Introduction

The Nebraska Juvenile Justice System 2019 Statistical Annual Report meets the requirements of Nebraska Revised Statute § 24-1007 (2014). This report is compiled by the Administrative Office of the Courts and Probation (AOCP). The report contains statistics on Juvenile Justice (status offense and juvenile delinquency) cases and on juveniles prosecuted in the adult court system. A status offense is an act that is prohibited because of the juvenile status of the person, but is not illegal if committed by an adult. Juvenile delinquency cases involve a violation of a law applicable regardless of juvenile or adult status. This report provides statistical information on juveniles in the justice system. The data presented show caseload statistics by case type, geography and demographics.

The data in this report was extracted from the Supreme Court’s Judicial User System to Improve Court Efficiency (JUSTICE), a case-based data storage system comprised of clerk entries of information from relevant court documents. Tables with court data report statistics on cases for youth ages 17 and under at the time of the offense. The Part (d) Juvenile Probation Activity tables are provided from the case management system, Nebraska Probation Application for Community Safety (NPACS). These tables report activity for juveniles ages 18 and under receiving probation services in the year.

The report contains a statewide section and 12 judicial district sections. Each district section has district summary tables followed by county data for that judicial district. If there is no data for a county, that county is not included in the table. All geographic tables include demographic statistics by age, gender and race/ethnicity if there is data for that group. If not expressly written on trial court forms, age, gender and/or race/ethnicity may be unknown to court personnel responsible for JUSTICE data entry and will be included as “Unknown” in this report.

For the majority of the report, age demographic groupings are based on the age of the juvenile at the time of the offense. Exceptions are noted in the report. Age groups used in this report are: 10 & Under; 11-13; 14-15; 16; and 17 and are based on Nebraska Revised Statutes 43-246.01 and 43-247 regarding allowable ages in juvenile court jurisdiction.

The number of "Unknown" demographics are not included in the percentage calculation in tables where percentages are calculated for demographic groups as a percentage of the total. This allows the "valid" percent to be displayed where demographics are known. In these instances, the percent column remains blank for the "Unknown" category. The "Unknown" group will have a percent value in tables where the percentage is calculated using the total cases for the demographic group.


Part (a) Juvenile Petitions and AdjudicationsNebraska Revised Statute 24-1007 (a) Juveniles prosecuted in juvenile court under subdivision (1), (2), (3)(b), or (4) of section 43-247, including the total number of filings and adjudications.

The Juvenile Petitions and Adjudications tables report the number of new juvenile cases and corresponding percent of adjudications by case type and demographic group for cases filed in 2019. The data consists of both county court and separate juvenile court cases. Only the most serious offense is counted for cases with multiple offenses, pleas or findings. Cases are counted in the Adjudicated column if at least one offense was admitted to in court. Supplemental petitions are not included in this data set. Age is reported as the age of the juvenile at the time of the offense. Cases filed in November or December of 2019 may not have reached the adjudication stage of proceedings. Juvenile cases where the age is unknown, if any, are included in the report.

Out of 3,910 juvenile cases statewide, there

are 2,703 (69%) adjudications in 2019.

Overall 69% of cases have been adjudicated. Overall, no significant differences are found among age groups. Among race, American Indians (61%) and Blacks (61%) are less likely to be adjudicated than Hispanics (74%) or Whites (73%). Overall, females (67%) are less likely to be adjudicated than males (70%). Females (93%) are more likely be adjudicated for traffic offenses than males (79%) and less likely (55%) to be adjudicated for status offenses than males (66%).

Part (b) Juveniles Prosecuted in Adult Criminal Court - Case Type Nebraska Revised Statute 24-1007 (b) Juveniles prosecuted in adult criminal court for felonies, misdemeanors, and traffic offenses. The information shall include juveniles sentenced to terms in adult jails and prisons and juveniles placed on adult probation.

