THE VILLAGE LAND REGULATIONS, 2001

PART IPIU:LlMINAKY

1. These Regulations may be cited as the Village LandRc!!;ulations, 200 L

2. In theseRegulations.unless thecontext otherwise requires­

"Act" means the Village. Land Act, 1999;

"authenticatedagreement"means a bindingand written agreement.between the parties to a process of mediation facilitated by amediatorand signed by the parties and the mediator,

"committee" means a village adjudication committee established undersection 53 of the Act and includes an adjudication officerexercisingpowers under section 56 of theAct;

"Council" means the VillageLand CouncileStablished by sectwn 60 ofthe Act;

"Court" has the meaningascribed to itby the Act;"Customary rightofoccupancy" has the meaning ascribed to it by the

Act;"derivative right" hasthe meaning ascribed to it by the Act;"District Lend Officer" mcann an uuthorieed officer appointed al: sucb

under Section II of the Land Act, 1999"District Land Registry" means the District Land Registry established

underthe Land Registration Ordinance. Cap. 334;"Government"meanstM: Government ofUnitedRepublicofTanunia;"informal mortgage" means the mortgage provided for by paragraph (a)

ofsubsection (6) ofsection I12 ofthe Land Act, 1999;"interest in the proceedings"means an interest,pecuniaryorotherwise,

(b) of subsection (6) of section 112 of the Land Act, 1999;"Local Government Authority" has the meaning ascribed to it by section

2 of the Act;"Occupier" means holder of Customary right of occupancy;"Officer" means the Village Executive Officer;"Qualified Valuer" has the meaning ascribed to it by section 2 of the

Land Act, 1999;"registered document" rn cuna U ccrti Ilcnt" of customary right of

. occupancy or a derivative right as provided for by Part IV of theAct, appearing in the First Schedule of these Regulations;

"Register of Village Land" means the register of village land maintainedpursuant to section 21 of the Act:

"village institution" means a village council, a committee ofa villagecouncil, a village adjudication committee, and an adjudicationofficer exercising powers under section 56 of the Act.

Notices 2. The notice of a hearing into any matter by a village institutionunder these Regulations shall be as prescribed in the FirstSchedule.

4. An order requiring the attendance of a person or requiring aperson to produce a document before a village institution shall be in thefOnTIS prescribed in the First Schedule.

5-(1) A summons issued by the chairman of a committee or anadjudication officer exercising powers under section 56 of the Act to aperson to attend a hearing under section 54 of the Village Land Actshall give the person to whom it is addressed not less than 14 daysnotice uf the day Ull which he or she is lU attend the hearing.

(2) A summons to which this regulation refers shall be asprescribed in the First Schedule.

7. In any hearing held under the provisions of the Act or theseRegulations, a village institution shall comply with the rules of naturaljustice indetennining its procedures and shall -

(a) conduct thehearing in public andin an informal atmosphere butwithdueregard to order.decorum andfairness to allparties andshallmakeplain to anyrepresentatives appearing for lilly pllrtiesthat the vin~geinstitution shallconcenttate on \he substanee ofthe matter before it and administer substantive justicewithoutundue regard to technicalities;

(b) exclude QJlY member of the village irtstitution who hall aninterestin the proceedings, which interestsuchmemberoithevillage institution shall be under a duty to declare, and thatmember1lhaI\ not sit or in any way be involved in a hcariny, asa memberof the village institution;

(c) beforethe hearingdetermine and announce the hours of theday when the hearing shall take place and in doing so shallhave regardto the convenience of the parties and the DOnna!

(ii) simple or customary forms of surveying ordemarcating boundaries using natural featuresand trees or buildings and other prominentobjects;

(iii) human activities on or about the land such as theuse of footpaths, cattle trails, watering points,and the placing ofboundary marks on the land;

(iv) maps, plans and diagrams, whether drawn toscale or not, which show by reference to any ofthe matters referred to in subparagraphs (ii) or(iii) of paragraph (k) the boundaries of the land;

(I) pay particular regard IlJ the interests in the land tne subject ofthe hearing of women, children and disabled persons andensure that all such interests are fully and properly consideredand recorded;

(m) in deciding whether to exercise ita discretion to adjourn ahearing, may adjoumthe hearing to facilitate any parties 10the hearing to reconcile any differences they may have abouttheir respective interests in the land and must then record anysuch agreement which is reached when the hearingrecommences;

