Impact on Federal Programs

There are 13 waivers that affect the Office of Federal Programs and Titles IA, IIA, REAP, RLIS

Federal funding is not being reduced and funds are not being lost.

Waiver #4: Schoolwide School Eligibility for Title I Schools

• There is no longer a “Fast-track” Schoolwide process. All new schools applying for a Schoolwide program beginning with 2014-2015 must meet the 40% poverty level.

• Current Schoolwide schools below 40% poverty level may continue operating as Schoolwide schools for the remainder of the 2014-2015 school year.

Waiver #6: School Improvement Set-Aside Requirements – Part 1 LEAs with schools in improvement status

must spend an amount equal to 20% of its Title I allocation to provide Supplemental Education Services (SES) and School Choice Transportation.

This requirement does not go into effect until the 2015-2016 school year.

Waiver #6: School Improvement Set-Aside Requirements – Part 1 Schools in Improvement Year 1 are only

required to spend the 20% on School Choice transportation. One percent of this reservation may be spent on parent outreach and assistance.

Schools in Improvement Year 2 are required to spend 5% of this reservation on School Choice, 5% on Supplemental Education Services, and the remaining 10% divided any way between the two. One percent of this reservation may be spent on parent outreach and assistance.

Waiver #6: School Improvement Set-Aside Requirements – Part 1 The “amount equal to 20%” of the Title I A

current year allocation must also be calculated against any amount of funds transferred into Title I from other programs.

This calculated amount, however, may be provided from other allowable Federal, State, Local or Private sources. It does not have to come out of Title I A funds.

Waiver #6: School Improvement Set-Aside Requirements – Part 1 The LEA will be responsible for

documenting the costs, funding sources, and services provided.

Any amount not spent must be added to the next years 20% reservation, should this reservation still be required.

Waiver #6: School Improvement Set-Aside Requirements – Part 2 Schools in Improvement status are

required to spend not less than 10% of their Title I A allocation on high quality Professional Development that addresses the academic achievement problem that caused the school to be identified for Improvement.

This is required each year the school is in Improvement.

Waiver #6: School Improvement Set-Aside Requirements – Part 2 Schools in Corrective Action or

Restructuring status are not required to spend 10% of their Title I A allocation on professional development.

Waiver #7: LEA Improvement Set-Aside Requirements

LEAs identified for Improvement are required to spend not less than 10% of their Title I A allocation on high quality Professional Development that addresses the academic achievement indicator that caused the LEA to be identified for Improvement.

The 10% of the Title I A current year allocation must also be calculated against any amount of funds transferred into Title I from other programs.

Waiver #7: LEA Improvement Set-Aside Requirements (Cont.)

The 10% that is spent on PD at the site level for Schools in Improvement may count towards the 10% that the LEA is required to spend on PD at the district level.

This is required each year the LEA is in Improvement status.

Waiver #8: Supplemental Educational Services (SES)

LEAs must resume offering SES services to eligible students in schools in the second year of improvement, corrective action or restructuring, no later than the 2015-2016 school year.

Waiver #10: Highly Qualified Requirements

An LEA that does not meet the HQ requirement under NCLB section 1119(a)(2) for 2 consecutive years must develop a corrective action plan and submit it to the Office of Federal Programs.

SEA shall enter into an agreement with LEAs - who did not meet the HQ requirement under section 1119(a)(2) and have failed to make AYP as described under Section 1111(b)(2)(B) for 3 consecutive years- on the use of the LEA’s Title II A funds.

Waiver #12: Transferability Limitations

All LEAs are limited to transfer up to 50% of their Title II A allocation into Title I A.

LEAs in Improvement status may only transfer up to 30% of their Title II A allocation into Title I A.

LEAs in Corrective Action status may not transfer any funds from Title II A into Title I A.

Waiver #13: Notification of Transfer

An LEA that transfers funds must modify the local plan and notify the SEA of its plans to transfer. (This occurs through the Consolidated Application)

Waiver #14: Transferability Set-Asides

Any Funds transferred to Title I Part A must be included in calculating any required set-aside.

This will impact the Homeless set-aside, Parental Involvement set-aside, and PD set-aside required for LEAs in Improvement.

Waiver #15: RLIS Use of Funds

An LEA that receives RLIS funds and failed to meet AYP, based on the results of assessments administered in 2014, must use the funds in the area(s) that it failed to meet AYP.

Waiver #16: REAP Use of Funds

An LEA that “REAPs” its Title II A funds and failed to meet AYP, based on the results of assessments administered in 2014, must use the funds in the area(s) that it failed to meet AYP.

Waiver #18: Rank-Order

An LEA receiving Title I A funds must rank- order ALL of its schools based on poverty level.

Title I eligible High Schools with a graduation rate below 60% are no longer eligible to be served with Title I A funds out of rank-order.

In the meantime…

AYP determinations have not yet been determined.

A school designation of Priority / Focus / Targeted Intervention exists until a new designation of Improvement / Corrective Action / Restructuring is given.
