inage d i t c h would be ready next week and he w i l l p repa re a p r e s e n t a t i o n t o t h e City Council on t h a t r e p o r t .

I n xesponse t o a question by M r . Wing, M r , Kiolbassa r e p l i e d t h a t it w i l l t a k e some $20 m i l l i o n t o complete t h e Golden S t r e e t Drainage Project.

H e s t a t e d t h a t t h e r e were n o t s i g n s ' p o s t e d t o wamof t h e p o s s i b i l i t y of such ac t ion . H e s t a t e d t h a t t h e woman's car w a s l o c a t e d on a n o r t h s i d e lot, where it had been towed. H e s t a t e d t h a t t h e wrecker o p e r a t o r t h e r e , confirmed t h a t t h e c a r n i v a l ope ra to r had authorized t h e towaway from t h e area of t h e c a r n i v a l ,

M r . Eureste stated t h a t he personally investigated t h e i n c i d e n t and feels that the C i t y should do something in this regard to stop such incidents.

Mr. Luis Garcia, Assistant City Attorney, commented that the l a s t State Legislature preempted t h e City i n t h i s area t o the extent that the City cannot halt such towaways, but he stated t h a t the State Law governing such cases requires t h a t a l a r g e s i g n s p e l l i n g out t h e t o w a w a y r i g h t s must be prominently posted n e a r the e n t r a n c e t o any such parking l o t and t h e park ing lot owner can be s u b j e c t t o a large l i a b i l i t y if abuse of t h e State Law i s proven.

A few of the Council members then engaged in a general discussion of the law in such cases .

Mr. Alderete requested t h a t staff i n v e s t i g a t e circumstances surrounding a Paul Thompson newspaper a r t i c l e reported on A p r i l 3, 1980, regarding t h e towing away of automobiles parked near t h e B a p t i s t Hospital. H e asked that staff report back t o t h e Council regarding t h i s ma t t e r .
