The Procurement Edge News for the Professional in Public Purchasing 1 SE SE SE SEPT PT PT PT 2008 2008 2008 2008 So those of you who had the opportunity to go to the 63 rd Annual NIGP Forum in Charlotte, N.C., have already returned to your respective offices and are engaging those around you with the wonderful experiences and knowledge you learned while there. Certainly, you’ve taken bits and pieces you jotted down in the Plenary Sessions and are ready to “Maximize Your Potential” just like Steve Gilliland told you to do, and you’ve remembered the “Oz Perspective” when dealing with “Inclusion and Diversity” as we learned from Lenora Billings-Harris; and, we know about our “Sustainable Environment, Ethical Procurement Policy” from the session headed by Paul Warren and Jim Nicholson, and, we will never forget the nuggets of wisdom that we were charged with from Mike Lipkin’s session to “Live Above The Line”. Finally, we were all humored and shaken with the impact Ross Shafer left when he informed us at the Closing General Session that contrary to previous reports, “Nobody Moved Our Cheese.” So, how do we STAY CHARGED? How do we convert all of the networking experiences, all of the new knowledge, all of the new applications of old theories, all of the things we never thought of before, all those new ideas that are bouncing around looking for a place to plant themselves, to nurture and to blossom for yourself and those where you are? How do we make a difference in the attitude we have as Public Purchasers and the example we give those around us because we have a new PRO-CURRENT running through us? The answer is two simple words: DON’T DON’T DON’T DON’T STOP STOP STOP STOP ! Don’t stop Don’t stop Don’t stop Don’t stop believing in yourself and the contributions that you can give to your staff and those around you. Don’t stop Don’t stop Don’t stop Don’t stop networking with new and old friends that have found a different way to do the same thing a little bit better. Don’t stop Don’t stop Don’t stop Don’t stop striving to excel in your profession by becoming certified to the highest level you can achieve. Don’t stop Don’t stop Don’t stop Don’t stop participating in Chapter Educational Opportunities and NIGP sponsored events. Don’t stop Don’t stop Don’t stop Don’t stop seeking out the wisdom of our organizational leadership and tapping them for the wealth of knowledge that most of them would love to share, but, haven’t been asked to do so. Don’t stop Don’t stop Don’t stop Don’t stop expressing your enthusiasm for your profession, for your chapter, or for yourself, knowing that people tend to surround themselves with the people that are excited and positive and progressive in the way they conduct themselves… because that kind of energy is CONTAGIOUS. Don’t stop Don’t stop Don’t stop Don’t stop inspiring and being inspired. The sure fire way to stay charged after being part of such a motivating experience as the 63 rd Annual NIGP Forum in Charlotte, N.C., is to make those disciplines part of your normal day to day and in so doing, RE-CHARGING and keeping another professional on track to join the Winner’s Circle. ~Steve Sammons

November 19, 2008, may seem a little too far away to be thinking about, but, like Christmas, it will be here before you know it. So why is November 19th so important? This is the date of the CO-OPP Annual Luncheon and Election of Officers. The Nominating Committee is responsible to distribute information to the General Membership for the purpose of nominating a member(s) of the Chapter who is/are interested in holding an office on the Board of Trustees. The offices include, the Vice-President, Secretary, Treasurer and Member-at-Large. We are in receipt of some nominations, and it appears there will be some choices to make this year, which is a fantastic sign that there is a growing interest in the leadership of this organization. The Nominating Committee plans to distribute a slate of candidates for election to the Offices of the Board of Trustees by October 17, 2008. The Intergovernmental Cooperative Purchasing

Committee (I.C.P.C.) was created to reduce the costs of

goods and services by providing public entities with

opportunities for cooperative purchasing. The thought is

that by agreeing on competitive specifications and

contract terms and conditions for items of common usage,

participants can benefit from the combined strengths of

each other to get the best possible pricing for their

entities. Over the past several years, committee

members have shared contracts and information for FUEL,

PAPER, CELL PHONES, OFFICE SUPPLIES, and PLASTIC CAN

LINERS, to name a few.

That being said, a spirited group of twelve (12) interested

CO-OPP members, representing the State, City, County,

Airport Authority, the City of Westerville, Lake Metro

Parks, Columbus City Schools, Ohio State University, the

Mid-Ohio Regional Planning Commission (MORPC) and

COTA, gathered at MORPC on August 20th

, to discuss how

to reinvigorate the committee and participation in it.

Discussion was lively and optimistic from the various

agencies with a focus on the various restrictions they are

each having with regard to Cooperative Contracts.

Steve Hunter of the State of Ohio shared some highlights

from the Report of the Procurement Reform and the

changes it meant for State Purchasing. Karl Kuespert and

Chris Johnston from Franklin County spoke on the

restrictions they are experiencing in buying from other

entities bids. Dennis Carney expressed his concerns

regarding Schools and the restrictions they have with

purchasing from CO-OPP contracts, and, Barb Johnson of

the Airport Authority, lead the discussion on the need to

develop ways to reach our membership by showing the

benefits of Cooperative Purchasing and actively

supporting a Committee with a charge to make a

difference for our organization.

