On January 3, 19S3, two copies of the annual financial

and statistical form (annual report) and two copies of the

gross intrastate operating revenues report form (gross operating

report) are being mailed to all utilities subject to the juris-diction of this Commission. These reports should be completed

for the calendar year 1982 and the original should be filed with

this Commission on or before March 3), 1983, as required by

Public Service Commission Regulation 807 KAR 5:006, Section 3(l),KRS 278.140 and KRS 27S.230(3). For good cause shown, the

Commission may, upon application in writing, allow a reasonable

extension of time for filing of the annual report; however, an

extension of time for filing the gross operati.ng report cannot

be granted.

The Commission, being sufficiently advised, finds that:

(1) The prompt and timely filing of the annual report

and the gross operating report is essential to the operation ofthe Commission and reasonably required in the exercise of itsstatutory powers.

IT IS THEREFORE ORDERED that the above-named utili.ty shall

file with this Commission its annual report and its gross

operating report for the calendar year 1982 on or before March 31,

1983.

IT XS FURTHER ORDERED that any utility failing to comply

with this order shall be subject to KRS 278.990 (a copy of which

is attached hereto), including the imposition of penalties pro-

vided therein.

(1) Aay officer, agent or employe of a uttTrty, as de-fined in KRS 278.010, and any other person who wiH-fully violates any of the provisions of KRS 278.010 to278.450, or who proem', aids or abets aay violation ofthose provisions by any such utility, shall be fined notmore than one thousand doHars ($1„000)or imprisonedfor not mote than six (6) months, or both. If any suchutility that is a private corporatioa violates any of theprovisions of KRS 278.010 to 278450, or does any acttherein prohibited, or fails to perform any duty imposedupon ii under those sections for which no penalty hasbeen provided by Iaw, or fails to obey any lawfu!requiremem or order of the commission having juriadic-lion, thc utiTity shall for each offense forfeit and pay tothe state treasurer, to be credited to the general fund, asum not less than twcaty4ivc doHars ($25.00) nor motethan onc thousand doHars ($1,000}. Each act, omissioaor failure by an officer, agent or other person acting foroi cmplcpjed by a utility and acting within thc scope ofhis employment shaH be deemed to bc the act, omrssioaor failure of thc utility.

(2) Actions io recover the principa amount due andpenalties under KRS 278.010 to 278.450 and this subsec-tion shall be brought in the name of the Commonwealthin the Fraakha Circuit Court. %hencver any utility issubject to a penalty under KRS 278.010 to 278.450 orthis subsection, the coarrrrise'on having jurisdiction ahaBcenify the facts to its counsel, who shaH bring an actionfor recovery of the principal amount duc and the pen-alty. The comxmssion may compromise aad dismiss theaction oa terms approved by the court. (7) Aay telephone company that refuses to make aconnection with the exchange or lines of another com-pany for a period of thirty (30) days after being orderedio do so by the utiTity commission under subsection (2)of KRS 278.530 shaH be fined aot less than oaethousand doHars ($1,000) aor more than five thousanddoHars ($5,000), to be recovered by iadictmcnt in theFranklin Circuit Court or in thc circuit court of thecounty whcre the company requesting the coanoctioa
