7.1 Gary Pundsack of lnnergex Renewable Energy Inc. made a deputation concerning the Ramona Solar Project that is being proposed to be located along Fairgrounds Rd and Concession M-N and McArthur Sideroad. The project consists of approximately 490 acres on 10 properties with a potential project capacity of 24 to 60 mw. Mr. Pundsack outlined the process that is required in order to receive approval to locate the solar farm in the area.

RESOLUTION NUMBER CR.148.15 MOVED BY: O'DONNELL SECONDED BY: SHARPE THAT we receive the presentation from lnnergex Renewable Energy Inc. AND THAT we receive the petition concerning the proposed development; AND THAT Ramona Solar LP (the Registered Proponent) is proposing to construct and operate a Large Renewable Solar Project (LRP) in the Township of Ramara; AND WHEREAS the Registered Proponent acknowledges that the LRP and Connection Line, either in whole or in part is to be located on lands under the jurisdiction of the Township of Ramara; AND WHEREAS the Registered Proponent has requested that the Council of the Township of Ramara indicate by resolution their support for the LRP and Connection Line on the Lands; AND WHEREAS pursuant to the LRP I RFP, Proposals that receive the formal support of the local jurisdictional authorities of all the Project Communities in which the LRP and Connection Line are being located in the form of a support resolution will be awarded Rated Criteria points for the purpose of ranking the Proposal in relation to other Proposals for a contract under the LRP I RFP; AND THAT the Council of the Township of Ramara supports the development, construction and operation of the LRP and proposed Connection Line on the Lands in

theory, subject to a "predevelopment agreement" being entered into between the Proponent and the Township of Ramara; AND THAT the Council of the Township of Ramara will complete the prescribed Municipal Agreement form, Adjacent Landowners forms and Municipal Council Support Resolution form once an agreement is in place.

7.2 Rick Hunter of Planscape Inc. spoke to Council on behalf of Strawberry Island Resorts Inc. regarding the proposed development of Strawberry Island. Mr. Hunter provided information to questions/concerns that that were raised during the first public meeting in August 2014. There will be a second public meeting to be held on June 15, 2015 at the Ramara Centre for public comments concerning the development.

7.3 Ben Longstaff of the Lake Simcoe Region Conservation Authority spoke to Council concerning the Ramara Creeks Subwatershed Plan. Mr. Longstaff provided details on subwatershed plans, legislative requirements and the process involved in establishing subwatershed plans.

Deputy Mayor John O'Donnell stated that he attended a ribbon cutting for Helping Hands recognizing their new office location and attended the Simcoe County Hospitality Awards and brought greeting on behalf of the Warden.

Thank you all FCM members and partners. We made some progress in Budget 2015.

Our collective efforts resulted in the creation of an ongoing $1 billion fund for public transit and a commitment to proceed with a new public safety broadband network to provide local first responders with access to critical communications tools.

Please read our detailed 2015 federal budget analysis to learn more. We have also compiled reactions in the media. Check out photos from FCM Budget Day activities on Parliament Hill.

With a federal election on the horizon, our work starts today to build on Budget 2015.

I look forward to working with you to further advance federal recognition of municipalities as partners in solving key challenges facing the country, such as the housing crisis and outdated wastewater and transportation infrastructure.

The Government of Ontario Process for Ministers' and Parliamentary Assistants' Delegations at the

AMO Combined Conference

Sunday August 16 -Tuesday August 18 Niagara Falls, Ontario

Individual Ministers and Parliamentary Assistants are being asked to participate in municipal delegations. Please note that not all Ministers and Parliamentary Assistants will be taking delegations. If your municipality wishes to meet with a Minister or Parliamentary Assistant, we ask that you complete and submit the online form. Please note all request forms must include the name of a contact person who is knowledgeable about the issue and available to respond to ministry inquiries in a timely manner.

The Ministry of Municipal Affairs and Housing (MMAH) will respond to delegation requests for the Minister of Municipal Affairs and Housing. MMAH will advise other Ministers and Parliamentary Assistants of delegation requests and decisions on delegations will be made and given to you by the Ministers requested. To assist in expediting your delegation request, we ask that you use the Municipal Delegation Request Form rather than going through your MPP or directly to the Ministers' Offices.

In order to facilitate municipalities in planning their delegation schedules we will advise municipalities of their delegation times prior to the conference. As a result, no delegation requests will be accepted after the DEADLINE of MONDAY, July 06,2015.

Municipalities will be contacted by the respective Ministries about their requests and, if applicable, the meeting time and location, approximately one week before the Conference.

To request a delegation meeting with a Minister, please include all the issues that you wish to discuss with that Minister on a single form. If you are requesting delegation meetings with more than one Minister, each meeting request should be made on a separate form. Each year questions about Lake Simcoe water levels come up: Who controls them? Why are they so low? Why are they so high? To name a few. The fact is Lake Simcoe water levels are not "controlled'; they are "managed" with the understanding that climate conditions are complex and can be unpredictable at times. Here are some facts that provide a better understanding of Lake Simcoe water levels and how they are managed.

