3. What information we collect about you as a RunFriendly customer

The type of information we may collect includes:

● Name ● Contact information: email address and telephone number,

and name and number of your designated emergency contact, if provided

● Survey question responses or other feedback linked to offers or competitions

● Health information (provided upon completion of a health questionnaire as requested by some of our Venue Partners)

● Google User ID if you created a RunFriendly account using Google

● Your marketing communication preferences

Financial Details

At the point of purchase our website requests card details using our payment provider Stripe. The card details will not be sent to servers in control of RunFriendly but only to servers of our payment provider Stripe. Stripe returns a token to us - a randomly looking combination of letters and numbers - which we store, to display the previously used card type and last 4 numbers at future purchases, in addition this token allows us to charge the card without storing the card details itself. Our use of Stripe as a payment provider means we use its terms of and conditions - https://stripe.com/gb/checkout/legal

4. What information we collect about you as a gym or venue operator

Where an individual has provided their personal details as contact information for their business we may collect the following personal data:

● Name ● Contact information: email address and telephone number(s) ● Details of the device used to contact us ● Details of your previous visits to the website or app ● Other information relevant to operator surveys

5. What we do with your personal information

RunFriendly will use your personal information for a number of different purposes, which are listed below, along with which of the reasons we rely on to do so.

Providing the functionality of our platform We engage in these activities to manage our contractual relationship with you.

Selected personal information including your name, emergency contact details and health questionnaire responses will be made available to any Venue Partner whose venues you visit for the following purposes:

● Emergency Contact Details (if and when provided): for the sole purpose of contacting your nominated contact in the event of an emergency.

● Your Name: for verifying your identification upon arrival at the venue.

● Your Health Questionnaire Information: a contractual requirement from some of our Venue partners to ensure customers are fit and well to use their facilities.

Unless otherwise described in this Policy, we may also share the information that we collect from you through the website with affiliates, agents, contractors, employees, and other service providers, and also according to law, at the request of a law enforcement agency or in compliance with any court order.

As we continue to develop our business, we may sell, buy, merge or partner with other companies or businesses, or sell some or all of our assets. In such transactions or where there is any change of control of RunFriendly, personal information may be among the transferred assets.

For example, if we suspend a RunFriendly Account for fraud or due to an ongoing criminal investigation at one of our partner venues, we may retain certain information from that Account to prevent that user from opening a new RunFriendly Account in the future.

● We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, we may keep some of your information for tax, legal reporting and auditing obligations.

VENUE VISITOR CONDUCT

We reserve the right to permanently suspend any user on the grounds of behaviour that we or our Partners, in good faith, deem at our mutual or sole discretion to be threatening, abusive or antisocial in any way. We operate a 'banned from one, banned from all policy' whereby if you are permanently suspended from one venue within the RunFriendly network you may be banned from all.

Please also note that whenever you present your RunFriendly Identifier at a venue you are agreeing to accept and abide by the terms and conditions of use governing that venue (which can be requested from the venue on arrival as required). Therefore any breach of venue-specific terms and conditions may result in a ban from all venues on the RunFriendly platform.

We will always respect our Partners right to refuse entry to any guest who does not comply with their terms and conditions.

A 'RunFriendly Account' is purchased by you and only applies to you and is valid to be redeemed at ‘Partner Venues’ for your entrance to use their shower and changing facilities only. All other services and products they provide should be paid for directly with the Venue Partner. On arrival you will be required to present your 'RunFriendly Account' booking for redemption and in doing so you agree to accept and abide by the terms & conditions of use governing that venue which can be requested from the venue on arrival as required.

Please note that a number of our venue Partners request that you provide them with proof of identity on arrival at the venue in order to ensure you are the purchaser of the RunFriendly Account. Acceptable forms of identification typically include passport, driving licence, ID card etc. However, please read the venue description carefully as a small number of venues will insist on photographic

ID only. Where this is the case we include a note to this effect on the venue description.

Please note that each RunFriendly Account you purchase will only grant you access to a venue. You may not share your codes with others, or purchase codes on behalf of someone else. If you cannot provide ID which matches the RunFriendly Account purchaser details then you will be prevented from accessing venues.

