TRANSCRIPT
The BioPreferredSM Federal Procurement Preference Program
Objectives
After completing this training, you will be able to:
• Define biobased and BioPreferred.• Give three reasons why the program is so important.• Cite important legislative and executive mandates for
BioPreferred.• Explain the designation process for biobased product
groupings.
Objectives• List three places to locate biobased products for
purchase.• Access the BioPreferred Catalog.• Access model procurement language for
BioPreferred.• List three categories of BioPreferred products in
which you have purchasing requirements.• Discuss your responsibilities related to biobased
products and how you will execute those responsibilities.
What are biobased products? Commercial or industrial products (other than food or
feed) that are composed in whole, or in significant part, of biological products, renewable agricultural materials (including plant, animal, and marine materials), or forestry materials.
What are biobased products?• Biobased products are made from renewable
agricultural materials • Biobased products often replace petroleum-based
products in many areas including automobiles, construction materials, cleaning chemicals, and clothing.
What are biobased products? Many biobased products
are being made for the function and comfort in the interior of businesses and homes– carpet backing, – padding for furniture,– printing ink, – insulating foams, – molded appliance cases
for refrigerators and freezers.
What is BioPreferredSM?
• BioPreferredSM is the name of the procurement preference program designed to increase the purchase and use of biobased products by Federal agencies.
The 2002 Farm Bill charges the United States Department of Agriculture (USDA) with managing the BioPreferredSM Program.
What is BioPreferredSM? USDA is tasked with designating groupings of
biobased products that require a BioPreferredSM federal procurement preference.
Why Purchase BioPreferred? The BioPreferred Program
aims to increase the purchase and use of renewable, environmentally friendly biobased products while providing green jobs and new markets for farmers, manufacturers, and vendors.
Why Purchase BioPreferred?
The BioPreferred program offers three major benefits: – Climate Change Impact
Reduction;– Energy/Environmental
Security; and– Economic Development.
Climate Change Impact Reduction
Qualifying biobased products reduce the introduction of new fossil carbon into the atmosphere.
Economic Development
Biobased products create jobs by increasing demand for agricultural and forestry materials and by increasing new product development, manufacturing and ultimately sales.
Energy/Environmental Security
Biobased products replace petroleum products helping to increase U.S. energy and environmental security and independence. Many biobased products are sustainable, renewable and compostable.
Why Purchase Biobased Products? The purchase of BioPreferred products by
federal agencies is required by law and Executive Orders
Legislative Basis of BioPreferred Program
• Section 9002 of Farm Security and Rural Investment Act of 2002 (2002 Farm Bill) require each Federal agency to establish an affirmative procurement program for qualifying BioPreferred products
Food Conservation and Energy Act of 2008 (2008 Farm Bill)
For biobased products:
– Establishes process for determining eligibility criteria for intermediate ingredients and feedstocks for Federal agency procurement.
– Permits labeling of intermediate ingredients, feedstocks, and complex products
Executive Orders 13423 and 13514
Requires Agencies in acquisitions of goods and services, to use sustainable environmental practices, including purchase preference for biobased products.
Executive Order 13514
• Signed by President October 2009
• Requires that 95% of all new contracts, including contract modifications, for products and services specify biobased products.
Federal Acquisition Regulation
Final rule published 11/7/2007:– Part 23: Agencies must
consider biobased products in acquisition planning and solicitations
– Part 52: Agencies must include biobased in new solicitation provisions and contract clauses
BioPreferredSM Designation Process
The federal procurement preference process begins with the designation by USDA of groups of biobased products that meet specified criteria.
BioPreferredSM Designation USDA initiates the designation process by gathering
product data to determine biobased content, technical characteristics, public health, and environmental data for a grouping of products.
BioPreferredSM Designation Process
The BioPreferred designation process information is reviewed and presented through the Federal Register for public comment before final designation is made.
BioPreferredSM Designation Process
Once a product grouping has been designated, any commercially available product that meets the minimum biobased content standards within that grouping becomes eligible for procurement preference by the Federal Government.
BioPreferred Product Examples
Examples of designated BioPreferredSM items include;
• floor coverings• paints and coatings• cutlery• cleaners• lubricants
The BioPreferred Designation Process
USDA will continue to designate product groupings for procurement preference.
A complete list and detailed description of
each BioPreferredSM designated item, and items for future designation, can be found at the USDA BioPreferredSM Web page www.usda.gov/biopreferred

Work," • Section L "Instructions to
Offerors“ • Section M "Evaluation
Factors for Award"
Sample Procurement Language
Sample Biobased Contract Language provided for:• Custodial Services • Food Services/Cafeteria • Grounds Maintenance • Minor Construction • Operations and Maintenance • Vehicle Maintenance
Current Topics in BioPreferred BioPreferred Label
USDA is establishing a voluntary labeling program that will also make it easier for federal and contractor personnel, technical personnel, and the general consumer to identify qualified BioPreferredSM products.
Labeling Program• Voluntary labeling program allows use of
BioPreferred logo to identify qualifying biobased products
• Label will apply to productand/or packaging
• Proposed rule published July 2009
• Review and commentperiod and market research completed
• Final rule under preparation
Purpose of Label
• Expand product use• Increase availability of
information to consumer• Help manufacturers market
biobased products• Unbiased source and indicator
of biobased content