Lake Simcoe is part of a much larger system known as the Trent-Severn Waterway (TSW). Ultimately water levels in Lake Simcoe are managed by Parks Canada, the Federal Government, via the Trent-Severn Waterway. Management of this system is extremely complex and considers all the varying needs and impacts that each decision or action will have on the rest of the system.

Depending on your relationship with the lake, you may have a different perspective on water levels; however, we do need to remember that Lake Simcoe is only one part of a much larger system. A balance must be achieved between managing water levels to prevent flooding of prop­erty and managing water levels for recreational use and fish and wildlife habitats.

Changes in Lake Simcoe Water Levels

Typically Lake Simcoe water levels vary by about 0.4-0.5 metres during any given year. The highest levels usually occur between April and June. As the summer progresses, the levels begin to drop because of increased evaporation and reduced inflows. The lowest levels are reached in late fall and winter.

Why are Lake Simcoe Water levels lowered in the summer?

The lowering of water levels which occurs every year at the same time is referred to as "drawdown".

Drawdown begins in the summer because it takes time to gradually reduce the levels in the lake. This needs to take place to make room for the precipitation that happens in the fall, winter and spring. In

order to protect against flooding and optimize public safety throughout the interconnected system, the lake is lowered to make room for high inflows that are typical over the non-navigation (off-boating) seasons.

It is important to note that Lake Simcoe water levels do not actually fluctuate all that much (see chart). Historic lows run at 218.4 metres and historic highs run at 219.5 metres. Actual fluctuations over the course of any one year are even smaller.

Why can't the water levels in Lake Simcoe stay higher, longer?

Because Lake Simcoe is a part ofthe larger Trent-Severn Waterway system, actions taken to change the water levels in Lake Simcoe cannot occur in isolation of the entire TSW system. What happens in one lake or river impacts rivers and lakes both upstream and downstream. For example, keeping Lake Simcoe water levels higher into late summer increases the potential of flooding in cottage country the following spring. This is because Lake Simcoe acts as a large storage basin for winter and spring snowfall, melt-water and precipitation. If the lake levels are kept high for too long, essentially there wouldn't be enough room in the lake to hold the water from these natural cycles, which would cause flooding and other environmental issues within the water­shed.

Water levels are important to fish and wildlife

The spawning season for cold water fish species is October 1st to December 31st. During this season, the draw­down is not supposed to exceed 1 Ocm. It is essential to have the TSW systems water levels lowered prior to fish spawning as fish spawn close to the water's edge in shallow areas. If the drawdown is done after eggs have been laid, the eggs may be exposed, dry up and die. This will not only affect fish and their habitat but other wildlife as well.

Are there other factors that affect Lake Simcoe water levels?

Yes. Significant and sustained winds can result in increased water levels along windward shorelines. For example, three to four consecutive days of strong westerly winds may cause increased water levels along the eastern shores of Lake Simcoe. Changes in lake water levels caused by sustained wind is known as a "seche" or"seching':

CLASS ENVIRONMENTAL ASSESSMENT COMPREHENSIVE STORMWATER MANAGEMENT MASTER PLAN

The City of Orillia (City) has initiated the development of a comprehensive stormwater management master plan (CSWM-MP) in accordance with the Lake Simcoe Protection Plan, the Lake Simcoe Region Conservation Authority (LSRCA) Guidelines and the Municipal Class Environmental Assessment Process.

As of June 2, 2009 the policies of the Lake Simcoe Protection Plan came into legal effect. Policy 4.5 of the "Lake Simcoe Protection Plan" states that "municipalities, in collaboration with the LSRCA will prepare and implement comprehensive stormwater management master plans for each settlement area in the Lake Simcoe Watershed". The City of Orillia is a settlement area within the Lake Simcoe Watershed and therefore needs to prepare a comprehensive stormwater management plan.

The City has retained Aquafor Beech Ltd . to develop the Stormwater Management Master Plan. This Class Environmental Assessment (EA) Master Plan is intended to improve the management of stormwater for both existing and planned development. The Comprehensive Stormwater Management Master Plan study will be prepared following a Master Planning approach under the Municipal Class Environmental Assessment Process in compliance with the Municipal Engineers Association document "Municipal Class Environmental Assessment," (October 2000, as amended in 2007 and 2011). The long range planning approach that is undertaken within the process will enable the City of Orillia to identify opportunities and be proactive in addressing issues before they become a problem. It will also allow the City to implement individual works which, over time, collectively become part of a larger management system.

A key component of the study is consultation with interested stakeholders (public, landowners and regulatory agencies). Public consultation will involve one (1) Public Information Centre (PIC). This PIC will be designed to obtain input from the public to assist in the decision making process. We are interested in hearing any comments or input that you may have about this study. There are no formal presentations scheduled. City staff and their consultant will be available to discuss the proposed works.

