THE OWNERS’ ASSOCIATION AT REDWOOD LAKES ARCHITECTURAL DESIGN GUIDELINES

Revised July 2018 (supersedes all prior editions) FOR MODIFICATIONS REQUIRING REVIEW AND APPROVAL BY

THE ARCHITECTURAL REVIEW AND COVENANTS COMMITTEE (“ARCC”)

Living in a planned community such as Redwood Lakes involves certain responsibilities. In order to preserve the value, desirability, attractiveness and architectural integrity of Redwood Lakes, the Redwood Lakes Homeowners’ Association Architectural Guidelines (“Design Guidelines”), as authorized by the governing documents, have been prepared. Since agreement to abide by these documents was recorded as part of the deed to every property within Redwood Lakes, all residents and property owners are subject to the provisions of the design guidelines stated in this guide. Homeowners are responsible for requiring a tenant to follow these guidelines for any changes they may make. The Architectural Review and Covenants Committee (“ARCC”) is charged with the responsibility of reviewing and approving, where appropriate, all proposed exterior alterations and improvements to residential dwellings and/or lots in this community prior to any construction or installation. The purpose of the ARCC and these Design Guidelines is not to restrict individual creativity or personal preferences, but rather to assure the overall continuity and harmony of design and building materials. This will help preserve and enhance the appearance and value of the Redwood Lakes neighborhood. The architectural character of all structures, or alterations, additions, or improvements thereof (other than interior alterations not affecting the external appearance of a structure) when visually related to each other and the surrounding natural environment shall be harmonious in terms of type, scale, size, form, color and material. The ARCC has established Design Guidelines to assist property owners in planning home improvements. Any addition, alteration or improvement in or to any lot or any portion of the property that is visible on the exterior of the home or on the property, requires written approval from the ARCC before improvements are started. In addition to these guidelines, owners must refer to the Declaration of Covenants, Conditions, Restrictions and Reservation of Easements of Redwood Lakes which are part of the documents of incorporation for this community. Of note, Article VI consists of General Restrictions on the Use of Lots and Improvements to be Made Thereon and Article IX discusses Party Walls and Party Fences. The sale of a home may be delayed if inspection for the Resale Disclosure Documents finds unapproved elements. The homeowners are responsible for the method of construction, the quality of the tasks, the meeting of all building codes, and obtaining the necessary permits. No homeowner shall change any part of the exterior to different color, or alter the exterior of any improvement on the property, including, but not limited to the doors and windows without prior written approval of the ARCC on the Owners’ Association at Redwood Lakes, Inc. Architectural Review Form (“ARF”) form. (NOTE: The ARF can be found on the management company’s website or you may contact

the management company and a form will be sent to you.) APPROVAL IS REQUIRED FOR ALL EXTERIOR ALTERATIONS AND MODIFICATIONS. The ARCC is only interested in the appearance of the exterior change to the property. FAILURE TO OBTAIN WRITTEN APPROVAL OF THE ARCC WHEN REQUIRED WILL CONSTITUTE A VIOLATION OF THE GOVERNING DOCUMENTS AND MAY REQUIRE MODIFICATION OR REMOVAL OF UNAUTHORIZED WORK OR IMPROVEMENTS AT THE HOMEOWNER’S EXPENSE. Once an application has been approved by the ARCC, the plans must be followed as approved. Any subsequent modification to the existing approved plans must receive written ARCC approval prior to construction. The Architectural Review Form (“ARF”) form submission is required in accordance with these Design Guidelines and plans must be submitted, even if the identical improvement was previously approved in the neighborhood.

CATASTROPHIC EVENT In the event of a catastrophic event to the dwelling or property (such as fire, tornado, etc.), rebuilding of the home or other structure without substantial changes does not require a review by the ARCC. Substantial changes in style of windows, doors, and garage doors as well as change of type of material, such as replacing siding with brick, must be approved. Additions to a house, such as a covered porch on the front of the house, a deck, or a screen-in porch, must be approved. Relocation of any structure must be approved. A new landscaping plan must be submitted for the yard, but the restoration of lawn surfaces requires no approval.

