SUBJECT: FY15/16 Work Plan Status Report RECOMMENDATION: The Commission receives the work plan status report. BACKGROUND: Each year the Commission adopts a work plan that includes anticipated applications as well as other administrative activities. The work plan for FY 2015-2016 was developed during the annual budget process. DISCUSSION: As we continue our progress to complete the projects identified in our work plan we can report progress on the updates to the MSR for the cities of Suisun City and Benicia. LAFCO staff is working with staff from Suisun City and Benicia to share the workload by assuming responsibility for five of the seven chapters in the MSR. We have encouraged city staff to develop the sections on present and planned capacity and the financial sections since they have that information. The City of Suisun City will be updating their sphere and Benicia is working on annexations that will be coming before the Commission. Staff received the administrative draft of the MSR and is awaiting responses to comments for additional information before it can be considered a Draft document. We received an application from SID for the detachment of portions of Brighton Landing including a detention basin, owned by the City of Vacaville, but outside city limits. Staff is reviewing the application for completeness and referral letters have been sent to affected agencies. We are processing an application for the detachment of a section of McGary Rd. from the City of Fairfield. The detachment is part of an agreement between the City and the County whereby the City would oversee repairs needed as a result of the landslide on Red Top Road. Once

repairs were complete the County would resume road maintenance responsibilities. One of the issues raised is who would provide emergency services to that section of Interstate 80 and McGary Rd. The City and the Cordelia Fire Protection District have an automatic aid agreement. However in order to maintain that agreement primary responsibility needs to be shifted to the District. Staff is working with the applicant and the District to resolve that issue so the detachment can go forward. We have been processing the Rural North Vacaville Water District (RNVWD) sphere of influence update. The SOI will include those parcels that receive water for fire hydrants from the District and pay an assessment. We anticipate the Commission will hear the SOI update at the March 21 meeting. On January 4 Solano LAFCO issued an RFP for the MSR update for the Fairfield-Suisun Sewer District and the Greater Vallejo Sanitation and Flood Control District. We received one proposal from SWALE Inc. Staff along with representatives from the two sewer districts reviewed the proposal and determined it was acceptable. Staff contacted references who confirmed that SWALE would be able to complete the MSR and provide a report of high quality. The Commission will be asked to authorize the Executive Officer to enter into a contract for the MSR. Work is to begin on May 1. Staff continues to support CALAFCO. At the November 13 CALAFCO Board of Directors meeting Michelle McIntyre was appointed as one of the alternates to the CALAFCO Legislation Committee. Michelle has been attending meetings and will be presenting an oral report. In addition the Executive Officer was requested by CALAFCO to assist CSDA with a guide to district formation. The Draft of the formation guide is complete and is expected to be available in June or July of this year. Completed

Recommendation: That the Commission receive and file this report. As of the filing deadline on February 19 two thousand and eighty six bills have been introduced, 705 in the Senate and 1,381 in the Assembly. CALAFCO sponsored SB 1266 (McGuire) which requires JPA’s that provide municipal services to file a copy of the agreement with their LAFCO. This will provide LAFCO’s with needed data on services provided in their county. There is no intention for LAFCO to assume any authority over JPA’s. Also of interest is SB 817 (Roth) which provides for the state to return the VLF lost to ERAF for cities that incorporated between January 1, 2004 and January 1, 2012. Not as great an impact but an impact none-the-less is the loss of VLF from annexation of islands to cities. There are no provisions for back payments for lost revenue, but the bill does reinstate future payments beginning in the 2016/17 year. Similar bills were passed in the last session SB 25 and SB 69 which were vetoed by the Governor. CALAFCO has taken a support position on this bill and requested member LAFCOs to lend their support as well. AB 2277 (Melendez) also addresses the loss of VLF with annexations. One other bill to monitor is SB 1262 (Pavley). The bill would require a city or county that determines a project is subject to CEQA to identify any water system whose service area includes the project site and any water system adjacent to the project site. If a water source for a proposed project includes water that doesn’t meet drinking water standards, additional information must be included in a water supply assessment. If no water system is identified, the bill would require a city or county to prepare a technical report containing prescribed information.

This is a CALAFCO sponsored bill with a number of amendments pending that should have been included when the bill was introduced. The intent is that all stand-alone JPAs, as defined in GC Section 56047.7, which includes a member that is a public agency as defined in GC Section 56054, and is formed for the purposes of delivering municipal services, shall file a copy of their agreement (and a copy of any amendments to that agreement) with the LAFCo in each county within which all or any part a local agency member’s territory is located.

Summary: As introduced, this bill is identical to AB 448 (Brown) from 2015 and AB 1521 (Fox) from 2014. This bill reinstates the VLF payment (through ERAF) and changes the way that the growth in the VLF adjustment amount (property tax in lieu of VLF) is calculated starting in FY 2016-17 to include the growth of assessed valuation, including in an annexed area, from FY 2004-05 to FY 2015-16. Beginning in FY 2017-18, the VLF adjustment amount would be the jurisdiction's annual change in the assessed valuation.

Summary: As introduced, this complicated bill makes a number of changes to GC Section 66473.7 and Section 10910 of the Water Code. In 66473.7, in the definitions section, the bill adds definitions pertaining to the use of groundwater by a proposed subdivision as the source of water. It adds an adopted groundwater sustainability plan as optional substantial evidence that the water system has sufficient water supply to meet the demands of the subdivision project. The bill adds that a groundwater basin identified by the State Water Resources Control Board (SWRCB) as a probationary basin is not considered a viable water supply. In Water Code section 10910, the bill makes the following changes: If no water system that is within or adjacent to the service area of the project site is identified as a viable source of water for the project, the city or county shall prepare a technical report that includes five factors. Based on this report, if the city or county determines that it is feasible for a water system to provide water to the project, the city or county shall submit the technical report to the local LAFCo with jurisdiction over the project. If the LAFCo denies the annexation or extension of service then the city or county shall develop a water supply assessment as outlined in section 10910.

SB 1263 (Wieckowski D) Public water system: permits.