Your comments will be maintained for reference throughout the project and will become part of the public record. Under the Freedom of Information and Protection of Privacy Act and the Environmental Assessment Act, unless otherwise stated in the submission, any personal information such as name, address, telephone number and property location

General Amendment to City of Kawartha Lakes Official Plan, Urban Settlement Area Boundary Refinements, and Secondary Plans for

Bobcaygeon, Fenelon Falls, Lindsay, Omemee, and Woodville

TAKE NOTICE THAT the Planning Committee, on behalf of the Council of the City of Kawartha Lakes, will hold a

Public Meeting on Wednesday, May 27, 2015 at 1:00 p.m.

in the Council Chamber, City Hall, 26 Francis Street, Lindsay, Ontario

THE PURPOSE OF THIS MEETING is to present and consider:

1. Endorsement of Secondary Plans for the urban settlement areas of Bobcaygeon and Lindsay together with the General Amendment to the City of Kawartha Lakes Official Plan. If the Secondary Plans are endorsed by Council, it is intended that the endorsed Secondary Plans be referred to the Ontario Municipal Board for consolidation with the Hearing of the outstanding appeals of the City of Kawartha Lakes Official Plan. The updated land use policies and schedules will provide guidance and direction in the management of land and the environment within the urban settlement areas of Bobcaygeon and Lindsay.

2. Adoption of three Secondary Plans for the urban settlement areas Fenelon Falls, Omemee, and Woodville. Policies contained in the General Amendment to the City of Kawartha Lakes Official Plan described above would apply to Secondary Plans for Fenelon Falls, Omemee, and Woodville. The updated land use policies and schedules will provide guidance and direction in the management of land and the environment within the urban settlement areas of Fenelon Falls, Omemee, and Woodville.

THE PURPOSE OF THIS AMENDMENT is to:

1. Introduce a General Amendment that amends Section 18 - Urban Settlement Designation and other policies in the City of Kawartha Lakes Official Plan regarding development in the urban settlement areas of Bobcaygeon, Fenelon Falls, Lindsay, Omemee and Woodville;

2. Introduce future development areas adjacent to the urban settlement areas of Fenelon Falls and Lindsay through the General Amendment;

3. Include new Secondary Plan policies for the urban settlement areas of Bobcaygeon, Fenelon Falls, Lindsay, Omemee and Woodville in the City of Kawartha Lakes Official Plan. The Secondary Plans include: • guiding policies for growth management, intensification and housing, economic

development, community facilities, parks and open spaces and trail systems, downtown development, sustainable development, urban design, natural heritage, cultural heritage, transportation and parking, servicing, environmental constraints, and land use;

• new and updated land use designations and policies to guide growth for residential, commercial, employment, institutional, community facility, and park development and protect environmental features;

• land use, environmental constraints, and transportation schedules; • identification of future development areas within the urban settlement areas of

Bobcaygeon and Fenelon Falls; and, • identification of Intake Protection Zone areas for the urban settlement areas of

Lindsay, Bobcaygeon, and Fenelon Falls.

4. To revise the urban settlement area boundaries based on the results of the Secondary Plan review for Bobcaygeon, Fenelon Falls, Lindsay, Omemee, and Woodville where appropriate; and,

5. To repeal the Town of Lindsay Official Plan, Village of Fenelon Falls Official Plan, and the County of Victoria Offici a I Plan for Bobcaygeon and replace these areas with Secondary Plans that reflect current planning policy.

The General Amendment and five Secondary Plans have been prepared to meet a number of key Provincial and local policies, including the 2014 Provincial Policy Statement, the Growth Plan for the Greater Golden Horseshoe and the City of Kawartha Lakes Official Plan.

ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of, in opposition to, or in respect of the proposed amendments. If You Wish to Be Notified of the adoption of the proposed official plan amendments, or of the refusal of a request to amend the official plan, you must make a written request to by providing your name and address on the appropriate form at the Public Meeting, or by sending such request to the address provided below.

If a person or public body does not make oral submissions at the public meeting or make written submissions to the City before the proposed amendments are adopted, the person or public body is not entitled to appeal the decision of the Council of the City of Kawartha Lakes to the Ontario Municipal Board.

What is Emergency Preparedness Week?

Emergency Preparedness Week is an annual event that takes place each year during the first full week of May.

This national event is coordinated by Public Safety Canada, in close collaboration with the provinces and

territories and partners. Ontario 211 and their supporters will be supporting Emergency Preparedness Week

May 3-9th 2015 to raise awareness of the 211 service and its benefits to residents during emergencies and

every day.

In Ontario, we are using the opportunity to partner with United Ways, municipalities and first responders to

build public awareness of the 211 service, and to encourage residents to make the right call when they need

help.

What is 211?

211 is an award-winning 3-digit phone and online service helping Ontarians connect to the complete range of

government and community-based health and social services. Calls are answered 24x7 by professional

information and referral specialists who are trained to assess caller needs, and to refer callers to the most appropriate resources.

211's resource database contains more than 60,000 records, making it the most comprehensive human

services database in the province. Combined with the demographic and caller needs information collected

through our calls, 211 provides individuals, agencies and planners with rich data on the supply and demand for human services in Ontario.

