Silent Auction Terms and Rules

All items may be subject to limitations and restrictions that are not listed in the program.

• All items require an opening bid as stated on the bid sheet. • All bids are legally binding with the bidder’s signature. • At any time, an item with a “Guaranteed Bid” line may be secured by the

bidder placing their name on that amount. The item is then considered sold to that bidder.

• The Silent Auction closes at 10:30pm. • The Vancouver Symphony makes every effort to accurately describe all

items. All items are sold “AS IS.” • The Vancouver Symphony neither warrants nor represents, and shall in no

event be responsible for the correctness of description, genuineness, or condition of the auction item. No statements contained in the catalogue or made orally at the sale or elsewhere shall be deemed a warranty, representation or assumption of liability.

• Restaurants, hotels and travel gift certificates exclude alcohol, taxes, gratuity, parking, resort fees, surcharges and incidentals unless otherwise

indicated. • All sales are final. There will be no exchange or refund on items by either

the Vancouver Symphony or the donor(s), including gift certificates, unless otherwise specified. Unless otherwise noted, all gift certificates expire

February 2013. • Full payment (cash, cheque and credit card accepted) must be made the

night of the auction. A cashier’s receipt must be presented before the removal of any purchased item on the night of the auction or any other time.

• Please check envelopes containing gift certificates before leaving the auction area. No substitutes will be issued.

• All items should be removed, or arrangements made for transport or delivery, at your expense, prior to the close of the evening.

• Participation in the auction constitutes acceptance by the bidder of all rules and conditions as set out in this document.

• According to CRA Guidelines, items purchased in an auction are not eligible for a tax receipt.

• If an auction purchase price exceeds the item’s retail price by 25% or more, the purchaser may receive a tax receipt for the portion of the auction purchase price exceeding the item’s retail value. This does not apply to items deemed priceless (items for which a value cannot be determined).