(n) have regard to the desirability, at any time during or after ahearing has ended of making a preliminary finding on anymatter and where it does so, it shall invite the parties tocomment on that finding either in person or in writing;

(0) try to reach a consensus On all decisions but if that is notpossible, then a majority decision may be reached with thereasons for both the majority decision and the minorityposition being recorded;

(P) in deciding whether any issue has been proved before thevillage institution, determine whether the facts have beenproved on the balance of probabilities, that is, whether it ismore likely than not that any fact has been proved;

(q) prepare a report which shall include-(i) the names of the members of the village

institution who held the hearing;(ii) the dale of the J;p.~rine:

(iii) 1he names of1he ?arties',(iv) a summary of the evidence of the.parties and all

witnesses;

(v) th" finrlinS" "11 all "9'''I'.I~ of the ease and claim"together with the reasons for those findings;

(vi) the recommendations on all aspects of the caseand claims together with reasons for thoserecommendations.

(r) sign the report prepared in accordance with the provisionsofparagraph (q).

PARTIIICOMPENSATION

8. The:following may claim compensation in respect ofvillageland which is transferred to general or reserved land under section 4 ofthe Act or which is declared to be hazard land under section 6 of the Actand from which the village council determines that villagers shall berequiredto vacatethat hazard land or part thereof-

(3) a villagecouncil on behalf of the viilagers in respect of the lossof communal land, assets and benefits derived from thatcommunal land;

(b) any villager occupying transferred land or hazard land under acua\omary right of occupancy whether that customary right ofoccupancy is registered or not.

9. Thebasis for assesament of the value of any land andunexhausted improvement for purposes ofcompensation, undertheActshallbe the market value of such land.

10. The market value of any land unexhausted improvementshall be arrivedat by use ofcomparative methodevidenced by actualrecent, sales ofsimilar properties or by use of income approach orreplacement cost methodwhere the OTOPertY is of special nature and notsal.eable.

Ll, Every assessment of the value of land and unexhaust'ed.improvement for the purposes of the Act shall be prepared by qualifiedvaluer. .

12. Every assessment of the value of land and unexhaustcdimprovement for the purposes of payment of compensation byGovernment or Local Government Authonty slIall be verified by theChief Valuer of the Government or his re:presentative.

13 Compensation fOT loss of anyinterestin land shall includevalue of unexhausted imp!ovement disturbance allowance, transportallowance, accommodation allowance and loss of profits.

14. The market rent for the building shall be assessed andmultiplied by thirty six (36) months in order to arrive at theaccommodation allowance payabIr..

15. The net monthly profit of the business carried out on theland shall be assessed (evidenced by audited accounts where DC(:CSSary

and applicable] and multiplied by thirty six (36) rnunths in order to

arriveat the loss ofprofits payable.

19. (I) The interest uponany compensation shall be paid bythe Governmentor the local government authority only where there isno promptpaymentof comoensation made.

(2) For the purpose of computinginterestpayable uponcompensation "promptpaymentof compensation"means payment ofcompensationwithin six months after the subject land has beenacquiredor revoked.

0) Whereamountofcompensation remains unpaid for sixmonths after acquisition or revocation, interest at the averagepercentages rate of interest offered by commercial banks on fixeddeposits shall be recoveruble until such compensationis paid.

20. In cases to which sections 4 and 6 of the Act applies, theCommissioner shall serve a notice in the form set out in the FirstS:~1t..dule on the v;H"ge counci! and on Ill! pCI SOilS occupying landunder a customaryright of occupancy or a derivative right within the

area of land covered by a notice of proposal to transfer village land or,as the case may be, a notice to declare land as hazard land inviting thevilla~\; council and all SUch persons as are referred to in this regulationto submit claims for compensation.

21. A claim for compensation shall be submittedon II form .~etout in Part III of the First Schedule to these Regulations Within not lessIhaJJ s.ixly days of Ihe receiptof (henotice referredto in regulation20.

14.(1) V,7here the Commissioner determines not to accept aclaim for compensation, the claim may, if the claimant and theCommissioner so agree, be referred to a person appointed by theMinister to act as a mediator on the matter.

(2) Where the mediator is able to affect an agreementbetweenthe parties, he shall report the agreement to the Minister, au6 theCommissioner shall, within twenty one days of the receipt of the reportfrom the mediator, arrange for compensation to be provided to theclaimant.

(3) Where the mediator is unable, within ninety days ofn<>goti"ti.,., botwo~ tho pt>rlioo, to no"i"t the plU'ti"" to ........ b ""agreement on a claim for compensation or where the parties or one of\hem are unwilling to refer the claim to a mediator, the claim shall bereferred to the competent Court.