Bonny Rickerson, CPPB, COTA is the acting CO-CHAIR for

ICPC and has been the spark plug in the ICPC

Revitalization effort. There is still much to do and plans

for a fall presentation to the MORPC Board of Directors

are well underway. Take a minute and think about how

ICPC can help your entity AND definitely make plans to

join us at our next meeting, Tuesday, October 14th

Purchasing Certification Council’s (UPPCC) computer

based testing for CPPB and CPPO certification will begin

in OCTOBER 2008.

The NIGP WEBSITE www.nigp.org has an excellent

module on the home page simply called CERT PREP

CENTRAL. After you click on the icon bearing those

words, you will be directed to a page which shows you a

really cool outline and resource guide to get you moving

in the direction of getting certified.

Everything from what you need to do to prepare to

how long in advance you should begin to what

“Foundation Classes” will help you run the course

successfully, is included in this resource.

I’m writing this from experience, having been through

the excitement of the Charlotte Forum, when CO-OPP

won two of the three major individual awards and

placed in the third category (Chapter of the Year). I saw

the names of my peers rolling marquee on the big

screen, bearing their letters of CERTIFICATION and YES, I

am punching in to CERT PREP CENTRAL to join them.

The Government Accountability Office (GAO) is the audit, evaluation and investigative arm of the United States Congress. Often referred to as “the Congressional

Watchdog” and the “Taxpayers’ Best Friend”, this Office is charged with monitoring the use of public funds, evaluating federal programs and making recommendations to help ensure the effective use of government funds on behalf of the American people. Another function of this office, which affects the way we do our jobs, is hearing and making judgments on various bid protests filed by vendors who for a myriad of reasons are deemed unsuccessful in public procurement bid opportunities.

Here are a few GAO decisions to consider:

LUCENT TECH., WORLD SERVICES, INC., Case #B-295462, March 2, 2005. The vendor filed a protest arguing that the agency unfairly excluded it from participation in a procurement effort. The GAO DENIED the protest because the Contracting Officer reasonably determined that the protestor had an ORGANIZATIONAL CONFLICT OF INTEREST arising from its preparation of the technical specification used by the agency in the solicitation.

WareOnEarth Communications, Inc.,WareOnEarth Communications, Inc.,WareOnEarth Communications, Inc.,WareOnEarth Communications, Inc., Case #B-298408, July 11, 2006. The vendor filed a protest challenging the agency’s issuance of amendments changing the basis of price evaluation, concluding that he was not given a reasonable opportunity to file his protest before the

due date of the revised bid proposals. The GAO DENIEDDENIEDDENIEDDENIED the protest noting that the protestor received the amendments four (4) days before the revised bid proposals were due and declined to take into consideration the factors involved in filing a protest, (i.e., research and the complexity of the protest issues). Their failure to do so undermines the significance of the no-exception standard of timeliness rules. SOMETIMES, the best medicine is knowing what is and

what isn’t and running the roost on those standards.

The Commission is a diverse bipartisan body of six (6) members, appointed by the Governor and confirmed by the Ohio State Senate. Commission members serve staggered six-year tenures during which time they have the primary charge to administer the Ethics Law and related statutes that governs most public officials and employees at the state and local levels of government. Ms. Willeke, Ms. Willeke, Ms. Willeke, Ms. Willeke, is an advisory Attorney, expert on Governmental Ethics and highly acclaimed speaker on the subject of Ethics as it relates to public service. In light of recent local and national scandals by many noted Public Officials and Ohio’s current get tough position on Ethics, the message she brings is one that will impact all public servants, no matter what capacity of state, municipal and county government they work in.

The responsibility of Ethics in public procurement, and more importantly in every facet of public service, is one that directly impacts the public confidence of public offices, officials, and agencies who have the privilege to represent them. The Commission will continue to oversee compliance with the law and the education of those who work within its agencies.

