INTRODUCTION

The dental council of India – a statutory body was constituted on 12th April 1949 under an act of parliament – The DENTISTS ACT ,1948(XVI of 1948) .

The amendments were made through an ordinance promulgated by the president of India on 27th August 1992

Though this ordinance i.e. under section 10A,10B,10C were introduced in the Dentist Act,1948 mainly to restrict mushroom growth of dental colleges, increase of the seats in any of the course and starting of new higher courses without the prior permission of central government – Ministry of Health and Family Welfare.

OBJECTIVES

In consonance of the provisions of the act,DCI is entrusted with the following objectives

1. Maintenance of uniform standard of dental

education both at UG and PG levelsa) It envisages inspections/visitations of dental

colleges for permission to start dental colleges, increase of seates,starting of new PG courses

i. To prescribe the standard curricula for the training of dentists, dental hygienist, dental mechanics and the condition for such training

ii. To prescribe the standard examinations and other requirements to be satisfied to secure for qualifications recognition under this act

TO ACHIEVE THIS THE NEEDS ARE

1. Uniformity of curricula standards of technical and clinical requirements, standards of examinations

2. A uniform standard of entrance to various courses in dentistry

3. Affiliation every dental college to an university

4. Supervision over all the institutions to ensure that they maintain the prescribed standards

5. Regulation of the profession of the dentistry

FUNCTIONS AND RESPONSIBILITIES

The dental council of India is mainly concerned with maintenance of standard of dental education, dental profession and dental ethics The council is composed of six constituencies representing central govt ,state govt,universities,dental colleges, medical council of India and the private practitioners of dentistry The executive committee is the governing body of the organisation,which deals with all procedural ,financial and day today activities and affairs of the council

TO SERVE THE ABOVE FUNCTIONS THE DCI HAS FORMED SOME RULES AND REGULATIONS IN WHICH THE FOLLOWING ARE SPECIFIED

a) Basic principle for the maintenance of minimum education standard for the BDS degree

b) Minimum physical requirements of a dental college

c) Minimum staff pattern for UG dental studies in colleges with 40,60and 100 member of admission

d) Basic qualifications and teaching experience required to teach BDS and MDS students

e) General establishment of dental facilities, its duration of course ,selection of students

f) Migration and transfer rules for students

g) Regulation of scheme of exam for BDS and MDS

h) Dental curriculum: Time and subject specifications to clinical programme,syllubus

CONSTITUTIONS AND COMPOSITION OF COUNCIL

The central govt shall constitute a council consisting of the following members namely

a) One registered dentist possessing a recognized a dental qualification elected by the dentists registered in part A of each state register

b) One member elected from amongst themselves by the members of MCI

c) Not more than 4 members elected from among themselves by

I. principals ,deans ,directors and vice principals of dental colleges in the state

II. Heads of dental wings of medical colleges in the state

III. One member from each university established by law in the state

d) One member to represent each state nominated by the govt of each such state from among persons registered either in a medical or dental register of the state

e) 6 members nominated by the central govt among 1 shall be a registered dentist and at least 2 shall be dentist registered in part B of state register

f) The director general of health services

INCORPORATION OF COUNCIL

The council shall be a body corporate by the name of the DCI having perpetual succession and a common seal

MODE OF ELECTION

Elections shall be conducted in the prescribed manner and where any dispute arises regarding any such election ,it shall be referred to the central govt whose decision shall be final

TERM OF OFFICE AND CASUAL VACANCIES

I. An elected or nominated member shall hold office for a time of 5 yrs from the date of his election

II. An elected member may at any time resign his membership by writing to the president and seat of such member shall there upon become vacant

III. An elected or nominated member shall be deemed to have vacated his seat if he is absent

IV. Members of the council shall be eligible for re election or re nomination

PRESIDENT AND VICE PRESIDENT OF COUNCILI. President and vice president of

the council shall be elected by the members ,from among themselves

STAFF,REMUNERATION AND ALLOWANCES

The council shall a) Appoint a secretary who may also act as

a treasurer b) Appoint such other officers and servants

carry out its functions under this actc) Secretary of the council shall be a

person appointed by the govt

The president and vice president of the council shall be chairman and vice chairman respectively of the executive committee

RECOGNISTION OF DENTAL QUALIFICATION

•The dental qualification granted by any other authority or institution in India ,which are included in part-1 •Any authority or institution in India grants dental qualifications not included in part-1 of the schedule may apply to the central govt to have such qualifications. The central govt after consulting the council may by notification in the official gazette amend part-1 of the schedule so as to include such qualification their in and also direct that an entry shall be made in part -1 of the schedule•The dental qualification granted by any authority or institution outside India which are included in part-2 of the schedule shall be recognized only for the purpose of the registration of citizen of the India