Juveniles Prosecuted in Adult Criminal Court tables consist of criminal and traffic cases in county court and criminal cases in district court that reached the point of sentencing in 2017. Cases with multiple charges are counted once per case and reported as the most severe offense. Cases for juveniles ages 13 and below must be filed and stay in juvenile court. Exceptions are some traffic case types where the county attorney has the option to file in criminal or juvenile court and instances where the offense was discovered after the juvenile was an adult. Therefore, the vast majority of juvenile cases appearing in adult criminal court data are for ages 14 through 17 at the time of the offense.

Overall, juvenile cases prosecuted in adult criminal court are just as likely to be traffic, misdemeanor or felony cases. Males (72%) are more likely than females (28%) to have offenses in adult criminal court. Among age groups, 17 year old’s are most likely to have misdemeanor (59%) and felony (59%) offenses than other age groups. Among races, overall, Whites (45%) are most likely to have cases in adult criminal court. This also applies to traffic and misdemeanor cases. Blacks (52%) are most likely to have felony cases in adult criminal court.


Of the 204 cases of juveniles prosecuted in adult

criminal court, 30% are traffic cases, 37% are

misdemeanor cases, and 32% are felonies.

Nebraska Revised Statute 24-1007 (b) Juveniles prosecuted in adult criminal court for felonies, misdemeanors, and traffic offenses. The information shall include juveniles sentenced to terms in adult jails and prisons and juveniles placed on adult probation.

Juveniles Prosecuted in Adult Criminal Court tables include criminal and traffic cases in county court and criminal cases in district court that reached the point of sentencing in 2019. All sentencing types are included where multiple sentencing types occur within a case (ex. probation/jail). Youth who are sentenced to probation in Adult Court are supervised by Adult Probation. Age is calculated from the age at offense, not the age at sentencing.

In adult criminal court 52% of cases involve 17 year olds. Males comprise 73% and Whites 45% of total cases. Youth ages 14-15 (86%) are more likely to be sentenced to probation than 17 year olds (64%). Hispanics (77%) and Whites (83%) are more likely than Blacks (49%) to be sentenced to probation. Overall, youth are more likely to be sentenced to probation (70%) than to jail (22%) or prison (15%). No differences are found between jail and prison sentences among age groups, gender or race.


Of the 204 cases prosecuted in adult criminal court, 63% were sentenced to probation, 22% to jail and 15% to prison.

The data represents motions to transfer filed in 2019 and transfers between court jurisdiction which occurred in 2019. Therefore, the exact same set of cases may not be represented in both columns. There can be multiple motions to transfer within a single case which, if filed in the same calendar year, would all be included in the counts below. Some cases may have a motion to transfer, but no transfer actually occurs or it occurs in a subsequent year. Transfers occur once per case.

The majority of motions to transfer from juvenile court to adult court are for 17 year olds (72%), males (90%) and Whites (52%). The majority of transfers ordered are for 17 year olds (89%), males (78%) and Whites (50%). No real differences are found in the percent of motions to transfer and transfers in juvenile court in any cohort. In adult court, 43% of motions to transfer to juvenile court are for 16 year olds, with 40% of transfers. Males are more likely to have motions to transfer (93%) than to be transferred (71%). Blacks are more likely to have motions to transfer (53%) than to be transferred (5%), while Whites are less likely to have motions to transfer (22%) than to have a transfer ordered (79%).

In juvenile court there are 60 motions to transfer to adult court

filed in 2019, and 9 cases transferred to adult court. Adult

court has 117 motions to transfer to juvenile court filed, and 96 transfers to juvenile

court in the year.

The Juvenile Probation Activity - Youth data is provided from the case management system, Nebraska Probation Application for Community Safety (NPACS). The table reports the number and percent of youth with various activity during the year. Youth are counted once in each category, regardless of the number of out-of-home placements, motions to revoke, or cases they may have in the year. Age groups are calculated specific to the activity as footnoted.