Summary: As introduced, this bill would prohibit an application for a permit for a new public water system from being deemed complete unless the applicant has submitted a preliminary technical report to the state board, as specified, and would allow the state board to impose technical, financial, or managerial requirements on the permit. The bill would prohibit a public water system not in existence on January 1,1998, from being granted a permit unless the public water system demonstrates that the water supplier also possesses adequate water rights to ensure the delivery safe drinking water, and would specify that the prohibition applies to any change in ownership of the public water system, including the consolidation of a public water system. The bill would allow the state board to deny the permit if the state board determines that the service area of the public water system can be served by one or more currently permitted public water systems. Finally, the bill would prohibit a local primacy agency from issuing a permit without the concurrence of the state board.

Summary: As introduced, this bill amends GC Sections 56133, 56425 and 56430. To begin, the bill would prohibit a LAFCo commission from authorizing a city or a district to extend drinking water or wastewater infrastructure or services until it has extended those services to all disadvantaged communities within or adjacent to its sphere of influence, as specified, or has entered into an agreement to extend those services to those disadvantaged communities, unless specified conditions are met. Further, it prohibits the commission from approving a sphere of influence (SOI) update where there exists a disadvantaged unincorporated community (DUC) within or adjacent to the city or special district’s SOI that lacks safe drinking water or wastewater infrastructure or services unless specified conditions are met. would prohibit commissions from authorizing a city or a district to extend drinking water or wastewater infrastructure or services until it has extended services to all disadvantaged communities within or adjacent to its sphere of influence, as specified, or has entered into an agreement to extend those services to those disadvantaged communities. The bill would additionally prohibit a commission from approving an annexation to a city or qualified special district of any territory greater than 10 acres, or as determined by commission policy, where there exists a DUC within or adjacent to the SOI of a city or special district that lacks safe drinking water or wastewater infrastructure or services, unless the city or special district has entered into an enforceable agreement to extend those services into the DUC as specified. The bill would define “qualified special district” to mean a special district with more than 500 service connections. The bill changes, when determining a SOI, the assessment of the feasibility of a reorg of agencies and recommendations of reorg of those agencies when it is found to be feasible, to a mandate (changes 56425 (h) from "may" to "shall"). Further, it adds (k), prohibiting a commission from approving a SOI update that removes a disadvantaged community from a city’s sphere of influence unless a majority of the voters in the disadvantaged community approve of the proposed SOI. The bill adds several requirements in GC Section 56430 relating to Municipal Service Reviews. First, it changes (b) to mandate the commission to assess various alternatives relating to the efficiency and affordability of infrastructure and delivery of services; and changes (c) to mandate the commission to include a review whether the agency being reviewed is in compliance with the CA Safe Drinking Water Act. This bill adds a number of mandates to LAFCos.

Summary: Would authorize a city council, located in an existing or newly formed district as specified, to adopt a resolution requesting that appointments of persons to the board of trustees instead be made by a city selection committee, established pursuant to specified provisions of law, and conditioned upon a majority of authorized city councils adopting their respective resolutions. This bill would authorize the city selection committee to decrease the total number of appointments to be made by the committee if a majority of city councils within the district make this request in their respective resolutions.

SUBJECT: MID-YEAR BUDGET STATUS & END OF YEAR PROJECTION FISCAL YEAR 2015-2016

RECOMMENDATION: The Commission receive and file this report. DISCUSSION: The mid-year budget status and end of year projection provides an overview of LAFCO’s expenses and revenues through December 31, 2015 as well as an end of year projection of expenses and revenues for the current fiscal year. The Commission’s adopted operating budget for the current year is $394,235. This included $124,655 for salaries and employee benefits, $269,580 for services and supplies. At mid-year, expenditure totaled $161,014 which represents approximately 41% of the adopted budget. Funding of LAFCO’s budget came from several sources. The County and the seven cities provided $334,186 of LAFCO’s operational costs which represents approximately 85% of the budget. The sources of the remaining income, came from anticipated revenues from changes of organization proposals, anticipated interest income, the Commission’s reserve fund, and fund balance from the prior year. In June 2015, the Commission amended its reserve policy to 20% of the operating budget, thus reducing the reserve from approximately $98,900 to $78,900. The Commission’s intent was that $20,000 would be used to help fund fiscal year 2015-16, specifically the Commission’s legally mandated service review or the contracted services budget line item. Additionally, it was anticipated that the fund balance from the prior fiscal year (2014-15) was $24,550 was used to help fund fiscal year 2015-16. About halfway through the fiscal year, staff learned of an additional fund balance account of $40,271. Discussions with regard to how to allocate the remaining fund balance and any other fund balance from the current fiscal

year will take place at the time the Commission adopts a preliminary and final budget in April and June respectively. Below is an overview of LAFCO’s expenses and revenue for the midyear budget projection.

• Salaries and Employee Benefits: The Commission’s adopted budget for this category was $124,655. At the end of the second quarter $63,621 has been expended on salaries, benefits, workers compensation insurance, and unemployment insurance. This represents approximately 51% of the total amount budgeted for this category. The difference can be attributed to retirement costs and health insurance costs which were slightly higher than anticipated. At the end of the fiscal year, it is anticipated the total cost to salaries and benefits will be $125,432 or approximately $775 higher than budgeted.

• Services and Supplies The adopted budget for this category totaled $269,580. At the end of the second quarter, expenditures under the services and supplies category totaled $97,393. This represents approximately 36% of the total amount budgeted. However, staff anticipates that at the end of the fiscal year, total expenditure for services and supplies will be $248,020 which represents approximately 92% of the total budgeted amount in this category. Of note in this category include:

o Expenditure for general liability insurance is $1,137 less than anticipated, as a

result of leasing office space from the County. Additionally, the Commission budgeted $1,000 which was included within the building lease budget line item for any costs associated with use of the County’s conference rooms. To date, the County has not billed LAFCO for these costs.

o Expenditures related to office supplies and postage is $2,500 less than anticipated.

o Expenditure associated with training, travel, and mileage is $6,200 less than anticipated as a result of less than normal attendance at CALAFCO workshops, conferences, and other CALAFCO classes. In addition, much of the CALAFCO Legislative Committee meetings were available by conference call.

o Expenditure associated with contracted services is $10,000 less as a result of the municipal service studies costing less than anticipated.

