AN ORDINANCEREQUIRING ALL FOOD ESTABLISHMENTS WITI-IIN "ftIE THRRITORIALJURISDICTION OF THE MUNICIPAI.ITY OF GERONA TO U$E ONLYIODIZED SALT.
WHEREAS, Art. ll, Section 15 of the 1987 Philippine Constitution states the "TheState shall promote the right to health of the people and instill consciousnessamong them";
WHEREAS, Book l, Title l, Section 16, RA 1760 states that "Every LocalGovemment Unit shall exercise the powers expressly granted, those necessary,appropriate or incidental for its efficient.and effective govemance and thosewhich are essential to the promotion of general welfare. Within their respectiveterritorial jurisdiction local government units shall ensure and support amongother things, lhe preseruation and promotion of health and safety, enhance theright of the people and preserve the comfort and convenience of theirinhabitants";
WHEREAS, Republic Act No. 8172, othenruise known as 'An Act for Saltlodization Nationwide {ASIN)" which was approved in 1995 provided fcr, amongothers, the elimination of micronutrient malnutrition in the country, particularlyiodine deficiency disorders, through the cost-effective preventive measures ofsalt iodization and for said purpose, mandated that local govemrnent unitsprovide mechanisms to ensure enforcement of the law (or its applicableprovisions) through local ordinances and public infom'lation campaigns;
NOW THEREFORE, on motion of Hon. Agerico $. Batenga, Chairman of theCommittee on Environmental Protection, Health and Sanitation and dulyseconded by Edwin Aldrin R.Yamoyam.

BE lT ORDAINED by the Sangguniang Bayan of Gerona, Tarlac, in sessionassembled, that:
Secfion 1. Title. This ordinance shall be known as mandatory requirement ofthe use of iodized salt in the Municipality of Gerona.
Secfi'on 2. Policy. lt is the expressed policy of the Municipality of Gerona toactively participate on the programs of the National Govemment in theelimination of micro nutrients matnutrition in the country, particularly iodinedeficiency and disorders through the most cost effective preventive andcorrective measures of salt iodization.
3. Appltcabilfu. This ordinance shall be applicable to all businessestablishments within the teritorial jurisdiction of the Municipality of Geronawhose businesses engage in the use of salt for human and animal consumption.
Secfion 4. Legal Basis. The legal basis of this ordinance are: Art. ll, Section 14of the 1987 Philippine Constitution; Book l, Title l, Section 16 of RA 7160, andRA 8172 orASIN Law.
Secfion 5. Coverage. All commercial food establishments, such as restaurants,canteens, carinderias, caterers, food outlets, food processors, meat processorsand junk food vendors are required to comply with this ordinance with theexemptions of salted eggs and ice cream makers.
Secfion 6. Definition of Terms. When used in this ordinance the followingwords/terms shall mean.
a. Micronutrient Malnutrition - a disorder resulting from deficiencies inVitamin A, iron, iodine and other micronutrients which the body needs inminute quantities everyday.
b. lodine deficiency disorders - a broad spectrum of deficiencies resultingfrom lack of iodine in the diet which leads to the reduction of intellectualand physical capacity, affecting everyone who is iodine deficient andmay manifest as goiter, mental retardation, physical and mental defectsand cretinism.
c. Salt iodization - the addition of iodine to salt for human or animalconsumption in accordance with specifications as to form, fortificant,method, manner and composition as may be prescribed by the BFAD.
Secfion T.lmplementing Office. The Office of the MunicipalMayor, through theMunicipal Health Office shall be lhe implementing office of this ordinance.
$ecfibn L Monitaring, The Sangguniang Bayan through the Committee onEnvironmental Protection, Health and Sanitation and the Local Health Boardshall monitor the effective implementation of this ordinance.
Secfi'on 9. Infatmatian and Educatian Campaign. There shall be informationand education campaign to be conducted. The Municipal Mayor shall designatethe Local Heath Board together with the Chairman of the Committee onEnvironmental Protection, Health and Sanitation of the Sangguniang Bayan forthis purpose.

Secfion 10. Apprapriatians. There shall be an appropriations to be included in
the budget and succeeding years budget in the Office of the Municipal Health
Office to be used in the implementation and monitoring of this ordinance.
Secfion 11. Repealing Clause. Any existing ordinances that are inconsistent
with the provisions ol this ordinance shall be deenned repealed or modified
accordingly.
SeCfIon 12, Penal ClaAse. Restaurant, Caterers, carinderias, meat and foodprocessors or other business in the tenitorial jurisdiction of the Municipality of
berona who violates any provision of this ordinance shall be penalized in the