211 in Ontario is supported by the Province of Ontario (Ministry of Community and Social Services), local

United Way organizations, and some municipalities. 211 also receives project support from public and private sector partners such as Ontario Trillium Foundation and Green Shield Canada Foundation.

Where is 211 available?

Since late 2011, 100% of Ontario residents have access to 211 through the phone or through the online portal

at 211ontario.ca. 211 is also available in all of Nova Scotia, parts of BC, Alberta, and Quebec. In

Saskatchewan and Nunavut, residents can search an online portal for information, but telephone service is not yet available. Visit 211.ca for details.

211 service began in Atlanta, Georgia in 1996, and has grown in many communities and states since that

time. Today, more than 92% of Americans and 60% of Canadians have access to 211.

Who calls 211, and what do they call for?

In 2014, more than half a million calls were answered by 211 in Ontario. The majority of our callers (75%) are

women, with approximately one third being over the age of 55, one third in the 35-54 age group, and the

other third being under the age of 35. More than 35% of our callers identify themselves as low-income

individuals, many of whom are on some form of social assistance. Many callers are looking for help

themselves, while close to 30% are calling on behalf of a friend, family member or client.

The reasons why people call are quite varied. 211 is for everyone, so we get questions on everything from

affordable child care options, to mental health supports, to care for an aging parent, to supports for very basic

needs such as housing, food programs and financial assistance. Last year, the top reasons for calling in

Ontario included Health Services, Income & Financial Assistance, Housing, Legal & Public Safety and Food & Meals. At a local level, caller needs may be slightly different based on local environment or emerging issues,

but at a provincial level, these represent a good snapshot of why people are calling 211 in Ontario.

up. Sometimes, callers might need help accessing programs, or might need a reminder to follow-up on the

referrals made. With their consent, a small percentage of callers are contacted at a later date to ensure that

they have successfully connected with the recommended agencies or programs. From time to time, 211 also

provides advocacy in situations where the caller may not have the capacity to make the next call on their own.

How do United Ways and other community organizations support 211 and why?

United Ways have been a driving force behind the creation and proliferation of 211 services in communities

all across the U.S. and Canada. United Way is a major funder of 211 so by supporting United Way, people are

supporting 211.

For United Way and for the agencies they work with, 211 is critical to advancing priority goals. There are so

many people in our community who don't know where to turn when faced with challenges in their lives. 211

helps residents to navigate the system and find the support they need, which takes the strain off agencies and

other services like 911 which would be handling these calls. 211 also provides community organizations with

meaningful data about the types of services people are looking for in what neighbourhoods, which helps to

better serve the needs of the community.

What is the difference between 211, 311 and 911?

The N11 numbers are assigned by the CRTC to create easier pathways to help for Canadian residents, but it

can be confusing if you aren't sure which one to call.

By now, most residents (including children) are aware that 911 is the number to call for life-threatening

emergencies.

In larger Ontario cities, 311 is the number established to access information about municipal services (such as

by-law enforcement, road repairs, garbage collection, municipal recreation programs, property taxes, etc.).

211 is the number to call for information on community-based health, social and government services. It is

the number to call when you need help, but aren't sure where to turn.

Why is the message Make the Right Call?

Often, calls are made to 911 that aren't life-threatening emergencies. Some callers know they need help, and

may not be aware of their options, so they call the number they know. These calls, and the subsequent

response from Police, Fire and Paramedics, can tie up emergency resources when support is available

elsewhere. 211 (and 311 where it exists) can take pressure off of the 911 system by providing residents with

another easy-to-remember number to call for non-urgent needs. By educating people about the 211 service,

and encouraging them to make the right call, emergency resources can remain focused on emergencies.

Dear Mr. Mayor Clarke and Council Members,

I am writing to let you know about a very important awareness campaign that will be "running through" your area.

The Canal Pursuit for Mental Health is a 750 km run that Clay Williams, from Waterloo, ON is going to be doing in 8 days. Yes, running approximately 100 km a day! It starts on Friday, August 28th at Port Severn following the Trent Severn Canal and the Rideau Canal finishing on Friday, September 4th on Parliament Hill in Ottawa. Clay will be running along each of the 91locks and through approximately 30 towns. The awareness and fund raising campaign is for "Defeat Depression" in conjunction with the Mood Disorder Society of Canada.

This challenge came during a discussion between Clay and Kevin, a friend, after Robin Williams, the actor, had taken his own life. Clay is all too familiar with depression and suicide. His wife and daughter as well as myself (his sister) suffer from depression and we have two brothers who have taken their lives, twenty-five years apart. Our stories are painful and long as so many others are. I'm sure each of you knows a family member, friend or co-worker that has been affected by depression or other mental health issues or has committed suicide? Research shows that mental health issues affect 1 in 5 Canadians.

Clay is a 54 years old ultra runner. He began running in 2003. He has completed many 100 km runs, 48 hour runs, the Great Wall in China for Arthritis, and humanitarian runs to name just a few. Clay has had interviews with radio, newspapers and magazines. Canal Pursuit for Mental Health is his most unique run in that it will be his longest run. A personal one as he relates to the cause and wants the message out there, "Mental health stigma must end!" so that it becomes a topic of conversation and not a dark and lonely life to live or end.