Revenue: For this category, the term “revenue” is broadly used to encompass all sources of funds used to finance LAFCO’s total expenditure. Total anticipated revenue for the current fiscal year was $394,325. At mid-year, total revenue realized was $380,603 representing 96% of the budgeted amount. By year end, staff is projecting total revenue will be approximately $392,000. Sources of revenue include the following:

• Other Governmental Agencies – The County and the seven cities have paid their legislatively apportioned share totaling $334,186.

• Licenses and Permits (Applications) – The Commission collects fees associated with changes of organization applications. Each year, staff estimates revenues from applications based on upcoming projects. Many projects take several months to complete and while the proposals are being processed, fees are deposited into the Commission’s deferred revenue line item and later transferred to the licenses and permits line item once actual costs are realized. At mid-year, the Commission had transfered $1,187 within the licenses and permit budget line item; however, staff anticipates at the end of the fiscal year, total revenue from applications will be over $12,000 based on ongoing existing proposals.

• Interest Income – The Commission currently uses the County Treasury to invest its funds. At mid-year, the Commission earned $680 and anticipates earning $1,000 by year end or approximately two times the budgeted amount.

• Reserve – At the beginning of the fiscal year, the Commission amended its reserve policy to 20% of the operating budget. As a result, the Commission transferred $20,000 to the Commission’s operating budget leaving a balance of $78,898 in the reserve fund.

• *Fund Balance – The fund balance represents the carry-over from the prior year’s budget. For

the current fiscal year, it was anticipated the fund balance from the prior year would be approximately $24,550, based on the difference between revenues and expenses from the fiscal year. At mid-year, it was discovered the fund balance account included an additional $40,271 from previous years. The fund balance will be reviewed as part of the Commission’s 2016-17 budget.

CONCLUSION: The Commission continues to be financially sound; revenue exceeds expenditure. The total fund balance remaining at the end of the current fiscal year will be considered as part of the following year’s budget. At this time, staff is not recommending budget adjustments, however; if re-appropriations are needed prior to the end of the fiscal year, staff will submit requests to the Commission at the June meeting. RECOMMENDATION: The Commission receive and file the mid-year budget status and end of year projection.

SUBJECT: Cordelia Fire Protection District Sphere of Influence Update RECOMMENDATION: Staff recommends the Commission approve the sphere of influence update subject to the conditions as outlined in the attached resolution. That includes the following actions:

1) Update the sphere of influence of Cordelia Fire Protection District. 2) Adopt the attached Notice of Exemption (NOE).

BACKGROUND: In December 2015 the City of Fairfield submitted an application to detach from their boundaries approximately 75 acres along McGary Road and Interstate 80 between Red Top Rd and Lynch Rd. The proposal area currently receives fire protection services from the Fairfield Fire Department and from the Cordelia Fire Protection District (CFPD) via an automatic aid agreement. In anticipation of the Commission considering the City’s change of organization request, per policy, all affected agencies (including CFPD) will need a current municipal service review (MSR) and SOI. The City of Fairfield has a current MSR/SOI while the CFPD has a current MSR, but has an out of date SOI. Updating the SOI for CFPD will allow the Commission to consider future change of organization proposals such as the McGary Road project. Discussion: At this time, staff is recommending a coterminous SOI for the CFPD (Exhibit A). The MSR determined that while the CFPD has sufficient capacity to provide adequate services to its present service area

through mutual and automatic aid agreements, any growth in demand would require additional funds. Thus future annexations would require identification of addition funding such as development impact fees to ensure adequate capacity and resources to continue to provide the current level of services. ANALYSIS: As part of the SOI update, the Commission is required to consider and prepare written determinations addressing the factors enumerated in G.C. §56425. The factors include: 1) present and planned land use, 2) the present and probable need for public facilities and services, 3) the present capacity of facilities and adequacy of services, 4) the existence of social or economic communities of interests, and 5) the present and probable need for facilities and services of any disadvantaged unincorporated communities. It should be noted some of these factors were addressed in CFPD’s latest MSR and are summarized in the appropriate sections below. SOI Determinations: (1) The present and planned land uses in the area, including agricultural and open-space lands. Portions of the CFPD’s boundary are located within the SOI of the Cities of Fairfield, Benicia, and Vallejo. However, the CFPD’s entire boundary and proposed SOI are unincorporated lands and under the sole land use jurisdiction of Solano County. The Solano County General Plan establishes the land use designations for the CFPD’s boundary and proposed SOI. Thus, the present land use information is based on the County General Plan. The majority of the District’s land use is designated agriculture; the area captures the District’s most northern boundary then along the western portion of the District’s boundary, and finally south toward the City of Benicia’s city limits. Portions of the District’s boundary, mostly in the Green Valley area is designated rural residential with some mixed use traditional communities. The District’s boundary also includes park and open space designations mostly in the Green Valley vicinity as well as Lynch Canyon located southeast of the intersection between Highway 12 and Interstate 80. There are also industrial designations along Interstate 680.

Planned land use in the District’s boundary and proposed SOI includes some rural residential proposals. There are proposed developments in Green Valley and in Rockville Corners (Woodcreek), within the District’s boundaries. Build-out of these projects may yield approximately 460 new residential dwelling units and would slightly increase demand for the District’s services. However; as noted portions of the District’s boundary is within the SOIs of the cities of Fairfield, Benicia, and

Vallejo and any city annexation of these areas will reduce the District’s service area as well as property tax revenues.

(2) The present and probable need for public facilities and services in the area.

The MSR found the District’s population is projected to increase from 2,597 in 2010 to 2,800 in 2020. It is anticipated that demand for service within the CFPD will increase minimally, as any growth demand generated by population growth will likely be balanced by city annexations of district territory. In addition, the MSR discussed the present services provided by the District.

