c) Capacity 13,670 TPA. d) Mining Area 0-74-66 hectare (Private land, Hill slope). e) EMP Cost Capital cost: Rs. 4.0 lakhs, Recurring cost: Rs. 3.1 lakhs.

The proposed mining activity is of extraction of Stone from the proposed mine site. The bed rock has perfect bedding planes and joint pattern, therefore, the stone is easily split able with crow bar and use of hammer. The rock is very hard, therefore, the bench of 6*6 meter is proposed and can sustain. Natural parapet wall is to be left on the outer ring of the bench face to check rolling down of boulders.

The project proponent has submitted the maps, ID proof, Letter of Intent dated 19.03.2015, joint inspection report dated 05.06.2013, letter from Environment Engineer dated 23.09.2013, Land Revenue records dated 27.02.2015, approved working-cum-Environment Management Plan dated 28.02.2015, geological plan, letter from Mining Officer dated 26.02.2015, letter from DFO dated 01.05.2015, NOC from Gram Panchayat dated 28.02.2015, detail of air, water and noise.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee recommended the case application for consideration of grant of environmental clearance by the SEIAA, subject to prior fulfillment of following conditions and along with project 'Specific Conditions' as at Annexure-A and 'General Conditions' to be stipulated as at Annexure-B

- The project proponent shall submit affidavit/ undertaking to provide the sanitary facility i.e. Toilet in a nearest located Government School i.e. Rawala Kair, GSSS under proposed CSR activities.

- The project proponent shall submit the revised location plan depicting the nearby village locations and land use pattern.

- The project proponent shall submit the mining data, year wise production of previously carried out mining activity.

- The project proponent shall again work out the water consumption w.r.t. sprinkling of water on the haul road.

- The project proponent shall assess the impact of dust and _noise in connection with the nearby school which is located at 400 meters aerial distance.

- The project proponent shall submit revised proposal for plantation of species which are fast growing and endemic to the area.

As proposed the mining is confined to the manual extraction of stone from the hill. In total five benches are projected. The buffer zone of 7.5m around the lease boundary will be developed for green belt. The link road is passing through the lease out area hence mining is suggested up to 50 meter.

The project proponent has submitted the maps, corrigendum by Industry department dated 16.02.2015, approved working-cum-Environment management Plan dated 27.04.2011, geological plan showing surface features, letter of Intent dated 19.02.2015, Jamabandi, joint inspection report, letter from Mining Officer dated 11.08.2014, letter from DFO-Theog dated 11.02.2013, NOC from Gram Panchayat dated 12.08.2013, photographs of site, noise monitoring, soil samples results, ambient air quality, surface water sampling etc.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee recommended case application for consideration of project for grant of environmental clearance by the SEIAA, subject to prior fulfillment of following conditions and along with project .'Specific Conditions' as at Annexure-A and 'General Conditions' to be stipulated as at Annexure-B:

The lease area is private barren land. The lease area will be used for extraction of limestone. Mining will be carried out as by open cast manual method with drilling & blasting. Pits will be excavated up to the depth of 15-20m with benches of width 4m & height 3 m from 1496 to 1400 meters RL.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee decided that the case be listed in next meeting with the following observations:

- The project proponent shall submit NOCs from IPH & PWD. - The project proponent shall resubmit the revised pre feasibility report along with

dully filled Form-I. - The project proponent shall submit details of legal source of water.

2.4 Sh. Surinder Singh Jamwal, Mis Shankar Stone Crusher, Village & Post Office-Duhak, Sub-Tehsil-Thural, District-Kangra, H.P.

Brief outline of the project: a) Project type Extraction/ collection Sand, Stone & Bajri. b) Project Location Khasra number 837, 852, 853 in Mauza Alampur Mohal

Lahar Duhak of Sub Tehsil-Thural, Kangra, Himachal Pradesh.

The proposed project is open cast semi mechanized mining. No drilling and blasting has been proposed. As proposed the mined out material is to be crushed to make grit hence all the hard rock will be utilized in the crusher. The mining is proposed between 702 meters R.L. to 660 meters R.L.

