TAKE note that the notice made under Section 79 of the Fisheries Management Act 2007, dated 21 December 2010, and published in the South Australian Government Gazette dated 24 March 2011, on page 823, being the fourth notice on that page, referring to the Gulf St Vincent Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a Gulf St Vin- cent Prawn Fishery Licence to use prawn trawl nets in the area specified in Schedule 1, during the periods specified in Schedule 2, and under the conditions specified in Schedule 3.

FISHERIES MANAGEMENT ACT 2007: SECTION 79

TAKE note that the notice made under Section 79 of the Fisheries Management Act 2007, dated 21 December 2010, and published in the South Australian Government Gazette dated 6 January 2011, on page 3, being the fifth notice on that page, referring to the West Coast Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a West Coast Prawn Fishery Licence to use prawn trawl nets in the waters specified in Schedule 1, under the conditions specified in Schedule 2, during the period specified in Schedule 3.

SCHEDULE 1

The waters of the West Coast Prawn Fishery adjacent to Venus Bay.

SCHEDULE 2

1. Each licence holder must ensure that a representative sample of the catch (a ‘bucket count’) is taken at least three times per night during the fishing activity.

2. Each ‘bucket count’ sample must be accurately weighed to 7 kg where possible and the total number of prawns contained in the bucket must be recorded on the daily catch and effort return.

3. Fishing must cease if one or both of the following limits are reached:

(a) The average catch per vessel, per night (for all three vessels) drops below 300 kg for two consecutive nights.

(b) The average prawn ‘bucket count’ for all three vessels exceeds 240 prawns per bucket on any single fishing night.

4. The fleet must nominate a licence holder to provide a daily update by telephone or SMS message to the PIRSA Fisheries Manager, to report the average prawn catch per vessel and the average prawn ‘bucket count’ information.

5. No fishing activity may be undertaken between 0700 hours and 1830 hours on any day during the period of this notice.

FISHERIES MANAGEMENT ACT 2007: SECTION 115

TAKE notice that pursuant to Section 115 of the Fisheries Management Act 2007, Pang Quong of PQ Aquatics, 4 Burrawong Avenue, Seaford, Victoria 3198 (the ‘exemption holder’), or a person acting as his agent, is exempt from Sections 71 (1) and 72 of the Fisheries Management Act 2007, but only insofar as the exemption holder shall not be guilty of an offence when taking one egg-bearing male Leafy Sea-dragon (the ‘exempted activity’) from the waters described in Schedule 1, subject to the conditions specified in Schedule 2 from 1 November 2011 until 1 April 2012 inclusive, unless varied or revoked earlier.

SCHEDULE 1

South Australian coastal waters excluding waters within one nautical mile of the jetties at Rapid Bay and Second Valley, excluding waters in aquatic reserves and marine parks.

SCHEDULE 2

1. The specimen collected pursuant to this exemption must be retained by the exemption holder.

2. The exemption holder or an agent must notify PIRSA Fisheries on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. 9902445.

3. The exemption holder must post a written report to the Director of Fisheries (G.P.O. Box 1625, Adelaide, S.A. 5001) immediately after collecting a Leafy Sea-dragon pursuant to this exemption, providing details of the location, time and conditions of the collection.

4. The exemption holder must also provide a written report to the Director of Fisheries (G.P.O. Box 1625, Adelaide, S.A. 5001) by 1 May 2012, providing the following information:

• The number of eggs hatched from the specimen collected pursuant to this notice;

• The number of animals hatched from these eggs and an indication of survival rate;

• The number of surviving animals kept as broodstock and the number of animals sold domestically, exported or given away; and

• A status report on the breeding program of the Leafy Sea-dragon.

5. While engaged in the exempted activity the exemption holder or his agents must be in possession of a copy of this notice and must be produced to a PIRSA Fisheries Compliance Officer, if requested.

6. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice.

TAKE notice that, pursuant to Section 115 of the Fisheries Management Act 2007, Rachel Lawrie of Ocean Eclipse Pty Ltd, 131 Flinders Highway, Port Lincoln, S.A. 5606 (the ‘exemption holder’) is exempt from Sections 52, 53 and 70 of the Fisheries Management Act 2007, but only insofar as she may take Razorfish (Pinna bicolour) for the purpose of aquaculture broodstock (the ‘exempted activity’) in the waters specified in Schedule 1, subject to the conditions in Schedule 2 from 17 May 2011 until 1 January 2012, unless varied or revoked earlier.