•In case of authority or institution outside India and held by a citizen of India is recognized for the purpose of the register when it is first prepared ,after the commencement of the dentists Act 1972 ,the central govt may after consultation with council ,amend part-2 of the schedule so as to include there in the dental qualification so recognized

QUALIFICATIONS OF DENTAL HYGIENISTSAny authority in a state which grants a qualification for a dental hygienists may apply to the council to have such qualification recognized and the council may after consulting the govt and the state council declare that such qualifications when granted after a specified date shall be recognized dental hygiene qualification for the purpose of this act

QUALIFICATIONS OF DENTAL MECHANICS

The council may prescribe the period and nature of an apprenticeship or training which shall be undergone and other conditions which shall be satisfied by a person before he is entitled to be registered under this act as a dental mechanic

EFFECT OF RECOGNITION

1. Any recognized dental hygiene qualification shall be a sufficient qualification for enrolment in the approximate register of any state

2. No person shall be entitled in any register as a dentist or dental hygienist unless he holds a recognized qualification unless he has undergone training which satisfies the prescribed requirement

POWER TO REQUIRE INFORMATION AS TO COURSES OF STUDY AND TRAINING AND EXAMINATIONS

Every authority in a state which grants any recognized qualifications shall furnish such information , as the council may from time to time require as to the courses of study and training and the examinations to be undergone in order to obtain such qualification

INSPECTIONS

The executive committee appoint members of inspection has it deems necessary to attend any examination held by authorities in the state which grant recognized qualification and to inspect any institution recognized by a training institution

Inspectors appointed under the section shall report to committee on the sufficiency of every examination at which they attend and of the course of study and training at every institution which inspect and on any other matters with regard to which they may require them to report

The committee shall forward a copy of such reports to the authority or institution concerned and shall also forward copies with remarks if any of the authorities or a institution concerned to the central govt and the state govt in which the authority or institution situated

APPOINTMENT OF VISITORS

Council may appoint such members of visitors as it may deem necessary to attend at any examination held by any authority or institution in a qualifications and to inspect any institution training students for recognized dental qualifications The report of visitor shall be treated as confidential unless in any particular case the president of the council otherwise directs –provided that of the central govt require a copy of the report of a visitor the council shall furnish the same

WITHDRAWAL OF RECOGNITION

When upon report by the executive committee it appears to the council

a) That the courses of study and training or the examination to be undergone or the condition for the admission took such courses are not in conformation with regulation made under this act

b) That an institution does not satisfy the requirement of the council a statement to that effect may be send by the council to the govt of the state in which the authority or institution is situated

c) The council after considering the recommendation of the state govt may declare that the qualification granted by the authority or institution shall be a recognized dental hygiene qualification only when granted before a specified date

WITHDRAWAL OF RECOGNITION OF RECOGNIZED DENTAL QUALIFICATIONS

1. When it appears to the council

a) That the courses of study and training or examination to be undergone or the condition for admission to such courses or students of proficiency required from the candidates at such examinations are not in conforming with the regulations made under this act

b) an institution does not in the matter of staff in the equipment accommodation training and other facilities satisfy the requirements of the council

a) council send a statement to that effect to the central govt ,after considering such statement ,the central govt may send to the state govt , and state govt shall forward with an intimation of the period to the authority or institution ,within which they may submit its application to state govt

b) After considering the application state govt shall make its recommendation to the central govt

c) The central govt after considering the recommendation may direct that an entry made in the part 1 of the schedule against the qualification granted by authority or institution

MODE OF DECLARATION

All declarations shall be made by a resolution passed at the meeting of the council and shall be published in the official gazette

THE INDIAN REGISTER

1. The council shall maintain a register of dentists to be known as the Indian dentists register and consisting of the entries in all state registers of India

2. Each state council shall supply to the council, 20 printed copies of the state register after the first day of April each year and each register shall inform the council of all the additions or amendments in the state register

PROFESSIONAL CONDUCT

1. The council may prescribe standards of professional conduct and etiquette or the code ethics for the dentists

2. Regulations made by the council may specify which violation shall constitute professional misconduct

INFORMATION TO BE FURNISHED

1. The council shall furnish copies of its minutes and of the minutes of the executive committee and an annual report of its activities together with an abstract of its accounts to the central govt

2. The central govt may publish in such manner as it thinks fit any report ,copy or abstract furnished to it under this section