The project proponent has submitted the documents like maps of site, NOC from Gram Panchayat dated 27.01.2010, letter from Mining Officer dated 19.02.2015, NOC certificate from DFO, Palampur dated 24.02.2015, joint inspection report dated 25.02.2010, affidavit regarding plantation, letter from Mining Officer dated 17.01.2015, NOC letter from I&PH department dated 30.03.2015, NOC letter from PWD department dated 23.02.2015, undertaking regarding legal source of water, grant of mining lease letter dated 24.03.2011.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee recommended case application for consideration of project for grant of environmental clearance by the SEIAA, subject to prior fulfillment of following conditions and along with project 'Specific Conditions' as at Annexure-A and 'General Conditions' to be stipulated as at Annexure-B:

- The project proponent shall submit NOC from IPH w.r.t. use of water from river. - The project proponent shall submit affidavit to plant Bamboo and Aamla trees in

the project site. - The project proponent shall submit affidavit/ undertaking to provide water cooler

with filtration in GPS Dugh under proposed CSR activities.

- The project proponent shall submit photographs of mining site from all the angles.

2.5 Sh. Abhishek Mahajan, S/o Sh. Jai Kumar Mahajan, Village-Bhambla, Post Office-Bhambla, Tehsil-Sarkaghat, District-Mandi, Himachal Pradesh.

Brief outline of the project:

a) Project type Extraction of Stone. b) Project Location Khasra number 1595 &1618 at Mauza & Mohal

Dhalwan/423, Sub-Tehsil-Baldwara, District-Mandi, Himachal Pradesh.

c) Capacity 19,345 TPA. d) Mining Area 00.93.39 hectare (Private land, hill slope). e) EMP Cost Capital Cost: Rs. l lakhs; Recurring cost: Rs. 0.80 lakhs.

The lease area is hilly slope. As proposed the method adopted for mining will be opencast manual method. Pits will be excavated up to the depth of 4 m with benches of height 4 m and ultimate pit limit will be 40 m i.e. from 1452 to 1412 meters reference level. Mining activity will not intersect ground water table as water table is present at 15 m bgl from the ground surface.

The project proponent has submitted the documents like Letter of Intent dated 09.07.2013, authority letter by proponent, letter from Mining Officer dated 10.03.2015, ecological features map, site photographs, joint inspection report dated 22.05.2012, NOC from Gram Panchayat dated 28.12.2011, affidavit by proponent regarding water source dated 30.04.2015 etc.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee decided that the case be listed in the next meeting with following observations:

- The project proponent shall submit photographs of well from which the water is proposed to be used alongwith information regarding water table, discharge etc.

- The project proponent shall submit affidavit to plant Bamboo and Aamla trees in the project site.

- The project proponent shall submit an undertaking/ resolution to provide the sanitary facility i.e. Toilet in a nearest located Government School/ Dispensary/ Panchayat Ghar clearly mentioning the name of that Government School/ Dispensary/ Panchayat Ghar under proposed CSR activities.

- The project proponent shall resubmit EMP with revised cost. - The project proponent shall submit NOC from IPH regarding shifting of water

supply pipe line from the mining site. - The project proponent shall submit NOC from nearby households. ·

The proposed project is a hill slope mining project for the mining project for the mining of stone located near Mauza/Mohal Vidhi, Tehsil-Baddi, Solan. During five year of mining total production useable material shall be approximately 93,100 tones.

The project proponent has submitted the letter from Department of Industries i.e. grant of mining lease dated 05.03.2011, joint inspection report dated 21.08.2010, approved working-cum-Environment Management plan dated 29.08.2011, letter from Mining Officer, Solan dated 11.03.2015, letter from DFO, Kunihar dated 16.03.2015, NOC from Gram Panchayat dated 28.06.2010, etc.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee recommended case application for consideration of project for grant of environmental clearance by the SEIAA, subject to prior fulfillment of following conditions and along with project 'Specific Conditions' as at Annexure-A and 'General Conditions' to be stipulated as at Annexure-B:

- The project proponent shall submit the data of mining with year wise production of previously carried out mining activity.

- The project proponent shall submit mining plan clearly showing approach road to the mining site.

- The project proponent shall submit the revised location plan depicting the nearby village locations and land use pattern.

- · The project proponent shall submit details of fast growing species which are endemic to the area and proposed to be planted in mining site.

- The project proponent shall resubmit EMP with revised cost. - The project proponent shall submit affidavit/undertaking to provide rain shelter

near Vidhi village under proposed CSR activities.

2.7 The Manager, Mis Su-Kam Power System Ltd. Plot No.7, Apparel Park-cum-Industries area, Katha, Baddi, Solan, H.P. Brief outline of the project:

The project proponent applied for assembling invertors. This additional activity does not come within the purview of SEAC. The proponent also stated that their Environmental Clearance which was granted in 2009 expired in 2014. The proponent has also submitted that their project falls under the category B-Item No. 3(a) of the Schedule specified under the Environment Impact Assessment Notification, 2006. While presenting the case during the appraisal of the application before SEAC the project proponent submitted that in view of the amendment in EIA notification dat~d 01-12-2009 the EIA, 2006 is not applicable in their case and therefore the SEAC may, therefore, give the necessary permission/ exemption from the EIA notification.