SCHEDULE 1

South Australian coastal waters of Denial Bay and St Peters Island Area.

SCHEDULE 2

1. The exemption holder may take a maximum of 500 Razorfish (Pinna bicolor) for the purpose of aquaculture broodstock.

2. A maximum of 50 individual species may be taken from each collection site. Each collection site must be a minimum of 100 m apart to reduce localised depletion of stock at each site.

3. No specimens taken pursuant to this exemption can be sold or transferred to another party.

4. All Razorfish taken pursuant to this exemption must be delivered to and retained on the registered aquaculture site of Land-based Aquaculture Licence No. FT00043.

5. The exempted activity may also be conducted on the exemption holder’s behalf by Dallas Power.

6. The exemption holder or agent must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and other related questions. Exemption No. 9902446.

7. The exemption holder must provide a written report to the Executive Director, Fisheries and Aquaculture, (G.P.O. Box 1625, Adelaide, S.A. 5001) within 14 days of any collection. The report is to provide details of the time, date, location and number of fish collected, including details of any mortalities.

8. The exemption holder must provide a written report to the Executive Director, Fisheries and Aquaculture, (G.P.O. Box 1625, Adelaide, S.A. 5001) within one month of the expiry of this notice and provide a report detailing a summary of the fish collected including the time, date, location and number of fish collected, including details of any mortalities along with a summary report of any outcomes of the breeding program during the period of the exempted activity.

9. While engaged in the exempted activity the exemption holder must carry or have about or near their person a copy of this notice. Such notice must be produced to a PIRSA Fisheries Officer, upon request.

10. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice.

NOTICE OF CONFIRMATION OF ROAD PROCESS ORDER

Road Opening and Closing Martin Road, Bute

BY Road Process Order made on 15 December 2008, the District Council of Barunga West ordered that:

1. Portions of Allotment 96 in Deposited Plan 39125 and Allotment 441 in Filed Plan 190193, more particularly delineated and numbered ‘10’ and ‘11’ respectively on Preliminary Plan No. 08/0047, be opened as road, forming a re-alignment of the adjoining Martin Road and the railway level crossing.

2. The whole of the un-named public road (railway level crossing) and a portion of the un-named public road generally adjoining Martin Road and the eastern boundaries of Piece 91 and Allotment 96 in Deposited Plan 39125, more particularly delineated and lettered ‘A’, ‘B’ and ‘C’ on Preliminary Plan No. 08/0047 be closed.

3. The whole of land subject to closure lettered ‘A’ be transferred to Viterra Operations Ltd in accordance with agreement for transfer dated 15 December 2008, entered into between the District Council of Barunga West and AusBulk Ltd.

4. Transfer to the Minister for Transport the whole of the land subject to closure lettered ‘B’ and ‘C’ for use for railway purposes.

On 3 July 2009, that order was confirmed by the Minister for Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 80656 being the authority for the new boundaries.

Pursuant to Section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.

The policy ordinarily covers an architect whether or not there has in fact been any negligence. By providing this protection for architects, professional indemnity insurance also protects the consumer and the public at large. Many registered architects in South Australia already have professional indemnity insurance. The purpose of this note is to inform those who do not have insurance that the Architectural Practice Act 2009 (which came into force on 1 January 2011), now makes it compulsory for anyone in South Australia wishing to register as an architect, or to continue to provide services as a registered architect to either have this insurance in place themselves, or to make sure that they are covered by their employer’s policy. Sections 28(1) (a) to (d) of the Act deal with the requirements for registration as an architect, and Section 28(1)(c) states that, unless the Board gives an exemption, any person applying for registration must satisfy the Board that they are:

“...insured against civil liabilities that might be incurred by the person in connection with the provision of services as a registered architect.” Section 59 of the Act prohibits any registered architect from providing services as a registered architect unless insured or indemnified against civil liabilities that might be incurred by the person in connection with the provision of architectural services. Any architect who provides architectural services without having professional indemnity insurance in place could be subject to disciplinary proceedings for unprofessional conduct. Amount of Insurance Cover The Act does not specify a minimum amount of professional indemnity insurance cover. An architect must be insured against civil liabilities “...in a manner and to an extent approved by the Board...”. The Board considers that any architect applying for registration should have in place as a minimum requirement, professional indemnity insurance of $1 Million. However, each architect will have to form their own view and, if necessary, seek advice about whether that amount is sufficient to meet the civil liabilities in respect of any particular practice, project and/or professional service undertaken.