Your support will magnify "Defeat Depression" campaign and donations tremendously, making that difference in lives, perhaps even someone you know. Mr. Mayor Clarke and Council Members, we ask for your endorsement for the Canal Pursuit for Mental

Health. Did you know that 70% of mental health problems have their onset during childhood or adolescence? A shocking statistic, do you agree?

Clay invites you, the council members in your area to join him on his run. Join him during his training run if you're a runner or a 15-30 min walk during a 6 hour weekend training run or strength training in the gym. (Bring along the media to spread the awareness campaign). Join him on August 28 at the start of the Run and/or have the residents in your area gather and_ wave and cheer him on as he runs through your area. You're invited to join him on September 4th, the last day of the Canal Pursuit for Mental Health and be a part of the last stretch with Clay as he carries his Canadian flag across the finish line on Parliament Hill to "Defeat Depression".

Clay's plan is to run this route laying down a challenge for other runners to do it next year, hopefully creating an annual event that will continue the battle against depression for years to come. With this in mind, Mr. Mayor Clarke and Council Members, in your hectic schedule, perhaps in conjunction with the Mental Health Services in your area and the Chamber of Commerce (who I will also be contacting) can brainstorm a perfect annual "Defeat Depression" awareness campaign prior to the Run. A challenge to the communities along the canal to collect the most pennies or nickels, a hot dog event, a fun day for children, a grandparents walk, a relay walk/run around the perimeters of your community with donations and pledges going to the Canal Pursuit for Mental Health. Make this "BIG NEWS" with the media about your campaign saying, "Defeat Depression- Talk to someone you trust. " You will make a difference!

Canal Pursuit for Mental Health: Waterloo man to run 750 km for Mood Disorders Society of Canada to promote awareness.

WATERLOO, ON March 17, 2015 Mood Disorders Society of Canada (MDSC) today extends an invitation to Canadians to get behind the Canal Pursuit for Mental Health Campaign through donations and sponsorship as Clay Williams runs from Port Severn to Kingston and all the way to Ottawa. The purpose of the run is to raise awareness of depression, end the stigma of mental illness, and to encourage people to reach out for help. Clay is running in honor of his wife, his daughter and his sister who all suffer from mood disorders, and in memory of his two older brothers who took their own lives.

The Canal Pursuit is a 750 km run roughly following the Trent Severn Canal from Port Severn to Trenton and then the Rideau Canal from Kingston to Ottawa, stopping in at each ofthe 911ocks on the way, and ending on Parliament Hill. Clay plans to start the run on August 28th, and complete it as quickly as he can, running 100 km per day, day and night with two hour rest stops every ten hours, and finishing on September 4th, 2015.

Clay Williams and Kevin Jenks developed this campaign, and are receiving support and encouragement from MDSC. "The conversation that we want to promote with this project is two-fold", says Clay. "First, if you're struggling with a mood disorder, talk to someone you trust. The second part oft he message is that physical activity can help make many symptoms of mood disorders more manageable, fitting in with the National Defeat Depression campaign. We all have an important role to play in getting rid of the stigma around mental illness, so that people can feel comfortable reaching out to seek treatment."

An application has been made by Lake Ramara Investments Limited, owner and Peggy Chiu, applicant requesting a minor variance under File A-9/15. The minor variance request is for an increase in the maximum gross floor area of the motel to permit an addition as well as for a reduction in the number of loading spaces required. The existing motel already exceeds the maximum gross floor area permitted as outlined in the zoning bylaw. The owners are proposing a one-story addition to the south-west side of the motel that would contain meeting room/conference center. The Committee received report BP-15-15 dated May 5, 2015. The Assistant Secretary Treasurer outlined the purpose of the application and advised the Committee that circulation had occurred in accordance with Provincial Regulations.

Peggy Chiu, applicant was in attendance and had nothing further to add.

Mike Thompson asked for clarification as to what exactly a loading area would look like and be used for at the establishment.

Peggy advised that 1 loading area was required under the previous Zoning Bylaw, and that they want to add an additional loading space to the other side of the building where the addition is being proposed. She explained the loading space is primarily used for deliveries of linens, catering, garbage collection etc.

Florian Camartin asked what the benefit of having the additional space would be.

Ms. Chiu advised that the applicant is proposing to add the additional space to the other side for deliveries where the conference room would be located. She did not believe having a third space would benefit the establishment.

Mr. Camartin asked for clarification of the building height.

Mr. Thompson explained addressing the existing height of the building is a house keeping item.

Mr. Camartin noted this was the best news he has received since the Casino came in. He was very pleased to see some development on Rama Road and noted that expansion is great. He fully supported the application.

Mr. Warren advised that he had visited the site, and that he felt the expansion is great for the area. He was in full support of the application.

Richard Whitty advised that in his opinion three loading spaces would definitely not be needed at the establishment and that he is happy to see some growth.

