Existing Development Plan

• Approved in 2013 (RZ13-07).

• Regency Gardens Apartment built in “Medium Density Residential” area in 2014.

• Current case (RZ20-24) seeks to create development opportunity for high-rise condominiums on “Market Village” area (10.29 ac.), referred to as “Innovation Condominiums”.

• Similar request (RZ20-15) was denied by City Council on September 8, 2020.

• September 2020: City staff/Galindo Group discussion about development plan that would regulate and ensure the realization of Mr. Galindo’s description of the project to the P&Z, City Council and marketing materials (e.g., Arabella, Houston).

• October 1, 2020: P&Z consideration and vote on two separate motions: one to recommend approval, and one to recommend denial of the request to the City Council.

• Both motions ended in a tie with four (4) votes in favor and four (4) votes in opposition, respectively.

• P&Z bylaws specify that the vote shall be considered an official action of making no recommendation to the City Council regarding this case.

Comparison: Staff Research vs. Applicant’s Request

Staff is concerned that the applicant’s proposed standards, followed at their minimum values, will not produce the buildings described, specifically the Arabella or the Innovation Condominiums described in the applicant’s marketing website and during previous statements made to the City Council.

Development Plan Components:

• Land use limited to high-rise residential condominiums, hotel, office and limited range of retail sales and service uses.

• High-rise condominium structures must be at least 10 stories tall, but no more than 170 feet in height (measured from base elevation at the center of pavement on adjacent W. Villa Maria Rd.)

• Maximum density: 35 units per acre.

• All construction activities within this District shall be supervised by a specific project architect of record.

• A qualified general contracting construction shall be responsible for the day-to-day oversight of the construction site

Development Plan Components:

• Traffic impact analysis (TIA) required

• The exterior appearance of each high-rise residential condominium building must be substantially the same as depicted.

• A landscape architect licensed by the State of Texas shall design, submit and supervise the construction of all landscape designs for any development project within this District.

• Applicant is requesting credit/fee waiver for the previous establishment of the Turkey Creek Conservation and Recreation Preserve for this project.

• Ordinary standards require $520 fee for each dwelling unit.

• Parks and Recreation Advisory Board recommends denying fee waiver (June 16, 2020).

Staff submits that the proposed development plan will:

• produce a high-quality mixed-use development featuring high-rise condominium residences;

• create development in a unique environment that makes use of the conservation of large natural spaces as an amenity; and

• create development that would become one of Bryan and College Station’s most recognizable features.

The proposal submitted with RZ20-24 is superior in quality to the previous submittal (RZ20-15) and the current development standards that govern the property (adopted in 2013).

The proposed plan is unique and supportable, based on its merits and sound planning principles.

• 180-foot right-of-way for West Villa Maria Road to the north

• flood hazard area to the east and south

• Traditions Club golf course green space located to the west

• The form and location of the land may not easily lend itself to low-density residential development.

• Higher-density residential development may a better alternative than what the existing PD-M zoning allows on the subject property.

• Planned development lies in an area that is considered one of the City’s higher growth areas due to its proximity to Riverside Parkway, the Health Science Center and the RELLIS campus.

• Staff recommends approving this request, subject to the condition that standard parkland dedication and development procedures apply to this project and that any reference to the City accepting the previous establishment of the Turkey Creek Conservation and Recreation Preserve in lieu of parkland dedication and development requirements of the Subdivision Ordinance be deleted from the development plan for this property.

The draft ordinance represents the applicant’s proposal and also includes the above-mentioned conditions recommended by city staff.