SUBMITTAL AND REVIEW PROCEDURES The topics in the guidelines below are in alphabetic order by topic. Be sure to check all pertinent topics related to your project. 1) Complete the Owners’ Assocation at Redwood Lakes Architectural Review Form (“ARF”) form. The current version of the form is available on the management company’s web site or, upon request, the management company will mail a copy to you. A copy is distributed with these guidelines. The form comes with instructions, including how to submit it. The attachments needed for the ARF will vary greatly depending upon the project. Contact the management company if there are any questions about what to include. Most submissions need drawings/photos of the improvement or addition that include the following:

a) Provide a plan of all proposed improvements and overall dimensions.

b) Show the location of improvement as it relates to the residence and all adjacent property lines, and/or setback dimensions. Use a copy of the site plan if appropriate.

Page 3: THE OWNERS’ ASSOIATION AT REDWOOD LAKES … · The ARCC has established Design Guidelines to assist property owners in planning home improvements. Any addition, alteration or improvement

Redwood Lakes HOA Guidelines July, 2018 Page 3 of 13

c) Provide a description of building materials, colors, and finishes. Show this information on plans where possible or show individually by item its material and color. For example, a screened in porch will have material and color displays for at least flooring, railing, roof, screen and gutters.

d) Provide all appropriate construction details.

e) Drainage and grading must be clearly indicated when the change impacts any neighboring property. Identify all proposed and existing drainage, the direction of water flow and how surface water is to be collected. The property owner is responsible for installation of proper drainage. No owner may alter, modify, remove or replace any drainage without receiving prior written approval from the ARCC. No owner may alter any existing drainage patterns to neighboring lots.

2) Keep a copy of the completed application package for your future reference. 3) The ARCC will evaluate all completed applications within 45 days of the receipt of all required materials. The ARCC will indicate its approval, approval with conditions, request for more information, or denial. The paperwork will be sent to the management company. 4) The management company will record and maintain the ARCC’s decision. They will also notify the applicant, in writing, of the decision. The Board of Directors (BOD) will receive a copy of all ARCC decisions. Retain a copy of the application and decision for your records. 5) Disapproved requests will identify the reason for the rejection. Homeowners are requested to make the necessary changes and submit the request for reconsideration. All disapproved requests may be appealed in writing. The appeal will be sent by the homeowner to the management company. The BOD will consider the appeal and make a decision at the next regularly scheduled meeting of the BOD. The decision of the BOD will be the final arbitration of any request.

GUIDELINES BY TOPIC ANIMALS - Dog runs are PROHIBITED. No section of a yard may be fenced off and used for dog activity. Dog houses and any other outdoor shelter built for animals may be permitted with a design similar to that of the house; however, all shelters must be approved by the ARCC. ANTENNAS AND SATELLITE DISHES - Satellite dishes that are 1 meter in diameter or less, television antennas and MMDS (multichannel, multipoint distribution) antennas are permitted but the installation, including location, must be approved. All wires and cables connected to these devices must be attached securely and not allowed to hang loosely. 1. Location - Devices must be installed in a location that will have minimum visibility from the front of the home. Whenever possible, the devices will be located in the rear yard, rear roof, or part of the roof that cannot be seen when viewing from the front of the house. Other locations are acceptable when the above locations provide unacceptable quality or increase the installation cost. Devices may not be placed beyond the front plane of the house simply for convenience.