Insurance Information to be provided Information about professional indemnity insurance cover is to be provided to the Board on the first application for registration and for each renewal of registration. A copy of a Certificate of Currency is to be provided with every application. Employees, including public sector employees, can submit a letter from their employer naming them as an insured employee and attaching the applicable Certificate of Currency. When investigating any complaint concerning the professional conduct of any architect, the Board will also require the architect to produce evidence of current professional indemnity insurance cover. Exemptions The Board may grant exemptions from the requirement for professional indemnity insurance. The Act does not specify any particular circumstances when exemptions apply but leaves it to the discretion of the Board to decide if and when exemptions are appropriate. The starting point must be that there will be very limited circumstances in which an exemption will be allowed where the person intends to provide architectural services. That person will have to satisfy the Board that there are exceptional reasons for an exemption to apply. For those categories of persons who wish to be registered as an architect but do not provide architectural services in South Australia such as: retired architects architects practising exclusively outside of

South Australia (overseas or interstate)

architects taking time off from work for

personal reasons such as maternity, paternity or carers leave

an exemption from the requirement to obtain professional indemnity insurance is more likely. However, advice should be obtained from your insurance broker as to whether ‘run off’ insurance is required in order to meet any on-going obligations from previous projects, advice or professional services undertaken before seeking the exemption. An exemption granted in any circumstances will be limited in time to the date of the next renewal and may be subject to conditions, such as the architect having to inform their clients about the absence of any professional indemnity insurance cover or that it is noted on the registration certificate that the architect is exempt from having professional indemnity insurance cover. A statutory declaration accompanied by substantiating documentation will be required the first and each subsequent time the exemption is sought (including on each renewal application) stating that the person making the application will not provide any architectural services whilst exempt. An exemption will not be granted when the application for exemption is based solely on the cost of insurance. Frequently Asked Questions Why do I need professional indemnity insurance when I only undertake small jobs? The widening of contractual liability in recent years has meant that even a small job can give rise to a significant claim.

There is not necessarily a link between the level of fee income and the size of a claim. The key issue is the extent of the loss that might result from any mistake. Reputable insurance brokers experienced in providing professional indemnity insurance can advise on realistic minimum levels of cover relevant to your particular situation or circumstances. Do I need cover for private jobs outside my employment? Yes, your employer’s cover will not cover you for work carried out on your own behalf. If you provide architectural services on your own behalf, you need to get appropriate cover. Do I need cover when I am giving advice on a pro bono basis for community groups, family or friends? Regardless of whether a professional person provides advice at no charge, or for an exchange of services or other benefit, they still have the same duty of care to their client, are exposed to the same liabilities, and can be sued for negligence. Architects in this situation should seek advice from a reputable insurance broker experienced in providing professional indemnity insurance.

Do I have to show clients a copy of my professional indemnity insurance policy? The amount of information an architect provides to clients regarding professional indemnity insurance cover should be negotiated between the parties. However dispute or uncertainty can be avoided or minimised if architects advise their clients of the extent of their insurance to ensure that the amount of cover meets their client’s minimum expectations. It is not uncommon for an architect to provide a Certificate of Currency for professional indemnity insurance to a client as evidence of cover. Use of the title “Architect” and its derivatives Guidance Note 2

The title Architect is a valuable and prestigious one, earned only after demonstration of high levels of competence and knowledge. For that reason, use of the title is restricted by legislation.

The primary purpose of the Architectural Practice Act 2009 (the Act) is to register architects, to regulate the practice of architecture and to protect the public interest.

The regulation of architects is governed by the Act a copy of which is available from the offices of the Board, or from the Boards website www.archboardsa.org.au

Some people are unaware that the title “Architect” is restricted in use by law in all Australian States and Territories (and most overseas countries) to practitioners registered with the registration boards established under State Acts of Parliament. The use of the title “Architect” and its derivatives by those not entitled to it frequently leads to formal complaints to the Architectural Practice Board of South Australia and the consequent expenditure of time and occasionally legal resources as the matter is resolved.

The holding of a degree in architecture alone does not allow a person or organisation to use the title “Architect”.