Doug Cooper advised he had no objections.

Mr. Thompson advised that the agreed with Florian, seeing commercial growth in the Township is great news.

Although no objections are being expressed for the creation of the proposed lot and the variance request, the owners should be aware of designated policies within the Lake Simcoe Protection Plan should they apply for any future development or site alteration. Approval for development or site alteration would be subject to Policy 6. 1 - 6. 7 and Policy 6. 20- 6. 29 of the LSPP.

That the owner demonstrate that Section 3. 1 of PPS2014 can be addressed appropriately which states that development shall generally be directed to areas outside of flooding and erosion. Mark Holliday was present and advised he had nothing further to add.

Mr. Thomspon advised that he had concerns with the lot size. He also was concerned with the comments received by the LSRCA with regards to the septic systems. He wondered if there would be enough room for a septic based on their comments. He explained to the applicant it may be best to defer the application until the applicant could demonstrate the septic systems would fit and the LSRCA is satisfied with the placement of the systems.

Doug Cooper advised he was in agreement with Mr. Thompson. He stated he walked to the back of the property and saw bulrushes on each side of the lot meaning there is water in the back which concerned him.

Richard Whitty wondered if the lot was big enough for a septic system.

Florian Camartin advised that he felt more information is needed to approve the application. He noticed that the lot had a lot of fill in it and wondered if a severance would be feasible.

Randy Warren agreed he would like more information. He noted that the LSRCA stated the property was within a drain in their comments.

Mr. Thomspon advised the owner it may be best to defer the application to get a more definitive answer from the LSRCA. He stated it would be helpful if the LSRCA comments included mapping and more information.

Mr. Holliday explained the intent of the severance is to enable them to fix the properties as there are currently two houses on the lot. They are hoping to repair the cottages and install septic systems for the houses as there currently is no sewage system on the lot.

Mr. Thompson noted that the one side of the proposed lot did not allow much room to traverse to the back of the lot.

Mr. Holliday advised they could straighten the house out as it is crooked on the lot. He asked for clarification for the setback for the septic system from the LSRCA.

Ms. Foster explained to the applicant a meeting could be planned for Township staff, LSRCA and the applicant to sort out the comments from the LSRCA.

Mr. Thompson advised the next best step would be to have a site grading plan done with the septic areas on it to demonstrate the room is there before returning to Committee.

Mr. Holliday agreed that would be best so he could ensure that the septic systems would fit on the lot prior to preparing a grading plan and would move forward from there.

Richard Whitty advised that he finds the lots in this area very interesting. He had a concern with the driveway width on the lot noting that from what he can see, it looks like the distance between the existing garage and the proposed garage is 12 feet, which the driveway runs through.

Ms. McKee advised that they confirmed with all their utility companies that the trucks are no wider than 8 feet.

Mr. Whitty had concerns that if the snow was piled up, there would be less room for the trucks to get through.

Ms. McKee advised that they blow the snow and would ensure that the way was clear.

Mr. Whitty was concerned about fire trucks getting to the house and felt uncomfortable with the proposal.

Doug Cooper explained that sometimes one has to look at the size of their lot, and propose a building that will fit. He felt comfortable that the drainage would be addressed at site plan approval stage.

Mr. Thompson advised that he measured the distance and there would be 13 feet across the driveway. He felt that the applicant is sandwiching the building onto the lot and didn't feel there was sufficient room.

Mr. Warren had concerns with the distances to the property lines of the proposed 0.6m. He considered if the applicant moved the garage closer to the lake, but noted it wouldn't make much of a difference.

Ms. McKee explained when planning the garage they tried to look further down towards the lake, but the garage would be too close and would be flooded due to the way the lot drops down towards the lake and they are trying to keep things high and dry. She explained there is insufficient room by the house and not enough room on the north side due to the septic system. She noted the existing 16' by 20' garage would most likely be demolished at some point in the future, but is not in their immediate plans.

Mr. Warren advised he could not support the application as presented.

Mr. Thompson noted if the 16' by 20' garage were to be demolished there would be much more room for the proposed garage.

Mr. Camartin advised he was not impressed with the drawing submitted by the applicant. He advised he is very concerned regarding the 13 foot driveway width.

Mr. Thompson noted he was surprised there are no provisions for a driveway width in the Zoning Bylaw or Ontario Building Code. He advised the applicant it might be best to have the property surveyed and look at other options for the garage. He advised that the sketch is not accurate and the Committee cannot make the decision with the information.

Ms. McKee agreed she would get a survey and return to Committee. Township of Ramara

Mr. Thompson noted that he too had no concerns as the sight lines were not impacted.

Paul Bertrand, father of the owner attended the hearing and had nothing further to add.

Mr. Warren asked if the access across the private road is registered on the deed.

Mr. Thomspon advised that a private road would be registered on title, and there would be an association that would pay to maintain the road.

Mr. Warren asked what the purpose of the stakes were in the ground.

Mr. Bertrand advised that there was a horseshoe pit there and thought perhaps that's what the stakes are for.