The committee after deliberating on the information submitted by the project proponent and considering the facts placed before the committee decided that project proponent may seek clarification w.r.t. primary and secondary metallurgical process from MoEF &CC, Gol and submit the same to the SEAC/ SEIAA for further decision in the matter.

2.8 Sh. Parminder Bansal, Mis Gupta Stone Crusher, Village-Malpur, P.O. & Tehsil-Baddi, District-Solan, Himachal Pradesh.

The proposed project is a hill slope mining project for the mining of stone located near Mauza/ Mohal Doduwal, Nalagarh, Solan. It has been proposed to collect 32,000 TP A. As proposed the mining will be done between 4 70 meters R.L. to 454 meters R.L. Within the lease area, open cast method of mining by bench formation 6*6 meters from top to bottom shall be followed.

The project proponent has submitted the maps of the area, letter from different departments like grant of mining lease dated 04.07.2011, joint inspection report dated 04.06.2011, Land Revenue records dated 17.11.2011, geological plan showing pit position, letter from Mining officer dated 31.03.2015, letter from DFO dated 04.04.2015 etc.

- The project proponent shall resubmit correct report with location of bore well. - The project proponent shall submit details of endemic and fast growing plants

proposed to be planted in mining site. - The project proponent shall resubmit EMP with revised cost (Recurring and non

recurring). - The project proponent shall submit the mining data, year wise production of

previously carried out mining activity. - The project proponent shall submit an undertaking/ resolution to provide the

sanitary facility i.e. Toilet in a nearest located Government School/ Dispensary/ Panchayat Ghar to the SEIAA clearly mentioning the name of that Government School/ Dispensary/ Panchayat Ghar under proposed CSR activities.

- The project proponent shall submit soil conservation plan. - The project proponent shall submit the revised location plan depicting the nearby

village locations and land use pattern.

The project was listed in 28th meeting of SEAC held on 17.06.2013, where, it was observed that the lease area is less than 5 ha, but located in Forest land, hence the project is categorized as B-1. The proponent shall prepare EIA as per standard Term of References (I'oRs) fixed vide item no. 4 of the minutes of 25'h meeting of SEAC subject to the condition that the proponent shall submit evidence that they have applied for Forest clearance and shall submit certificate issued by Forest Department that there is no protected area notified under Wild Life Protection Act, 1972 within 10 Km of the lease area.

After preparing the draft EIA (as per the generic structure prescribed in Appendix-II of the EIA Notification, 2006) covering the above mentioned issues, the proponent will get the public hearing conducted and take further necessary action for obtaining environment clearance in accordance with the procedure prescribed under EIA Notification, 2006.

Now, the project proponent has applied afresh for obtaining Environment Clearance as category B-2 project stating the application has been submitted as per amendments in EIA Notification.

The project proponent appeared before the committee and stated that they had applied as per earlier provisions of EIA Notification. But since now as per office memorandum issued by MoEF&CC, Gol dated 9th June, 2015, the project does not fall in purview of the provisions of said notification.

- The project proponent shall submit contour plan map of the project site. - The project proponent shall orient the presentation w.r.t. the environmental

competent authority. - The project proponent shall give details of plan proposed for conserving the

existing tree cover in and around the site. - The project proponent shall make plan for water balancing with provision for

optimum reutilization of waste water after treatment. - The project proponent shall provide the appropriate mechanism for the collection,

segregation, treatment and disposal of municipal solid waste. - The project proponent shall submit the number of vehicles proposed to be parked

in the parking area along with area detail. - The project proponent shall submit details of muck management plan, roof top

4.1 Observation of State Expert Appraisal Committee w.r.t. Survey documents of Minor Mineral Quarries prepared for various districts of HP by Department of Industries.

SEAC observed that during the process of appraisal of above mentioned category of projects i.e. Minor/Major Mineral Quarries in the State, the committee is not able to determine/ evaluate the cumulative impact on environment, since the cases are coming up for appraisal in isolation for different areas at different times. However, some time, it has been observed that there are many other mining leases which are adjoining to each other and therefore, may have adverse cumulative impact at a later stage and hence may require mitigation measures accordingly. The committee felt very strongly that it is of utmost importance at this stage, while considering/approving such cases of environmental clearances, the holistic view of such cluster be kept in consideration both qualitatively and quantitatively. It is, therefore, important that the Department of Industries (Geological

Wing) and this committee may sit together to deliberate on the issue at the earliest possible.