Services Provided

Figure 1 details the services provided by CFPD. If a service is not provided by CFPD, but is offered by another agency, it is indicated in the figure. Resources from Cal Fire provided outside the state responsibility area (SRA) are provided on a mutual aid basis. Availability is dependent upon fire activity, time of year, and other factors.

CFPD provides services outside of its boundary area through an automatic aid agreement with the City of Fairfield Fire Department. In addition, the District maintains a master mutual aid agreement with Solano County fire providers, and on occasion may respond to areas within another agency’s

boundary.1 CFPD participates in strike teams comprised of other county agencies, which may on occasion respond around the State.

The District has an automatic aid agreement with Napa County Fire Department for the SR 12 (Jamison Canyon) corridor. Additionally, to the northwest of CFPD is an area that does not have a local fire provider, which is designated as being within Cal Fire’s jurisdiction, where the District provides fire services when necessary and provides permit services. Similar to all other fire protection districts in the County, CFPD contracts with the County Sheriff’s Office for dispatch services.

(3) The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide. As previously noted, some of the information needed for the determinations the Commission is required to consider in the SOI can be found in the District’s MSR. The MSR provided the following determinations.

• The District reported that it had sufficient capacity to provide adequate services to its present service area through mutual aid agreements. Any growth in demand would require additional funds, likely in the form of development impact fees, to ensure adequate capacity and resources to continue to provide the current level of services.

• It appears there is marginal capacity to provide adequate services to the existing service area based on the condition of the District’s facilities and CFPD’s response times.

• Both of the District’s stations are in fair condition, which constitutes a capacity constraint. Station 31 reportedly has the most significant needs, as it is in need of a roof repair and mold removal from the living and sleeping quarters. Different long-term solutions are being considered to address these needs; however, financing constraints limit the extent of any capital improvements or replacements.

• CFPD identified the need for a new facility in the southern part of the District; however, due to financial constraints, a schedule for construction has not yet been determined.

• With regard to vehicles and equipment, an Environmental Protection Agency regulation requires that all tier 0 diesel engines be replaced or upgraded by 2016. However, CFPD does not presently have sufficient funds to replace the affected vehicles.

• CFPD services appear to be adequate. The District has minimally adequate response times and an ISO rating which is comparable to other providers in the County. CFPD response times slightly exceed the NFPA 1710 response guidelines and meet the SEMSC EMS response time standards. There are certain areas along the periphery of the District where there can be longer response times depending on traffic.

• District management methods appear to generally meet accepted best management practices. The District prepares a budget before the beginning of the fiscal year, conducts annual financial audits, maintains current transparent financial records, tracks employee and district workload, and has an established process to address complaints. CFPD could improve its management practices by conducting more formalized long-term capital planning and updating its 10-year goals and objectives.

(4) The existence of any social or economic communities of interest in the area if the commission determines that they are relevant to the agency. There are four census designated places (CDP) located within Solano County including Green Valley CDP which is entirely located within the CFPD’s boundary. According to Census data, the population for Green Valley CDP in 2010 was 1,625 which represent approximately 63% of the total population within the District’s boundary and proposed SOI. In 2012, the median household income for the Green Valley was $139,474 which is significantly higher than the State’s median household income. Therefore, while the Green Valley CDP may be considered a community of interest, it is not a disadvantaged unincorporated community. (5) For an update of a sphere of influence of a city or special district that provides public facilities or services related to sewers, municipal and industrial water, or structural fire protection, that occurs pursuant to subdivision (g) on or after July 1, 2012, the present and probable need for those public facilities and services of any disadvantaged unincorporated communities within the existing sphere of influence. Disadvantaged Unincorporated Community (DUC) is defined as an inhabited territory (12 or more

registered voters) with an annual median household income that is less than 80 percent of the statewide annual median household income. There are no DUC’s within the proposed sphere. Other SOI Considerations: When adopting, amending, or updating a sphere of influence for an existing district, the commission shall establish the nature, location, and extent of any functions or classes or services provided by existing districts. In relation to fire protection agencies, the California Department of Forestry and Fire Protection (Cal Fire) provides services throughout the State. Generally, Cal Fire services are focused in wildland areas defined as State Responsibility Areas (SRA). Similarly, the United States Forest Service (USFS) also provides services in California, primarily within forests and grasslands. Areas where USFS services are provided are defined as Federal Responsibility Areas (FRA). A majority of the territory within CFPD is considered high and moderate fire hazard SRA territory where Cal Fire has responsibility for wildland fires. Cal Fire also provides technical support throughout the County in the form of specialized services such as fire suppression handcrews, dozers, and helicopter services when necessary. CEQA The California Environmental Quality Act (CEQA) requires that an environmental review be undertaken and completed for the SOI study. Staff is recommending the Commission finds the proposed SOI update qualifies for a General Rule Exemption from further CEQA review. The General Rule Exemption is based upon CEQA Regulation §15061(b)(3), which states: “The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.” Since there are no land use changes, or changes in services, or environmental impacts, a Notice of Exemption is appropriate (Exhibit C). CONCLUSION: Staff recommends a coterminous SOI for the CFPD. Through analysis via the District’s MSR, it was determined that while the CFPD has sufficient capacity to provide adequate services to its present service area through mutual and automatic aid agreements, any growth in demand would require additional funds. As such, staff is not recommending extending the District’s SOI beyond its current existing

boundary. STAFF RECOMMENDATIONS: Staff recommends the Commission 1) approve the proposed resolution to update the sphere of influence for the CFPD. 2) The Commission, acting as the Lead Agency under to CEQA, adopts the attached NOE.

