A Brief Report of the Second Session July - August, 1999 of the Third Legislative Assembly of the State of Goa.

The Second Session July-August 1999 of the Third Legislative Assembly of the State of Goa commenced at the Assembly Hall, Panaji on Wednesday 7 July, 1999. The House was adjourned sine-die on 3 Augilst,1999. Total time taken for the Business of the sitting was 69 hours and 05 minutes.

V. Shri Jitendra Deshprabhu raised a joint of order that there i have been some contemptuous utterances in the press by the Hon. Leader of Opposition, Shri Manohar Parrikar regarding attempt at the Panchayat level at Tuem to demand money from small scale units.

Hon. Speaker ruled that the House is a place where we have to discuss serious matters. When somebody makes allegations outside the House, Hon. Members should refute it in the papers or wherever it has come. If Hon. Member makes a charge on you here, you have every right to deny the charge or refute it. You are a new Member, lot of things will come in the papers. We don't have to pay attention to that.

Hon. Speaker informed the House that. he would deviate from the usual procedure being followed in the House., of Members speaking first and then the senior Leaders of the Opposition as well as Miriisters. However, he would allow the Hon. Members to speak today, as some of the Members are very new and they are not aware of the procedure.

Hon. Speaker also informed the House that yesterday he did not want to stop the new Member from Pemern from talking as we are guided by the Rules of the House. The Business of the House comes first. He further continued that if they have got any important matter to be brought in the Ilouse, they should give a notice two hours before the cornrnerlcelnent of the sitting of the House. He further continued that the Members during the question hour have to elicit information and they now have the Right to Information Act where one can get al\ the information. He also informed the House (that if the Hon. disturb the proceed- ings of the House, be will have to and it is as good as you have not spoke+ in the House.

"Whereas Margao city is situated on the banks of river Sal and in olden days the essential items like tiles, wood etc. used to be transported to Margao city via rher Sal and due to non dissiltation of the river the areas like Khareband, Pedda, Comba .

flooded every year during monsoon. Therefore this House strongly recommends Government to take up the work of dissiltation of this river on priority basis to avoid continuous flooding of these areas during monsoons."

actively interacting with the National Hurnan Rights Commission and National Commission for Women Rig,nts and have prepared an ontline of :he new prison Bill to replace the existing Prisons Act, I. 894.

And whereas, it is felt desirable to repeql the Public Debt Act,1944 and replace the same with a new Le islation viz. I. Shri Luizinho Faleiro made corrections to Starred Question No.34. Shri Manohar Parrikar. raised apoint of order pointing out that replies given in the Mouse are wrong and manipulative. He also cited the reply given to Starred Question No.139 which was given earlier in the last session and Hon. Minister for Transport had then apologized and a ruling was also given by the Hon. Speaker as it was subject to breach of privilege. Hon. Speaker stated that wrong replies should not be given in the House. He also stated that he will not hold the Hon. Minikters responsible, but the officers corbcerned. He directed the Ministers to warn the officers concerned and that a serious note should be t+en of this in future.

And Whereas the Government of IndidMinistry of Home Affairs have in their vide letter also stated that the Hon'ble Supreme Court in its ordsr dated the 23rd December, 1996, in Writ Petition(c) No. 12223 of 1984 has also deliberated on various isues like overcrowding, delay in trial, torture and ill treatment, neglect of health and hygiene, insubstantial food and inadequate clothing prison vices, deficiency in . communication, streamilining of jail visits and has given directions to the Union of India to deliberate about enacting

' a new prison Act to replace century old Indian Prison Act 1894;

And whereas, since the subject "Prisons" is a matter in List 11-State List of Seventh Schedule to the Constitution Parliament have no authority to legislate on the subject unless Resolutions under Article 252 of the Constitution are passed by two or more States;

And whereas the Government of India/Ministry of Home Affairs vide their said D. 0. letter dated 12-2-1998, requested this S,lte to have the appropriate resolution passed by out State Legislature authorising Parliamentary -legislation on prisons in public interest;

And whereas it appears to the Legislature of this State that -__ - it is desirable that matters relating to the subject "Prisons" 1

should be regulated in this State by Parliament by law. o\ 0

Now, therefore, this House resolves that the matters relating I to the subject "Prisons" should be regulated in this State by Parliament by law in terms of Article 252 of the Constitution."

AND WHEREAS, the subject matter of such a law is relatable mainly to the matter enumerated in entry 43 in list I1 in the Seventh Schedule to the Constitution of India;

AND WHEREAS, Parliament has no power to make such a law for the States with respect to the matter enumerated in entry 43 in List I1 aforesaid except as provided in Article, 249 and 250 of the Constitution of India;

AND WHEREAS, the hb l i c Debt Act, 1944 is applicable for marketable loans raised by Reserve Bank of India on behalf of both Union and the State Government;

AND WHEREAS, it is felt desirable to repeal the Public Debt Act, 1944 and replace the same with a new Legislation I viz. "Government Securities Act" in order to enable the