25. Compensation under sections 4 and 6 of the Act andregulation 13may takethe form of all or any ofthe following-

(a) land of comparable quality, extent and productivepotentialto the land lost;

(b) a building of comparable quality, extent and use withcomparableto the building lost;

(c) plants and seedlings;l<\) ace ~es \0 OOl1)ll1 unn1 0.1l30W;

(e) a sum of morley equal in value to tht'unexhaustedimprovements on the land transferred or declared to behazard land or to compensatefor the reduction in amountof land either through the loss of or damage to the landwhich can be used for productive purposes or to pay-forthe costs of disturbance brought about by the transfer ofthe land or the declarationofthe landas hazard land;

(t) regular suppliesof grain and otherbasic foodstuffs fora specifiedtime;

(g) such other forms of corapensation as may be agreedbetweenthe claimantand the Commissioner.

26. A proposalfor the joint management of village land betweentwo villagesor a villageand a .district councilor an utban authoritymaybe made by the Commissioner to the villagecouncilsand district couricilur urbau authority or by a village council to enother village council or to

any local authority or by any local authority to a village council withwhich it is proposed to establishsuch a joint management arrangement.

27. A proposalreferred to in Regulation26 shall be consideredand voted on by the village councils and the councils of the localauthorities.

28. Where a proposal is rejectedby any villagecouncil or localauthority a period of not less than threemonths shall elapsebefore thatproposal or a revised proposal may be brought forward forreconsiderationby the village council or local authority which rejectedthe-earlier proposal.

29. The village councils antl local authorities which vote ip.favour of establishing a joint management arrangement, shall eachappoint not less than three nor mOT\: than five persons to -a jointcommittee to develop thejoint managementarrangement.

30. Wherethe joint committee hasreached agreementon a draftJomt management J",."ngement, it shall be referred to the villageassembly and the council of the local authority for those bodies toconsider and vote on the arrangement.

31. A village assemblyand the council of a local authority maypropose changes in the draft joint management arrangement and anysuch proposed changes shall be referred to the joint committee for itsconsideration.

32,. A joint management arrangement shall not come into ·eff'eetunless and until each and every village and local authority involved inthe arrangement is agreed on the tenus of the arrangement and hasvoted to adopt the arrangement.

33. The jomt committee established to develop the jointmanagement agreementshall be responsible of the operationof the jointmanagement agreement and shall meet not less than once every threemonths to ensureits efficientand effective operation.

(b) the disposalofwaste on the land;(c) the protectionand conservation of any village land forest

reservesor other areasof forest managedby the village orotherspecialareas ofvillageland;

(d) the provisionof technical supportto the village to assist itin the management ofthe village land;

PART VREGISTER OF VILLAGE LAND

36. The Registershall be divided into the following Parts:

(a) Part A the Certificate of VillageLand;(b) Part B: the Title Register; and(c) Part C: the PublicChargesRegister.

37. (l) A Certificate of Village Land shall be in the formprescribed in the First Schedule and shall be kept in a separate folder inthe Register.

(2) The only entries that may be made on a Certificate of VillageLand are:

(a) alfp.rationo;: required to he made hy the C:ommi~~ioner torecordchangesin the boundaries of'the village land;

(b) entries to record parcels of land that have been excisedfrom or added to village land under the provisions ofsections4 and 5 ofthe Act;

38. (l) The Title Register shall be the register which contains -

(a) the record ofcustomary rights of occupancy ~ Section 1ofthe Title Register;

(b) the record of all derivative f!ghts -. SectjoIl 2 ofthe TitleRegister;

(c) the record of all dispositions and transactions involvingcustomary rights of occupancy and derivative rights,including any cillltions entered on the Title Register ­Section 3 of the Title Register.

(2) The Officer shall register jn the appropriate section of theTitle Register in the manner provided for in these Regulations alldocuments presented to him in the tonus prescribed in the FirstSchedule.

39. {l)The Public Charges Register shall be the register whichcontains--

(a) documents of surrender of a customary right ofoccupancy;

(b) orders ofabandonment ofland;(c) orders of !\Jmporary assigruueut of a customery right of

occupancy;(d) information concerning the payment and non-payment

of any rent, taxes, rates, fines or other dues payable toany public authority in conneerio» with the hoMing of a

customary rigllt of occupancy or II derivative right ortheoccupation of village land;

(e) documents recording the details of a land sharingarrangement;

(f) entries to record a decision by the village assembly orvillage council or other body with powers so to decidethat an area of viJJage land shall be. reserved for forestlise wild management or otherwise set aside forpurposes of conservation;

(g) entries to record that pQrt of village land set aside bydecision of the village assembly as communal villageland under section 13 of the Act.