WHEREAS, the Solano Local Agency Formation Commission (LAFCO) is required to

amend spheres of influences of local governmental agencies whose jurisdictions are within Solano County in accordance the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (CKH Act) Government Code Section (G.C. §) 56000 et. seq.; and,

WHEREAS, CFPD provides fire protection, emergency medical services and other fire

related services to approximately 2,597 residents in a 56 square mile area in the unincorporated area of Solano as described in the municipal service review; and

WHEREAS, pursuant to G.C. §56425 and the adopted Sphere of Influence (SOI) Policy of

the Solano LAFCO, the LAFCO is required to update the SOI update every five years or as necessary; and,

WHEREAS, the SOI of the Cordelia Fire Protection District (CFPD) is due for an update;

and,

WHEREAS, the notice of the public hearing was published and mailed 21 days prior to the public hearing in accordance with the CKH Act; and,

WHEREAS, the Commission received and considered all written and oral testimony at

said public hearing; and, WHEREAS, the Executive Officer prepared an analysis and staff report including written

determinations for the proposed SOI; and, WHEREAS, the proposed SOI is coterminous with district boundaries; and WHEREAS, the Commission acting as the lead agency certifies the action is exempt from

CEQA under the General Rule Exemption section §15061(b)(3) of the CEQA Guidelines and that a Notice of Exemption is appropriate to comply with CEQA.

PROPOSAL SUMMARY: The Rural North Vacaville Water District (RNVWD) has submitted a request by agency resolution to update their existing sphere of influence (SOI) to include parcels that are currently receiving water for fire hydrants only. The update would expand the District’s existing SOI which is coterminous with their boundary. The District has demonstrated ample water supply for those in their existing boundaries and those receiving water for fire hydrants. The RNVWD has additional capacity to be able to serve future customers. DISCUSSION: On January 14, 2014, the RNVWD Board approved Resolution 2014-20 requesting LAFCO initiate a Sphere of Influence Update and subsequently submitted an application to LAFCO. However, before LAFCO can update an agency’s SOI, LAFCO is required to conduct a municipal service review (MSR). Through the MSR, LAFCO is able to collect data and provide some analysis of service provision by each city and special district within LAFCO’s legislative authority.

In February 2015 the Commission approved a MSR for the RNVWD and made several determinations including:

• The District currently serves a population of approximately 1500 persons. • The District is able to meet the service demands of its customers. • The District was in the process of updating its rates to meet increasing expenses. • The District had a financial reserve policy to cover shortfalls.

Furthermore, the Commission recommended the District develop a Capital Improvement Plan to integrate SCADA and generator replacements, arsenic treatment, meter replacement every 3-5 years, and provide for a replacement plan or reserves for replacing fire hydrants. Upon adoption of the MSR, the Commission has sufficient information to establish or update an agency’s sphere of influence. A sphere of influence (SOI) is defined as a plan for the probable physical boundaries and service area of an agency. LAFCOs are legislatively mandated to develop and, as necessary, review and update SOIs for all cities and special districts under their legislative authority every five years. The Commission is also required to enact policies designed to promote the logical and orderly development of areas within the sphere (G.C. §56425). According to the Commission’s Sphere of Influence Policy, the SOI of an agency shall be used by the Commission as one of several factors for its changes of organization/reorganization decisions. The Commission’s SOI Policy states that not all lands within a SOI will be eventually annexed; however, before the Commission will consider an annexation proposal, the area must first be within an agency’s SOI and the SOI must have been adopted within the last 5 years. RNVWD serves an unincorporated area north of the City of Vacaville. The District’s service area is comprised of the areas along Cantelow Road, English Hills, Gibson Canyon, and Steiger Hill. RNVWD is a community water system that runs on two wells drilled to a depth of 1,400 feet, each having a capacity of 500 gallons per minute. Well 2 has been placed on emergency standby, as the average arsenic concentration has been consistently above the State’s mandated limits. Well 1 remains the only source for reliable production. The water system also includes two 300,000 gallon tanks with two booster pumps each that pump 250 gallons per minute. As noted, RNVWD has one active groundwater source (Well 1) and one emergency standby groundwater source (Well 2). Both wells are located at the end of Buena Vista Lane, approximately 1,000 feet apart. Hydro-geologically, the wells are located in the Solano subbasin of the Sacramento County Valley groundwater basin.

RNVWD’s water distribution system was constructed to support a maximum of 533 water service connections. RNVWD currently serves 394 customers with active water connections; the remaining connections are not active, but have been allocated. Some of the property owners who own property within the District’s boundary with active connections purchased additional “supplemental connections” or water rights. To date, there are 101 supplemental connections. The remaining 38 connections fall within the category of reservations. Some customers were allowed to reserve connections to be paid at a later time. At the end of February 2016, the 38 reservations are set to expire and will be returned to the District. Existing District Boundary: The District’s current boundary, (as shown in exhibit A) includes those customers who have active water connections. They receive both domestic water and water for fire hydrants. Those parcels are considered to be located within Zone 1. The Fire Protection Zone or Zone 2 includes those customers who only receive water for fire hydrants. The District is proposing to include in their SOI those customers who are within Zone 2,, shown on Exhibit A in red. Proposed SOI: The Districts proposed SOI, includes all of the Fire Protection Zone or Zone 2. The District’s proposed SOI is limited to those parcels in Zone 2 because the District potential service area is limited by their existing infrastructure. Additionally, the parcels within the proposed SOI are presently receiving services from the District. While there are 231 parcels in Zone 2, the District can only serve an additional 139 connections.. Therefore not every parcel located within the District’s proposed sphere will be able to annex to the District. Location within the District’s SOI does not guarantee eligibility for annexation, it is one of several factors the Commission must consider in its decision making process. In order for new customers to receive services from the District, specific conditions must be met including compliance with Solano County land use policies. Some of these conditions include:

• The property must be located within the District’s immediate vicinity due to infrastructure constraints.

• They must purchase a connection and as previously stated there remain 139 available connections.

• If the property is located outside the District’s boundary, they must also request annexation to the District.