A third (32%) of youth placed on probation are 14 - 15 years of age, seven out of ten (69%) are male and six out of ten (60%) are white. Of the 1,571 youth with an out-of-home placement in the year, 31% are 14 - 15 year olds, 69% are male, and 52% are white. There are 929 motions to revoke probation, 30% are for 17 year olds, 69% for males, and 56% for whites. Only 15 youth have probation revoked in the year. A total of 2,292 youth have a satisfactory release from probation. Of these, 34% are 14-15 years old, 67% are male and 63% are white. Hispanic origin comprised 26% of those placed on probation and ranged from 22% Hispanic for out of home placements to 40% of revocations. Three out of ten (29%) youth with a satisfactory release are Hispanic.

Of the 2,393 youth placed on probation in 2019, 2,292

have a satisfactory

release, and 15 cases have probation revoked.

Part (d) Juvenile Probation - Risk Level and Length of ProbationNebraska Revised Statute 24-1007 (d) Juveniles placed on juvenile probation, the number of juveniles on probation in out-of-home care, the number of juveniles completing probation, the number of motions to revoke probation and probation revocations, and the average length of time on probation.

Youth Level of Service/Case Management Inventory (YLS/CMI) is an assessment tool used to systematically measure risk for recidivism and appropriate supervision intensity for youth on probation. The following table shows the classification results for youth who entered probation in 2019, and a separate set of youth that discharged from probation in 2019. Youth that are assessed at low or moderate low risk are matched to Juvenile Community-Based Resource (JCBR) supervision and those assessed at high or moderate high risk are matched to Juvenile Community-Based Intervention (JCBI) supervision intensity.

The Juvenile Court’s jurisdicition terminates at the age of majority. The age group for 18 year olds average length of probation includes 18 and 19 year olds.

A total of 2,398 youth are placed on probation in 2019. Of those with an initial risk assessment, 54% are assessed with a low/moderate risk, while 43% have a high level of risk. The final risk assessment, given to 1,692 youth, is significantly different from the initial assessment. The final risk assessment shows 63% of youth are low risk, while 37% are high risk. Nebraska Revised Statute 24-1007 (e) juveniles with and without access to counsel in juvenile and adult court, both appointed and retained.

The Juveniles Access to Counsel table displays the percent of juveniles represented by an attorney in criminal cases from county court and district court and juvenile cases from county court and separate juvenile court. Data includes new cases filed and cases transfered from one county to another during calendar year 2019. Cases filed in 2019 may not have reached the sentencing/adjudication stage of proceedings. Cases for juveniles ages 13 and below must be filed and stay in juvenile court. Exceptions are some traffic case types where the county attorney has the option to file in criminal or juvenile court and instances where the offense was discovered after the juvenile was an adult. Therefore, the vast majority of juvenile cases appearing in adult criminal court data are for ages 14 through 17 at the time of the offense. Age is reported as the age of the juvenile at the time of the offense.

In criminal court, no real differences were found between age groups. Females (25%) are less likely than males (52%) to have counsel. Blacks (71%) are more likely to have counsel in criminal court than Hispanics (52%) and Whites (31%) and Hispanics are more likely than Whites to have counsel. In Juvenile court, 11-13 year olds (79%), 14-15 (79%) and 16 year olds (79%) are more likely to have counsel than 17 year olds (72%). Males (79%) are more likely to have counsel than females (74%). Blacks (95%) are more likely than American Indians (79%), Hispanics (75%) and Whites (72%) to have counsel in juvenile court.

The recidivism table is based on probation youth that were successfully discharged in 2018 and whether or not the youth received a new adjudication and/or adult conviction within one year of their probation discharge date. See Appendix III § 1-1001. Uniform definitions of recidivism for Nebraska State Probation and Nebraska Problem-Solving Courts for a complete definition of recidivism. The data is a combination of the Administrative Office of the Courts and Probation’s separate databases. Probation youth recidivism is counted once per youth with the most serious offense reported.

Overall, 22% of youth that were discharged in 2018 recidivated within a year. Youth 18 years of age (27%) and 19 & over (31%) are more likely than younger age cohorts to recidivate. Males (25%) are more likely than females (16%) to recidivate. Blacks (31%) were found to be more likely than whites (19%) to recidivate.

