The Law Offices of Justin G. Morgan, P.A. recently made a recovery of $260,000.00 for a client after a very serious automobile accident.

After the accident, our client suffered many aches and pains typically associated with an automobile accident; such as neck pain and back pain. However, our client also had head pain and headaches after the accident, which became progressively more severe. This condition ultimately required necessary corrective surgeries. To complicate the claim for the head injury, our client had a significant pre-existing medical condition and prior surgeries for issues related to the head pain and headaches.

After the conclusion of our client’s initial medical care, the claim was presented to our client’s own insurance company. Our client’s insurance company agreed to pay the $10,000.00 underinsured motorist’s policy limit, and that claim was resolved.

The claim was also presented to the at fault driver’s insurance company; and after much negotiation prior to a lawsuit being filed, the top and final pre-lawsuit offer was $32,000.00, due to the fact that the insurance company was not allowing any value at all for our client’s head injury. The insurance company claimed the head injury was entirely a pre-existing condition.

Not being deterred by the denial of the head injury claim, our firm filed suit, even though the case was very challenging. After extensive litigation, consultations with expert witnesses, and before trial, the case settled for $250,000.00, when at the outset of presentation of the

claim, the defendant’s insurance company only offered $32,000.00. The total recovery for our client was $260,000.00, which was $218,000.00 more than what was offered by the insurance companies prior to the lawsuit being litigated and settled prior to trial.