ANALYSIS: GC §56425 Written Determinations: Pursuant to G.C. §56425, the Commission must make written determinations on the five factors below when establishing or updating a proposed sphere:

1. The present and planned land uses in the area, including agricultural and open space lands.

Exhibit A shows the present boundaries of the District as well as the proposed SOI. The District’s boundary and proposed SOI, is adjacent to the City of Vacaville. The District is located immediately northeast of the City’s boundary and sphere of influence. The RNVWD’s proposed SOI does not extend to the City of Vacaville’s Planned SOI nor does it extend to the City’s voter approved urban growth boundary. However, the District’s existing boundary and planned SOI was included as part of the City’s General Plan planning area. The District’s boundary and proposed SOI lies within the unincorporated portion of Solano County. According to the County General Plan’s land use designation, the majority of the area within the RNVWD’s boundary and proposed SOI is designated as rural residential. A portion of the southwesterly area and the northernmost areas of the District’s boundary are designated as agricultural. Exhibit B provides more detailed information regarding those parcels proposed for inclusion within the District’s SOI. The majority of the parcels within the proposal area are currently developed with single family residences; however, many of the areas are not currently developed to the maximum density allowed by the County’s General Plan. County Zoning in the District proposed SOI varies from Rural Residential 2.5 acres, Rural Residential 5 acres, and Ag 20. The total acreage for the proposed SOI is 1,440 acres of which approximately 1,066 acres are zoned rural residential and 374 agricultural.

2. The present and probable need for public facilities services in the area.

The District was formed in 1996 to address inadequate water sources in the area. Since District formation, LAFCO has received several annexation requests. The purposes of the annexation requests varied from needing to comply with the County’s General Plan (as a result of parcel subdivision) to needing a more reliable source of potable water. In the near future it is likely that landowners may want to subdivide and need a reliable source of potable water.

3. The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide. The California Department of Public Health (CDPH) requires the RNVWD to have sufficient storage and source capacity to meet the Maximum Day Demand (MDD). According to CDPH, the MDD in 2012 was 0.494 million gallons. Total production capacity of Well 1 (active well) is approximately 0.648 million gallons per day (MGD). An additional emergency source capacity of 0.648 MGD can be supplied by Well 2. RNVWD has approximately 0.6 million gallons in storage capacity, which is greater than the MDD. The CDPH, in its published report, determined that RNVWD has sufficient water available to meet its MDD. While the data is from 2012, it should be noted that according to the California Department of Water Resources (DWR), 2012-2014 was one of California’s driest consecutive years in terms of precipitation and the data collected by CDPH falls within this time frame. Given that the District has sufficient capacity even during drought years the District should have sufficient capacity in normal and dry years.

4. The existence of any social or economic communities of interest in the area if the commission determines that they are relevant to the agency. The RNVWD is bordered by the City of Vacaville to the south and the Allendale Census-Designated Place (CDP) to the north. As previously noted, the District’s service area is not located within the City’s planned SOI or the voter approved urban growth boundary and as such, there are no indications the City will be providing urban services to RNVWD service area. Also as previously noted, the RNVWD’s potential service areas are limited by their existing infrastructure and also by the number of connections the District is allowed. As a result, the RNVWD cannot extend services to the Allendale CDP.

5. For an update of a sphere of influence of a city or special district that provides public facilities or services related to sewers, municipal and industrial water, or structural fire protection, that occurs pursuant to subdivision (g) on or after July 1, 2012, the present and probable need for those public facilities and services of any disadvantaged unincorporated communities within the existing sphere of influence.

Disadvantaged Unincorporated Community (DUC) is defined as an inhabited territory (12 or more registered voters) where the area has an annual median household income that is less than 80 percent of the statewide annual median household income. Pursuant to the 2010 Census, the annual median household income was estimated at

$81,398 for the zip code that includes all of the RNVWD and its proposed sphere. Since the state median household income is $61,632 the District’s zip code median household income exceeds 80 percent of the statewide median household income. Therefore the area within the boundary of the RNVWD and the sphere does not qualify as a DUC.

California Environmental Quality Act (CEQA): SOI are projects subject to environmental review under CEQA. On January 14, 2014 the RNVWD Board approved Resolution 2014-20 requesting LAFCO initiate a Sphere of Influence Update. The District filed a Notice of Exemption on April 20, 2015. LAFCO staff subsequently noticed affected agencies on April 30, 2015. The statutes of limitations for Notices of Exemptions filed after 5 days of agency adoption is 180 days pursuant to G.C. 15112(c)(5) or October 27, 2015. LAFCO serving as the responsible agency must accept a CEQA determination of the lead agency, the District, or assume lead agency responsibility. As LAFCO has not received any comments on the proposed SOI and the action is non-controversial, staff does not recommend assuming lead agency status. Staff is recommending the Commission review and consider the information contained within the Lead Agency’s Notice of Exemption is adequate for the purpose of this application. STAFF RECOMMENDATION: Staff recommends the Commission 1) approve the proposed resolution to update the sphere of influence for the RNVWD. The sphere of influence of the RNVWD shall include those parcels shown in Exhibit A. In addition, staff recommends 2) the Commission, acting as a Responsible Agency pursuant to CEQA, certify that it has reviewed and considered the Notice of Exemption filed by the RNVWD.

amend spheres of influences of local governmental agencies whose jurisdictions are within Solano County in accordance the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (CKH Act) Government Code Section (G.C. §) 56000 et. seq.; and,

WHEREAS, every determination made by the Commission must be consistent with the

spheres of influence (SOI) of the local agencies affected by those determinations in accordance with G.C. §56375.5; and,

WHEREAS, the Rural North Vacaville Water District filed an application with Solano

LAFCO to update its sphere of influence; and

WHEREAS, the notice of the public hearing was published and mailed 21 days prior to the public hearing in accordance with the CKH Act; and,

WHEREAS, the Commission received and considered all written and oral testimony at

said public hearing; and, WHEREAS, the Executive Officer prepared an analysis and staff report including written

determinations that concluded the SOI of the Rural North Vacaville Water District (RNVWD) shall be updated; and,

WHEREAS, the Commission acting as the responsible agency certifies it has reviewed

and considered the Notice of Exemption prepared by the RNVWD acting as the lead agency under CEQA.

NOW, THEREFORE, BE IT RESOLVED that pursuant to G.C. §56425 the Commission

makes the following determinations: a) The present and planned land uses in the area, including agricultural and open-space lands.