Cases are counted in the Adjudicated column if at least one offense was admitted to in court. Supplemental petitions are not included in this data set. Age is reported as the age of the juvenile at the time of the offense. Cases filed in November or December may not have reached the adjudication stage of proceedings. Youth that are assessed at low or moderate low risk are matched to Juvenile Community-Based Resource (JCBR) supervision and those assessed at high or moderate high risk are matched to Juvenile Community-Based Intervention (JCBI) supervision intensity.

Exceptions are some traffic case types where the county attorney has the option to file in criminal or juvenile court and instances where the offense was discovered after the juvenile was an adult. Therefore, the vast majority of juvenile cases appearing in adult criminal court data are for ages 14 through 17 at the time of the offense. Age is reported as the age of the juvenile at the time of the offense.

Appendix I Nebraska Revised Statute 24-1007

Revised Statutes » Chapter 24 » 24-1007

24-1007. State Court Administrator; compile judicial workload statistics; how; juveniles in Nebraska's justice system; annual report; contents.

(1) The State Court Administrator shall compile uniform and accurate statistics which will assist in the evaluation of judicial workloads. The judicial workload statistics shall be based on caseload numbers weighted by category of case. The judicial workload statistics shall be compiled annually for each district, county, and separate juvenile court judicial district in the state.

(2) The State Court Administrator shall develop and provide an annual report to the Legislature and the Governor on juveniles in Nebraska's justice system. The report to the Legislature shall be provided electronically. For purposes of this section, juvenile has the same meaning as in section 43-245. The report shall include, but not be limited to, geographic and demographic information on the following:

(a) Juveniles prosecuted in juvenile court under subdivision (1), (2), (3)(b), or (4) of section 43-247, including the total number of filings and adjudications;

(b) Juveniles prosecuted in adult criminal court for felonies, misdemeanors, and traffic offenses. The information shall include juveniles sentenced to terms in adult jails and prisons and juveniles placed on adult probation;

(c) The number of motions to transfer and the number of cases transferred to adult court from juvenile court and from adult criminal court to juvenile court;

(d) Juveniles placed on juvenile probation, the number of juveniles on probation in out-of-home care, the number of juveniles completing probation, the number of motions to revoke probation and probation revocations, and the average length of time on probation;

(e) Juveniles with and without access to counsel in juvenile and adult court, both appointed and retained; and

(f) Rates of recidivism.

Appendix II Probation Definitions

The Probation information was collected from the Nebraska Probation Application for community Safety (NPACS) case management system. Traditional probationers and Problem Solving Court probationers are included in this analysis. The following are explanations of the data.

1. Youth Level of Service/ Case Management Inventory (YLS/CMI) score: Youth Placed on Probation – Initial Classification based on YLS/CMI Level provides an analysis of the number of youth whose first YLS/CMI score would place them in the Juvenile Community-Based Resource (JCBR) classification, or the Juvenile Community-Based Intervention (JCBI) classification. JCBR are commonly referred to as the low risk youth and their cases are managed accordingly, while the JCBI youth have scores of moderate high, high or very high. JCBI youth have more supervision requirements to address their high risk. Some youth do not have an YLS/CMI assessment completed before their probation is terminated. This can be due to a brief probation term, or successful completion of pre-adjudicated services.

2. Placed on Probation: the count of all youth that were formally placed on Probation between January 1 and December 31 of the previous year.

3. Placed Out of Home: this information is a count of all youth who were placed in an out of home placement (OHP) at some point during the calendar year. This information represents the number of youth that were out of home, not the number of placements. For example, one youth may be out of home in detention, move to a shelter and eventually transition home. The youth would be counted once even though they had two different OHP. If a youth is placed in OHP on their 19th birthday prior to being released from Probation, the youth is included in the placed at 18 years old age bracket and the appropriate gender, race and ethnicity group.

4. Motion to Revoke: the count of all youth that received a motion to revoke on any of their active cases in the report year. A youth may have multiple court cases being processed concurrently, but the youth would only be counted once in this report.