Mr. Warren advised he had no real concerns with the application.

Mr. Cooper advised that small lots created in the 1950's to 1960's like these generally create variance situations. He noted that the septic situation should be looked at as a precaution.

Mr. Bertrand advised that the owner does plan to rebuild a new house in the future, and is planning on installing a new system.

Mr. Whitty noted that from the survey it does appear that the septic has been thought of as a system seems to be plotted on the plan.

Mr. Bertrand advised that the owner compared his land to a neighbour that recently installed a Waterloo Bio-filter system and estimated the size. He noted that the subject property is larger than the lot he compared it to.

Mr. Whitty asked if the lot flooded. He was advised the lot does not flood. Mr. Whitty stated he had no concerns.

Mr. Thompson believed this would make the lakeside better and that the application makes sense.

Mr. Warren advised he was also in favour of the application.

An application has been made by Gerry & Vera Cameron-van Amelsvoort, applicants, requesting a minor variance under File A-1 0/15. The minor variance request is for a reduction in the front yard setback and high-water mark setback to a proposed dwelling. A minor variance was approved on the property in 2005 allowing for a 0.93m front yard setback and a 3.96m setback to the highwater mark. The applicant is changing the shape of the proposed house and as such requires a new variance. The proposal will require the following variances to Zoning Bylaw #2005.85, as amended:

In order to address designated policy 6.45 [c) of the LSPP with regard to limiting the scope of encroachment of the proposed development within the 30m minimum vegetation protection zone of the Lake Simcoe shoreline, we recommend that the allowable lot coverage be no more than 30%. Coastal engineering report to be completed. Owner provide a 3m width planting plan along the entire shoreline. A permit be obtained for all development and site alteration.

Ms. Foster advised the Committee that the applicant has had several meetings with the LSRCA and the concerns have been addressed and the applicant is aware of what is required.

Mr. van Amelsvoort was in attendance and had nothing to add.

Mr. Cooper supported the application noting there were no major changes to the original board order and that the situation with the LSRCA has been resolved.

Mr. Whitty had no issues and noted the original application was denied in 2005 due to lack of information, not because the Committee didn't support the proposal.

Mr. Warren asked if the applicant had done the excavation on site.

Mr. van Amelsvoort advised that the previous owner had a permit issued for a dwelling on the lot and had a footing put in.

Ms. Foster advised the Committee that the previous owner had a permit issued from the LSRCA and Township to develop the lot but health conditions have impaired his ability to continue, which is why the lot is being sold.

Mr. van Amelsvoort explained their proposal includes a slab on grade, where the last proposal had a crawl space.

Mr. Warren had concerns with ice jams affecting the property and asked if the Township would be held liable.

Mr. Thompson believed that the coastal engineering study would address those concerns. He also noted the LSRCA may require a covenant be registered on title.

Mr. Camartin noted that the lot is messy, and difficult to develop - but that the water and sewer will definitely help.

Mr. Thomspon noted it was a creative way of using the property and agreed that the sewers help in making the lot coverage a nonissue.

Mr. van Amelsvoort applauded the Committee for the time, consideration and care they put into the applications that come in front of them. He advised that he has been to many Committee of Adjustment hearings in other municipalities that do not work with the applicant the way the Ramara Committee does. He noted it was refreshing to see a Committee work with the people instead of pushing the applications back with no support or information on how to rectify the situation. He appreciated that Ramara Township has a Committee with such considerate members that take the time to better the community and the residents and properties within it.

5. MINUTES

RESOLUTION CA-21-2015 MOVED BY: Florian Camartin SECONDED BY: Doug Cooper THAT the minutes of the April7, 2015 hearing be approved presented.

6.1 The Committee received the Notice of Board Hearing for the OMB regarding the Leis/Ruhl consent and variance applications. The Committee expressed concern that the Township would not be present as they felt the Board would not have an understanding of why the Committee chose to approve the application. Ms. Foster explained that since the Committee approved the application they showed support for the boundary adjustment, the appellant and applicant will need to be present at the hearing as it is a civil dispute over the boundary adjustment. She advised that the minutes, decision, report and all correspondence are submitted to the OMB with the appeal and that the OMB reviews all of the documents prior to the hearing. Mr. Camartin was particularly concerned as he feels the land is not prime agricultural and hopes that the Board does not deny the application.

BEING A BYLAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE RAMARA SOCCER CLUB AND THE CORPORATION OF THE

TOWNSHIP OF RAMARA

WHEREAS the Municipal Act, R.S.O. 2001, provides that a municipality has the capacity, rights, powers, privileges of a natural person of exercising its authority under this or any other Act;

AND WHEREAS the Council of the Corporation of the Township of Ramara deems it expedient to enter into an agreement with the Ramara Soccer Club for the use of portions of the property being the soccer fields and surrounding areas associated with the property for soccer games and practices.