Based on above deliberations decided that the experts of Department of Industries (Geological Wing) may be requested to make a presentation before the Committee on the survey documents which have been prepared for Major/ Minor Mineral quarries at district level so as to ensure the mitigative measures are imposed/ taken accordingly.

4.2 Chairman expressed deep appreciation and gratitude to the members, Secretary of SEAC and staff of the Department of Environment, Science and Technology, Shimla, Himachal Pradesh for the sincere hard work, commitment and positive attitude in dealing with & considering the matters brought before the committee. Committee was able to achieve complete unanimity in the decision making process. The members and staff extended their full cooperation in conducting the business even during late hours. Chairman and Members also thanked to the Department of Environment, Science & Technology for arranging logistic support for meetings of the committee.

Annexure-' A'

Specific Conditions: i. Stone and Bajri is not allowed to be sold to crushers not having consent to establish and

operate and also not complying with the condition stipulated by State Pollution Control Board.

11. The project proponent shall obtain Consent to Establish and Consent to Operate from the Himachal Pradesh Pollution Control Board and effectively implement all the conditions stipulated therein.

m. Environment clearance is subject to final order of the Hon'ble Supreme Court oflndia in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004, as may be applicable to this project.

1v. Annual replenishment report certified by an authorized agency shall be submitted. In case the replenishment is low, the mining activity/ production levels shall accordingly be decreased/ stopped.

v. Effective safeguard measures shall be taken to control particulate matter level so as to ensure that these are within permissible limit.

vi. Regular monitoring of ambient air quality shall be carried out and records maintained. The results of monitoring shall be submitted to MoEF&CC and its Regional Office and CPCB, SPCB regularly.

vu. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of particulate matter such as loading and unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul roads. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the Central Pollution Control Board in this regard.

vm. The project proponent shall undertake adequate safeguard measures during mining and ensure that due to this activity the hydro-geological regime of surrounding area shall not be affected. Regular monitoring of ground water level and quality shall be carried out around the mine lease area by establishing a network of existing wells and installing new piezometers during the mining operation. The periodic monitoring [(at least four times in a year pre-monsoon (April-May), monsoon (August), post-monsoon (November) and winter (January); once in each season)] shall be carried out in consultation with the State Ground Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to the MoEF&CC and its Regional Office Dehradun, the Central Ground Water Authority and the Regional Director, Central Ground Water Board. If at any stage, it is observed that the groundwater table is getting depleted due to the mining activity, necessary corrective measures shall be carried out.

ix. The project proponent shall obtain necessary prior permission from the competent authority for drawl of requisite quantity of water for the project.

x. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and grease in the river from the vehicles used for transportation.

x1. Vehicular emission shall be kept under control and regularly monitored. The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded.

xn. No drilling and blasting operation shall be carried out.

xm. Mineral handling area shall be provided with the adequate number of high efficiency dust extraction system. Loading and unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated.

xiv. Periodical medical examination of the workers engaged in the project shall be carried out and records maintained. For the purpose, schedule of health examination of the workers should be drawn and followed accordingly.

xv. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

xvi. The project authority shall implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, Central Ground Water Board.

xvn. The project proponent shall undertake all the commitments made during the public hearing and effectively address the concerns raised by the locals in the public hearing as well as during consideration of the project, while implementing the project.

Annexure-'B'

General Conditions:

i. No change in mining technology and scope of working should be made without prior approval of the MoEF &CC.

11. No change in the calendar plan including excavation, quantum of mineral Sand, Gravel, Boulders (minor mineral) and waste should be made.

111. Four ambient air quality-monitoring stations should be establis)led in the core zone as well as in the buffer zone for RSPM (Particulate matter with size less than 10 micron i.e., PM10) and NOx monitoring. Location of the stations should be decided based on the meteorological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board.

iv. Data on ambient air quality should be regularly submitted to the MoEF&CC including its Regional office located at Dehradun and the State Pollution Control Board/ Central Pollution Control Board once in six months. Provisions contained in notification no. B-29016/20/90/PCI-I dated 18.11.2009 should be allowed for monitoring.

v. Fugitive dust emission from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and at transfer points should be provided and properly maintained.

vi. Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects.

vii. Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to dust and take corrective measures, if needed.