5. Revocations Only: the number of youth that had probation revoked on one or more cases. Individual youth are counted and not the number of cases that were revoked. When a motion to revoke is filed, the court has several options that they can pursue including: revoking the probation case and terminating the probation term, extending the probation term, sending the youth to YRTC and continuing probation after that placement, or dismissing the motion to revoke. For this category, only those youth whose cases were revoked and terminated in the reporting period are included. Further details regarding revocations can be found in the Juvenile Probation’s Detailed Analysis.

6. Successful Discharge: the number of youth who were successfully discharged from Probation, during the year, on one or more court cases. Successful completion includes completion of pre-adjudication, pre-disposition, traditional probation, early release and YRTC probation. Length of Probation is provided in months. Some youth may be listed as discharged from probation without an official start date. These are youth that may have completed pre-adjudication or pre-dispositional services. These youth are not officially disposed to probation but there is a court case completion/discharge date entered because the court case is closed. Some youth will also appear to be discharged at 19 or later due to the time lapse between court proceeding and case closure. Youth can also be discharged past 19 years old if Nebraska Probation is providing interstate probation supervision.

7. All Discharges YLS: this information contains a listing of youth that were discharged during the report year. Age is presented at time of probation start (which may be prior to the report year), and age at time of discharge. Length of probation is displayed in months. Some youth may be listed as discharged from probation without an official start date. These are youth that may have completed pre-adjudication or pre-dispositional services. These youth are not officially disposed to probation but there is a court case completion/discharge date entered because the court case is closed. A final YLS/CMI score and classification is also provided for any analysis on the number of youth that were discharged at each level. It is not uncommon for there to be more youth at a JCBR level discharged as opposed to JCBI. This is due to the process of stepping high risk youth down to a lower supervision level before discharging them from probation.


Age calculations

1. Youth placed on probation: age at which their probation term began during that calendar year.

2. Out of home placement: age at the first admission to out of home placement during that calendar year.

3. Motions to Revoke: age at which the motion to revoke was filed/created during that calendar year.

4. Probation Revoked: age on the date which the disposition for the motion to revoke was applied during that calendar year.

5. Satisfactory Release: age on the date which the disposition for discharge from probation occurred during that calendar year.

6. Initial Risk Level: age at which their probation term began during that calendar year. Youth are assessed just prior to or after they begin their probation term. For consistency, the age when they began their probation term was calculated.

7. Final Risk Level: age on the date which the disposition for discharge from probation occurred during that calendar year. Youth may be assessed within six months of their release. For consistency, the age when they were discharged from probation was calculated and reported in regards to their final risk assessment level.

Appendix III § 1-1001. Uniform definitions of recidivism for Nebraska State Probation and Nebraska Problem-Solving Courts

For the purpose of accurately assessing post-program recidivism across justice programs, Nebraska State Probation and Nebraska Problem-Solving Courts shall utilize the following uniform definitions of recidivism for all adults and juveniles within their respective programs.

(A) Adults:

As applied to adults, recidivism shall mean a final conviction of a Class I or II misdemeanor, a Class IV felony or above, or a Class W misdemeanor based on a violation of state law or an ordinance of any city or village enacted in conformance with state law, within 3 years of being successfully released.

(B) Juveniles:

(1) As applied to juveniles, recidivism shall mean that within 1 year of being successfully released from a probation or problem-solving court program the juvenile has:

(a) an adjudication pursuant to Neb. Rev. Stat. § 43-247(1) or (2).

(b) for a juvenile 14 years or older, a final conviction for a Class W misdemeanor based on a violation of state traffic laws or ordinances of any city or village enacted in conformance with state law; or

(c) a prosecution and final conviction as an adult for any crimes set forth in subsection (A) above.

(2) For juveniles that age out of the juvenile system within 1 year of program exit and who did not recidivate post-program as juveniles, the adult definition of post-program recidivism, including any drug-related or alcohol-related conviction, shall apply.