AND WHEREAS the Council of the Corporation of the Township of Ramara deems it expedient to enter into an agreement with the Ramara Soccer Club to establish terms of use and maintenance of the grounds;

NOW THEREFORE the Council of the Corporation of the Township of Ramara enacts as follows:

1. THAT the Mayor and Clerk are hereby authorized to enter into an Agreement with the Ramara Soccer Club substantially in the form attached hereto as Schedule A;

2. THAT this bylaw shall come into force and take effect on the date of passing.

THIS AGREEMENT DATED THE __ DAY OF ___ , 2015

BETWEEN THE RAMARA SOCCER CLUB

(Hereinafter called the "Club")

AND THE CORPORATION OF THE TOWNSHIP OF RAMARA

(Hereinafter called the "Township")

WHEREAS the Ramara Centre property located at Part of Lot 27, Concession 10, Township of Ramara, known municipally as 5482 Highway 12 (hereinafter called the "property"), is owned and managed by the Township;

AND WHEREAS the Club uses those portions of the property being the soccer fields and surrounding areas associated with the property for games and practices (hereinafter called the "grounds");

AND WHEREAS the Township and the Club are desirous of entering into an agreement to establish terms for use and maintenance of the grounds;

NOW THEREFORE the parties to this agreement covenant and agree as follows:

1) TERM:

a) The Club may have full use of the existing and future soccer pitch areas and grounds for a period of four years (May to September).

b) Paragraph (a) above does not give the Club exclusive use of the property and the Club will advise the Township of the dates and times required by the Club as early in the spring as possible.

c) The Township reserves the right to prioritize the use of the property for special events from time to time;

d) The Township reserves the right to restrict usage of the fields in any given year up to May 15th subject to the discretion of the Parks Foreman and the Parks and Recreation Coordinator for the Township.

2) CAPITAL WORKS AND MAINTENANCE:

a) The Township will continue with its current grass cutting policy which is minimum every 14 days;

b) The Club will maintain the grounds to standards approved by the Township;

c) The Club will keep the grounds in a clean and orderly manner, free from all garbage and refuse. The property shall be left in such condition at the end of each practice and game;

d) The Club shall continue with its weed program established in 2005 to include:

i) Weed and feed playing fields in the spring of each year; ii) Fertilizer playing fields in the fall of each year.

e) The Township will provide 1 lockable dumpster during the soccer season at the Township's cost. A key will be provided to the soccer club which must be returned immediately upon end of this contract agreement;

f) The Club will endeavour to provide funds to prepare and gravel the parking area between the newest soccer field and the small grassed ball diamond;

g) Upon termination of this Agreement, all leasehold improvements shall become the property of the Township;

h) The Club will advise soccer registrants of the 'No Dogs Allowed' policy on the property and the Township will post proper signage and provide bylaw enforcement;

i) The Township will provide portable toilets to be located on the property from May to September of each year at the Township's cost. As agreed the Club will be invoiced for hand sanitizer in each of the units at the end of the season;

j) The Township will provide signage to alert users of the fields that the Ramara Centre grounds is a Dogs Prohibited zone;

k) The Township will install signage in 2015 alerting users of the fields that Ramara Township supports the No Smoking near playgrounds or playing fields legislation as mandated by the Province;

I) The Club will advertise for and choose their own vendor for Saturday morning games keeping in mind that the vendor must still obtain licensing and inspection from the Township;

m) The Club may proceed with capital works on the property subject to the approval of the Township. This includes but is not limited to the planting of trees to provide shade on the berms of the fields.

3) ADULT LEAGUE PLAY AND CHARGES

a) It is hereby acknowledged that an adult league has been established with the Club. While the Township currently maintains a zero fee facility structure for players under 18 years for the remainder of this agreement, a fee shall be attached to adult league games. In 2015, that fee shall be $10 per game+ HST and returning to the current established facility rental fee for adult league play.

4) DAMAGE/INSURANCE/INDEMNITY/NOTICE:

a) It is hereby acknowledged and agreed that the Township shall not be liable at any time for any damage to the property of the Club which is left or installed upon the property, and which may arise from or be attributable to vandalism or theft occasioned by a third party.

b) The Township shall not be responsible for any personal injury sustained by a Club player, coach, manager, spectator or any employee or other person who may be upon the property or in entrances thereto. All risks of any such injury shall be assumed by the Club, who shall hold the Township harmless and indemnified there from.

c) The Club shall obtain and provide proof that the Township is named as insured on the Club insurance policy. The minimum liability insurance shall be $5,000,000.

d) The Club shall give the Township prompt written notice of any accident or any safety hazards on the property.

e) The Club on behalf of itself, successors and assigns, agrees to indemnify and save harmless the Township from and against any and all claims, suits, actions and demands whatsoever which may arise either directly or indirectly by reason of this Agreement.

f) Any notice which either of the parties is required or permitted to give pursuant to any provision of this Agreement, if intended for the Township shall be left in the Ramara Centre Administration Office (mail slot of office door), or if intended for the Club, shall be mailed to the Ramara Soccer Club, PO Box 742, Orillia, ON L3V 6K7.

4. Either party to this agreement may terminate this agreement by notifying the other party with one year's notice.