The most usual method of obtaining registration is for an applicant to acquire:- a minimum of 5 years approved

academic study and

a minimum of two years supervised and logged practical experience in a registered architect’s office and

a pass in all sections of the Architectural Practice Examination.

The maintenance of strict standards which are enforced by a statutory authority rather than a professional body is regarded as extremely important in allowing consumers to make an informed choice and allowing Australian architects to gain overseas commissions. In addition our local universities would not be able to attract overseas students to architecture courses without this statutory recognition.

Section 38 of the Act provides that it is illegal in South Australia to hold out a person, partnership or body corporate as an architect unless they are registered with the Board in South Australia. The maximum penalty is $50,000 or imprisonment for 6 months.

Some limited exceptions are provided under Section 41 of the Act. Certain titles and descriptions are available in South Australia for example “Landscape Architect”, “Naval Architect” or “Computer Systems Architect”.

A person holding an architectural qualification may describe himself or herself as holding that qualification.

The Board has become aware of an increasing number of instances where individuals who have graduated from a tertiary institution with a degree in architecture, but who are not registered, describing themselves as ‘graduate architects’.

This is an offence against the Act. However, university graduates may use the term 'graduate of architecture' or 'graduate of architectural studies' without being in breach of the Act.

Yes, the use of the approved post nominal for your tertiary qualification is permitted provided you do not use them in such a way as to imply that you are an architect.

ROADS (OPENING AND CLOSING) ACT 1991 Road Closure, Portion of Sixth Street and

Seventh Street, Bowden NOTICE is hereby given pursuant to Section 10 of the said Act, that the City of Charles Sturt proposes to make a Road Process Order to close and transfer (at no costs) to the Land Management Corporation, portions of Seventh Street and Sixth Street, adjacent to Park Terrace, shown more particularly delineated as ‘A’ and ‘B’ (respectively) on Preliminary Plan No. 11/0021. A copy of the plan and statement of persons affected are available for public inspection at www.charlessturt.sa.gov.au. Council’s office at 72 Woodville Road, Woodville and the office of the Surveyor-General, 101 Grenfell Street, Adelaide. Any application for easement or objections must be made in writing within 28 days from 2 June 2011, to the Council, P.O. Box 1, Woodville, S.A. 5011 and the Surveyor-General, G.P.O. Box 1354, Adelaide, S.A. 5001, setting out full details. Where a submission is made, Council will give notification of a meeting to deal with the matter.

THE COORONG DISTRICT COUNCIL

Assignment of Road Names NOTICE is hereby given that pursuant to the provisions of Section 219 of the Local Government Act 1999, at the meeting held on 17 May 2011, Council resolved to assign road names within The Coorong District Council to the following: • That the road name for Golf Course Road, Tailem Bend, be

assigned to the length of the road commencing from the southern side of the intersection of Railway Terrace and Parklands Terrace, until it reaches the point where the road reaches a left hand turn.

• That the road extending to the left from Golf Course Road, Tailem Bend, which is the entrance to the Agri-Industrial Park be returned to its originally intended name of Big Olive Grove, Tailem Bend.

• That Olive Road, the last road on the right leading off Big Olive Grove, returns to its originally intended name of Umbria Court.

Re-naming of Roads

NOTICE is hereby given pursuant to Section 219 (4) of the Local Government Act 1999, that the District Council of Robe resolved pursuant to Section 219 (1) of the Local Government Act 1999, at its meeting held on Tuesday, 10 May 2011, to assign the names to the public roads described below:

The Springs Road is re-named to Springs Road from Southern Ports Highway to Boomeroo Park Road and Wright Bay Road be re-named to Wrights Bay Road from Southern Ports Highway to Section 104, Hundred of Waterhouse.

Notice is hereby given pursuant to the Trustee Act 1936, as amended, the Inheritance (Family Provision) Act 1972 and the Family Relationships Act 1975, that all creditors, beneficiaries, and other persons having claims against the said estates are required to send, in writing, to the Office of Public Trustee, G.P.O. Box 1338, Adelaide, S.A. 5001, full particulars and proof of such claims, on or before 1 July 2011, otherwise they will be excluded from the distribution of the said estates; and notice is also hereby given that all persons indebted to the said estates are required to pay the amount of their debts to the Public Trustee or proceedings will be taken for the recovery thereof; and all persons having any property belonging to the said estates are forthwith to deliver same to the Public Trustee.
