While innovation will be supported throughout the whole programme, the third pillar on Open Innovation will essentially focus on scaling up breakthrough and market-creating innovation, also by establishing a European Innovation Council, support the enhancement of European ecosystems of innovation and continued support to the European Institute of Innovation and Technology (EIT).

Some of these features could be achieved, not only by the EIC but also through traditional instrument (i.e. Fast track to innovation, SMEs instruments which we would like to be maintained)

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 173(3), Article 179, Art 180, Article 182(1), Article 183, and the second paragraph of Article 188

We are surprised that the fundamental articles of TFUE related to research are missing

To deliver scientific, economic and societal impact in pursuit of this general objective, the Union should invest in research and innovation through Horizon Europe - a Framework Programme for Research and Innovation 2021-2027 (the ‘Programme’) to support the creation and diffusion of high-quality knowledge and technologies, to strengthen the impact of research and innovation in developing, supporting and implementing Union policies, to support the uptake of innovative solutions in industry and society to address global challenges and promote industrial competitiveness; to foster all forms of innovation, including breakthrough innovation, and strengthen market deployment of innovative solutions; and optimise the delivery of such investment for increased impact within a strengthened European Research Area.

Important to underline the impact on civil society, which is too much diluted by the market deployment

We do prefer to enlarge the scope: the competitiveness of the whole Union not only of its industry

Such engagement by industry should see its participation in the actions supported at levels at least commensurate with those under the previous framework programme Horizon 2020 established by Regulation (EU) No 1291/2013 of the European Parliament and the Council ('Horizon 2020').

Such engagement by industry should see its participation in the actions supported at levels at least commensurate with those under the previous framework programme Horizon 2020 established by Regulation (EU) No 1291/2013 of the European Parliament and the Council 20% of the total combined budget for the specific objective of the Pillars 2 & 3.

For the sake of clarity in a legal text would be better to fix an amount (percentage), instead of recalling other (previous) Regulation. The proposed percentage is the same established in Horizon 2020.

RECITAL 11 pag 18

The OECD definitions regarding Technological Readiness Level (TRL) should continue, as in the previous Framework Programme Horizon 2020, to be taken into account in the classification of technological research, product development and demonstration activities, and the definition of types of action available in calls for proposals. In principle grants should not be awarded for actions where activities go above TRL 8.

In principle Horizon Europe grants should not be awarded for actions where fund activities go above TRL 8.

We do not see Horizon Europe as the right envelop to find actions above TRL 8, which are directly ready for the market. Beside the remits given by the Article 182 TFUE, a check of compliance with the State Aid rules is envisaged.

Moreover from recital 15 to 26 the word “research” occurs 1 time only!! (recital 26)

the scientific community calls for FET instruments to maintain their identity, be continued under pillar 1 as in the past and not transformed into Pathfinder and Accelerator.

The aim described in the recital does not belong to FETs open that have been framed into pathfinder and accelerator.

As for recital 10, we do prefer to enlarge the attractiveness and competitiveness to the whole Union (not only economic and industrial)

It is necessary to establish the minimum conditions for participation, both as a general rule where the consortium should include at least one legal entity from a Member State, and with regard to the specificities of particular type of actions under the Programme.

This provision should be in the articles instead in the recitals

RECITAL 44

It is appropriate to establish the terms and conditions for providing Union funding to participants in actions under the Programme. Grants should be implemented taking into account all forms of contribution set out in the Financial Regulation, including lump sums, flat rates or unit costs, with the view to further simplification

This provision should be in the articles instead in the recitals

“it is appropriate” it’s not a legal definition

RECITAL 48

Pag 24

The current system of reimbursement of actual personnel costs should be further simplified building on the project-based remuneration approach developed under Horizon 2020 and further aligned to the Financial Regulation

This provision should be in the articles instead in the recitals

We don’t see appropriate in a legal text to recall provisions of previous Framework Program. A legal text should be self-standing, especially for the newcomer.

Program Structure

(1) Pillar I 'Open Science', pursuing the specific objective set out in Article 3(2)(a) and also supporting specific objectives set out in Article 3(2)(b) and (c), with the following components:

(a) the European Research Council (ERC);

(b) Marie Sbrodolowska-Curie Actions (MSCA);

(c) research infrastructures.

(2) Pillar I 'Open Science', pursuing the specific objective set out in Article 3(2)(a) and also supporting specific objectives set out in Article 3(2)(b) and (c), with the following components:

(a) the European Research Council (ERC);

(b) Marie Sbrodolowska-Curie Actions (MSCA);

(c) research infrastructures.

(d) Future Emerging Technologies (FET)

FET has been and currently is one of the most appreciated instrument by the scientific community and which paves the way towards industrial competitiveness.

Displacing FET under the Pillar 3 distorts its very nature. Nor the rebranding in “pathfinder” and “accelerator” is appropriate to the FET target.

Moreover, the evaluation process could be affected by an inappropriate assignation of the proposals.

paragraph 4 new (pasted and modified from the “Decision on establishing the specific programme”)

Up to five missions, including the new FET Flagships emerging under Horizon 2020, with specific goals will be identified and launched within the pillar, starting from 2023,

establishing a comprehensive portfolio of projects, but also drawing on relevant activities and

outputs from other parts of the programme. The specific provisions on missions are set out in Article 5 of the “Decision on establishing specific the programme”.

It is fundamental to define the number of missions for a strategic long-term planning, establishing the order of magnitude for the budget to be allocated to each mission.

Missions

paragraph 5 new (pasted and modified from the “Decision on establishing the specific programme”)

“Ideas for Missions” will be collected via public consultation and finally decided and co-designed as part of the Horizon Europe strategic planning process, which will include a collaborative effort by relevant Commission DGs, Member States, the European Parliament and relevant stakeholders.

Commission DGs to ensure links to Union policies. The members of the missions’

board will normally be appointed by the Commission, following an open call for expression of interests, and taking into account the need for balance in expertise, gender, age and geographical distribution. However, if appropriate, existing governance structures could also be used as members of the missions’ board.