2. Screening - Satellite dishes and antennas which are installed at ground level will be screened so that they are not visible from the street or to other lot owners to the greatest extent practical. 3. No longer in use - An antenna or satellite dish that is no longer in use is encouraged to be removed, especially if it is installed at ground level. ATTIC FANS - Attic fans are permitted. They must be installed on the rear side of the roof ridgeline, so as to have no visibility from the front of the home. BARBEQUES and PORTABLE GRILLS – Barbeques and portable grills are NOT to be permanently stored in the driveway or the front of the house or on the sides of the house parallel to the right or left sides of the neighbors’ houses. They will be out of site when not in use. This includes charcoal grills, smokers, gas and electric grills. BASKETBALL BACKBOARDS - Permanent basketball backboards are prohibited. Portable backboards are acceptable provided they are properly maintained and the entire playing area is located on owner’s property. Portable backboards must not impede the use of sidewalks and must be moved away from streets, aprons and sidewalks to another location on the owner’s property when not in use. Permanent court markings are not permitted on the playing surface. CLOTHESLINES - Clotheslines or similar apparatus for the exterior drying of clothes or household items are NOT permitted. DECKS and SCREENED IN PORCHES - All decks and screened-in porches, including the conversion of a deck to a screened in porch, must be approved by the ARCC prior to installation. Complete plans must be submitted with color samples as required. Re-staining an existing deck with the same color does not require approval. If sun screening is needed on a screened-in porch, roll-up shades screens are useful for permanent placement. Blankets, sheets and towels may not be used as sun screens on screened-in porches or decks. 1. Location - Decks and stairs must be located in rear yards and must not break the side plane of the house. Decks shall not be erected forward of the rear plane of a dwelling unit. 2. Specific dimensions shall be considered on a case-by-case basis. 3. Color - The band boards, picket rails, posts and top rail may be stained or painted with a color approved by the ARCC. Consider natural wood hues or stains for wooden structures. Wood stains may allow the wood grain to show. An accurate picture showing a sample of wood stain color or paint color must be included with the application. If the decking material is composite, PVC or plastic, an accurate picture showing a sample of that color must be included with the application. Aluminum pickets may be selected but the color must be approved. All components must be properly maintained.

4. Under-deck Storage - Elevated decks have an under-deck area which can have a negative visual impact on adjoining neighbors, particularly when used as an informal storage space. The use of decorative screening or landscaping to minimize the adverse visual impact is encouraged and may be required by the Association. The installation of lattice for screening purposes is permitted for elevated decks. Lattice openings must be a minimum of one inch wide. 5. Privacy Trellises & Screens - The attachment of privacy screens and trellises for elevated decks will be permitted if consistent with the size of the deck and house. Privacy screens shall not extend more than three feet above the top rail of the railing. Examples of objects include but are not limited to large stones, sculptures, benches, weather vanes, freestanding poles of all types, fountains and water falls, and items attached to approved structures. These items will be evaluated for size, location, compatibility with architectural and environmental design qualities and visual impact on the neighborhood and the surrounding area. Small, decorative objects including flowerpots, small rocks, and small decorative garden accents do not need approval. Note: Swings, gliders, play sets, and other such items are not allowed in front yards. DRIVEWAYS - Driveways must be maintained in good condition. Crumbling concrete or asphalt or loss of smooth service must be repaired. There will be only one driveway per yard which will be oriented to the house’s garage door or doors. Any addition to or extension of the driveway must be approved by the ARCC. Guidelines for driveway extensions and modifications are below: 1. The material for the any extension to the driveway (used as a surface for motor vehicles) must be the same as the original driveway material and be contiguous material. Adding gravel to the side of the driveway and using it for an extension is not permitted. 2. A modification to the driveway cannot include widening the driveway width (increasing the length of the distance) where the driveway meets the street or the sidewalk. 3. All extensions made to the driveway width must be on the side of the driveway further from the front door. 4. The driveway may be widened up to a maximum of nine (9) feet wide. The new total width of the driveway at the garage wall will typically be 28 to 32 feet if it is increased to permit the parking of one extra vehicle near the garage door. (Houses on corner lots may have a slightly different configuration.) 5. Modifications at the sides of the driveway must not have any material, such as gravel, other rocky material or pavers which would permit vehicles to be driven or parked upon it. Modifications to the areas beside the driveway which are not for driveway extension are considered landscaping activity and approved/disapproved on a case by case basis.