Exhibit A shows the present boundaries of the District as well as the proposed SOI. The District’s boundary and proposed SOI lie within the unincorporated portion of Solano County. According to the County General Plan’s land use designation, the majority of the area within the RNVWD’s boundary and proposed SOI is designated as rural residential. A portion of the southwesterly area and the northernmost areas of the District’s boundary are designated as agricultural. The majority of the parcels within the proposal area are currently developed with single family residences; however, many of the areas are not currently developed to the maximum density allowed by the County’s General Plan. County Zoning in the District proposed SOI varies from Rural Residential 2.5 acres, Rural Residential 5 acres, and Ag 20. The total acreage for the proposed SOI is 1,440 acres of which approximately 1,066 acres are zoned rural residential and 374 agricultural.

b) The present and probable need for public facilities and services in the area.

The District was formed in 1996 to address inadequate water sources in the area. Since District formation, LAFCO has received several annexation requests. The purposes of the annexation requests varied from needing to comply with the County’s General Plan (as a result of parcel subdivision) to needing a more reliable source of potable water. In the near future it is likely that landowners may want to subdivide and need a reliable source of potable water. In addition there are 139 connections available that may need services as well.

c) The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide.

RNVWD’s water distribution system was constructed to support a maximum of 533 water service connections and the District has adopted a program to allocate those connections to property owners and thereby limit the demands on the system. All of those have been allocated. RNVWD currently serves approximately 394 customers with active water connections; the remaining 139 are not active. The RNVWD municipal service review found no capacity issues. The California Department of Public Health (CDPH) requires the RNVWD to have sufficient storage and source capacity to meet the Maximum Day Demand (MDD). According to CDPH, the MDD in 2012 was 0.494 million gallons. Total production capacity of Well 1 (active well) is approximately 0.648 million gallons per day (MGD). An additional emergency source capacity of 0.648 MGD can be supplied by Well 2. RNVWD has approximately 0.6 million gallons in storage capacity, which is greater than the MDD. The District has sufficient capacity in normal, dry, and extended dry years.

d) The existence of any social or economic communities of interest in the area if

the commission determines that they are relevant to the agency.

The City of Vacaville and the Allendale CDP which is located adjacent to the service area of RNVWD may be considered a community of interest.

(e) For an update of a sphere of influence of a city or special district that provides public facilities or services related to sewers, municipal and industrial water, or structural fire protection, that occurs pursuant to subdivision (g) on or after July 1, 2012, the present and probable need for those public facilities and services of any disadvantaged unincorporated communities within the existing sphere of influence.

Disadvantaged Unincorporated Community (DUC) is defined as an inhabited territory (12 or more registered voters) with an annual median household income that is less than 80 percent of the statewide annual median household income. The subject area does not meet this definition.

NOW, THEREFORE, BE IT RESOLVED AND ORDERED that Sphere of Influence Map, included herein as Exhibit A, designating the Sphere of Influence, is hereby adopted by the Commission.

SUBJECT: Financial and Payroll Services Staff Recommendation

1) Direct staff to submit a letter to the Auditor that we intend to terminate the agreement in 90 days as specified in the MOU.

2) Authorize the Executive Officer to sign a contract with the City of Vacaville for an amount not to exceed $14,400 for financial, payroll and human resource services and $7,300 for setup charges.

Background:

Cortese-Knox-Hertzberg Section 56375(k) provides that LAFCO ‘s can contract for professional services to carry out and effect the functions of the commission. LAFCO is also an independent agency as Section 56380 states that the commission shall make its own provision for quarters, equipment, supplies and personnel.

Accordingly in 2009 LAFCO entered into a separation agreement with the County. One of the provisions in that agreement allowed LAFCO to enter into a MOU for county services. To date we have an MOU for IT services, Human Resource services, Audit services, and Financial and Payroll services. For the most part these agreements are working well. However our agreement with the Auditor’s office for Financial and Payroll services has had some issues.

• Auditor’s Staff Authorizing Transfers from LAFCO Accounts to the Auditor’s Account for Services.

Over the last year we received an email that a Journal Voucher had been completed for the transfer of funds for financial services in FY 2014-15. Rather than requesting the Executive Officer’s signature it was signed by a County employee in the Auditor’s office on behalf of the

Executive Officer. Of concern was that the amount was higher than the amount in our agreement as well as bypassing LAFCO’s oversite of expenses. Only after the Executive Officer objected was LAFCO forwarded a Vendor Claim for approval in the correct amount. Even though this practice was reviewed by the Auditor and there was a commitment not to repeat this practice LAFCO later received a note that there was a Journal Voucher signed by a County employee on behalf of the Executive Officer for payment of the cost of our most recent audit. Once again after our objection an invoice was sent with a Vendor Claim for the Executive Officer’s approval.

• Underfunding LAFCO in FY 14-15 CKH also provides for LAFCO to transmit our annual budget to the Auditor for billing the cities and County for LAFCO operating expenses. Staff noticed the financial statements for as early as February of 2015 that revenues were only 85% of the budgeted amount or $312,158 instead of $350,795. The initial reaction was that one of the cities had not made their contribution. The Executive Officer contacted the Auditor and learned that she decided to only bill the cities at 85% of the adopted budget. She stated we had a fund balance that she was monitoring and thought she had discretion to be sure the amount in the fund balance was not too high. The Executive Officer had to explain that it was the Commission that has the discretion not the Auditor.

• Implementation of the 2% COLA for the analyst In February the Finance Committee agreed to include a 2% COLA in the budget for our Analyst. That amount was approved by the Commission in the Preliminary budget in April and the Final Budget in June. The Auditor refused to process the pay increase and apparently had a meeting with the three supervisors who sit on the Commission. A member of the Auditor’s staff told us we needed a PAF. However the form requires the approval of the Human Resources (HR) Director. The Executive Officer sent a note back that requiring the HR Director’s approval allowed him to approve or disapprove an action of the Commission. We reminded the Auditor’s staff we were not a County department and would not be including a PAF. It came down to whether the Commission approved the change in the PSR, which we did in August. Then the issue became whether we really intended to increase our Analyst pay by 2% because we had Y rated her pay.