vni. A separate environmental management cell with qualified personnel should be set-up under the control of a Senior Executive, who will report directly to the Head of the Organization.

ix. The funds earmarked for environmental protection measures should be kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the MoEF &CC and its Regional Office located at Dehradun.

x. The project authorities should inform to the Regional Office located at Chandigarh regarding date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work.

xi. The Regional Office of this Ministry located at Chandigarh shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer ( s) of the Regional Office by furnishing the requisite data I information I monitoring reports.

xn. The project proponent shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard copies as well as by e-mail) to the MoEF&CC, its Regional Office Dehradun, the respective Zonal Office of Central Pollution Control Board the State Pollution Control Board. The proponent shall upload the status of compliance of the environmental clearance conditions, including results of monitored data on their website and shall

update the same periodically. It shall simultaneously be sent to the Regional Office of the Ministry of Environment and Forests, Chandigarh, the respective Zonal Office of Central Pollution Control Board and the State Pollution Control Board.

xiii. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parisad I Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

xiv. The State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and the Collector's office/ Tehsildar's Office for 30 days.

xv. The environmental statement for each financial year ending 31st March in Form-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of environmental clearance conditions and shall also be sent to the Regional Office of the MoEF &CC, Dehradun by e-mail.

xvi. The project authorities should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the MoEF&CC at http://envfor.nic.in and a copy of the same should be forwarded to the Regional Office of MoEF&CC at Dehradun.

Special Conditions:

i. The Project Proponents shall provide Water balance sheet to Authority.

11. The Project Proponent shall submit returns/ details of recyclable wastes, and other solid wastes which shall be generated from the process to the Authority regularly.

111. The Project Proponent shall obtain No Objection Certificate for ground water use/ installation of tube well from Central Ground Water Authority/ IPH Department. Proponent should have standby bore well. Long term sustainability of water shall be ensured.

iv. Proponent shall ensure the energy efficiency sheet by maximum possible use of renewable sources of energy. The solar lights, CFL, LED lights shall be used to reduce the requirement of the energy and shall apply all possible techniques to reduce the energy consumption. At least 50% of street lights should be solar lights and provision shall be made for installation of solar water heater.

v. The proponent shall provide dual plumbing system and entire treated sewage shall be reused for flushing in the toilets of the flats.

v1. Project Proponent shall ensure that there are proper arrangements for management of occupational health and safety in accordance with the law as required for machinery safety, personnel safety and health care, fire & explosion safety.

vu. The Project Proponents shall ensure that the planning of the proposed project is done in a manner that vehicular traffic flow in the public areas and roads is not restricted and dedicated parking for the complex users is provided.

viii. The Project Proponent shall obtain all the requisite approvals/ clearances/ NOCs as may be applicable to the Project from the competent authorities under different Acts/ Rules/ Regulation/ Order/Directions etc.

ix. The construction material such as grit/ bajri, sand shall be obtained from authorized dealers/ suppliers only and no illegal mining etc. shall be caused.

x. The Project Proponent shall consult the local office of the Department of Forests or any other such authorized agency, university, institution for types of trees should be planted for development of the green belt around the Project site. Preference should be given to ornamental plants.

xi. Keeping in view the labour to be employed during the construction phase arrangements to maintain hygienic conditions in the labour camps such as temporary toilets, fuel facility etc shall be made for which provision shall be made by the proponent.

xn. The Sewage Treatment Plant shall be designed and installed concurrent with the construction of the project as per the requirement. Collection sump for treated sewage shall be provided for reuse for flushing systems.

xm. The Municipal Solid Waste which shall be generated by the Project during the construction and operational stage shall be managed as per provisions of Municipal Solid Waste (Management & Handling) Rules, 2000 under Environment (Protection) Act, 1986.

xiv. Water sprinkling techniques shall be used during the construction phase to minimize the dust in air.

xv. The DG sets shall be provided with proper exhaust muffler and stack height. DG set and other fugitive emission sources shall be more than 10-15 feet above room level. Norms prescribed for DG Sets in the Environment Protection Rules, 1986 shall be complied with.

xvi. Institutional responsibility would vest with promoters for maintaining and operating the environmental services such as Sewage treatment Solid Waste treatment and disposal.

xvn. The muck generated during construction shall be disposed off in scientific manner by providing proper and adequate retaining structures.

xvm. All designing shall be done based on IS-1893 (Zone-V) considering the seismicity of the project area.

xix. In the event of any statement made by the project proponent or by its consultant being found false, this clearance shall automatically stand cancelled.