FORUM NOTES FROM CHARLOTTE AND YOUR V.P. As I pitted, after a long race on the high banks of Lowe’s Speedway in Charlotte, N.C., I have been able to reflect on what this year’s forum meant to me, both, as a professional and as a member of CO-OPP. First, let me congratulate Barbara Johnson (National Manager National Manager National Manager National Manager of the Year)of the Year)of the Year)of the Year) and Gayle Blankenship (National Buyer of the YearNational Buyer of the YearNational Buyer of the YearNational Buyer of the Year). What an honor it is to see two of our own take these esteemed awards in the same year. What a statement it makes for our Chapter and most importantly Barb and Gayle. CO-OPP has had three (3) Buyer of the YearBuyer of the YearBuyer of the YearBuyer of the Year recipients, Jack Yost, Parshotan Lal Channa, and now, Gayle Blankenship. I was fortunate to be part of the Leadership Symposium on Saturday, July 26th. It was an all day event that discussed current trends, issues, and ideas for Chapters. Let me tell you, CO-OPP’s engine is revving at a much higher RPM than most Chapters. We are certainly on the front stretch of the race. The networking with folks is always my most enjoyable time at forums, which may have something to do with my shshshshy y y y personality. Anyways, the trends coming to Public Procurement include more bids by RFP, succession planning, cooperative procurement efforts, and, green initiatives, and, because of our own networking web, our entities will be on the right side tires of these trends and won’t need a “splash~n~go” or duct tape to finish the race. Though I am still a few months away from being your leader, I have a sense of anxiety and nervousness. Thanks to Mark Hutchison during his term as President, CO-OPP has been able to be re-energize and re-focus beyond the heights reached before him and filling his shoes will be a daunting task (especially since I only wear a size 10). When I think of the members of this organization that continue to give their time, effort, and dedication, through service on committees and volunteering efforts, I just shift into gear and know that everything will be fine. “The process by which the public purchaser

demonstrates a standard of compentency for the

benefit of public and themselves.” There are

currently three (3) levels of Certification available in

our organization. The Certified Professonal Public

Buyer (CPPB) is the first level, followed by the

Certified Public Purchasing Officer (CPPO) and the

most recent addition to the Certification family, the

Executive Certificate in Public Procurement (ECPP).

All of these levels of certification express a

combination of work experience, coursework in

procurement, dedication to the profession, and

formal education. The UPPCC website, accessible

from the NIGP Education tab, has a PDF file of the

new 2008 Body of Knowledge that is exceptional for

CPPB/CPPO Examination Preparation.

The core of continuing educational opportunities for

NIGP members. Over 100 total classes, some of

which are scheduled at various venues/chapters

throughout each year. A complete listing is

available on the NIGP website in a spreadsheet

appropriately called, “The Guide”. It contains the

Course name, the Continuing Educational Units

(CEU’s), the contact hours and the UPPCC

recertification points you have and/or will earn by

attending.

Distance learning, at your own pace, in your own

confines, on your PC, at a time that is convenient to

you is the ideal way to hone your skills, creatively

train your staff, and encourage lively discussion

amongst your peers. There are also some online

graduate courses in public procurement being

offered through Florida Atlantic University (FAU),

which can be accessed from the NIGP Website.

With the use of a computer and phone, you can

participate in a 90 minute live workshop from your

desk, focusing on topics which cover the pulse of our

organization. You can ask questions, particpate in

discussions and interact with your instructor and

other classmates from around the country, all while

earning certification points. These sessions are

limited and require a registration process for

scheduling purposes.

LOCAL OPPORTUNITIES: At the time of this printing, there were no more

CPPB and/or CPPO Examination Preparation Classes

being offered in 2008, with the exception of a CPPO

Webinar (see bullet on this page).

The Franklin County Board of Commissioners is comprised of three elected Commissioners who are given charge for the management and direction of the 33rd largest County in the United States. Commissioners Marilyn Brown (President), Mary Jo Kilroy, and Paula Brooks, have collectively administered a budget of over $1.25 billion to protect and preserve the high quality of life that continues to reward Franklin County with national regard for sound fiscal planning, leadership and overall business practices, ranking it among the very best in our Country. The Board is responsible for the operation of some of the most important agencies for our citizenry: Animal Care and Control, Child Support Enforcement, Economic Development & Planning, Fleet Management, Human Resources, Job and Family Services, Homeland Security and Justice Programs, Office on Aging, Public Facilities Management, Purchasing Department and Sanitary Management. Our Spotlight this month falls on a keynote player in a very efficient and active Purchasing Office, responsible for the generation of over 200 competitively bid contracts and more than 12,000 Purchase Orders in excess of $200 million of non-payroll expenditures. Jennifer L. Fair is a Senior Purchasing Coordinator, with a concentration in Information Technology, a position she has held for the last 2+ years of a 16 year career with the County. In 2001, while working with Franklin County Children’s Services (FCCS), Jennifer received the Franklin County Children’s Services Bright Idea of the Year Award, for her work on the creation and completion of the Farewell to Franklin Village Event. Just the beginning of her honors, Jennifer was again honored in 2002 by FCCS, with the Franklin County Children’s Services Employee of the Year (Indirect Services), an achievement marking her continued success and professional excellence. In her purchasing endeavors, Jennifer has been directly involved in the coordination of a wide array of bids from Senior Options Services, which provides our older citizens with their rights to community based programs and care giving services enabling them the quality of life they deserve, to Software programs to keep our Sheriff’s offices current with the technological advances they need to do their jobs. A graduate of Westland High School, Jennifer has one son, Joey, age 9, who commands the best of her quality family time. She enjoys camping and bargain shopping in her spare time and hopes to continue her natural progression with the County, accepting each challenge as a new opportunity to keep Franklin County at the pinnacle of our nation’s County Governments, ranking in the top 5, as one of the best managed counties in America.