When using RunFriendly services, you also shall be subject to any posted guidelines, FAQs, or rules applicable to such services, which may be posted and modified from time to time.

MONTHLY AND YEARLY subscriptions

Monthly and Yearly subscriptions are valid for entries to RunFriendly Partner Venues, which may be subject to change. All monthly and yearly subscriptions are valid only for the individual who has purchased them only.

RECURRING BILLING OF MONTHLY subscriptions . All Monthly subscriptions will be billed monthly, on the same date each month. By starting your Monthly Pass you authorise us to charge you a monthly membership fee, the 'Monthly Renewal Payment', at the then current rate.

RECURRING BILLING OF YEARLY subscriptions . All Yearly subscriptions will be billed annually, on the same date each year. By starting your Yearly Pass you authorise us to charge you a ‘Yearly Subscription Fee’, at the then current rate.

PAYMENT METHODS FOR MONTHLY subscriptions . You may edit your payment method information at any time via your account or by contacting [email protected]. If an applicable payment is not successfully settled, for any reason, you remain responsible for any uncollected amounts.

CANCELLATION OF MONTHLY subscriptions. Monthly subscriptions can be cancelled at any time up until the day before the renewal is due, to prevent the next Monthly Renewal Payment from being billed. UNLESS EXPRESSLY STATED TO THE CONTRARY HEREIN, OR AS PROVIDED BY APPLICABLE LAW, PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our subscribers. The amount and form of such refunds or discounts and the decision to provide them, are at RunFriendly's sole and absolute discretion.

PAUSING A MONTHLY SUBSCRIPTION. With a Monthly Subscription, the user will have the option to pause their subscription for a temporary period. While a user is paused, they

will not have access to any RunFriendly Venue Partners unless paid for directly to the venue or by a different provider.

RESUMING A PAUSED SUBSCRIPTION. When a user pauses a subscription, they have the option to pause for a defined period (1 or 3 months), or an undefined period. If the user has paused for 1 or 3 months, their Monthly Subscription will automatically resume on the date stated during the pause process, in the user's account and pause confirmation email. If the user has paused for an undefined period, their Monthly Subscription will remain paused until the user manually selects to resume their pass via their RunFriendly account. The price will be confirmed before the payment is taken.

10. MINIMUM AGE TO PURCHASE A PASS

You have to be aged 16 years or above to purchase a subscription. However some of our Partners allow parents and other legal guardians to purchase subscriptions to be used at Partner Venues for children under 16 in their care. This is most likely to be the case for Local Leisure Centre facilities where swimming subscriptions are available. As it is entirely under the discretion of the Venue you are advised to check with the Partner that you intend to visit if you would like to purchase a pass for children less than 16 years of age. Some of our Partners do require customers to be at least 18 years of age in order to purchase a pass, this will be made clear at time of booking.

11. VOUCHERS, DISCOUNTS AND PROMOTIONS

We do from time to time, we make vouchers and discounts available through affiliate websites or email promotions. Where applicable, the expiry date and validity period of a voucher or discount will be stated in any communications from us. We cannot guarantee the validity of voucher codes or discounts on websites not endorsed by ourselves. Vouchers and discounts will vary in their validity of use towards different subscriptions. Vouchers may not be valid at every gym on the website.

Vouchers and discounts cannot be used in conjunction with one another, unless explicitly stated – where a second voucher is applied to an account, the original voucher will be overwritten and its discount will be lost. Vouchers are non-transferrable and have no cash value. Placing a voucher for sale is strictly prohibited and will ensue in the voucher being made void.

To redeem a voucher, you must follow the stated guidance, typically to present the code at checkout, or through the voucher section of ‘My Account’ prior to checkout.

RunFriendly reserves the right to reject a voucher with reasonable cause, and to withdraw any offer at any time without warning.

12. FRIEND REFERRAL SCHEME

REFERRER REWARDS The terms for our referrer scheme are being developed with our RunFriendly user community. Guidance and terms will be provided upon the launch of a trial scheme.