We then agreed to hear the issue in closed session on the October agenda. According to the Brown Act if a public agency meets in closed session and agrees to take action it must report out in open session and take a vote in open session. At our October meeting one of our Commissioners asked if we could just vote in open session and asked for staff’s recommendation. Legal Counsel who was in attendance did not disagree. The Executive officer stated the recommendation was to grant the LAFCO Analyst a 2% COLA retroactive to July 1 when the increase was approved for the FY15-16 budget.

Six weeks and three pay periods passed. We inquired again about processing the COLA. The Executive Officer received a call from HR staff asking where this item was on the agenda. We replied it was in closed session and she could view the agenda on our website. Finally the Executive Officer received an email from the Director of Human Resources that he could not approve the COLA because we violated the Brown Act. Our response was to explain the closed session process, what had transpired, and the MOU with the Auditor’s Office did not reference approval by any other department or reference standard County procedures. The overriding issue appears to be that the Auditor treats LAFCO as another County Department rather than as an independent agency.

• Adjusting Reserves by $20,000 as determined by the Commission for FY15/16 In addition despite numerous discussions and emails it still appears that the Auditor still feels she has discretion over LAFCO funds. In reviewing our financial statement for November we noticed our revenues were only at 50%. When staff inquired we found that it was the County’s share that had yet to be transmitted. In previous years it was transmitted in September. Failure to transfer the County’s share may have cost LAFCO interest revenue since interest is paid based on cash on hand.

At the same time staff noticed that reserves hadn’t been reduced by the $20,000 that was to be transferred to contract services. The contract services amount was correct, however it appeared the amount was transferred from the fund balance rather than reserves. Staff resubmitted our budget letter to the Auditor, the resolution adopting the budget, plus the resolution amending our reserve policy to be sure there was compliance with the Commission directive.

Recommendation:

The undeniable conclusion from what has transpired is that LAFCO should find an alternate service provider. Staff has received proposals from the City of Vacaville, O’Connor Accounting Services, Kathy’s Bookkeeping, and several payroll service providers, Paychex, ADP, and Wells Fargo.

Our existing MOU with the auditor’s office allows for either party to terminate the agreement by providing 90 days’ notice. Therefore staff also recommends the commission to direct the Executive Officer to notify the Auditor of our intention to terminate the contract in 90 days.

The City of Vacaville provides payroll services for Solano Transportation Authority and is familiar with government accounting processes. Vacaville would provide service for basic accounting, payroll and human resources to work with enrollment changes for medical, retirement and other benefits. Their proposal would require the payment of stipends with a deduction for federal, state, and workers compensation. LAFCO would issue a W-2 at the end

of the year instead of the 1099. At present Commissioners receive a 1099 which makes them responsible for their fair share of federal and state taxes. The contract with the City of Vacaville would be for $7,300 for setup and $14,400 for financial and payroll services. Staff recommends the commission authorize the Executive Officer to enter into a contract with the City of Vacaville for payroll and financial services.

Recommendation: That the Commission authorize the Executive Officer to enter into a contract with SWALE Inc. for the Municipal Service Review for the Fairfield Suisun Sewer District and the Vallejo Sanitation and Flood Control District for an amount not to exceed $26,850.

Background: When the Commission approved the workplan for FY15/16 one of the top

priorities with regard to Municipal Service Reviews was an update to the 2006 Solano LAFCO Sewer MSR. Cortese-Knox-Hertzberg requires updates to the MSR be completed every five years. The last service review was completed in 2006. Besides the fact the MSR is more than five years old the legal requirements have changed. Instead of nine areas to review there are now seven, including the new section on disadvantaged unincorporated communities (DUCS). Should there be any proposals for a change of organization or a sphere of influence update there would need to be an updated MSR in order for LAFCO to process the application.

Discussion: To meet the needs staff issued a request for proposals on January 4,

2016. The RFP was emailed to five consulting firms which had experience completing wastewater service reviews. Although the original due date was January 29 the deadline was extended to February 5 at the request of one of the consultants. The RFP was also posted on our website.

Staff received one proposal from SWALE Inc. for $26,850. The FY 15/16 budget includes $40,000 for studies. Should the Commission authorize funding this proposal there are sufficient funds in the budget to fund the wastewater district study. The proposal was reviewed by a committee consisting of LAFCO staff and a representative from each of the wastewater districts. The proposal was found to be responsive to the RFP. SWALE Inc. has had experience with providing wastewater MSRs to Nevada LAFCO. A check of references confirmed that they produced a high quality service review, on time and within budget.

Recommendation: Staff has reviewed this proposal and found the scope of work and the

proposed level of effort to be sufficient to complete the MSR. Staff recommends the Commission authorize the Executive Officer to enter into a contract with SWALE Inc. for an amount not to exceed $26,850.

The meeting was called to order at 1:30 pm. All members were present. Michelle Heppner from County Exec’s office was also in attendance along with Michelle McIntyre LAFCO Analyst.

1. Communications from the public. There were no communications from the public.

2. Mid-year budget review The Committee reviewed the mid-year budget projections. There was a question about why the fund balance and the reserves were not posted. As of January 5, 2016 the reserves were $78,898 and the available fund balance was $40,271.19. Staff was directed to revise the spreadsheet to include those figures. There was also a question about unfunded liabilities and whether the fund balance should be used for that purpose or refunded to the contributing agencies. The Committee was asked if the mid-year budget was of sufficient concern to have it included as the only item on a February LAFCO agenda. The Committee thought it might be useful to have a March LAFCO meeting and piggyback the Finance Committee meeting with that. The FY 16/17 budget would be discussed at that time with the preliminary budget ready for the April LAFCO meeting.

3. Financial and Payroll services A discussion took place about issues LAFCO had with the Auditor’s office with regard to financial and payroll services. After discussion it was determined that LAFCO should go with another service provider and that it should be another municipal agency. The City of Vacaville had submitted a proposal and the Committee requested they provide a draft agreement. The Committee also requested a report detailing issues with the Auditor’s office providing service and a copy of the MOU with the Auditor. The item on changing service providers would be on the March agenda. This would allow LAFCO to provide its 90 day notice should the Commission agree to the change.