(2) The Officer shall register m the l'UlJllC I,;narge;e; KeglsleI mthe manner provided for in these Regulations all documents relating tothe matters referred to in this Regulation presented to him in the formsprescribed in the First Schedule.

44. 47. (I) The Officer shall -

48. (I) Transactions in land which is held under a registereddocument shall take priority as between themselves according to the dateon which and the time at which they were registered in accordance withRegulation 40. '

(2) A transaction which is registered in accordance withRegulation 40 shall have priority over a transaction which has not beenregistered, whether the transacnon is registered before or after thetransaction which has not been registered was completed.

49. The Officer may refuse to register or enter into the register anydocument if-

(a) it is not in the prescribed form; or(l» th.. form or "thor doeurnent i .. co de£ective by virtue of

its being tom, stained, faded or partially destroyed thatit can no longer be understood; or

A party proposing to use a certified copy of a registereddocument in a civil case shall deliver a copy of the "certified copy to theopposing partyand such copy shall be received in evidenceiftheTnbunalor court is satisfied that the copy was delivered in sufficient time beforethe hearing in which it is to be used to enable the opposingparty to inspectthe original register from whichthe copy has been taken.

60. The Registry shall open to members at the public on suchdays, hours and intervalsas the Village Council shall determine.

PART VIADJUDICATION

.61. For purposesofsection 54 of the Act, the committee shall,in accordance with section 7(2) of the Act, give notice in a formprescribedin the First Schedule to these Regulations.

62.(1) The committee shall walk around the land. the subject ofadjudication tracing, ascertaining, verifYmg, determiningand marking theboundaryof the land.

76 (l) Until such time as orders have been made and publishedunder regulation 74, no village council may grant or agree to grant oragree to a disposition of a customary right of occupancy or create or agreeto the creation of a derivative right in village land or out of a customaryright of occupancy which exceeds twenty hectares or which would resultin a villager occupying land in excess of twenty hectares or the maximumamount of land held by a villager in that village whichever is the lesseramount without the consent of the District Councilor the Conunissioneras is provided for by this regulation.

(a) be guided by the principles of objectivity, fairness andjustice, giving consideration to, among ether things, therights and obligations of the parties, the customary andstatutory lawsandtraditional practiceson land,due regllFdbeing had to Constitutional provisions, and theCIrcumstances surrounding me matter mctU(\lJlg anyprevious dealings or disputes betweenthe parties;

(c) meet or communicate with the partiestogetherorseparately: .

(d) at any stage of the proceedings make proposals. eitherorally or in writing and with or without reasons for thesettlement of anydispute betweentheparties;

(6) as a result of mediation, when it appears that there areelements of an agreement or settlement which may beacceptable to the parties, formulate the terms of theagreement or settlement aruI explain the te:rrns to theparties and after receiving those comments from theparties, reformulate those terms taking mto accountthosecomments.

(2) Where an agreement or settlement hasbeen reachedbetweenthe parties; thecommillee or council as the case may be shall draw up awritten agreement which, once it has been signed by 1111 parties, shall bebindingon the parties.

?9.The forms set out in the First Schedule shall be the formswhich shall be used in connectionwith the exerciseof any functions underthe Act andthe Regulations tn which they refer.

80. The forms contained in the First Schedule to theseRegulations may be modified 'or altered in expression to suit thecircumstancesof every case; and any variation from such a form not beinga matter of substanceshall not affect its validityor regularity,

81. The fees which are specified in the third column of the SecondSchedule to these Regulations shall be the fees which are payable inrespect of any of tile activities specified in the first column of thatSchedule.

8:2. (1) Where any breach of condition of a customary right ofoccupancy stated in column 2 of the Third Schedule to these Regulationshas arisen the village council may impose a fine specified in column 3 ofthe said Schedule,

(2) The Village Council shall be at liberty to impose upon anoccupiera lesseramount than that specified in the Third Schedule.

83.Attestldion and execution of deeds shall be as provided underSection 63 of the Land Act 1999 and Section 91 to 94 of the LandRegistrationOrdinance, Cap. 334.
